The context of this article is the quest for justice and reparations for Australia's indigenous citizens. In 1991 the Council for Aboriginal Reconciliation was established through a unanimous vote in both houses of the Australian federal parliament. Comprised of twenty-five members (twelve of whom are Aboriginal and two Torres Strait Islanders) the Council identified eight key goals for a process centered on fostering the recognition of indigenous cultures by non-Aboriginal Australians, and on promoting fair and proper standards for indigenous Australians in health, housing, employment and education, and other fields.

In Australia, public debate about recognition of the nation’s First Australians through constitutional change has highlighted the complexity and sensitivities surrounding Indigenous/state relations at even the most basic level of legal rights. But the unevenness of race relations has meant Aboriginal perspectives on race relations are not well known. This is an obstacle for reconciliation which, by definition, must be a reciprocal process. It is especially problematic in regions with substantial Aboriginal populations, where Indigenous visibility make race relations a matter of everyday experience and discussion. There has been considerable research on how settler Australians view Aboriginal people but little is known about how Aboriginal people view settler Australians or mainstream institutions. This paper presents the findings from an Australian Research Council project undertaken in partnership with Larrakia Nation Aboriginal Corporation. Drawing on in-depth interviews with a cross-section of Darwin’s Aboriginal residents and visitors, it aims to reverse the racial gaze by investigating how respondents view settler Australian politics, values, priorities and lifestyles. Through interviews with Aboriginal people this research provides a basis for settler Australians to discover how they are viewed from an Aboriginal perspective. It repositions the normativity of settler Australian culture, a prerequisite for a truly multicultural society. Our analysis argues the narratives of the participants produce a story of Aboriginal rejection of the White Australian neo-liberal deal of individual advancement through economic pathways of employment and hyper-consumption. The findings support Honneth’s arguments about the importance of intersubjective recognition by pointing to the way misrecognition creates and reinforces social exclusion.

In 1988 the Aboriginal Education Policy Task Force called for broad equity between Aboriginal people and other Australians in access, participation, and outcomes at all stages of education. Aboriginals are not achieving a comparative level of success at school compared to non-Aboriginals. Symptomatic of problems in our schools are, the over representation of Aboriginals in lower classes, the high drop-out rate of Aboriginal children and their low participation rates in the senior years of high school. Some 17% of Aboriginal youth continue their schooling to year 12 compared to 49% of all students (Department of Employment, Education and Training, 1988, p.7). The failure of Aboriginal children to achieve at school has been widely interpreted as an individual failure on the part of Aboriginal children. Poor attainment has been attributed to lower I.Q. and ability, inadequate home environments, and poor parenting and not to the inadequacies of the education provided, to prejudices Aboriginal children face or to the active resistance by Aboriginal people to the cultural destruction implicit in many educational programs (McConnochie, 1982, p.20). An examination of the determinants of school success shows that Aboriginal children’s cultural values, beliefs and practices and Australian schools are often in conflict. To improve the outcomes for Aboriginal children schools are required to assess whether or not they are catering for the inherent needs and talents of individual Aboriginal children.

SummaryThe variability of three behavioural risk factors for heart disease—heavy alcohol and tobacco consumption and physical inactivity—was assessed in an Australian Aboriginal community, where heart disease death rates were high. Prevalence levels were assessed by comparison with those experienced by all adult Australians and by evaluating whether Aboriginal rates were influenced by underlying sociodemographic conditions. Relative risk ratios, odds ratios and logistic regression analysis were used.A total of 159 males and 114 females participated. Compared to all Australians, Aborigines are significantly more likely to drink five or more drinks on a drinking day, to be current smokers, and not to participate in vigorous exercise. In the Aboriginal community, univariate analysis indicates that: the odds of being a heavy drinker are significantly higher for those in unsatisfactory health; odds of being a current smoker are significantly higher for those in unsatisfactory health or unemployed; odds of not participating in vigorous exercise are significantly higher for those in unsatisfactory health, unemployed or without secondary education. Multivariate analysis shows that risk of being a heavy drinker is independently associated with sex, age, and health status; risk of being a current smoker is associated with health and employment status. The risk of not participating in vigorous exercise is significantly related to all sociodemographic variables examined. Reasons for these associations are discussed.

