This chapter evaluates the merits of Brussels as a venue for international arbitration proceedings. It discusses the history and development of arbitration in Belgium; the processes and rules involved as well as the role of courts in the conduct of arbitration proceedings; and rules for arbitral awards. It concludes that the revision of the Belgian Law on Arbitration (BLA) based on the United Nations Commission on International Trade Law (UNCITRAL) Model Law in 2013 has resulted in a modern, state of the art, and progressive arbitration law, which is characterized by flexibility and demonstrates the will of the Belgian legislator to provide an efficient framework for a modern business environment within which arbitration can proceed in the best possible circumstances. The geographical position of Brussels, its status as an international administrative and business center, and the relatively low cost of arbitrating in Brussels further explain why it is increasingly chosen as a seat for arbitration.

When the Peace Conference opens in Paris in January 1919, Georges Clemenceau insists upon the importance of prosecuting war criminals. It decides to set up a Commission on Responsibilities, with representatives of the five Powers (the United States, the British Empire, France, Italy, and Japan), as well as five smaller countries, including Belgium. The Commission soon agrees that the Kaiser should not be prosecuted for starting the war or for violating Belgian neutrality. However, a majority, led by the British representative, Ernest Pollock, and the French delegate, Ferdinand Larnaude, insist that the Kaiser should be tried for violations of the laws and customs of war by an international tribunal. The Americans, led by Robert Lansing, are fiercely opposed. Compromise proves impossible. The Commission issues a majority report favouring trial of the Kaiser for war crimes, while the Americans and the Japanese write dissenting opinions.

This chapter argues that despite its ability to sustain itself as a political system for almost 200 years, Belgium gives substantial empirical support to the lingua franca thesis. The existence of different public spheres within this political system has played a major role in preventing the satisfactory enactment of democratic representation at the national level, inducing centrifugal forces that have gradually led to the partial disintegration of the state. The federalization of Belgium along linguistic lines in 1993 can, in essence, be seen as the crescendo of a long process whereby the supposedly natural logic of the lingua franca thesis has gradually set in. If we take Belgium as our only case, the prospects for a well-functioning and sustainable multilingual democracy are not especially encouraging.

Bringing together contributions from legal scholars and practitioners, this book contributes to a broader reflection on the extent to which policy controversies on humanitarian admission to Europe are channeled and managed through law. The book is divided into four parts. The first part identifies the international and European legal obligations that are binding on both the EU and the Member States, and the constraints they impose – potentially and actually – when dealing with migrants who are outside EU territory. The second part studies the legal framework of humanitarian admission in three Member States (Germany, Italy and Belgium), as well as the related procedures and practices. The third part focuses on the experiences of those seeking humanitarian admission, including how they mobilize the law to obtain legal access to Europe. It presents the results of ethnographic fieldwork conducted among refugees in a refugee camp in Uganda who are seeking resettlement, as well as the testimony of the lawyer who defended a Syrian family applying for a humanitarian visa in Belgium in a landmark case that was litigated before the CJEU (X. and X. v. Belgium). The fourth part discusses the prospects for future developments in the EU legal and policy framework, including attempts at reforming the EU Visa Code and establishing a Union resettlement framework. The book is edited by Marie-Claire Foblets and Luc Leboeuf, both from the Department of Law and Anthropology of the Max Planck Institute for Social Anthropology.

This chapter portrays the historical actors who established the unique ethnographic collections of the Royal Museum for Central Africa and the Royal Museum of the Armed Forces and of Military History (Belgium). The objects they collected, like the majority of those in the museum, arrived in Belgium during the colonial period. The government of the Congo Free State, then the Ministry of Colonies and several scientific institutes issued directives encouraging their agents to collect artifacts, as well as photographic images of “indigenous types” and specimens of physical anthropology. This chapter examines the current amnesia about human remains of colonial provenance and the challenges surrounding the exhibition of religious objects now presented as great artworks of universal interest by metropolitan museums. Addressing the ethics of curatorial practice, the chapter proposes that curators of ethnological collections of colonial provenance, as public historians, strive to make collecting history accessible to larger audiences in their exhibitions.

Communication is recognized as one of healthcare professionals’ core clinical skills. Even though many endeavours have been undertaken to help professionals acquire these skills, many questions remain unanswered in terms of the transfer of learned skills to clinical practice, and in terms of the impact of this transfer on patients’ care and well-being. In the last two decades, communication skills training programmes, designed for healthcare professionals working in cancer care, have been the focus of several research endeavours of a research group based in Belgium. The efficacy of designed programmes has been tested in studies using a controlled design. Studies varied in the type of teaching method, the length of training, and the outcome measures considered. Four programmes will be detailed in this chapter in terms of rationale and results. The conclusion will build upon these experiences to develop recommendations and discuss where we may go from there.

