The objective of this thesis is to consider whether the institutionalist hypothesis that the choice of organisational form functions to limit the transaction costs of organising productive activities explains a major standard-form contract which is used in building production. I approach this task by demarcating three models of contract which represent different points along a "contracting continuum". Each of the three governance structures - classical contract, relational contracting and the firm - represents a distinct patterning of resource co-ordination and each generates its own configuration of transaction costs. Thus the contracting continuum provides a basis for comparing the cost-reducing strengths and weaknesses of governance structures that vary with respect to their characterisation of relations between economic actors, and of the form and substance of both planning and implementation of decisions. The second part of the thesis focuses on the standardform building contract and its location along the contracting continuum. This part of the thesis addresses the question of "transactional fit" between the building contract and the activity which it purports to regulate. The analysis proceeds by identifying sources of transaction costs in the context and in the practices of building production and examining the governance implications of the contractual responses to such costs. 11 In its conclusions the thesis attempts to evaluate the contribution of institutional analysis our understanding of legal conceptions of contract. By using an industry-wide standard-form contract as a focus, I hope to illustrate some of the strengths and also the limitations of this approach. Building contracts have received little academic attention in the UK., and transaction cost analysis of governance structures is a young science which has been pursued with more enthusiasm by economists than by lawyers. As yet there has been little attempt to relate substantive aspects of the lawyer's understanding of contract to the "new institutional economics". It is hoped that this thesis will make a contribution to that exercise.

With the growth experienced in the Building Industry, it is increasingly important to have a contract document that can be used on projects that is reasonably acceptable to all parties concerned. The objective of the research was to determine the effectiveness of the Joint Building Contracts Committee Series 2000 Principal Building Agreement (JBCC 2000 PBA)(Edition 4.1, March 2005) currently used in the Building Industry. The literature reviewed and results of quantitative research amongst contractors formed the basis of this study. The study revealed that the JBCC 2000 PBA is the most favourable contract document used by contractors in the Building Industry. With the inclusion of a range of construction guarantee alternatives in the contract document in lieu of the retention clause, more than half of the respondents have indicated that they are in favour of a retention clause to be included in the contract document as an alternative security option. The study also showed that there are still areas of concern with regards to the difficulty in interpreting and implementing numerous clauses of the document and that amendments were made to the document without legal advice, resulting in disputes. The research further also revealed that developing building contractors experience difficulties in general where the JBCC 2000 PBA is used as contract document on projects. There also seems to be no balance of risk between the employer and contractor in most cases where this contract document is used. The research concluded with proposals on revisions to some clauses to ensure a better contract document that will be acceptable to all contractors in the Building Industry and ultimately to be an internationally acceptable document.

Toward the end of 1999 and during the early part of 2000, the commercial construction sector in the Auckland area of New Zealand was affected as a result of liquidations of a number of major commercial construction companies. The aim of the research is to investigate the employment of building contracts, their administration, and into the incidence, nature and resolution of disputes executed during the calendar years of 1999 and 2000. This research was undertaken by surveying 100 commercial and 60 residential projects undertaken in the Auckland region of New Zealand to determine if the problems being experienced by the commercial contractors who were liquidated was incidental and limited to the commercial sector. Projects surveyed ranged in value between NZ$10,000 and NZ$700,000 for residential projects and between NZ$150,000 and NZ$99,000,000 for commercial projects. The literature review identifies, analyses and discusses: (i) To what extent are 'standard' forms of building contracts used by the construction industry including who was responsible for the drafting of those contracts? (ii) What provision was made in these building contracts for the resolution of disputes? (iii) Who was responsible for the independent administration of those building contracts? (iv) What was the incidence of disputes that resulted as a consequence of the usage of these building contracts and what was the nature of the disputes and how were they resolved? and (v) Would the construction industry in New Zealand benefit from legislation that would require that an independent third party be engaged for the administration of the building contract? Gaps in the literature of all areas of the research were identified. The following hypothesis was promoted: The incidence of disputes is reduced in building contracts that are administered by an independent third party for both commercial and residential sectors of the construction industry in New Zealand. A statistical analysis of the data collected was used to test the hypothesis as well as to determine whether the appointment of a third party to administer a contract between the client and contractor was of direct benefit and assisted in the avoidance or resolution of disputes. The results provided support for the hypothesis in both the commercial and residential sectors of the construction industry. Additionally, there was also qualitative endorsement for the propositions. The surveys provided evidence about the attitude adopted by those involved in the particular sectors to the independent administration of building contracts. 79% of the building contracts surveyed in the commercial projects were independently administered compared to 42% in the residential sector. The data was also used to provide positive test results for a proposition known as the 'principle of remotivity' which states that: 'the further the architect (or designer) is from the independent administration of a building contract during its execution, the more likely it is that disputes will arise'. The research confirmed that the culture of the construction industry in New Zealand; the legislation used to control the industry; and the decisions of local judiciaries in construction related matters are different to those adopted in Australia and the United Kingdom. These variations are not recognised by persons connected to and detached from the construction industry. The dissertation concludes by making 19 (nineteen) suggestions and recommendations. The research was limited to projects undertaken in Auckland, New Zealand and replication of the study would provide a broader understanding of this area of inquiry and further data to qualify the 'principle of remotivity'.

