The decision of the Human Rights Committee in Kindler vs. Canada1 marked its first substantive decision on the subject of the violation of human rights under the International Covenant on Civil and Political Rights (ICCPR) consequent upon extradition by a State Party, and making the extradition itself a violation of Covenant obligations. Two cases have followed — Chitat Ng vs. Canada2 and Cox vs. Canada.3 The requesting State in all cases was the United States and given the increase in the numbers of requests for extradition between Canada and that country, from 29 in 1980 to 88 in 1992 and the enthusiasm of Canadian lawyers for proceedings before the Committee, ‘litigation’ in this area is likely to form a significant part of the Committee's work in the future. The ensuing comment analyses the decisions and the issues raised.

Since the 1970s, the appointment of trial judges in Canada has generally involved an arms-length committee of professionals, although the structure of these committees and their role in the process has varied from province to province, as well as evolving over time. Yet these “new” structures and “new” processes did not prevent a major judicial appointment scandal in the province of Quebec in 2010, culminating in the formation of the Bastarache Committee to recommend changes. This paper summarizes the forty-year history of Canadian judicial appointment committees, identifies the major challenges that face those committees, and suggests the basic values toward which reforms to the appointment process might be directed.Depuis les années 1970, la nomination des juges de première instance au Canada a généralement mis à contribution un comité de professionnels indépendants, bien que la structure de ce comité et son rôle dans le processus de nomination aient varié d’une province à l’autre et évolué avec le temps. The article examines the peculiarities of the Soviet policy of return-to-the-homeland campaign from Canada to the Ukrainian SSR, which since 1955 was conducted by the Committee for Repatriation to the Motherland. The Ukrainian Diaspora in Canada occupied a special place in the committee’s efforts. The propaganda campaign for re-emigration was aimed at forming a positive images of the Soviet Union / Ukrainian SSR, in particular their economic achievements. The emotional component that was used to stir up nostalgia among the Diaspora was also fully used. The Ukrainian pro-communist press published numerous letters by Ukrainians who had lived in Canada but returned to their native land as evidence of the wonderful life in Ukraine. The return-to-the-homeland campaign was helped by leftist Canadian organizations (such as Association of United Ukrainian Canadians) through their own newspapers. It regularly published letters to friends in Canada from recent returnees. The return-to-the-homeland campaign was conducted in the context of the Cold War and the difficult relationship between Canada and the Soviet Union. However, re-emigration from Canada did not become so massive, as hoped for by its organizers, and by its scale was inferior to reminiscences from other countries (for example, from Argentina). The hundreds of Canadians who resettled in the Soviet Union in the second half of the 1950s represented only a small part of the Ukrainian origin community in Canada. But even in this situation, the Canadian government’s position on the return-to-the-homeland campaign was clearly considered too passive by members of the Ukrainian Canadian Committee. Canadians who returned to the U.S.S.R. felt duped and were not easily integrated into Soviet life. Those who succumbed to the manipulation of Soviet propaganda were quickly disappointed with the realities of life in the Ukrainian SSR and began to appeal for a return. Such persons immediately fell within the sight of the Committee of State Security, whose staff conducted “preventive conversations” with them. From the Canadian government’s perspective, there were no problems for people who had been born in Canada and they were eligible for Canadian citizenship. From the Soviet point of view, such steps were equivalent to political betrayals and were completely prevented. Separate cases of successful returns to the ocean were fixed at the beginning of the 1970s, which became possible due to the detente of international tensions during the Cold War and more persistent actions by Canadian authorities. A small number of repatriates managed with considerable difficulty to return to Canada. Some of them (N. Demydenko, E. Lenko) have been seeking permission to go to Canada for several years.

