People who file complaints against the police tend to experience objectively unfavorable outcomes, for most complaints are not sustained. But features of citizen oversight might be expected to enhance the procedural justice of the complaint review process and, hence, provide positive subjective experience despite the outcomes. Using data collected through interviews with complainants about their experience with complaint review in a city that provides for citizen oversight, we examine the factors associated with complainants’ subjective experiences. We find that complainants’ subjective experiences are shaped mainly by outcomes, while features of the process that might be expected to enhance its procedural fairness have little or no effect on complainants’ judgments.

This study takes a critical perspective in examining public attitudes towards police stop-and-search powers and, more particularly, police misconduct. It shows how police accountability works through the formal and complex system of complaints against police. It shows a system designed to favour the police against the citizen. In the eyes of some citizens this has tended to reduce the legitimacy of the complaints process, which has led to its under use. Certain police practices and services appear to impact more on diverse sections of the public than it does on the white community. It shows how aberrant police behaviour exposes some of the sociological issues such as black over-representation in public dissatisfaction and complaint statistics. The research also highlights the hidden figure of police deviance and misconduct. This study acknowledges future changes in complaints management proposed by the Home Secretary, David Blunkett MP. However, these proposals do not appear to go far enough. The complaints process is beset with a number of significant problems which include inaccessibility, complication and inequality. The study suggests, as the way forward, a model of ‘good practice’ using a pragmatic approach, which is customer-focused and overcomes many of the problems that allow for easy access, simplification and informality. The principle of civil libertarian ideals prevails, satisfying the legal notion, ‘justice must not only be done but must be seen to be done’.

Purpose – The purpose of this paper is to investigate the factors which contribute to, or mitigate against, both the likelihood and timing of the onset of police misconduct. Design/methodology/approach – Research hypotheses were tested examining the first personnel complaint filed against officers, using both all complaints and only substantiated complaints, from data collected on a large cohort of officers followed over a substantial portion of their careers. Findings – Black officers and those exhibiting poor academy performance were at an increased likelihood of onset when compared to white and Hispanic officers and those who did better in the academy, while having a college degree lowered this likelihood. Officers whose first complaints were filed by citizens, and officers working certain patrol zones had quicker onset times. Those officers whose first complaint was related to service, as well as officers with prior military service, had longer onset times. Research limitations/implications – This study relies on personnel complaints to measure onset, was conducted in a very large police department, and does not include arrest data on officers over time. Practical implications – Onset occurs early in officers’ careers. Some factors are consistent across complaint types, while others depend on whether all complaints or only substantiated complaints are used to measure onset, which suggests that future research should consider carefully which measure they employ. Originality/value – This study employs a longitudinal data set which follows a cohort of officers from the start of their careers, and is thus ideal for exploring the onset of misconduct.

Practitioners define the police complaints system of Hong Kong as a two-tier system. In this article, written at the request of the organisers of a 2014 Symposium, the international reform trend and purposes of police complaints systems are briefly outlined before examination of the Hong Kong system. A different conceptualisation is suggested to the one currently preferred by practitioners. It is observed that three organisations – the Independent Commission Against Corruption, the Complaints Against Police Office of the Hong Kong Police Force, and the Independent Police Complaints Council – share responsibility for handling complaints against the police. It is proposed that a full and comprehensive audit of the powers, duties and responsibilities of the three organisations that comprise this tripartite system, supported by research on the experiences of complainants, would provide an important evidence base for developing the system.

China does not have an independent police complaints system. Police services are under the control of local governments and police chiefs, and police chiefs have specific responsibility for the supervision of police complaints. Although traditionally the Chinese prosecutors have acted as independent supervisors in the more serious complaints against the police, they are still seen as part of the criminal justice establishment. Recent efforts to change the present system have proved ineffective and inadequate in a modernising and reforming China and there are now calls for an independent element to be introduced into the police complaints system in China. This article discusses the main issues involved and suggests a way forward.

