This paper analyzes the legislation related to concessions on maritime domains and indicates the need to adjust certain legal provisions to improve the quality of the concession granting procedure. The object of this paper is to indicate the issues in determining the real value of a concession fee in the process of preparing a feasibility study for granting the concession, and to give a scientific contribution by proposing procedures and measures, which can enable setting more precise concession fee values. Using the methods of comparison, analysis, and synthesis, authors prove that in the process of preparing a feasibility study for granting the concession it is not possible to assess the real value of the concession and concession fee with certainty, as it is necessary to estimate economic sizes in the long term. Each concession contract, lasting longer than five years, should be subject to a peer review owing to changes in economic, political, demographic, and other indicators, and if necessary, the value of concession fee should be adjusted accordingly. The authors explain the stated imprecision in the estimate of economic indicators by the index of uncertainty of economic policies, and with the inability of long-term forecasting of potential economic crises.

AbstractIn 1896, the Russian empire established a territorial concession in the Chinese treaty port of Hankou. Russian activity in the treaty ports has usually been subsumed into a wider ‘European’ or ‘Western’ presence, the assumption being that the Russian empire copied existing British and French concessions. This article traces the development of the idea of establishing a Russian concession from its inception to the early years of its development. The various arguments made at different stages in this process make clear that the decision was not a simple case of imitation of existing concessions, but was reached in the context of a broader shift in ideas about the proper relationship between economy, nation, and the Russian imperial state.

Introduction. In the West, concessions are the most common form of public-private partnership in such sectors of the economy as telecommunications and communications (60 %), energy production and distribution (19 %), transport (18 %), and water supply (3 %). As a form of public-private partnership concession agreement pursues the goal of involving private investment in the creation, reconstruction, modernization of socially significant publicly owned facilities. Based on public interests, government will determines the goals and parameters of the concession project and takes control over its using, and the concessionaire takes on operational activities (development, financing, creation, use, management, provision of services to consumers). Purpose. The purpose of this article is to conduct concessions, including the content concluding, amending and terminating a concession agreement in the field of heat supply. Methodology. Achieving this goal was achieved through the use of general scientific and particular scientific research methods: dialectical, formal logical, systemic-structural, comparative legal, technical-legal, linguistic, scientific analysis method. Results. The historical aspect of the formation of the concession and the analysis of concession models leads to the conclusion that this legal framework is the most effective alternative of public-private partnership in relation to socially significant infrastructure facilities. Conclusion. Today, there is a process of implementation of the concession mechanism in Russia, the state is interested in partnerships with private capital in weak investment areas. However, society and business have incomplete understanding of the essence of the concession, the practice of its application. The transition to a concession system means a change in the essence of relations between the state and business in both legal and economic contexts. The implementation form of the concession agreement should fix the balance and mutual interest of the parties in the application of the most effective, modern and technological methods of construction, reconstruction and use of facilities, as well as the provision of quality services to consumers.

Abstract.The article considers modern aspects of financial support of investment activities on the basis of public-private partnership. The expediency of using one of the key forms of public-private partnership -concessions in the process of financial support of investment activities of state and communal economic entities is substantiated. The existence of a significant impact of the mechanism of transformation of the movement of financial resources as a result of concession relations, the practical implementationof which allows to obtain a significant economic effect for the national economy and the state budget. Financial support of their investment and innovation development. The extremely important role of the state in the process of financialsupport of investment activities on the basis of public-private partnership is emphasized. Taking into account the existing approaches of scientists and practitioners to the interpretation of the essence of the categories "state regulation", "state regulation of innovation development" the author's interpretation of the definition "state regulation of innovative development of concession activity" is proposed as a component of concession management system. Increasing financial and economic security.The necessity to singleout among the main tasks of the mechanism of state regulation of financial support of investment and innovation development of concession activity such tasks as: development of financial and economic relations of concession subjects is substantiated; providing practical orientation of research works; innovative renewal of production facilities of concession facilities.The existence of a systemic impact of financial support of investment activities on the basis of public-private partnership on the trajectory of future socio-economic development of the country is proved.

Budgetary constraints are forcing transport infrastructure authorities to raise private funds to finance the construction of new projects and the maintenance of existing ones by using concession contracts. One of the key elements in correctly defining a concession scheme is to establish an adequate risk-sharing mechanism among the stakeholders that take part in the process. This paper describes and analyzes the effect of the new Spanish Concession Law on risk sharing, in particular, the effect of the so-called progress clause on the calculation of risk held by the concessionaire. This law was designed both to reinforce private financing of public facilities and to improve the legal framework by defining a new risk-sharing approach, particularly in relation to the risks involved in estimating traffic demand. The paper finishes with an analysis of a specific application of the traffic risk-sharing approach for highway concessions in Spain.

Public-private partnership was not unknown in Macedonia prior to the adoption of the latest legislation on concessions and PPP in 2007. Many infrastructure and other public interest projects have been developed or tried in the form of concessions mainly at the state level over the past few years. The Concession and Other Forms of Public-Private Partnerships Act marks an important step towards stimulating more intensive use of public-private partnerships, particularly in developing infrastructure and public services at the local self-government level. One has to welcome the introduction of this very concept of the Public-Private Partnerships Act into the Macedonian legal system because it brings this form of financing local development closer to both public and private partners, and it makes the whole process of structuring and awarding PPP projects more transparent and clear. Purpose Targeting public–private partnership (PPP) projects, the purpose of this paper is to help decision makers fairly allocate financial risk between governments and private investors through a properly designed length of concession period. Design/methodology/approach On the one hand, the length of the concession period should be long enough to help private investors to achieve their expected profits. On the other hand, the length of a concession period cannot be decided without agreeing on an upper limit, since an overlong concession period takes too much time for governments to recover their investment and leads to an overly lucrative condition for private investors. Following this logic, the concession period decision range is decided, which defines the lower and upper limits for the length of the concession period. The net present values (NPVs) for governments and private investors are estimated via Monte Carlo simulation to better reflect the uncertainties. To further decide on the optimal length of the concession period, the principle of fair risk allocation between governments and private investors is adopted. The concession period, as an important project parameter, should help to minimize the financial risk gap between governments and private investors. Findings The developed concession period determination process is validated using a numerical example of a PPP transportation project. The analysis outcomes show that the proposed methodology is capable of determining the length of the concession period so as to control private investors’ profit within a reasonable range while achieving a fair allocation of financial risk between governments and private investors. The outcomes also indicate that, before determining the optimal length for the concession period, governments may need to make a choice between better financial risk allocation or stringent profit control for private investors. Research limitations/implications The determination process developed here may be inapplicable to social infrastructure PPPs where the income stream is less predictable. In addition, the data analysis targets a highway project with a capital subsidy provided by the government. To strengthen the effectiveness of the proposed determination process, further research should apply the model to PPPs with other kinds of government support. Originality/value The concession period for a PPP project is an important parameter and it is a common practice for governments to predetermine the length of the concession period before inviting tenders. The existing models for determining the concession period focus too much on the simulation of NPVs for project parties and neglect the importance of risk allocation in signing and maintaining a long-term contract. There is also a lack of research to evaluate the influence of governments’ preferences on the length of the concession period. To overcome the limitations of the existing models and enrich the methodology for concession period determination, this paper contributes to the body of knowledge by developing a concession period determination process which can help governments to make better decisions. The financial risk is expected to be more evenly shared between governments and private investors with the concession period derived from the proposed process. This determination process is also capable of evaluating the influence of governments’ preferences on the length of the concession period.

