This Article explores the Trump regulatory reform agenda and its potential impact on environmental determinants of health. The Article begins with a discussion of the Department of Commerce’s (DOC or Commerce) initial fact-finding investigation to evaluate the impact of federal regulations on domestic manufacturing. The Article next presents an overview of the Trump administration’s regulatory reform formula as announced in E.O. 13771 and the interim guidance explaining E.O. 13771 and E.O. 13777 (the executive order announcing the Trump administration’s plans to enforce the regulatory reform plan announced in E.O. 13771). The Article then examines the federal agency initiatives undertaken in response to the Trump directives, including both fact-finding dockets and regulatory action published in the federal register applying the executive orders. This Article concludes with concerns about the practical effects of the new policy on the future of environmental determinants of health and recommends that the policy be reevaluated after a year to understand the unintended effects of this means of deregulation.

To address the concern of environmental pollution, it is necessary to study the effect of environmental regulation on industrial solid waste emission reduction in China. This paper aimed to analyze the effectiveness of provincial environmental regulation (both formal and informal) on the industrial solid waste emission reduction. The results show that both the effect of formal and informal environmental regulations on industrial solid waste emission intensity present an inverted “U” shape. The threshold value of per capita GDP as an indicator variable is CNY 16,299 and CNY 15,572 respectively. The effect on pollution emission reduction will appear when the value is higher than the threshold, and the two-way transmission mechanism between formal and informal environmental regulations does exist. When GDP per capita exceeds CNY 27,961, there is a phenomenon of “rebound” in the effect of informal environmental regulation on pollution reduction. Based on the findings, it was suggested that both formal and informal environmental regulation should be promoted to achieve the goal of industrial solid waste emission reduction. The coordination between formal and informal environmental regulation should be considered when the government makes policies. Different environmental regulation policies should be implemented in different regions. Informal regulation should be enriched and further promoted. Environmental law should play an important role in maintaining the public’s participation in environmental regulation to prevent the failure of informal environmental regulation.

This paper reviews and discusses the debate over the effectiveness of environmental regulation in promoting industrial Technological Environmental Innovation (TEI). Using the innovation-friendly regulatory principles adapted from Porter and van der Linde (1995a, 1995b), this paper demonstrates how properly designed and implemented environmental regulation (TEI promoting regulation) has played a critical role in promoting TEI in the transport industry in California and Hong Kong. In both cases, it has shown that stringent environmental regulations that send clear and strong signals for future environmental performance requirements are critical in promoting TEIs in the public transport industries. Unlike traditional command-and-control regulations, TEI promoting regulations are strongly supported by incentive and capability-enhancing measures.

Abstract The argument that stringent environmental regulations are generally thought to harm export flows is crucial when determining policy recommendations related to environmental preservation and international competitiveness. By using bilateral trade data, we examine the relationships between trade flows and various environmental stringency indices. Previous studies have used energy intensity, abatement cost intensity, and survey indices for regulations as proxies for the strictness of environmental policy. However, they have overlooked the indirect effect of environmental regulations on trade flows. If the strong version of the Porter hypothesis is confirmed, we need to consider the effect of environmental regulation on gross domestic product (GDP), because GDP induced by environmental regulation affects trade flows. The present study clarifies the effects of regulation on trade flows by distinguishing between the indirect and direct effects. Our results indicate an observed non-negligible indirect effect of regulation, implying that the overall effect of appropriate regulation benefits trade flows.

As the continuous changes in environmental regulations have a non-negligible impact on the innovation activities of micro subjects, and economic policy uncertainty has become one of the important influencing factors to be considered in the development of enterprises. Therefore, based on the panel data of Chinese high-tech enterprises from 2012–2017, this paper explores the impact of heterogeneous environmental regulations on firms’ green innovation from the perspective of economic policy uncertainty as a moderating variable. The empirical results show that, first, market-incentivized environmental regulation instruments have an inverted U-shaped relationship with innovation output, while voluntary environmental regulation produces a significant positive impact. Second, the U-shaped relationship between market-based environmental regulation and innovation output becomes more pronounced when economic policy uncertainty is high. However, it plays a negative moderating role in regulating the relationship between voluntary-based environmental regulation and innovation output. This paper not only illustrates the process of technological innovation by revealing the intrinsic mechanism of environmental regulation on firm innovation, but also provides insights for government in environmental governance from the perspective of economic policy uncertainty as well.

