Giorgio Agamben‘s work has been at the forefront of modern debates surrounding sovereign exceptionalism and emergency powers. His theory of the state of exception and engagements with Michel Foucault appear to focus upon sovereign power‘s ability to remove legal protections from life with impunity, described by the figure of homo sacer. Much secondary scholarship concentrates upon this engagement. This thesis contends that this approach is too narrow and assimilates Agamben‘s work into Foucault‘s own thought. Through his engagement with Foucault, Agamben‘s thought is argued to be immanent and directed toward questions of fundamental ontology. Agamben contends that the human being, and all social structures, including law, are defined negatively through being held in relation to an ineffable transcendent ground. This negativity is transmitted through the exception. In challenging foundational mythologemes, Agamben questions received conceptualisations of sovereignty, arguing that sovereignty is a mythologeme used to legitimate and justify governmental praxis. Agamben‘s immanent thought seeks to philosophically justify a messianic politics and form-of-life no longer grounded in negative foundations. This form-of-life Agamben terms ―whatever-being‖, a life lived beyond relationality. This thesis transposes Agamben‘s thought on exception, sovereignty, the human and power into the realm of legal reasoning. A form of ethical decision-making and precedent charitable to Agamben‘s thought is constructed, constituting a unique contribution to jurisprudence. This ethical decision focuses on whatever-being‘s singularity. However, Agamben‘s eschewing of relationality means this ethical decision-making is aporetic, still reliant upon a derivate form of relationality. This thesis illustrates how Agamben‘s thought is constructed through a misreading of Heideggerian hermeneutics and a failure to acknowledge its debt owed to Levinasian ethics. Agamben remains trapped within two critiques of his non-relationality, one drawn from Heidegger‘s hermeneutic circle of Being, the other drawn from Levinas‘s ethics of the Other. Ultimately, Agamben‘s philosophical conclusions are contended to be unsustainable

Defesa: Curitiba, 15/12/2016<br>Inclui referências : f. 128-134<br>Resumo: O presente trabalho pretende abordar o vínculo entre soberania e biopolítica na reflexão de Agamben, a qual investiga criticamente a tradição política Ocidental. Soberania e biopolítica não são, para Agamben, meras formulações teóricas consagradas, situadas temporalmente, mas estão implicadas em uma estrutura metafísica que opera de maneira absoluta em toda história política do Ocidente por meio da captura do vivente e da produção da vida nua. Nosso objetivo, portanto, é o de tornar inteligível a forma como essa vida nua - a vida do homo sacer - é colocada como, ao mesmo tempo, produto originário e fundamento da ordem política no Ocidente a partir da interrogação sobre o ponto oculto de intersecção entre o modelo jurídico-institucional e o modelo biopolítico do poder. No primeiro capítulo abordaremos o conceito de soberania a partir da tradição política com que Agamben dialoga, com destaque para Hobbes, Kelsen e Schmitt. Como resultado desse primeiro capítulo teremos a concepção de vida matável como fundamento da comunidade política, bem como uma primeira aproximação da estrutura da soberania, que se define pela exceção ou bando. No segundo capítulo nos deteremos sobre o conceito de biopolítica a partir da relação existente entre o pensamento de Agamben e o de Foucault, extraindo desse debate tanto o contraste entre as abordagens da biopolítica entre ambos os autores, quanto suas divergências e convergências metodológicas; além disso, lançaremos mão de uma interpretação biopolítica do trabalho de Arendt para a compreensão tanto do diagnóstico da politização da vida quanto da reversibilidade entre democracia de massa e totalitarismo. No terceiro capítulo aprofundaremos as noções mais essenciais do trabalho de Agamben, com destaque para o paradoxo da soberania, a estrutura de bando, a relação entre linguagem e direito, bem como anunciaremos, na esteira de Agamben, a necessidade de um pensamento para além da relação entre ato e potência, modelo que emprestou à tradição Ocidental a estrutura de bando. Por fim, delinearemos algumas considerações a respeito da noção de homo sacer, dando destaque para a crítica feita por Agamben à teoria da ambiguidade do sacro. Ao final da dissertação pretendemos ter esclarecido de que forma Agamben desenvolve suas reflexões a partir do fio condutor da inclusão originária da vida no direito, isto é, pela relação indissociável entre vida e direito, sacralidade e exceção. Souveraineté et biopolitique ne sont pas, selon Agamben, des simples formulations théoriques longtemps établies, situées temporellement, mais sont impliquées dans une structure métaphysique qui opère de façon absolue dans toute l'histoire politique de l'Occident à travers la capture du vivant et la production de la vie nue. Notre objectif est celui de rendre intelligible la façon dont cette vie nue - la vie de l'homo sacer - est, au même temps, mise comme produit originaire et fondement de l'ordre politique dans l'Occident, à partir de l'interrogation sur le point caché de l'intersection entre le modèle juridico-institutionnel et le modèle biopolitique de pouvoir. Dans le premier chapitre on traitera du concept de souveraineté à partir de la tradition politique avec laquelle Agamben établie un dialogue, notamment avec Hobbes, Kelsen et Schmitt. Comme résultat de ce premier chapitre on aura la conception de vie tuable comme fondement de la communauté politique, ainsi comme une première approche de la structure de la souveraineté qui se définit par l'exception ou le band. Dans le second chapitre on concentrera sur le concept de biopolitique à partir du rapport entre la pensée d'Agamben et celle de Foucault, ce qui nous permettra d'en extraire tant un contraste entre les approches de la biopolitique entre les deux auteurs, comme ses divergences et convergences méthodologiques; en outre, on fera appel à une interprétation biopolitique des oeuvres d'Arendt pour comprendre tant le diagnostique de la politisation de la vie comme celui de la réversibilité entre démocratie de masse et totalitarisme. Dans le troisième chapitre on approfondira les notions les plus essentielles du travail d'Agamben, en soulignant le paradoxe de la souveraineté, la structure de band, le rapport entre langage et droit, aussi comme il sera annoncé, dans la foulée d'Agamben, la nécessité d'une pensée au-délà du rapport entre puissance et acte, modèle qui a prêté à la tradition Occidental la structure de band. Finalement, on tracera quelques considérations sur l'homo sacer, en soulignant les critiques adressées par Agamben à la théorie de l'ambiguïté du sacre. À la fin de cette dissertation on envisage avoir éclairé de quelle façon Agamben développe ses réflexions à partir du fil conducteur de l'inclusion originaire de la vie dans le droit, c'est-à-dire, par le rapport indissociable entre vie et droit, sacralité e exception. Previous issue date: 2014<br>This study investigates the notion of state of exception in Giorgio Agamben as an apparatus that captures the life of the citizen through its own suspension, an empty space of law, a zone of anomie in which all legal determinations come into a zone of indistinctness. The theorization of this legal institute is developed in a perspective of an genealogical and paradigmatic approach in order to situate it on the threshold of the contemporary world and its political consequences and what may mean to act politically today. In order to analyze modern theories of state, the italian thinker employs an artifice of Roman law: the iustitium – ‘the suspension, stoppage of law’, that produced a legal vacuum. In the Modernity, the state of exception operates continuously with multidimensional forms in which the concentration field is the modern paradigm of the nomos an the “bare life reaches its maximum indeterminacy”. In the state of exception which unites norm and life, that applies disapplying itself, produces an anomie zone, the challenge is to paralyze the biopolitical machine of the state of exception which determines life on multiple levels, since the earliest eras of Western civilization.<br>Este estudo investiga o estado de exceção em Giorgio Agamben enquanto dispositivo que, por meio do direito captura a vida do cidadão, pela de sua própria suspensão, um espaço vazio de direito, uma zona de anomia em que todas as determinações legais entram em uma zona de indistinção. A teorização desse instituto jurídico é desenvolvida na perspectiva de uma abordagem genealógica e paradigmática em vista de situá-lo no limiar da contemporaneidade, suas consequências em âmbito político, e o que ainda pode significar agir politicamente na atualidade. Ao analisar as modernas teorias de estado, o pensador italiano emprega um artifício do direito romano: o iustitium, ‘suspensão, paralisação da lei’, que em seu tempo produzia um vácuo jurídico. Na modernidade, o estado de exceção continua a operar de modo permanente sob formas multidimensionais, nas quais o campo de concentração é o paradigma moderno do nomos e a ‘vida nua atinge sua máxima indeterminação’. No estado de exceção que une a norma e a vida, que se aplica se desaplicando, pela força-de-lei, produz uma zona anomia, o desafio reside em paralisar a máquina biopolítica do estado de exceção, que determina a vida nas múltiplas esferas, desde os tempos primitivos da civilização ocidental.

DE ENSINO<br>A dissertação parte da afirmação feita por Agamben no prefácio de Estâncias de que a palavra ocidental encontra-se fraturada, cindida em um polo extático-inspirado [a poesia] e um polo racional-consciente [a filosofia], sem que nenhum dos dois consiga reduzir plenamente o outro. A partir desse diagnóstico, que retoma o tema platônico da antiga querela, delineam-se alguns dos modos como a relaçao aparece em parte da obra do filósofo (além do já citado Estâncias, A linguagem e a morte, o prefácio de Infância e história, Categorias italianas, Ideia da prosa e a seção acerca do sujeito em O que resta de Auschwitz), discutindo-se temas como som e sentido, dessubjetivação, inefabilidade do fundamento da linguagem e corpo e linguagem, privilegiando sempre o diálogo que Agamben estabelece com a literatura e trazendo poetas para o debate.<br>This dissertation begins with Agamben s claim in the introduction of Stanzas: the western word is fractured, split between inspired-ecstatic [poetry] and rational-conscious [philosophy] poles, neither ever succeeding in wholly reducing the other. From this diagnosis, which resumes the theme of the ancient quarrel, some of the ways in which the relation between philosophy and poetry appear in Agamben s work are delineated (in some of his writings such as Stanzas, Language and Death, the preface to Infancy and History, Categorie Italiane, Idea of Prose and the chapter about the subject in The Remnants of Auschwitz). Themes like sound and sense, desubjectivation, the ineffability of the negative foundation of language and body and language are discussed, always privileging the dialogue Agamben establishes with literature and bringing poets to the debate.

This thesis offers an adjunct to recent theories of the haptic contingent upon proximity by considering how embodied engagement might take place at a distance. Developing a broad definition of gesture as a motion away from the (carnal or camera) body that is nonetheless always attached to it, the thesis seeks a state of in-betweenness unmediated by touch. Two chapters explore this gesture-as-bodily-extension as an analytical approach to art. Each focuses on an insistently individual artist, according each a different theoretical approach in order both to do justice to that individuality and to test fully the potential and limits of the gestural approach in question. The first chapter focuses on the writings and films of the écrivain-cinéaste, Chantal Akerman, whose gesturality, equal parts literary and cinematic, is explored through Giorgio Agamben’s similarly language-based thoughts on gesture, the moving image and repetition. Charting a three-stage gesture of (displaced) demonstration (proximal, medial and distal) that finds its linguistic correlate in a triad of slippery shifters (là, làbas and ça), it examines how, and why, the artist, in a relentless process of ressassement informed by atrocities always one step away from first-hand experience, translates these to page and screen as the story of ‘la petite chose à côté’. The second chapter centres on the photographs, films and installation work of the artiste-cinéaste, Agnès Varda, using an approach developed from selected writings by the German art historian, Aby Warburg, the majority translated into English for the first time. As with Akerman, Varda’s work insists upon a spectatorship premised on distance, but it also demands complicity. Defining the viewing experience not as the still contemplation of moving images but as the active contemplation of still ones, the chapter explores the relation between onlooker and image by harnessing Warburg’s vision of a gesture encoded in the artwork that may be triggered anew through mobile, engaged and bodily spectatorship from afar; a vision underpinned by his concepts of the animated accessory (bewegtes Beiwerk), the memory-image (Erinnerungsbild) and the inbetween space of artistic encounter (Zwischenraum). Ultimately, this thesis asks, and answers, two questions. What can theories of gesture contribute to a close analysis of artists whose work demands distance? And do these highly individual artists exceed the scope of theory – and in so doing, expand it?