Introduction. The article reveals motives of attracting foreign entrepreneurs to Soviet economy, difficulties with hiring local labor force in concessions, contradictions and solutions between Soviet organizations and concessioners. Relations between foreign entrepreneurs and Soviet government agencies as well as Soviet engineers and workers were regulated by the law. Methods and materials. The author uses the comparative historical method in the work, which makes it possible to compare the number of foreign and domestic labor in concession enterprises, to show the need of attracting foreign specialists to concession and state enterprises, to reveal the cooperation of foreign entrepreneurs with the Soviet state. Sources from The State Archive of the Russian Federation, The Russian State Archive of Economics and The Russian State Archive of Social and Political History were identified for the study. Regulatory acts of state significance (decrees, concession agreements) reflecting the policy of the state in relation to the economic activity of private capitalists; records management documentation (circulars, official correspondence, reporting documentation) covering the real state of affairs at concession enterprises allow to show the peculiarities of relations between Soviet state institutions and foreign entrepreneurs. Analysis. Sometimes concessioners did not meet the governmental requirements in labor force attraction, which caused mutual claims. The author also analyses hiring foreign professionals in Soviet state enterprises because of their important contribution to the Soviet economy recovery and development. Foreign professionals were involved in the production process organization and local labor force education at Kuznetskiy coalfield minery, Stalingrad tractor factory and other state enterprises. Concessions were equipped with brand-new techniques and technologies and were also involved in the local labor force education. Results. The article analyzes the reasons of early cancellation of contracts by foreign professionals and workers and their mass departure from the USSR in the 1930s – 1940s. For example, prosecution and custody for industrial accidents were among of such reasons. Despite this, new foreign engineers were forbidden to enter Sakhalin island by Soviet authorities. The article focuses on the correlation between the deterioration of the international situation from the middle 1930s and existence of Japanese concessions in the USSR until the middle 1940s.The author pays a lot of attention to investigate the issue of obeying to the Soviet labor law by concessioners using unpublished archived documents.

Abstract. The systematic development of British Concession in the 19th century had a profound impact on the development of cities in the history of modernization in East Asia. To find out the relevance of the urban management system of the British concession and the process of urban modernization between different cities in East Asia, this paper combs the development process of land allocation and urban management in the early British concession by using the land regulation. It focuses on the specific case of the 1866 land regulation promulgated by the British concession in Tianjin from the perspective of colonialism and the construction and management system of the East Asian British concession. It analyses the historical background and influence, then further explores the reasons for its promulgation. This finding can fill part of the vacancy in the history of urban development and play an important role in the development of contemporary urban construction in East Asia as reflection and reference.

Demand for the construction of retirement villages is increasing with the worldwide growth in ageing populations. However, the development of retirement villages can be impeded by many factors, such as limited available land and high investment costs. Public–private partnership (PPP) as an alternative financing mechanism has been widely applied in the construction of public infrastructure projects and may provide new funding sources for building retirement villages. By applying PPP to the construction of retirement villages, the independent living requirements of seniors can be met and the financial difficulty of the construction of retirement villages can be resolved. Similar to other PPP projects, when retirement villages are constructed under a PPP process, the concession period is a key decision variable in relation to the success of the project. The concession period is stated in the project contract between the government and private investors, and stipulates the date when the project ownership and operation are transferred from the private investor back to the government. The government should take detailed information into consideration at the initial project stage when determining the concession period. This paper proposes PPP as a new procurement method to be applied to the construction of rental retirement villages and develops a concession period determination process for PPP retirement village projects with consideration of real options, focusing on the option to defer. An empirical example with alternative scales, which is developed from an existing retirement village in Geelong, Australia, is used to numerically verify the process and the impacts of key variables on the concession period. The determination process provides an alternative tool for governments to design the concession period before the tendering stage and will benefit the development of industries associated with services for the ageing population. This process can also be applied to the construction of other financially non-viable PPP projects such as social housing.

This research has focussed on the development of a commercial business model (CBM) for providing tourism and support service based commercial activities in Victoria's national parks which also allowed for the protection of the parks natural values. National parks are vital if we as a nation are to retain our natural heritage - but the public sector land stewards of these important assets are facing increasing funding and user pressures. The result is a growing focus on the commercialisation of our national parks to provide services and generate the revenue required to maintain these assets. However, this has resulted in the exacerbation of a long existing conflict - these commercial operators are primarily focus on the achievement of a commercial return, while the land stewards' main responsibility is in the protection of the natural values of these assets. In completing this project an abductive research approach (using grounded theory) has been adopted. Specifically, the research activities undertaken included data collection via a number of techniques including stakeholder interviews, detailed examination of existing commercial arrangements, literature research on international approaches and models, development of a suggested commercial business model based on a synthesise of the research outcomes and, finally, obtaining user feedback. The use of the various data sources, and subsequent sourcing of user feedback facilitated the triangulation of the research results. The findings from this research challenge a number of the practices currently adopted in the structuring of commercial activities suggesting that these practices are inhibiting the quality of the service being provided to the national park visitor along with the level of protection being afforded to the parks natural values. The resulting CBM provides park managers with a framework for identification and structuring of commercial business activities, practical guidance on the actions required in the completion of a concession process and identification of a number of the relevant issues which need to be considered and addressed in establishing and managing a national park concession. The CBM has been developed specifically for application within Victoria's national parks (based on a public/private sector relationship). The output will also provide guidance on methods for embedding natural values on public/private sector relationships in other settings.

