There are many arbitrator colleagues throughout the world who knew him from international arbitrations and conferences, and admitted his talent and exceptional skills both as a practitioner arbitrator and as the leading official of the International Council for Commercial Arbitration ICCA over many years. This article aims to pay tribute to him whose passing is a great loss not only to the Hungarian but also to international arbitration and arbitrators.

This article explains how French arbitration law enables a party to turn to the French courts for arbitrations seated outside of France, when faced with the risk of denial of justice. It describes the jurisdiction and role of the French ‘juge d’appui’ (or ‘supporting judge’), in preventing a denial of justice in arbitrations that bear no connection to France. This lecture was delivered as the 2023 International Dispute Resolution Institute (IDRI) Annual Lecture in Abuja, Nigeria, on 28 April 2023. It discusses the major challenges and opportunities of arbitrating in a modern world. In doing so, it addresses the increasing digitalization of arbitration, the introduction of two main new types of arbitration, i.e., digital/online arbitrations on the one hand and free zone arbitration on the other, as well as the arbitration of new types of disputes, i.e., disputes involving economic sanctions and disputes related to human rights (HR). In this sense, this lecture offers a tour d’horizon of the changing face of arbitration in the 21st century, testifying to its innate procedural flexibility and adaptability. Arbitrators and arbitral institutions, in turn, are advised to adapt in order to stay relevant in the modernizing discourse of arbitration.

Arbitrations of competition cases are a relatively new phenomenon. The authors of this work were members of the ICC’s recent Task Force on Arbitrating Competition Disputes and this note is taken in large part from their report to the Task Force on procedural issues. This work touches on many procedural issues, including those that are somewhat predictable in arbitrations of competition disputes and those that are not. These include the power of the arbitrator to rule on the competition issue, the burden of proving a violation, as well as educating the tribunal on different competitive impacts in different jurisdictions, and the duty to render an enforceable award and how that plays in an arbitration of a competition case given the important public policy issues at stake. The effect of a ruling of a state competition authority is analyzed. Discovery issues are discussed as well, given their importance in complex disputes, and the note concludes with a discussion of the dispositive motion in competition disputes and how that type of motion might square with the policy of arbitration as well the enforceability issues it presents.

Abstract: This article deals with the relationship between the temporary reliefs and arbitration, with special focus on the innovations of the new Code of Civil Procedure and the changes in the Arbitration Act. In order to do so, first, a brief summary of the subject of temporary reliefs by the new Code of Civil Procedure is made, which is applicable to national and eventually international arbitrations. Secondly, the paper examines the recent changes of the Arbitration Law, whose new text establishes two phases, with two competent authorities for the granting of early reliefs: before the arbitration is instituted, the request is addressed to the courts; after the constituted arbitration, the request is directed to the arbitrator. At the end, an examination of the applicability of such devices is carried out and, also, decisions of the Brazilian courts on the subject are analyzed.

One year after the reform of Arbitration’s Law came into force, the moment requires an overcoming of the narrow focus about the unavailability of the public interest in order to let another issues flourish. Considering the enhancing of regulation over important sectors of economy to which arbitration has been linked as an ADR tool (ports, energy, PPPs, public procurement), the next step involves the harmonization of legal regimes aiming to endeavor arbitrations with public administration. This article analyzes the overcoming of the first obstacles’ phase and beliefs raised against the arbitration with public administration. In the first part some questions are addressed and few myths are pointed out. Next, the article presents some tools employed to overcome dogmatic premises. Further, it concludes with factual and practical aspects of arbitrations governed by the reform of Arbitration’s Law.

The Indian lawmakers have an agenda to promote India as an Arbitration hub for solving disputes, thus, they brought about certain changes to the Arbitration and Conciliation Act, 1996 by way of an amendment namely, the Arbitration and Conciliation (Amendment) Act, 2015 (“2015 Amendments”) which aimed at achieving this goal by facilitating speedy and efficacious resolution of disputes through arbitration. It is widely accepted that India prefers ad hoc arbitration over institutional arbitration. Though various arbitral institutions have been set up in India, especially in the last five years, ad hoc arbitration continues to be the preferred mode of arbitration. Moreover, a large number of international arbitrations involving Indian parties are seated abroad and administered by foreign arbitral institutions. In order to promote institutional arbitration in India, it is imperative that: (a) Indian parties involved in domestic and international arbitrations are encouraged to shift to institutionally administered arbitrations rather than resort to ad hoc arbitrations; and (b) India becomes a favored seat of arbitration for international arbitrations, at the very least in matters involving Indian parties. With this background, this paper delineates certain issues that exist in the Institutional Arbitration in India and identifies areas for reform in the Indian arbitration, to strengthen the existing arbitration mechanisms, and also to put forward focus areas for promoting institutional arbitration in India.

