Pełny tekst źródłaTo study " The penal couple: culprit / victim " it is to study an union and a duel. A couple supposes the meeting of both agents. The whole is to know how the protagonists are going to meet? In which circumstances? And according to which scenario? The questions multiply but what is certain that it is not the coincidence that always dictates the victimization. Latent victim, amenable victim, indicated victim, ideal victim, determined victim or social victim, all are convened by the aggressor. However, It remains to understand the choice of the victim. This one can be carrier innate characteristic or still a label imposed by its social course. In both cases the victim appears as a designated target , designated by the group to who she belongs to a vulnerable group, by the nature of her subjects. In other cases, the victim is initially not determined. It is her who attracts the culprit towards her, so creating a certain interaction between both agents. And it is moreover, this interaction which concretizes at best the definition of the penal couple. Indeed, a couple is brought to exchange. During this exchange appears clearly the role of the victim. Victim and culprit represent a duality difficult to separate. The interaction between them can find its basis in a relation between both. This relation favors the understanding of why of certain offenses. And this is why it was held by the legislator to dictate special offenses with an independent legal qualification because of this relation (infanticide, incest, parricide, harassment). The interaction between both protagonists can find its basis in the behavior of the victim in front of culprit. In this sense, the victim is not simply an amenable subject, she is going to turn out reactive, collaborator. To talk about the collaboration, about the guilt, about the responsibility of the victim can be ambiguous. How can we accept such adjectives for a supposed agent to be the part which undergoes the evil? This terminology countered shocking but its contribution does not make the slightest doubt. It is the major component of all the discipline of the victimology. Thus the whole is to understand her in its real context to avoid any diversion. In the face of what has been raised, we hold a culprit who appears as the active agent who commits the wrong and the victim who turns out to be the passive agent who undergoes him. The rhythm between both subjects accelerates until the evil is made. The offense being consumed, the rhythm between both decreases. The existence of the penal couple keeps however joining in time. The guilty overdraft does not enjoy anymore its active role. The roles are then reversed. After the evil is made, the looks turn to the victim. What is she going to make? The victim is more only the person who undergoes, but the person who takes revenge. At the bottom, the victimization is far from being an easy phase in the life of the victim. It is a terrible and destabilizing experience. It is not a fleeting event. It is the process which extends in time. At first, the victim has to make a step forward and learn to denounce. Then his victimization should not be a life sentence. She has to demand her rights. This express claiming of the victims is a claiming of dignity, consideration and honor. The penal trial appears for him as producer of the truth. It is the long-awaited moment to express its suffering and its pain. It is archetypal a scene of justice to calm the victim. It is also a scene of conciliation allowing "to negotiate" the justice to calm the penal couple. We enter then the approach of the justice restaurant owner allowing the culprit to become aware of the repercussion of its act in the life of the victim and to try to repair the caused evil. This emotional restoration including excuses establishes a very important compensation in the eyes of the victim. She can forgive and hope by this gesture to arrive at the forgetting

This link creates a gap between the partners, such a gap being necessary for each of them to be connected, and to live as an individual. The greater the desire for fusion, the more concrete the gapbecomes, leading to no sexual intercourse, somatizations, violent behaviour, appearence of an outsider. The couple symptom, created by the couple, itself, replaces the internalisation of the third agency. The link puts into place defensive collusions, wich are signs of fixation echoing the partners' pregenital histories. The return of the repressed leads real symptoms to appear and to a crisis. The psychical work supplied to overcome crises works out of collusion. With each other and through each other, the partners gradually untangle what had beeen previously condensed in thise collusions. The working over then leads onto the link either becoming stronger or disappearing totally, allowing each one to progressively integrate elements awaiting symbolisation that were until then collusive. Under such circumstances, the psychical work provided by the couple may be seen as organising or reorganising its psyche, and enabling the partners to work over again the original mourning and that of the oedipien parents. In order to achieve this work, the setting and the couple as supporting group agencies must be reliable and the link must be objectal and libidinal enough. Dual therapy offers consulting ailing partners to form such a supporting group agency. It enables the link to be created afresh, the workin out of the differentiation inside the dyad and the projections of the internal object upon the real objects