The aim of this article is to assess the role of Brazilian Court of Auditors - TCU and itspossible intervention in regulatory matters in view of public service concession processes.In order to structure a concession it is necessary the production of feasibility studies bythe regulatory agency and subsequently edit the bid invitation and its annexes, which willbe the cornerstone for the bid. Regulatory decisions are reflected in those documentsduring the structuring phase. According to legal requirement this documentation shall beapproved by TCU for effective concession implementation and that raises the doubt if theCourt must analyze the regulatory issues contained in it. With the aim of clarifying thisstir an empirical study was carried out with three regulatory agencies from the logisticssector: National Railroad Transportation Agency - ANTT, National WaterwayTransportation Agency - ANTAQ and National Civil Aviation Agency - ANAC. Thisarticle evaluated 40 judgments issued by TCU for the current concession structuring inthe herein mentioned sectors. The purpose was to verify if any deliberation from thisCourt has the power to intervene in regulatory subjects in which therefore the decisionmakingshould rely on the regulatory agency.
O presente trabalho visa analisar a atuação do Tribunal de Contas da União (TCU) e sua possível intervenção em matéria regulatória, nos processos de concessão de serviços públicos. Para a estruturação de uma concessão é necessário que a agência reguladora produza os estudos de viabilidade e, posteriormente, publique o edital e seus anexos que servirão de base para a licitação. Durante a fase de estruturação ficam refletidos nesses documentos decisões de caráter regulatório. Por imposição legal, essa documentação precisa ser aprovada pelo TCU para a efetiva implementação da concessão. Surge então dúvida sobre se poderia a Corte de Contas intervir nas questões regulatórias ali contidas. Para esclarecer tal questão, foi realizado um estudo empírico nos processos de concessão de três agências reguladoras do setor logístico: Agência Nacional de Transportes Terrestres (ANTT), Agência Nacional de Transportes Aquaviários (ANTAQ) e Agência Nacional de Aviação Civil (ANAC). Neste trabalho foram avaliados quarenta acórdãos do TCU emitidos para a estruturação de concessões atualmente em vigor, nos referidos setores. O intuito foi verificar se alguma determinação dessa Corte de Contas teve o condão de intervir em matérias de caráter regulatório e que, portanto, deveriam ficar na alçada decisória da agência reguladora.

Mining or industrial activity? This is not only an ancient question in Peruvian mining sector but a key issue for domestic and foreign private investment on cement. Since few years ago, cement manufacturing process has been being qualified and regulated by the Peruvian Mining Authority as a mining benefit process which implies the obligation to obtain a benefit mining concession previously. However, upon a review of the technical process aspects, the legal framework in force and a recent judgment enacted by the Constitutional Court of Peru regarding this topic, the position traditionally assumed by the Ministry of Energy and Miningcould be reconsidered.
¿Es actividad minera o industrial? Ésta no es solo una antigua interrogante en el sector minero peruano sino una cuestión clave para la inversión privada local y extranjera del rubro cementero. Desde hace algunos años, la producción de cemento ha venido siendo calificada y regulada por la autoridad minera como beneficio minero, lo cual importa la obligación del titular de obtener previamente a la ejecución de la misma una concesión de beneficio. Sin embargo, a partir de una revisión de los aspectos técnicos del proceso, el marco normativo vigente y un reciente pronunciamiento del Tribunal Constitucional en relación a este tema, la tradicional posición adoptada por el Ministerio de Energía y Minas podría ser repensada.

