Abordaremos en esta tesis el análisis del conjunto de “Poemas en prosa” publicados dentro del libro póstumo de César Vallejo. Nos centraremos en su valor intrínseco y al mismo tiempo intentaremos establecer ciertos lazos con la poesía anterior y con los poemas posteriores, que culminan la creación poética de Vallejo. Se trata, pues, de un intento de lectura diacrónica (Meo Zilio 17, nota 11) a partir de dos temas articuladores de la poesía vallejiana: la familia y la relación de alteridad. Nuestra hipótesis de trabajo es que los “Poemas en prosa” constituyen una poética gozne, una poética de transición y de articulación entre la poesía escrita en el Perú y desde el Perú, y la poesía final de nuestro poeta. Los “Poemas en prosa” parisinos constituirían una etapa de continuidad, pero al mismo tiempo de diferenciación y recreación de la escritura poética. Habría asimismo una relación entre la materia formal (la prosa poética) y el tratamiento diverso/similar de los temas señalados. Etapa de reelaboraciones diversas (estéticas e ideológicas) que conducirán a la culminación de la obra universal del poeta peruano, los años de redacción de los “Poemas en prosa” (1923-1928/29) coinciden además con la creación del grueso de su obra periodística, con el libro misceláneo Contra el secreto profesional y la novela breve Hacia el reino de los sciris (Georgette, “El origen” 62). En ella podemos rastrear los primeros contactos directos con la cultura occidental parisina, las reacciones del creador, su manera particular de asimilarlas y cómo se va perfilando en sus poemas en prosa, un tránsito hacia el “último” Vallejo, aunque aceptamos que este último estadio está lejos de ser uniforme y completamente nuevo, dado que, como la crítica ha señalado, no hay hiatos profundos entre obra y obra del poeta santiaguino (Coyné, Medio siglo 85). Este tránsito se da, a nivel formal, a través de la prosa poética y no del verso. Los primeros poemas de Vallejo son poemas de forma clásica a nivel versal y estrófico; en Trilce nos encontramos con un verso dinamitado, quebrado para expresar nuevos sentidos solo expresables con ese ritmo. En los así llamados Poemas humanos y en España, aparta de mí este cáliz, estamos ante un verso libre, sin rastros del ritmo versal apegado a preceptos, sean del modernismo o de talante vanguardista, pero sin por ello dejar de estar apoyado en los ritmos tradicionales. En medio, los “Poemas en prosa” —ritmo de poema en prosa con una consustancial cosmovisión, cuya funcionalidad trataremos de establecer.

L'objectif de cette these est d'ameliorer la connaissance des variations du niveau de la mer et des circulations oceaniques dans cette region, il s'agit d'observer et de comprendre les variations du niveau de la mer, de valider les mesures d'altimetrie satellitaire (topex/poseidon et ers 1) et de determiner les transports au cca. Ce travail a ete mene en particulier dans le cadre du reseau international gloss (global sea level system) pour la surveillance de l'evolution a long terme du niveau de la mer, et dans le cadre du projet international woce (world ocean circulation experiment), incluant la mission satellitaire franco-americaine de topex/poseidon. Cette etude a permis des informations sur le niveau de la mer et la circulation generale dans cette region : le niveau de la mer moyen sur tout le domaine donne une pente negative de 2 mm/an entre 1993 et 1995 et il y a l'existence d'un meandre permanent le long du front subtropical dans le courant circumpolaire antarctique.

El origen de la inmunidad diplomática se remonta desde que el hombre se vio en la necesidad de relacionarse, comunicarse e interactuar con personas de otros estados, países, culturas, religiones, etc. Esto con el fin de celebrar tratados, acuerdos de paz, acuerdos comerciales, delimitación de fronteras u mandatos de monarcas y reyes. Estos beneficios diplomáticos no solo se confieren a los individuos que tienen cargos políticos o que tienen misiones diplomáticas, sino que la legislación internacional concede prerrogativas a los Organismos Internacionales con el fin de que sus misiones no se vean afectadas y puedan realizar sus actividades de manera eficiente. Estas actividades es decir “trabajo” no se pueden realizar de manera mágica, sino que dichos organismos necesitan de personas “trabajadores, empleados” para desempeñar funciones concatenadas y llegar a un fin. Para el buen funcionamiento de las relaciones laborales se han creado leyes que ayudan a regular el comportamiento entre patrón (Organismo Internacional) y trabajador de esta manera no solo el Derecho Laboral es responsable de regular esta interacción, sino que se vincula con el Derecho Internacional Público. Los conflictos que se suscitan entre un trabajador y un patrón (Organismo Internacional) son en cierta manera “iguales “a los conflictos entre una empresa y un trabajador, con la diferencia que los Organismos Internacionales cuentan con inmunidad diplomática.

