Major improvements in weld inspection are obtained using Phased Array technology with capability for beam steering, electronic scanning, focusing, and sweeping the ultrasonic beams. Electronic scanning is much faster than raster scanning, and can optimize angles and focusing to maximize defect detection. Pressure vessel (PV) inspections typically use “top, side, end” or “top, side, TOFD” views, though other imaging is possible. Special inspections can be performed, e.g., for specific defects, or increased coverage. Defects can be sized by pulse-echo as per code, by time-of-flight Diffraction or by back diffraction. New PV inspection codes, particularly ASME Code Case 2235, permit the use of advanced ultrasonic inspection techniques. Pipeline girth weld inspections use a unique inspection approach called “zone discrimination,” and have their own series of codes. While similar equipment is used in pipeline as in PV inspections, the pipeline philosophy is to tailor the inspection to the weld profile and predicted lack of fusion defects. Pipeline displays are specifically designed for near real-time data analysis. Both ASME CC 2235 and the pipeline codes permit the use of Fitness-For-Purpose, which reduces construction costs. Overall, phased array systems meet or exceed all PV and pipeline codes.

The use of software products in today's world has increased dramatically making quality an important aspect of software development. There is a continuous need to develop processes to control and increase software quality. Software code inspection is one way to pursue this goal. This paper presents a collaborative code inspection process that was designed during an action research study using Collaboration Engineering principles and techniques. Our inspection process was implemented as a sequence of thinkLets, chunks of facilitation skill, that were subsequently field tested in a traditional paper-based and Group Support System (GSS)-based environment. Four inspections were performed on four different pieces of software code in two different organizations. Results show that regardless of the implementation, the process was found to be successful in uncovering many major, minor, and false-positive defects in inspected pieces of code. Overall observations and feedback suggest that the collaborative inspection process was considered to be productive and satisfactory. GSS inspections were more effective, especially in terms of major defects. GSS inspections were also found to be more efficient. Finally, the GSS inspections outperformed the paper inspections from a practical perspective: logging and managing defects in a GSS was far superior.

Fire-code inspection and compliance are among the highest priorities for fire-inspection agencies to reduce the loss of life and property that can result from fire incidents. Requirements for code compliance and inspection vary throughout towns and states within the United States, and building owners who violate these codes can be penalized via fines and mandated compliance measures. To the best of our knowledge, no previous study has investigated the strategic behavior of players in a fire-code inspection process. This paper fills the gap by presenting the game-theoretic approach to modeling building owners’ behaviors with respect to fire-code compliance and the inspection strategies of fire-inspection agencies. Both a decentralized model (sequential game in which the fire-inspection agency moves first) and a centralized model (simultaneous game controlled by one central decision maker) are developed to identify the best inspection strategies for the agency and the best compliance strategies for the building owner. This study provides prescriptive insights that can enable policymakers to improve fire-code compliance and inspection by identifying the conditions that motivate the players to participate positively in the inspection and compliance processes. Numerical sensitivity analyses of the equilibrium strategies and the expected losses of the players are provided, along with a comparison of the results between the decentralized and centralized models.

<abstract><p>Maritime transport plays an important role in global supply chain. To guarantee maritime safety, protect the marine environment, and enhance the living and working conditions of the seafarers, international codes and conventions are developed and implemented. Port state control (PSC) is a critical maritime policy to ensure that ships comply with the related regulations by selecting and inspecting foreign visiting ships visiting a national port. As the major inspection result, ship detention, which is an intervention action taken by the port state, is dependent on both deficiency/deficiencies (i.e., noncompliance) detected and the judgement of the inspector. This study aims to predict ship detention based on the number of deficiencies identified under each deficiency code and explore how each of them influences the detention decision. We innovatively view ship detention as a type of anomaly, which refers to data points that are few and different from the majority, and develop an isolation forest (iForest) model, which is an unsupervised anomaly detection model, for detention prediction. Then, techniques in explainable artificial intelligence are used to present the contribution of each deficiency code on detention. Numerical experiments using inspection records at the Hong Kong port are conducted to validate model performance and generate policy insights.</p></abstract>

