Government can sabotage itself. From the president’s choice of agency heads to agency budgets, regulations, and litigating positions, presidents and their appointees have undermined the very programs they administer. But why would an agency try to put itself out of business? And how can agencies that are subject to an array of political and legal checks sabotage statutory programs? This Article offers an account of the “what, why, and how” of administrative sabotage that answers those questions. It contends that sabotage reflects a distinct mode of agency action that is more permanent, more destructive, and more democratically illegitimate than more-studied forms of maladministration. In contrast to an agency that shirks its statutory duties or drifts away from Congress’s policy goals, one engaged in sabotage aims deliberately to kill or nullify a program it administers. Agencies sabotage because presidents ask them to. Facing pressure to dismantle statutory programs in an environment where securing legislation from Congress is difficult and politically costly, presidents pursue retrenchment through the administrative state. Building on this positive theory of administrative sabotage, this Article considers legal responses. The best response, this Article contends, is not reforms to the cross-cutting body of administrative law that structures most agency action. Rather, the risk of sabotage is better managed through changes to how statutory programs are designed. Congress’s choices about agency leadership, the concentration or dispersal of authority to implement statutory programs, the breadth of statutory delegations, and other matters influence the likelihood that sabotage will succeed or fail. When lawmakers create or modify federal programs, they should design them to be less vulnerable to sabotage by the very agencies that administer them.

Purpose The purpose of this paper is to understand the relationship between administrative entrepreneurship and bureaucratic (administrative) leadership in government bureaucracies. Design/methodology/approach This topic is empirically examined in the context of India’s district administration. A within-case analysis is conducted of a District Collector’s efforts to initiate change using a case study research methodology. Data from elite interviews, analyzed in NVivo 11, are used to draw descriptive inferences that are tested against a set of conditions using the process tracing technique. Findings The District Collector in the study aspired to be a transformational leader by demonstrating administrative entrepreneurship, but in reality due to the formal organizational structures, the style of bureaucratic leadership functioning is transactional. Research limitations/implications This study contributes to furthering public leadership theory as it opens up the classic question: what type of leadership is expected out of administrative leaders in government bureaucracies? This is a critical issue given that District Collectors are responsible for the welfare of one-sixth of the world’s population. Practical implications District Collectors need to get comfortable with the duality inherent in their position – that their organizational structures allow them to be both administratively entrepreneurial and rigid – and learn the art of navigating these complex structures. Public sector training academies for career civil servants need to engage with the subject of administrative entrepreneurship and leadership. Originality/value This is the first study, to the best of knowledge, to develop an analytical typology that can be used as a diagnostic tool for administrative leaders to holistically assess their leadership style.

This quantitative study analyzed the relationship between district characteristics, the educational environment and the administrative organizational structure in public schools in the Commonwealth of Pennsylvania between the 1996-1997 school year and the 2006-2007. More specifically, this study conducted an assessment of the changes and stability that have occurred in the Commonwealth's 501 public school district's administrative positions and structures and determined the trends or relationships that exist between the administrative structure in comparison with district characteristics and the educational environment. Pennsylvania public schools have increased in total number of administrators across the Commonwealth from 5,734 in the 1996-97 school year (Database 1996-97) to 7,348 administrators in the 2006-07 school year (Database 2006-07). This is an increase of 1,614 administrators across the 501 public school districts. These increases have not been consistent from one year to another or across districts. Little is known concerning the relationship between internal district characteristics, the external educational environment and administrative changes or stability. In addition, little is known about that combination of characteristics that have allowed some districts to remain stable in a changing educational environment. In an effort to provide more information on these issues, this quantitative study analyzed public school administrative positions and structures in the 501 Pennsylvania school districts over time in relation to the district's characteristics and educational environment. By assessing combinations of district characteristics and the educational environment, this study sought to find similarities and differences in how districts administratively respond to forces and pressures on the organization.

