This chapter explores what the reasons for deviating from modified universalism in practice may be. To do so, it draws on behavioural international law and economics. The chapter argues that certain decision-making biases may play a role in cross-border insolvency and can explain both negative inclinations and instances of lack of cooperation, as well as the relative success of modified universalism. The key argument here is that instead of yielding to territorial inclinations, cross-border insolvency law has a debiasing role to play. It should attempt to align choices with optimal solutions, overcoming biases, and should also close gaps in the cross-border insolvency system in line with modified universalism.

Integrity or moral wholeness is the foundation of moral resilience. Integrity arises when intentions, words, thoughts, and actions align and there is fidelity in adherence to ethical commitments, norms, and conscience. It includes a robust notion of moral agency that includes considerations of the congruence of intentions, character, choices, behavior, and actions as well as responsibility for them. It requires a well-honed conscience; moral sensitivity, perception, and imagination; self-regulatory capacities; ongoing reflection to evaluate one’s intentions, motivations, and actions; cognitive judgment; the ability to devise reasonable solutions to internal conflicts; and steadfast commitment to responsibly enact considered decisions. Clinicians have dual obligations to those they serve and to themselves. Personal and relational integrity are fundamental considerations for clinicians. This dynamic interplay requires attunement to the issues of personal and relational integrity that are at play in clinical practice, including relationships with patients, families, colleagues, leaders, organizations, and the broader society.

The intertextuality of John Rolland’s Court of Venus, announced in its opening quotation and subsequent displays of scholarship and poetic skill, is central to the poet-narrator’s self-construction as a man improved by studying literature. However, the extent of Rolland’s reading is obscured by his unacknowledged use of key sources, including dictionaries, to populate his poem with Classical figures and cultivate a learned diction. While this might be read as pretension to a literary elite Rolland associates with the bygone court of David Lyndsay, the moral vision of his poem is greatly enlarged by its attempt to align such bookish learning with knowledge gained through experience—foregrounded by allusion to Chaucer’s Wife of Bath. In this way The Court of Venus models an urbane, knowing morality working towards wisdom and self-governance while recognizing the diversity, and disruptive desire, of human nature.

Getting Out explores the evolution of early release in England and Wales between 1960 and 1995. In the past three decades crime has become a highly contested political issue with implications for the humanity, fairness, and effectiveness of the criminal justice system. This book seeks to turn current crime debate on its head and examine the circumstances in which politicians and policy-makers have found it desirable to reduce the custodial element of a prison sentence and encourage the rehabilitation offenders in the community. Drawing upon a period of detailed archival research this book considers three critical moments of reform which have helped to shape the historical evolution of this secretive and little understood area of public policy. It argues that early release has always been bound up with prevailing societal justifications for punishment and the appropriate use of imprisonment within our liberal democratic system. It draws attention to the uneasy constitutional balance of power between the judiciary and the executive, and reflects upon the administrative task of governing large captive populations where the hopes and expectations of inmates do not always align with the interests of prison authorities or the community at large. This book challenges widespread assumptions about policy change and shows how the historical evolution of parole in England and Wales was shaped, to a significant degree, by the legacy of past political choices and the fluid balance of power within government.

Missionaries and Indian elites cooperated in translating the gospel message into the indigenous languages. They faced an inevitable trade-off between fidelity to Christian orthodoxy and intelligibility within the alien Mesoamerican culture. The result was either a deficit of meaning for the neophytes or a surplus of meaning created by attaching alien indigenous connotations to the Christian discourse. Zapotec and other indigenous doctrinal texts reveal a range of choices: at one extreme, terms deemed untranslatable, like “God” and “soul,” were imported as loan words; at another extreme, difficult terms were given elaborate explanatory glosses (periphrasis) in the target language, which elucidated meaning but at the expense of economy and fluency of expression.

This chapter explores the procedural and theoretical resources developed by Roman authorities to deal with the conflicts of law that resulted from these processes.