ABSTRACTBackgroundCompetence committees play a key role in a competency-based system of assessment. These committees are tasked with reviewing and synthesizing clinical performance data to make judgments regarding residents’ competence. Canadian emergency medicine (EM) postgraduate training programs recently implemented competence committees; however, a paucity of literature guides their work.ObjectiveThe objective of this study was to develop consensus-based recommendations to optimize the function and decisions of competence committees in Canadian EM training programs.MethodsSemi-structured interviews of EM competence committee chairs were conducted and analyzed. The interview guide was informed by a literature review of competence committee structure, processes, and best practices. Inductive thematic analysis of interview transcripts was conducted to identify emerging themes. Preliminary recommendations, based on themes, were drafted and presented at the 2019 CAEP Academic Symposium on Education. Through a live presentation and survey poll, symposium attendees representing the national EM community participated in a facilitated discussion of the recommendations. The authors incorporated this feedback and identified consensus among symposium attendees on a final set of nine high-yield recommendations.ConclusionThe Canadian EM community used a structured process to develop nine best practice recommendations for competence committees addressing: committee membership, meeting processes, decision outcomes, use of high-quality performance data, and ongoing quality improvement. These recommendations can inform the structure and processes of competence committees in Canadian EM training programs.

Traditionally, Canadian commentary on the Judicial Committee has focused on the effect or impact of the imperial tribunal's decisions on the nature of Canadian federalism. Numerous studies have examined the issue of whether or not the Judicial Committee strengthened the powers of provincial governments at the expense of the federal government by misinterpreting the Constitution Act, 1867 and by ignoring the intentions of the fathers of Confederation who sought to create a strong centralized government. The Canadian preoccupation with the merits of this debate has led one distinguished political scientist, David E. Smith, to suggest that “perhaps too much” has been written about the Judicial Committee. The literature examining the relationship between the Judicial Committee and Canada has not, however, addressed the significance of the imperial context in which the tribunal's decisions were written. The Judicial Committee was not only the final appellate body for Canada but was also responsible for hearing disputes from other parts of the Empire. Decisions written for one Dominion or colony could have profound legal and political effects on another.

Purpose: The Canadian Nephrology Trials Network (CNTN) was formed in 2014 to support Canadian researchers in developing, designing, and conducting prospective studies in nephrology. In response to the changing landscape and needs within the Canadian nephrology research community, an interest in further growth and development of the network was identified. In the following report, we describe the process undertaken to re-envision the network through the creation of 3 new committees and how the committees are facilitating change and growth within the CNTN for future sustainability. Sources of information: To understand areas for improvement and capacity building, the organization charged with overseeing the CNTN, Canadians Seeking Solutions and Innovations to Overcome Chronic Kidney Disease (Can-SOLVE CKD), began by conducting an environmental scan. As well, 2 informal surveys were sent to nephrology professionals (who were members of the CNTN and the Canadian Society of Nephrology) and patient partners (from Can-SOLVE CKD). Methods: In September 2018, 44 CNTN members and other stakeholders from across Canada (including patient partners and representatives from research funding agencies) convened for a 2-day visioning workshop in Mississauga, Ontario. The agenda for this workshop was largely based on the results from the informal surveys. CNTN leadership participated and chose other workshop participants through informal stakeholder mapping and purposeful recruitment. Patient partners were recruited to participate in the workshop through advertisement within the Can-SOLVE-CKD patient council. The survey results and discussion questions were presented to participants at the workshop who, in turn, discussed in large- and small-group session ways in which the CNTN might be expanded. Results: Surveys of patient partners indicated that they would like to see greater involvement of patients in the research process. Surveys of researchers indicated that they wanted more support and resources for coordinating prospective trials. The themes which emerged from the workshop discussions were peer review, engagement, and training. These themes were broadened and formally re-named to Scientific Operations, Communications and Engagement, and Capacity Building. A working committee, each co-led by a nephrologist with research experience and a patient partner, was created to advance each of these identified themes. An executive committee was created to provide overall strategic leadership and governance to the network. The Scientific Operations Committee conducts peer reviews; provides letters of endorsement after peer review; and holds semi-annual in-person meetings where researchers can present their proposals and obtain feedback from multiple stakeholders, including patients. The Communications and Engagement Committee publishes a quarterly newsletter, engages the community on Twitter, and reaches out to community sites and new nephrologists to engage them in research. The Capacity Building Committee conducts webinars to encourage patient partners to develop their own research questions and is developing a hub-and-spoke model to improve research collaboration. Limitations: We did not conduct formal stakeholder mapping. Only attendees of the visioning workshop provided input, and not everyone’s comment or opinion was included in the workshop report. Perspectives were limited to the sample of people who attended the workshop or were surveyed and may not reflect perspectives of all stakeholders in nephrology research in Canada. We did not use formal qualitative methodology to summarize the workshops. Implications: Renewed areas of focus and related committees within the CNTN could lead to an increased capacity for nephrology research, increased engagement and collaboration with researchers, a higher likelihood of funding with rigorous peer review, and more clinical trials and multicenter collaborative prospective research being conducted in Canada.