It is a problem worth thinking about whether the government’s environmental regulation policies can meet the residents’ requirements for environmental quality, and benefit the people. The study of the public’s subjective evaluation can more intuitively judge whether the government’s environmental regulation has realized “ecological benefits for the people”. Based on the data of the Chinese General Social Survey (CGSS) in 2013, this paper studied the impact of environmental regulation and environmental awareness on environmental governance satisfaction by an ordered probit model. The study found that environmental regulation has a significant positive impact on environmental governance satisfaction, while environmental awareness has a significant negative impact on environmental governance satisfaction. We also found that when public environmental awareness is taken into account, the positive relationship between environmental regulation and environmental governance satisfaction is affected. The robustness test proved this conclusion.

Purpose There is no conclusive whether environmental regulation is a constraint or an incentive to the production development. The purpose of this paper is to analyze the non-linear effects of environmental regulations on economic outcomes from the combined perspective of labor productivity and environmental regulation costs. Design/methodology/approach Under the assumption of maximizing the utility of residents and maximizing the profit of firms, this research introduces a mathematical model that incorporates the promotion effect of environmental regulations on labor productivity and the costs of environmental regulations. On this basis, the authors analyze the non-linear relationship between environmental regulations and economic outcomes theoretically. This paper also conducts an empirical test using the panel data of 28 provinces in China from 1998 to 2015 through threshold regression. Findings Theoretical analysis shows that environmental regulations impose both the environmental regulation cost effect and the compensation effect on the labor productivity enhancement. The ultimate impact of environmental regulation on economic outcomes depends on the comparison of these two effects. Under the different intensities of environmental regulation, the magnitude of these two effects may not be equal. The empirical results further confirm the nonlinear relationship between environmental regulations and economic outcomes. Originality/value Previous studies have neglected the role of environmental regulations in improving labor productivity. This work’s main contribution is to propose a novel framework to study the non-linear relationship between environmental regulation and the growth of economic outcomes from perspective of labor productivity and the costs of environmental regulations.

Cette thèse développe l’analyse d’une politique économique environnementale appliquée dans le cadre d’une économie ouverte et dans celui d’une économie fermée. Elle étudie les effets sur le bien-être et l’environnement des réglementations volontaire et obligatoire tenant compte de l’hétérogénéité des agents économiques et des pays. Elle s’intéresse en particulier aux différents types d’éco-étiquetages en autarcie (Chapitre 1) et après ouverture au commerce international (Chapitre 2); aux programmes d’apport d’information à plusieurs niveaux (Chapitre 3); et aux taxes sur les émissions et marchés publics écologiques (Chapitre 4). L’analyse montre que non seulement le gouvernement mais également les éco-consommateurs peuvent inciter même les producteurs éco-indifférents à se décider pour l’agir respectueux de l’environnement. Les instruments de politique environnementale induisent auto-sélection et polarisation dans les marchés desservis par des entreprises hétérogènes en termes de productivité. Je démontre que des instruments volontaires peuvent avoir des résultats positifs sur le bien-être et l’environnement. En fonction d’hypothèses précises, ils peuvent également être plus efficaces que des approches obligatoires. Le modèle montre également que quand il y a ouverture au commerce international, la politique écologique a un effet supplémentaire sur le bien-être et sur l’environnement, dépendamment du type de politique et des consciences environnementales des différents pays commerciaux
This thesis develops an applied environmental economic policy analysis in closed and open economy frameworks. It investigates welfare and environmental outcomes of voluntary and mandatory regulation allowing for heterogeneity across economic agents and countries. Particularly, it focuses on voluntary eco-labels of different types in autarky (Chapter 1) and upon opening to international trade (Chapter 2); multi-tier information provision programmes (Chapter 3); and emission taxes and green public procurement (Chapter 4). The analysis shows that not only the government but also eco-concerned consumers can incentivise even eco-indifferent producers to act more environmentally-friendly. Environmental policy instruments induce self-selection and polarisation in the markets served by firms heterogeneous in their productivity. I demonstrate that voluntary instruments can lead to positive welfare and environmental outcomes. Under particular assumptions, they also can be more efficient than mandatory approaches. The model also shows that upon opening to international trade eco-policy yields additional welfare and environmental effects conditionally on the type of the policy and the environmental awareness difference across trading countries