The narrative is well known: in the nineteenth century Christianity became ‘feminized’, men were turned into the irreligious or uninterested other, and at the start of the twentieth century there were several attempts to bring man back to church and ‘masculinize’ religion. Both trends, the ‘feminization’ and ‘masculinization’, have been traced in American and European Christianity. Research on both sides of the Atlantic has thereby placed the ‘masculine religion’ of the early twentieth century in opposition to the ‘feminine’ character of nineteenth-century Christianity. But should we examine the ‘masculinity’ promoted in this era solely from this oppositional perspective? Are we not, by doing so, falling in line with a narrative that has already triggered criticism? This chapter address these questions by examining the all-male Catholic movements that developed in France, Belgium, and Germany.

This chapter examines the juxtaposition of war and gender in The Backwash of War, a collection of thirteen short stories by Ellen Newbold La Motte (1873–1961) based on her experience as a volunteer nurse in Belgium at a hospital behind the French lines during World War I. La Motte's stories literally devoted to the wounds of the Great War, as well as the psychological and moral degradation caused by the conflict. Yet La Motte also acknowledges how even her own critiques, no matter how intransigent, are always at risk of feeding back into the machinery of war on both ideological and practical grounds. As a woman, she understood quite well how war discourse strategically exploits the opposition it sets up between the peaceful virtues of womanhood and the warlike instincts of masculinity by constructing the protection of the former as a license for the latter. This chapter also considers the themes of medicine and torture in The Backwash of War.

The 2008 financial crisis triggered the worst global recession since the Great Depression. Many OECD countries responded to the crisis by reducing social spending. Through eleven diverse country case studies (Belgium, Germany, Greece, Hungary, Ireland, Italy, Japan, Spain, Sweden, United Kingdom, and the United States), this volume describes the evolution of child poverty and material well-being during the crisis, and links these outcomes with the responses by governments. The analysis underlines that countries with fragmented social protection systems were less able to protect the incomes of households with children at the time when unemployment soared. In contrast, countries with more comprehensive social protection cushioned the impact of the crisis on households with children, especially if they had implemented fiscal stimulus packages at the onset of the crisis. Although the macroeconomic ‘shock’ itself and the starting positions differed greatly across countries, while the responses by governments covered a very wide range of policy levers and varied with their circumstances, cuts in social spending and tax increases often played a major role in the impact that the crisis had on the living standards of families and children.

The individual chapters analyse the methods and channels of propaganda utilised in neutral countries, including rumours, newspapers, cartoons, films, pamphlets and magazines as well as radio broadcasts, official reports, diplomatic movements, cultural campaigns and soft power. They look to understand how these methods and channels have been deployed and how effective they have been in changing or reinforcing opinions and outcomes. Finally the book highlights the interaction between the concepts of propaganda and neutrality. It considers whether neutrality is a form of propaganda in itself, whether it is possible to be truly neutral in any propaganda battle and how the different forms of neutrality, including projected strict neutrality, non-belligerency and non-alignment, have been utilised by neutrals and belligerents to achieve propaganda goals in the last 120 years.

Abstract This book provides the first ever in-depth treatment of shared rule, a crucial but so far largely neglected dimension of federalism and multilevel governance. The book discusses shared rule’s conceptual evolution and defines three different meanings commonly ascribed to it: shared rule as horizontal cooperation, centralization, or bottom-up influence-seeking. An original expert survey conducted among thirty-eight federalism scholars in eleven countries is used to measure actual as opposed to merely potential regional government influence over national decisions. Drawing on a wide range of literature, from lobbying and political parties to power-sharing and secessionism, the book then investigates the emergence and impact of shared rule thus understood. The evidence presented includes qualitative case studies on Belgium, Canada, Germany, Spain, Switzerland, and the USA as well as quantitative, cross-sectional analyses at regional and national level. The book shows that shared rule has the potential to become the holy grail of territorial politics in that it satisfies both those wanting greater unity and uniformity of policy-making and also those desiring greater regional autonomy and recognition of diversity. Building on the conceptual and empirical groundwork laid by the Regional Authority Index, the book thus takes us further and deeper into the mechanics of territorial contestation, cooperation, and cohesion.