Critiques of messianic thought is taking place within philosophy and can be viewed in the light of a return of religion; the messianic can be thought of as a way to understand the contemporary situation. A returning messianic figure allows for a transformative and negotiating critique of how to think a secular messianism, and in a larger scale; a critique of a secular thinking which defines itself against the religious perspective. A messianism, redeemed from religious thought, appears as a model for rethinking faith and hope aswell as concepts of time and history. This essay performs a close reading of the Italian philosopher Giorgio Agambens book The Time that Remains, a Commentary on the Letter to the Romans, in which he states that the Pauline letter is to be read as the fundamental messianic text in the Western tradition. With the commentary Agamben argues that Walter Benjamin´s philosophy of history constitutes a repetition and appropriation of Paul´s messianic concept. The essay shows in what way Agamben extend the messianic thought within the textual, and thus; that the messianic has special claims within literature and poetry and that Agamben, in his correlated reading of Paulus and Benjamin, points in a direction of a metaphysic of literature and reading. The essay seeks to, with Agamben, establish a critique of the messianic model and to discuss and reflect upon poetry as a particular possibility to perform and transform time and memory. I do so through an interpretative reading of the poets Ghayath Almadhoun and Marie Silkeberg book To Damaskus, aiming to define and show how the messianic model relates to the poem and a particular conception of history.

This paper reports how according to Heidegger, Deleuze, and Agamben, both the notion of thinking and of philosophical activity, far from meaning the same, involve fundamental differences. However, our reading of the three authors also proposes to discover a common affiliation related to the contrast between “doxa” and “thinking”; Heidegger’s, Deleuze’s and Agamben’s are three ways by which we can understand the “birth” or “emergence” of thinking as an experience or activity that should not be understood as stemming from the field of communication or re-presentation. All these considerations converge finally in the subtle quality of thought as liminal “pow-er” that, according to each author, must also be understood in its paradoxical quality of “impotence”, quality much closer to the experience of in-corporation as an event (Heidegger); to the pre-supposed, non-discursive moment –and simultaneously con- stituent– of either philosophical, artistic, or scientific “creation” (Deleuze); or to the pure enjoyment of power, as the experience of a type of “deprivation”, both positive and unlimited, as well as eluding any “function” (Agamben).<br>El presente artículo da cuenta de cómo en Heidegger, Deleuze y Agambenlas concepciones sobre el pensar, por un lado, y la actividad filosófica, por otro, lejos de ser indistintas la una respecto de la otra, implican diferencias fundamentales. Sin embargo, nuestra lectura de los tres autores también propone descubrir una filiación común referida a la contraposición entre “doxa” y “pensamiento”: las de Heidegger, Deleuze y Agamben constituyen tres vías por las que podemos comprender el “nacimiento” o “surgimiento” del pensamiento, experiencia o actividad que no debe suponerse como efectuación posible desde el ámbito de la comunicación o re-presentación. Todas estas consideraciones confluyen, finalmente, en la calidad sutil del pensamiento como “potencia” liminar que, de acuerdo a cada autor, debe comprenderse también en su calidad paradójica de “impotencia”, calidad mucho más cercana a una experiencia de la in-corporación como acontecimiento (Heidegger); al momento presupuesto y no discursivo –y a la vez constituyente– de la “creación” ya sea filosófica, artística o científica (Deleuze); o al de la pura fruición de la potencia, como experiencia de una especie de “privación” tan positiva como ilimitada y que sesustrae a cualquier “función” (Agamben).

The argument presented in this paper is that during the Shoah the Nazis were attempting to further enforce the understanding that humanity is essentially self-destructive or superfluous. Several writings are examined more closely to support this argument: Emil Fackenheim's To Mend the World: Foundations of Future Jewish Thought (section IV), Hannah Arendt's The Origins of Totalitarianism (Part 3) and, finally, Giorgio Agamben's "Homo Sacer": Bare Life and Sovereign Power (Part 3). Each of these author's writings are used as a focus for a discussion of the self-destructive tendencies that are a part of Nazism in its relationship to: Law, the Idea of Man and Ideology. An effort is made during the discussion of these topics to arrive at an appreciation of the extremely alarming extent to which the Nazis had enforced the creation of a society that was wholly self-destructive.
This argument concerning the Nazi understanding of humanity also recognizes the creation of a society that is wholly self-destructive as an underlying threat that continues to pose an ongoing danger to the post-Shoah world. The recognition of this threat unfortunately demonstrates the relevance of the Nazi understanding of humanity to this world (a relevance which at the outset may not have been apparent). Amongst the challenges this poses is that as the creation of a wholly self-destructive society further intensifies the possibility for philosophy increasingly disappears.
In the concluding chapter, reference is again made to the writings of Fackenheim, Arendt and Agamben. These writings are referred to as part of a discussion of resistance to the threat of creating a post-Shoah world that develops into a society that is wholly self-destructive. Also included in this discussion is the importance of this type of resistance to the possibility for philosophy in this world.

Previous issue date: 2016-01-05<br>CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior<br>Neste trabalho dissertativo de mestrado buscamos investigar, a partir do pensamento arqueogenealógico de Giorgio Agamben, os contornos configurativos das influências teológicas que o poder foi ganhando ao se constituir numa maquinaria bipolar de soberania-governo no mundo ocidental. A pesquisa inicia com uma leitura da noção de anarquia da lei no estado de exceção como algo que está no cerne das investigações político-filosóficas de Agamben. Logo em seguida, tangencia o problema da bipolaridade na relação entre reino e governo diante da articulação que este mantém com a estrutura da maquinaria de governo. Dando sequência a esta investigação, buscamos cotejar o problema da governamentalidade teocêntrica e a noção de liberdade permissiva que esta concede à potência de ação que o ser humano carrega consigo no âmbito das possibilidades de intervenção no mundo. Outra questão que se faz relevante é a do mistério governamental presente no limiar das relações estabelecidas entre a teologia e a política. Neste horizonte, o problema da governança político-teológica no Ocidente é burilado tendo em vista uma melhor compreensão do problema da gestão da vida e das coisas. Esta asserção nos remete ao conceito agambeniano de dois paradigmas, a saber, o da teologia política e o da teologia econômica que são centrais na constituição de sua genealogia teológica da economia e do governo. Isto implica no estatuto teológico da economia e em seus desdobramentos constitutivos no que tange ao operar do Estado moderno. O desembocar desta questão se dirige para dentro da aporia personificada na noção de secularização que se estabelece na tensão entre as categorias de messianismo e soberania. Esta ideia forte opera no sentido de termos que consequentemente cotejar numa espécie de correlação epistemológica às categorias de messianismo e resto em seu prisma político. Como fundamentação epistêmica relevante gerada a partir desta noção correlativa, nos deparamos com a bipolaridade genealógica da soberania e governo no limiar entre o ser e a práxis econômica. Na genealogia de Agamben observamos a instauração de uma fratura operada pela teologia cristã entre o ser e o agir no cerne da natureza divina que se ergue como algo que nos dirige para dentro do problema do governo providente da liberdade humana e as conexões resultantes desta fratura teológica nas reais implicações existentes entre a soberania política e a práxis governamental. Por fim, tratamos do problema da crítica que Agamben tece à democracia como governamentalidade das massas e ao dispositivo da glória como legitimação da soberania moderna imanente as sociedades do espetáculo operadas pela máquina governamental de poder biopolítico que opera por meio das aclamações e do consenso das massas em gestão programada pelos meios midiáticos com o seu poder de persuasão e estabelecimento dos consensos no seio das democracias contemporâneas.<br>In this work we seek to investigate masters argumentative, from the arqueogenealógico thought of Giorgio Agamben, outlines the theological influences and or config that power was winning to become a bipolar-sovereignty government machinery in the western world. Therefore, we continue with our reasoning by a reading of the law notion of anarchy in the state of exception as something that is at the heart of the philosophical investigations of political Agamben along its extensive project Homo Sacer. Soon after, we give attention to the problem of bipolarity in the relationship between the kingdom and government on the joint that it has with the government machinery of the structure. Continuing this research, we seek to collate the problems concerning God-centered governmentality and the difficulty inherent in the idea of permissive freedom that this gives the power of action that the human being carries within operative intervention possibilities in the world. Another issue that we consider important and that we approach here is the government this mystery at the threshold of the links between theology and politics. Against this background, the problem of political-theological governance in the West is hulled towards a better understanding of the complex reasons involving the management of life and things. This statement brings us to the concept of agambeniano two paradigms that are, namely, the political theology and the economic theology. These paradigms are central to the creation of a theological genealogy of the economy and government. This implies the theological status of the economy and its constituent developments regarding the operation of the modern state in their calculations management of life. The culminate this issue goes into the stalemate embodied in the notion of secularization that is established in the tension between the categories of messianism and sovereignty. This strong idea operates in the sense of having to collate consequently a kind of epistemological correrelação the categories of messianism and rest in their political prism. How relevant epistemic justification generated from this corollary notion, we face the bipolarity family of sovereignty and government in the current threshold between being and economic praxis. In the genealogy of sovereignty and Agamben government noted the establishment of a fracture operated by Christian theology between being and act at the heart of the divine nature which stands as something that drives us into the government's problem provident of human freedom and resulting connections of this theological fracture in real implications existing between political sovereignty and economic government practice. Finally, we deal witht the problem of criticism that Agamben weaves democracy as governmentality of the masses and the glory of the device as legitimization of modern sovereignty inherent spectacle of societies operated by the state machine of biopolitical power that operates through the cheers and the masses consensus promoted by media means with its power of persuasion and establishment of consensus within the contemporary democracies.

Para alcanÃar tais objetivos, à preciso exemplificar e descrever os conceitos sobre estado de exceÃÃo, totalitarismo, biopolÃtica e vida nua. à preciso caracterizar e determinar como Auschwitz nasceu, como foi possÃvel conceber tal espaÃo de vida e de morte. à preciso entender e percorrer os caminhos que levaram a Alemanha, um dos berÃos culturais mais esplÃndidos da humanidade, a conceber e colocar em prÃtica o extermÃnio de milhÃes de pessoas consideradas impuras e socialmente indesejadas. Os campos de concentraÃÃo sÃo a mÃxima do totalitarismo que representam um limite, um extremo com um objetivo: a âdominaÃÃo total do homemâ. Dissertação apresentada para cumprimento dos requisitos necessários à obtenção do grau de Mestre em Ciências da Comunicação<br>Esta dissertação parte da ideia de que o conceito de dispositivo é o operador conceptual mais decisivo para pensar a experiência contemporânea. Para tanto, tomámos com objecto o conceito de dispositivo na obra de Giorgio Agamben e assim tentámos compreender como poderia ser útil o modo pelo qual Agamben pensa o conceito de maneira a perceber a relação prioritária da técnica com política. A primeira parte desta dissertação é uma abordagem às raízes do conceito de dispositivo na obra de Martin Heidegger e na de Michel Foucault pretendendo-se compreender a tradição de pensamento na qual o próprio Agamben se insere. Na segunda parte explorámos a importância que assume na obra do filósofo italiano o dispositivo teológico e, por outro lado, como é que a relação da política com a técnica é pensada pelo mesmo autor. Chegámos a duas conclusões: (a) uma das suas principais inovações foi demonstrar como o conceito de dispositivo é também devedor de um outro conceito da teologia cristã, o de oikonomia, assim Agamben mostra como a nossa cultura apelidada de secular depende da sua herança teológica; (b) a obra de Agamben, apesar das suas inovações falha na compreensão de que o principal dispositivo na nossa cultura é agora técnico, o que o leva a uma ausência de uma filosofia da técnica substancial no seio da sua teoria do dispositivo, que não lhe permite compreender amplamente os fenómenos políticos associados às novas tecnologias de informação e comunicação no contexto da nossa sociedade do controlo.