The existing theories pertaining to joinders and consolidations in arbitration present two contrasting schools of thought for examining multi-party and multi-contract arbitration requests. This article critically analyses the two opposing schools’ examination of joinders and consolidations to demonstrate the inadequacy of both. After highlighting the dire need for development of a fresh theoretical framework for assessing requests for joinders and consolidations, this article builds on consent-based theories to develop a ‘fragmented consent framework’ to understand consolidated arbitrations. This framework breaks down a party’s consent to arbitrate into consent for four major elements of arbitration and highlights various reasons why ‘consent to opposing/other arbitrating parties’ ought to be considered irrelevant for multi-contract arbitration-related questions. It concludes by highlighting the relative superiority of the fragmented consent framework as a method of assessing joinder/ consolidation requests, as compared to the existing theories.

Tax treaty arbitrations to date have only been rare. With the MLI and the Dispute Resolution Directive, however, numbers of arbitrations may reasonably be expected to go up. Authorities will have to face the question, whether they want to administer arbitrations themselves, or prefer to instead call on facilitation by professional arbitration institutes as is customary practice in such important areas as commercial or investment arbitration. Proper and effective administration will be a significant factor to the eventual success of tax treaty arbitration. Absent any guidance in either the MLI or the Dispute Resolution Directive, the issue requires careful consideration from authorities.

Abstract

As international trade is constantly increasing, the number of disputes between international parties is greater than ever. In view of the fact that it is difficult to get court judgments recognized and enforced, arbitration has gained a great foothold in international commercial disputes. The leading international legal framework for recognition and enforcement of arbitral awards is the New York Convention of 1958 with 142 Member States as of today. It simplifies recognition and enforcement of arbitral awards in foreign countries. Nevertheless, certain criterions are required to be fulfilled and a much-debated criterion is the writing requirement for arbitration agreements.

The writing requirement is found in Article II(2) of the New York Convention and it stipulates that an arbitration clause or an arbitration agreement must be signed by the parties or contained in an exchange of letters or telegrams to constitute a valid arbitration agreement, which is the foundation of a recognizable and enforceable arbitral award. The requirement in itself is clear, but the development of electronic communication and the fact that national courts interpret the writing requirement differently, leads to dissimilar requirements in various countries. Moreover, numerous new ways of how to conclude contracts have been established during the 50 years that has passed since the adoption of the New York Convention and the ever increasing number of disputes has questioned the function of the writing requirement. The UNCITRAL has, by adopting a model law, tried to accomplish a uniform interpretation and establish what it takes to fulfill the writing requirement. The starting point for the work of the UNCITRAL was to modify national arbitration legislation and thus reach the objective of harmonizing the writing requirement.

The thesis undertakes an international outlook in three countries, Australia, Italy and Sweden. These countries are all Member States of the New York Convention but there are great differences in their legislation. Sweden imposes no writing requirement and Italy has applied a very restrictive interpretation. Australia has incorporated the UNCITRAL Model Law. The international outlook illustrates how the interpretation depends on national arbitration legislation and attitude towards the writing requirement.

An analysis of the current general legal context shows a weakening threshold for fulfillment of the writing requirement. It is also evident that the writing requirement is not in line with how international trade is practiced today. The writing requirement frequently constitutes a formalistic problem regarding conclusion of contracts, as it comprise a requirement with-out function. In addition to this, the attempts of the UN have failed to eliminate uncer-tainty and the divergence in interpretation. To reach a uniform interpretation, an immense overhaul of the New York Convention is needed, alternatively that additional States adhere to the UNCITRAL Model Law and thus eliminate the national differences of today.


