In the past this religion has proven its adaptability and compatibility to all the cultures and civilizations. Consequently, we can assure with certainty that Islam is completely flexible and adaptable to a given environment. The migratory flow to Europe from Muslim countries has established its roots gradually in a non-Muslim and secular environment. In this unprecedented context an innovative reflection has emerged englobing all the societal aspects. It consists in thinking out new viewpoints on creating models that are coherent for Muslims in Europe and are in accordance with the western society. This renewal depends essentially on the double capacity of combining reason and respect of the patrimony of the basis of Islamic jurisprudence. Yet, it also has to incorporate the analytical interpretations of this patrimony through the new tools of comprehension, meeting with the aims of Islamic laws.The aim of this research is about the concept of a Fatwa that allows adaptation bringing suitable solutions for the Muslims living in Europe. This research includes structuring of CEFR, its methodology of assessment as well as the categories of laws that are subjected to flexibility. The Fatwas issued by the Council consequently determine the mechanisms used to solve cases specific to European context where the Muslim communities are a minority. This allows us to evaluate the pertinence and the admissibility of embellishing of Fiqh which is meant to open new horizons, all the same without being totally detached from the existing legal patrimony

Scrutinizing alterations in the identities of researchers and the intricate fabric of both individual and collective scientific relationships, the thesis closely examines the distinct call for projects put forth by the ERC. By analyzing the selection processes leading to the identification of "excellent" individuals and projects, the investigation dissects the intricate interplay between institutional incentives for project submissions, national and international configurations of the university market, operational logics, and a diverse array of epistemic cultures.The socio-technical framework of the European Research Council (ERC) at the European level and the incentive policies at the national level are strategically devised to enhance the support for exploratory, individual, and "excellent" research endeavors. In this context, an inquiry arises: How do the recipients of ERC grants perceive their application process to the ERC and evaluate the success of their respective projects? The narrative meticulously traces the trajectories of laureates throughout the lifecycle of their projects. They may even be perceived assecondary issues. This study of administrative litigation, based on a systematic analysis ofadministrative case law, aims to establish the opposite. Preliminary issues are characterized by theirdiversity as well as by their influence on the lawsuit, however, they are often perceived as useless andcumbersome procedural complications aiming to delay the resolution of the dispute. This study aimsto explicit the process by which the administrative law judge builds a preliminary issue and what is thelegal foundation of such an issue. From this angle, albeit the fact that the parties to the main disputeplay an essential role, it is the judge, who mainly retains the power to formulate the preliminary issue.This analysis challenges the traditional portrayal of preliminary issues as paralyzing the judicial“office”. To the contrary, far from immobilizing the “office of the judge”, an in depth study of positivelaw reveals the extensive powers that the judge a quo possesses with regards to the case at bar.Finally, the reception by the judge a quo of the preliminary ruling corresponds to a sharing of juridicalsovereignty implying the passing of a juridical act emanating from a process of co-decision. Thisstudy aims to shed light on the functioning and the complexity of a mechanism rarely examined fromthis angle. Pełny tekst źródłaLe dépassement du seul critère juridique et la prise en compte du temps long remettent clairement en question l’idée que le Conseil européen ne soit devenu une institution qu’avec le traité de Lisbonne et interrogent, entre autres, sur ce que signifie « être une institution » dans l’UE. Plusieurs questions de pouvoir fondamentales sont soulevées :Comment les institutions sont-elles crées et développées dans l’UE ?Le Conseil européen est-il une institution « supranationale intergouvernementale » ?L’ordre politique européen est-il un ordre politique autonome ?
Le développement de la recherche a procédé en 3 phases, pour lesquels les répertoires de codification juridique, politique et symbolique ont servi de grille d’analyse. En premier lieu, le temps de l’instituant, temps court posant les bases du temps long dans lequel se développe l’institutionnalisation, a été étudié. Il correspond au moment de l’incursion directe et explicite des Etats dans la sphère européenne. Puis, les évolutions et trajectoires respectives des différents processus de codification du Conseil européen ont été examinées, tout au long de son existence dans l’ordre politique européen. Enfin, l’omniprésence de l’interaction national-européen a conduit à observer les processus suivis par les « sous-institutions » du Conseil européen, dans la mesure où ils permettent d’expliquer son institutionnalisation dans l’ordre politique européen. Le couple franco-allemand et la présidence du Conseil européen ont ainsi fait l’objet de processus d’institutionnalisation propres, mais intrinsèquement liés à ceux suivis par le Conseil européen, et ont servis à déterminer les interactions entre les ordres politiques nationaux et l’ordre politique européen.
Cette recherche a notamment mis en évidence le fait que l’institutionnalisation du Conseil européen a principalement été réalisée sur le plan politique (au travers des actions des acteurs, des rôles qu’ils ont façonné et investi, de la stabilité qu’ils ont instauré par la répétition de pratiques, de convergences de vues facilitées par la pression du groupe, ou encore du respect de l’échelon national par la dimension supranationale), en étant partiellement soutenue sur le plan symbolique, tandis que le droit n’a très longtemps fait que suivre ces processus et n’est vraiment intervenu que pour reconnaître l’existant ou dresser un état des lieux du consensus en vigueur au moment où les circonstances appelaient des reconfigurations substantielles.