Sweden has a goal of having an electricity production solemnly comprising renewable energy sources by the year 2040. To cater for the fulfillment of this goal, more onshore wind power will be needed in Sweden. The wind farm itself has been studied both in terms of its impacts on societal and environmental interests as well as how the Swedish spatial planning system paves the way for more wind power or not. The connection of wind farms to the regional and national transmission grid is far less studied. Therefore, this thesis explores the grid connection process and how it is experienced by the practitioners in terms of wind power developers and network operators. Also, the ways in which the power grid is taken into account when finding a location for a wind farm is studied. This is done by a literature review and a thematic analysis of ten conducted interviews. The grid connection process is presented, along with the four main themes identified by the thematic analysis; Making two long processes parallel, The importance of grid capacity, Dialogue between the developer and the network operator and Proactive consideration of grid connection. The results suggest that the grid connection process, in combination with the wind farm development, is experienced as time-consuming, which gives rise to problems regarding technology development and puts the finalization of the entire project at risk. Consequently, the practitioners want to make the processes more parallel. This is however complicated by the associated risks of not being reassured grid capacity and inflexible permit procedures. Another important result is that the network operators and developers often have different interests to guard, which can complicate the grid connection process further. The available capacity in the grid is crucial when locating a wind farm, but also the economic distance to the point of connection, which in turn depends on several parameters. It is suggested that consideration of the power grid should be more integrated with the spatial planning in Sweden. This can improve the predictability of wind power planning, promote adequate power grid planning and facilitate the Swedish goal of an electricity production only comprised of renewable energy by 2040.
För att genomföra en grön omställning av Europas energisystem väntas mer elproduktion av förnyelsebar energi integreras. Sverige har som mål att ha en elproduktion som enbart består av förnyelsebar energi till år 2040. För att åstadkomma detta mål förväntas andelen vindkraft i landet att öka. Att ansluta till elnätet hör till en av de fundamentala nödvändigheterna för att etablera en vindkraftpark. Trots detta så är planering och utförande av nätanslutning till det svenska elnätet en förbisedd del av processen för att etablera vindkraft i Sverige. Syftet med denna studie är därför att undersöka anslutningsprocessen för landbaserad och storskalig vindkraft och bidra att till ökad kunskap kring hur denna process upplevs av utövarna. Dessutom undersöks det hur vindkraftsprojektörer tar hänsyn till elnätet när de letar områden för vindkraft. Detta görs med en litteraturstudie angående hur anslutningsprocessen går till, följt av en tematisk analys av intervjuer med nätägare och vindkraftsprojektörer. En övergripande bild av anslutningsprocessen och relaterad litteratur presenteras. Fyra huvudteman identifieras från den tematiska analysen; Att göra två långa processer parallella, Signifikansen av nätkapacitet, Dialogen mellan vindkraftsprojektör och nätägare och Proaktiv hänsyn av nätanslutning. Resultaten visar att en stor utmaning med anslutningsprocessen är att den tillsammans med utvecklingen av vindparken upplevs som så pass långdragen i tid, att problem uppstår med teknikutveckling och genomförandet av projektet i sig. Detta bidrar till att vindkraftsprojektörer och nätägare vill försöka göra processerna för utveckling av vindparken och nätanslutningen mer parallella. Att processen för att utveckla vindparken är tidskrävande och osäker bidrar till att den nödvändiga nätkapaciteten inte alltid kan garanteras, vilket försvårar en synkronisering av processerna. Ett ytterligare viktigt resultat är att nätägare och vindkraftsprojektörer ofta har olika intressen under nätanslutningsprocessen, vilket kan komplicera dess förlopp. Var det finns nätkapacitet är en stor faktor vid lokalisering av vindkraft, men även det ekonomiska avståndet till en anslutningspunkt som i sin tur beror på flera parametrar. Elnätsfrågan är komplex både när det gäller lokalisering och anslutning av vindkraft. Men för att skapa goda förutsättningar för mer vindkraft i Sverige, och för uppfyllandet av målet till 2040, bör elnätsfrågan hanteras proaktivt och integreras mer i den fysiska planeringen i Sverige.

This work aims to verify the material truth principle in the administrative procedure for granting disability benefit (sickness and disability retirement pension both) as well as checking the principle of real truth in the judicial process for the same benefits. The intention is to note that the Administrative sphere the process for granting benefits, follows own principles, whose forecast is in the Law of Administrative Procedure. Upon completion of the medical report issued the decision is yet to be taken into consideration characteristics and principles of public administration to better consider the application of the principle of real truth. Already in judicial headquarters for the granting of sickness or disability retirement under the principle of real truth can possibly be interpreted more broadly by the judge, taking into account that apply to judicial proceedings, not only constitutional procedural principles, but strictly procedural principles applicable to pension harvest. After medical-legal experts, the court issues a move that meshes the interpretive act, multidimensional effects, with expert verification, which conceives better application of the principle of real truth. At the end we observe the effects of the application of the principle of real truth in the judicial process, and jurisprudential that is generated due to the interpretation of the judge tract
A presente dissertação tem por objetivo verificar o princípio da verdade material no processo administrativo para concessão de benefício por incapacidade (auxílio-doença e aposentadoria por invalidez, ambos previdenciários); e verificar o princípio da verdade real no processo judicial para os mesmos benefícios. A intenção é observar que, na esfera administrativa, o processo para concessão de benefícios segue princípios próprios, cuja previsão encontra-se na Lei de Processo Administrativo. Após a realização da perícia médica, a decisão é emitida; contudo, devem ser levados em consideração características e princípios próprios da administração pública que melhor consideram a aplicação do princípio da verdade real. Já em sede judicial, a concessão de auxílio-doença ou aposentadoria por invalidez, à luz do princípio da verdade real, tem possibilidade de ser interpretada de forma mais ampla pelo juiz, levando em consideração que são aplicáveis ao processo judicial princípios não somente processuais constitucionais, mas também processuais, estritamente aplicáveis à seara previdenciária. Após a perícia médica judicial, o juiz emite decisão em que se coaduna o ato interpretativo e os efeitos multidimensionais com a verificação pericial, o que concebe melhor aplicação do princípio da verdade real. Ao final, observam-se os efeitos da aplicação do princípio da verdade real no processo judicial e a jurisprudencialização, que é gerada por conta do trato interpretativo do juiz

A ideia central desse estudo tendo como problemática de partida a identificação se ocorre a percepção por parte dos atores sociais em relação ao processo de privatização da água e de que forma ocorre. Buscou-se observar as possíveis alterações sociais do cotidiano local. Sustenta-se o assunto na preocupação mundial que se tem em relação a água e sua gestão, uma vez que o acesso a água potável é um direito humano essencial para vida, necessitando ser preservado e universalizado. A centralidade da tese está na percepção dos sujeitos. Destaca-se que a chamada privatização, é um processo de concessão da água por meio de licitação pública. Para verificar a problemática utilizou-se de material documental e a pesquisa empírica. O estudo constatou que, a partir dos dados colhidos, a ideia de que não haja percepção do processo não é, em nada, evidenciada. A hipótese inicial do trabalho não foi comprovada. A percepção existe, sim, e pode ser não favorável, como verificado com mais intensidade em Cochabamba, ou mais favorável, como se é o caso de Uruguaiana. Para a concretização do estudo, realizou-se uma exposição documental sobre o processo de privatização da água ocorrido em Cochabamba na Bolívia e a sua recepção pelos atores e também no Brasil, optando-se em realizar a pesquisa em Uruguaiana (em dois momentos 2012 e 2013), pois foi o primeiro município do Rio Grande do Sul em que ocorreu a concessão da água para uma empresa privada. Em Uruguaiana constatou-se a existência de percepção e de um consenso entre os atores com a satisfação e melhoria da qualidade da água e serviços prestados pelo gerenciamento da água por uma empresa privada, sendo positivas as alterações sociais ocorridas até o momento, como a maior conscientização e participação social nas questões sociais, além de observar-se "in loco" a satisfação com a as políticas públicas realizadas pela administração pública municipal. Em relação a metodologia empregada foi por meio de uma pesquisa descritiva, exploratória e os dados coletados foram analisados qualitativamente.
The central idea of this study as having problems starting if the identification is the perception on the part of social actors in relation to the privatization of water and how it occurs. We attempted to observe possible changes every day social site. It is held on the subject worldwide concern that has been compared to water and its management, as access to clean water is a human right essential to life and needs to be preserved and universalized. The central thesis is the perception of the subject. It is noteworthy that the called privatization process is a water concession through public bidding. To verify the problem was used documentary material and empirical research. The initial hypothesis of non-perception process is not sustainable from the data collected. There is a perception of the process, and this perception goes in two ways: in Cochabamba the perception of the process is a negative perception, while in Uruguaiana there is a favorable perception of the privatization process that is occurring. In carrying out the study, there was a documentary exhibition on the process of privatization of water held in Cochabamba in Bolivia and its reception by the actors and also in Brazil, opting in to search on Uruguaiana (on two occasions in 2012 and 2013) because it was the first city of Rio Grande do Sul in which occurred the water concession to a private company. In Uruguaiana found the existence of perception and consensus among stakeholders with the satisfaction and improvement of water quality and services provided by water management by a private company, with positive social changes yet occurred, as the largest awareness and social participation in social issues, and observed "in situ" satisfaction with public policies carried out by municipal government. Regarding the methodology used was through a descriptive, exploratory and the data collected were analyzed qualitatively.