Canada has been very much at the centre of the establishment of the International Criminal Court (ICC) since the momentum shifted in late-1994 from the International Law Commission (ILC) to more broadly representative bodies established by the General Assembly. It was Canada that chaired the ‘like-minded’, a group of states active during the several sessions of the Preparatory Committee and during the Diplomatic Conference in Rome from 15 June to 17 July 1998. The ‘like-minded’ were committed to invigorating the ILC's draft statute by enhancing the independence of the Prosecutor and trimming the sails of the Security Council. At Rome, Canadian diplomat Philippe Kirsch was elected chair of the Committee of the Whole, and he directed the intense negotiations throughout the five-week session. Kirsch crafted the final package of compromises that was submitted to the Conference at its close, on the morning of 17 July, and that succeeded in rallying the vast majority of delegations when put to a vote later that day. Since then, Kirsch and his team have presided over the ongoing work of the Preparatory Commission.

The second phase of a Canada-wide study of ethics committees in English-language hospitals in Canada involved site visits to five selected hospitals to assess the effectiveness of the ethics committee. In this article the findings of this pilot study are reported, including the perspectives of physicians, nurses and hospital administrators on the ethics committee of the various hospitals. The results of the study, albeit limited by being a pilot study, raise a series of questions for hospital administrators, medical administrators and nursing administrators.

In 2005, Minister of Justice Irwin Cotler proposed and tabled in Parliament a number of reforms to the federal judicial appointment process. These reforms were designed to increase the transparency and enhance the accountability of the procedures by which judges are appointed to federally operated Canadian courts, including the Supreme Court of Canada. Included in the reform package was a Code of Ethics for members of the judicial appointment committees, as well as a directive to publish on an annual basis the identity of the members of the judicial appointment committees, the number of total applications for judicial office, and the number of that total that have been recommended or highly recommended by the committee. Crucially, a set of guidelines for the operation of the judicial appointment committees was provided, which outlined the overriding principles that committee members were to consider during the appointment advisory process.

The aim of the research is to analyze peculiarities of cultural exchange between Canada and the Ukrainian SSR in the 1960s and 1980s, which took place during the Cold War. The research methodology is defined by an interdisciplinary approach (history, culture, foreign relations) and is based on general scientific and special scientific methods, first of all, retrospection and historical comparison. The scientific novelty of the research is that on the basis of archival materials determined the forms and content of cultural exchange between the Ukrainian SSR and Canada, in particular its propaganda content. The Conclusions. During the Cold War the cultural sphere became an arena of confrontation, and art (or what was meant by it) became part of ideological propaganda campaigns. Cultural exchange was seen by the Soviets as a way of representing «achievements of socialist culture» to Canadian Ukrainians and as an effective propaganda tool. Formally, on the Soviet side, cultural exchanges were carried out by specially created organizations, which, however, were managed and financed through the Central Committee of the Communist Party and the International Department of the Committee of State Security (KGB). The request to maintain cultural ties with the Ukrainian SSR in Canada was largely due to the desire of the Ukrainian community overseas to maintain spiritual ties with the Motherland. Different approaches to the interpretation of cult exchange – from approval to complete denial – have provoked a lively discussion in the diaspora. Adherents of cultural programs from the Ukrainian SSR were Canadian left-wing organizations, such as the Association of United Ukrainian Canadians. The League of Liberation of Ukraine was a categorical opponent of the cultural exchange, whose representatives saw in the artists from the USSR Soviet emissaries called to «destroy» the Ukrainian community in Canada. Organizations within the Ukrainian Canadian Committee (UCC) condemned cultural exchange as a one-sided tool of Soviet propaganda, but viewed cultural ties as a way to influence Soviet artists. Because of one-sided Soviet cultural infiltration, on several occasions the UCC voiced its protest against Canada’s cultural exchanges with this country. Ukrainian Canadian artists, choirs and dance ensembles are not permitted to perform in Ukraine unless they were politically acceptable to the Soviet authorities.