The Hon. John Dawkins (then) Minister for Employment, Education and Training, launched the Aboriginal Education Policy at a grand event in the Committee Room at Parliament House on 26th October 1989. The Prime Minister blessed the occasion with his presence and a short speech. Three of the former Chairs of the the National Aboriginal Education Committee were there, as were Aboriginal and Torres Strait Islander educationists from most Australian states. Only New South Wales, which decided to boycott the launch, wasn’t officially represented.There are two reasons for calling the policy that the Minister launched the Aboriginal Education Policy. Firstly, because it is the first policy formally endorsed by any National government; and secondly, because it responds to the call made in the 1988 Report of the Aboriginal Education Policy Task Force, for a concerted national effort – to achieve broad equity between Aboriginal people and other Australians in access, participation and outcomes at all stages of education. Our position still seems to me to be a somewhat uncertain one. There is a national ambivalence towards us. Numerically we are not very strong — just 1.6 per cent of the population; 265,000 people as counted at the 1991 Census. It could be said, however, that we get more than our share of this nation's attention. There are good and bad aspects to this. In the popular imagination, there are two basic images of Indigenous Australians: one I would term a ‘cultural’ image, that accepts us for our uniqueness, our ‘Australianness’; the other image is the ramshackle world of poverty, deprivation and hopelessness. Aboriginal and Torres Strait Islander people are the most disadvantaged group in the country. Whatever social indicator you use — health status, education, employment, contact with the law — we are at the bottom of the heap. This is such a commonplace statement of fact that it is in danger of becoming a piece of empty rhetoric.These are the views on the current position of Aboriginal disempowerment in Australian society, expressed by Lois O'Donoghue (1995: 5).

Indigenous students are not attaining the same educational and employment outcomes as non-Indigenous students. Psychological constructs have been demonstrated by research with non-Indigenous Australians to impact upon desirable educational outcomes; however, there is a dearth of Aboriginal education research that has identified psychological constructs of salience to Indigenous students. The purpose of this study was to: (a) evaluate the self-concepts of Indigenous secondary students; (b) identify Indigenous students' aspirations; (c) elucidate Indigenous students' perceptions of barriers faced in attaining their aspirations; and (d) compare and contrast the pattern of results for Indigenous students to results for non-Indigenous students from the same schools. A total of 1686 students (517 Indigenous and 1151 non-Indigenous) from urban and rural regions from three Australian States participated. Indigenous students displayed statistically significantly lower academic (school, maths, verbal) self-concepts in comparison to non-Indigenous students. Significantly more Indigenous students in comparison to non-Indigenous students aspired to leaving school early, attending Technical and Further Education (TAFE) institutions and were less likely to know much about what sort of job or further education and training they could pursue after leaving school. Indigenous students also rated nine potential barriers with significantly higher scores compared to non-Indigenous students in regard to limiting or stopping them from achieving what they want to do. The results have important implications for career education and counselling interventions in educational contexts.

Aboriginal people comprise ~30% of the Northern Territory population, but make up well under 10% of the government bureaucracy designed to serve that population. This paper is based on PhD research into Aboriginal experiences of participating in this bureaucracy. Interviews were conducted in 2007 with 76 people of Aboriginal and/or Torres Strait Islander background who had worked in the Northern Territory Government since self-government in 1978. The process of recruiting interviewees revealed a high degree of career mobility between government and the Indigenous sector of publicly funded organisations which operates at arm’s length from government. This finding was quite pronounced in the desert centre of Alice Springs, at the periphery of the Northern Territory administration, where those who were encouraged as a livelihood option to build Aborigines’ numeric representation in government were unable to represent their people in more substantive ways without coming into tension either with the terms of their employment or with their communities. The paper explores the ways in which Aboriginal public servants sought substantively to represent others and the phenomenon whereby many who sought representative roles in the government of the desert were in orbit and thus neither inside nor outside but somewhere at the edges of government. The paper concludes by observing that the knowledge and experience of Aboriginal people who orbit at the edges of government may be made more accessible through collaborations with the Indigenous sector than solely through government employment.

Despite commitment by the Australian Government to improve the economic independence of Indigenous people Aboriginals and Torres Strait Islanders they are the most socio economic disadvantaged group relative to other Australians. This commitment manifests in the four main strands of; 1) welfare, 2) installation of the Community Development Employment Projects (CDEP) scheme, 3) legislation enabling Traditional Land Owners and miners to negotiate agreements for training and employment of Indigenous people, and 4) programmes to encourage Indigenous entrepreneurship. This paper reports an Australian Indigenous entrepreneurial business (furniture making) initiated by the Gumatj clan of the Yolngu people in East Arnhem Land in the Northern Territory (NT) of Australia. These Indigenous people are employed in timber milling and transporting the milled timber to Gunyangara on the Gove Peninsula where it is dried and used to make furniture. Overcoming the literature documented barriers to Australian Indigenous entrepreneurship compelled the Gumatj to develop a business model with potential to foster pathways for other Indigenous small business endeavours.