Previous issue date: 2017-08-01<br>Pretende-se, aqui, explicar a relação entre soberania e governo e evidenciar sua mútua inflexão, conforme o pensamento do filósofo italiano G. Agamben. Essa inflexão está mediada pelas ideias de ὀικονομία e δόξα. Para tanto, foi necessário, em um primeiro momento, explicar a metodologia agambeniana, e em seguida visitar a leitura da história do pensamento político-teológico. O método agambeniano é arqueológico e paradigmático, isto é, diante das dicotomias estruturantes da cultura ocidental, ir além das exceções que as produz, não para encontrar um estado originário, mas para compreender a situação hodierna. Assim, a arqueologia é uma via de acesso ao presente. Trata-se de superar a lógica binária transformando-a em bipolaridades, passar das oposições substanciais para campos de forças, percorridos por tensões polares, sem traçar linhas claras de demarcação. Quando Agamben fala da compreensão paulina do “messiânico” e sua capacidade de derrubar qualquer representação através da “divisão da própria divisão”, sinaliza o cerne “teológico” do mais básico empreendimento filosófico. A mais filosófica obra de Agamben sempre terá correlato teológico, assim como seus escritos sobre teologia sempre terão importantes conclusões filosóficas. Em consequência, a bipolaridade auctoritas e potestas assume agora a forma da articulação entre reino e governo e faz questionar a relação entre ὀικονομία e δόξα, entre o poder como governo e gestão eficaz e o poder como realeza cerimonial e litúrgica. O paradigma político estaria atravessado, desde a origem, pelo paradigma econômico. O ponto oculto entre ambos consiste no conceito, jurídico e político, de estado de exceção. Em suma, aquilo que caracteriza a política moderna não é tanto a inclusão da zoé na pólis, em si antiguíssima, nem simplesmente o fato de que a vida como tal venha a ser um objeto eminente dos cálculos e das previsões do poder estatal; decisivo é, sobretudo, o fato de que, lado a lado com o processo pelo qual a exceção se torna em todos os lugares a regra, o espaço da vida nua, situado originariamente à margem do ordenamento, vem progressivamente a coincidir com o espaço político, e exclusão e inclusão, externo e interno, bíos e zoé, direito e fato entram em uma zona de irredutível indistinção.<br>It is intended here to explain the relationship between sovereignty and government and to show their mutual inflection, according to the thought of the Italian philosopher Giorgio Agamben. This inflection is mediated by the ideas of ὀικονομία, glory. In order to do so, it was necessary, at first, to explain the Agambenian methodology, and then visit the reading of the history of political-theological thinking. The Agambenian method is archaeological and paradigmatic. It is, in the face of the structuring dichotomies of Western culture, to go beyond the exceptions that produce them, not to find an original state but to understand the situation in which we find ourselves. Archeology is the only way to access the present. Overcoming binary logic means turning the dichotomies into bipolarities, the substantial oppositions in the field of forces, traversed by polar tensions that are present at each point, without tracing clear lines of demarcation. Field logic versus substance logic. In turn, when Agamben speaks of the Pauline understanding of the "messianic" and its ability to overturn any representation through the "division of division itself", it is signaling the "theological" core of the most basic philosophical enterprise. Agamben's most philosophical work will always have its theological correlate, just as his writings on theology will always have important philosophical conclusions. As a consequence, the bipolarity auctoritas and potestas now takes the form of the articulation between Kingdom and Government and makes question the relation between ὀικονομία and δόξα, between the power like government and effective management and the power as ceremonial and liturgical royalty. The political paradigm would be traversed, from the origin, by the economic paradigm. The hidden point between the two consists in the concept, legal and political, of state of exception. In short, what characterizes modern politics is not so much the inclusion of zoé in the polis, in itself very old, or simply the fact that life as such becomes an eminent object of calculations and predictions of state power; It is decisive, above all, that alongside the process by which the exception becomes the norm everywhere, the bare life space originally situated on the fringes of the order is progressively coinciding with the political space , And exclusion and inclusion, external and internal, bíos and zoé, law and fact enter a zone of irreducible indistinction.

Giorgio Agamben ocupa, hoje, um lugar de destaque no pensamento e no debate
contemporâneo. A sua influência faz-se sentir em vários domínios desde a Estética à
Política, convoca diferentes posições concordantes ou críticas no interior da Filosofia ou
fora do seu território conceptual.
Situar e acompanhar (criticamente) o percurso da categoria de potência na obra de
Agamben e, em particular no seu pensamento político, implica não apenas esclarecer a sua
transversalidade e a sua relação com a actualização, mas as transformações a que conduziu.
Desde logo, perceber que a referida categoria passou a integrar um outro universo de
abordagem (presente nos últimos livros), onde se destaca a passagem da potência à
operatividade e à produtividade da acção. Referir a potência à negatividade da relação
soberana (nas suas várias configurações e contextos histórico-temporais) mas também à
instituição da vontade e à capacidade de agir é, precisamente, o propósito essencial desta

Potency and sovereign power on Giorgio Agamben’s Political Onthology
Giorgio Agamben is today one of the leading figures of contemporary thought and debate.
His influence is widespread in several fields, from Aesthetics to Politics, amassing
supporters and critics both within and outside Philosophy and its conceptual domain.
To situate and propose a critical analysis of the trajectory of the category of potency in
Agamben’s work, especially in his political legacy, we need to establish not only its
pervasiveness and how it relates to actuality but the changes it sets in motion. We need to
start by clarifying how potency has come to integrate another stance of approach (in the
later works), with the emergence of the central issues of how potency comes into
operativity and hence into productive action. This dissertation’s main purpose is precisely
to trace potency to the negativity of the sovereignty relationship (in its diverse historical
configurations and contexts), as well as to the establishment of the will and the ability to
act.

In the forty years separating Stanzas and the recently published final instalment of the Homo Sacer series, The Use of Bodies, Agamben has regularly turned to topological figures in pursuing his critical analyses of the biopolitical horizon of modernity. Topologies of Abandon provides the first sustained analysis of the topological orientation of Agamben's work, developing an alternative spatial genealogy of a series of key concepts and figures in Agamben's thinking. The thesis considers a series of conceptual topoi explored by Agamben and argues that his theoretical project consists of a series of interrelated investigations into the configuration of place and localisation: the ontological space of the exception, the location of the subject within language, and the place of life in contemporary configurations of power. In my analysis of each of these topologies I argue against the common conception of Agamben's work as providing a pessimistic and negative diagnosis of contemporary forms of biopolitical governance from which there exists little hope of emancipation. Paradoxically, the potentiality that marks Agamben's utopic topos of life is found in the place of an abandonment, and it is by exploring the negative and privative topologies of abandon in Agamben's work that the thesis seeks to re-orient future readings of the largely misunderstood affirmative dimension of this philosophical project. The thesis provides a comprehensive overview and analysis of Agamben's use of topological figures throughout his body of work. Considering Agamben's methodological use of paradigms, signatures, and archaeology from a topological perspective, the thesis reconsiders the relationship between the biopolitical studies of Agamben and Foucault on this basis. The project situates Agamben's topological interest within the context of a wider critical-philosophical turn to the field in the twentieth-century, showing that Agamben's work is influenced by the topological current informing philosophies of the lifeworld and the metalogical inquiries of structuralism. The thesis also reconsiders Agamben's relationship with the thought of his former teacher Heidegger in terms of the two thinkers' shared interest in a ‘topology of being'. Following the topological thread running throughout Agamben's oeuvre, I demonstrate how from his earliest works Agamben seeks to map out an affirmative topos of life that perforates the surfaces and limits of its philosophical, juridical, and political determinations.

This concern, founded in the theory of the double significance of language advanced by Émile Benveniste, extends in Agamben’s thought from the linguistic to the political, in which it is articulated in terms of the exception, the subject of that illicit intellectual exchange between Walter Benjamin and Carl Schmitt. Alternatively, Agamben also speaks of the taking place of language in terms of intentionality, a concept revived from Scholastic philosophy by Franz Brentano, a principal influence upon Agamben’s own principal influence Martin Heidegger. Brentano’s regeneration of intentionality directly paved the way for twentieth-century phenomenology, but his insistence on the likeness of philosophy and science, the organization of concepts into a classificatory system, and his animosity towards the linguistic have all arguably contributed to the restriction of his work to the margins of contemporary thought. How do these two notions, therefore, exception and intention, converge in Agamben’s thought, and what bearing does this confluence have upon Brentano’s largely forgotten original articulation of the concept? This thesis establishes an original reading of Agamben’s thought by tracing the evolution of the taking place of language in its multifarious appearances in his corpus, and locates an implicit correspondence between the thinker and his invisible predecessor.

Previous issue date: 2013<br>Resumo: Neste Trabalho, o escopo é analisar como Giorgio Agamben e Hannah Arendt pensam a política contemporânea, principalmente a relação da política com o direito. A intenção é mostrar que, apesar de ambos os autores partirem de diagnósticos da modernidade bastante parecidos, chegam a lugares bem diferentes no tocante à relação do direito com a política. Ambos parecem compartilhar, à primeira vista, um diagnóstico de esvaziamento do espaço público, o predomínio da violência nas relações, uma sociedade massificada, a vida biológica ganhando centralidade nos contextos políticos, etc. Porém, com base nessas premissas, Agamben chega a teses como o Estado de Exceção permanente, o campo (de concentração) como paradigma da política contemporânea, a contiguidade entre o totalitarismo e a democracia e o caráter essencialmente violento do direito, teses essas que não podem ser aceitas por Arendt. A intenção é demonstrar que mesmo Arendt compartilhando esse diagnóstico com sua concepção de política pautada na pluralidade e na liberdade, ela enxerga outras perspectivas para a política atual, como o papel da Constituição de garantir as liberdades públicas<br>Abstract: This study aims to analyze how Giorgio Agamben and Hannah Arendt think the contemporary politics, chiefly the relation between politics and law. The intent is to show that, although both authors derive from very similar diagnosis of modernity, they reach well-distinct places regarding the relation between law and politics. Both of them seem to share, at first sight, a diagnosis of public space emptying, the predominance of the violence in relations, a massified society, the biological life acquiring centrality in political contexts etc. However, based on those premises, Agamben get to theses such as the state of permanent exception, camp (concentration) as a contemporary politics paradigm, the contiguity between the totalitarianism and democracy, and the essential violent character of the law, such theses which cannot be accepted by Arendt. reflection on the fate of European democracy. According the philosopher, we no longer
live under the aegis of democracy and the governmental paradigm of our time could not
even be called political. The concept that replaced any political notions was that of
security, and the slogan "for security reasons" has taken on a worldwide scale the new
parameter of government of the contemporary political order. In order to understand this
diagnosis, Giorgio Agamben proposed, on that occasion, the invitation to carry out a
genealogy of the concept of security from an acute research on its origin and history in
the paradigm of state of exception. This dissertation aims, together with Agamben, to
untangle the concept of a state of exception, too demonstrating its implication and
relation with human life. The concept of exception state developed by Agamben during
the Homo Sacer project resumes the debate about the law between Carl Schmitt and
Walter Benjamin in the 1920s. We reconstitute this debate step-by-step to demonstrate
how essential it was for Agamben to contact the works of the German jurist for the
development of the theme of exception. It was, however, taking on Benjamin's side in
that discussion that the Italian philosopher was instigated to direct his fiercest criticisms
of the democratic state of law. It follows from this takeover of the diagnoses of being
the state of exception the governance paradigm of contemporaneity and the sign that the
state of exception inscribes sovereignty in a paradox. We also develop Agamben's
proposal to point to the confluence between the biopolitical model coined by Foucault,
but years before also diagnosed by Hannah Arendt, and the juridical-institutional model.
That is, the point where life and right touch the figure of the sovereign and the bare life.
What this dissertation also worried to point out from the title was how much the contact
with the theoretical contribution of Walter Benjamin was decisive for Agamben in the
development of his political concepts composed in the political project Homo Sacer.<br>No fim do ano de 2013, em Atenas, Giorgio Agamben expôs uma importante reflexão
sobre o destino da democracia europeia. Segundo o filósofo, não vivemos mais sob a
égide da democracia e o paradigma governamental de nosso tempo sequer poderia ser
denominado político. O conceito que substituiu quaisquer noções políticas foi o da
segurança e o slogan ―por razões de segurança‖ assumiu, em escala mundial, o novo
parâmetro de governo da ordem política contemporânea. Para compreendermos esse
diagnóstico, Giorgio Agamben propôs, naquela ocasião, o convite de realizar uma
genealogia do conceito de segurança a partir de uma pesquisa aguda sobre a sua origem
e história no paradigma de estado de exceção. Esta dissertação tem como finalidade, em
conjunto com Agamben, destrinçar o conceito de estado de exceção demonstrando,
também, qual seria a sua implicação e relação com a vida humana. O conceito de estado
de exceção desenvolvido por Agamben no decorrer do projeto Homo Sacer retoma o
debate sobre o direito travado entre Carl Schmitt e Walter Benjamin na década de 20 do
século XX. Reconstituímos passo-a-passo esse debate para demonstrar o quanto foi
essencial para Agamben o contato com as obras do jurista alemão para o
desenvolvimento do tema de exceção. Foi, contudo, tomando para si o lado de
Benjamin naquela discussão que o filósofo italiano foi instigado a direcionar suas
críticas mais ferozes ao estado democrático de direito. Seguem dessa tomada de partido
os diagnósticos de ser o estado de exceção o paradigma de governo da
contemporaneidade e a indicação de que o estado de exceção inscreve a soberania em
um paradoxo. Desenvolvemos ainda a proposta de Agamben em apontar para o ponto
de confluência entre o modelo biopolítico, cunhado por Foucault, mas anos antes
também diagnosticado por Hannah Arendt, e o modelo jurídico-institucional. Isto é, o
ponto onde vida e direito se tocam na figura do soberano e da vida nua. O que esta
dissertação também se preocupou em pontuar, desde o título, foi o quanto o contato com
o aporte teórico de Walter Benjamin foi determinante para Agamben no
desenvolvimento de seus conceitos políticos compostos no projeto político Homo Sacer.