Building Information Modeling (BIM) is altering the way that the construction industry is developing design documents by involving all members of the design team as well as the general contractor early in the design process. The members are encouraged to offer advice on the design and constructability on the project. However, not only is the design process changing, but the liability and responsibility of each team member is changing as well. The alteration in responsibility can severely impact structural engineers because of the level of responsibility already associated with their role in the design process. This report looks at the concerns industry leaders and legal professionals have with how BIM is altering the liability landscape, such as standard contracts, software interoperability, data misuse, intellectual property, loss of data, the legal status of the model, the standard of care, and design delegation. In addition to the liability concerns, this report examines the steps that industry leaders have taken to prevent any unnecessary additional liability from affecting structural engineers.

This study therefore begins by analysing the client's objectives to establish the factors affecting each objective and to determine the inter-relationship and possible conflict between these factors. The principal types of contracts and methods of selecting a contractor are then identified. The methods of selecting a contractor are then evaluated according to these factors and their effects on the client's objectives are established. This evaluation is then used as the basis for recommending a procedure to choose which method should be used to select a contractor, in order to accomplish the client's objectives, under differing circumstances.

This thesis describes the results of research analysing the sub-contractor's risk elements in refurbishment projects. One of the main characteristics of refurbishment projects is that work is usually in small packages and scattered throughout the building making it unprofitable for one contractor to undertake. It is argued that the selection and appointment of the most suitable sub-contractors is very important in refurbishment projects as all other control measures have little effect once a totally unsuitable subcontractor has been appointed. The research methodology involved the extensive collaboration of a retired chief estimator with over thirty years experience in one of Britain's biggest construction firms with extensive knowledge in the management of sub-contractors and several other refurbishment contractors' senior management staff who were involved in choosing subcontractors for their contracts. Knowledge acquisition and representation and the evaluation of expert system shells are extensively reviewed. One of the important features of knowledge based systems is its ability to handle uncertain knowledge. Fuzzy set theory is shown to have certain advantages over other methods of dealing with uncertainty and has been employed in developing this knowledge based system. The research began with an evaluation of sub-contractors' selection and appointment as it is currently performed by refurbishment contractors. This exercise consisted of a wide range of criteria of which information is both qualitative and subjective in an unstructured intuitive manner with considerable reliance on the judgement of the evaluee. Thus, the research focused on a more formalised approach to the subcontractor's appointment. An adaptation of the Repertory Grid knowledge elicitation technique and subsequent grid analysis provides a methodology for organising logically related propositions into a hierarchical structure. A prototype knowledge based decision support system SSARC, for the selection and appointment of the most suitable sub-contractors for refurbishment projects, has been developed. This system represents a contribution in this area of research into refurbishment contracts which has been largely neglected to date.

According to findings presented in literature, construction projects are restrained within budgeted cost. Hence, the operational system is challenged within prohibitive cost limits to deliver projects at a stipulated time and at a satisfactory quality. This has prompted the intention of establishing effective management of cost constraint on building project delivery in South Africa. Data for the main study were collected through observations, semi-structured and unstructured qualitative interviews and quantitative close-ended questionnaires administered to construction stakeholders working in the Western Cape and Gauteng provinces, South Africa. Findings are that the following are factors that affect cost during building production process: additional works without contractual procedure, inadequate co-ordination of design phase and construction phase during production by project managers, financial mismanagement, frequent changes in design, cost of materials in the market, fluctuation of price of materials. Additional findings are proper monitoring and controlling at stages during production, procurement of competent contractors and subcontractors, involvement of experienced professionals in production, proper briefing by the client during production process, targeting quality during production, prompt decision taking during production, and the establishment of effective communication systems on site during production, frequent changes in building design by the client during production affect construction cost; frequent changes in building design during production cause rework; changes in building design during construction caused by errors and omissions detected affects quality of project delivered; and specification due to procurement of new materials during construction causes changes in building design, labour productivities, wrong planning for machine usage on site, late delivery of equipment during production and unanticipated increases in prices of building materials. Late delivery of materials also affects production process. Regular meetings on site will promote efficient productivities of human resources, team work on site during production, general progress reports on site during production, projects schedule/timetable for production and work programmes for site activities. The study concluded by recommending that proper adoption of these findings by the South African construction stakeholders during production processes will enhance delivery of building projects at reduced construction resources, at the standard of quality expected, at the time stipulated, at the budgeted cost specified, and to the satisfaction of the client. Interest will be achieved as illustrated under each objective of the research study. This research recommends further investigation of the effects of building material supply management during production processes in the South African construction industry.