Le Kyōun-shū, recueil de stances et de poèmes du moine Ikkyū Sōjun (1394-1481) Sōjun (1394-1481), se distingue de la masse des nombreuses œuvres similaires que produisirent au Moyen Age les moines zen de l’école Rinzai par les provocations et les positions très critiques à l’égard des coreligionnaires de celui –ci que l’on y trouve. La grande célébrité d’Ikkyū, ou plus précisément de certaines images de lui, a longtemps conditionné la lecture de ces quatrains. En s’interrogeant sur le sens que prennent ceux-ci une fois relacés dans les divers contextes de leur production, cette thèse propose une présentation des motivations et des enjeux de la pensée d’Ikkyū. Le XVe siècle est une période de bouleversements dans la société japonaise, et en conséquence dans les relations qu’entretenaient les temples et les laïcs. Dans l’histoire de l’école zen, alors que s’amorce le déclin du système des Cinq Montagnes, le Daitoku-ji, auquel est affilié Ikkyū, connait une suite de crises mettant à mal la spécificité dont il s’enorgueillissait. C’est en grande partie contre les évolutions de son école induites par ce contexte que se dresse Ikkyū. Il le fait en adoptant une posture particulière revendiquant la transgression sous diverses formes, en premier lieu desquelles la composition poétique. Il peut ainsi à la fois avoir un discours polémique très violent et attaquer les moines qu’il considère comme décadents sans avoir à quitter une école dont il se pose en seul et unique héritier. The Kyōun-shū, collection of poems and stanzas of the monk Ikkyū Sōjun (1394-1481), differs from the numerous similar works produced during the middle age by others Rinzai zen monks by the provocations and the very critical position against his religious community that can be found in it. The celebrity of Ikkyū, or more precisely of different images of him, has, for a long time, determined the way the quatrains were read. By questioning their meaning once put in the context of their production, this thesis proposes a presentation of the motivations and the issues of the thought of Ikkyū. The XVth century is a time of upveal in the Japanese society, and consequently in the relations between the temples and the lay people. In the zen school history, when the Five Mountains system begins to decline, the Daitoku-ji temple experiences several crisis that undermine the specificity it priced itself. It is mainly against the evolutions of his school induced by the context that raise Ikkyū. He does it by adopting a special posture, claiming several forms of transgressions, at the first place the poetic composition. By doing so, he can, in the same time, have a polemical discourse and attack the monks he considers to be decadents, and not to have to leave a school he claims to be the only legitimate heir. Les progres technologiques tres recents ont permis la construction des radars polarimetriques capables d'acquerir simultanement et de facon coherente tous les termes de la matrice de diffusion, c'est-a-dire l'information polarimetrique. Pour les etudes d'observation de la terre, il s'agit a present d'evaluer l'apport de l'information polarimetrique comparativement aux donnees classiques. Pour cet objectif, nous avons developpe dans une premiere phase des methodes d'analyse des donnees. Ces methodes comprennent d'une part la mise en uvre de l'etalonnage des donnees et le developpement de filtres du speckle et d'autre part le developpement de discriminateurs a partir de l'information polarimetrique. The Cory site (FaNq-75) is a multicomponent Middle Period site located in Saskatoon in south-central Saskatchewan, Canada. The site was excavated in 2001 by Stantec Consulting Ltd. as part of a remediation program for a SaskWater pipeline project. Four occupation levels were identified with one complete and two fragmentary projectile points identified. Level II of the Cory site contained a complete projectile point, which was an atypical Gowen point, and was radiocarbon dated to 5910 ± 60 rcybp. The collection from the site was obtained from the Royal Saskatchewan Museum for a more thorough analysis as part of this thesis. Three new radiocarbon dates were obtained for previously undated levels of the site. In addition to the description of the Cory site, this thesis also reviews the published material from a number of Middle Period sites on the Northern Plains. This review led to a reconsideration of the traditional classification of Middle Period archaeological cultures. Previously, the Gowen complex and the Oxbow complex had been considered separate, but related entities. In this thesis, a new classification is proposed with the Gowen complex and the Oxbow complex combined into a single archaeological culture.