Poderíamos afirmar que o projeto Homo Sacer, que marcará o pensamento de Giorgio Agamben em sua fase mais recente, busca colocar em operação uma crítica do aparato político ocidental, sustentada por uma leitura da modernidade que aponta a persistência em seu núcleo de dispositivos ligados a uma metafísica negativa de origem jurídicoteológica. Tal crítica será construída fundamentalmente a partir da leitura dos estudos elaborados por Michel Foucault em torno do tema da biopolítica, aliado a um segundo debate, realizado entre Carl Schmitt e Walter Benjamin em torno da relação entre soberania e estado de exceção. Para o filósofo italiano, a modernidade estaria marcada pela coincidência progressiva entre espaço político, gestão da vida e a generalização de dispositivos próprios ao Estado de Exceção, afirmando não a polis, mas o campo de concentração, como o paradigma político fundamental do Ocidente.<br>The Homo Sacer project, the pillar of Giorgio Agambens later thought, seeks to operate a critique of the Western political apparatus, supported by a reading of modernity that points to the persistence, at its very core, of a negative metaphysics of juridicotheological origin. This critique derives primarily from a reading of Michel Foucaults studies on biopolitics, allied with a second debate, held between Carl Schmitt and Walter Benjamin, on the relationship between sovereignty and the state of exception. For the Italian thinker, the modern state is marked by the progressive coincidence between the political space, life-management and the state of exception. Based on this thesis, Agamben elects the concentration camp rather than the polis as the fundamental political paradigm of the West.

From the inventory that Agamben will make out of the originating concepts of the treaty of Aristotle Peris Psykhês as well as the archaic Roman Law towards the definition of bare life , to the Agamben s readings on the reflections of Walter Benjamin, Hannah Arendt and Michel Foucault, which will be tackled as biopolitical hypothesis , by going through surveys on the Schmitt s exception and the reine Gewalt in Benjamin s, the thesis is intended to expose the inevitable threshold of the political problems with the discussions on time and memory within Agamben s philosophy presented below, in addition to some of the main difficulties, implications and contradictions involving its formulation. Thresholds (Schwellen) must be understood herein not only in a methodological but also epistemological sense the way that Agamben thinks its philosophy, through ontology, politics, law and esthetics and the temporary sense, the specificity of the thresholding concept to characterize the unique relation about the human time with the memory, the history and the politics<br>A presente tese objetiva abordar o problema das relações entre política e tempo na obra do filósofo italiano Giorgio Agamben, situando-o a partir de quatro limiares onde esta questão é ali desenvolvida: a) a problemática da vida nua e das formas-de-vida; b) o problema da comunidade; c) o estado de exceção; d) a relação entre o tempo, a memória e a história. Do inventário que fará Agamben de conceitos oriundos do tratado aristotélico Peris Psykhês e do direito romano arcaico para a definição da vida nua , às leituras agambenianas das reflexões de Walter Benjamin, Hannah Arendt e Michel Foucault a partir do que chamaremos de hipótese biopolítica , passando pelas pesquisas sobre o estado de exceção schmittiano e a reine Gewalt em Benjamin, esta tese pretende expor a inevitável imbricação da problemática política com os debates em torno do tempo e da memória na filosofia agambeniana, apresentado, ademais, algumas das principais aporias, implicações e antinomias envolvendo sua formulação. La presente investigación analiza la figura del campo de concentración en la propuesta de Giorgio Agamben. Esto contempla la ampliación conceptual que el autor lleva a cabo sobre esta figura, lo que la convierte en un paradigma que le permite analizar la estructura de la política en occidente. Para mostrar el modo en que Agamben comprende y utiliza la noción de campo como un paradigma, es necesario revisar sus antecedentes intelectuales. Con este fin se examina el trabajo de Hannah Arendt en torno al totalitarismo y al campo de concentración y detención. Arendt muestra la aparición de una nueva forma de gobierno, el totalitarismo, que por sus características políticas, implementa la estructura de los campos de concentración. Del mismo modo, analiza la falta de respaldo jurídico que sufren los deportados, y el proceso de des-humanización por el que atraviesan. Posteriormente, se reflexiona sobre el trabajo de Agamben sobre el campo de concentración. En este punto se analiza el estado de excepción como la forma jurídica que permite la aparición de estos espacios. A su vez, se evidencia la relación entre la vida, la política y el derecho bajo la forma de la estructura de la soberanía, lo que abre la posibilidad a Agamben de mostrar el campo de concentración como un paradigma. De la misma manera, se estudia el trabajo de Michel Foucault en torno de biopolítica, mercando los puntos en común y los puntos de alejamiento con la producción de Agamben respecto esta forma de poder. La noción de "racismo de Estado" cobra gran relevancia al interior de esta investigación, ya que le permite a Agamben mostrar la estructura del abandono legal que sufre la vida al interior de los espacios de excepción. Finalmente, se revela la forma extrema que alcanza históricamente la vida desnuda - el "musulmán" - bajo la estructura del campo de concentración, cuya organización político-jurídica posibilita el abandono de la vida en un espacio en el que queda a merced de la violencia<br>Ce travail de recherche analyse la figure du camp de concentration dans le travail de Giorgio Agamben. Cet examen porte notamment sur l’extension conceptuelle réalisée par cet auteur, faisant du camp de concentration un paradigme qui lui permet d’analyser la structure de la politique en Occident. Afin de montrer comment Agamben comprend et utilise la notion de camp de concentration, ses références théoriques doivent être explorées. Ainsi, le travail d’Hannah Arendt sur le totalitarisme et les camps de concentration ainsi que les apports de Michel Foucault en ce qui concerne la biopolitique et le racisme d’Etat sont analysés. Dans cette étude, nous proposons une clé de lecture qui montre comment, au sein de la notion de camp de concentration comme espace d’exception, s’articulent des notions juridiques, biopolitiques et historiques, qui permettent à Agamben de révéler le fonctionnement de la structure politique. Ainsi, la figure de l’homo sacer, de la vie nue, et du musulman prennent une place fondamentale dans une réflexion philosophique qui cherche à éclairer la place et le poids du camp de concentration dans l’œuvre d’Agamben<br>This research analyzes the figure of the concentration camp in Giorgio Agamben’s work. It focuses on the conceptual extension performed by the author, turning the concentration camp into a paradigm that allows him to analyze the structure of politics in the Western world. In order to show how Agamben defines and uses the notion of the concentration camp, it is necessary to study his philosophical references. Thus, the work of Hannah Arendt on totalitarianism and concentration camps, as well as the contributions of Michel Foucault on biopolitics and state racism, are examined. This research sets forth an interpretation of the articulations of legal, biopolitical and historical notions at stake in the concentration camp as a place of exception, allowing Agamben to expose the functioning of political structures. Thereby, the figures of the homo sacer, of bare life and of the Muslim, become crucial in a philosophical reflection that seeks to take stock of the importance of the concentration camp in Agamben’s work

Agamben percebeu que Hannah Arendt não deu continuidade às suas pesquisas sobre a política, deixando uma lacuna, pois não fez a ligação entre a vida e o campo, ou seja, não estabeleceu vínculo entre a zoé e o espaço da exceção soberana. Por este viés, é possível indagar até que ponto a filosofia política de Agamben é influenciada e encontra sua fonte nas ideias políticas de Hannah Arendt. Com base nisso, analisamos a vida como problema sob o aspecto puramente biológico e suas implicações políticas. Consideramos que Agamben esboça o conceito de vida nua não como as formulações de Foucault, que trabalha a vida numa visão unificada, mas buscando inspiração, assim como Arendt, na filosofia grega antiga, que não tem uma única definição de vida, já que a vida é apresentada como zoé (vida natural), bios (vida política) e bios theoretikos (vida contemplativa). O tema deste projeto é, então, a questão da vida no pensamento político de Agamben e sua interpretação das reflexões de Arendt, relacionando-a com as noções de economia e de política. Dentro desta análise, verificamos ainda o vínculo existente entre animal laborans, desenvolvido pela teoria arendtiana, e o homo sacer, no pensamento agambeniano. É esclarecido ainda como cada autor investiga e desenvolve o conceito de sociedade e seu nexo com a noção de oikonomia. A hipótese central é que, a partir da análise dessas implicações, encontramos, nos dois autores, a possibilidade de uma política não mais atrelada aos dispositivos de captura da vida pela oikonomia, mas relacionada à potência da vida como uma categoria filosófica, de modo a criar uma ação que vai além das previsibilidades, pautada na autonomia (Arendt) e na potência do não (Agamben), construindo o horizonte da política que vem.<br>The problem discussed in this thesis is the centrality of life and its connection with politics in Agamben and Arendt thinking. Agamben realized that Hannah Arendt did not continue his research on politics, creating a gap, since she did not make the connection between life and the field, in other words, she did not establish a bond between zoé and the space of the sovereign exception. From this point of view, it is possible to investigate how much political philosophy of Agamben is influenced and finds conection in the political ideas of Hannah Arendt. Based on this, we analyze life as a purely biological problem and its political implications. It is considered that Agamben presents the concept of nude life not like Foucault’s formulations, who understands life in a unified vision, but seeking inspiration, as well as Arendt, in ancient Greek philosophy, that does not have a single definition of life, since life is presented as zoé (natural life), bios (political life) and bios theoretikos (contemplative life). Then, the theme of this project is the issue of life in Agamben's political thinking and his interpretation of Arendt's reflections, relating it to economic and political notions. During this analysis, we also verify the link between animal laborans, developed by the Arendtian theory, and homo sacer, in Agambenian thought. Besides, it is clarified how each author investigates and develops the concept of society and its nexus with the notion of oikonomia. From the analysis of these implications, the central hypothesis, in both authors, is that the possibility of a policy no longer linked to the devices of capture of life by oikonomia, but related to the potency of life as a philosophical category, in order to create an action that goes beyond predictability, based on autonomy (Arendt) and the potency of non (Agamben), building the horizon of politics which comes.