Stack inspection is a mechanism for programming secure applications in the presence of code from various protection domains. Run-time checks of the call stack allow a method to obtain information about the code that (directly or indirectly) invoked it in order to make access control decisions. This mechanism is part of the security architecture of Java and the .NET Common Language Runtime. A central problem with stack inspection is to determine to what extent the local checks inserted into the code are sufficient to guarantee that a global security property is enforced. A further problem is how such verification can be carried out in an incremental fashion. Incremental analysis is important for avoiding re-analysis of library code every time it is used, and permits the library developer to reason about the code without knowing its context of deployment. We propose a technique for inferring interfaces for stack-inspecting libraries in the form of secure calling context for methods. By a secure calling context we mean a pre-condition on the call stack sufficient for guaranteeing that execution of the method will not violate a given global property. The technique is a constraint-based static program analysis implemented via fixed point iteration over an abstract domain of linear temporal logic properties.

Commercial and public buildings are more vulnerable to fires because of their complex use functions, large number of centralized occupants, and the dynamic nature of the use of space. Due to the large number of these types of buildings and the limited availability of manpower, annual fire inspections cannot ensure the continuous compliance of fire codes. A crowdsourcing application, iInspect, is proposed in this paper to harvest collective intelligence in order to conduct mass inspection tasks. This approach is supported by building information modeling (BIM) based virtual reality (VR) and an indoor real-time localization system. Based on the International Fire Code and 27 fire inspection checklists compiled by various local authorities, a generic list of inspection items suitable for iInspect is proposed, along with a reputation-based monetary incentive model. A prototype of iInspect was created for Android mobile phones, and a case study was performed in an office building in Tianjin, China, for verification of this crowdsourcing inspection approach.

The development of robot technology and AI makes it possible using outdoor mobile robots inspecting substations instead of manual work [. To solve the technical problems of substation patrolrobots navigation, a general scheme of substation intelligent inspection based on the red guide line is put forward. The 2-D bar code records main inspected equipments information, aiding patrol robot positioning navigation. The system utilizing LabVIEW virtual instrument software with IMAQ Vision module has been successfully written and related to pictures image processing, detecting and reading 2-D bar code. It has practical significance to improve the efficiency and to enhance the portability and flexibility of substation inspection scheme.

Ultrasonic guided wave testing is an essential technique in non-destructive testing for structural integrity of oil and gas pipelines. This technique, based on the pulse-echo method, is often used for the long-range detection of pipelines at any location. However, guided waves suffer from high attenuation when they propagate in attenuative material structures and multiple wave modes due to the excitation, which reduces the power of echo signals and induces corruption caused by coherent noise. In this paper, a developed hybrid coded excitation method that uses the convolution of a Barker code and Golay code pair is proposed and applied for an ultrasonic guided wave testing system to excite the torsional guided wave mode T(0,1) in a steel pipe. The proposed method combines the advantages of these two coding methods and increases the flexibility of code lengths. The performance is evaluated by signal to noise ratio and peak sidelobe level of the processed signal. Both theoretical simulations and experiments have investigated using the proposed codes composed of Barker codes and Golay code pairs of different lengths and combinations. The experimental results show the significant improvement of the signal to noise ratio and the peak sidelobe level due to the proposed hybrid code usage for the excitation of guided waves. The values are further improved to around 32 dB and around −24 dB, respectively. Overall, the proposed hybrid coded method for improving the echo SNR can benefit from guided wave testing to reduce coherent and random noise levels and many other potential applications.

Recent research has shown the value of social metrics for defect prediction. Yet many repositories lack the information required for a social analysis. So, what other means exist to infer how developers interact around their code? One option is static code metrics that have already demonstrated their usefulness in analyzing change in evolving software systems. But do they also help in defect prediction? To address this question we selected a set of static code metrics to determine what classes are most "active" (i.e., the classes where the developers spend much time interacting with each other's design and implementation decisions) in 33 open-source Java systems that lack details about individual developers. In particular, we assessed the merit of these activity-centric measures in the context of "inspection optimization" — a technique that allows for reading the fewest lines of code in order to find the most defects. For the task of inspection optimization these activity measures perform as well as (usually, within 4%) a theoretical upper bound on the performance of any set of measures. As a result, we argue that activity-centric static code metrics are an excellent predictor for defects.