Pełny tekst źródłaIntegrative Behavioral Couple Therapy (IBCT), an empirically supported and evidence-based third-wave behavioral approach for treatment of couples, is examined in this multiple case study. Specifically, the qualitative experiences of therapists using IBCT in their work with intercultural couples are examined through each therapist’s typed responses to open-ended questions. Each participating therapist in this study contributes by describing one case in which IBCT was used to help the couple navigate cultural differences as part of treatment. This study describes the various stressors faced by intercultural couples, therapists’ formulations of cultural differences, change processes and change mechanisms during treatment, and similarities and differences across therapists’ reports. The study concludes with participating therapists’ recommendations for treatment of intercultural couples in general, and recommendations for utilizing IBCT with intercultural couples. Lastly, implications for future research are provided.

More and more understood as a unitarian concept, the couple is now included in an understanding that goes beyond the type of union, to the point where a common law of couples becomes a reality, promoted by the legislator. Doing so, the legal ways of ending a cohabition or a PACS are now obviously converging with the way of ending a marriage, thanks to the extension of protective laws that initially concerned only married couples.From here, must we consider inevitable the development of a common law of ending a couple, at the expense of the specificity of divorce ? Or, at the opposite, is the ending of a couple still the best representation of the fundamental differences between unions, revealing their very nature - moreover now that the laws of conjugality have been deeply reconsidered through the legalization of same sex marriage ?Such is the alternative for the legislator, who has now to give a brand new coherence to the laws of conjugality

Pełny tekst źródłaAlthough one-third of partners in couple therapy have experienced childhood abuse, our field has developed few specific interventions that address the lingering effects of child abuse on current couple dynamics. A common impact on adult survivors is the struggle to trust their intimate partner. Furthermore, asymmetrical gendered power processes often erode trust. Given the propensity for adult-survivor couples to experience a distrusting emotional culture, this dissertation studied the effect of gendered power dynamics on trust in partner interactions, as well as identified clinical processes of Socio-Emotional Relationship Therapy (SERT) that helped adult-survivor couples change power disparities to a mutually supportive and trusting emotional culture.
This dissertation includes two publishable papers. The first article articulates relational trust theory, which integrates feminist, social constructionist views with relational ethics. This theoretical conceptualization describes how the intermingling of gendered power interactions and adult-survivor power responses negatively impact emotional connection. The second article presents the results of a longitudinal grounded theory study of video and transcripts of 40 SERT sessions with four heterosexual adult-survivor couples. The findings from the research were applied to an additional four couples to refine the final grounded theory on how to work with the intersection of trust, gender, and power issues of adult-survivor couples. Three key themes on gendered power processes emerged: 1) gendered fear of being vulnerable, 2) unique gendered power approaches, and 3) distrustful reactions. The analysis identifies five key clinical processes to enhance trust: 1) recognize gendered power’s effects on relational safety, 2) comprehend the socio-emotional experience of partners, 3) accentuate relational needs, 4) initiate partners sharing power, and 5) identify trustworthiness of partners. The study also delineates components of relational vulnerability that augment trust.
The final dissertation chapter compares the findings from the grounded theory analysis to current CFT models with adult-survivor couples and discusses clinical implications for addressing the complex interplay of gender, power, and trust in partner interactions. A significant contribution of this dissertation is a better understanding of the link of trust with gender and power dynamics in adult-survivor intimate relationships and how to sensitively address relational processes interfering with trust.