A presente dissertação propõe, através de conceitos extraídos de pensadores diversos, em especial Gilles Deleuze, Félix Guattari e Giorgio Agamben, o desenvolvimento de ferramentas para análise e criação de obras artísticas no campo da representação. Partindo de dois conceitos-chave, o território na concepção de Deleuze e Guattari, e a profanação na interpretação de Agamben, esta dissertação discute a ligação existente entre áreas artísticas variadas (como a performance, o teatro, o cinema etc.), bem como a relação entre materiais do passado e os do presente, a fim de evidenciar o vasto campo de criação e análise artística presente nas artes da representação contemporânea. Ainda, para demonstrar a contundência do ferramental discutido e aprofundado nesta dissertação, o autor desenvolveu uma parte prática em que tece um texto dramatúrgico inspirado pelas ideias debatidas no decorrer do seu trabalho teórico.<br>The present dissertation proposes, through concepts drawn from diverse thinkers, mainly Gilles Deleuze, Félix Guattari and Giorgio Agamben, the development of tools for analysis and creation of artistic works in the field of representation. Based on two key concepts, the territory in Deleuze and Guattari\'s conception, and the desecration in Agamben\'s interpretation, this dissertation discusses the connection between varied artistic areas (such as performance, theater, cinema, etc.), as well as the relation between materials of the past and those of the present, in order to highlight the vast field of artistic creation and analysis present in the contemporary representative arts. Moreover, to demonstrate the strength of the tools discussed and deepened in this dissertation, the author developed a practical part, in which he weaves a dramaturgical text inspired by the ideas debated in the course of his theoretical work.

Giorgio Agamben's work is a constant presence in the current critical debate over sovereign power, law and politics. With the more than two decades long series Homo sacer, he has traversed the borders of academic disciplines, providing renewed sources of inquiry for the orientation before the contemporary widespread and violent biopolitical-economic administration of life. This research project investigates some of the central themes of the critical account of legal and political thought that Agamben has offered in his works. The eight chapters composing this thesis are conceived as specific theoretical paths through Agamben's oeuvre, which in their autonomy and mutual interaction aim at offering a, hopefully, meaningful contribution to the field of continental legal philosophy. In this work, I argue that Agamben's Homo sacer project provides a fundamental theoretical framework for the comprehension of the role and functions of law and sovereign power in biopolitical regimes. The central thesis that this project advances is that Agamben's interrogation of juridical and political thought and of ontology uncover a missing link in the problematic separation of sovereignty and law from governmental practices that the discourse on biopolitics has inadvertently inherited from Foucault's work. Agamben succeeds in doing this in two main ways: first, he redefined the contours of the theory of sovereignty in relation to biopolitics (shading light over the tight bond that ties together sovereign power, life and governmental practices); second, with the idea of "form of life" he has disclosed a biopolitical interpretation of law, providing, also, the ground for an innovative theory of the subject. This work, thus, is structured in two parts. The first part has been organised around Agamben's engagement with the question of sovereign power. Rather than focusing on the problems of the state of exception or the camp - given that the critical literature on such topics is more than abundant - I proceed with the analysis of sovereignty, as a "normalising power", in its relation to life and the idea of government. The second part of the thesis, instead, has been devoted to the disentanglement of the concept of the "form of life". A form of life is a life that has been put-in-form, actualised in a given (legal or social) institution, and trapped under the yoke of sovereign power. While the tone and the plane of analysis of the two parts could be sometimes divergent, they intersect on a central point: sovereignty as the power to establish the criteria of normality of the political community, to decide on the forms of life that are "inside or outside" the legal and political order. Sovereignty, in this regard, lays down, from time to time, the limits of the social and political life of the state, and in doing so, decide which forms of "life" are a part of it (and thus worthy of protection), and which are excluded.

Se o nosso século é aquele em que a sociedade tornada espetacular culmina na erosão de toda experiência possível, ele é também aquele em que os conceitos jurídicos perdem sempre mais sua materialidade: em nome da defesa do direito chegamos contraditoriamente a uma realidade jurídica rarefeita. Explorando os diálogos estabelecidos pelo filósofo com outros filósofos, tais como Walter Benjamin e Michel Foucault, e outras áreas do saber constituído, tais como a história, a literatura ou a teoria social, o texto que se segue buscará permitir visualizar um complexo diagnóstico. Através do uso de conceitos políticos basilares e do auxílio de determinadas figuras paradigmáticas, veremos como o liame entre soberania, exceção e vida nua contamina todo o espaço político contemporâneo. O fruto do trabalho que agora se apresenta não quer todavia somente decifrar ou diagramar um cenário decomposto. Pode ser que, em última instância, ele queira também contribuir, ainda que modestamente, para desobstruir - como escreve o filósofo na introdução do primeiro livro da série Homo sacer - o campo em direção à nova política que ainda resta inventar<br>Abstract: The present research's goal is to map and identify a path in Giorgio Agamben's on-going work that, from the perspective of political philosophy, leads from a cluster of reflections around cultural critics to decisive incursions of what here I called juridical critics, prioritizing in the first moment the readings of Infanzia e storia, La comunità che viene and Il tempo che resta, and in a second moment the books which belong to the project Homo sacer, specially Homo sacer: il potere sovrano e la nuda vita, Stato di eccezione and Quel che resta di Auschwitz. If our century is the one in which society becoming spectacular culminates in the erosion of every possible experience, it is also the one where the juridical concepts loose more and more their materiality: in behalf of right's defense we arrive contradictorily at a thin juridical reality. Exploring the dialogs established by Agamben with others philosophers, such as Walter Benjamin and Michel Foucault, as well with others areas of constitutive knowledge, like history, literature or social theory, the text that follows will search to allow the visualization of a complex diagnosis. Through the use of basic political concepts and with the assistance of some paradigmatic figures, we shall see how the bond between sovereignty, exception and bare life contaminates the entire contemporaneous political space. However, the fruit of the work which now comes to presentation does not only intend to decipher or to diagrammatize a decomposed scenario. Para tanto, adentrar-se-Ã, inicialmente, nas reflexÃes do primeiro grande expoente dessa perspectiva, Michel Foucault, jà que este repropÃe o termo biopolÃtica de modo a direcionÃ-la para uma nova compreensÃo e crÃtica da modernidade e do poder. Posteriormente, tratar-se-à da reflexÃo agambeniana acerca do estado de exceÃÃo e do seu vÃnculo com o poder soberano. Estes, para o autor, se fundam, necessariamente, em um paradoxo, porquanto pressupÃem a existÃncia de uma figura (o soberano) interna e, ao mesmo tempo, externa à prÃpria ordem na qual se encontra. O objetivo do percurso aqui realizado à mostrar como Agamben faz convergir os dois modelos de anÃlise do poder, isto Ã, o da biopolÃtica e o jurÃdico-polÃtico, este Ãltimo evitado por Foucault. Esses conceitos, dentre outros, constituem, para Agamben, elementos originÃrios da polÃtica ocidental que marcam a premÃncia da sua tese da contiguidade e paralelismo entre soberania e biopoder. Tudo isso permitirà compreender a transformaÃÃo da biopolÃtica em seu desdobramento, decorrido desde o sÃculo passado, no que se convencionou chamar d e âtanatopolÃticaâ, na qual se encontram prÃticas como a eutanÃsia e o extermÃnio em massa realizado nos campos de concentraÃÃo. Os grandes regimes totalitÃrios do sÃculo XX, segundo Agamben, sà podem ser compreendidos adequadamente, e em toda a sua complexidade, a partir da perspectiva que tem como ponto de partida algo como o conceito de vida nua. Antes, porÃm, deve-se observar a reflexÃo de Hannah Arendt acerca da relaÃÃo entre direito e nacionalidade, sobre a qual Agamben faz uma leitura especÃfica e, por assim dizer, biopolÃtica. Previous issue date: 2014-06-03<br>Sovereignty is a concept made shallow as it presents frail theoretical solutions when
applied to aspects from reality.
The research hereby aims at understanding Giorgio Agamben s diagnosis on sovereignty
by going through the core of Carl Schmitt s thinking in his theory of the sovereign power as
well as the displacement of such problem in Michel Foucault s writings.
Agamben is an intellectual who perused stern philosophical pathways, sovereignty having
stood first and foremost for him along the issue of the potentiality of not being. His approach
to reality takes place through the motto to prefer not to, from which he glimpses one
possibility for putting down one s relationship between wanting and being able to, and
between the constituent and constituted powers. And such annihilation is in effect essential
for Agamben since his concept of sovereignty takes into consideration a juridical category not
only weakened of its representativeness but most of all originating from an unprecedented
biopolitical catastrophe.
The path chosen by Agamben for such conclusion is one of a paradigmatic ontology, that
is, the axes of understanding for the phenomena which ousted political character from
juridical ordinances. The paradigms nuda vita (bare life) and the state of exception mainly
constitute the structural elements whose function is to ultimately keep the exception-ridden
life of the law.
The bottleneck established by sovereignty is undone by a new form-of-life, which means
the absolute desecration of a life power over which neither sovereignty nor the law can have
control over<br>A soberania é conceito esvaziado porque apresenta frágeis soluções teóricas quando
aplicadas aos aspectos da realidade.
Esta pesquisa tem por objetivo a compreensão do diagnóstico de Giorgio Agamben a
respeito da soberania percorrendo a centralidade da teoria do poder soberano do pensamento
de Carl Schmitt e o deslocamento do problema em Michel Foucault.
Agamben é um intelectual de árido percurso filosófico e a soberania para ele, antes de
tudo, é uma questão da potencialidade de não ser. A sua aproximação da realidade se dá pela
fórmula preferiria não, na qual ele vislumbra uma possibilidade de destruição da relação entre
querer e poder, entre poder constituinte e poder constituído. E tal destruição, de fato, é
essencial para Agamben porque o seu conceito de soberania considera uma categoria jurídica
não só esvaziada de representação, mas, sobretudo, originária de uma catástrofe biopolítica
sem precedentes.
O caminho escolhido por Agamben para essa conclusão é o de uma ontologia
paradigmática, ou seja, eixos de entendimento para os fenômenos que destituíram o caráter
político do ordenamento jurídico. Os paradigmas da nuda vita e do estado de exceção,
principalmente, são elementos estruturais da soberania cuja função é, enfim, o de manter a
vida excepcionada do direito.
O nó estabelecido pela soberania desata-se por uma nova forma-de-vida, o que significa
uma absoluta profanação de uma potência da vida sobre a qual nem a soberania, nem o direito
podem ter mais controle

Previous issue date: 2018-06-26<br>A presente dissertação tem como objeto de investigação dois conceitos que se inserem na teoria política e jurídica de maneira única: poder constituinte, amparado na interpretação de Antonio Negri, e potência destituinte, que Giorgio Agamben articula ao final do seu projeto Homo Sacer. Ambos autores desenvolvem seus conceitos como alternativa filosófica que se impõe contra a estrutura jurídico-política na qual estamos inseridos. Para atingirmos nosso objetivo, procuramos analisar os pressupostos e as questões principais que qualificam tanto o poder constituinte quanto a potência destituinte. Em razão disso, primeiramente investigamos o conceito de potência em cada um dos filósofos, além de Espinosa, tendo em vista não apenas a sua expressão política, mas também sua configuração ontológica. Do mesmo modo, foram objeto de investigação conceitos que são percebidos como essenciais para a correta apreensão do nosso objeto de pesquisa, tais como o de soberania, poder, democracia, multidão, além de inoperosidade, uso, forma-de-vida. Mesmo que haja uma contraposição, uma aporia, entre poder constituinte e potência destituinte, o que está em jogo na teoria de ambos os autores é, justamente, arquitetar novas formas como nós compreendemos a política, o direito, mas também a ontologia que os acompanha. Todo o debate empreendido por Negri por um lado e por Agamben, de outro, está em vista de abrir as alternativas, as possibilidades, para pensarmos uma nova vida política.<br>The present dissertation has as object of investigation two concepts that are inserted in the political and juridical theory in a unique way: constituent power, supported in the Antonio Negri’s interpretation, and destituent potential, that Giorgio Agamben articulates in the end of his project Homo Sacer. Both authors develop their concepts as a philosophical alternative that imposes itself against the juridical-political structure that we are inserted. To reach our goal, we seek to analyze the assumptions and the main issues that qualify both the constituent power and the destituent potential. For this reason, we first investigate the concept of power (potential) in each philosophers, in addition to Espinosa, in view not only its political expression, but also its ontological configuration. In the same way, concepts that are perceived as essential to the correct apprehension of our research object, such as sovereignty, power, democracy, multitude, inoperability, use, form-of-life were also investigated. Even if there is a contraposition, an aporia, between constituent power and destituent potential, what is at the theory of both authors is precisely to architect new ways to we understand politics and law, but also the ontology that accompanies them . All the discussion undertaken by Negri on one hand and by Agamben on the other is aimed in opening alternatives and possibilities for thinking about a new political life.