Seal impressions on bullae offer new ways of approaching the local realities of Seleukid administrative and fiscal practice. Previous studies of these objects have focused primarily on the iconography of the impressed seals. However, analysis of the find-spots of bullae, their forms, the sealing protocols employed, the quantities of extant seal impressions, and the interactions that are evidenced by several individuals impressing their seals on a single bulla, enables a range of aspects of royal bureaucracy in Babylonia to be reconstructed. This study is based on thousands of published and tens of unpublished bullae from several Seleukid sites, and also incorporates a few bullae from elsewhere that are impressed by seals with Seleukid motifs. It demonstrates the importance of groups of men ‘on the ground’ for the articulation and enforcement of royal power. Routine bureaucracy ensured that taxes were collected and local authority maintained throughout the long periods when the king and court were absent from a region, and even during instances of conflict over the throne. Nonetheless, some of the surviving evidence appears to reflect bureaucratic failings; there were also moments of reform and instances of idiosyncratic behaviour. The bullae suggest that administrative practice was relatively homogeneous across Babylonia, but differed from that known from the Greek cities of western Asia Minor. There are however similarities between Seleukid administration in Babylonia and Ptolemaic administration in Egypt, suggestive of cross-fertilisation between the two Hellenistic powers. This study is important because scant information survives about the daily realities of Seleukid control from anywhere in the empire, and very little on Seleukid rule in Babylonia. Fully exploiting these initially unpromising sources helps to fill an important gap in our knowledge, and enables broader comparisons of imperial structures between the Seleukid, Ptolemaic and Achaemenid empires.

There has been a growing concern raised by nurse educators regarding the potential for litigation by nursing students who are dissatisfied with educators' appraisal of these students' clinical performance. A descriptive survey using a cross-sectional design was used to assess the relationships between institutional policies and procedures related to student clinical evaluation practices and the incidence of student grievances and appeals of faculty decisions. Population for this survey was diploma and basic baccalaureate nursing programs in Canada (N=94). The response rate to this survey was 86.2% (81/94 programs). Data were obtained using two self-developed questionnaires which tested for support of two prototypic models derived from literature reviewed. Variables studied included the decision-makers' location (educational institution, hospital), their role or position, their functions, and the guidelines under which they performed student evaluations. Also studied were mechanisms available to students to question the decision. Data were analyzed using descriptive statistics. Reliability of the data from the administrative practices instrument was assessed using contingency tables which compared the program's reported data to its written policies and procedures. The level of agreement was approximately .50 which was considered adequate bearing in mind the frequent discrepancies between policies and procedures in most institutions.. There were five significiant findings, these being: (1) there exists a lack of faculty evaluation standards when evaluating students in clinical settings, (2) in one-third of the programs a clinical instructor alone makes a student's clinical decision, (3) it appears that in some programs the same members serve on more than one level of review panels, (4) procedures employed in the conducting of informal and formal hearings are rarely written, and (5) grievance and appeal panels tend to alter professional judgments of nurse faculty even though panel members frequently are non-nurses.

This thesis seeks to examine the political and administrative organisations of al-Andalus during the period of the Almohads. It employs close analysis of the sources in order to explore how the Almohad government system worked and to identify the extent of the development and the efficiency of its structures during the period. Each chapter focuses on a specific part of this system. Chapter I examines the founding of the political organs established by the founder of the Almohad movement, Ibn Tūmart, and the reforms made by his successor, the founder of the empire, ʿAbd al-Muʾmin. Chapter II discusses the administrative political system of al-Andalus, especially the administrative divisions of the provinces, and the political structure of the government, represented by the governors and the kuṭṭāb. Chapter III examines the financial institutions and its structures, such as the ʿāmil, the mushrif, and the ṣāḥib al-aʿmāl, in addition to the Almohad sikka and its development. Chapter IV, the final chapter, studies the judicial system and highlights its religious functions.