However, the decline of the British culture of Liberty during the eighties led to a change of the traditional sources of protection. This change was materialized in the Human Rights Act 1998, which is designed to give further effect to the rights and freedoms guaranteed in the European Convention on Human Rights. But has this new document succeeded in reviving the spirit of liberty characteristic to the British psyche ? Answering this question requires an assessment of the impact of the Human Rights Act 1998 on the effectiveness of the protection of liberty but also its impact on the British Constitution as a whole. It provides a necessary impetus, defines general orientations, arbitrages the dispute between member states, symbolyses the internal solidarity, and represents the external political interlocuteur. But the European council has a hybrid and contradictory character. It should resolve the problems that union is confronted with, but at the same time, all of the member states pursue their own national interests, even if they often diverge or conflict with those of the others partners. Facing a Europe on the decline, the ambition of the European council is grand, but its means are smaller, so it continuously searches for compromise, and its rhetoric and actions are sometimes incoherent. A sociological study can help us to understand the contributions and the limits of the European council to the European integration. The first part of the thesis is a general knowledge, the European council is studied like a whole entity ; the second part treats the European council like a compound of many diverse actors ; the third part is a conceptual analysis by some integration theories about the Western Europe

Nevertheless, the international origin of this principle remained unexplored. This study shows that the impartiality is a recurring requirement in the speeches on the justice, and it since the Antiquit. In spite of its philosophic obvious fact, the juridicisation of the principle of impartiality showed itself sinuous and uneven through the history and the legal cultures (Civilian /Common law). The peculiarities of the political system of the United Kingdom so explain the direct applicability of the principle in the motocross from the origins of Common law. On the other hand, in French law, its explicit consecration was late and provoked by the article 6 EHCR

Pełny tekst źródłaThe coexistence of jurisdictions attached to distinct juridical orders raises the question of the nature of the inter jurisdictional relationships, as well as, more specifically, of the situation of the Conseil d' État vis-à-vis the Conseil constitutionnel and the judges in Strasbourg and Luxembourg. A first movement tends to consider that the Conseil d' État is the agent of a jurisdictional monologue. It appears that an ideological superstructure has determined the institutional infrastructure. The former results, from one hand, from the contemporary rhetoric about human rights. On the other hand, it is orchestrated by a doctrinal strategy that pursues the prominence of the law while denying the autonomy of the juridical science. The jurisdictional monologue is constructed within the institutional infrastructure. The cornerstones of the construction are the Constitution and the Fédération, as sources, respectively, of the international law unity, and the European law. But the notion of the authority of judgments and the autonomy of the Conseil d' État are not likely to show a hierarchical inter jurisdictional link. Thus there is a deconstruction of the jurisdictional monologue. A second movement considers that the Conseil d' État is an actor in a jurisdictional dialogue. In this perspective, there is a positioning and a communication by the judges. The judges' positioning is dependent upon the jurisprudential strategies implemented. The strategies vary among jurisdictions based on the jurisdictional latitude which positions the judges in the dialectic of freedom and in the constraint of the activity of interpretation. The judges' communication evidences, from one hand the creation of a judges' dialogue which, without satisfying the habermassian postulate of a strategy and domination free discourse, adopts the demand for a narrative coherence. On the other hand, it also attests of the transformation of the production system of the law. Hence, the idea of a complexification of the law is validated, underlined by the change from a pyramidal logic to a network logic