In this research, we used nondestructive test based on ultrasonic test as inspection method, and made up inspection robot in order to control of ultrasonic probe on the SWP surface, and programmed to signal processing code and pattern classifying code by user made programming code. For evaluation of flaw signal is reflected on welding flaw, user-made program codes are composed of signal processing and probability neural network (PNN) and backpropagation neural network (BPNN). And then, we actually confirmed to the theoretical advantage of each neural network method compared probability neural network with backpropagation neural network for classification and recognition rate. For the application of classifier to SWP inspection system, BPNN classifier is adequate in the first stage. And then, the application of PNN classifier is adequate as the next stage. Because of PNN application need enough sample data that is due to probabilistic density function.

The purpose of this research is stability estimation of plant structure through classification and recognition about welding flaw in SWP(Spiral Welding Pipe). And, In this research, we used nondestructive test based on ultrasonic test as inspection method, and made up inspection robot in order to control of ultrasonic probe on the SWP surface, and programmed to signal processing code and pattern classifying code by user made programming code. Inspection robot is simply constructed as 2-axes because of welding bead with fixed pitch. So, inspection of welding part can be possible as composition of inspection part for tracking on welding line. For evaluation of flaw signal is reflected on welding flaw, user-made program codes are composed of signal processing and Bayesian classifier and perceptron neural network and back-propagation neural network. And then, we confirmed to superiority of neural network method compared with Bayesian classifier for classification and recognition rate. According to this result, we selected back-propagation neural network as classification and recognition method about the system of SWP stability Estimation[2]. Through this process, we proved efficiency on the system of SWP stability Estimation, and constructed on the base of the system of SWP stability Estimation for the application in industrial fields.

The paper describes the architecture of software tools for automating the management of code review of software prototypes of design solutions that allow to obtain such effects as ensuring interactive interaction between the designer and an expert performing code review, as well as reducing the expert’s time spent on commenting the code by selecting a comment from the list prepared in advance for each requirement from the requirements obtained during the analysis. The tools being developed consist of three main parts. The first part presents requirements in a question-and-answer format including standard comments to be inserted into the prototype code in case of non-compliance with these requirements. The second one is a relational database, which is designed to store the source codes of prototypes aimed at inspection and passed it with expert comments. The third one is a Web-application that allows the designer to send prototype codes for review and see the results of the inspection, and an expert to provide viewing and editing of the prototype source code with the insertion of both standard, pre-prepared comments, and written in free form.

School principals were charged with classroom supervision which had been in the supervisors’ area of responsibility by the regulations effectuated in 2014. The aim of this study was to find out the views of school principals on classroom supervision based on the amendment of regulations. The research was conducted by a qualitative design and phenomenological method was used. Study group of the research was school principals working in the districts of Battalgazi and Yeşilyurt in Malatya, Türkiye in the academic year of 2019-2020. The semi-structured interview guide, which was designed by the researchers, was used as the data collection tool after the expert opinions were obtained and corrections were made on it. 15 school principals, who were chosen by convenience sampling, were interviewed. Interviews were recorded based on the approval of participants. Code names were given to all participants as M1, M2, M3, … Qualitative data gathered from the participants during the interviews were analyzed by content analysis. First, the researcher coded the data separately. After that, both the researcher and another field member coded the data synchronically and reached a consensus. New codes were created where divergence appeared. It can be stated that school principals have positive views on being charged with classroom supervision. In fact, school principals state that they are not troubled with their supervision duty on teachers, but supervisors should also take part in the supervision process in order to make the process more effective and active.

This article addresses the criteria that are decisive in determining whether a given document can be referred to as Protocol within the meaning of the provisions of Chapter 16 of the Penal Code. From this point of view, the two-staged medico-legal postmortem inspection, consisting of an external inspection and autopsy (opening of the corpse) can be de lege lata documented by drawing up a medico-legal report, which is not considered a Protocol. The autopsy, artificially separated from an inspection (cf. Art. 209, par. 4 of the Penal codc), is carried out “in the presence” of a prosecutor, not under his supervision or with participation, by a forensic pathologist who is not authorized to draw up a Protocol. In the light of the above, Art. 209, par. 4 of the Penal Code should be amended for the sake of truth and justice.