Purpose The purpose of this paper is to empirically examine the relationship between police use of force and citizen complaints alleging improper use of force. Design/methodology/approach The current study utilizes official use of force and citizen complaint data, as well as surveys of patrol officers, from the Assessing Police Use of Force Policy and Outcomes Project, a multimethod National Institute of Justice funded study. Findings Bivariate and multivariate analyses revealed that the number of use of force incidents that officers were involved in, as well as the types and levels of resistance they encountered from citizens, was related to use of force complaints from citizens. That is, those officers that were involved in more use of force situations were engaged in force encounters where the highest level of citizen resistance was “failure to comply,” and faced higher cumulative levels of citizen resistance, received more complaints alleging improper use of force. Research limitations/implications Studies of citizen complaints against police officers, especially those alleging improper use of force, should consider the number of force incidents officers are involved in, as well as other theoretically relevant force correlates. Practical implications Administrators, concerned with citizen allegations for improper use of force against their officers, should work to encourage their personnel to minimize the number of use of force applications, or at least less cumulative force, to resolve encounters with citizens. Originality/value While prior studies have examined police use of force and citizen complaints independently, the current study examines the empirical connection between use of force behavior and the generation of complaints from citizens.

This study demonstrates the potential for using complaints data to identify and remedy misconduct problems in policing, and to reduce complaints. The study is distinctive in focusing on units of police management responsibility at the operational level. Drawing on the criminological concept of crime mapping, analysis of complaints was conducted at a more specific level than previously attempted, either in the subject jurisdiction or in published research on the topic. The study is also distinctive in attempting to control for the effects of different “task environments” — by comparing units of similar size and similar duties — and by comparing complaint patterns in terms of concentration and prevalence. A high concentration of complaints was interpreted as indicative of a problem with small numbers of individuals attracting a large number of complaints. A high prevalence was considered indicative of a more diffuse problem that might be associated with negative aspects of the workplace culture of a unit. The analysis found units in all possible combinations of concentration and prevalence of complaints. Out of 436 units, 38 had no complaints and 79 had either a high concentration or a high prevalence. Five units had a combination of a high concentration and high prevalence. A number of implications follow from these findings subject to more refined research. For example, cases of high concentrations of complaints might to be addressed with responses tailored to individual behavioural patterns. The issue of a possible negative culture should be addressed through reviews of management practices, with attention to issues such as supervision and staff morale.

Recent widespread protests and intensive media coverage of actual and alleged acts of police misconduct against members of vulnerable populations (e.g., Indigenous and racialized persons, mentally ill and/or addicted persons) overrepresented in the criminal justice system have renewed interest internationally in the factors influencing civilian complaints against police. In Canada, a major concern exists regarding how Indigenous persons who feel improperly treated by the police perceive and confront barriers to making formal complaints about such treatment. This study focuses on the Royal Canadian Mounted Police (RCMP), the police agency providing services to the majority of rural and northern reserve communities. Our survey and interviews with influential “community informants” (in this instance community court workers) with intimate knowledge of such local communities, shared culture and language, and vicarious appreciation of the experiences of community members support the view that Indigenous persons do encounter significant barriers to launching formal complaints and are consistent with other research literature. We discuss our findings, raise policy considerations for decision makers such as police leaders and police complaints bodies, and outline implications for future research.

Purpose From 2002 to 2014, the Portland Police Bureau reported large reductions in complaints against officers and use of force indicators. The purpose of this paper is to develop a case study to document these changes and explore possible influences. Design/methodology/approach The paper maps the changes in conduct indicators against the developing relationship between the Bureau and the Portland Independent Police Review Division, and changes in policies and procedures. Findings Public complaints reduced by 54.4 per cent, while the rate of specific allegations per officer fell by 70.1 per cent. Quarterly use of force incident reports were reduced by 65.4 per cent between 2008 and 2014. Annual average shootings decreased from a high of nine per year across 1997-2002 to just below four per year in 2009-2014. Fatal shootings also trended downward but remained two per year in the last three years on record. Reforms instituted during this period that may have influenced these trends include a more rigorous complaints process, an early intervention system (EIS), enhanced external and internal review mechanisms, policy changes and training initiatives. Research limitations/implications The researchers were unable to control for a range of additional variables that may have influenced the findings, including police deployments and changes in officer demographics. Practical implications The study provides support for strategies to improve police conduct including external oversight, diagnostic research, training focussed on de-escalation and minimal force, and complaint profiling and EISs. Originality/value There are very few studies available showing large long-term reductions in adverse police conduct indicators.