This annotatedCoxford Lectureis the first account dedicated to tracing the part played in the 1980-82 patriation of the Canadian Constitution by the British House of Commons, particularly by its Select Committee on Foreign Affairs. This committee, for which author was the adviser, investigated the propriety of the UK Parliament’s acceding to a request for amendment of the British North America Act 1867 (as amended) if the amendment were opposed by a substantial number of Provinces and it would affect their powers. Against the firm opposition of the Canadian government (secretly being assisted by the British government), the Committee reported in January 1981 that acceding to such a request in such circumstances would be a breach of Parliament’s constitutional responsibilities. A second report, in April 1981, defended that opinion against the Canadian government’s vigorous attempt in March to refute it. The Committee’s position strongly resembles that of the “conventions” majority of the Canadian Supreme Court in September 1981. But the resemblance should not obscure a significant difference, rooted in the distinct authority of the UK Parliament during this terminal phase of the patrimony that, by Canadian decision in 1931, it had inherited: some imperial responsibilities (by then only procedural, and terminated in 1982) for the polity and people of Canada.

Although the public advisory committee has become a very common tool for involving local people in forest management decisions, it does not necessarily broaden the base of public input and may simply replicate the challenges of access, representation, and capacity to participate that are found in wider society. As a category of social exclusion, this study explores why women are significantly underrepresented on forest management advisory committees in Canada and how these committees function as gendered units. Research involved 25 semistructured interviews with members (and former members) of two forest management advisory committees: Tembec in Manitoba and NewPage in Nova Scotia. The strongest evidence in our study suggests that these committees operate within male-dominated institutions and particular masculine norms that are simply taken for granted. Thus, social relations based on gender often go unacknowledged. Findings also showed that the lack of critical mass of women often limited the active participation of the small number of women involved in committee activities. Our empirical observations suggest that unless we attend to gender when involving communities in establishing strategies for forest management, we will reinforce gender disadvantage and exclusion and overrepresent industrial and utilitarian interests of forestry over other community and ecocentric values.

Free trade is part of neo-liberal economics, which is centred on the free market principles of limited government regulation and private sector competition. Free trade focuses on the elimination of trade barriers and tariffs. In Canada, the movement toward free trade began in 1985 with the Royal Commission on the Economic Union and Development Prospects for Canada, which encouraged free trade between the United States and Canada, and concluded with the 1988 federal election that sealed Canada’s fate within economic union with the United States. This article will combine a Neo-Marxist and Political Process Theory framework to address how during the period from 1985 to 1988, Canadian social movements adopted innovative tactics and mobilized against free trade to gain greater influence over trade policy. The international charter of human freedoms became a legal reality via the coming into force of the following three documents : the International Convention on Economic, Social and Cultural Rights, the International Convention on Civil and Political Rights and the optional protocol attached to it. The Human Rights Committee was created under the Convention on Civil and Political Rights. In accordance with the controlling machinery set up under the optional protocol, the Committee must examine complaints from individuals who feel that their rights as defined and protected by the Convention, have been violated. Besides Uruguay, Canada is the country that submits the greatest number of complaints to the Human Rights Committee. To this days, six « communications » putting it into question have been at the origin of the adoption of « final views » two of which have demonstrated a violation of rights laid down in the Convention. Yet various improvements have proved to be desirable so as to make resorting to the Committee more efficient. It is even conceivable that making the rule on exhausting internal recourses might allow the Committee to influence Canadian law by inciting Canada to amend its Constitution or to integrate the Convention into its national law so as to be usable before the courts. The Committee has thereby contributed to increasing the basic freedoms of Canadians via the Convention on Civil and Political Rights. Although their accomplishments have been praiseworthy, work done by the Human Rights Committee risks being incomplete if the status quo continues.

Purpose This paper aims to explore governance committee’s attributes in terms of composition, roles/duties and responsibilities and operations. Design/methodology/approach Information on the governance committee and the board in general was collected from the websites of 167 Canadian firms. Financial data were collected from the Sedar database. Findings Results uncover two patterns of governance committee attributes (composition, roles and operations), resulting in our characterization of governance committees as “less active” and “more active.” In light of additional analyses, the two groups also differ in terms of antecedents and impact. Practical implications This study can help board members to enhance board effectiveness by describing governance committee attributes and identifying contextual factors that could lead to a more active governance committee. In addition, it suggests that such committee can improve financial performance. Originality/value This empirical research focuses on the governance committee, a largely unexplored primary board oversight committee. An index comprising 19 duties and responsibilities performed by the governance committee was developed.

