The Rome Statute was designed to largely align criminal norms with actual state practice based on the realities of warfare. Article 8 embodied notable new refinements (e.g. in relation to disproportionate attack under Article 8(2)(b)(iv)), but did so against a backdrop of pragmatic military practice. This chapter dissects the structure of war crimes under Rome Statute to demonstrate this deliberate intention of Article 8 and then describes the correlative considerations related to charging practices for the maturing institution, including command responsibility. When properly understood and applied in light of the Elements of Crimes, the Court’s charging decisions with respect to war crimes ought to reflect the paradox that its operative provisions are at once revolutionary yet broadly reflective of the actual practice of warfare.

It requires a well-honed conscience; moral sensitivity, perception, and imagination; self-regulatory capacities; ongoing reflection to evaluate one’s intentions, motivations, and actions; cognitive judgment; the ability to devise reasonable solutions to internal conflicts; and steadfast commitment to responsibly enact considered decisions. Clinicians have dual obligations to those they serve and to themselves. Personal and relational integrity are fundamental considerations for clinicians. This dynamic interplay requires attunement to the issues of personal and relational integrity that are at play in clinical practice, including relationships with patients, families, colleagues, leaders, organizations, and the broader society.

Historically, the majority of Pentecostal churches stem from holiness and revivalistic streams of Christianity, while neo-Pentecostal churches are often indigenous plantings that broke away from congregations established by earlier Protestant mission. Given their stress on religious experience and their belief in the indwelling power of the Holy Spirit, Pentecostal churches have always stressed individual holiness, and this holiness is understood in terms of abstinence from drugs, alcohol, gambling, immodest dress, and sexual immorality as traditionally defined. This chapter describes adjustments and initiatives that indicate how new norms may emerge. The issue is essentially concerned with the interpretation of Scripture and variations in church government. Where these interpretations align with an LBGT-friendly hermeneutic, LBGT-friendly Pentecostal churches will and have emerged. Such changes tend to occur in new or split-off groups rather than in traditional Pentecostal denominations, especially when denominations are governed by large ministerial conferences where decisions are by secret ballot.

This chapter discusses the U.S. Supreme Court’s decisions during its October 1953 and 1954 terms. In the 1953 term, the Court issued signed decisions in only two “Communist” cases. Both were decided in the government’s favor by a divided Court, and the new chief justice voted with the majority each time. In Barsky v. Board of Regents the Court considered New York’s suspension of a medical doctor’s license solely because of his contempt-of-Congress conviction for refusing to produce to the House Un-American Activities Committee the records of an alleged Communist “front.” The term’s other “Communist” decision, Galvan v. Press, was a deportation case wherein a long-time resident alien was deported for having once been a Communist Party member. In 1954, the Court issued decisions in Emspak v. United States and in Brown.

This paper explores the over-representation of Indigenous people in suicide statistics internationally as indicative of the impact of the broader context of colonialism. The purpose of this discussion is to broaden the focus beyond criminal justice over-representation and to explore the ways in which research, social policy and legal institutions align to transform systematically the colonial condition into a medical one. We argue that the recommendations aimed at Indigenous people in coronial suicide inquests perpetuate a focus on Aboriginal people as the problem to be solved, as opposed to the impact of colonial relations, and that such insights are as relevant to criminal justice jurisdictions, as they are to coronial or medico-legal ones.

This chapter considers litigation under the Alien Tort Statute, which provides for jurisdiction over suits brought by aliens for torts in violation of international law. The chapter begins by exploring Congress’s likely intent in enacting the Statute in 1789, and how the Statute may have related to Article III of the Constitution. The chapter then describes how the Statute received little attention until the Filartiga decision in 1980, which allowed for it to be used by aliens to sue other aliens for human rights abuses committed abroad. The chapter proceeds to explore a variety of doctrinal issues relating to this human rights litigation, including the source of the cause of action, the standards for bringing a claim, and the ability to sue corporations. The chapter then discusses the Supreme Court’s 2013 decision in Kiobel v. Royal Dutch Petroleum, in which the Court substantially curtailed the territorial reach of claims that could be brought under the Statute.

Osteoarthritis (OA) is a chronic, disabling disease that warrants care that aligns with the principles of ‘chronic disease management’. Central to the success of chronic disease management is the ‘informed, activated patient’. Patient information strategies, including the use of patient decision aids, are essential to enabling patients with OA to self-manage their disease and engage in informed, shared decision-making. Such strategies are best delivered by a multidisciplinary team of healthcare providers and adapted to the characteristics, preferences, and values of the individual OA patient. Patients actively involved in their own disease management, that is, ‘self-management’, including shared goal-setting and decision-making about treatment interventions, are, on average, more adherent to treatment recommendations, have enhanced self-efficacy and, ultimately, experience better health outcomes.