This thesis develops an account of Agamben’s philosophical archaeology through an analysis of the notions of signatures, paradigms and the archē, and through an examination of Agamben’s critique of both Western metaphysics and deconstruction. It claims that Agamben’s philosophical archaeology and his analysis of the differentiating logic of Western metaphysics constitute the necessary framework from which the Homo Sacer project should be examined. In this sense this project rearticulates Agamben’s works on signification, language and ontology with his archaeology of power. Indeed, my thesis reconstructs Agamben’s critique of metaphysis in order to bring together the two parts of the Homo Sacer project through an analysis of the production of bare life: the archaeology of the signature of Sovereignty and the archaeology of governmentality. It argues that throughout the work of Agamben there is no rupture in terms of his treatment of power but rather that there are different emphases that are combined in his analysis of the governmental machine. Finally, this thesis uses the theoretical and methodological frameworks that it develops to address the relation between biopolitics, the governmental machine, Agamben’s account of ontology, and bare life. To conclude, this thesis offers an examination of Agamben’s notion of resistance, that is, the politics of inoperativity through an analysis of the central categories that constitute his attempt at rendering inoperative the signatures of Life and Power: Destituent Power, form-‐of-‐life, and Use.

Previous issue date: 2017<br>A presente tese propõe uma aventura do pensamento com a investigação do problema do direito através das obras e dos escritos do filósofo italiano Giorgio Agamben. A partir disso, a vida fora do direito e o direito em sua não relação com a vida surgem como propostas de Agamben para uma saída ao viés juridicizador sobre a vida. Assim, dois âmbitos do direito são distinguidos: o direito em sua forma instrumental, que captura a vida em um laço lógico-dialético orientando o funcionamento do direito como ciência capaz de produzir conhecimento, e o Direito reflexivo, que busca o sentido do direito refletindo sobre ele mesmo e que não produz conhecimento, pois é aporético. Esses dois âmbitos aparecem com maior clareza na medida em que pensamos a crise atual do Ocidente em nossa época a partir das reflexões de Agamben em que o direito é colocado em questão. Em Nietzsche, filósofo alemão do século XIX, a mundivisão tragicômica da vida permite um olhar artístico sobre as coisas que escapa à captura dispositiva da vida pelo conhecimento lógico-dialético da ciência e que, combinada com o pensamento de Agamben sobre o direito, permite outro viés sobre a vida e sobre o próprio direito. Para isso, a pesquisa rompe a barreira entre a teoria e a filosofia e busca na narrativas mítica da tragédia Antígona o elemento mais originário do direito instrumental e do Direito reflexivo; busca na comédia Pluto a constatação originária da transformação do Deus em dinheiro; e, por fim, no mito do toque de ouro de Midas, o paradigma da tentativa de domínio total da vida e das coisas do mundo como condição humana elementar. Ao final da tese, propomos como possível um método peculiar de se investigar inter e supradisciplinarmente as coisas: a costura tragicômica dos saberes. <br><br>Abstract : This thesis proposes an adventure of thought with the investigation of the problem of law through the works and writings of the Italian philosopher Giorgio Agamben. From this, the life outside o the right and the right in its non relation with the life arise like proposals of Agamben for an exit to the juridicization bias on the life. Thus, two areas of law are distinguished: the right in its instrumental form, which captures life in a logical-dialectic loop orienting the functioning of right as a science capable of producing knowledge, and reflective Right, which seeks the meaning of the right reflecting about himself and that does not produce knowledge, because it is aporetic. In Nietzsche, a nineteenth-century German philosopher, the tragicomic worldview of life allows an artistic glance at things that escapes the operative capture of life by the logical-dialectical knowledge of science and which, combined with Agamben's thinking about right, allows another perspective about the life and about the right. For this, the research breaks the barrier between theory and philosophy and searches in the mythical narratives of the tragedy of Antigone the most original element of instrumental right and reflexive Right; seeks in the comedy of Pluto the original realization of the transformation of the God into money; and, finally, in the myth of the golden touch of Midas, the paradigm of the attempt to master totality of life and things of the world as an elementary human condition. At the end of the thesis, we propose as possible a peculiar method of investigating inter and supradisciplinarily things: the tragicomic stitching of the knowledge.

Estes, para o autor, se fundam, necessariamente, em um paradoxo, porquanto pressupõem a existência de uma figura (o soberano) interna e, ao mesmo tempo, externa à própria ordem na qual se encontra. Os grandes regimes totalitários do século XX, segundo Agamben, só podem ser compreendidos adequadamente, e em toda a sua complexidade, a partir da perspectiva que tem como ponto de partida algo como o conceito de vida nua. Antes, porém, deve-se observar a reflexão de Hannah Arendt acerca da relação entre direito e nacionalidade, sobre a qual Agamben faz uma leitura específica e, por assim dizer, biopolítica. Yet, both Agamben and Copjec each write to reject positivist notions of ethics, which each theorist identifies as rooted in the same ideological apparatuses that propagate exclusionary and violent actions. By turning away from pre-given ethics and ideology, these writers attempt to delineate why these philosophies have been the vehicle of violence and racial oppression, and reiterate the importance of turning away from such thought in order for the subject to conceptualize a new way of being and relating to others that combats dominant ideology. Agamben's theoretical concept of homo sacer that lies at the center of his philosophical project, and Copjec's Lacanian understanding of the subject as inherently ruptured, both delineate subjectivity, as well as the concepts of race and racism in novel ways. Using these theorists to read Morrison's novels illustrates the critical concepts outlined by these two thinkers.
In the first chapter of this thesis, I plan to outline Agamben's notion of homo sacer, and Copjec's theorizing of the subject as inherently ruptured. I employ Morrison's piece of literary criticism, Playing in the Dark: Whiteness and the Literary Imagination, to demonstrate how Morrison's literary and intellectual project as a writer also aims to refigure subjectivity, illustrating and expanding upon Agamben and Copjec's work. In the second chapter, I will move on to discuss Agamben's political philosophy and concept of homo sacer, analyzing Morrison's novels, A Mercy, and Home to demonstrate how her work illustrates and expands upon Agamben's analysis of biopolitics. Lastly, in the third chapter of this thesis, I place Morrison in dialogue with Copjec, demonstrating how Morrison's characters illustrate the notion of a ruptured subject, and why it is important to read her work through this lens. I aim to demonstrate how Morrison's characters expand upon the notions of race, femininity, and subjectivity as conceived by Copjec. The ultimate goal of this thesis is to delineate why it is beneficial to place these three writers in dialogue with one another to analyze notions of racial identity, subjectivity, violence, and trauma.

the dehumanization process in the contemporary politics and how, in terms of biopolitics, a concept of Foucault, modern man has his life questioned in contemporary politics, and becoming thus bare life, a term created by Giorgio Agamben to describe life devoid of humanity.
Therefore a theoretical and bibliographical research was undertaken,which initially addresses the concept of bioplítics , then presents Agamben‟s work, considering its relevance in the approach/explanation of contemporary phenomena and its criticism of human rights, and finally brings up the contributions of psychoanalysis to the subject.
Thus, it was possible, besides observing, clarifying and deepening the dehumanization of politics proposed by Agamben, to comprehend through psychoanalysis the form by which this dehumanization is based on psyche and through what mechanisms the political management feeds desubjectivation of man as a political being, turning him into just bare life, plain and simple life.
One can conclude that such a movement takes place through generalization of the populations, turning them into mere statistical data, and thus nullifying the will, which reduces the strength of social demands. In the political scene, after Auschwitz and the dropping of the atomic bombs on Japan, every human life is nothing more than a plain datum in the strategic game of global power<br>Esta tese tem como objetivo investigar, a partir da análise da obra do filósofo italiano Giorgio Agamben e das contribuições da psicanálise, o processo de desumanização na política contemporânea e como, nos termos da biopolítica, conceito cunhado por Foucault, o homem contemporâneo tem sua vida posta em questão na política contemporânea, tornando-se vida nua, termo cunhado por Giorgio Agamben para descrever a vida desprovida de humanidade.
Para tanto, realizou-se uma pesquisa teórica/bibliográfica, que primeiramente aborda o conceito de bioplítica, em seguida, apresenta a obra de Agamben, considerando sua atualidade na explicação/abordagem de fenômenos contemporâneos e sua crítica aos direitos humanos, para, em seguida, trazer as contribuições da psicanálise ao tema.
Com isso, foi possível, além de constatar, explicitar e aprofundar a proposta de Agamben de desumanização pela política, compreender, por meio da psicanálise a forma pela qual esta desumanização funda-se na psique e por meio de quais mecanismos a gestão política alimenta a desubjetivação do homem político, tornando-o apenas vida nua, ou seja, vida pura e simples.
Conclui-se que tal movimento dá-se por meio da generalização das populações, tornando-as apenas dados estatísticos e, assim, anulando o desejo, o que diminui a força das reivindicações sociais. Este estudo tem como objetivo principal rever a categoria Refugiado para poder refletir sobre a Saúde Global como dispositivo da biopolítica moderna. O estudo espera contribuir nessa construção oferecendo uma reflexão crítica a partir da visão agambiana de dispositivo e de uma política que vem. Trata-se de avaliar se a Saúde Global, em seus anseios de governança da saúde planetária, não pode ser tomada bem mais como um dispositivo de captura da vida nua, categoria central no pensamento de Giorgio Agamben. A vida nua é justamente o Refugiado. Daí a importância da análise dessa categoria. Propomos assim uma hipótese funcional de trabalho: perceber a Saúde Global, a partir de sua própria definição, como um campo de tensões e de dissensos necessários para a construção de uma nova política, uma vez que as análises da figura do Refugiado mostraram o colapso do Estado-nação e da categoria de direitos humanos. A construção dessa pesquisa está ancorada sobre três elementos centrais: 1º a ideia de refugiado e de hospitalidade: o ser que se é, é ser localizado territorialmente, ser-no-mundo, onde o mundo de relações estabelecidas permite/favorece/permeia/forma a identidade do sujeito. A desterritorialização é o próprio desterro do sujeito, um desarvorar que clama por novas possibilidades de fincar raízes, as quais só são possíveis através de outros movimentos, ou seja, através do con-solo ou da devolução do solo. Encontramo-nos aqui no limiar da perda de identidade e da necessidade de criar condições de reconquista por meio do abrigar, do refugiar, do acolher, do com-partilhar. Essa dimensão mais originária do ser humano ou da sua condição metafísica essencial, na prática, serviu de fio condutor ou de fundamento para a construção de estatutos jurídicos do Refúgio e da Hospitalidade A crise se instala quando todo este aparato parece perder significado e sentido; 2º as novas formas de dizer-se/olhar-se/compartilhar-se no mundo globalizado. Utilizamos os verbos no reflexivo pela seguinte razão: mais do que dizer algo a alguém as novas tecnologias parecem pautadas na necessidade de transmissão de identidade. Ser-no-mundo é ser-na-linguagem. Os relatos de fuga dos refugiados feitos por eles mesmos com seus smartphones são um dizer sobre si, um dizer sobre a situação, uma denúncia do que está acontecendo; 3º as rupturas abordadas são uma questão de Saúde Global. O elo que une cada um desses elementos é a reflexão crítica do filósofo Giorgio Agamben em sua pesquisa sobre o Homo Sacer.<br>The main objective of this research is to think over the Refugee category in order to be able to ponder about the Global Health as a modern biopolictical tool. The research aims to contribute in such construction offering a critical reflection from the Agamben\'s view of dispositif and from an incoming politics. It is about evaluating whether the Global Health, in its governance anticipation of the universal health, could be taken much more as a bare life catcher tool, category centered in the Giorgio Agamben philosophy. The bare life is precisely the Refugee. Thus the importance of analyzing this category. Therefore we propose a work functional hypothesis: to perceive the Global Health, starting from its own definition, as a tension field and as necessary dissensions to construct a new politics, since the analysis of the Refugee picture indicated a collapse of the Nation-State and of the Human Rights category. The construction of this research is anchored on three main elements: (1) the idea of refugee and of hospitality: the being that is, the being located territorially, being-in-the-world, in which the network and relationship established allows/favors/permeates/forms the subject\'s identity. The deterritorialization is the subject\'s own banishment, a disenbowelment that calls for new possibilities to establish roots, which are only possible through other movements, which means through the \'con-soil/console\' or the soil\'s return. We find ourselves on the threshold of identity\'s loss and of the need to create conditions of regaining by sheltering, welcoming, sharing. This dimension mostly originated from the human being or from its essential metaphysical condition, in practice, served as a guiding thread or as a foundation for the Refugees and Hospitality law\'s construction. The crisis sets when all this apparatus seems to lose its meaning and reasoning; (2) the new ways of saying/looking/sharing yourself in the globalized world. The reflexive tense was used for the following reason: rather than saying something to someone, new technologies seem to be ruled by the need of identity transmission. Beingin- the-world is being-in-the-language. The escaping reports from the refugees made by themselves with their smartphones are a saying about themselves, a saying about the situation, an accusation about what is happening; (3) and finally, the addressed ruptures are a Global Health matter. The bond which connects each of these elements is the critical reflection of the philosopher Giorgio Agamben in his research about the Homo Sacer.