Blockchain technology with its distributed ledgers attracts massive attention today and creates interest in many different industries. One of the most promising areas for implementation of blockchain technology is its use to create fully automated and decentralized contract solutions, so-called smart contracts. The blockchain technology is also expected to develop the concept of BIM by facilitating the creation of a common model. The problem addressed in this study is the limited amount of research carried out in the blockchain field and the potential use of smart contracts in procurement of services in the construction industry.  The construction industry differs from many other industries as it is project-based with changing circumstances and conditions. The study shows that the construction industry is an industry focused on discussions and disputes, the majority of which are linked to payments and contractual interpretations. Two of the key concepts of the study are therefore moral hazard and opportunistic behavior. Opportunistic behavior can affect norms, the willingness for cooperation and the degree to which parties trust each other. Designing contracts to reduce the risk of moral hazard and opportunistic behavior is therefore an important aspect. The study has chosen to study both relationships that are hierarchical to nature but also peer-to-peer.  The purpose of the study has been to conceptually reflect on percived opportunities and challenges with blockchains in the construction industry regarding two identified applications, smart contracts and BIM. To investigate this, a qualitative interview study has been conducted. The study points to the need for a more standardized building process that is subject to a certain degree of repetition to achieve successful use of a blockchain network and smart contracts. The study also shows that there is a positive attitude from the respondents regarding a possible development for several of the potential applications of blockchain technology. Blockchain technology and smart contracts have the potential to improve the reliability and credibility of logbooks, self-checks and work performed within a building project. Furthermore, the study highlights the importance of long-term relationships and confidence in reducing opportunistic behavior. Based on previous research and empirical analysis, the study contributes to an increased understanding of which levels in the construction industry smart contracts may be applicable. The study shows that smart contracts are not perceived suitable for complex contracts where the work to be performed can be changed many times during the contract period. The study, on the other hand, indicates that blockchain development with BIM is not demanded at the present time. Finally, the study points out that blockchain technology is perceived to have the potential to make the building process more transparent and open with reduced power conditions at the same time as it gets less centralized which opens up the need for research in that direction.
Blockkedjetekniken med sina distribuerade liggare lockar idag massiv uppmärksamhet och skapar intresse inom många olika branscher. Ett av de mest lovande områdena för implementering av blockkedjetekniken är dess användning för att skapa helt automatiserade och decentraliserade kontraktslösningar, så kallade smarta kontrakt. Blockkedjetekniken spås även kunna utveckla begreppet BIM genom att underlätta skapandet av en gemensam modell. Problemet som adresseras i denna studie är den begränsade mängd forskning som har utförts gällande blockkedjor och smarta kontrakts potentiella användning vid upphandling av tjänster i byggbranschen.  Byggbranschen skiljer sig från många andra branscher då den är projektbaserad med föränderliga förhållanden och förutsättningar. Studien visar på att byggbranschen är en bransch kantad av diskussioner och tvister, vars majoritet är kopplad till betalningar och kontraktstolkningar. Två för studien centrala begrepp är därmed moral hazard och opportunistiskt beteende. Opportunistiskt beteende kan påverka normer, viljan till samarbete och i hur hög grad parter litar på varandra. Att utforma kontrakt så att risken för moral hazard och opportunistiskt beteende minskar är därmed en viktig aspekt. Studien har valt att studera både relationer som är hierarkiska till naturen men också peer-to-peer.  Syftet med studien har varit att konceptuellt reflektera över uppfattade nya möjligheter och utmaningar som finns med blockkedjor i byggbranschen gällande två identifierade användningsområden, smarta kontrakt och BIM. För att undersöka detta har en kvalitativ intervjustudie genomförts. Studien pekar på att det krävs en mer standardiserad byggnadsprocess som omfattas av en viss grad av upprepning för att få en lyckad använding av ett blockkedje-nätverk och smarta kontrakt. Studien visar också på att det finns en positiv grundinställning från respondenternas sida kring en möjlig utveckling för flera av blockkedjeteknikens potentiella applikationer. Blockkedjetekniken och smarta kontrakt har potentialen att förbättra tillförlitligheten och trovärdigheten hos loggböcker, egenkontroller och utförda arbeten inom ett byggnadsprojekt. Vidare belyser studien vikten av långsiktiga relationer och tillit för att minska opportunistiskt beetende. Baserat på tidigare forskning, empiri och analys bidrar studien till en ökad förståelse kring vilka nivåer inom byggbranschen smarta kontrakt kan vara applicerbara. Studien förevisar att smarta kontrakt inte uppfattas lämpa sig för komplicerade kontrakt där arbetet som ska utföras kan ändras många gånger under kontraktsperioden. Studien indikerar däremot att blockkedje utvecklingen med BIM inte efterfrågas i dagsläget. Slutligen pekar studien på att blockkedjetekniken uppfattas ha potential att göra byggprocessen mer transparent och öppen med minskade maktförhållanden samt mindre centraliserade vilket öppnar upp behov av forskning i den riktningen.