Pełny tekst źródłaThis PhD dissertation answers the double issue of: 1) how the main EU policy device regarding research, known as the Research and Technological Development Framework-Programme (FP), influences the scientific practices of its users; and 2) how the scientists weight on the actual contents of this policy. The question therefore is: through what processes does a European research project come to reality? The proposed answer is based on interviews, archives, semi-quantitative treatment of emails and in-situ observations of a EU research project called EA-Biofilms, funded through the sixth FP. The outline of the demonstration follows the chronology of this project. Its emergence is institutionally structured, upstream, by the political construction of the FP (Chapter 1) and of the research funding market the FP encompasses (Chapter 2). The cooperation can then be seen crystallizing, first, around an object that federates the involved scientists (Chapter 3) and, second, around a contract between the EU administration and the research consortium (Chapter 4). The implementation of the project is then scrutinized through the study of the cooperation devices that are used to steer the project (Chapter 5), and of the ways the coordination tools frame actual scientific work (Chapter 6). The various mechanisms which bring a EU research project to reality thus rely on devices – for selection, quality or insurance – and objects – scientific, contractual or technical – which both oil and frame the interactions between actors

This prefigures a supreme collective magistracy of the European Union and a credible, moderate and politically determined instititional leadership. The originality of this political and ledal identity od the European Council resides in the fact that its institutional evolution built itself up on the specific and characteristic contradictions of the European Union. The first sign of the institutional evolution of the European Council is the emergence of a structural frame specific to the European Council. In a simultaneous and complementary manner, a phenomenon of convergence of several different elements started. These elements enable the definition od an original statutory frame of the European Council. Both of these factors, which have been, are, and will continue to be conditioned by the progresses of the community and institutional process decided by the political will of the Heads of States or Heads of Governments, established both axes of study of our thesis. Although he is not a tax judge by law, he has succeeded in establishing himself as protector – now essential – of the rights and interests of the taxpayer, affirming both his singular place and his irreducible difference. He does not owe this position – at least not solely – to the remarkable and noted intensity of the constitutionalization movement which has affected tax law over the last 30 years. It draws it above all from the powerful link made up of reciprocal utilities which unites it to its own tax jurisprudence. Using tax litigation to perfect and energize its control of constitutionality, the specificities of constitutional tax litigation have allowed it to build itself as the source of authority that everyone knows – welcomes or regrets – today, both in the internal order than in the external order

Pełny tekst źródłaUnder the both influence of communitarization and fundamentalization of the national civil legislations, a real European civil law, common core of all the European Union member states, emerges. However, this European civil law, which is under construction, particularly lacks coherence and systematization. Community institutions suggested to codify the whole or parts of the civil matter. This option has aroused many doctrinal reactions, especially in France, doubts arising about the interest and the opportunity of such an undertaking. In fact, these doubts are fostered by the fear that national civil codes could disappear, cultural and legal diversities alike. Obviously, it can be explained by a narrow approach of codification. The will to elaborate and enact a European civil code requires to adapt the « code » and the « codification » to the European context. Thus, such a process will not result in uniformity. It should lead to open codification, respectful of the national differences. Consequently, the European civil code will provide a remedy for the incoherence and complexity of the European civil law