In three essays, the relationship between environmental regulation and firm behavior is explored. First, firms are found to influence the price in a regulatory market for emissions permits by exercising market power within their own price market. As the degree of market power in three high emitting industries increased, the price of NOx permits in Southern California’s RECLAIM permit increased as well. Second, the process of firm learning is explored. Power plants facing more stringent environmental regulation are found to learn from environmental regulation and experience efficiency gains. These gains are found to spillover to other power plants facing less stringent regulation through knowledge networks. Third, the decision of electricity firms to participate in reserve markets is modeled and simulated in order to measure the effect of increased wind power in the market on this decision. As the amount of wind power in the market increased, the expected capacity available in the market decreased, inviting the possibility of electricity shortages. However, the reduced variability in market outcomes when wind penetration increases suggests that policy makers may be better able to manipulate existing market mechanisms to induce investment in new capacity.

Environmental degradation limits the prospects of sustainable economic development and the pursuit of a life of better quality. An informational approach to environmental regulation, a policy innovation implemented after direct regulation and economic incentive mechanism, has exhibited its positive results on pollution reduction. Since 1995, this approach has been exported from the developed world to more than ten developing countries by international policy advisors. China experimented with environmental performance information disclosure (EPID) pilot programs in Zhenjiang, Jiangsu province and Hohhot, Inner Mongolia between 1999 and 2000. Mixed results have been found. The disclosure program was sustained in Zhenjiang but was stopped in Hohhot only after the pilot phase. Furthermore, there has been no extensive research on how an informational approach to environmental regulation worked in a developing country context such as China, where private environmental enforcement by civil society and markets are lacking. This comparative case study advances our knowledge of the informational approach to environmental regulation by examining its implementation and impact. The following factors are found to be critical for policy implementation: perceptions of the policy innovation by local leadership and implementers, capacity of local environmental protection agencies, and the contexts in which the policy was carried out. Disclosed environmental information was able to induce better industrial environmental performance and incorporated the environment into development decision making by local government officials. However, environmental performance information disclosure alone was not sufficient to involve the public in environmental protection in China. For administrative, legal, market, and public forces to converge in environmental compliance and enforcement in China, building better institutional infrastructure is in order.

International agreements arising from the need to deal with the global warming promoted by countries decided to embrace a climate change policy bring on the debate of the impacts on firms in a global competitive market. Facing, therefore, different environmental standards accordingly to firm’s physical location. Once European Union is taking the lead in adopting stringent environmental regulation, this study aims to assess the impact of environmental regulations on firms in Europe. A novel database was constructed providing firm-level air pollution emission information in the European Union. Using difference-in-difference model, the effect of the intervention of EU environmental policy change suggests a negative response in fixed assets among EU firms due to the 2006 EU policy. The evidence to the hypothesis that firms in European Union have been decreasing its firms fixed assets, as a proxy of production capacity, with the change in environmental regulation, provides general support for the PHH, however, it doesn’t remain in robustness checks. The contribution of this work is bringing a revisited view of the actual effect of environmental regulation based on Kyoto Protocol directives on European firms.

