The textbook contains a systematic presentation of the main institutions of banking law in accordance with the academic discipline "Banking Law", taught at the Department of Banking Law of the Moscow State Law University named after O. E. Kutafin (MSLA). It examines the banking system of the Russian Federation and its structure; the features of credit institutions as subjects of banking law; the legal basis of the national payment system, its relationship with the banking system of Russia; the legal regulation of the deposit insurance system; legislation on bank accounts; the main types of bank loans; currency transactions carried out with the participation of authorized banks, and operations of credit institutions in the securities market. Attention is paid to the ratio of electronic money with electronic means of payment, the mechanism of non-cash payments and the procedure for implementing the institute of payment clearing. The proposed diagrams and tables facilitate the assimilation of the most difficult questions.

This chapter begins by setting out the Core Principles for Effective Banking Supervision produced by the Basel Committee in September 1997, reissued in a revised version in October 2006, and further revised in the light of the crisis in 2012. The 2012 revision of these principles focused on four major areas: corporate governance within banks; an obligation on supervisors to ensure that banks are appropriately prepared for resolution; an obligation for supervisors to assess bank risks in the context of the macroeconomic environment; and the idea that supervisors should have higher expectations of banks which are globally systemically significant than for other banks. The discussions then turn to capital regulation, constraints on bank capital regulation, quantum of bank capital requirements, whether the banking crisis proves that risk capital-based regulation failed, market crisis and regulation, and protecting the public from the consequences of bank failure.

This chapter describes the widening jurisdiction of the UK Banking Act 2009 (BA) to include—not only banks—but also regulated non-banks and non-bank group entities. The UK BA, as initially drafted, applied only to banks—that is, to the legal entities which held a UK deposit-taking authorization. However, since in general banks conduct their activities through banking groups rather than as single entities, it rapidly became clear that for a group of any size it was necessary for the resolution authority to act in respect of group companies other than the authorized bank. Thus, as from 1 August 2014, the resolution powers and tools set out in the Act can be applied to any UK-incorporated member of a bank group. The chapter also provides a detailed consideration of when the various powers may be exercised, and what the formal triggers are for the commencement of resolution.

This chapter explores bank resolution financing in the Banking Union, a project launched in 2012 as a direct response to the euro area’s crisis that began in Spain. The Banking Union is a streamlined and highly centralized regime for the supervision and resolution of all banks in the euro area and beyond, based on a novel, complex institutional set-up. The Union relies on supranational decision-making, especially with regard to the largest and most important banking institutions. The chapter assesses the Banking Union’s two-pronged institutional construction: the Single Supervisory Mechanism (SSM) and the Single Resolution Mechanism (SRM). It concludes by discussing how the Bank Recovery and Resolution Directive (BRRD) affects resolution financing in the Banking Union.

This chapter examines the statutory regime for the regulation of banks and banking in the UK. It first considers the development of UK banking supervision before discussing the traditional nature of bank supervision and the role and function of the Bank of England. It then reviews earlier and more recent crises in UK banking markets, including with regard to Northern Rock, and the circumstances surrounding the transfer of responsibility for bank supervision initially from the Bank of England to the Financial Services Authority (FSA) and then from the FSA to the Prudential Regulation Authority. It also analyses the main provisions contained in the Bank of England Act 1998, later amendments under the the Banking Act 2009 and the Financial Services Act 2012, and relevant sections of the Financial Services and Markets Act 2000 (FSMA). Finally, it explores the most recent changes announced with regard to ring-fencing, recovery planning, and resolution.

This chapter discusses banking group supervision. At first glance the necessity for the supervision of banking groups is not obvious. However, banks are now known to be subject to contagion risk. In theory the failure of a company which is a member of a bank group has no effect on the regulated bank. In practice, the failure of a company in a bank group will send a strong signal to the outside world that the group is in difficulty. It would in theory be possible to operate a group bank with such a degree of separation that the market as a whole believed that the bank would genuinely be unaffected by the failure of one of its subsidiaries. However, in practice the market believes that banks are closely connected with the groups of which they are members, and that failures elsewhere in a group will have important knock-on consequences for a group bank.

When designing a crisis management framework, a key decision for policymakers is whether to combine the deposit protection and bank resolution functions, or whether to create two separate bodies. This chapter sets out the United Kingdom’s approach to dealing with failing banks. In the United Kingdom, the deposit guarantee scheme, the Financial Services Compensation Scheme, is a separate institution from the resolution authority, the Bank of England, and the banks’ prudential supervisor, the Prudential Regulation Authority. The Banking Act 2009 provides for a framework within which the PRA, Bank of England, HM Treasury, and FSCS work closely with each other prior to and during a bank failure.

This chapter discusses the basic concepts of banks and banking. A bank is an institution that accepts deposits from the public and lends the monies thus raised. However, bank balance sheets include a range of types of exposures to a range of types of counterparties, which give rise to risks. To minimize risks, most banks diversify their lending across a number of different strategies and types of business. Both managers and regulators of banks have a task which in principle is relatively straightforward. These include understanding exactly which risks the bank is in fact exposed to; quantifying those risks; assessing returns which may be obtained through the taking of those risks; and assessing the degree to which the risks to which they are exposed are correlated to each other, in order to establish the total risk which is faced by the institution as a whole.