Pełny tekst źródłaCarlo Sforza's political action (1872-1952) is deep-rooted in the reflections on federalism. In 1930 he declares that to solve european problems the foundation of the United states of Europe should be rapidly achieved. His inspiring model is the Swiss confederation. The French-italian customs union (1948) is therefore the first step to realize a real and advantageous political union. The project regards economy as a whole and not only the interests of specific fields of the italian or french economy. Sforza also shares his political sentiments with the european movements. The positions of the European parliamentary union becomes more determined in 1948, on occasion of the Unterlaken plan. As regards the European movement, he garthers round him the leaders of the European countries, but he does not suggest a true federal plan. Starting from 1950, the European federalist movement becomes the most active among all European movements. The expectations arisen from the project "Europe" foster the origin of the Council of Europe (1949), which Sforza would have formerly given the name "European union". The integration of the Council of Europe to the OECE is fundamental in order to share and combine the political action of the Council with the technical preparation of the economic organization. But the controversial position of Great britain causes negative reactions and contagious uncertainty. Richard Coudenhove-Kalergi foreshadows then the foundation of a confederal organization without british presence. When the Council of Europe comes to discuss the content of the text of the CECA treaty (1950), the Assembly undertakes to avoid a casting vote so as not to take a position which could be against the Socialists. Little by little, the Council changes into permanent institution and conference. In this context, the schman plan seems to be revolutionary indeed. The italian minister realizes that he immediatly has to give his assent to the Schuman plan and that has to take part in the CECA negations from the very beginning. Sforza and the other ministers find the first element of European community in the foundation of high common authority and in the fusion of national sovereignties

Pełny tekst źródłaThis study, centred on administrative science, analyses the struggle for leadership between the conseil d'etat of france in one hand and the european courts, i. E the court of justice of european communities and the european court of huma n rights, in the other hand. Historically, it shows that both of the communitary and european courts owe a lot to two french lawyers, M. Lagrange who imported techniques from the conseil d'etat to the c. J. E. C. , and R. Cassin, who was the main author of the provisions of the european convention of human rights concerning the european court. In a dynamic point of view, this study, through a closed survey of case law, describes the evolution that led to the reversal of the relations between the french and the european courts. The french conseil d'etat, which enjoyed a model position when the european courts were created, saw its influence go down as the authority of the c. J. E. C. And the european court of human rights increased. Its fight for restoring its authority took a mainly procedural and technical appearance - disagreement about the operating conditions of pre-judicial action and primacy of communitary law - but the spread of communitary law finally made it surrender. Nevertheless, the conseil d'etat of france is not bound to decline : the achievement of communitary integration gives it the opportunity to perform a new role on the european scene as a consultative authority

Pełny tekst źródłaDealing with the unititiated relationship to quantitative "evaluation" of the territorial public intervention, this thesis analyses the European Social Fund (ESF) and the Conseil régional de Picardie (CRP) cases and combines interviews, statistics, archives and observations. Four questions outline the demonstration. The ESF case enables to show that the law is a possibility and inefficiency condition of quantification. If it contributes to determine the existence and the features of the CRP statistics infrastructure, the law also makes figure manipulation possible. The links between law and statistics can adopt a dialectical connection, where quantification is used as an instrument to exploit legal uncertainties. The performative nature of statistics forms is due to the more or less close correspondance between the technical, institutionnal and symbolic properties of these forms and those of the context they are introduced in. The CRP case reveals a separation between the adjustment of statistical and evaluative tools and their performativity. The conditions that have contributed to the establishment of these tools have also limited their effectiveness. If it has some innovative aspects, the "new public quantification" is not that far from other statistics forms if we examine for instance its categories of legitimation. We show the reversibility of the "evaluation", both resources and ties for groups of agents involved in institutionnal rivalries. The proceedings of an "evaluation" can be analysed as the retranslation of differences of opinion about social issues extrinsic to the evaluation procedure

Pełny tekst źródłaSince the implementation of regulation 4064/89 on community mergers control, 90% of the commission decisions are common market compatibility ones. The commission combines both the political functions definied under articles 2, 3, and 155 of eec treaty and exclusive authority for the control of mergers. The commission has sometimes been in position to tolerate some mergers to hold more than 60% of community market although they would have prohibited such a plan under articles 85 and 86 of the eec treaty. The commission has chosen an economical, practical and political view of what the control of mergers should be, based on a principle of neutrality. It did not prevent them from interpreting the regulation, sometimes contra legem and applying it in a discretionnary way. The commission has established itself as a unique and unavoidable authority in terms of competition. But, is such a apparent and dual policy is acceptable in today's community institutional context? what is its future in the forthcoming global trade and legal system?