As it is widely accepted, human rights are inalienable and equal rights that we have simply because we are human. They are guaranteed to all people regardless of their nationality, race, sex, ethnicity, etc. Moreover, they are rights that their holder cannot lose them temporarily or permanently. Yet, today many millions people around the world are denied to exercise their most basic human rights because they are not citizen of any country. They are stateless people. Although there have been many international human rights mechanisms to protect rights of stateless people, in real life almost all stateless people are still subject to torture, discrimination, xenophobia, racism, difficulty enjoying their social, economic and cultural rights, and arbitrary and indefinite detention. Considering this contradiction, this thesis aims to question the meaning of the existence of stateless people for human rights theory. This issue was firstly studied by Hannah Arendt. Then, her analysis has been developed by many authors in different manners. Two important figures among them are Giorgio Agamben and Jascque Ranciè<br>re. Thus, this thesis attempts to evaluate the human rights of stateless people in the light of approaches of three authors: Arendt, Agamben, and Ranciè<br>re. Considering critical power of both of three approaches to human rights in contrast to mainstream theories of human rights, this thesis regards Jascque Ranciè<br>re&rsquo<br>s approach as an explanatory approach for human rights of stateless people since it focuses on political power of human rights for even stateless people.

Previous issue date: 2011<br>Resumo: A presente tese de doutorado tem por escopo discutir aspectos da teoria política de Giorgio Agamben, em especial os conceitos que ele apresenta a respeito do poder soberano, da violência do Estado contemporâneo, da exclusão, em razão do estado de exceção permanente, dos sujeitos sociais por ele chamados homo sacer e, finalmente, dos direitos humanos. A obra política de Giorgio Agamben se ergue sobre um intenso debate ocorrido especialmente entre três importantes pensadores contemporâneos: Carl Schmitt, Walter Benjamin e Hannah Arendt. Enquanto o pensador contemporâneo se utiliza de Schmitt para entender a condição violenta do Estado atual naquilo que corresponde ao estado de exceção e da consequente criação do campo como o espaço da consolidação da exceção; ele se aproxima de Arendt para discutir a democracia como uma proposta para o futuro, na perspectiva da criação efetiva do direito a ter direitos; e se fundamenta em Benjamin para compreender a condição violenta do Estado e do direito contemporâneos, descortinando o engodo gerado pelo mito do contrato social. Este trabalho se divide em seis capítulos, além de sua Introdução. No primeiro, discutiremos a questão da soberania, exceção, Estado e direito, traçando paralelos e demonstrando discordâncias entre fontes diretas e indiretas da obra de Agamben, como Carl Schmitt, Hans Kelsen, Max Weber e Georg Wilhelm Friedrich Hegel. No segundo capítulo, abordaremos os reflexos, no pensamento de Agamben, dos antagonismos entre as teorias de Schmitt, Benjamin, Kelsen e Arendt, no que concerne à questão da unidade e da pureza. No capítulo seguinte, concentraremos maior atenção sobre os conceitos de autoridade e poder, momento em que promoveremos um contraponto entre Arendt e Schmitt, observando os reflexos das formulações desses autores na filosofia política de Agamben. No quarto capítulo mostraremos as críticas, divergentes entre si, feitas por Arendt, de um lado, e Schmitt, de outro, sobre o problema da revolução permanente. Então, demonstraremos a influência de Karl Marx sobre a obra de Georges Sorel, e desta sobre a de Benjamin. Nesse momento, relacionaremos o messianismo de Benjamin com a "profecia" da "política que vem", feita por Agamben, além de demonstrarmos as proximidades de tal "profecia" com a concepção anárquica da política social desenvolvida por Foucault. No quinto capítulo, trabalharemos a questão do sagrado, do profano e do tempo que resta, este, tema de livro de Agamben, em que ele tem por referência preciosas formulações de São Paulo. O centro deste capítulo, além da obra mencionada, será o livro Homo Sacer: o poder soberano e a vida nua I. Finalmente, no capítulo derradeiro, abordaremos os temas direitos humanos e democracia, ao procedermos à conclusão deste trabalho<br>Abstract: This doctorate thesis has for its objective to discuss aspects of the political theory of Giorgio Agamben, especially the concepts that he presents in regards to the sovereign power, in regards to the violence of the contemporary State, in regards to the exclusion, on account of the state of permanent exception, of the social subjects by him called homo sacer and, finally, in regards to the human rights. The political work of Giorgio Agamben was based upon an intense debate occurring amongst three important contemporary thinkers: Carl Schmitt, Walter Benjamin and Hannah Arendt. While the contemporary thinker uses Schmitt to understand the violent condition of the present State in that that it corresponds to the state of exception and of the consequent creation of the rural environment as the space of the consolidation of the exception; he comes close to Arendt to argue the democracy as a proposal for the future, in the perspective of the effective creation of the right to have rights; and he bases in Benjamin to understand the violent condition of the State and of the contemporary rights, uncovering the decoy generated by the myth of the social contract. This work is composed of six chapters, not including the introduction. In the first chapter, we will discuss the question of sovereignty, governing by exception, State and right, drawing parallels and showing disagreements between direct and indirect sources of the work of Agamben, and Carl Schmitt, Hans Kelsen, Max Weber and Georg Wilhelm Friedrich Hegel. In the second chapter, we will approach Agamben's thoughts about the consequences of the differences between the theories of Schmitt, Benjamin, Kelsen and Arendt, with respect to the question of unity and purity. In the following chapter, we will focus attention on the concepts of authority and power, when we will promote a counterpoint between Arendt and Schmitt, observing the consequences of the formulations of those authors in the political philosophy of Agamben. In the fourth chapter we will show the criticisms, made by Arendt, on one hand, and Schmitt, on the other, and about the problem of the permanent revolution. We will then demonstrate the influence of Karl Marx over the work of George Sorel, and also the influence of George Sorel over the work of Benjamin. At this moment, we will relate the messianism of Benjamin with the "prophecy" of the "politics that comes", made by Agamben, as well demonstrating the proximity of such "prophecy" with the anarchic conception of the social politics developed by Foucault. In the fifth chapter, we will pursue the question of the sacred, of the profane, and of the time that remains, the latter being the subject of the book of Agamben, in which he has referenced precious formulations of Saint Paul. The focus of this chapter, beyond the work mentioned, will be the book Homo Sacer: the sovereign power and the bare life. On one side, the very notion of experience which will be studied and questioned to the point of denying its possibility. It will be replaced by an in-fancy theory that will find its power in the limits of language. Contrastingly, we analyse the eminently ontological notion of "image" in the work of the Italian philosopher which
h enables Agamben to develop a power theory which is seen to be able to deactivate the use of both the images constituted in fixed archives, as well as the images captured in contemporary show. DE ENSINO<br>In un contesto storico nel quale il diritto, secondo aspetti più o meno correnti, attraversa una grande crisi di leggitimità, la qui presente dissertazione si inserisce nel tentativo di comprendere quali sono i limiti e orizzonti di questa crisi, cercando concetti chiave che permettano di riflettere se questa stessa crisi può essere considerata congiunturale o strutturale. Il presente studio cerca di analizzare l’opera di Giorgio Agamben a proposito dell’analisi del diritto, o delle possibilità aperte per pensare al diritto a partire da questo autore, ma anche stabilendo il dialogo con altri pensatori che permettano una maggior delucidazione dell’oggetto proposto. Si è cercato di identificare gli elementi centrali per contribuiri al tentativo di esporre alcuni aspetti che rispecchino l’universo concettuale del diritto e delle sue correlazioni, tra cui l’eccezione e la violenza. Nel primo capitolo saranno presentate alcune linee generali sul pensiero di Agamben per poter esporre in quale modo si articola la critica al diritto fatta dall’autore, di cui sonno oggetto il secondo e terzo capitolo.<br>Num contexto histórico em que o direito, segundo concepções mais ou menos correntes, passa por uma constante crise de legitimidade, o presente trabalho se insere na tentativa de compreender quais os limites e os horizontes dessa crise, buscando chaves conceituais que permitam refletir se esta crise pode ser considerada como conjuntural ou estrutural. A presente pesquisa busca analisar a obra de Giorgio Agamben no que tange a análise do direito ou das possibilidades abertas para se pensar o direito a partir deste autor, mas também estabelecendo o diálogo com outros pensadores que permitam uma maior elucidação do objeto proposto. Busca-se apontar elementos centrais para que se possa contribuir na tentativa de expor alguns aspectos que dizem respeito ao universo conceitual do direito e de suas relações, dentre eles a exceção e a violência. Primeiramente serão apresentadas algumas linhas gerais sobre o pensamento de Agamben para expor de que maneira se articula a crítica ao direito feita pelo autor, objeto do segundo e do terceiro capítulo.