It finds an expression under three lifestyles recognized by the law: the marriage, Pacs, the common-law marriage. All three are open without condition of difference in sex. The law built a legal framework with this solidarity (very organized, imperative, where the contractual will which has more room today is subjected to the control of the judge) in the marriage, then in Pacs where a place much larger was left with the contractual will. It gave up with jurisprudence the care to cure the consequences that the absence of relative text to the common-law marriage could have since equity and justice ordered it. When the law did not envisage them, it is the jurisprudence which built the legal mechanisms justifying the existence of solidarity of the couple. Solidarity thus concerns well the nature even of the couple. There exists a unit with the life of couple because this one answers characteristics, with needs, which are identical whatever the lifestyle, that there is or not difference in sex in the couple. Differentiations to which the recognition of several lifestyles in couple leads appear increasingly inadequate today. The recognition of the only one official shape of life in couple would constitute the means of erasing the differences in the implementation of solidarity and would thus make it possible to correct the negative effects related to solidarity of the couple. This legal framework would consist of a set of obligatory rules, essential with the life of couple, concerning as well the patrimonial extra interests as the patrimonial interests; a place would be left with the contractual organization of the life of couple. It is in the two functions of solidarity that are the mutual aid between the members of the couple and the guarantee with respect to the creditor thirds of the couple that would build this new right of solidarity in a single civil union

Pełny tekst źródłaThe contemporary law of conjugality is based on a principle of pluralism. Nevertheless, the notion of “couple” is increasingly significant. Indeed, marriage, civil partnership (PACS) and cohabitation appear as a reflection of a conjugality which claims to be plural and with gradual effects. But the latter is increasingly hindered by the unity of the notion of couple. Besides, the daily patrimonial relations of spouses, civil partners and unmarried partners are organised around the same principles: strengthening economic collaborations and assigning the appropriate patrimonial protection. Therefore it may be considered to introduce in the Civil code, de lege ferenda, a unitary definition of the notion of couple as well as a set of common rules for all couples, regardless of their form of conjugality. The daily patrimonial relations of all couples would subsequently be governed by the same rules according to the unity of the notion of couple. However, the unity of the notion of couple does not completely erase the principle of pluralism of conjugalities. Despite the convergence between marriage and civil partnership, both those institutional modes of conjugalities rely on different economic models. Indeed, set aside the daily patrimonial organization, in a marital situation each spouse is entitled to a participation in the enrichment achieved by the other during the union - whereas the participation of each civil partner in the other’s enrichment is strictly limited to the investment operations

Pełny tekst źródłaThe study of social representations in couples' relationship and in the marriage, has a primary objective to know which is the relation between the ideal image of the couples' relationship and the marriage, and the personal experience; as well as to know the semantic contents of the representations regarding the couple relationship and the marriage, and also the way those meanings act over the individual and social practices. The methodological procedures used were the semi-directive interview and the questionnaire. The interviews went through two types of analysis : thematic and sequential content and lexicographic Alcest's support, for the questionnaire, the statistical processor SPSS. The results' interpretation was made according to three analysis levels: cultural (institution and values), social (expectations and hapiness) and individual (sexuality, affectivity and communication). The conclusions were that the image of the couples' relationship and the marriage, for men as well as women, still remains in traditional terms. It is due to this focus, that a new problematic about the ideal image and the personal experience on the couples relationship and marriage is approached, and by shedding light on the interactions and correspondences between representations, practices and values

Among the people who do not leave unscathed of their accident, some are touched by an irreversible motor deficiency, which can take the form of a paralysis or an amputation of one or more members of their body. These people make the experiment of the motor disability. This destabilizing experiment cannot be reduced with its only body dimension. It implies, for the individual, to have to compose with an institutional period (at the hospital, then in a center or a unit of rehabilitation and readjustment, during several months, even years), to reformulate his existence, like rebuilding his marital relation. Hardly studied in the field of the sociology of the couple or the sociology of the disability, the marital dimension of the experiment of the motor disability makes it possible to seize at the same time the dynamics of the marital relation and the capacity of this relation to attenuate a durable and destabilizing test for the individual having a motor deficiency. Starting from interviews carried out near women and men confronted with a motor deficiency (hemiplegia, paraplegia, tetraplegia, amputation) for a few years, this thesis has proposed, on the one hand, to analyze the ways in which these individuals (re)build their experiment of the motor disability with their spouse and, on the other hand, of seizing the consequences of the appearance of motor deficiency on their marital relation