O crédito hipotecário abrange créditos destinados à aquisição, construção, arrendamento e/ou manutenção de habitação. O modelo de scoring permite distinguir os bons e maus créditos, através do perfil de risco dos clientes, seguindo-se a decisão de conceder ou não crédito. O objetivo deste trabalho foi desenvolver um processo de monitorização aplicado ao modelo de scoring de crédito hipotecário para concessão da Caixa Geral de Depósitos. O propósito desta monitorização é verificar se o modelo, implementado em junho de 2018, mantém uma boa capacidade preditiva. Em particular, pretende-se verificar a fiabilidade do modelo, as suas características discriminantes, a sua performance, entre outros. Adicionalmente, esta monitorização tem como objetivo realizar atualizações no modelo e, em casos extremos, o desenvolvimento de um novo modelo.
Mortgage credit includes credits for the purchase, construction, lease and/or house maintenance. The scoring model makes it possible to distinguish between the good and bad credits, through the risk profile of customers, and then make the decision on whether grant or not grant credit. The objective of this work was to develop a monitoring process applied to the mortgage credit scoring model for the granting of Caixa Geral de Depósitos. The purpose of this monitoring is to verify whether the model, implemented in June 2018, maintains a good predictive capacity. In particular, it is intended to verify the model's reliability, its discriminating characteristics and its performance, among others. Additionally, this monitoring aims to make updates the model and, in extreme cases, the development of a new model.

Esta pesquisa desenvolveu-se em uma instituição financeira e teve por objetivo propor um modelo de gestão de riscos para o processo de concessão de financiamentos imobiliários. Adotou-se o método de pesquisa de estudo de caso e abordagem qualitativa e quantitativa. A fundamentação teórica envolveu o Acordo de Basileia e a tipologia de risco no âmbito bancário, as diretrizes para a gestão de riscos no Sistema Financeiro Nacional, normas de referência em gestão de riscos e maturidade, compliance e gestão de processos. A análise do processo e dos dados possibilitou identificar várias ineficiências para as quais foram apresentadas sugestões de melhoria. Vários riscos foram identificados, analisados e avaliados. Foi sugerido novo modelo para o processo que considerou, além do escopo mais amplo, o desenvolvimento de sistema de informação para o qual foram elicitados vários requisitos funcionais e não funcionais. Foram propostas diretrizes para mitigar os riscos do processo de concessão de financiamento imobiliário e aumentar a eficiência da gestão. Por fim foi proposto um modelo de alto nível para a implantação da Gestão de Riscos. ____________________________________________________________________________________ ABSTRACT
This research was developed in a financial institution and aimed to propose a model of risk management to the process of granting mortgages. We adopted the method of case study research and qualitative and quantitative approach. The theoretical framework involved the Basel Accord and the typology of risk in banks, the guidelines for the management of risks in the financial system, reference standards in risk management and maturity, compliance and process management. Process analysis and data enabled us to identify several inefficiencies for which suggestions for improvement were presented. Various risks were identified, analyzed and evaluated. New model for the process considered in addition to the broader scope, the development of information system for which various functional and non-functional requirements are elicited was suggested. Guidelines have been proposed to mitigate the risks of granting mortgage process and increase management efficiency. Finally we propose a high-level model for the implementation of Risk Management.

A existência de controles internos efetivos é fundamental para a adequada mitigação dos riscos presentes nas atividades das instituições financeiras. As regras prudenciais estabelecidas nos Acordos de Basiléia, na Lei Sarbanes Oxley e, no Brasil, pelo Conselho Monetário Nacional, têm orientado os gestores quanto às boas práticas que devem adotadas para estabelecimento e manutenção de um sistema de controles internos efetivo. Todavia, independente dos marcos regulatórios, as organizações devem considerar que o adequado controle dos riscos é uma ferramenta essencial para a sua própria gestão e sobrevivência. Neste contexto, o objetivo deste trabalho foi identificar os controles internos aplicados pelo Banco Nacional de Desenvolvimento Econômico e Social - BNDES no seu processo de concessão de crédito, por meio de uma pesquisa exploratória na documentação de processos desta instituição, direcionada para um dos seus principais produtos: o BNDES Finem, na modalidade direta. Os resultados indicam que os controles internos estão constituídos com base em princípios essenciais, como segregação de funções, definição de responsabilidades, padronização de informações e normatização interna.
The existence of effective internal controls is fundamental to adequate mitigation of the risks present in the activities of financial institutions. The prudential rules laid down in the Basel Accord, the Sarbanes Oxley Act and, in Brazil, the National Monetary Council, have guided managers on good practices that should taken to establish and maintain an effective system of internal controls. However, regardless of regulatory frameworks, organizations must consider the appropriate risk control is an essential tool to their own management and survival. In this context, the objective was to identify the internal controls applied by the National Bank of Economic and Social Development - BNDES in the process of granting credit, through an exploratory process in the documentation of this institution, directed to one of its main Products: BNDES Finem, in direct mode. The results indicate that internal controls are established based on principles such as segregation of functions, defined responsibilities, standardization of information and internal standardization.