Members have been receiving notification from Inspection Bodies about their X-ray equipment being due for inspection. On enquiry, it has been discovered that, in some instances, this notice was based on erroneous data that Inspection bodies may have received from the Radiation Control, who had not correctly updated their records, due to "a lack of manpower". SADA strongly advises members who receive this notification to check their documentation before booking said inspections and, if the notification is incorrect, to request their usual inspection body to correct their records. SADA has serious concerns about the current legal framework and enforcement of the Act governing X-ray equipment. It questions the Code of Practice and more particularly, the legal standing of inspection bodies, licensing delays and the entire legislative framework. To this end, SADA has made an extensive written submission to the Minister of Health raising our concerns. In the meantime, as the legislative framework applies to practitioner, in its flawed framework, we provide members useful information for the benefit of members around the whole issue of licensing and testing of X-ray equipment so that members are properly informed when receiving notices of inspections or having to licence their new or used X-ray equipment.

ABSTRACT An internal audit engagement at a large bank revealed that legacy software code can represent significant risk to an organization. In this engagement, several instances of malicious COBOL source code were discovered through manual inspection and identification. The internal auditors were concerned that more instances of faulty code could be in the production environment, and that manually inspecting over 100 million lines of source code would be infeasible. Under their auspices, I developed the Retrospective Static Source Code Analysis Framework for automatically identifying source code files likely to contain source code faults. We implemented this audit analytic framework in a tool called COBOL Analyzer. Using the tool, the auditors discovered thousands of potential source code files with faults and, using a ranking method, audited the most suspicious ones. The tool was deemed a success and it is undergoing further development by the internal audit team.

The current in-service inspection (ISI) strategy for the nuclear piping in many countries consists of both the code requirements such as ASME B & PV Code Sec. XI and the country-specific regulatory requirements, so called as the enhanced ISI. The enhanced ISI reflects the operating experience of piping failure, while the ASME Code Sec. XI requirement is based on random sampling for the inspection points. In this study, a new strategy for ISI of nuclear piping was proposed based on piping failure frequency. This strategy basically reflects the operating experience because the piping failure frequency is based on the piping failure database. The new concept of minimum inspection rate was also introduced in this new ISI strategy. As pilot study, the new ISI strategy was applied to the Class 1 piping system such as reactor coolant system and safety injection system of Ulchin Unit 5 which is the 1,000 MWe Korean Standard PWR. The results from the proposed new strategy were compared to those from the ASME Code Sec. XI. The results show that the new ISI strategy reasonably reflects the operating experience. The results also show that the concept of the minimum inspection rate can compensate the unbalance in the number of inspection points between the very large differences in the piping failure frequency.

Buffer overflow (BO) is a well-known and widely exploited security vulnerability. Despite the extensive body of research, BO is still a threat menacing security-critical applications. The authors present a comprehensive systematic review on techniques intended to detecting BO vulnerabilities before releasing a software to production. They found that most of the studies addresses several vulnerabilities or memory errors, being not specific to BO detection. The authors organized them in seven categories: program analysis, testing, computational intelligence, symbolic execution, models, and code inspection. Program analysis, testing and code inspection techniques are available for use by the practitioner. However, program analysis adoption is hindered by the high number of false alarms; testing is broadly used but in ad hoc manner; and code inspection can be used in practice provided it is added as a task of the software development process. New techniques combining object code analysis with techniques from different categories seem a promising research avenue towards practical BO detection.

This article reviews about the views of Madiha El Mehelmy Hotb, the Head of the Pressure Vessels Technical Services Division for Regie Du Batiment Du Quedec, on how ASME Boiler and Pressure Vessel Code has evolved over the years. Hotb reveals that during the 1980s, ASME’s regulatory approach covered all aspects of the life cycle of a boiler or a pressure vessel from design to being taken out of service. It also confirmed every step in between – fabrication, installation, repair and modification, and in-service inspection. During later years, the institution moved toward accreditation of authorized inspection agencies, changed the publication cycle from three years to two, eliminated addenda, and restructured the Code committees. New Section VIII and division 2 were written, and the Codes were published in digital electronic format. Hotb believes that the Code will continue to be widely used and adopted in future. It will have a bigger and larger input from all over the world and will have further outreach and adoption by far more countries.