A number of reforms described as the New Public Management (NPM) have been introduced in the UK. Key elements of this are the introduction of markets, an increase in the production of performance information and changes to organisational structures. This research evaluates the impact of these reforms on accountability. In order to do this a model of effective accountability is developed from the existing literature. The criteria of effective accountability are the provision of information by the steward, clarity of assignment of responsibilities, the ability of the principal to control the steward and the ability of the principal to apply rewards or impose sanctions An overview of the NPM and accountability is provided in the first paper. Three papers examine the impact of increased performance information on accountability, through an analysis of documents and plans. The conclusion is that the information provided does not meet the needs of the relevant stakeholders. Three further papers assess the impact of changes in organisational structure and find that clarity and democratic accountability are marginally enhanced. The final paper analyses the impact of a consumer approach to accountability in education. It concludes that resistance to this, from officials and politicians, diluted the possible benefits of increased clarity and sanctions for parents. The eight pieces of research show that although accountability overall has not been significantly enhanced, the impact of reforms has varied between the different elements of effective accountability. The giving of an account and clarity of account have been strengthened by the reforms, but there is more limited evidence on the other two criteria. These latter two areas in particular are important issues for further research on accountability. This research has contributed significantly to our understanding of the impact of reforms on accountability. This has been achieved through original empirical research as well as theoretical developments concerning the importance of information and the quality of data required by different stakeholders.

Recently researchers have started to investigate the cognitive strategic orientations of individual top managers and have pointed out these may be key in determining the direction and success of their organizations in terms of performance, but they have been unable to effectively operationalize this notion in empirical research and this is holding up knowledge development. To make a contribution that helps overcome this limitation a theoretical framework is developed which specifies the different possible cognitive strategic orientations of top managers as well as those of managers at lower organizational levels involved in the strategy process. This theoretical framework is investigated in the empirical phase of the study into strategic orientations in practice. Additional contributions to knowledge of strategic orientation are made in three main domains. Firstly, current knowledge of strategic orientation is largely limited to analysis at the level of the firm whereas there is a lack of understanding of any relationships with practice at lower organizational levels. The exploratory research undertaken for this thesis contributes to new knowledge of different rational, developmental and interactive strategic orientations of front-line managers and this contributes to a cognitive explanation for emergent strategy linked to strategy processes embedded in practice. In theorising the presence of different strategic orientations in practice the discussion highlights the importance of network and spatial embeddedness within enacted environments. Secondly, a contribution to further knowledge of the links between strategy processes and the content of strategies within a retail context is made. The research highlights different strategy processes used in practice by retail front-line managers in a branch network of stores and these are linked to consequences such as different objectives, performance expectations and the fulfilment of personal goals. Thirdly, a contribution to research methodology is made by addressing problems associated with the comparison of cognitive maps.