Sammanfattning

En ständigt ökande internationell handel leder till en ökning i antalet tvister mellan parter från olika länder. Då nationella domslut är svåra att få erkända och verkställda i en främmande stat har skiljedomsförfaranden ökat i antal. Regelverket kring att få en skiljedom erkänd och verkställd i en främmande stat utgörs främst av New Yorkkonventionen från 1958 med 142 fördragsslutande stater till dags dato. New Yorkkonventionen möjliggör att en internationell skiljedom lättare kan erkännas och verkställas i en främmande stat. Dock måste vissa kriterier vara uppfyllda och ett av de mest omdebatterade och domstolsprövade kriterierna är det skriftliga formkravet för skiljeavtal.

Skriftlighetskravet regleras i Artikel II(2), New Yorkkonventionen och påvisar att skiljeavtalet måste vara undertecknat av parterna eller inkluderat i brev- eller telegramväxling för att vara giltigt. Ett giltigt skiljeavtal formar grunden för en verkställbar skiljedom. Kravet i sig är relativt tydligt men med teknologins frammarsch och det faktum att nationella domstolar tolkar skriftlighetskravet olika har kraven för att uppnå skriftlighetskravet skiftat från land till land. Framförallt har olika sätt att sluta avtal tillkommit under de 50 år som New Yorkkonventionen har existerat och även det ökande antalet internationella skiljedomsförfaranden har ifrågasatt grunden för skriftlighetskravet. UNCITRAL har genom en modellag om kommersiella skiljeförfaranden försökt skapa enhetlighet om hur skriftlighetskravet skall tolkas och vad som krävs för att uppnå kravet. Utgångspunkten för UNCITRAL’s arbete har varit att förändra nationell lagstiftning och därmed uppnå målet om harmonisering av skriftlighetskravet.

Uppsatsen gör en internationell utblick i tre länder, Australien, Italien och Sverige. De tre länderna är fördragsslutande stater till New Yorkkonventionen men deras nationella lagstiftning skiftar markant. Sverige påvisar inte något skriftlighetskrav för skiljeavtal och Italien har tolkat skriftlighetskravet restriktivt. Australien har fullt ut inkorporerat den modellag som UNCITRAL har utarbetat gällande kommersiella skiljeförfaranden. Utblicken visar även i flera rättsfall hur olika tolkningen av skriftlighetskravet blir beroende på den nationella lagstiftningen och inställningen till skriftlighetskravet.

En analys av rättsläget påvisar att tröskeln för att uppnå skriftlighetskravet tenderar att luckras upp. Det framkommer även att skriftlighetskravet inte är i fas med hur internationell handel praktiseras idag. Skriftlighetskravet är ofta ett formalistiskt problem vad gäller avtalsslut och konstituerar ett krav utan funktion. Därtill har de försök som gjorts från överstatligt håll misslyckats med att undanröja osäkerheten och skiftningar i tolkningen. För att uppnå enhetlighet krävs en genomarbetning av New Yorkkonventionen, alternativt att fler stater anammar UNCITRAL’s modellag och därmed undanröjer de nationella olikheter som existerar idag.

Arbitration is a well-established and widely used method of resolution of disputes outside the state courts. There are various arbitration centers around the world. The Istanbul Arbitration Centre ISTAC is an independent, neutral and impartial institution providing efficient dispute resolution services for both international and domestic parties. The arbitral awards rendered under ISTAC Arbitration Rules are subject to enforcement by officers just as court decisions. ISTAC arbitration proceeding is carried out by The Sole Arbitrator or Arbitral Tribunal which consist of President and other arbitrators. The Sole Arbitrator or Arbitral Tribunal shall render the award on the merits of the dispute, within 6 months from the date upon which the completion of the signatures on the terms of reference. When the dispute is resolved by an Arbitral Tribunal, it shall decide by majority. In the absence of majority, the award shall be made by the President of the Arbitral Tribunal. The arbitral award contains information of parties and arbitrators, the reasoning of the award, the decision, the decision concerning the costs of the arbitration. The awards are signed by Sole Arbitrator or Arbitral Tribunal. The Sole Arbitrator or Arbitral Tribunal may correct ex officio any computational and typographical errors in the award within 30 days of the date on which the award was rendered. The arbitration proceedings are terminated by the issuance of the award or by the occurrence of any circumstances which are stipulated under ISTAC Arbitration Rules Article 3.

