Streszczenie:
The subject of discourse in this study is ‘leadership and governance imperatives for development in the Democratic Republic of the Congo’. The qualitative research method was deemed the most suitable in attaining the objectives of the study. The study comprises six chapters. The main objective of the study is to contribute to an understanding of the challenges that constitute a stumbling block for the establishment of a system that promotes good governance and places the DRC on the path to development. Beyond the analysis of challenges, the study also examines the environment in which leaders evolve and it focuses on leadership challenges and governance imperatives that prevail in the current setting of the country. In this context, the study formulates a framework for leadership development. The study aims at proposing a perspective for leadership development considering the fact that the DRC urgently requires leaders who are competent and effective, and who can consider modern principles of management and governance as provided by the case studies of Brazil and Botswana in order to offer the much needed leadership in the nation-building process. Considering the crises the DRC has endured throughout the years, leadership’s role is of great importance as leaders have the ability to transform the adverse circumstances that Congolese people have faced since the inception of independence. The study insists that is possible only if leaders can inspire hope and change the patterns of how things have been done in the country. The DRC needs leaders who are able to help unleash its potential and allow the country to regain and to maximise its strategic position as a significant player in the continental geopolitical affairs. The thesis argues that the success of any leadership mainly depends on the kind of social order that prevails in the DRC and on the type of the political arrangement adopted by its leaders. The main challenge facing the DRC is establishing an effective leadership. The legacy of colonisation coupled with the misrule by Congolese cadres have made it difficult for the DRC to secure a system that promotes good governance and creates conditions for economic development. An effective and purposeful leadership has the ability to provide a clear policy guideline that might bring about change in the functioning of the country’s institutions. In the case of the DRC, an effective leadership will be the one that will create an environment that promotes the reforms much needed in the political and administrative structures of the country and, consequently, enhance conditions for a successful implementation of policies for the betterment of all. This study proposes that Congolese people deserve a civilised nation and a set of capable leaders who can maximise the country’s abundant resources so that citizens can benefit from the country’s wealth. As soon as the DRC finds the path to prosperity and development, it will be possible for the country to also impact positively on its neighbouring countries and the whole continent at large.

Streszczenie:
This paper considers the situation of Congolese women and their almost complete social, political and economic marginalization in society. The Congolese constitution formulates the principle of gender parity between men and women; however, numerous provisions of the law still actively discriminate against women, relegating them to the status of second-class citizens. The violent conflict that the Congo has experienced and continues to experience has only exacerbated the socio-economic and cultural differences in status between men and women. How are Congolese women responding to these obstacles and have they been able to make any sustainable gains in doing so? The findings of this paper contend that despite the inequities that they experience in the social, political and economic spheres, Congolese women have in fact been able to take steps towards achieving gender equality. The conflict that has so negatively affected them has also provided them with intended and unintended opportunities for improving their situation. One such opportunity is evident in the creation of City of Joy, a women empowerment program established and developed entirely by Congolese women. A refuge for survivors of sexual violence, City of Joy helps rehabilitate these women with the hope that they will have acquired the necessary tools to catalyze social change as they are reintegrated into their respective communities after the six-month program. City of Joy as a case study illustrates both the opportunities for empowerment and change as well as the difficulties of providing women with meaningful agency given the structural obstacles that they are faced with. Although it is difficult to evaluate the long-term success and sustainability of the program, the general observations that can be gleaned from this example demonstrate that war and conflict can create fresh beginnings and new opportunities for women to produce their own social, political and economic realities. City of Joy, although limited in scope, is a socially enhancing program and a pragmatic step toward increasing the probability of a peaceful outcome in the aftermath of a brutal and long-lasting conflict and will ultimately have a positive long-term effect Congolese society.

Streszczenie:
Uganda currently hosts 1.4 million refugees and conflict-affected people. Known as the “best place” in Africa to be a refugee, Uganda’s policies encourage self-sufficiency and local integration. However, many refugees, particularly women and girls, face persistent challenges. Understanding the reproductive health needs of this population and exploring the accessibility of services for conflict-affected populations in this low-income host country is a priority. This multi-methods study aimed to assess the reproductive health needs of displaced Congolese women in camp- and urban-based settings in Uganda. We interviewed key informants, facilitated focus group discussions with refugee women, and conducted in-depth interviews with Congolese women of reproductive age to better understand knowledge, attitudes, practices, and services. Our results suggest that Congolese refugees have significant unmet reproductive health needs. Maternal health and delivery care is characterized by insufficient human resources, inconsistent medication availability, discrimination, bribery, and communications challenges. The availability of contraceptive products, including emergency contraception, is limited in camp-based settings due to supply-chain management challenges and theft by staff; lack of contraceptive knowledge among Congolese refugees shapes use. Finally, the legal restrictions on abortion lead to unsafe practices among refugees and pose a barrier to the provision of post-abortion care. This study provides insight for opportunities to improve the delivery of sexual and reproductive health services to refugees in Uganda to ensure that the infrastructure and processes align with national policies and international guidelines.