Phénomène séculaire, la pollution a pris une nouvelle ampleur au début des années 1970. Cette transformation a conduit l’État à mettre en place un dispositif de protection visant à prévenir ou réparer les dommages susceptibles d'en résulter. A une période où il faisait par ailleurs l'objet de nombreuses contestations, le droit administratif s'est alors trouvé confronté à un nouvel objet. L'étude des évolutions issues de cette rencontre révèle d'abord que les équilibres du droit administratif institutionnel ont été ajustés. L'institution étatique, largement attendue, s'en trouve revalorisée. Et les relations administratives sont redéfinies. Au sein de l'appareil administratif, l’État central est renforcé. Dans ses relations avec ses administrés, le pouvoir administratif s'est au contraire ouvert, favorisant sa démocratisation. Par ailleurs, les mouvements du droit administratif substantiel ont été modérés par l'appréhension de cette nouvelle mission. Du fait de sa dimension collective, la lutte contre la pollution se prête mal à la subjectivisation du droit administratif. Quant à la tendance à la contestation de l'autonomie du droit administratif, elle est également limitée. La transversalité de l'objet pollution favorise l'ouverture du droit administratif aux autres disciplines. Pour autant, l'intégration des sources extra-juridiques reste maitrisée et les effets de l'exercice de cette nouvelle mission en termes de banalisation du droit administratif sont mesurés
Although an age-old phenomenon, pollution has gained a new momentum throughout the l 970's. This development prompted the State to institute a plan to prevent or repair potential subsequent damages. At a time when it had already aroused many disagreements, administrative law then had to deal with a new matter. Balances of institutional administrative law were adjusted. The value of the state institution highly expected, was reasserted. And the administrative relations were redefined. Within the administrative institution, the unitary state was reinforced. On the contrary, the administrative power opened up towards its citizens, thus fostering its democratization. Besides, substantial administrative law, apprehensive of this new mission, tempered its movements. Due to its collective nature, pollution abatement does not lend itself to subjectivization of administrative law. While individual interests still hold an important place, the protection plan and its guarantees are based on the administrative action. The propensity to contest the autonomy of administrative law is also limited. The transversal essence of the pollution topic encourages administrative law to embrace other disciplines. Nevertheless, the integration of sources unrelated to law remains under control and the fulfilment of this new mission has moderate consequences in terms of trivialization of administrative law

To the study of the establishment of the European Commission in 1958 and its administrative structures, a "new" dimension can be said to have been added with material that has become available with the opening of the Historical Archives of the European Communities. Through this material one has been able to study from first-hand sources influences and aspects of the setting-up of the European Commission which has hopefully cast new light on this process. An interview with former Secretary-General of the Commission, Emile Noël, has given first-hand experiences of the work of the early Commission from a personal source. Approaching the study of the European Commission, one cannot avoid the High Authority. This was as close as one could get to a predecessor to the Commission. Their differences, however, were partly due to the scope of the High Authority, which covered a much smaller area of society, dealing only within the industries of coal and steel. Secondly, the Treaties of the ECSC and EEC approached the legislative process rather differently. Within the ECSC, legislative powers were given to the High Authority alone, whereas in the EEC, this was shared between the European Commission and the Council of Ministers, making the EEC less "supranational". Furthermore, differences between the two executive bodies can be found in the characters of its two Presidents, Jean Monnet and Walter Hallstein respectively. Monnet approached the setting-up of the High Authority in a minimalist way, only expanding and developing its administration according to needs. Hallstein believed in developing administrative structures first, for then to be able to concentrate on the developing of policies. It was also in this way that the Commission was able to perform its most characteristic, and unique feature, that of a political leadership. The influence of President Hallstein was here to prove considerable, together with the rest of the College of Commissioners, operating in a strictly collegiate and independent manner. Particularly during the Free Trade Area negotiations between the Six and the rest of the OEEC, the Commission showed its ability to take political initiatives. The Free Trade Area negotiations had started in an intergovernmental fashion in 1956, two years before the EEC and the Commission came into operation. Nevertheless, the Commission proved capable of entering the negotiations half way through, seeking to carry them on as the single voice of the Six.

AbstractIn the system of German federalism, the administrations of the 16 federal states (Länder) have central responsibility for the enforcement of both federal and state law. Despite all the heterogeneity in terms of size, administrative tradition and culture, their administrative structures are relatively uniform. Everywhere, the municipalities, which are part of the state executive under state law, play a significant and, above all, independent role as bodies of the public administration. There are some differences, but administration seems in some respects relatively homogeneous, not least due to the largely similar staffing structures, career patterns and administrative cultures. Structural reforms of very different scopes have been a long-term phenomenon since the 1990s.