There is a tendency to view R2P diffusion in the Asia Pacific region as a function of ‘norm containment’, which explains endorsement of R2P as a result of the weakening, deconstruction, or dilution of R2P to render it more compatible with the region’s state-centred security norms and practices. This chapter demonstrates, however, that R2P has diffused in the Asia Pacific region through a dynamic process of negotiation and compromise between international R2P norm advocates and Asia Pacific actors, which has witnessed concession and accommodation on both sides. Through case study analysis of how the governments of Japan and India have engaged with R2P, the chapter argues that the Asia Pacific’s socialization to R2P is most aptly characterized as a balance of R2P norm containment and localization, witnessed in Asia Pacific actors shaping the contours of the R2P norm and accommodating its prescriptions through gradual, incremental normative and institutional change.

The division of Indian and other South Asian markets among the various European nationalities led to vital changes of territorial sovereignty. The corresponding process of commercial, political, and military manoeuvering was accompanied by treaty making which formalised the initial power positions, and the relevant clauses and stipulations reflected the consecutive stages of the struggle. As soon as some of the European powers or agencies obtained from their Asian counterparts preferential treatment coupled with prohibitions directed against other European nationalities, all of them plunged into retaliatory practices, each attempting to secure the maximum of concessions or the establishment of a monopoly for itself. This chapter examines the various discriminatory or prohibitory clauses included in some treaties and the type or pattern of stipulation adopted by the contracting parties.

This chapter examines the various forms of conservative resistance used by slaves in Florida and often elsewhere within the slave empire of the United States. William Dusinberre called these types of actions or inactions nonviolent “dissidence.” Indeed, bondservants actively, though discreetly, resisted their owners on a day-to-day basis. In doing so, many slaves believed that they could either get away with their recalcitrance or use it to negotiate concessions from their masters. Since enslaved blacks knew that violent attacks could mean immediate death, they naturally and intelligently sought other means of expressing their discontent concerning plantation or farm regimens. Sometimes they made life uncomfortable for their masters, and sometimes, in the process, they made life uncomfortable for themselves.

A democratization process might open up opportunities to launch a cycle of protests, and the movement’s great mobilization capacity might create opportunities for it to survive. However, these openings might not be enough to reach significant concessions. Opportunities for success depend on whether negotiations with insurgents are included in democratizing pacts among political elites. To illustrate these arguments, the chapter provides an account of the development of the Zapatista movement from its public emergence in 1994 through 2003. This time frame contextualizes the movement within Mexico’s democratic transition. The chapter closes with an overview of the organization of the book.

Theories of just peace have remained understudied in international law and peace studies. This chapter introduces major themes of the book and traces the role of peace and justice in just peace discourse. It identifies different approaches towards just peace in three fields: just war theory, peacebuilding practice, and transitional justice approaches. It argues that just peace is more than ‘just a peace’, namely a stable peace with justice, but at the same time highly dependent on relational and discursive dimensions. It requires negotiation, recognition, and implementation and involves concession or compromise from parties. It is not only related to form and process, but connected to different dimensions of justice (retributive, procedural, restorative, and distributive justice) which need to be adjusted to the context of transitions from conflict to peace. Peace must be perceived to be fair and just.

This chapter establishes a framework for the governance of intermodal terminals throughout their life cycle, based on the product life cycle. The framework covers the initial planning by the public sector, the public/private split in funding and ownership, the selection of an operator, ensuring fair access to all users, and finally reconcessioning the terminal to a new operator, managing the handover and maintaining the terminal throughout its life cycle. This last point is especially important as industry conditions change and the terminal's role in the transport network comes under threat, either by a lack of demand or by increased demand requiring expansion, redesign and reinvestment. Each stage of the life cycle framework is operationalised based on empirical examples drawn from research by the authors on intermodal terminal planning and funding, the tender process and concession and operation contracts. In future the framework can be applied in additional international contexts to form a basis for transport cost analysis, logistics planning and government policy.

Concession behavior is typically seen in bargaining processes, e.g. in intergovernmental negotiations. In traditional bargaining theory, especially in game-theoretic models, concessions to opponents are interpreted as actions in which the conceding party looses face. In this article, we propose a new approach to bargaining: peer coordination. Rather than loosing face on conceding to opponents, focal governments will increase their reputation among peers when adjusting to the present positions of the peers. Relying on a data set on the EU Intergovernmental Conference of 1996 which led to the Amsterdam treaty, we test and corroborate the hypothesis that a peer coordination model which assumes peer coordination in intergovernmental policy networks makes better predictions for negotiation outcomes than a random model which we interpret as a kind of null model.

This chapter discusses the reception of the ECHR in Austria and Switzerland. Topics covered include the accession and ratification of the ECHR in both countries, the status of the ECHR in national law, an overview of the activity of the European Court of Human Rights, and the ECtHR's case law and its effects on the national legal order. Although both countries joined the ECHR at a relatively early stage, this starting position led to different outcomes. The main reason is because the common denominators of neutrality and federalism in these two countries are actually rather small: as Austria follows a very different concept of neutrality, it did not face any (political) difficulties before and during the ratification process. Switzerland, on the other hand, was very reluctant to join the Council of Europe and careful to avoid any concessions with regard to neutrality.

This chapter reports a set of experiments that consider people’s appraisals of specific policy compromises in Congress, focusing on whether people like compromises less once they understand what types of policy concessions they entail. Drawing on recent congressional compromises on domestic violence legislation, education reform, and health-care policy, the experiments test whether people evaluate Congress and its policy outcomes differently when bills are represented as compromises where both sides made concessions in order to achieve policy gains. The results show that people are disappointed when they learn that a bill failed to pass due to members of Congress refusing to compromise. Members of Congress do not seem to be penalized for their support of compromise legislation. Policy compromises serve to boost the perceived legitimacy of the decision-making process, particularly among those who are ideologically opposed to the outcome.