Streszczenie:
The eastern part of the Democratic Republic of Congo (DRC) has been described as the ‘rape capital of the world’ due to the severity and brutality of sexual violence that Congolese women experience. Sexual violence as a weapon of war in conflict-torn areas takes the form of rape, sexual slavery and the insertion of objects into cavities (such as knives, rifle barrels, pieces of glass, sticks, wood, bottles and pestles coated in chili pepper). It predominantly targets girls as young as two years old and women as old as eighty years old. Perpetrators of such illegal and immoral acts of violence in eastern DRC (North Kivu and South Kivu provinces) include members of the national army, members of rebel groups and United Nations Peacekeeping personnel. Congolese women’s rights are constantly undermined and violated. This is despite the country’s legal obligations to protect Congolese women through its ratification of a number of international and regional conventions and treaties which promote the rights of women and prohibit sexual violence. The Congolese Constitution contains provisions aimed at promoting and protecting women’s rights, including the protection of women against sexual violence. Despite various pieces of legislation and calls by human rights activists to halt acts of sexual violence, Congolese women continue to face unwanted pregnancies, abortions, sexually transmitted diseases, HIV/AIDS, destroyed reproductive organs, injuries and even death. Sexual violence continues unabated in eastern DRC as a tactic used by various armed groups to terrorise and control the population living in conflict-torn eastern DRC. This mini-dissertation is a cry for justice in that it highlights sexual violence crimes and other human rights abuses faced by women in eastern DRC and calls for perpetrators to be held accountable.

Streszczenie:
Fewer rural Congolese women complete 4 antenatal care (ANC) visits than do urban women, despite high maternal and child mortality rates. This quantitative cross-sectional survey applied Andersen's behavioral model of service utilization to examine whether the ANC facility type, provider type, provider gender, time to ANC facility, cost, and number of services can predict ANC compliance among rural women. The study was a secondary analysis of the 2015 Maternal and Child Health (MCH) survey, which comprised 1,280 eligible women selected through stratified random sampling. The analysis included bivariate and multivariate logistic regressions. The findings showed that women seen in private facilities, AOR = 2.220, 95% CI [1.384, 3.561], p < .01; women seen by female providers, AOR = 1.407, 95% CI [1.055, 1.877], p < .05; and women receiving 7 to 9 ANC services, AOR = 1.680, 95% CI [1.142, 2.472], p < .05, were more likely to complete 4 ANC visits. The cost of services and time to the ANC facility had no association with ANC compliance. Further analysis showed that private facilities provided more services (median of 6 vs. 5, p = .000) and had more women attended to by doctors (11% vs. 2%, p = .000) and female providers (72.9% vs. 58.4%, p < .001). These findings suggest that service quality and provider gender play a role in ANC compliance in rural areas. Therefore, Congolese health authorities should establish quality improvement programs and incentives to attract female providers to rural areas. This study contributes to positive social change by identifying ANC access barriers of rural populations and informing future efforts to close the urban-rural gap in MCH outcomes.

ENGLISH ABSTRACT: This study aims to explore the existing knowledge, attitudes and practices regarding HIV/AIDS among Congolese refugees living in Cape Town in order to create awareness and suggest possible measures to avert the spread of the pandemic among them. The target population are Congolese refugees living in Cape Town, with a refugee or an asylum seeker status. Due to the total population and difficulties in contacting them, the participants (50) were randomly selected among traders and hair dressers. The study used a quantitative research design. The Desk Top Market train station in Cape Town is an open market place where most Congolese traders sell their goods to the public. The data were collected at this market area in Cape Town using a questionnaire. To avoid any possible discrimination or stigmatisation resulting from being identified as a refugee in the study, the Congolese were contacted from the market place without screening them on the basis of their status. The participants were, however, required to tick their status in a box provided on the questionnaire. Furthermore, strict confidentiality was maintained to avoid the possible stigmatisation arising from the Congolese traders’ refugee status. According to the findings Congolese refugees have knowledge about HIV/AIDS and the route of transmission. The majority knows how to protect themselves against HIV/AIDS but it seems this protection discontinue shortly after a quick trust between them and their partners. It is may be because most refugees are in need of financial protection on their arrival so they do not have any other choice than to let it go. During the process of data collection there was an opportunity to discuss with some of them protection and most of them stated that condom use is not safe as condoms breaks often. Many Congolese do not believe in male circumcision for the reduction of risk because 100% of them are circumcised and some still have contracted HIV/AIDS. Some of Congolese does believe HIV can be cured because they have seen people who were cured through prayers. The findings also indicate the level of awareness is very low in this community because they still believe they can just by looking at other individuals they can detect if someone is HIV positive or not.

This study investigates how female migrants negotiate the tension that arises from being entrepreneurs, being mothers, and having families. It shows how entrepreneurship offers them self-emancipation but limits the time they spend raising their children and time they spend with their families, but puts them in a position to provide financially for themselves, their children, and families. The focus of the study is on Congolese female migrant and also females from few African countries. It is hypothesized that female migration and entrepreneurship negatively impacts the relationships of these females with their children and families. Data was obtained through a survey of fifty-three respondents who were conveniently selected. This took place in the Western Cape Province, taking Cape Town, Bellville, and Parow as the cities to be observed. The statistical package for social sciences was used to analyze data. The results showed that female entrepreneurship has a negative impact on their relationships with their children but to an extent improves their relationships with their families and/or partners.