The extent of Australian Indigenous employment disadvantage has been quantitatively established by researchers since the 1970s. Indigenous Australians have higher unemployment and lower participation rates, they are occupationally concentrated in low skill, low paid jobs, and their income is significantly lower on average than that of other Australians. The explanations given for this disadvantage largely focus on skills deficit and geographical location of Indigenous people. However these explanations do not stand up to scrutiny. Indigenous employment disadvantage remains irrespective of where Indigenous Australians live or how well they are qualified. Alternative explanations are clearly needed. A clue to the direction of research is given by the same researchers who acknowledge the legacy of history in creating the situation of disadvantage faced by Indigenous Australians. However, to date the nature of this legacy has not been explored. It is this history which is the focus of this thesis. The research questions which the thesis addresses are: 1. Are there identifiable 'invariant elements' which underpin the institutional forms which have regulated the treatment of Indigenous Australians within the economy, particularly in relation to employment, from colonisation until recent times? 2. Do these invariant elements help explain the continuing employment disadvantage of Indigenous Australians? To examine the history of the treatment of Indigenous Australians in relation to employment, four concepts were developed from the regulation school of economic theory and the work of Appadurai. These concepts are econoscape, reguloscape, invariant elements and institutional forms. The notion of 'scape' allows for recognition that when Australia was colonised, there already existed a set of economic arrangements and social and legal system. The conflict between the introduced economy and legal and social systems can be conceived as a conflict between two econoscapes and reguloscapes. Analysis of the econoscape and reguloscape from international, national and Indigenous perspectives for the period from colonisation to 1850 has enabled the identification of 'invariant elements' which describe the ways of thinking about Aborigines brought to the Australian colonies and adapted to the realities of the Australian situation. The four invariant elements identified are summarised as belief in 1) Aboriginal inferiority; 2) Aboriginal laziness, incapacity and irresponsibility; 3) the need for white intervention in Aboriginal lives; and 4) disregard for Aboriginal understandings, values and choices. The fourth invariant element is conceptualised as the foundation on which basis the other three developed and were able to be perpetuated. Analysis of the laws pertaining to Aborigines promulgated between 1850 and the 1960s in four jurisdictions shows that the same invariant elements influenced the nature of the institutional forms used to limit the freedom of movement and of employment of Indigenous Australians. Although during the period from the 1850s to the 1960s there was ostensibly a change in policy from one of protection to one of assimilation of Indigenous Australians, in fact little changed in terms of perceptions of Aborigines or in the institutional forms which, by the 1920s in all jurisdictions surveyed, controlled every aspect of their lives. Confirmation of the influence of the invariant elements was sought through closer study of two particular cases from the beginning and end of the above time period. These case studies involved examination of the institutional forms within the context of the econoscape and reguloscape of different times, in the first case in Victoria in the 1860s-1880s, and in the second case in the Northern Territory in the 1960s. The analysis indicates that the invariant elements had a continuing influence on perceptions and treatment of Indigenous Australians at least to the referendum of 1967. This thesis establishes, through rigorous analysis based on a robust theoretical and methodological foundation, that identifiable ways of thinking, or invariant elements, have underpinned continuous Indigenous employment disadvantage and help explain this continuing disadvantage. The common explanations of Indigenous disadvantage are also consistent with these invariant elements. The thesis concludes by recommending further research based on the findings of this thesis be conducted to scrutinise policy and practice over the last three to four decades in relation to Indigenous employment. It also emphasises the importance of redefining the problem and finding solutions, tasks which can only be done effectively by Indigenous Australians.

Government figures put the current indigenous unemployment rate at around 23%, 3 times the unemployment rate for other Australians. This thesis aims to assess whether Australian indirect discrimination legislation can provide a remedy for one of the causes of indigenous unemployment - the systemic discrimination which can result from the mere operation of established procedures of recruitment and hiring. The impact of those practices on indigenous people is examined in the context of an analysis of anti-discrimination legislation and cases from all Australian jurisdictions from the time of the passing of the Racial Discrimination Act by the Commonwealth in 1975 to the present. The thesis finds a number of reasons why the legislation fails to provide equality of opportunity for indigenous people seeking to enter the workforce. In nearly all jurisdictions it is obscurely drafted, used mainly by educated middle class white women, and provides remedies which tend to be compensatory damages rather than change to recruitment policy. White dominance of the legal process has produced legislative and judicial definitions of "race" and "Aboriginality" which focus on biology rather than cultural difference. In the commissions and tribunals complaints of racial discrimination are often rejected on the grounds of being "vexatious" or "frivolous", not reaching the required standard of proof, or not showing a causal connection between race and the conduct complained of. In all jurisdictions the cornerstone of liability is whether a particular employment term, condition or practice is reasonable. The thesis evaluates the approaches taken by appellate courts, including the High Court, and concludes that there is a trend towards an interpretation of reasonableness which favours employer arguments such as economic rationalism, the maintenance of good industrial relations, managerial prerogative to hire and fire, and the protection of majority rights. The thesis recommends that separate, clearly drafted legislation should be passed to address indigenous disadvantage and that indigenous people should be involved in all stages of the process.

Aboriginal Australia is facing a time like no other. This chapter reflects on our ever-adapting culture, as we are lamenting the passing of our cultural custodians, each of whom is a library of profound knowledge. It articulates how a global groundswell of creative work, controlled and created from an Aboriginal and/or first peoples perspective, works to retain language and revitalize ritual forms. Our creative practices have enabled Indigenous arts industry workers across all genres a relevant voice, better employment prospects, community outcomes, and, most important, the control of how we are perceived. Viewers of museum exhibitions now have more awareness of the sophisticated and complex societal structures we have developed and lived for thousands of years. But what of the continuing cultural obligations and clan/nation responsibility, the cultural inheritance of the oldest living race?