In recent years the integration of design and manufacture software applications has received significant research effort as it has major potential to improve industrial performance. Product modelling is becoming accepted as the mechanism by which a central source of product data can be captured to provide an integrating mechanism between a range of design and manufacture functions. This paper describes the exploration of a product model environment as an integration mechanism for a number of manufacturing code generation functions, namely a machine planner, an inspection planner and a feedback system. These provide an integrated preproduction proving facility. The software implementation concentrates on the machining and inspection of two-and-a-half-dimensional prismatic components using a three-axis vertical machining centre and a coordinate measuring machine.

Research shows that community socioeconomic status (SES) predicts, based on food service types available, whether a population has access to healthy food. It is not known, however, if a relationship exists between SES and risk for foodborne illness (FBI) at the community level. Geographic information systems (GIS) give researchers the ability to pinpoint health indicators to specific geographic locations and detect resulting environmental gradients. It has been used extensively to characterize the food environment, with respect to access to healthy foods. This research investigated the utility of GIS in determining whether community SES and/or demographics relate to access to safe food, as measured by food service critical health code violations (CHV) as a proxy for risk for FBI. Health inspection records documenting CHV for 10,859 food service facilities collected between 2005 and 2008 in Philadelphia, PA, were accessed. Using an overlay analysis through GIS, CHV were plotted over census tracts of the corresponding area. Census tracts (n = 368) were categorized into quintiles, based on poverty level. Overall, food service facilities in higher poverty areas had a greater number of facilities (with at least one CHV) and had more frequent inspections than facilities in lower poverty areas. The facilities in lower poverty areas, however, had a higher average number of CHV per inspection. Analysis of CHV rates in census tracts with high concentrations of minority populations found Hispanic facilities had more CHV than other demographics, and Hispanic and African American facilities had fewer days between inspections. This research demonstrates the potential for utilization of GIS mapping for tracking risks for FBI. Conversely, it sheds light on the subjective nature of health inspections, and indicates that underlying factors might be affecting inspection frequency and identification of CHV, such that CHV might not be a true proxy for risk for FBI.

Software development projects have been blamed for being behind schedule, cost overruns, and the delivery of poor quality product. This paper presents a simulation model of a data warehouse to evaluate the feasibility of different software development controls and measures to better manage a software development lifecycle, and improve the performance of the launched software. This paper attempts to address the practical issue of code defects in each stage of data warehouse application development. The author has compared the defect removal rate of their previous project to the newly proposed enhanced project development life cycle that uses code inspection and code scorecard along with other phases of software development life cycle. Simulation results show that the code inspection and code score-carding have achieved a significant code defect reduction. This has also significantly improved the software development process and allowed for a flawless production execution. The author proposes this simulation model to a data warehouse application development process to enable developers to improve their current process.

The cataloguing and revision of reactor pressure vessels (RPV) manufacturing and in-service inspection codes and their standardized material specifications—as a technical heritage—are essential for understanding the historical evolution of criteria and for enabling the comparison of the various national regulations, integrating the most relevant results from the scientific research. The analysis of the development of documents including standardized requirements and the comparison of regulations is crucial to be able to implement learned lessons and comprehend the progress of increasingly stringent safety criteria, contributing to sustainable nuclear power generation in the future. A novel methodology is presented in this work where a thorough review of the regulations and technical codes for the manufacture and in-service inspection of RPVs, considering the implementation of scientific advances, is performed. In addition, an analysis focused on the differences between irradiation embrittlement prediction models and acceptance criteria for detected defects (both during manufacturing and in-service inspection) described by the different technical codes as required by different national regulations such as American, German, French or Russian is performed. The most stringent materials requirements for RPV manufacturing are provided by the American and German codes. The French code is the most stringent with respect to the reference defect size using as a criterion in the in-service inspection.