Using the theory of intersectionality, the present research aims to characterize, through the interpretation of the narrative constructed by the Belgian newspaper Le Soir on the Congolese community in Brussels, the Belgian imaginary of the migratory flows between the now Democratic Republic of Congo and contemporary Belgium, during the temporal lapse between 1989 and 2000. In this effort, within the period established, it was possible to identify the Congolese migratory movements and their relation with the different political and economic contexts of the African country; also, became explicit a lack of intersectionality in public policies, abuses by the authorities, a institutional insufficiency on the part of the institutions, and a relation of estrangement and exoticization, in general, on the part of the Belgian, regarding the Congolese and the African immigrant community living in the country

Streszczenie:
"Although the United Nations (UN) has often been pivotal in forging the international response to serious human rights crimes in such settings, the justice gap in countries such as the Democratic Republic [of] Congo (DRC) (the focus of this study) underscores the need for more systematic UN efforts. The war in the DRC has resulted in one of the world's worst humanitarian crisis with over 3.4 million displaced persons scattered throughout the country. An estimated 3.5 million people have died as a result of the war. The armed conflict has been characterised by appalling widespread and systematic human rights violations, including mass killings, ethnic cleansing, rape and the destruction of property. The most pressing need to be addressed is the question of justice and accountability for these human rights atrocities in order to achieve a durable peace in the country and also in the Great Lakes region (Rwanda, Burundi, Uganda, Angola and the DRC, to name just a few). In this respect, this study will address the grave human rights violations committed in the DRC and the mechanisms for dealing with them. It is particularly true in post-conflict situations where justice systems have been either partially or completely destroyed, that national courts are not capapble of arriving at a uniform stance, or willing to provide justice for atrocities in the immediate future. As a result, international justice seems to be a crucial and last resort that must continue to be fortified against efforts to undermine it. ... Chapter one will set out the content of the research, identify the problem and outline the methodology. Chapter two will discuss the state obligations in international law to prosecute gross violations of human rights and gives a summary of the human rights violations situation during the Congolese war. Chapter three will discuss the available naitonal mechanisms for accountaiblity in the DRC. It will discuss if national courts and TRC are able to deal with these atrocities committed in the DRC. Chapter four will analyse the extent to which the ICC could deal with the Congolese case and challenges. Chapter five will discuss the trends towards accountability in the DRC and the way forward. Chapter six will draw a conclusion on how to break the cycle of impunity in the DRC." -- Introduction.

The aim of this study was to explore the democratisation process that unfolded in the Democratic Republic of Congo from 1990 to 2006 with a view to establishing whether Huntington’s model of democratisation as set out in his Third Wave: Democratisation in the Late Twentieth Century (1990) is useful in analysing the Congolese transition. Huntington’s model is essentially based on the experiences of democratisation in the so-called third wave of democratisation that occurred in countries in Southern and Eastern Europe, Latin America and Asia. In line with Huntington’s analysis of the democratisation process elsewhere, the study examined, among other things, the triggering factors of the democratisation process; the modes and characteristics of the transition and the factors favouring and obstructing the development of democracy in the Congo. The study has found grounds for some minor deviations from Huntington’s observation of experiences elsewhere. These pertain to the sequence of the democratisation process, the complexity of the problem in the Congo and the role of the military. Whereas Huntington posited that one of three modes of transition occurred in a particular country – transformation, replacement and transplacement – all three modes transpired in a dialectical sequence in the Congo. In addition, the democratisation process in the Congo was intensely militarised since it involved not only the government and what one could call the ‘classical’ opposition, but also an ‘armed opposition’ encompassing several rebel groups and militias backed by foreign armies, each with its own agenda. Furthermore, when the military was confronted with the pressure to democratise elsewhere, it was generally instrumental in the democratisation process. In the Congo, to the contrary, it is the powerlessness of the military that constituted an obstruction to the democratisation process in the country. The weakness of the generals in the Congolese army results from their vassalisation by politicians who utilised army officers for their political ends. However, in an overall evaluation of the applicability of Huntington’s model to the Congolese democratisation process, it can be stated that, despite the above minor differences, Huntington’s model serves as a useful tool in analysing the democratisation process in the country, irrespective of the complexity of the Congolese experience. The model serves to elucidate the causes, patterns, power dynamics in the democratisation process, and also identifies potential problems in the consolidation of democracies. Its usefulness in analysing the Congolese transition makes it an equally useful tool in analysing the democratisation processes in other African countries.

In 2013, the U.S. Department of State allocated nearly $45 million to the Texas Office of Refugee Resettlement to help aid with the resettlement of 6,922 refugees. Approximately 10 percent of all refugees who were brought to the U.S. that year were resettled in Texas. Austin received 716 of those refugees. For 30 years, the U.S.'s Refugee Admissions Programs has been providing aid and money to help refugees fleeing religious and political persecution resettle in the U.S. The program is a system of public-private partnership in which the U.S. Department of State hands out funds to local non-profit organizations to oversee the initial six months of the resettlement. The current program is largely underfunded and is based on a self-sufficiency model that requires refugees find a job within four months of arrival setting many refugees on a path towards poverty as they are often come from conflict zones with minimal English skills, knowledge of how the U.S. works or programs to help them use whatever skills or education they have to find better paying jobs. This paper critiques elements of the U.S. Refugee Admissions Program through the case study of one family that has recently arrived in Austin, Texas, from the Democratic Republic of the Congo.