In a country where gender and development is promoted, professionals, educators, students, household and families must be exposed in the issues of Violence against Women and Children in the Philippines. Hence, this mixed method study determined the prevalence of domestic violence against women and children in the municipality of Malvar with an end goal of proposing extension service activities to minimize the problem of domestic violence in the municipality of Malvar. Specifically, it dealt with the following: the issues of violence against women and children in the municipality from 2014-2016, the police officers’ perspective in addressing such case, and the factors that drive the complaints to report such case. The data were obtained through the issues of violence reported in the women’s desk and interview of the two police officers and two random victims. By evaluating and analysing the information gathered, the researchers found out that the common factor that lead the complainant to report the case was the victim’s fear that even their children may experience violence from the husband. The results of the study also revealed that reluctance of the victims to pursue the complaints and the victims’ tolerance of abuse are the problems which boil down the culture. In connection to victims’ reluctance to pursue the complaint, problems like costly, lengthy litigation and corruption in the judiciary and prosecution exist. These problems discourage the victims in filing formal complains. In addition, there is no established national free legal aid program for financially challenged women. In line of the above cited problems, the researchers recommend that victims be referred to DSWD even if she does not file formal complaint. In instances when the victims chooses to go back to her abuser, consistent monitoring and counselling must be done to inform them of other remedies like that of Barangay Protection Order which is cheaper and readily available in barangay.

The use of body-worn cameras (BWCs) by the police is rising. One proposed effect of BWCs is reducing complaints against police, which assumes that BWCs reduce officer noncompliance with procedures, improve suspects’ demeanor, or both, leading to fewer complaints. We report results from a global, multisite randomized controlled trial on whether BWC use reduces citizens’ complaints. Seven discrete tests ( N = 1,847 officers), with police shifts as the unit of analysis ( N = 4,264), were randomly assigned into treatment and control conditions. Using a prospective meta-analytic approach, we found a 93% before–after reduction in complaint incidence ( Z = −3.234; p < .001), but no significant differences between trial arms in the studies ( d = .053, SE = .11; 95% confidence interval [CI] = [−.163, .269]), and little between-site variation ( Q = 4.905; p = .428). We discuss these results in terms of an “observer effect” that influences both officers’ and citizens’ behavior and assess what we interpret as treatment diffusion between experimental and control conditions within the framework of “contagious accountability.”

Existing research shows that distrust of the police is widespread and consequential for public safety. However, there is a shortage of interventions that demonstrably reduce negative police interactions with the communities they serve. A training program in Chicago attempted to encourage 8,480 officers to adopt procedural justice policing strategies. These strategies emphasize respect, neutrality, and transparency in the exercise of authority, while providing opportunities for civilians to explain their side of events. We find that training reduced complaints against the police by 10.0% and reduced the use of force against civilians by 6.4% over 2 y. These findings affirm the feasibility of changing the command and control style of policing which has been associated with popular distrust and the use of force, through a broad training program built around the concept of procedurally just policing.

Recent history shows that a significant number of citizens, internationally, are now seeking litigation against police agencies when law enforcement officers violate their civil rights. Often the events that precede complaints occur due to poor policy, training and early warning by law enforcement agencies. Hence, this study analysed past policies and training procedures that were in effect for the San Francisco, California Police Department (SFPD) during 1998, to determine if there was any liability of risk following evidence of officer misconduct. Mixed methodology, using a descriptive quantitative approach and based on a historical design, was used to determine whether or not the SFPD had appropriate policies, training, and control measures in place to minimise potential citizen complaints against officers that could have led to misconduct allegations and, ultimately, civil litigation. Results showed that SFPD policies, recruit and in-service training and early warning system measures resulted in a lower number of substantiated complaints of officer misconduct based upon clear policy, appropriate training, and deployed early warning system measures. Consequently, the findings suggested that the SFPD created a lower liability profile in respect to random versus non-random risks required in court to explain a department's position relative to their risk management of officer misconduct.

Purpose More than a half a dozen published studies have observed the effect of body-worn cameras (BWCs) on complaints against the police. Nearly all, with varying degrees of methodological sophistication, tell a similar story: a strong reduction in complaints filed against the police once BWCs are in use. However, the entirety of the published evidence comes from English speaking countries, limited to the USA and the UK, and is restricted to the effects of BWCs on response policing. The purpose of this paper is to extend this body of research to Latin America, and to specialized policing jobs. Design/methodology/approach The authors measured the consequence of equipping traffic police officers with BWCs in five out of the 19 traffic police departments in Uruguay (n=208), and compared these settings to both the pre-test figures as well as to the non-treatment departments. Interrupted time-series analyses and repeated measures of analysis were used for significance testing. Findings Statistically significant differences emerged between the before–after as well as the between–groups comparisons: complaints were five times higher in the comparison vs the treatment jurisdictions, and there were 86 percent fewer cases compared to the pre-treatment period. Research limitations/implications These outcomes suggest that the effect of BWCs on complaints is ubiquitous. Practical implications The findings indicate that BWCs provide an effective solution for reducing grievances against the police, which can potentially be a marker of increased accountability, transparency and legitimacy for the Latin American law enforcement departments. Originality/value This study is an extension of findings on BWCs to non-English-speaking police departments, with a focus on specialized policing rather than patrol policing.