AbstractAfter 1990, the rupture of the politico-administrative system and transformation of the German Democratic Republic (GDR) was essentially shaped by the process of German unification and the GDR’s integration into the ‘old’ Federal Republic. Thus, basic constitutional and institutional issues, such as legal rule (Rechtsstaat)-based administration, inclusion in the European Union, were (‘exogenously’) pre-determined by the GDR’s accession to the ‘old’ Federal Republic. The chapter highlights East Germany’s politico-administrative transformation after 1990 by addressing the organisational and personnel dimensions of the remoulding and rebuilding of the administrative structures at the new Länder and local levels. Finally, notwithstanding the particularities of the ‘East German case’, it raises question whether there are lessons which other countries facing transition or transformation can draw from East Germany’s experience.

AbstractThe chapter investigates the position of academic policy advice in Norway with an emphasis on political science, based on notions of politico-administrative systems and Scandinavian administrative traditions. We ask: What are the main access points for certified academics to bring their expertise to policymaking? What trends can be discerned? What is the position of Norwegian political scientists in emerging structures and processes of policy advice? The chapter identifies structures and processes in the provision of political science expert advice in Norway. Norwegian political scientists are heavily engaged in the provision of policy advice, at various levels of government as well as in public debate on relevant issues. There is also evidence which indicates strong involvement in policy advice in two areas: the Norwegian Research council and participation in ad hoc advisory bodies. Trends point towards a change in the forms of policy advice as well as a strengthening of the position of political science experts in the national policy advice system.

Report considers the field of governance first at the level of constitutional institutions and tradition, addressing the development of Turkey’s constitutional politics and contemporary debates as its subject matter. Secondly, the report includes the primary institutional structures relevant to establishing constitutional institutions into its subject matter. In this context, the political party regimes, electoral system, and public administration must be handled with their current structures and problems. Whether at the level of the constitution or the primary institutional structures, analyses are debated in terms of the socio-administrative dynamics that are determinant in shaping these structures, the effects these dynamics have on the formation of institutional structures and administrative traditions, and finally their impact on the functioning of Turkish politics. When creating the vision document, the report will identify Turkey’s stance within global debates through both its similarities, as well as its peculiarities to other nations. In this context, concrete and practicable recommendations are made to improve the functionality of the Presidential System, which was introduced with the 2017 Constitutional Referendum.

Over the last few decades, in-place recycling of asphalt pavements has seen increased use by the highway industry, primarily to take a dvantage of potential cost and logistical savings compared to conventional reconstruction. More recently, the U.S. Navy and Federal Aviation Administration have allowed recycling to be used on airfields with lighter traffic. This report contains a discussion of in-place recycling design considerations obtained from a literature review of its use in the highway industry. Observations developed from a review of airfield pavement projects that have utilized recycling is also included. A structural analysis was performed using the Pavement-Transportation Computer Assisted Structural Engineering (PCASE) tool to determine typical stiffness values that recycled layers must achieve to support various types of military aircraft traffic for different pavement structures. Overall, in-place recycling is recommended for consideration as a rehabilitati on technique for military airfield pavements, and further investigation is recommended before it is implemented it into design guidance.