This dissertation consists of a contextual reading of the texts of Jeremiah on semah (23:5-6; 33:14-16), together with the related texts in Isaiah (4:2; 11:1-2) and Zechariah (3:8; 6:12). The context I am reading from is the present political situation in the Democratic Republic of Congo (DR Congo) and the leadership crisis since independence. I first approach the Masoretic Text (MT) in a synchronic way and I do not focus on a rigorous study of the texts in discussing their form, source and redaction criticism. To analyse the texts on "branch" in Jeremiah, Isaiah and Zechariah, I pay particular attention to the literary context of texts. My synchronic approach seems to de-contextualise the texts under study from their socio-historical context. However, in chapters Three and Five I place these texts in the broad historical context of the Davidic kings from about the time of Jeremiah until Judah‟s return from Exile. The analysis of the current Congolese leadership situation is confined particularly to the governance of President Mobutu Sésé Seko. In particular, the focus is on the second period of his presidency, from 1975 to his dismissal on May 17, 1997. The social situation, during this period, had worsened immeasurably in the country.

Constant change through global competition, technological advances and socio-economic improvement, permeates the contemporary environment in the world including certain African countries. Oil refineries are in constant progress with regards to modernisation and development. Many oil refineries all over the world are operating according to the expected scope of oil products to be produced and supplied, in line with the objectives of meeting domestic and international demand. The Democratic Republic of Congo (DRC) has one oil refinery only named Congolese Company of Oil Refining Industries (SOCIR), which has become less productive, uncompetitive, inefficient and unable to achieve its socio-economic roles or goals of supplying the country with oil products and of contributing to national socio-economic development. This study aimed to explore the socio-economic role of the petroleum refining industry in the DRC, through the case study of the SOCIR. The objectives of the study were to evaluate the factors affecting the socio-economic development in the DRC; identify the challenges experienced by SOCIR in the macro-environment; and explore the socio-economic effects the upgrading of SOCIR could have on the socio-economic situation in the DRC. In order to achieve these objectives, the study was undertaken as a quantitative survey combined with qualitative in-depth interviews to provide better understanding of the information obtained from the survey. The quantitative study was conducted on administrative personnel, academics, students, and public and private participants involved in the oil and gas industry in the DRC. Hundred participants were selected for the quantitative survey and five in-depth interviews were conducted to discuss the findings and results obtained through the quantitative study. The macro-environment variables of the PESTIE model were used to accomplish the aim and objectives of this study. The result of this study revealed that most factors affecting the socio-economic development of the DRC are related to the PESTIE instabilities, lack of economic diversity and constant national and regional ethnic or armed conflicts that are fuelled by multiple interests linked to natural mineral resources. The ageing of SOCIR infrastructure, the lack of financial capital and the lack of investments for human capital development were identified as the main challenges experienced by SOCIR. Furthermore, it was highlighted that if SOCIR upgraded with new efficient processing technology, it could increase its capacity of production, contribute on reducing the effects of total dependency on imports of all needs for petroleum products and prevent the country from exporting the total oil output, contribute on supplying the country with sufficient quality and quantity of clean oil products, and promote the oil and gas industry development and integration. The results of this study also indicated that SOCIR development could play a key role leading to economic diversity and growth with direct, indirect and induced impacts of massive job creation and contribute on reducing unemployment, poverty and inequality of many Congolese which are living under the poverty datum line. The study revealed that the outcome of the oil and gas industry integrated and developed through SOCIR modernisation strategy could steer the socio-economic change and transformation in the country. It is recommended to the government of DRC to constantly review, monitor and implement policies and regulations that could promote the oil and gas industry development in the country. The results of the study should also influence policy-makers and decision-makers on formulating innovative and creative policies, setting programmes, methods and interventions, which will enable the development of the oil and gas industry.

Streszczenie:
The survival of the majority of refugees in their host countries is characterised by poverty resulting from different sets of vulnerabilities. Formal education/training appears to offer the only opportunity for refugees to improve their survival chances. This study examined formal education/training as a livelihood strategy of Congolese refugees who have graduated in different fields of study in South Africa and are currently living in Durban and what have been its outcomes. This study found that, though formal education/training has the potential to improve the livelihood opportunities of Congolese refugees who graduated in South Africa, by increasing their chances of accessing better pay employment and improving their well-being, it still needs to be strengthened through the protection and promotion of refugees’ rights, a change in public attitude towards refugees and the careful selection of fields of study. In order for formal education/training to effect sustainable positive changes in the lives of respondents, there is also a need to formulate and implement supportive policies and legislations with the view to address specific livelihood challenges pointed out in this study.

Streszczenie:
This qualitative study conducted in South Africa, explores the socio-economic integration of Congolese migrants living in Johannesburg. Drawing on respondents own subjective experiences, this study investigates the way Congolese perceive and explain socio-economic integration and the role that gender-roles play in this understanding. Participants were identified using purposive sampling as well as snowballing techniques and narratives of ten Congolese women and men were employed in data collection using semi structured interview guide. Data for this study was analysed using a combination of content, narrative and discourse analysis. Analysis of the data revealed that loss of status played a major role on Congolese men’s and women’s feelings and perceptions of socio-economic integration. Loss of status was increased by migration through intersections of unequal power relations, access to services, and broader related migration issues. Findings also reveal that participants drew on specific migration related discourses including poverty, access to services (institutional), legal status, socio-economic status, socio-cultural status and xenophobia to explain their perceptions and feelings regarding socio-economic integration in South Africa. Further analysis indicates that being socially and economically integrated is not simply defined by having jobs, the right to access services, associating with South Africans but having the lifestyle that one had in the country of origin prior to migration. This includes feeling respected and finally having the same economic and social power as the locals. Among discourses drawn on, participants also used the discourse on traditional practices to justify their unwillingness to integrate into the South African community. The unwillingness to integrate also arises from what respondents described as the reversal of gender roles, and culture showing how these can be a barrier to socio-economic integration.