This chapter establishes the main issues to be explored in this book, including the dramatic transformation that Sinn Féin and the IRA underwent. It provides a critique of existing explanations, arguing that they mistakenly assume the politics of Sinn Féin is driven primarily by the military capacity of the IRA. Existing explanations also assume that interplay between the British state and Irish republicans led to their moderation, but these explanations neglect the wider institutional context in which republicans chose to change their strategy. In contrast, this chapter sets out the argument that sustained contact with, and inclusion in, key political processes, namely party politics and a consolidated framework of democratic institutions, extracted moderate concessions from republicans in a gradual and path-dependent process.

Sustainable infrastructure demands that declared principles of sustainability are enacted in the processes of its implementation. However, a problem arises if the concept of sustainability is not thoroughly scrutinized in the planning process. The public interest could be undermined when the rhetoric of sustainability is used to substantiate a proposed plan. This chapter analyses the manifestation of sustainable development in the Boggo Road Busway Plan in Brisbane, Australia against the sustainability agenda set in the South East Queensland Regional and Transport Plans. Although the construction of the Busway was intended to improve public transport access in the region, its implementation drew significant environmental concerns. Local community groups contested the ‘sustainability’ concept deployed in Queensland’s infrastructure planning. Their challenges resulted in important concessions in the delivery of the Busway plan. This case demonstrates that principles of sustainable infrastructure should be measurable and that local communities be better informed in order to fulfill the public interest in regional planning.

Abstract Since the implementation of the Drilling Performance Department in late 2017, ADNOC Offshore has been able to develop a company performance-oriented culture among the drilling teams. This performance culture is reflected in 25% ILT reduction in 2018 and 12% in 2019. Furthermore, 37 NPT RCA cases were investigated and concluded in 2019, which resulted in 57 actions for tracking and closure. With 5 (five) concessions, 9 (nine) different shareholders, and 39 (thirty-nine) rigs, drilling performance management is challenging. ADNOC Offshore created a centralized Drilling Performance Team to capitalize on this diversity as an opportunity to improve the traditional drilling performance role. This paper describes the team's approach on Drilling Performance and the consecutive result. The team enhances the typical drilling performance role of Key Performance Indicator (KPI) management and reporting by adopting the Performance Opportunity Time (POT) and Root Cause Analysis (RCA) Process. At the same time, the Drilling Performance Team facilitates the flow of information between teams to ensure effective knowledge transfer within such a large organization. The POT concept tackles the well duration reduction through the reduction of Invisible Lost Time (ILT) and Non-Productive Time (NPT). To reduce the ILT, the team took advantage of the extensive technical background in the various drilling teams. Performance improvement initiatives were proposed by taking references from different teams within ADNOC Offshore and evaluating the application in other concession. Other approach is to compare with out-of-company references. For NPT reduction, the innovative approach was to use the HSE Root Cause Analysis (RCA) concept. This RCA process led by the Drilling Performance Team was implemented to standardize the approach and have a systematic investigation analysis. This process resulted in identifying root causes and effective corrective action plans. As per HSE, addressing the root causes of incidents would result in the most significant impact in NPT. This approach also allows an independent and more detailed look on the subjects, where commonly these tasks are done in a limited manner by drilling teams alone with their ongoing operational workload. Finally, results are communicated to the drilling organization through lessons learned portal and technical bulletins.

Abstract Raven is the third stage of the West Nile Delta development (following Taurus / Libra and Giza / Fayoum) from two BP-operated offshore concession blocks, North Alexandria and West Mediterranean Deepwater. The Raven project included the design of various rigid pipelines, of which one specifically is the subject of this paper. The 16" RSM to RP in-field flowline is approximately 4.8 km long, connecting a manifold (RSM) to a PLEM (RP) through a route that crosses a prominent geological feature identified as the Rosetta Channel, a submerged canyon that extends for about 30 km. The Rosetta Channel is about 2.5 km wide at the location of the 16" flowline route crossing, with steep slopes going down for approx. 40m (in height) on the RSM side, and then climbing up approx. 150m (in height) towards the RP side. Although it is typically preferred to avoid very rough geophysical features, this is not always possible or practicable and it is not uncommon to come across challenging seabed features that demand complex engineering solutions in order to minimise risks and associated costs. This paper addresses the numerous technical challenges involved in the design of the 16" flowline that crosses the Rosetta Channel. Following close collaboration between all involved stakeholders, a robust, reliable and cost-effective solution was achieved after a detailed engineering process, where the final design required a unique combination of mitigations including seabed excavation, pre-lay rock carpets, post-lay rock berms, cable jetting, curve bollards and sleepers.

