Evolutionary theories have always been treated by legal scholars as a sort of cousin to the legal theoretical family, both in Europe and the United States. They are nice theories, they tell interesting stories, you sometimes listen to what they have to say and when among friends, you may even quote them. However, in the modern mononuclear family, when it is time to tackle important issues and reach important decisions, or simply to celebrate some success stories, these cousins are often left outside the door, being simply “relatives” and not part of the legal family in the proper sense. A former evolutionary scholar strikingly stated in a manner that can be seen as representative of the general skepticism towards the evolutionary approach of a large segment of the legal family, “Legal scholarship should not be so timid as to depend on others for its theoretical models. We might take our inspiration where we find it, but we should build our theories within our own discipline, constrained only by the data that defines it and the criteria of quality appropriate to it.” The main objective of this article is to take the first step towards making evolutionary theory “our own discipline,” by elevating evolutionary theory from the status of “cousin” to one of “sibling” (or at least “in-laws”) of the legal family. The focus in particular is to understand why, despite the fact that the evolutionary theory approach to law (or “evolutionary theory and law”) has been present quite a while in the legal scholar's discussion, the legal world at large has left it at the front step of the legal house. Based on this analysis, the task is also to evaluate whether it is possible, after certain adjustments, to invite evolutionary theory into the larger family of legal thinking, in particular as part of the legal theories of law-making (as “legal evolutionary theory”).

In the past decade, evolutionary paleoecology has shifted away from corroborative research of the “me-too-ecology” type toward its proper domain—the evolutionary consequences of ecological properties, roles, and strategies at the individual, population, community, and species levels. The science of evolutionary paleoecology tests for linkage between a species' ecology and its macroevolutionary history. Do the ecological characters of species within clades influence differential rate dynamics, particularly rates of faunal turnover and diversification? Intellectual coequality, once hampered by the misunderstanding that the role of paleoecology is to find examples of past ecology imperfectly entombed in the fossil record, is strengthened by the increasing number of evolutionary ecologists who have called for explicit paleontological contributions to resolve theoretical issues. The fossil record provides a necessary perspective to an understanding of process.

It is often argued that evolutionary theory and feminism remain in tension, since the evolutionary view of human nature is hard to reconcile with the feminist view. The goal of this paper is to demonstrate that this thesis is false. This goal is realized by reconstructing a certain anti-feminist evolutionary argument (whose descriptive conclusion is the “patriarchal” picture of male and female nature, and the normative conclusion is the claim that given the deep differences between men and women the feminist postulates cannot be achieved) and providing its critique. The argument is based on three premises: a theory of parental investment, the assumption of a relatively large (compared with other species) men’s parental investment in ancestral environments, and the uncertainty of paternity. Its (descriptive) conclusion is the claim that men are “by nature” much more polygamously disposed, much more desirous of power (over the opposite sex), and much more aggressive than women. The paper presents several objections to this argument. The first objection questions its internal coherence. The second one points at its counterintuitive (not supported by empirical facts) consequences. The third one criticizes one of the assumptions of the argument, i.e. the assumption about a relatively large (compared with other species) men’s parental investment in ancestral environments.

This article analyzes the view of evolutionary theory as a theory of forces. The analogy with Newtonian mechanics has been challenged due to the mismatch between drift and the other evolutionary forces. Genetic drift and its lack of direction has done that several authors tried to minimize or to protect its status as a force. I argue that the attempts to maintain drift as a force, in a strong manner, are not fully successful. I also show how historical and theoretical reasons explain why the Newtonian analogy arose, insofar as it is helpful in revealing the causal structure of evolutionary theory.

Adaptive dynamics theory has been devised to account for feedbacks between ecological and evolutionary processes. Doing so opens new dimensions to and raises new challenges about evolutionary rescue. Adaptive dynamics theory predicts that successive trait substitutions driven by eco-evolutionary feedbacks can gradually erode population size or growth rate, thus potentially raising the extinction risk. Even a single trait substitution can suffice to degrade population viability drastically at once and cause ‘evolutionary suicide’. In a changing environment, a population may track a viable evolutionary attractor that leads to evolutionary suicide, a phenomenon called ‘evolutionary trapping’. Evolutionary trapping and suicide are commonly observed in adaptive dynamics models in which the smooth variation of traits causes catastrophic changes in ecological state. In the face of trapping and suicide, evolutionary rescue requires that the population overcome evolutionary threats generated by the adaptive process itself. Evolutionary repellors play an important role in determining how variation in environmental conditions correlates with the occurrence of evolutionary trapping and suicide, and what evolutionary pathways rescue may follow. In contrast with standard predictions of evolutionary rescue theory, low genetic variation may attenuate the threat of evolutionary suicide and small population sizes may facilitate escape from evolutionary traps.

The traditional emphasis on human nature as the foundation of politics needs to be reexamined from the perspective of contemporary biology. Because biological processes operate independently on the individual, the social group, and the species, an evolutionary approach to both observational research and cost-benefit analysis does not entail reductionism. Selfishness and altruism, participation in social groups, languages and cultures, and the rise and fall of centralized states can all be illuminated by empirical evidence and theories in the life sciences. For political philosophy, a new “naturalism” points to a return to the Aristotelian view that values or standards of judgment have rationally intelligible foundations, thereby challenging the relativist or nihilistic orientation that has characterized most contemporary thought.