This is a study of local integration of Congolese refugees from The Democratic Republic of Congo (DRC) living in Johannesburg. The point of departure is from Jacobsen’s assertion that refugees are de facto integrated when they are not in physical danger, are able to sustain livelihoods through access to land or employment, and can support themselves and their families, are socially networked into host communities so that intermarriage is common, ceremonies like weddings and funerals are attended by everyone and there is no distinction between refugees and local communities. The study looks at the amount of interaction between refugees and South Africans, the dynamics involved in social integration and the perception of integration by refugees and service providers. Refugees and service providers in Johannesburg were interviewed and conclusions are drawn from their responses and the literature consulted.

Online banking in the financial sector has revolutionised the banking industry. This study aims to determine the perception of electronic banking, from the consumer`s perspective among Congolese consumers using South African banks in the Greater Durban area. Banks are competing on the basis of technology and service offering to win a sizeable share of the online market. Congolese consumer is a good target market, however, very little is known about the factors influencing Congolese consumer behaviour in the online banking sector in Durban. An understanding of the demographic profile, factors prompting the use of electronic banking and motivators influence the adoption of electronic banking. Analyses of Congolese customers adopting electronic banking will facilitate the formulation of marketing strategies to foreign nationals in South Africa. The empirical section of the study involved data collection through the use of self-completion questionnaires administrated by the researcher. A survey was conducted in the greater Durban area using convenience sampling methodology and 288 completed questionnaires were collected by the researcher. The key findings revealed that the demographic profile (gender, area of residence, marital status, and income categories) influences the adoption of electronic banking as a segmentation basis. It was interesting to note that most of respondents were married and reside in Central Durban and South Durban. Furthermore, psychological factors (motivators, attitudes, perceptions and perceived risk) were found to influence the adoption of electronic banking to a large extend. Interestingly, cultural factors (social class, age and education level)play a significant role in the adoption of electronic banking by Congolese customers of South African banks. The findings also revealed that the driving force for the adoption of electronic banking was that respondents have a job which requires them to have a bank account. Most of the banks in South Africa offer free internet banking to their clients. Since convenience sampling method was used, the findings of this study may not be generalised. Based on the findings of this study it is apparent that the customer analysis of banking clients should be examined on a regular basis. A customised strategy for foreign national customers residing in South Africa should be developed on a regular basis.

Nowadays, the management of infectious diseases is especially threatened by the rapid emergence of drug resistance. It has been suggested that the medicine quality assurance combined with good medication adherence may help to reduce this impendence. Moreover, the search for new antimicrobial agents from medicinal plants is strongly encouraged for the exploration of alternatives to existing therapies. In this context, the present work focused on both the quality evaluation of commercialized antimalarial medicines from the Democratic Republic of the Congo and on the phytochemical investigations of a Congolese Ancistrocladus species

To regulate and facilitate are the main functions of legal rules. These purposes are achieved by a harmonised legal system by which the law becomes identical in numerous jurisdictions. The process to unify the law of sale internationally started in the 1920s and culminated, in 1988, in the implementation of the CISG. This Convention intends to provide clarity for most international sales transactions by regulating the formation of contracts, and the rights and obligations of the seller and the buyer resulting from the contract. The CISG has these days enjoyed much ratification and influenced a number of legislation reforms worldwide. Despite the role it played during the drafting process of the CISG, the DRC has not yet ratified it. Instead, the country continued to rely, until recently, on colonial legislations which had become out-dated, and inadequate to meet modern international sales contracts requirements. The situation appears to have been improved a year ago as the effect of the adoption of OHADA law whose Commercial Act is largely inspired by the CISG. Because the introduction of OHADA law in the DRC is very recent, this study intends to assess the current state of Congolese sales law by comparing it with the CISG and South African law, which is non-CISG but modernised. The comparative study aims at establishing whether current Congolese law, as amended by OHADA law, is sufficient or has shortcomings; if it has some, it aims to identify those shortcomings, and make suggestions for their improvements. After discussion, it has been discovered that the ratification of OHADA law has significantly improved Congolese domestic sales law. Given that there remain certain unresolved shortcomings in Congolese international sales law, however, the study ends by a proposal for the accession of the DRC to the CISG in order to fill them.