Because U.S. restaurants are inspected at least annually against criteria in the U.S. Food and Drug Administration Model Food Code, large amounts of data are generated and should be systematically reviewed. The purpose of this study was to determine the relationships among the data obtained through health department inspections, the contributing factors to foodborne illness identified by the Centers for Disease Control and Prevention, and the risks of outbreaks of norovirus, Salmonella, and Clostridium perfringens infection associated with a specific restaurant. These agents were chosen for the analysis because they cause the majority of foodborne illnesses. A theoretical predictive assessment tool was built that extracts data from routine health department inspection reports for specific restaurants to establish a risk profile for each restaurant and identify the likelihood of a norovirus, Salmonella, or C. perfringens outbreak at that restaurant. The tool was used to examine inspection reports from restaurants known to have had confirmed norovirus, Salmonella, and C. perfringens outbreaks. Although evaluation of an extensive data set revealed lack of an overall association between outbreak inspection scores and routine inspection scores obtained at outbreak restaurant locations, certain specific violations were significantly more likely to be recorded. Significant differences in types of violations recorded during outbreak and routine inspections were determined. When risks based on violation type can be identified, targeted actions may be able to be prioritized and implemented to help decrease illnesses.

The American Welding Society has developed its first welding design code for titanium alloy welded structures, through its consensus standards process and the work of many volunteers,. Defining the provisions of this new code required collecting and summarizing both strength and fatigue data for titanium structural welds. The design provisions were based on these data, but only in context of other provisions of the code in areas of welding procedure qualification, fabrication, and inspection. For instance, the allowable imperfection sizes found on inspection had to be correlated with the expected fatigue performance of imperfect welds. Test data from welds in the primary structural alloy Ti-6Al-4V are described for several weld configurations, both with and without welding imperfections.

However, the current inspection robot has the disadvantages of weak adaptability to complex environment, insufficient inspection scope, low efficiency and low intelligence. Therefore, this paper designs a GIS monitoring system based on the rail robot. By installing all kinds of sensors on the rail robot, with the help of binocular vision and mechanical arm, the omni-directional live detection of GIS in transit can be realized.

Large area inspection using a robot is critical in a disastrous situation; especially when humans are inhabiting the catastrophic environment. Unlike natural environments, such environments lack details. Thus, creating 3D maps and identifying objects has became a challenge. This research suggests a 3D Point Cloud Data (PCD) merging algorithm for the less textured environment, aiming World Robot Summit Standard Disaster Robotics Challenge 2021 (WRS). Spider2020, a robotic system designed by the Robot Engineering Laboratory, University of Aizu, was used in this research. Detecting QR codes in a wall and merging PCD, and generating a wall map are the two main tasks in the competition. The Zxing library was used to detect and decode QR codes, and the results were quite accurate. Since the 3D mapping environment has fewer textures, decoded QR code locations are used as the PCD mapping markers. The position of the PCD file was taken from the location given by the robotic arm in Spider2020. The accuracy of merging PCD was improved by including the position of PCD files in the merging algorithm. The robotic system can be used for Large area Inspections in a disastrous situation.

Code review is the process of manual inspection on the revision of the source code in order to find out whether the revised source code eventually meets the revision requirements. However, manual code review is time-consuming, and automating such the code review process will alleviate the burden of code reviewers and speed up the software maintenance process. To construct the model for automatic code review, the characteristics of the revisions of source code (i.e., the difference between the two pieces of source code) should be properly captured and modeled. Unfortunately, most of the existing techniques can easily model the overall correlation between two pieces of source code, but not for the “difference” between two pieces of source code. In this paper, we propose a novel deep model named DACE for automatic code review. Such a model is able to learn revision features by contrasting the revised hunks from the original and revised source code with respect to the code context containing the hunks. Experimental results on six open source software projects indicate by learning the revision features, DACE can outperform the competing approaches in automatic code review.

Abstract The technology of wideband code division multiple access (WCDMA) has been applied to band selective interference cancellation system (ICS) repeaters. To inspect the telecommunication quality of the systems, quality engineers must check the shape of the signals at the corresponding frequency band of the repeaters. However, measuring the signal quality is a repetitive manual task which requires much inspection time and high costs. In the case of small-sized samples, such as the example of an ICS repeater system, Bayesian approaches have been employed to improve the estimation accuracy by incorporating prior information on the parameters of the model in consideration. This research proposes a virtual method of quality inspection for products using a correlation structure of measurement data, mainly in a Bayesian regression framework. The Bayesian regression model derives prior information from historical measurement data to predict measurements of other frequency bandwidths by exploiting the correlation structure of each measurement data. Empirical results show the potential for reducing inspection costs and time by predicting the values of adjoining frequency bandwidths through measured data of a frequency bandwidth in the course of quality inspections of ICS repeater systems.