Previous issue date: 2015-02-20<br>The present dissertation aims to explore only one of the input ports of the philosophy of Giorgio Agamben: the theological genealogy signature "power" in its unitary form. Despite the multifaceted work of Agamben, there is a kind of spine that runs through all the philosopher's reasoning in the last 25 years. Agamben usually puts his reader that place he calls the zone of indifference, or even of inoperativity. The origin of the idea of a zone of indifference or inoperativity that Agamben uses as ubiquitous assumption in his work, is precisely the Judeo-Christian messianic theology - so it is a theological genealogy. This philosophy of indifference or political messianism present in the work of Agamben always shown from three basic movements operated by the author. First, he criticizes between two categories historically placed in opposition in Western thought. Zoe and bios, inside and out, law and anomy, exception and rule, etc. After highlighting this polarity, it passes to the second movement that comes to bring out an indifference zone between these two poles. The figure of the homo sacer, the state of emergency, the concentration camp, etc., are also examples of people, places and situations where these bilateral oppositions become indifferent and enter a inoperativity zone. All this he shows that, finally, in the third movement of his argument, be able to present what is perhaps a unique proposition: the messianic moment of destituinte suspension. The Franciscan way of life, the use without possession, divine violence, or profanity are different ways of bringing an action that is outside the reading key metaphysical power / act. Each of these fundamental movements will be explored in the three parts of this dissertation focusing mainly on the signature “power” in his philosophy.<br>A presente dissertação tem por objetivo explorar apenas uma das portas de entrada da filosofia de Giorgio Agamben: a genealogia teológica da assinatura “poder” em sua forma unitária. A revelia da multifacetada obra de Agamben, existe uma espécie de coluna vertebral que perpassa todo o raciocínio do filósofo nos últimos 25 anos. Agamben habitualmente coloca o seu leitor naquele lugar que ele chama de zona de indiferença, ou mesmo, de inoperosidade. A origem da ideia de uma zona de indiferença ou de inoperosidade, que Agamben usa como pressuposto ubíquo em sua obra, é justamente a teologia messiânica judaico-cristã – por isso se trata de uma genealogia teológica. Essa filosofia da indiferença ou messianismo político presente na obra de Agamben sempre se mostra a partir de três movimentos básicos operados pelo autor. Em primeiro lugar, ele faz uma crítica entre duas categorias historicamente colocadas em oposição no pensamento ocidental. Zoē e bíos, dentro e fora, lei e anomia, exceção e regra, etc. Após destacar esta polaridade, ele passa ao segundo movimento que se trata de fazer emergir uma zona de indiferença entre estes dois pólos. A figura do homo sacer, o estado de exceção, o campo de concentração, etc., são também exemplos de pessoas, lugares e situações em que essas oposições bilaterais se tornam indiferentes e entram em uma zona de inoperosidade. Tudo isso ele mostra para que, por fim, no terceiro movimento de sua argumentação, poder apresentar aquela que talvez seja sua única proposta: o momento messiânico de suspensão destituinte. A forma de vida franciscana, o uso sem posse, a violência divina, ou a profanação são diferentes modos de apresentar uma ação que esteja fora da chave de leitura metafísica potência/ato. Cada um desses movimentos fundamentais será explorado nas três partes da presente dissertação tendo como foco principal a assinatura “poder” em sua filosofia.

Previous issue date: 2016-08-04<br>The initial purpose of this essay is to look for evidences that the work of the italian writer
Giorgio Agamben influences the Latin American academic politic literature in a significative
way. In a complementary manner, it intends also to evaluate if the own latin american history
represents an incentive to researchers of different knowledge's areas get help in the
Agamben's teachings, in reason to a convergency of theories (Homo Sacer, State of
Exception, bare life, biopolitic, camp, etc) and facts (colonization, dictatorial regimes,
violence state, etc.). At the end, original manners to enrich reasonings and debates about
important social political problems will also be evaluated, using, for that, concepts developed
by Giorgio Agamben, writer that, necessary to register, owns a theoretical framework rich,
dense, sometimes complex, but, first off all, quite appropriate to face actual questions related
to the natural tension between the State and the Individual and, therefore, related to the own
life.<br>A proposta inicial desta dissertação concentra-se, principalmente, na procura de indicativos
de que a obra do escritor italiano Giorgio Agamben influencie de maneira significativa a
literatura político acadêmica produzida na América Latina. De modo complementar, pretendese
avaliar também se a própria história latino americana representa um incentivo para que
pesquisadores de diferentes áreas do conhecimento recorram aos ensinamentos de Agamben
em razão de uma convergência entre teorias (Homo Sacer, estado de exceção, vida nua,
biopolítica, campo, etc) e fatos (colonização, regimes ditatoriais, violência estatal, etc). Por
fim, serão avaliadas também maneiras originais de enriquecimento de raciocínios e debates
elaborados sobre importantes problemas sociopolíticos, utilizando, para tanto, conceitos
desenvolvidos por Giorgio Agamben, autor que, necessário registrar, possui um arcabouço
teórico rico, denso, algumas vezes complexo, mas, acima de tudo, sobremodo apropriado para
o enfrentamento de questões atuais e relacionadas à tensão natural entre o Estado e o
indivíduo e, portanto, à própria vida.

Sob a perspectiva de Giorgio Agamben, buscaremos os fundamentos teóricos que envolveram a imaginação durante a história ocidental até o momento em que esta se torna expropriada do conhecimento. Levamos em conta que noção de imaginação está inserida em um contexto de transmissão cultural que cada época gera para a próxima, e que, no entanto, também modifica suas fundamentações. Entenderemos a imaginação a partir do termo fantasma, ou seja, não como um termo isolado, mas envolvido em uma complexidade cultural, e entrelaçado de características, da quais, memória, sonho, linguagem, desejo, melancolia e sensação são seus aliados e que marcam a grande particularidade imaginativa como fantasma, que é de ser
imaterial, abstrato, e ainda, associada ao caráter do espírito. Na primeira parte, desenvolve-se a teoria do fantasma de Aristóteles que com o estoicismo e principalmente com o
neoplatonismo, começa a possuir suas primeiras vinculações com a antiga teoria do pneuma. Desta união obteve-se a noção do espírito fantástico que influência o período medieval intensamente. Nesta cultura conhecemos fatos importantes que nos levam a compreender tanto os mecanismos da imaginação, quanto a entender os primeiros sutis aspectos do processo de expropriação da imaginação na cultura ocidental. Mais do que tudo, a
reformulação ontológica que acontece na modernidade gera uma expropriação do sujeito da experiência (psyché), fenômeno correlato a expropriação da imaginação, gerando uma inserção no conflito entre racional e irracional. Na segunda parte, delimitamos a tratar primeiramente dos efeitos da exclusão da imaginação diante da experiência transmissiva, ou seja, a experiência tradicional e narrativa da qual se contrapõe ao experimento científico. Esta a nível, que poderíamos dizer, mitológica, no sentido do uso das palavras enquanto nos fazem sentido para vida. No segundo delineamento, trataremos de uma experiência, que se insere no
que poderíamos dizer, ritualística, no sentido em que invade as criações e o fazer cultural dos sujeitos em sociedade. Entretanto, ao que parecem, estas duas esferas inacessíveis nos dias atuais, aguardam novas possibilidades para serem demarcadas. O que temos em conta,
segundo Agamben, é que estas atividades, nunca são abandonadas como práticas fantasmáticas pelo adulto, apesar de hoje em dia estarmos perdendo esta potencialidade e desta forma, suas conseqüências na destruição da experiência e na impossibilidade usar, são
apenas reflexos da destruição da história e da dominação cultural. Agamben percebe que as formas simbólicas, as práticas textuais, as criações da cultura humana, todas precisam se apropriar do negativo, ou seja, do objeto ausente (fantasma) para plasmar certa realidade. A
experiência parece ter um sentido não exatamente na esfera concreta, mas entre a esfera imaginativa e assim, demarca fortemente as limitações que a cultura ocidental acabou deixando em segundo plano. No caso da manifestação lingüística, temos o signo resistente a toda significação representa-se pela metáfora. No caso do usar ou fazer humano que longe de demarcar sua utilidade, desvia-se para a ausência do objeto fetiche. Captar estas limitações e suas saídas através da teoria lingüística da Infância e da teoria do jogo da Profanação são as propostas de Agamben.<br>Under Giorgio Agambens perspective we search for the theoretical foundations which have
involved the imagination during the western history until the moment in that this history is
expropriated of the knowledge. We take into account what imagination notion is inserted in a
context of cultural transmission which each time generates for the next one and, however, also
modifies their foundations. We understand the imagination since the concept of phantasm, in
other words, it is not an isolated term, but it is involved in a cultural complexity and
interlaced of characteristics which are connected to memory, dream, language, desire,
melancholy and sensation and define the great imaginative particularity of ghost which is
immaterial, abstract and still related to the character of spirit. In the first part we develop the
theory of Aristotles ghost that has its first links to the old theory of pneuma starting from stoicism and mainly neoplatonism. From this union it was obtained the notion of fantastic spirit that influence the medieval period intensely. In this culture we know important
facts that lead us to understand the mechanisms of imagination as well as the subtle first
aspects of the expropriation process of imagination in western culture. Plus than everything
the ontological reformulation that happens in the modernity generates an expropriation of the
experience subject (psyché), correlated phenomenon to the expropriation of the imagination,
generating an insert in the conflict between rational and irrational. In the second part we
approach firstly the effects of the exclusion of imagination before the transmissive experience,
in other words, the traditional and narrative experience which opposes to the scientific
experiment. This is, so we could say, in a mythological level, in the sense of the use of the
words while they make us sense for life. Secondly we approach an experience that interferes
in what we could name, ritualistic, in the sense of the invasion of the creations and of the
doing of culture of the subjects in society. However, how it seems, these two inaccessible
spheres in the current days await new possibilities for being demarcated. According to
Agamben, these activities are never abandoned as fantasmatic practices by the adult, although
we are losing this potentiality nowadays and, in this way, t heir consequences in the
destruction of the experience, and in the impossibility to use this potentiality, are just reflexes
of the destruction of history and the cultural dominance. Agamben notices that the symbolic
forms, the textual practices, the creations of human culture, all need to take the negative, in
other words, the absent object (phantasm) to shape certain reality. The experience seems to
have a sense not exactly in the concrete sphere, but among the imaginative sphere and like
this, it strongly demarcates the limitations that the western culture ended up leaving in second
plan. In the case of the linguistic manifestation, we have the resistant sign to all significance
represented by the metaphor. In the case of the using or of the doing of human being, which
far away from demarcating its usefulness strays for the absence of the object fetish. To
capture these limitations and their exits through the linguistic theory of Childhood and through the theory of the game of Profanation are the proposals of Agamben.

This thesis starts by studying the specificity of Michel Foucault’s account of the emergence of bio-power in contrast to that developed by Giorgio Agamben. It focuses on the mutation of jurisdiction Foucault describes in the first volume of the History of Sexuality, which corresponds to the shift from the law of the sovereign to that of the norm. Challenging the idea that the concept of biological life can be spontaneously used to understand the type of relationship which links modern political power and life, this thesis questions the epistemological implications of this concept by inscribing it within Foucault’s wider description of the emergence of anthropological knowledge. Instead of understanding biopolitical modernity as the expression of the power of the sovereign, this thesis demonstrates that it is not the persistence of sovereign power but its transformation which allows to think the meaning of the concept of life targeted by human sciences. This thesis inscribes the historical emergence of anthropological knowledge within Foucault’s wider study of the Western history of subjectivity. It claims that it is the postulate of anthropological truth which provides a basis to the concept of norm. It demonstrates that anthropological knowledge is itself based upon an epistemological concept of truth which Foucault historicizes. This thesis argues that the concept of sovereignty can be used to problematize the relationship between the lives of individuals and their emergence as objects of knowledge. It shows that Foucault’s account of life as bios and aesthetics of existence provides a sense of the ethical sovereignty of the self which gets obliterated within the logic of the modern episteme.

“Soberanía” es la palabra que atraviesa de polo a polo la presente tesis. ¿En qué sentido habrá que entender el “y” de su título? En principio, no como una relación al modo de una conjunción entre elementos diferentes primariamente aislados entre sí. El “y” denotaría, ante todo, la relación originaria –es decir, la relación que es condición de todas las otras relaciones posibles- en cual toda soberanía constituiría, en sí misma, bio-política. Aparece, entonces, “bio-política”, concepto que, a la luz de las investigaciones de Foucault, no ha dejado de aparecer en la literatura filosófica contemporánea. Pero ¿por qué el guión que separa “bios” de “política”? En primer lugar para advertir que lo que en la soberanía está en juego es ante todo, la “forma de vida”. En segundo lugar que, a su vez, no habría política –al menos política en Occidente- sin esta implicación y, en tercer lugar que lo que se trataría de atender es, precisamente, esa relación que liga, de modo indisoluble, “forma de vida” y política. ¿En qué consistiría ese nexo? Es lo que, a continuación, se pretende explicar.