This study explores the schooling experiences in South Africa of migrant children from the Democratic Republic of Congo (DRC). Migration has been an area of interest within political, social and academic circles. In recent times, studies have been and are being conducted on issues on migration especially with the aim of exploring migrants’ experiences and challenges. This study addresses the experiences of migrant children from the Democratic Republic of Congo in schools in South Africa and their social identity as migrants. It aims to bring these issues into focus and to encourage further research and debate with the aim of finding ways of ensuring better schooling experiences for these migrant children. As its objective, and in line with the aspirations of inclusion and diversity of the present system of education in South Africa, this study: enables an insight into the Congolese migrant children’s school experiences and the resulting challenges for schooling in South Africa, provides an avenue to explore these challenges and experiences in the light of educational policies in place in South Africa and how these challenges affect the children’s education, raises critical issues regarding inclusion and diversity in the South African educational context, and contributes to ongoing debate, awareness and research interest in the area of study. The study addresses the extent to which the inclusive schooling system in South Africa does in reality include these migrant children. This study is situated within the critical paradigm and engages Social Identity Theory as its theoretical framework. It employs a case study methodology to explore the schooling experiences of migrant children from the Democratic Republic of Congo. The theoretical framework as well as the methodology used in this study makes provision for a critical engagement in the analyses of these experiences.

The novel, in Zalre, is proliferating despite the economic difficulties of the country. Popular writing, in particular, consisting of shortish books and selling for very reasonable prices, has become something of a phenomenon. The leader of that market, not studied here, is Zamenga. The two works chosen, Mais les pieges eieien: de la fete of Bwabwa wa Kayembe M. (1988) and Train des malheurs by Tshibanda Wamuela Bujitu (1990) illustrate a category of writing that reflects daily realities without making emotional demands on the reader. The heroes are virtuous, and there is a happy ending. A type of novel we have called intermediate makes more demands on the reader, and is particularly less simplistic as to its moral. Kin-Ia-joie Kin-la-folie by the journalist Achille Ngoye (1993) strike a chord of fellow feeling in the heart of . anyone struggling to live in Kinshasa and aware of the undercurrents of crime. The happy ending allows the reader to indulge in fairly deep reflection, or simply to close the book with pleasure. Le fils de la tribu by Pius Ngandu (1983) is much more troubling, unless the reader enjoys the beauty of a tragic ending. Above all, no reader can fail to reflect on the underlyirig-tl'!essage, Ngandu's plea for the· brotherhood of tribes and a cessation of the fratricidal wars ravaging Africa. The last text, Le bel immonde by V.Y. Mudimbe (1976) takes the reader into a category of much denser story-writing, and finds once again that the reader is not able to read without reflecting on the implications of what he has read.

This study was based on the heterosexual form of sexuality as it is the most dominant form of masculinity amongst the Congolese. The aim of this dissertation was to investigate the type of migrant Congolese heterosexual men living in Durban who mostly use sex-enhancing substances and the reasons behind the practice. It sought to explore the impact of the black African isiZulu cultural environment influence about the use of sex-enhancing substances on the DRC men heterosexual in their negotiation of masculinities within the transnational space Further, the study critically examined how migrant Congolese heterosexual men are renegotiating their masculinities in a transnational space through sex enhancing substances. The key question in this study was “How are men from the DRC using sex-enhancing substances to re-negotiate their masculinities in the transnational space”? The methodology was qualitative and in-depth interview was utilized as the method of data collection. The results of this study indicated that the migrant Congolese heterosexual men in renegotiating their masculinities within the transnational space through sex-enhancing reinforce existing hegemonic notions of masculinities and also end up creating new forms of hegemonic notions of masculinities. Streszczenie:
The African continent has been beset with violent conflicts, civil wars and extended periods of instability. The continent’s future depends on the capacity to prevent, manage and resolve conflict. Reacting to conflict has proven highly expensive for the international community and has strengthened the case for a greater focus on conflict prevention. This study will examine the role, relevance and success of preventive diplomacy in responding to and preventing violent and protracted conflicts in Africa, in particular recent international efforts to seek a concrete, comprehensive and all-inclusive peace settlement to the conflict in the Democratic Republic of the Congo. The conflict in the Democratic Republic of the Congo had resulted in what many analysts considered to be ‘Africa’s First World War’. The aim and objective of this study will be to assess the role of preventive diplomacy, in particular efforts by the international community to resolve the conflict in the Democratic Republic of the Congo. The study of the success of preventive diplomacy in responding to the conflict in the Democratic Republic of Congo will cover three distinct phases. The first phase will assess the historical development of the crisis in the former Zaïre dating back from 1997 to 1998 and initial steps that were taken to address the conflict. The next phase will cover the period dating from 1999-2000 following the signing of the Lusaka Ceasefire Agreement, while the final phase will assess developments and efforts to secure peace by the international community from 2001 until 2004, while providing for a brief discussion on possible future developments. The research will commence by examining various theoretical contributions and insights produced on conflict prevention and the concept of preventive diplomacy. The examination of conflict prevention and preventive diplomacy will be rooted in theoretical insights produced by Michael Lund (1996) and other influential contributions on preventive diplomacy. The theoretical framework for this study will be based on Michael Lund’s model of preventive diplomacy. Although Lund’s conceptual framework provides a valuable insight into the theory of preventive diplomacy an additional theoretical consideration may be included into his assessment. Lund’s theoretical framework fails to address the impact of psychological variables and the extent to which prevailing conflict attitudes may exert a negative influence on a conflict situation. This may render the effectiveness of preventive diplomacy at the level of unstable peace obsolete if it fails to take prevailing conflict attitudes into account. This dissertation will also propose the inclusion of social-psychological approaches to augment the strategy of preventive diplomacy as developed by Lund. Very little conclusive and in-depth research has been conducted on how psychological variables, particularly conflict attitudes such as negative images, attitudes, perceptions and conflict behaviour can fuel and exacerbate a conflict situation, especially conflicts in Africa and how this may derail the success of preventive diplomacy in resolving such severe conflicts. In the numerous efforts to secure peace in the embattled Democratic Republic of the Congo scant consideration, evaluation and analysis has been produced on the way in which conflict attitudes such as misperception, fear, distrust, hostility and suspicion, became not only a major stumbling block to the peace process, but also negatively affected the outcome of the various peace agreements that were negotiated. One of the core arguments this dissertation will posit is that preventive diplomacy has not been successfully applied in resolving conflicts in Africa, and will continue to fail, unless greater emphasis is placed on structural prevention, that includes an assessment and strategy for responding to conflict attitudes, such as misperception, hostility, suspicion, fear and distrust. It could be argued that preventive diplomacy initiatives when taken alone and independently of a broader strategy of conflict prevention are likely to fail unless they are linked to measures and actions that tackle the deeper or structural causes of conflict. Greater emphasis should be placed on timely and adequate preventive action, through the vigorous promotion of preventive diplomacy, particularly structural prevention. The conflict in the Democratic Republic of the Congo is intermittently erupting and will continue to do so, unless the structural causes of the crisis and the various conflict attitudes are effectively dealt with. The study will commence with the theoretical and conceptual framework of the study, consisting of a discussion of conflict, preventive diplomacy, and conflict prevention. The conflict in the Democratic Republic of the Congo will be discussed as well as the underlying factors that contributed towards the brutal and excessively violent nature the conflict came to assume. The study will also examine the international response to the conflict in the Democratic Republic of the Congo as well as the immediate diplomatic efforts initiated to resolve the crisis from 1998-1999, which culminated in the signing of the Lusaka Cease-Fire Agreement on 10 July 1999. An assessment of the intervention efforts initiated by the United Nations, the Southern African Development Community (SADC) and other key African states, in particular South Africa will also be undertaken. The impact of psychological variables and the importance of assessing the crucial contribution of social-psychological approaches towards understanding and resolving conflict will be briefly considered with particular reference to the protracted tensions which persisted between Rwanda and the DRC, despite the conclusion of numerous peace agreements between both countries. The final chapter will form an evaluation of the prospects for peace in the DRC beyond 2004 and will conclude the study with particular reference to the extent to which the research questions have been adequately addressed with final recommendations on the role of preventive diplomacy in addressing conflict.