The problem of determining an appropriate procurement form for the management of a construction project has been surrounded by controversy and strongly held opinions. The work reported here attempts to indicate some rational basis for choice in this decision by identifying those factors which significantly affect project performance, with particular reference to the distinctions between design build and traditional procurement forms. Two basic propositions are addressed by the work. The former is that design build forms perform better than traditional forms. This view is based on the conventional, construction industry view of the factors which affect performance. The latter is that contextual factors and the management and organisation of the construction process are the major determinants of project performance. This view stems from the application of management theory to the construction process and takes into account more and diverse variables than the conventional view. The factors which affect construction project performance are identified by reviewing three basic areas which are fundamental to the research. The first is the construction process and the way it has been treated and analysed in the past, which has been based around the traditional form of organisation. The second is the perceptions held concerning the design build process and how this procurement form has developed over recent years. A taxonomy of design build organisations is presented. Finally, the literature concerning project management, in general and specifically applied to the construction process, is reviewed and those factors which have been identified as affecting project performance identified. Following on is a review of performance measures which have previously been adopted. Based on this review a number of measures are chosen to compare performance (a mixture of objective and subjective measures). The foregoing leads to the situation where two research models are proposed and tested, by the formulation of related hypotheses, in two separate phases of the research process. A sample of 47 projects was used in the initial phase of the work and this was followed up by 27 detailed case studies in the subsequent phase. The data collected are analysed using partial correlation analysis as the principal analytic tool and the main results are reported below. The primary conclusion to be drawn is that procurement form is not a good predictor of performance. In general, the management, organisation and contextual variables are found to be more strongly associated with performance. Specifically, increased client complexity and dependence are found to be associated with reduced performance, as are increased project complexity and uncertainty. Document certainty and completeness and the degree of competition in letting construction works are all factors found to affect performance. Familiarity and differentiation are organisational factors which are found to be strongly associated with performance. Finally, it is shown that different procurement forms can be located on a structure grid and that those organisations which are appropriately located are associated with higher levels of performance.

The objective of this thesis is to explore BIM, IPD and their implementation into a building project contract. The Integrated Delivery Processes is comprised of a collaborative team of Designers, Constructors, and Owners working side by side to create a successful project. BIM has been introduced as a technology into the industry, as a tool that these parties can use for better understanding the project. Through case studies of IPD projects using BIM are observed, it was determined that although BIM was used, one problem faced is the lack of BIM standards included initially in a contract for in an IPD project. There are templates available by the AIA, AGC, and USACE, but they are not all standalone documents. A guideline for the parities to discuss will be introduced as conversation piece that would help segue into what might be included in the contract documents.

Since 1976 public agencies in Oregon have been allowed to select construction contractors using a "qualification" based competition instead of the more typical lowest responsible bid or Design-Bid-Build (DBB) basis. Since 1985, at least 136 such selections, commonly known as CM/GC for Construction Manager/General Contractor, have been made. The results of this policy have not previously been analyzed. This research compares these selection methods, seeking to answer the following questions: Does the CMl/GC method result in projects that differ from DBB projects regarding cost and schedule control? Are CMl/GC projects more efficient than DBB projects, where efficiency is defined as the data envelopment analysis (DEA) technical efficiency score? Does efficiency depend on an interaction between project type and the selection method? How do project stakeholders evaluate the benefits and drawbacks of the two selection methods? How do projects compare when the only apparent difference between them is the selection method? To answer these questions, we identified 407 Oregon public building construction projects and obtained a variety of data, including cost and schedule results, for 215 jobs (111 CMl/GC and 104 DBB). We analyzed the data several ways, including statistical analysis, DEA, and various qualitative methods. Results: There was no statistically significant difference between the CMl/GC and DBB projects regarding cost and schedule control. The DEA technical efficiency scores showed that CMl/GC projects outperformed the DBB projects. There was no interaction effect between project type and selection method. Project stakeholders stated that reduction of risk is the principal benefit of using CMl/GC; however, architects and subcontractors are less enthusiastic than owners and general contractors. Data on two nearly identical projects indicated that the DBB project was less costly than the comparable CMlGC project and also incurred less cost growth; both projects were completed on time. To summarize, this research fails to find support for the current Oregon law that exempts certain projects from competitive bidding based on the presumption that CMl/GC will lead to substantial cost savings but does indicate that the CMl/GC projects may be better able to accommodate accelerated project schedules.