This dissertation is composed of three chapters regarding international trade and environmental regulation. The first chapter focuses on the relationship between port ownership and the port R\&D investment. I investigate whether a larger degree of private involvement in the port sector makes for a higher level of welfare, as well as an improvement in port performance. I establish the stage games to analyze the reciprocal international trade. The theoretical findings indicate that the endowment of population plays an essential role in choosing the optimal port ownership. In the second chapter, I investigate the effect of port pollution regulation on port ownership. I incorporate the regulation tax on emissions from port cargo handling into the international duopoly trade model. The results of the stage games suggest the same ownership of the ports in both countries. I also extend the categories of port structures to include the transfer of port ownership to the other country. The policy implication is to have the small country own both ports, which is opposite to the port governance in reality. In the third chapter, I explore the equilibrium port ownership structures without other policy issues or regulation on the port sector being considered. The influence of country size per se suggests that a small country should privatize its port in the context of a privatized port in the large country. For a large country, it is better to choose a type of ownership different from the small country's. In addition, it is the country whose population is greater than a third of the scale in the other country that should own both ports.

Finally, the author proposes theneed for a structural change in Peruvian Mining and Environmental Regulations under the framework of what he calls a «positive regulation».
En el presente artículo el autor reflexiona acerca de los objetivos y principios trazados en la década del noventa, en lo que respecta específicamente a la simplificación administrativa comparándolos con los objetivos actuales de dinamización de la economía y reducción de trámites innecesarios; principalmente, los referidos a procedimientos mineros y ambientales. Consideration of a global viewpoint in modern impact analyses suggests that we should favor the efficient use of available infrastructure over the wasteful development of new infrastructure when comparable volumes of oil and gas production are concerned. This global benefit of efficient development is overlooked in traditional environmental impact analyses that typically focus on local concerns within a narrow geographic range. This traditional approach, which is common in more affluent developed countries, may actually contribute to increased global impacts by establishing stringent regulatory regimes discouraging development that would allow the efficient long-term use of that infrastructure. This disregard for global efficiencies favors development in underdeveloped countries where economic development goals may overshadow local concerns for environmental protection. This paper is based upon the results of a study of onshore industrial infrastructure capacity in Central California sponsored by the U.S. Minerals Management Service. This study evaluates the oil and gas production potential of offshore leases that could be accommodated by existing infrastructure and a balanced program of facility replacement. Though these oil and gas resources were originally identified over ten years ago, local environmental policies have delayed their development. An example of oil and gas production activities in other parts of the world that provide energy supplies equivalent to this unrealized potential is described along with an overview of selected environmental characteristics. This paper concludes that environmental review procedures addressing oil and gas development should include consideration of global implications of locally restrictive approval policies.

The 11th Five-Year Plan of China has established obligatory targets for main pollutant emissions while the completion of the targets has been associated with the achievements of local officials. With the full implementation of this plan, many enterprises began to take forward-looking environmental protection strategies to cope with the increasingly stringent environmental regulations. Most of the existing literature have systematically studied the impact of environmental regulation from the perspective of industry or region, but they have not considered the dynamic response of enterprises to environmental regulation. The research on the economic consequences of enterprises adopting forward-looking environmental protection strategies for environmental protection investment at the micro level is relatively insufficient. This paper uses the data of China's listed manufacturing companies from 2011 to 2017 to study the effect of environmental protection investment on their business performance of enterprises. The results show that environmental protection investment has a positive cumulative effect on company’s business performance, especially in non-state-owned enterprises. Based on this conclusion, this paper puts forward relevant policy suggestions to promote enterprises to implement forward-looking environmental protection strategy and gain competitive advantage.

In Poland, after World War II, most of the technical infrastructure was built based on a construction permit, and without a legal title to a given real property. Therefore, a necessity arose for the regulation of property rights where technical infrastructure was built. For the establishment of the right-of-way for transmission facilities it is essential to regulate the legal relationships between the owner of the real estate and the transmission entity and their entry into the land and mortgage register. The extent of the granted right-of-way determines the value of consideration for the owner of the encumbered property. This study analyzes the rules for the determination, establishment and surveying preparation of the right-of-way for various types of transmission facilities. First a thorough examination of the legal status of the real property was required and then the extent of the necessary right-of-way to be established for the given facilities was analyzed. The next stage of the study involved determining the extent of the rights-of-way and appropriate protective zones for the networks pursuant to the relevant technical guidelines. The analysis revealed significant diversity of legal regulations on the establishment of the right-of-way for the specific types of public utilities.