In this study I will examine two texts by the Congolese author Sony Labou Tansi, namely The Seven Solitudes of Lorsa Lopez and Parenthesis of Blood. The aim of the research is to examine how and why the author uses techniques of allegory and magic realism instead of realism in his work. By closely examining the two texts and with the help of comparisons with his other works, I intend to show that the world he is representing is too fabulous to be rendered in a realistic manner. The use of allegory and irony in the text is a strategy that helps the author to challenge the oppression and despair in his society. The issue of gender is also important in both texts, therefore, I will examine how Labou Tansi portrays women in his works. I will do this by comparing his presentation of women to other female characters found in African canonical works by male writers.

Ilondo, Justine Rachel. "An exploration of the cultural understanding and help-seeking behaviours of Congolese immigrants in South Africa regarding mental health challenges". Diss., 2017. http://hdl.handle.net/10500/23203.

Pełny tekst źródła
Streszczenie:
The ongoing war in the Democratic Republic of Congo (DRC) has caused sustained trauma on a number of levels and stressors that could easily have debilitating consequences on the mental health of Congolese citizens. The literature further reveals that immigration brings with it a host of additional stressors. The stress related to immigration, an appreciation of diverse cultural understandings of mental health, the burdens and costs of adequate mental health policy and provisioning within developing countries, are concepts that are not well understood nor fully documented. The present study explored the cultural understanding and help-seeking behaviours of Congolese immigrants in South Africa. The purpose of the study was to understand the ways in which Congolese cope with stressors related to immigration. Using SocialIdentity Theory as a partial conceptual framework, the role of acculturation processes in their understanding and help-seeking behaviours regarding mental health challenges, were examined. A platform for participants to suggest suitable ways of responding to improving the management of mental challenges in their community was provided. A qualitative approach, based on Participatory Action Research (PAR) and content analysis to explore the emerging narratives, was used with a Gauteng-based sample to gather the accounts of the lived experiences of Congolese immigrants. A snowball sampling technique enabled twenty-seven respondents to participate in one paired conversation and five focus groups. The emerging findings are critically discussed aligned to the six categories of inquiry structured by the interview schedule, namely, coping strategies since immigration, the understanding of mental health challenges, the possible impact of being immersed in the South African culture, perceptions of mental challenges and persons affected within the Congolese community, the preferred help-seeking behaviours regarding mental health challenges and, finally, their recommendations for improving the management of mental health challenges. The layered meta-analysis of the data consisted of interrogating the thematic categories, then conducting an analytical review aligned to both the pertinent research aim and objectives, as well as related theoretical positions and research findings. v | P a g e The key research question underpinning this study was formulated as follows: “Will immigrating from the DRC to South Africa change the understanding and help-seeking behaviours of Congolese?” The study drew on the processes of acculturation from Social Identity Theory to examine these processes. Participants reported experiencing the effects of acculturation but in different ways. Patterns of assimilation, separation and integration were found. The study therefore served to contribute to our understanding of the effects of acculturation with regard to the cultural understanding and help-seeking behaviours of Congolese immigrants in South Africa regarding mental health. Most significantly, the assumption of high levels of trauma and stress within this vulnerable community were unfounded. Rich and complex survival strategies have emerged requiring refinement of our knowledge about migrant communities. The strengths and relative weaknesses of the study are shared as well as a set of recommendations for future research in this domain.