Since the 1990s, transport concessions, including public-private partnerships (PPPs), have been increasingly adopted by governments as an alternative for financing and operations in public investments, especially in transport infrastructure. The advantage pointed out by proponents of these models lies in merging the expertise and capital of the private sector to the public interest. Several arrangements are possible and have been employed in different cases. After the duration of the first PPP contracts in transportation, many authors have analyzed the success and failure factors of partnerships. The occurrence of failures in some stages of the process can greatly encumber the public administration, incurring losses to the fiscal responsibility of the competent bodies. This article aims to propose a new commercial consolidation model applied to transport infrastructure to ensure fiscal sustainability and overcome the weaknesses of current models. Initially, a systematic review of the literature covering studies on transport concessions between 1990 and 2015 is offered, where the different approaches between various countries are compared and the critical success factors indicated in the studies are identified. In the subsequent part of the paper, an approach for the commercial consolidation of the infrastructure concessions is presented, where the concessionary is paid following a finalistic performance model, which includes the overall fiscal balance of regional growth. The formerly public owned Brazilian Freight Rail System was under pressure in the middle nineties, mainly due to the revenue insufficiency, resulting from the government rate control policy and the inherent lack of investments, as well as the increasing funding requirements from the public budget. In this context, the system has been denationalized in the mid nineties, following a corridor format, with 11 regionalized concessions, with 30 year term contracts, running under a price-cap rate regime. The denationalization model has set contractual production and safety targets, which ultimately have indirectly set the required investments to comply with the contractual targets. The post denationalization scenario has allowed the rehabilitation of the former freight rail installed capacity, as a result of private investments on both rail network and rolling stock. The acknowledged freight rail system installed capacity recovery, followed by a profit guided management, have fostered the improvement of freight rail system’s performance, which ultimately have been translated into system’s production and safety enhancements. Albeit the huge advances observed during the first half of contract terms, there were some hurdles to be addressed, mainly the low interoperability/interchange rates, as well as the lack of greenfield investments, required for the necessary expansion of the Brazilian rail network. In this context, the regulatory authority has issued, in 2011, a rail regulatory package reform, focused on: i) interoperability improvement; ii) a widespread service coverage along the rail network (stretches production targets) and iii) a compilation of rail stakeholders (shippers and carriers) rights and obligations. The so called 2011 rail regulatory package has brought more transparency and equilibrium among shippers and carriers relationship, but has not addressed the lack of greenfield required rail investments, necessary to expand the freight rail share on Brazilian transport matrix. In this context, the Brazilian Government has proposed in 2012 the Freight Rail System Unbundling (Open Access Model), in which infrastructure managers would be in charge of providing rail capacity (with the guarantee of the demand risk covered by the Brazilian government) and granted rail operators allowed to operate on the network under a fee payment. However, the unbundled freight rail proposal has not evolved, mainly due to the lack of funding required to guarantee rail infrastructure managers return on investments, resulted from a strong fiscal crisis. Currently, the Brazilian Rail Regulatoy Authority is working on a proposal to extend the current (bundled) freight rail contracts, conditioned to contractual adjustments, focused on the imposition of mandatory investments for capacity improvement and interoperability enhancement. This work is supposed to present an overview of Brazilian Freight Rail System’s performance evolution since the denationalization process, followed by an assessment of the 2011 Rail Regulatory Reform, the 2012 Rail Unbunbled initiative attempt and the perspectives associated with the current freight rail bundled contract term extension proposal.

Abstract Unitisation has evolved globally as the best mechanism for the joint development of hydrocarbon bearing reservoirs that straddle two or more concessions or licenses. The concept of unitisation is underpinned by the need to avoid competitive exploitation of hydrocarbon resources, maximise its economic recovery, eliminate proliferation of production facilities and reduce development and operating cost.1 The practice of unitisation in the Nigerian oil and gas landscape has gained traction over the years with several straddle fields identified as candidates for unitisation and more than ten (10) agreements for joint development (both Pre Unitisation Agreements and Unitisation and Unit Operating Agreements) executed in the industry. This has occurred under a regulatory regime for unitisation that has evolved from the concise provisions of Section 48 of the Petroleum (Drilling and Production) Regulation 1969 as amended, to the robust Guidelines for Unitisation issued by the Department of Petroleum Resources (DPR) in 2008 (revised in 2019) (Guidelines) in response to the complexities of joint development encountered by parties. While the Guidelines is an excellent attempt at providing a process for unitisation, it does not provide sufficient guidance on the contract regime for unitisation as the bedrock for joint development. A critical look at the contracts governing joint development in the light of global best practices is important to ensure that it meets in an effective manner the objectives of unitisation. A review of the contract regime for unitisation would be incomplete without recognising the impact that underlying contracts governing separate concessions have on unitisation. To this end, the posture of Production Sharing Contracts (PSCs) on gas development in a unit is worth reviewing in the light of the benefits of commercialising gas to the State and the Contractor. This paper reviews the contract regime for unitisation in Nigeria as regulated by the Guidelines and the impact that underlying contracts (particularly PSCs) have on unitisation. The paper will proffer recommendations for inclusion in the Guidelines with a view to improving the process of joint development of shared reservoirs in Nigeria.

Suction piles are widely used in deepwater engineering both for anchoring and as foundation systems. In the first case the piles serve as anchor points for mooring systems in alternative to more standard drag anchors or piles. More recently, however, they have been used as structure foundations. In this role suction piles are a competitive alternative to the more traditional solutions of driven piles or mudmats, for platform jackets, subsea systems and subsea equipment protection structures. This solution provides cost savings in fabrication and required installation equipment. Furthermore, the foundations are relatively easy and rapid to install and can be positioned with high precision by controlled and simple marine operations, and they can be removed for reuse. This paper describes the use of steel suction piles for deepwater subsea Manifolds, Tie-in Spool Bases and Subsea Control Distribution Assemblies, in the West Delta Deep Marine (WDDM) and Rosetta concessions offshore Egypt. Most of the structures were supported by a single suction pile foundation; pile diameters ranged from 4 m to 8 m and penetrations from 8 m to 12 m. One of the larger units was supported by a “quad” foundation frame with four suction piles. Soils in the area are very soft, normally consolidated clays typical of deepwater conditions. Design is complicated by seismicity of the area, which required the foundations to resist significant horizontal dynamic loads in addition to the normal vertical operating loads. The solution adopted utilized an internal top plate in contact with the soil allowing full development of base bearing capacity. As the pile skin friction in these soils is very low, the increased end bearing leads to significant savings on foundation weight and cost. The paper discusses the main aspects of foundation design, covering the installation process with expected self weight penetration and the required suction to achieve the target design penetration, the retrieval operation for repositioning in case the final inclination is out of tolerance, the assessment of the bearing capacity and the stability under the combined vertical, horizontal and overturning loads during operation and earthquake conditions. Seismic design was based on a nonlinear dynamic analysis. In some cases the seismic loads were comparable to the ultimate foundation capacity and the final acceptance criteria utilized a Performance Based Design philosophy. In this approach the foundation is considered acceptable if the deformation experienced by the structure, during and after the seismic event, does not jeopardize structural integrity.

Based on the study, a number of changes to Russian laws have been proposed. First of all, this applies to a commercial concession contract. The author proposes to amend the Civil Code of the Russian Federation by supplementing the article on commercial concession with the right of organizations that do not conduct commercial activities to conclude the same contracts on a general basis. The appropriateness of applying the classification of transactions into real and consensual ones in relation to this contract is justified. The peculiarities of transfer of the complex of exclusive rights to objects of industrial property with participation of social enterprises under the legislation of the Russian Federation are studied.