Pełny tekst źródłaThe Open Method of Coordination (OMC) constitutes a new European instrument, which aims at furthering national policies convergence by setting common objectives and guidelines that are to be implemented by Member States. The OMC appears a method which differs from the way States positions are usually brought together. Indeed, it does not impose obligations upon States, which retain the exercise of their competence, it stands out of the traditional channels of European law and it favors an original form of convergence, based more upon the exchange of good practices and cognition than upon legal norms. By focusing on the social domains in which the OMC is enforced, this research aims at studying the legal reality of this method. The OMC reveals a new way of conceiving European legal norms and, more broadly, the influence techniques of European law. The OMC use must be thought and viewed in a perspective of association with the normative elements of the European legal system and, more particularly, with the requirements of the Community of Law

Our work has led to concrete realization as scientifical, socio-political and organizational communities were simultaneously advancing. The basic, ethical, epistemological, theorical, methodological framework in which this double activity (research and praxeology) can be understood will be examinated. The study of the shift from internalism of sciences (searches finding themselves cut off from the rest of the world) to externalism (research centers meeting social demand) will make it possible to stress the main changes impulsed to the ways of having access to knowledge by this shift of purposes in science. This method of intervention aimed at policy makers is to be found in our center (observation center for employment, education, and development) under a characteristic way : expert's report and advice. This double activity includes a survey and a written report with advice to our customers. It combines the clasical scientific process with a method to take steps, some of them being in our report. This report is the main factor which contributes to train policy makers. Il really is the essential tool for coming to decisions under the condition that the symbolic and pragmatic processes have been first examinated. As an exemple the decisional context will be analysed (study concerning the university of toulouse-le-mirail)

The European Commission defends the credibility of its policy initiatives, like energy and environment targets or new market mechanism, by scientific reports. Facing strong stakeholders, an elected European Parliament and a Council representing the national interests, the Commission founds its legitimacy in the "objectivity of the figures". Almost twenty years before the formal Impact Assessment, most of the Commission proposals were already submitted to Economy-Energy-Environment modelling analysis. Scientific results are used by the Commission - technocracy by excellence - in its preparatory legislation to justify economically and to support politically its initiatives

Large scale french retail trade in the interwar period consists essentially of three types of enterprise: department stores, chain stores and popular price shops. In 1919, it represents only a small sector of the world of employer organisations. This sector will little by little organise itself in the interwar period, to the stage where it will acquire a real place along side public power. These employer organisations, representing and defending the activities of different sectors such as the groupement d'etudes des grands magasins (1919) and the federation nationale des entreprises a commerces multiples (1937), or the promotion of external commerce and the european idea like the comite d'action economique et douaniere (1925). These organisations together would promote public debate on the economy and europe. Jacques lacour-gayet, their principal representative is an example of a new high level unionised employer organisation official during the interwar period. Across this stand point one helps to maintain an integrated liberal discussion which rejects both the notions of a planned economy and at the same time the temptation of neo liberalism. The circles which are controlled by commerce play an important role during the liberation, in coordinating different pro-european movements with liberal tendencies. The number of these movements increased and organised themselves with the objective of sustaining a solid european based project