Guided to economic realism, social law is keeping at a distance formal legal link and takes into acount immediate economical link. But social law specificity shouldn't be magnified. There is no economical pattern for the couple and marriage remains the reference. The real difference between social and civil law about what a couple is appears through the study of relationships between the members of a couple. While civil law has steadily evoluated in the sense of a greater autonomy of individuals, social law stands for an interdependance of couple members as shown by the substantial part played by derived rights in social protection. This interdependence is moderated in proportion with resistance demonstrated to unimarried couples by positive law. The setting up of a uniform status for couples prooves useless. On the contrary, a legislative act in order to rule an assumption for the couple should be promoted

Pełny tekst źródłaThe figure of the Machiavellian couple, which appears in Shakespeare, Laclos, Barbey d’Aurevilly, Henry James, James M. Cain, among others, is studied through a three-fold approach. The first one is a structural one and aims at identifying the basic elements of the figure and its scenario. This approach confirms the existence of two matrix, one based on the couple of Macbeth and the other on the pair of libertines of Laclos’ novel Les Liaisons dangereuses. The second approach is interpretative and underlines the biblical basis of the figure of the Machiavellian couple in its Shakespearean version, which is a rewriting of the Fall of Adam and Eve while the couple of Laclos signals the deterioration of romantic relationships in a courtly meaning. The third approach deals with aesthetics and aims at studying the forms and poetics of the figure and its effect on the reader as well as its added value in relation to the “Canon figure” of the Villain. This third approach deals also with the aesthetics of Evil linked to the figure of the Machiavellian couple

We will see that many companies and techniques can be combined with the SCI in a patrimonial optimization. But, considering that all these legal arrangements may be risky if they were not correctly realized, it seems essential to know how to realize the right setting, which will not be sanctioned in front of a court. Therefore the issue of this work will be to demonstrate how to achieve a maximum optimization of the couple’s housing wealth through an SCI. We will see, indeed, that it is possible to propose a solution not only optimal, but also secure and perennial.To achieve this, it will be necessary to ensure that the legal protection of the couple does not infringe the legal protection of non-related third. Thus, various elements will have to be integrated into the strategist’s scheme. Some of them will consist in knowing the licit purposes, or not, and the clever legal arrangement which can be realized through a real estate civil company. Others will serve to a defense in court, when for example a company, although lawful, is questioned. The timely nesting of all these elements will offer a durable and safe solution, for the couple: this is what we call the right arrangement.In the end, this work will allow us to consider all the necessary aspects, to propose an optimized long-term company, with little chance of being challenged in court, and a maximum chance of success if the company, although lawful, was questioned in front of a court. Moreover, this work will permit to protect or defend persons in front of a court, if we consider that a Real Estate Company damages a couple’s member, a members of his family, or third party’s rights

Pełny tekst źródłaThe liberal influence in Family Law and the rise of individualist ideology have led to a multiplication of conjugal life forms and considerably increased the diversity of laws and methods applicable to couples in International Private Law. To analyse couples under International Private Law leads us to rethink the International Private Law of the Couple. Deconstructing this subject brings to light the current non-adaptation of the classic conflict of laws method and the insufficiency of the recognition approach. In fact, current International Private Law as it pertains to couples neither guarantees the international recognition of theconjugal bond nor ensures a coherent legal treatment of legal problems faced by international couples. It is therefore necessary to examine a possible methodological evolution of thesubject. This study aims to demonstrate that it is possible to adapt the classic conflict of lawsmethod by taking into account the objectives of the recognition approach whilst founding iton the lex auctoritas rule. This would not only bring better coherence to International Private Law of the Couple but it would also assure a real legal stability for international conjugal relationships