This book offers a clearer understanding of the nouvelle théologie, an influential French reform movement that flourished during the 1930s and 1940s, championed ressourcement, or, a ‘return to the sources’, and hoped to build a certain rapprochement with modernity by appropriating the historical method, aspects of phenomenology, and social engagement. Comprised of theologians and philosophers from the Jesuit theologate Fourvière in Lyon and the Dominican house at Le Saulchoir in Belgium, they were led by such figures as Henri de Lubac, Jean Daniélou, Marie Dominique Chenu, and Yves Congar. After identifying a lacuna in the secondary literature, the book remedies certain historical deficiencies by constructing a history more sensitive to the wider intellectual, political, economic, and cultural milieu of the French interwar crisis, that establishes continuity with the Modernist crisis and the First World War. It examines the modern French avant-garde generations that shaped intellectual and political thought in France. The historical narrative examines various stages of older generational influence on the development of the nouveaux théologiens, including the influence of the Modernists as well as older generations of Jesuit and Dominican mentors. Moreover, the effects of the First World War are examined, as is their religious formation in the 1920s, the emergence of their wider generation during the crisis years of the 1930s, and their own participation in the wider intellectual thirst for revolution. It explores the 1940s, when the generation of 1930 rose to prominence and the global triumph of their thought during the 1960s.

Abstract This book shows that teachers at monolingual schools respond ambivalently to their linguistically diverse groups of pupils. It does so to reveal practices that often fall off the scientific radar: language-in-education research is mainly interested in describing teachers with a critical or conservative view of monolingual school policies. These teacher types are useful for advocating multilingual education policies, but they leave much ordinary, inconsistent behavior unaccounted for. The interest in critical and conservative teachers also encourages us to praise or blame teachers, while it invites incompatible explanations: critical teachers have somehow escaped a monolingual ideology that completely deceives their conservative colleagues. Based on linguistic-ethnographic research in five Dutch-medium schools in Brussels, Belgium, this book seeks to explain how teachers who severely impose monolingual policies also adhere to an egalitarian pedagogy, why teachers who criticize monolingual policies also maintain and justify them, and why teachers who recognize pupils’ primary varieties in class also prohibit these varieties on various occasions. The book suggests, moreover, that ideology can account for teachers’ habitual as well as critical activity by viewing ideologies as contradictory, so when people internalize ideologies, they adopt contrary opinions that allow them to think. The book argues that this capacity is crucial for attending to the multiple, competing, goals that classroom interaction presents, that it typically invites inconsistent, albeit rational, behavior, and that if this inconsistency is common and chronic, researchers of language-in-education need to improve their radar and develop a different kind of dialogue with teachers.

Long gone are the times when class-based political parties with extensive membership dominated politics. Instead, party politics has become issue-based. Surprisingly few studies have focused on how the issue content of West European party politics has developed over the past decades. Empirically, this books studies party politics in Belgium, Denmark, France, Germany, the Netherlands, Sweden, and the UK from 1980 and onwards. The book highlights the more complex party system agenda with the decline, but not disappearance, of macroeconomic issues as well as the rise in ‘new politics’ issues together with education and health care. Moreover, various ‘new politics’ issues such as immigration, the environment, and European integration have seen very different trajectories. To explain the development of the individual issues, the book develops a new theoretical model labelled the ‘issue incentive model’ of party system attention. The aim of the model is to explain how much attention issues get throughout the party system, which is labelled ‘the party system agenda’. To explain the development of the party system agenda, one needs to focus on the incentives that individual policy issues offer to large, mainstream parties, i.e. the typical Social Democratic, Christian Democratic, or Conservative/Liberal parties that have dominated West European governments for decades. The core idea of the model is that the incentives that individual policy issues offer to these vote- and office-seeking parties depend on three factors, namely issue characteristics, issue ownership, and coalition considerations. The issue incentive model builds on and develops a top-down perspective on which the issue content of party politics is determined by the strategic considerations of political parties and their competition with each other.

He then examines the ways in which Bible is used in the novels as well as the ways in which Poirot understands God and evil to be at work in the world. Clanton also considers that many do not encounter Poirot in his original literary contexts. That is, far more people have been exposed to Poirot via “mediated” renderings and interpretations of the stories and novels in various other genres, including radio, films, and TV. As such, the book engages the reception of the stories in these various genres, since the process of adapting the original narrative plots involves, at times, meaningful changes. The book concludes by examining the impact Poirot and his stories have had on readers and viewers and, more specifically, fan groups from which primary reflections and data will be gathered and analysed. Capitalizing on the immense and enduring popularity of Poirot across multiple genres and the absence of research on the role of religion and Bible in those stories, this book is a necessary contribution to the field of Christie studies and will be welcomed by her fans as well as scholars of media and religion.