Streszczenie:
This research uses Contextual Bible Studies as the main approach in searching for ways in which the Bible may be used as a resource to contribute to a holistic education for people with disabilities (PWDs). It explores the situation of PWDs in the DRC and demonstrates how the image of PWDs has been negatively portrayed, and how PWDs’ situation has been perceived as a misfortune. Consequently, the socio-cultural concept of disability has influenced the biblical interpretation of disability making PWDs seem to be “lesser human beings”. Therefore, the use of three biblical texts, which are Exodus 4, 1-17; 2 Corinthians 12, 1-10 and Acts 3, 1-11, in this study serves to re-read the Bible in a constructive way from the disability perspective. Each Bible study has its main focus related to the question of this study mentioned above: the first biblical text, Exodus 4, 1-17 is designed for IMAN’ENDA members with the aim of helping PWDs to discover their real identity in the light of Bible study. The core verse of this study is verse 10, in which I focused on, “How God views disability”. The second text, 2 Corinthians 12, 1-10, is designed for PWDs as well as for ablebodied people in order to understand suffering as another way of discovering oneself. The main focus of this Bible study is on v. 9, in which I dealt with “Power through weak body”. The third biblical text is Acts 3, 1-11, and is designed for church leaders from the Presbyterian Church in Kinshasa with the aim of helping church leaders to widen their understanding of healing for better integration of and support for PWDs in society. The text focuses on healing that I referred to as “Holistic Healing”. The study also offers a theological reflection on disability in the Bible. This is based, on the one hand, on findings from Bible studies with PWDs and Presbyterian Church leaders and lecturers; and, on the other hand, on interviews conducted with Protestant Church leaders and religion lecturers, and Catholic high school pupils. These investigations were conducted in order to develop a holistic educational programme for PWDs in the DRC, which is proposed as a programme in Social Transformation.

Streszczenie:
As the Congolese conflict marks the 20th year, and the peace process 17 years, the apparent question is why is the search for peace in the DRC proving elusive? Spoilers and other impediments to the peace process in the DRC have been studied and UN peacekeepers have been operational in the country for nearly seventeen years, but the conflict continues. This study therefore seeks to understand the potential of UN peacekeeping to hinder the peace process in the DRC, and the United Nations Organization Stabilization Mission in the Democratic Republic of the Congo (MONUSCO) constitutes a study case. MONUSCO has been in operation for six years today succeeding the United Nations Organization Mission in the Democratic Republic of Congo (MONUC), and is still operating. Inasmuch as it looks early to gauge whether MONUSCO is contributing to progress or hindering the peace process in the DRC, this study focuses on the practices of UN peacekeepers under MONUSCO and their potential to delay peace initiatives. Using secondary data as the main source of information, i.e., books, articles, journals, news, UN reports and resolutions, triangulation and Game Theory, especially the Prisoners’ Dilemma Analytical Framework derived from the Prisoners’ Dilemma Game Matrix, this study finds that the Stabilization Mission is inconsistent, i.e., UN peacekeepers are performing controversial tasks: use of force to protect civilians, engaging in battles to neutralize armed militias and investigation of war crimes and human rights, tasks that have generated resentment from the FARDC/Kinshasa government and the armed militias, making the search for peace a one actors responsibility [MONUSCO’s task]. A clear indication that MONUSCO is hindering the peace process in the DRC. The thematic analysis details five (5) themes and indicates that; cooperation is problematic, use of force to protect civilians is controversial, there is a mismatch between doctrine and practice, i.e., deviation of UN peacekeeping from the basic principles, the justice dilemma, and an understanding of peace as absence of war and fighters. The thesis concludes that practices of MONUSCO need revisiting, dialogue should be encouraged, revision of peacekeeping principles and accurate timing of interventions, so as to enhance progress in the search for peace in DRC.

This thesis is a true representation of my artistic academic work, written passiantely and informed with logical interpretation of other authors' perepectives, i.e., it is a deskstudy. It took me 10 weeks to produce this piece of work which adds to the ongoing debate on the Congolese process and UN peacekeeping in the DRC and other parts of the world. Streszczenie:
The mission of the Gareganze's Brothers in Christ Church facing the chaos of the socio-political situation in DRC resulting mostly from the question of the Congolese nationality is to dynamise the christian mission and to protect the poor, set free the captives, because God is always at their side. The DRC, though, has enormous natural resources and the competent human resources capabilities. The national institutions seem to be unable to handle this situation because of the lack of political culture, mismanagement and moral untidiness. The successive Congolese crises mostly are the same, the common denominator resides in the causes that brought them about. The main objectives of the antagonist groups are political leadership and material wealth. The findings of our analysis will help the Church of Christ in Congo, to fulfill the prophetic mission and the vision of God, for the positive transformation of the Congolese society.