Pełny tekst źródłaThe Machining modelling must be at present realized by considering methodologies allowmg to lmk the Couple Workpiece Tool (CWT) and the Machine-Tool-Workpiece (MTW) system. These methodologies are based on physical models, and on experimental results. In this context the CWT limit parameters COM in conventional turning, in hard bad turnind and also during sbock cutting are studied. A methodology to determine the cutting speed range is established. The tudy of the influence of the cutting speed on the CWT parameters showed the importance of the cbip fissuring phenomenon. The tool life time is important for determining manufacturing cost. It is very difficult to establish a robust law. It iS absolutely necessary to realize some experiments. Nevertheless, mean values of the Taylor's wear law exponents can be used in first estimation. Based on these experimental studies, the data necessary for manufacturers are analyzed to estahlish a global methodology for the construction of an information model. The study is divided into two levels: the data level based on the STEP standard, and the semantic level based on ontologies and PSL. The international standards are considered to propose a consensual method

Pełny tekst źródłaThe context of a couple’s break-up, whether they are married, in a civil partnership, engaged or cohabiting, is conducive to prejudice the respective interests of either person in the couple. As the issue of compensation for damages emerges, the temptation is to blame the other person, especially when this one can be regarded as the cause of the break-up. An action can be brought on the basis of tort liability in the section 1382 of the French civil Code. The question of its implementation was still open. A detailed analysis of the case-law shows that this legal basis, which is supposed to award compensation, is actually used as a punishment. This resistance to the development of objectification and to the increasing legal neutrality in the organization of the couple’s relationships had to be clarified and explained. The first objective of the study was to grasp the reality of the phenomenon : tort liability is used as a “private penalty”, which highlights its repressive function. The second purpose was to determine the values that judges are trying to protect through this particular way of application of the law. Beyond the diversity of sanctioned behaviours, the thesis aims at bringing out the role of judges in finding a right way between the right to compensation and the freedom to break-up

Such a militant individualism stands though actually in the way of living together. In fact, the notion of a tie inherent in the pair proves to be a priori antinomic with the demand of a support of personality : individuality goes against unity. Does it mean therefore that the yearnings for identity, typical of our post-modern society lead to consider the relation between woman and man as fellowship of two strictly independent individualities? Everyone can, by instinct, easily discern it can’t be so. The pair never shows any indifference to the fate of protection of personality : an enrichment of the personality, thanks to the couple, will suit to the imparing of the support of personality by the pair. This impact, both negative and positive of the couple on the protection of personality isn’t though unvarying. It differs not only according to the means of personality 5rignhts of personality and civil freedoms) but also according to ways of living together. Differences between couples aren’t obliterated. They reveal the deep motive of each way of living together

Pełny tekst źródłaFrom a group of divorcing poeple, in conflict about the keep of their child (ren) by law, this research aims to circle the caracteristics of the expression about child. We are less concerned here by the child in his singular personality, but an imaginary child carried by the parents. This one creates a barrier to the understanding of the real child. Our psycho-analytical reading of the clinical material collected from personal interviews is made in three following manners (showned for our study): a) the child-investment in paternal and maternal expressions b) the place of the child in the "collusion" of the couple c) the place designated to the child in reference to the previous generations. Either than a fantasy about the child, we tried to show some examples of myths which appear in a symetrical way in a moment of crisis, opposing the maternal paternal family lines. Those myths "inclose" the child in the imaginary field. They form an obstacle to a psychological work and bereavement. The comparaison of the divorcing-group with the control-group shows the following points: if the "biological" dimension is often raised with the maternal aspects (hypothesis), it appears that the oedipian problematic is prevalent in both parents. Then the couple is often unsettled in its relations during precise periods in the libidinal (real) child development. Finally it also appears the importance, in the parental problematic, of the child identifications to some generational objet(s). Those identifications place the imaginary child outside a mental space in a certain way. The divorcing-group brings to light the general question of parental-ness, caracterising itselfby some aspects bounded to the primary narcissism of subjects. Those subjects are deeply touched in their identity and their capacity to perpetuate themself in a filiation, and so "to transmit" from generation to generation