A new government gives room for new ideas and the implementation of these. In the case of public private partnerships, it is more that the government is brushing of the dust from something the same governing party (The Conservative party, Høyre) started the last time they had governing power in Norway. In 1998, they started three trial PPP projects in road infrastructure. This is some years ago, and with the rejuvenated focus on PPP, it would be wise to see how the three first projects faired compared to the more traditional way of organising the construction of roads in Norway. A key characteristic of public-private partnerships is that the two tasks of building a facility and subsequently operating it are bundled and delegated to a single private contractor, while under traditional procurement, separate contractors are in charge of these two tasks. This thesis seeks to find what contracts and financing possibilities there are, as well have a look at what the different types offer. The aim is to find out whether it is possible to use the market even better in order to find a solution to build roads with a span longer than the finalisation of the road. By that, the meaning is taking the operation of the road into account. In order to answer these challenges, the aim of this thesis seek to: (1)Create an overview over contract details in the three existing Norwegian PPP projects and compare it to the traditional contract formulation regarding both construction and later operation of the road. The aim is to find a way to describe the governance and payment scheme for PPP compared to traditional contracts.(2)Consider factors that influences the LCC in the PPP contract E39 Klett-Bårdshaug, and evaluate findings with traditional construction and operation contracts.(3)If possible, find a conceptual estimate for the LCC at E39 Klett-Bårdshaug, compared to LCC for similar road elements (road in the day, bridge, and tunnel) from traditional road construction contracts regarding both construction and operation. When looking at what elements in the PPP project E39 Klett-Bårdshaug that effect the LCC, several factors that can be hard to transfer to traditional contract forms is identified, including total enterprises such as the road development contract. The payment model and scheme is something you only get with a PPP project. The findings shows that it is reasonable to attribute many of the positive sides of PPP to the payment scheme, but also most of the negative sides. The road development contract tries to implement some of the positive sides, and the results of the test project in E6 Helgeland will show the output.There are clear differences between the PPP contract used in Norway, and the examples being used as a deterrent against using it. The finance and payment profile in the Norwegian contract will not be affected in the same way by the financial crisis as in other countries. In other countries, the reduced traffic amount due to the crisis lead to the need for governmental support in order to keep the projects going. Some of these projects have changed to a payment scheme more similar to the Norwegian one, where the toll income goes to the Government, which in turn pays out the money from the toll stations and ads over the budget if the tolls does not cover the needed payment sum.Getting relevant figures from the PPP projects turned out to be hard, the same when it came to similar traditional construction and maintenance projects. A report containing general maintenance and construction figures was acquired, which made it possible to do an estimate of what the maintenance costs of the PPP project would be if it were a traditional maintenance contract. The conceptual estimate show maintenance costs for the road according to NPRA standards. Through analysis of the traffic, an alternative way of measuring the traffic is also presented.

Within the design community, a growing number of researchers have shown interest in extending the value context to include design, such that designers focus on maximizing the 'value' of the product or service, rather than simply satisfying a set of requirements. Thus, by applying a value-driven approach to design, the design community hopes to show that the magnitude of cost and schedule overruns may be reduced, or even eliminated. However, a common criticism of value-driven approaches is that they are difficult to implement, and not sufficiently pragmatic to be used for large scale engineering problems. Further, some argue that less rigorous methods appear to provide reasonable results in practice, and so rigor is not necessary. To reconcile these disparate viewpoints, it must be shown that value-driven approaches contribute to the design process, and can be implemented in practice at a reasonable cost. In response, I propose that the cause for the lack of practicality in value-driven approaches is attributable to the lack of well established and verified methods and tools. This dissertation presents research that attempts to address this deficiency by first developing a better understanding of effectiveness for methods that seek to enable value-driven design. This investigation leads to a concise set of desired characteristics for methods for guiding the development of value-models which then motivate the creation of a Systematic Method for Developing Value Models (SMDVM). To evaluate the SMDVM, it is applied to the design and retrofit of buildings for energy efficiency. A simulation workbench is developed as a tool to automate the development and analysis of value models for building design and retrofit contexts. The workbench enables architects, engineers, and other practitioners to easily incorporate uncertainty into analyses of building energy consumption, as part of a value-driven approach to design and retrofit.