Chaudhuri gives a New Delhi insider’s view on the efforts by Indian leaders to engage with China on these issues under the previous Congress government. He argues that by the end of the Singh administration, Indian policy makers had concluded that China was an ‘autistic power’ and that their approach of engagement had failed. Chaudhuri tracks the further changes in India’s approach under Narendra Modi, including India’s decision to align with the United States and Japan. This chapter explores what the reasons for deviating from modified universalism in practice may be. To do so, it draws on behavioural international law and economics. The chapter argues that certain decision-making biases may play a role in cross-border insolvency and can explain both negative inclinations and instances of lack of cooperation, as well as the relative success of modified universalism. The key argument here is that instead of yielding to territorial inclinations, cross-border insolvency law has a debiasing role to play. It should attempt to align choices with optimal solutions, overcoming biases, and should also close gaps in the cross-border insolvency system in line with modified universalism.

This chapter analyses Pennsylvanian and American politics in the late 1790s, focusing particularly on the Jay Treaty debates, the Alien and Sedition Acts, the Fries Rebellion, and the Pennsylvania gubernatorial election of 1799 (a key precursor to the Adams–Jefferson election of 1800). In each episode, Pennsylvanians adopted a different set of political practices, all nevertheless predicated on some form of representative action. In all these episodes, Pennsylvanians argued the right of popular political engagement did not end at election time, but instead was a continuous factor that should shape the governmental decision-making process. The outpouring of popular political activism in a variety of forms underscored the importance of a participatory political culture that could be seen to represent the people as a whole.

The United Nations Convention on the Rights of Persons with Disabilities (CRPD) presents in a tailored form the rights of such persons. Mental health disabilities are included. While the Convention is most welcome, it is hugely challenging when it comes to involuntary treatment. Important authorities have interpreted it as excluding all forms of ‘substitute decision-making’. The Convention demands ‘respect for the rights, will and preferences’ of persons with disabilities. This chapter examines the meaning of ‘will’ and of ‘preference’. A problem arises when a person’s currently expressed ‘preference’ (or desire or wish) diverges from the person’s ‘will’ (taken to mean a person’s relatively enduring and deeply held value commitments). Both cannot be respected at the same time. Which should have precedence? The method of ‘interpretation’ discussed in Chapter 7 allows such a determination to be made, and aligns the ‘fusion law’ proposal with the objectives of the Convention.

This book provides timely analysis of the cross-border exercise of banking activity in the EU and its supervision, from the perspective of the ‘home-host rule’. It examines the current system and the efficacy of recent reforms considering whether the centralization of decision making and a more effective mutualization of financing tools could increase the efficiency of the EU banking system. The EU banking market is very integrated since banking institutions based in the Union are free to perform their activities within the common market. This has allowed EU banking institutions to significantly increase their cross-border operations. This way of working is based on the home country control principle according to which EU institutions performing cross-border activities continue to be supervised by their home country supervisor. Grounded in a research-based, conceptual model called Technological Pedagogical and Content Knowledge (TPACK), the essential premise of Music Learning Today: Digital Pedagogy for Creating, Performing, and Responding to Music is that music educators and their students can benefit through use of technology as a tool to support learning in the three musical processes—creating, performing, and responding to music. Insights on how technology can be used to advantage in both traditional and emerging learning environments are provided, and research-based pedagogical approaches that align technologies with specific curricular outcomes are described. Importantly, the book advocates that the decision on whether or not to utilize technology for learning, and the specific technology that might be best suited for a particular learning context, should begin with a consideration of curricular outcomes (music subject matter). This is in sharp contrast to most other books on music technology that are technocentric, organized around specific software applications and hardware. The book also recognizes that knowing how to effectively use the technological tools to maximize learning (pedagogy) is a crucial aspect of the teaching-learning process. Drawing on the research and promising practices literature in music education and related fields, pedagogical approaches that are aligned with curricular outcomes and specific technologies are suggested. Japan's attack on Pearl Harbor unleashed rampant racism and distrust towards all things alien, and it raised perplexing questions of national identity that still reverberate. Persons of Japanese ancestry were the victims of racist acts and governmental loyalty investigations, and, finally, of exclusion and imprisonment. The majority of Japanese Americans complied with government actions, including the drafting of Japanese Americans into military service, often viewing such service as an opportunity to display their allegiance to the United States. However, some 200 Japanese Americans drafted into the Army refused to serve in combat while their families languished in internment camps. Here, for the first time, the resisters' story is told in vivid detail, following many of them into the post-war years and assessing the ramifications of their actions on their lives. The history of Japanese Americans in World War II does not record the stories of these resisters. It does not mention the War Department Special Organization to which many of them were transferred or the individuals who were tried and sentenced by military courts to long prison terms. The 200 conscientious military resisters felt betrayed by the government and viewed the decision to imprison Japanese Americans as an immoral acquiescence to West Coast racism. Castelnuovo does not abandon the narrative with the end of World War II. Instead, she follows many of the resisters into the post-war years, assessing the ramifications of their actions on their lives as individuals and within the broader context of the Japanese American community. Happily, most of the resisters were eventually re-embraced by their community, but, until now, they have been forgotten by students of World War II. That is an oversight Soldiers of Conscience will certainly remedy.