AbstractNearly two-thirds of all deaths worldwide are from non-communicable chronic diseases, with a similar proportion in Canada. According to the Global Burden of Disease Study, unhealthy eating is the leading risk for death and the second leading risk for disability in Canada. It is clear that to adequately address this major health issue, we need a comprehensive approach that includes strong governmental policy. In 2016 the Canadian government released its Healthy Eating Strategy, for which updating Canada’s Food Guide was a key element. The Government has proposed to release the guiding principles and policy statements documents in early 2019, followed by the healthy eating plans later in 2019. Much of this work aligns with many policies that have been developed and adopted by the Canadian health and scientific organizations that are members of the Canadian Hypertension Advisory Committee. As such, the current editorial is a call to action for the healthcare and scientific community, both individuals and organizations, to ensure they have policies consistent with and supportive of those that have been developed through the Hypertension Advisory Committee collaboration, and to actively participate in providing input and feedback on the Healthy Eating Strategy through the Health Canada Stakeholder Registry. Although audit committees typically are considered a crucial corporate governance mechanism, knowledge is scant about the practices carried out in audit committee meetings. This paper provides insights into practices that audit committee members carry out in meetings, including the part of the meetings where members meet privately with auditors. The investigation was conducted via a field study in three Canadian public corporations—whose respective audit committees complied to a large extent with regulatory guidelines of the Toronto Stock Exchange and the voluntary recommendations of the Blue Ribbon Committee on audit committee effectiveness. Further, the three audit committees that we investigated are generally perceived as effective by the individuals who attend meetings. Our results highlight key matters that audit committee members emphasize during meetings, such as: accuracy of financial statements; appropriateness of the wording used in financial reports; effectiveness of internal controls; and the quality of the work performed by auditors. We also elicit the evaluation criteria that members use to assess written and verbal information submitted by managers and auditors. In addition, we found that a key aspect of the work carried out by audit committee members consists of asking challenging questions and assessing responses provided by managers and auditors.

This paper offers a short story of Crown sovereignty at the Supreme Court Canada in order to shed light on questions the Court has raised about the legitimacy of Crown sovereignty over territory claimed by First Nations. In skeletal form, the story is simple. The Crown — first Imperial British and later Canadian federal and provincial — asserted sovereignty over what is now Canadian territory, and Canadian courts (and the Judicial Committee of the Privy Council) accepted those assertions without question. Yet the Supreme Court of Canada has lately qualified Crown sovereignty in striking ways, perhaps most notably in speaking of “de facto Crown sovereignty” in reasons released in 2004.

My credentials for the position no doubt included my (equally privileged) position on faculty at the Graduate Centre for Study of Drama (U of T) and my experience co-chairing a conference on Atlantic Canadian Theatre the year before. However, I also knew and, in various capacities, had worked with many of the others on the organizing committee, and from the outset, I felt that my contributions were not merely welcome but sought out, carefully considered and, when helpful, acted upon. I was also one of only two men on the eleven-member committee1 – a significant factor on a number of levels and the position from which I offer the following observations.

AbstractIn 2006, the Canadian government introduced a new component to its process of selecting Supreme Court justices, a review committee composed of members of Parliament. Tasked with interviewing justices prior to their appointment to the bench, the committee met four times, interviewing only five of the eight judicial candidates appointed to the bench before the Conservative government announced the committee's termination in 2014. This study offers the first comprehensive analysis of the performance of this ad hoc judicial review committee. Using an original dataset, we find that MPs asked little by way of probing questions, such as those related to policy or a candidate's previous jurisprudence. However, we do find some evidence that the hearing process was used to further the political aims of the participating political parties.

The recent scandals on corporate governance have forced the regulatory bodies to issue new corporate governance mechanisms. These new governance mechanisms include banks. The purpose of this study was to observe changes to the boards of directors, to the committees reporting to the board, to the board of directors‟ independence and adoption to certain charters and checklists in Canadian banks for the periods covering the years 2002-2004. Our sample covers the eight largest domestic banks in Canada. Results indicate a reduction in board members and in the number of committees reporting to the board. However, it increased supervision by increasing the number of board committee meetings. Most of the banks in our sample have separated the role of Chairman and CEO, thereby increasing the independence of the board. There was also an improvement in the adoption of a new charter for the board of directors.