Building production in public institutions, especially higher education buildings, has received large government investment in recent years. These investments contributed to increasing concern over the environmental issues and the quality in projects development in these institutions. The REUNI program, for example, contributed to the growth and expansion of Federal Universities, between 2007 and 2012. In this context, it is detected that, most of the delays in project development in public institutions, are caused by the characteristics of contracting and the project management in these kind of institutions. Also, public institutions contracts often hire professionals from different companies that usually do not work as an integrated team, plus they have communication difficulties and problems to understand the scope, that ended up causing incompatibility between projects and rework. Also, public institutions contracts often hire professionals from different companies that usually do not work as an integrated team, plus they have communication difficulties and problems to understand the scope, that ended up causing incompatibility between projects and rework. Besides, there is a growing demand for sustainable buildings and the projects still do not incorporate sustainability concepts. Therefore, the objective of this research is to develop a Referencial Term for project contracting in public institutions, modeling the process according to the principles of Concurrent Design and incorporating sustainability concepts into this Term, through a case study of a public institution, in order to contribute to improving its design process management. To achieve the objective it was made a documentary and bibliographical research and a case study in a public higher education institution. The methodology was divided into six steps: literature review; description case study and first diagnosis; comparative of referencial terms and second diagnosis; selection and organization of sustainability concepts; development of the referencial term; validation, result analysis and future proposes. As tools to develop these steps, it was used design process and models of referencial terms, as well as, it was researched strategies, criteria and recommendations for environmental sustainability, surveyed in bibliographical sources. Also, it was used comparative tables produced by spreadsheets, flowcharts and checklists. As a result of this study, the design practice of the institution was registered, environmental sustainability concepts were inserted into design process, also, it was possible to develop, apply, analyze the Referencial Term proposed and validate it by an officer of UFS. This work contributed to improve the quality of the design process in the public institution researched and the Referencial Term proposed can be used in other public institutions.
A produção de edificações em instituições públicas, principalmente as de ensino superior, vem recebendo grandes investimentos do governo nos últimos anos. Tais investimentos colaboraram para o aumento da preocupação com as questões ambientais e com qualidade no desenvolvimento dos projetos nessas instituições. Como exemplo, cita-se o programa REUNI que, entre 2007 e 2012, contribuiu para o crescimento e a expansão das Universidades Federais. Neste contexto, observa-se que os atrasos no desenvolvimento dos projetos em órgãos públicos se devem às particularidades de contratação e ao gerenciamento dos projetos. Ademais, nas contratações públicas, os projetos são desenvolvidos por profissionais de empresas distintas, que não trabalham de forma integrada e têm dificuldade de comunicação e de entendimento do escopo dos serviços, gerando incompatibilidade entre os projetos e retrabalhos. Aliado a isso, busca-se o desenvolvimento de edificações sustentáveis, no entanto, os projetos ainda não incorporam conceitos de sustentabilidade socioambiental. Nesse sentido, o objetivo desta pesquisa é elaborar um Termo de Referência para contratação de projetos, modelando o processo de acordo com os princípios do Projeto Simultâneo e incorporando ao Termo de Referência conceitos de sustentabilidade, através do estudo de caso de uma instituição pública contratante, de forma a contribuir para melhoria do gerenciamento do processo de projeto da instituição. Para tanto, realizou-se pesquisa bibliográfica e documental e o estudo de caso na Universidade Federal de Sergipe. A metodologia foi dividida em seis etapas: revisão de literatura; descrição do objeto de estudo e 1º diagnóstico; comparativo de termos de referência e 2º diagnóstico; seleção e organização dos conceitos de sustentabilidade socioambiental; montagem do Termo de Referência; validação, análise dos resultados e propostas futuras. No desenvolvimento dessas etapas, utilizou-se como ferramentas os modelos de processo de projeto e termos de referência pesquisados, bem como as diretrizes, os critérios e as recomendações de sustentabilidade socioambiental pesquisados em fontes bibliográficas, quadros comparativos elaborados com o auxílio de planilhas eletrônicas, fluxogramas e listas de verificação. Como resultado deste estudo, registrou-se a prática de projeto da instituição pesquisada, inseriu-se conceitos de sustentabilidade socioambiental ao processo de projeto, bem como foi possível montar, implementar, analisar o Termo de Referência proposto e validá-lo junto a um funcionário da UFS. Com isso, contribui-se para a melhoria da qualidade do processo de projeto no ambiente da instituição pública pesquisada e o Termo de Referência proposto poderá ser utilizado em outras instituições públicas.

Den 1 januari 2015 trädde en del ändringar i plan- och bygglagen i kraft. Detta då den dåvarande regeringen ville uppnå en effektivare planprocess, för att öka bebyggandet i riket. Lagändringen påverkade planprocessen samt förutsättningarna till upprättandet av genomförandeavtal. Genom övergångsbestämmelserna lades dock ett förbehåll in, för att reglera i vilka situationer äldre lagstiftning skulle användas. Detta förbehåll är att en detaljplan ska vara ”påbörjad” innan 1 januari 2015. Denna studie syftar till att undersöka när en detaljplan är ”påbörjad”.  Studien grundar sig på att nu gällande plan- och bygglag (fortsatt kallat PBL) samt tillämpningen av denna undersöks utifrån olika metoder. För att tolka juridiken kring begreppet, har ett rättsdogmatiskt förhållningssätt använts genom olika tolkningsmetoder. För att få en förståelse för hur juridiken tillämpas har ett rättssociologiskt förhållningssätt nyttjats. Detta har skett genom att en enkätundersökning utförts, där Sveriges samtliga kommuner tillfrågats hur de tolkar begreppet.  Undersökningen har påvisat att begreppet ”påbörjats” är oklart. I PBL regleras inte vad en ”påbörjad” detaljplan är. De definitioner som Boverket och regeringen har tagit fram är oklart formulerade. Den enkätundersökning som skickades ut till alla Sveriges kommuner gav ett varierande resultat som styrker teorin om att begreppet ”påbörjad” detaljplan är oklart. De befintliga definitionerna är i behov av förtydligande, för att likrikta kommuners tillämpning av dessa övergångsregler. Enkätundersökningen visade att 67 % av kommunerna tolkat begreppet ”påbörjad” efter de definitioner som Boverket samt regeringen utformat. Det som också framkommit genom studien är att skillnaderna i PBL innan och efter 1 januari 2015 är stora, vilket bland annat innebär att kommunens förutsättningar att upprätta detaljplaner och exploateringsavtal har förändrats.
1st of January 2015 some changes were made in the Planning and Building Act. This was made because of the Swedish government wanted to make the planning process easier. The law changes include the planning process and the development contracts for detailed development plans. The transitional provisions, however, made a reservation to regulate the situations in which older legislation would be used. The regulation is that older legislation should be used if the detailed development plan were initiated prior to 1 January 2015. The purpose of this study is to investigate when a detailed development plan is initiated.  The study is based on current legislation and its application, this will be investigated using various methods. To interpret the law about the concept, legal dignity approach has been used through different interpretation methods. In order to gain an understanding of how the law is applied, a legal sociological approach has been used. This was done by conducting a questionnaire survey, where all the municipalities in Sweden were asked how they interpret the concept.  This has shown that the term is unclearly defined, as evidenced by the varying answers received from the municipalities in the survey. However, the majority of municipalities interpret the concept "initiate" according to the definitions that the National Board of Housing, Building and Planning and the government have formulated. What is also evident from the study is that the differences in the different legislation are large and that the municipality's conditions change significantly depending on when a detailed plan is "initiated". The study also shows that the units within the municipality interpret the term in a generally similar manner. The result of the legal interpretation and compilation of the survey shows that National Board of Housing, Building and Planning and the government's definitions of "initiated" detailed development plan are unclear. And that the existing definitions are in need of clarification for the application of these transitional rules by similar municipalities.