This study aims to find out how the quality of complaints of acts of violence against children and women in the Central Kalimantan Regional Police PPA Unit. The method used is the Qualitative method, the research conducted was descriptive research in which the Central Kalimantan Regional Police PPA Unit was the research location. Data collection techniques use observation, interviews, and documentation. Based on the results of the study, the Quality of Handling Complaints on Violence Against Children and Women of the Central Kalimantan Regional Police PPA Unit is still not optimal, because of the five service quality indicators there are two indicators that have not run well, namely Tangibles, and Responsiveness while the three indicators that have gone well are reliability indicator, Assurance, and Empathy.

Twenty years after Ireland adopted an external supervisory board model to promote public confidence in the handling of complaints against the police (the Garda Síochána), it had to replace it with a cross between the Police Ombudsman for Northern Ireland and the Independent Police Complaints Commission in England and Wales. This paper examines the nature and scale of the board's failure and offers a critique of the internal and external factors responsible. It focuses, in particular, on how the police and the government, acting separately and in combination, managed to smother the potential of the supervisory board model. It also offers insights into how the board contributed to its own failure. The paper concludes by drawing attention to the fact that several of these negative forces can also be active in the new complaints procedure that commenced operations in 2007.

This paper examines the implementation process and impacts of an Early Intervention System (EIS) introduced into the New Zealand Police in 2013. The system was associated with large reductions in complaints of 72.5% against target employees ( N = 526), but without this clearly translating into reductions in the overall number of complaints. The New Zealand case also highlighted the issue of the different potential uses of early intervention. Should the priority be officer welfare or the more usual aim of improving officer conduct, police–citizen relations and public confidence in police? The authors argue that the traditional focus on reducing adverse incidents between police and citizens, with public complaints as a major guide and measure, should have at least equal weight in an EIS that is part of a comprehensive state-of-the-art police integrity management system. The paper also highlights the need for detailed publicly accessible data to ensure accountability of investments in integrity strategies.

Reports of citizen complaints of police misconduct often note that officers are rarely disciplined for alleged misconduct. The perception of little officer accountability contributes to widespread distrust of law enforcement in communities of color. This project investigates how race and segregation shape the outcomes of allegations made against the Chicago Police Department (CPD) between 2011 and 2014. We find that complaints by black and Latino citizens and against white officers are less likely to be sustained. We show neighborhood context interacts with complainant characteristics: Incidents alleged by white citizens in high–crime and predominantly black neighborhoods are more likely to be sustained. These findings provide context for understanding tensions between communities of color and the CPD. These results are consistent with theories that individual and institutional actors prioritize white victimhood and reflect the neighborhood effects literature stressing the interaction between individual and contextual factors in shaping outcomes.

The present article analyses how leading news outlets reported and commented on complaints against the Norwegian police during the period 2005-2008. The study is based on content analyses of press and television coverage, with special emphasis on a publicly debated police action in which a student of African origins lost his life. In most cases, news coverage of the police and the investigators of the police is event-driven, and the picture of the police seldom points to institutional or organizational problems. The story is too often one about individual wrongdoings alone. Unfortunately, such media pictures matter and influence policy decisions, especially when they become the point of departure for political debate

Much recent policing reform has been concerned with strengthening organisational and individual accountability through complaints, discipline systems and external oversight. Civil litigation against police has largely been ignored as an accountability measure. This research aimed to broaden the understanding of police litigation in Australia, and determine the implications for its use as an accountability mechanism. While the findings are not definitive, they generally conform with previous research outcomes that most cases initiated by civilians involve allegations of police abuse of power or process corruption. A new finding is that police sue their own organisations at about the same rate as they are sued by members of the public, although primarily for unfair dismissal. The results show a need for more detailed research, but highlight that civil litigation can form part of a regulatory web for identifying, controlling and preventing police misconduct.