Purpose of review: The Kidney Research Scientist Core Education and National Training (KRESCENT) is a national Canadian training program for kidney scientists, funded by the Kidney Foundation of Canada (KFOC), the Canadian Institutes of Health Research (CIHR), and the Canadian Society of Nephrology (CSN). We describe our first year of incorporating patient partners into a scientific peer-review committee, the 2017 committee to select senior research trainees and early-career kidney researchers for funding and training, in the hope that it will be helpful to others who wish to integrate the perspective of people with lived experience into the peer-review process. Sources of information: Other peer-review committees, websites, journal articles, patient partners, Kidney Foundation of Canada Research Council, Canadians Seeking Solutions and Innovations to Overcome Chronic Kidney Disease (Can-SOLVE CKD) Patient Council, participants in the 2017 Kidney Foundation of Canada KRESCENT peer-review panel. Methods: We describe our motivation, rationale, guiding principles, plans, feedback, implementation, and response. Key findings: We disseminated a “call for patient partners” 8 weeks before the meeting, seeking patients or their care givers to partner with the KRESCENT peer-review panel; we defined these people with lived experience of kidney disease as patient partners. Eight patient partners came forward and all participated as reviewers. Patient partners first participated in a webinar to learn about the function, structure, and processes of a peer-review committee. They practiced reviewing plain language summaries and giving feedback. In a subsequent teleconference, they shared and discussed their reviews. Plain language summaries were scored, overall, on the same 0-5 quality scale used by scientific reviewers. Three patient reviewers participated in some or all of the 6-hour meeting, which was conducted as usual, for this panel, by teleconference (initially audio only; from 2020 onwards by videoconference). In the meeting, the 2 assigned scientific reviewers first gave their scores, followed by the patient reviewers giving their scores, and discussion (mostly scientific, and conducted in usual scientific language). Scientific reviewers then negotiated a consensus score based on their initial scores, the discussion, patient reviewers’ scores and statements, and the scientific officer’s notes. Patient reviewers, scientific reviewers, and the Kidney Foundation of Canada (KFOC) were generally positive about the process. The increased length of the meeting (estimated at 1 hour) was generally thought to be acceptable. Patient reviewers also provided feedback on the methods used to incorporate patients into the research under review. These comments were concrete, insightful, and helpful. The patients did not uniformly recommend that basic scientists involve patients in their work. We did not detect bias against preclinical science, work that did not involve patients, or rarer diseases. Some patients found participation inspiring and enlightening. All participants appreciated the idea of patient partners as community witnesses to a group process committed to fairness and supportiveness. We discussed assigning formal meaningful weight to patient reviewers’ assessments. Most, but not all, patients thought that the scientific reviewers were ultimately the best judges of the allocation of scarce research resources. Limitations: Patient participants tended to be Caucasian, middle class, and well educated. Because of the difficulties of travel for some people living with or supporting those living with kidney disease, our findings may not generalize fully to peer-review meetings that are conducted face to face. This is explicitly a supportive panel, committed to reviewing junior scientists with kindness as well as rigor; our findings may not generalize to panels conducted differently. We did not use formal qualitative methodology. Implications: Inclusion of patient partners as patient reviewers for the KRESCENT program peer-review panel was feasible, added value for scientific and patient reviewers, and for the funding stakeholders (CIHR, KFOC, and CSN). We were glad that we had taken this step and continue to refine the process with each successive competition.

The mandate of the CAG Education Committee is to facilitate, develop and promote excellence as it pertains to educational initiatives for the Canadian gastroenterology community. Professional education has long remained a priority of the CAG - a fact well recognized by the membership. The 2002 CAG Strategic Planning Survey showed that members rate Canadian Digestive Diseases Week (CDDW) as the most important CAG service, on par with Digestive Diseases Week regarding its usefulness (1). CDDW 2004 offered delegates a variety of basic science and clinical symposia, the popular and well received 'Breakfast with the Expert' sessions and a comprehensive Postgraduate Course reviewing key developments in gastroenterology, nutrition and hepatology.