One of the most common alternative dispute resolution methods used in the Sri Lankan construction industry is arbitration. However, challenging arbitration awards based on legal grounds at the courts has been a current trend by the disagreeing party. If this situation occurs continuously, the purpose of having arbitration as an alternative dispute resolution method can be abandoned. Therefore, the study aims to identify the causes where arbitration is challenged in multi-story building construction projects in Sri Lanka through a case study. The methodological choice was qualitative and used semistructured interviews from six arbitrators and 2 case studies that referred to courts to challenge arbitration awards as research strategies. The study found the poor attitude of parties, lack of technical knowledge, reliability, and capability of the arbitrator to act according to the arbitrary acts imposed by the government as the main causes. Further. The study recommends arbitrators consider the reasons to act well enough and reject the cases if the arbitration is likely to be challenged in courts, train arbitrators to be reliable and on technical knowledge, and improve parties' attitudes by educating on the arbitration procedure and its benefits. This paper analyses the issue of “third-party funding”, something widely criticised in investment arbitrations. It is an issue addressed both through UNCITRAL Working Group III and in the amendment of the ICSID Procedural Rules (the current version adopted on 21 March 2022). The author discusses the issue and why it has been seen as problematic, then focuses on proposals for solutions discussed in debates. Finally, she compares the proposals discussed in UNCITRAL Working Group III with the newly adopted amendment of the ICSID Procedural Rules.

Because of exportation and importation of countries, the amount of commerce enlarged, therefore foreign agreements increased. Because of having differnet law systems of the contries the people, working on permanent investment and commerce wishes to have the suitable arbitration that they want.From this point of view, begining from the year 1898, It has been worked on to develop contraptions do international authorized commercial court’s duty. Then permanent arbitration council was established, Cenevre Convention, New York Convention was established, and the rules of international arbitration called UNCITRAL was constituted. The countries which are the contracting parties of these agreements, agreed that the implement of rules on their own domestic law systems. In addition, they delegated compulsory execution for these rules. Beside this, to organise the international commercial arbitration, countries and private institues are founded arbitration institues. Today there are hundereds of international commercial arbitration institues, which are called as the same name of their city’s, the most favorite and their woking systems are explaned.

The article considers the relevance of arbitration courts in the modern legal space. The historical aspects of the development of arbitration courts are revealed. The concepts of "arbitration court" and "arbitration proceedings" have been defined. The regulatory and legal framework for the functioning of arbitration courts, methods of formation of an arbitration court are considered. The features of arbitration proceedings are disclosed, as well as the advantages and problems of the arbitration court system are studied.

This study examines the question, of whether the pervading disappointment surrounding the practice of commercial arbitration in Sri Lanka, is due to the assimilation of court practices into commercial arbitration by the legal practitioners. Arbitration as an Alternative Dispute Resolution (ADR) method to judicial processes was introduced with the enactment of Arbitration Act No.11 of 1995 and hailed as an effective ADR for the resolution of commercial disputes. Participants were ten senior legal practitioners involved in both court practice as well as commercial arbitration for more than ten years in Sri Lanka. The study used a phenomenological research design to explore the perspectives of ten participants. It was hypothesised that the legal practitioners involved in both court and commercial arbitration practice would have a deeper understanding of the disappointments surrounding commercial arbitration practice and why commercial arbitration has not yielded the anticipated result of efficiency in dispute resolution over court practice. The results indicated that the same practitioners in court and arbitration, bring the same attitudes and skill set practised in courts into commercial arbitration. Thus, the emerging theme is to create an attitudinal shift in the participants of commercial arbitration for the speedy resolution of disputes in comparison to formal court practice. Commercial subjects and their relations in the trade of goods and services lead to disputes between participants as a result of non-fulfillment of rights and obligations which derive from concluded contracts. This kind of disputes as well as inefficiency of national courts are the main reasons for finding alternative ways of fast and efficient way of solving disputes out of the national courts. Solving disputes out of the jurisdiction of the national courts derives from the will of the parties..The parties trough arbitration agreement agree to solve the dispute trough a third party in form of arbitration court. The arbitration agreement is valid if it has valid form and content Done analyzes indicate that the form of the arbitration agreement and the content of the arbitration agreement are the kind of questions that are not easy to give comprehensive and precise answer, although in the contemporary arbitration law it is widely accepted that the parties to the arbitration have freedom of consensual choice of the form and the content of the arbitration agreement. Thereto for the validity of the arbitration agreement it is needed fulfillment of particular material law terms with respect to general and special conditions which refer to the form and content of the arbitration agreement Because of that different aspects of material validity of the arbitration agreement differ in various states.