Extensive discussion in the engineering community as exemplified by forums presented by ASME PVP in 1994 and 1995 will be cited. Recent academic and NRC managerial support for risk-informed performance-based regulation will also be cited. The expressed need for risk neutrality will then be addressed.

The article is devoted to the analysis of the historical, legal, and theoretical foundations for changing the normative model for the beginning of a pre-trial investigation under the current Criminal Procedure Code of Ukraine, as well as determining the main directions for further improvement of the criminal procedural legislation, etc. As a result of the study, several provisions and conclusions have been formed regarding the deepening of the theories of criminal procedure and forensic science, substantiation of proposals for improving the current criminal procedural legislation, and the development of modern methodology (techniques) for investigating crimes. It is noted that the current stage of criminal law enforcement requires the maximum approximation of the system of domestic criminal legislation to European standards. In this aspect, the formation of an effective system of pre-trial investigation is impossible without a comprehensive analysis and generalization of the state of crime in the country and abroad, means of combating it, and the processes of further reforming the criminal procedural legislation and the criminal justice system as a whole. It is emphasized that this problem was traditionally considered by domestic scientists in the plane of the Criminal Procedure Code of Ukraine in 1960. However, relying on the legislation of the past, they cannot fully satisfy the modern requirements and challenges of investigative practice. First of all, it concerns the determination of the beginning of criminal proceedings – the emergence of a criminal procedural legal relationship. The consideration of several drafts of the Code of Criminal Procedure of Ukraine of different editions on these issues is illustrated. Thus, during this study, we came to the following conclusions. An analysis of the criminal procedural legislation does not allow us to unequivocally deny the possibility of carrying out verification actions before entering information into the ERDR. However, the question arises as to how complete information about the act is necessary to obtain for the proper implementation of its preliminary legal qualification, clarification of other information listed in part 5 of article 214 of the Code of Criminal Procedure of Ukraine, as well as the fulfillment of the requirements of part 4 of article 26, article 477 of the Code of Criminal Procedure of Ukraine. According to Part 2 of Art. 93 of the Criminal Procedure Code of Ukraine, one of the ways to collect evidence by the prosecution is to conduct investigative (search) actions. At the initial stage of the pre-trial investigation, before entering information into the Unified Register of Pre-trial Investigations, in urgent cases, only an inspection of the scene of the incident can be carried out from the entire system of investigative (detective) actions provided for in the Code of Criminal Procedure of Ukraine. However, the criminal procedural regulation of the inspection of the scene in part 3 of Art. 214 Code of Criminal Procedure of Ukraine is imperfect. Among the shortcomings, one should first highlight the gaps in determining the legal grounds for conducting an inspection of the scene of an incident in a person’s housing or other possessions, the imperfection of the legal regulation of further work with temporarily seized property, determining the types of inspections that can be carried out, etc. These and other problems of legal regulation are detrimental to the effectiveness of the work of investigative and operational groups when visiting the scene. Meanwhile, a well-conducted inspection of the scene, the collection, and proper consolidation of evidence during the investigative action is the key to the effectiveness of the work at the initial stage of the pre-trial investigation and can ensure the achievement of the objectives of criminal proceedings (Article 2 of the Code of Criminal Procedure). Therefore, the shortcomings of the legal regulation of the inspection of the scene of the incident also determine the relevance of the chosen research topic and the need, based on the improvement of the current criminal procedural legislation. Summarizing certain shortcomings of the procedural and legal regulation of the beginning of a pre-trial investigation, we also note that the Code of Criminal Procedure of Ukraine in 2012 did not eliminate the problem of unjustified refusals to start a pre-trial investigation, but significantly improved the situation in the field of observance of the applicants’ rights to access to justice.