The Palaeoproterozoic southern Goren volcano-sedimentary belt of northeast Burkina Faso represents a sequence/package of rocks formed in a back-arc basin environment. Evidence is based on a conformable sequence of basalts that have geochemical affinities of normal mid-oceanic ridge style basalts (N-MORB) as well as arc-related magmas. Tholeiitic compositions, determined by major and trace element geochemistry, are exclusive to the study area, which is unique to northeast Burkina Faso. Flat, chondrite-normalised REE patterns suggest dominantly N-MORB compositions, with the occasional elevated Th and Al2O3 values, suggestive of arc basalts. Depleted chondrite-normalised concentrations of phosphorus (0.5-0.03 times lower than chondrite) and Ti (1-5 times chondrite) as well as anomalous concentrations of N-MORB-normalised Ta (80-120 times greater) are characteristic of the tholeiitic basalts of the Goren belt. The volcanic rocks are intercalated with a succession of volcanogenic manganese deposits, siltstone, volcaniclastite, volcanogenic greywacke and a discrete pyroclastic breccia deposit composed of lapilli- to bomb-sized volcanic debris, indicative of bimodal volcanism. The volcanic facies were established through field and petrographic interpretations. The subaqueous facies architecture consists of proximal, coherent and autoclastic basaltic flow units containing porphyritic, aphyric, amygdaloidal and hyaloclastic textures as well as pillowed, jointed and flow-banded basaltic lithofacies. Proximal to distal volcanogenic manganese deposits intercalated with basalt flows indicate a syn-volcanic genesis. A discrete pyroclastic interbed (~300 m thick) within a volcanogenic, marginal marine to offshore greywacke succession occupies a distal facies relative to the volcanic source and indicates a bimodal source of volcanism, i.e., mafic and intermediate. Volcanogenic manganese deposits are characterized by quartz-ankerite stockwork breccia, a braunite-ilmenite-magnetite-chalcopyrite-pyrite-(gold) mineral assemblage and increased Ba concentrations, indicating syn-volcanic seafloor-related hydrothermal activity. The Goren volcano-sedimentary belt presents potential for economic mineralisation in volcanogenic primary manganese and base metal deposits.

The non-consensual destruction of a nasciturus is a disturbing societal phenomenon that negatively permeates the lived realities of pregnant women with positive maternal intention. These women choose to experience a full term gestation and they choose to give birth to a live and healthy infant. At some point during their gestation they are non-consensually deprived of their choices through active third party violence by commission or passive third party negligence by omission. These women have no legal recourse for their loss, because in South African law, the non-consensual destruction of a nasciturus is not a crime. The nasciturus is not recognised as a victim separate from the pregnant woman despite the manner in which the pregnant woman freely chooses to interpret her pregnancy. The consensual destruction of a nasciturus enjoys legal protection in South African law by virtue of the provisions contained in the Choice on Termination of Pregnancy Act 92 of 1996. The choice to terminate a pregnancy is therefore legally recognised in South African law, whereas the choice to continue a pregnancy is not legally recognised. Argument is advanced in this dissertation for the legal recognition of the choice to continue a pregnancy by criminalising non-consensual nascitural destruction through the creation of a Choice on Continuation of Pregnancy Act. Non-Consensual nascitural destruction occurs as a result of violence against pregnant women as well as in situations of medical negligence. Empirical data is provided to demonstrate how non-consensual nascitural destruction can occur in medical settings where negligence is suspected. The inherent human need to safeguard and protect the nasciturus has been in existence since time immemorial. Despite this need, in South African law, legal subjectivity, and the ability to be recognised as a separate victim of crime, remain contingent upon a live birth. Evidence suggests that the requirement of live birth in law developed as an evidentiary mechanism and not as a substantive rule of law. Its relevance in circumstances of non-consensual nascitural destruction is doubtful at best. The law in South Africa has failed to take cognisance of the psychosomatic dimensions of personhood and argument is advanced in favour of a nuanced and constitutionally sensitive approach to matters of moral as well as legal personhood. Authentic female autonomy and reproductive freedom requires a re-evaluation of the paradigms that surround nascitural safeguarding and protection, and a transformative approach to constitutional interpretation. The establishment of a legislative scheme to criminalise the nonconsensual destruction of a nasciturus is proposed. Within this legislative scheme certain precautions and fortifications are suggested in order to avoid any potential erosion of the rights of pregnant women who have negative maternal intention. It is demonstrated that it is in fact possible for pregnant women with positive maternal intention and pregnant women with negative maternal intention to both enjoy legal protection without encroaching upon one another’s constitutional rights to reproductive freedom, bodily autonomy and privacy. It is contended that achieving the aforementioned is the final barrier to authentic female reproductive freedom in South Africa.