Pełny tekst źródłaThe point of our study is to show that the speeches delivered by Felipe Gonzalez and José Maria Aznar, the two Spanish Prime Ministers, to the Members of Parliament in which they explained the conclusions drawn from European Councils, represent a textual dimension that is made of communicative strategies that were either required by the Community institution and the Parliamentary institution embodied by the two utterers or chosen by the two Prime Ministers.Our study, based on certified parliamentary speeches and focusing on the diachronic dimension of the successive electoral mandates of the two Prime Ministers (1987-2003), tries to evaluate on a discursive, linguistic and thematic level (using lexicometrical tools available with Lexico 3 and Coocs softwares) to what extent the European Council and the Parliament exert some leverage on the speeches and how the utterers free themselves from the institutional constraints, using the political speech as a strategic and rhetorical alternative. Thus, these lexical statistics enable us - to extract «thematic words» that shape our speeches and lexical networks that are built on lexical attractions (co-occurences), to shed some lights on the relation existing between a lexical occurence and a historical event which will allow us to grasp the Spanish dimension of it; - to compare the speeches of our two utterers in order to underline the regular lexical patterns and the discursive specificities that will lead us to sketch out the stylistic and thematic characterisation of the two politicians

Pełny tekst źródłaIntermediaries intervene on behalf of the unemployed in the employment market in order to assist them in their job search. Examination of the advice preferred brings to light the availability of Job Search Assistance (J. S. A. ) Manuals as well as situations of direct interaction between councilors and the unemployed. A quantitative analysis in this domain proved to be impossible ; the characteristics of the councilors, the unemployed as well as the job search advisory structures remain vague since no precise numbers have been established. Only a micro-sociological study, based on an interactionist theoretical approach, has permitted an observation from the "inside" of these counseling techniques. These techniques are not insignificant and are not based uniquely on good intentions towards the victims of unemployment. They propose a behavioral model, that is a prescribed role for the good job seeker that takes into account the balance of power present in the confrontation between offer and demand in the employment market. In this way, the councilors' discourse transmits a behavioral norm designated herein by the term "regulatory job search". Those counseled should acquire a social competence, a know-how that consists of skillfully manipulating the codes of interaction in order to assume an inferior position in regards to the recruiter without losing face. J. S. A. Is not affiliated with any particular theoretical contribution, but provides an on-site apprenticeship that includes several sessions where employment interviews are simulated. Councilors utilize some forms of symbolic violence in order to initiate a secondary socialization process. (Berger, Luckmann, 1996). Pełny tekst źródłaThe subject of this study focuses exclusively on the right to a healthy environment in European law as it is defined by the two major European legal systems which constitute this right: Council of Europe and European Union. It seems fundamental to understand how these two complementary but also competing legal orders can be seized in a similar way or, on the contrary, significantly different from the great challenge of the right to a healthy environment. The choice to study the right to an environment in a European context is justified by the special approach offered by European law as a field of analysis. Indeed, the two organizations and their respective legal orders, the European Union and the Council of Europe, are two systems that work differently, which are driven by singular objectives but which do not exclude certain reconciliations. Thus the right to a healthy environment in Europe is most often apprehended from two different approaches. On the one hand, the "droit de l’hommiste" angle, very much favored by the Council of Europe, which claims its pioneering role in the protection of human rights, democracy and the rule of law . On the other hand, the European Union, first conceived as an Economic Union and an organization that remains fundamentally driven by economic objectives. Of course, the EU also defends and protects human rights. But the healthy environment or the high level of environmental protection that is its corollary is more frequently confronted with fundamental freedoms guaranteed by the EU, in particular freedom of movement within the framework of the internal market. This balance between the human right approach and the internal market approach is very specific to EU law. European law will be studied in a systemic approach: process of norm production. This specificity of European law to the healthy environment and its dynamics deserve to be apprehended both from the point of view of the recognition of right and its implementation, which we will see that it is animated by springs specific to each of organizations, but which are not necessarily exclusive of each other