The modern understanding of the state as a complex social system allows us to assert that its resilience is based on ensuring systemic homeostasis as a stabilizing dynamic mechanism for resolving contradictions arising in society associated with the threat of losing control over the processes of public administration and legal regulation. Public administration is a kind of social management that ensures the organization of social relations and processes, giving the social system the proper coordination of actions, the necessary orderliness, sustainability and stability. The problem of state resilience is directly related to the resilience of state (public) administration requires a «breakthrough in traditional approaches» and recognition of «the state administration system as an organic system, the constituent parts and elements of which are diverse and capable of continuous self-development». Within the framework of the «organizational point of view» on the control methodology, there are important patterns and features that determine the viability and resilience of public administration and regulation processes in the state and society. These include: W. Ashby's cybernetic law of required diversity: for effective control, the degree of diversity of the governing body must be no less than the degree of diversity of the controlled object; E. Sedov’s law of hierarchical compensations: in complex, hierarchically organized and networked systems, the growth of diversity at the top level in the structure of the system is ensured by a certain limitation of diversity at its lower levels; St. Beer’s principle of invariance of the structure of viable social systems. The Federal Aviation Administration instrumented four concrete slabs of a taxiway at the John F. Kennedy International Airport to collect pavement responses under aircraft and environmental loading. The study started with developing preprocessing scripts to organize, structure, and clean the collected data. As a result of the preprocessing step, the data became easier and more intuitive for pavement engineers and researchers to transform and process. After the data were cleaned and organized, they were used to develop two prediction models. The first prediction model employs a Bayesian calibration framework to estimate the unknown material parameters of the concrete pavement. Additionally, the posterior distributions resulting from the calibration process served as a sensitivity analysis by reporting the significance of each parameter for temperature distribution. The second prediction model utilized a machine-learning (ML) algorithm to predict pavement responses under aircraft and environmental loadings. The results demonstrated that ML can predict the responses with high accuracy at a low computational cost. This project highlighted the potential of using ML for future pavement design guidelines as more instrumentation data from future projects are collected to incorporate various material properties and pavement structures.

School-related gender-based violence (SRGBV) remains difficult to measure because of high sensitivity and response bias. However, most SRGBV measurement relies on face-to-face (FTF) survey administration, which is susceptible to increased social desirability bias. Widely used in research on sensitive topics, Audio Computer-Assisted Self-Interview (ACASI) allows subjects to respond to pre-recorded questions on a computerized device, providing respondents with privacy and confidentiality. This brief contains the findings from a large-scale study conducted in Uganda in 2019 where primary grade 3 students were randomly selected to complete surveys using either ACASI or FTF administration. The surveys covered school climate, gender attitudes, social-emotional learning, and experiences of SRGBV. Through this study, we find that although most survey responses were comparable between ACASI and FTF groups, the reporting of experiences of sexual violence differed drastically: 43% of students in the FTF group versus 77% of students in the ACASI group reported experiencing sexual violence in the past school term. We also find that factor structures are similar for data collected with ACASI compared with data collected FTF, though there is weaker evidence for construct validity for both administration modes. We conclude that ACASI is a valuable tool in measuring sensitive sub-topics of SRGBV and should be utilized over FTF administration, although further psychometric testing of these surveys is recommended.

This working paper predicts the fiscal and public health outcomes from a change in the excise tax structure for cigarettes in Ghana. More than 5,000 people are killed by diseases caused by tobacco every year in Ghana (Tobacco Atlas 2018). Currently the country has a unitary tax administration approach, with a uniform ad valorem tax structure on all excisable products, including tobacco. However, the ECOWAS directive on tobacco control, in line with the WHO Framework Convention on Tobacco Control (WHO 2003), recommends a simple tax structure – using a mixed excise system with a minimum specific tax floor to overcome the limitations of an ad valorem system on tobacco products, especially cigarettes. The study therefore simulates mixed tax policy interventions, and assesses their effect on government revenue and public health relative to the current ad valorem tax system. Primary data collection of tobacco prices in three geographical zones of the country was conducted in February 2020, across both rural and urban localities. This was supported with secondary data from national and international databases. Based on the assumption that Ghana adopts a mixed tax structure, the simulation shows that, if the government imposes a specific excise tax of GH₵4.00 (US$0.80) per pack in addition to the current ad valorem rate of 175 per cent of the CIF value, the average retail price of a cigarette pack would increase by 128 per cent, cigarette consumption decrease by 27 per cent, tobacco excise tax revenue increase by 627 per cent, and overall tobacco-related government tax revenue increase by 201 per cent.1 Additionally, there would be significant declines in smoking prevalence (3.3%), smoking intensity (1,448 cigarettes per year), and 3,526 premature smoking-related deaths would be avoided. The paper advocates for a strong tax administration and technical capacity, with continuous commitment by the government to adjust the tax rate in line with the rate of inflation and per capita income growth.