Uppdragsgivare för detta examensarbete är Skanska Sverige AB Region Stora Projekt, som arbetar med stora bro- och anläggningsprojekt. Störst behov ligger i att få ökad kunskap om de Allmännai projekten. Arbetet med anbudskalkyler innebär att förutse projektkostnader och kostnaderna Allmänna kostnader utgör en betydande del av projektets totalkostnad och är svårkalkylerade. Generellt uttryckt utgör denna post de byggkostnader som används gemensamt i projektet. Nyckeltal komprimerar information i syfte att göra den mer lättillgänglig för användaren. Syftet med denna rapport är att få fram nyckeltal tänkta att i första hand användas till att kvalitetssäkra kommande anbudsarbeten. Det material och data som rapporten baseras på är intern information om referensprojekten och slutrapporter. För två av resurserna kan nyckeltal presenteras, samma gäller för en tredje baserat på att referensprojekten har liknande utförande. Det är rimligt för en fjärde. De resterande är för objektsspecifika och det finns för lite underliggande data för att kunna dra någon slutsats. För dessa krävs det fler referensprojekt för att kunna få fram tillförlitlig data.
The taskmaster for this thesis is Skanska Sverige AB Region Stora Projekt, who works with large bridge- and construction projects. Greatest need is to enhance the understanding of the General costs of the projects. Tender calculation means to predict project costs and General costs are a significant part of the project's total cost and is difficult to calculate. This post is, broadly expressed, the construction costs that are used jointly in the project. Ratios compress information in order to make it more accessible to the user. The purpose of this report is to present ratios primarily intended to be used to quality-assure future tender work. The material and data to which the report is based on is internal information about the reference projects and their final reports. For two of the resources ratios can be presented, the same applies to a third based on that the reference projects have similar design. It is reasonable for a fourth. The remainder is too object-specific and there is little underlying data to draw any conclusions. For these require more reference projects in order to obtain reliable data.

Recent years has seen a significant drive away from traditional procurement routes with contractors finding themselves with an increasing responsibility for control of design - a process they have had little experience in managing. They now have to adapt accordingly. The learning curve is steep, not least because many projects must now be delivered fast track while co-ordinating increasingly complex fabric and content of buildings without a platform of accepted good practice to manage the design process. This is a major factor preventing the UK construction industry from delivering projects on time, to budget and to the specified quality. There is a need to educate an increasing number of people in design management techniques to equip them to manage today's fast moving and demanding projects. However, many current design management tools are insufficiently developed for industry application. Therefore, to improve design management in the industry, current techniques must be modified to align them with the needs of the modern design manager. This research has developed and tested a training initiative aimed at improving design management practice within a major UK Design and Construct Contractor. It comprises a Design Management Handbook, Design Management Training, Team Support and Project Monitoring. The Design Management Handbook is the core of the training initiative. It addresses critical aspects of design management practice and provides design management tools. Training provides guidance to project teams on the tools and practices. In Team Support project teams are supported in the implementation of the new practices and tools to help embed new ways of working in company practice. Project Monitoring establishes the impact of the new practices on project performance to demonstrate that they are working and thus reinforce change. To establish the training initiative's effectiveness and key findings, the impact of the initiative on design management performance has been explored. The research has established which practices and tools were used, which were not, as well as an understanding the applicability and performance of each Handbook practice and tool. From this, barriers to implementing new design management tools in industry were identified and strategies developed in order to overcome such barriers.