Pełny tekst źródłaThe principle of subsidiarity has become a principle of european law with the article 38 of the european community treaty. The purpose of our work is to show that this article wich is supposed to protect member states against the growing communautaries competences will not succed in his task. The principle will fail because of his ambivalence. In his classical meaning, it must protect the inferior level against the superior level's intervention. But, in his modern meaning, it justifies the intervention of the superior level so that it can help the inferior one. The analysis of the practice shows that in domestic affairs, in international law and in european law the subsidiarity was an inefficient barrier in such cases. The theory of the implied powers is responsible for this failure. This jurisprudential creation born in the u. S. Law and transposed in international and european law cohabits with the principle but has an inverted function : it legalizes the growth of competence of the superior level so that it has the necessary powers to take action for the fulfilment of the purpose of the constituent instrument (constitution or treaty). Well then, the implied powers have always succeeded in their confrontation with the subsidiarity (in his classical meaning). It will be the same with article 3b. Beyond, it seems possible to demonstrate that because of his ambiguous formulation, the subsidiarity of that article 3b is essentially a conventional ratification of the theory : the modern meaning of the principle is in fact nothing but a conventional illustration of the theory

Pełny tekst źródłaThe european parliament, in a few years, has been able to approach the three powers usually acknowledged to a parliament in western democracies: -to vote the law -to allow taxes -to supervize the policy of the executive the european treaties draw their inspiration from parliamentary logic; the parliament discusses, in public session, the general report which is proposed by the commission and the treaties foresee the possible sanction: the motion of censure of the integrated executive, which involves it's collective resignation. If the parliamentary logic exists, it still remains uncompleted on the european scale and lies in the only control of the commission, neglecting the real deciding institution, that is the council. So, the political control power does'nt correspond with the reality of the institutions. The whole procedure of the parliament, from a democratic point of view, consists on the "reconstruction" of it's ability. If it has been able to give itself the largest means for questionning the two executives, the sanction, limited to the only commission, still shows a democratical deficiency

The first examines general problems of the region. Finally, this section stresses problems of transition to the market. The second part studies the most significant economic branches (both weak and strong), as well as regional development in the USSRr (e. G. The internal logic of that development and its effects). The works of the standing conference of local and regional authorities in Europe will be particulary studied as well as those of the committe in charge of the regional politics in the European parliament. . . In ordre to attain that goal this organisation had elaborated many instruments renforcing thereby the cooperation between its members in all the fields. The major part of these instruments was devoted to the mutual aid in repressive matters, all in safeguarding the human rights. In ordre to permit the reciprocal surrender of delinquents between its members the council of europe have elabarated the european convention of extradition dated the 13 december 1957. This study concerns the legal nature of the extradition in this european framework which is principally conventional but, neverthless, coherently reconciliable and the bilateral and other competing systems. The contents of this european system consiste in fundmental classicales principes recongnized in delinquents extradition matters. Although it does not introduce important changes to these principes the council of europe remains, however, vigilant that the principal texte follows the evolution of policy in criminal matters without neglegting the human rights. The council prepare, this doubtless the judiciary space, which is desierd since somme years ago and wich will be the principal theme for the comming years espcially after 1992

Pełny tekst źródłaThis thesis highlights my final research results at CERN (European Nuclear Research Center). It deals with advanced control algorithms integrated for the 21 Gas System installations of the new particles accelerator named LHC (Large Hadron Collider). The process is enclosed into the strategic GCS project (Gas Control System): producing the overall control systems by recursive declinations via an automation production application. The controls equipments engage are industrials Programmable Logic Controllers combine with SCADA systems (System Control And Data Acquisition). In this context some advanced control algorithms are well adapted by its capability to comply with these typical needs: the Smith Predictor (dead time compensation), the predictive methods (robustness and convivial tuning), the RST controller (open structure and polynomial resolution) and the online parametric identification methods. The work presented is structured in four points. First, it deals with the synthesis of advanced control loop and identification methods for an industrial Programmable Logic Controller. Second, it exposes the implementation validity. Third, it develops the systemic use of advanced control loops in a large scale project build with two innovative methodologies: a framework of development and a model driven realization. Fourth, it concludes by providing to the Gas process experts a standard interface allowing an efficient use of advanced control algorithms