Purpose The purpose of this paper is to examine whether the representativeness of police departments, i.e. the extent to which the demographics of sworn police officers mirror their local constituency’s demographic makeup, has an effect on communities. The study seeks to explain whether community complaints about police use of force are related to the representativeness of the police department. Design/methodology/approach The study examines the relationships between use of force complaints lodged against a police department and the representativeness of the police vis-à-vis their community using ordinary least squares regression and city fixed-effects models. The stratified sample of 100 large US cities uses data from the US Census Equal Employment Opportunity Survey and the Bureau of Justice Statistics Law Enforcement Management and Administration Statistics Survey from several points-in-time. Findings The analysis suggests that racial makeup and, to a lesser extent, local residency of police departments might matter in reducing community conflict with police, as represented by use of force complaints. However, the fixed-effects model suggests that unobserved community-level characteristics and context matter more than police departments’ representativeness. Originality/value This study seeks to provide a unique perspective and empirical evidence on community conflict with police by integrating the public administration theory of representative bureaucracy with criminal justice theories of policing legitimacy. The findings have implications for urban policing as well as law enforcement human capital and public management practices, which is essential to understand current crises in police-citizen relations in the US, especially in minority communities.

This study uses a sociological juridical approach with descriptive analysis research specifications. The data used are primary data and secondary data obtained through interviews and literature study. The data analysis method used is qualitative analysis. Furthermore, based on the research results it can be concluded: Law enforcement against police officers who violate the code of ethics in carrying out their duties at the Central Java Regional Police refers to Act No. 2 of 2002 concerning the Police, Government Regulation of the Republic of Indonesia Number 2 of 2003 concerning Disciplinary Regulations for Members of the National Police and Regulation of the Chief of Police No. Pol. 14 of 2011 concerning the Professional Code of Ethics for the State Police of the Republic of Indonesia. Several factors that hinder law enforcement against unscrupulous police officers who violate the code of ethics are divided into internal factors: Leaders who have not fully paid attention to the implementation of disciplinary law enforcement duties for Polri members, level of discipline, awareness and compliance of Polri members with binding disciplinary regulations and applies to him is still relatively low so that disciplinary violations keep happening, Polri's disciplinary law enforcement often appears to lack transparency. In addition, this research also analyzes the obstacles and efforts made by Buleleng police in uncovering cases of child abuse in Buleleng. This research is an empirical study with a study that sees law as a reality that includes social reality, reality of culture and others (examine law in action). This empirical law study aims to examine legal issues in its practical dimensions, especially related to legal protection for victims of violent crime in Buleleng district. This research uses primary data and secondary data with research location in Buleleng. Technique of collecting data is done through observation and interview. The collected data is then processed and analyzed qualitatively. The results of this study indicate that the Buleleng police prepare by receiving reports or complaints from victims of violence, whether orally or in writing as a form of regulation. The place for report or complain is on the section integrated police service center. Basically legal protection against child victims of violence is conducted in accordance with the Child Protection Act. Basically legal protection against child victims of violence is conducted in accordance with the Child Protection Act. While related to obstacles faced by Buleleng police in revealing cases of violence that occur to children that investigators often have difficulty in finding the perpetrators, lack of information from perpetrators or victims, chronology is often covered, not conformity information between perpetrators and victims. In addition, investigators find it difficult to obtain information or information from traumatized victims, lacking evidence, obstacles to finding witnesses, and the results of their visum. Furthermore, related to the efforts made, Buleleng police conducted the process of receiving reports or complaints from families of victims who experienced violence. In addition, assistance was also provided by the integrated service center for the empowerment of women and children in Buleleng, in the case of violence that occurred was accompanied, mainly related to cases of sexual violence. Using records of complaint to the police and requests for lettres de cachet, this article explores the structure of conflict that existed in eighteenth-century Parisian families. In contrast to earlier work, it finds that the vast majority of complaints were lodged against spouses, not children, and that it was wives above all who used the state's relatively new coercive capacity in Paris to buttress their position in the family. The article concludes that the impact of the French state on social structure and relationships was a complicated one that cannot be reduced to the reinforcement and protection of those, like fathers, already advantaged by cultural and economic circumstance.

There have been complaints against the Argentinian police for decades (CELS, 2013, 2015). The Argentinian police (either federal, national, prefectural or military) have been characterised as the ‘blue leviathan’ (Saín, 2008), being responsible for gross human rights violations and excessive violence committed against civilians. The present article focuses on youth, aiming to explore their perceptions regarding police violence and impunity based on past negative experiences in one of the most affected areas in the metropolitan region of Buenos Aires, the Mitre neighbourhood. The quantitative data gathered for this study furthers the discussion on institutional legitimacy and the mutual relationship between the development of confidence, obedience in law and procedural justice, in Argentina and beyond.