Building contractors are unhappy about the existing post-tender use of the bills of quantities, particularly the way in which data produced by the estimator may be independently produced again or amended to a suitable format by other management functions. This research aimed at proposing better formats and presentations for the estimating data in order to reduce the repetition and re-work involved in the post-tender use of estimating data, hence to reduce the complexities in data flow in building contractor organizations. The work was primarily carried out for the Sri Lankan industry. To establish the scale and nature of the problem, past work on the format and presentation of estimating data and its current management was studied through literature, interviews and discussions with professionals in ten case studies. Proposals were formulated defining; an efficient classification and coding system, a well defined library structure, a new format to the contractor's copy of the estimate, and effective uses of the computer. The main proposal was to split the unit rate into its components and to provide a breakdown of resource requirements for each bill item. The documents prepared in two test projects were used to demonstrate the feasibility of the proposals in the earlier case studies, and feedback was obtained on the use and extent of use of the improved estimate in post-tender works. A live project was undertaken to investigate the practicability of implementing of the proposals. Finally, an independent survey, without disclosing the results derived from test projects, case studies and the live project was carried out to assess the acceptability of the proposals in the whole industry. All practical work was undertaken in Sri Lanka. The main conclusions derived from these works are; Any research that would investigate the contractor's efficient post-tender use of estimates hould be addressed to contractor organisations; and any proposal that would improve the contractor's data management should be based on contractor's presentation of the estimate. Although the contractors widely use the estimate in their management functions, the full potential is not obtained throughout the contract. Substantial re-work exists in the use of estimate in contractor's post-tender works. The average extent of use of the estimating data was measured at 50% the other 50% of data required re-work. Proposals presented in this research would increase the extent of use of the estimate, hence improve the contractor's data management. The new average extent of use of estimating data (after the introduction of proposals) derived from case studies was 75%. This new average, when compared with the earlier average (50%) showed a 50% possible improvement in the extent of use of estimate in the industry. Test projects, the live project and the independent survey, all showed that the proposals are not only feasible and practicable to implement in contractor organizations, but also acceptable in the whole industry as solutions which would improve the extent of use of the estimate and reduce the complexity of data flow in contractor organizations. The significance of these conclusions is that any contractor organization can adopt the proposals to improve their management because not only has their practicability been investigated but also their acceptability in the whole industry in Sri Lanka as a solution to data complexities is established. The conclusionsa re also of value to other countries.

Bunge is a global agribusiness company that has invested in a facility to produce extruded ingredients and inclusions in its Woodland, California rice mill. Because Bunge is not a branded food manufacturer, it is in a unique position to be a contract manufacturer to a variety of customers without the potential for a conflict of interest. Also, because Bunge is primary in three of the most common ingredients for extruded products, corn, rice and oil, this would be a move down the value chain that would allow it to be more competitive. The initial investment in Woodland has allowed Bunge to learn more about the manufacture of extruded ingredients and inclusions and also gauge overall market demand. A possible next step would be to build a second facility in the eastern half of the United States to expand capacity and be geographically situated to supply the Midwest, South and Northeast regions of the U.S. In order to begin exploring the possibility of a greenfield expansion into the contract manufacture of extruded ingredients and inclusions, this thesis considers three subjects. The first is a customer survey case study, which discovers the customer found high price and whether or not the manufacturer was considered a strategic partner to be the most significant factors in how desirable a manufacturer is. The second subject considered is the ideal location for a second manufacturing site based on a number of factors, including distance from both the customer base and inputs, labor issues, and any savings associated with a particular site. It was found that distance from the ultimate customer may be less important overall than the other factors. The third and final component of the research involved conducting a financial feasibility study. The analyses were conducted under alternative scenarios and subjected to a sensitivity analysis on a number of crucial variables. The weighted average NPV for the alternative scenarios was about $31 million and the IRR of 13.8% cleared the company’s investment hurdle rate. The payback period was estimated to be just under six years. All these suggest that the project as presented in this research is feasible and any investment in it, subject to the absence of any unforeseen event, will be profitable. It is hoped that this information can be used as a starting point and a guide to consider a future investment based on demand and other market indicators available at the time such a decision is required.

Although the United States has hired private contractors to execute government-funded work since its inception, these contractors have become increasingly more common since the 1980s. The United States Agency for International Development (USAID) has been no exception; the number of for- and non-profit contractors designing and implementing international foreign aid projects has proliferated. The complicated relationships among USAID, nonprofit, and for-profit contractors raise important questions about the factors that influence 1) which types of organizations receive contracts, and 2) which characteristics increase the likelihood that contractors will form inter-organizational partnerships via their work on USAID's contracts. This dissertation explores both by examining 232 contractors that implemented USAID's democracy-building projects abroad 1999-2004. First, logistic regressions were used to assess the influence of nonprofit organizations' political affiliations on their ability to obtain USAID's contracts. The results of these analyses suggest that that in certain years, nonprofit organizations with prominent, politically connected board members were more successful than others in obtaining USAID contracts. In other time periods, the composition of nonprofits' boards had no significant impact on organizational success in acquiring contracts.Second, this dissertation evaluates whether inter-organizational familiarity influences the likelihood of contractors partnering on USAID-funded contracts. The results of logistic regressions indicate that inter-organizational familiarity from past partnerships has increased the chance that organizations partner in certain time periods. These findings stress the role of organizational learning in their decisions to partner, as well as the impact of government programs designed to diversify the pool of available contractors. This research considers the ways that changing political environments influence the availability of resources for contracting organizations with particular characteristics. Moreover, it underscores the need to assess the contracting system in order to ensure that those chosen to implement government-funded work are as capable, innovative, and accountable for their work as possible.