SUMMARY. In response to the challenges posed by the coronavirus (COVID-19) pandemic, Ukraine has undergone the necessary legislative changes, harmonized with international approaches, which in turn have led to significant changes in health care practices. The Law of Ukraine “On Amendments to Some Legislative Acts of Ukraine on Provision of Treatment of Coronavirus Disease (COVID-19)” № 539-IX, the Order of the Ministry of Health “On Approval of the Procedure for Prescribing and Using Medicines for the Treatment of Coronavirus Disease (COVID-19)” of 30.06.2020 № 1482, registered in the Ministry of Justice of Ukraine on July 08, 2020 for № 641/34924, establish the conditions of use of registered medicines according to the indications not specified in the instructions for medical use (off label), and unregistered medicines, recommended by the relevant official bodies outside Ukraine for the treatment of COVID-19. In pursuance of legislative acts, the Standard of Emergency Care “Coronavirus Disease (COVID-19)”, the Standards of Medical Care “Coronavirus Disease (COVID-19)”, the Standard of Pharmaceutical Care “Coronavirus Disease (COVID-19)”, the Protocol “Provision of medical care for the treatment of coronavirus disease (COVID-19)” were developed, approved and updated in accordance with the established procedure. At the same time, in order to assist the doctor and the patient in making a rational decision in different clinical situations, a clinical guideline “CLINICAL MANAGEMENT OF PATIENTS WITH COVID-19. “LIVE” CLINICAL INSTRUCTION” was developed – a document containing systematic provisions on medical and medico-social assistance, developed using the methodology of evidence-based medicine on the basis of reliability and proof confirmation. The basis of this clinical guideline is the WHO guideline “Clinical management of COVID-19: interim guidance” (27.05.2020), supplemented by the provisions of other WHO documents, as well as clinical guidelines of Great Britain, Belgium, USA and Australia. This guideline, as a living guideline, is a WHO innovation driven by the urgent need for global collaboration to provide reliable data and guidance emerging in the world as the result of numerous randomized clinical trials on COVID-19. The clinical guideline reflects the sequence of evidence on COVID-19 treatment in the world during a pandemic, on the basis of which the treatment strategy depending on the stage of the disease was formed and the decisions to include and exclude drugs in the protocol for COVID-19 treatment were justified, and will be further updated.

AB InBev is today’s uncontested world leader of the beer market. It represents over 20 per cent of global beer sales, with more than 450 million hectolitres a year flowing all around the world. Its Belgian predecessor, Interbrew, was a success story stemming from the 1971 secret merger of the country’s two leading brewers: Artois and Piedboeuf. Based on first-hand material originating from company and private archives as well as interviews with managers and key family actors, this is the first study to explore the history of the company through the nineteenth and twentieth centuries.The story starts in the mid-nineteenth century with the scientific breakthroughs that revolutionized the beer industry and allowed both Artois and Piedboeuf to prosper in a local environment. Instrumental in this respect were the respective families and their successive heirs in stabilizing and developing their firms. Despite the intense difficulties of two world wars in the decades to follow, they emerged stronger than ever and through the 1960s became undisputed leaders in the national market. Then, in an unprecedented move, Artois and Piedboeuf secretly merged their shareholding in 1971, though keeping their operations separate until 1987 when they openly and operationally merged to become Interbrew. Throughout their histories Artois, Piedboeuf, and their successor companies have kept a controlling family ownership. This book provides a unique insight into both the complex history of these three family breweries and their path to becoming a prominent global company, and the growth and consolidation of the beer market through the nineteenth and twentieth centuries.

This book is used in a number of universities in Belgium, the Netherlands and on Dutch Caribbean islands. In the course of an international parenting program of different universities in Europe, participants inquired repeatedly about an English version of our book. This edition answers to that question. But how to translate the different meanings of the first part of the Dutch title into proper English? And also in such a way it can be well understood in other European countries as the special focus of this book? Let us take you shortly along our process of decision making, how to translate the above title. The second part of the title is the easiest to translate: A guide for professionals working with parents. Let us be clear from the start: This book is not about helping parents raising their children. About the content later more, but now shortly about the second part of the Dutch title which seems to have much more possibilities for translation. “Do you understand those parents?”, would be a first option. This can be read as an invitation to try and understand parents, parenthood or parenting of a person, a couple or a group. The first title part in the Dutch version often has an association of difficulty how to understand parents. Or even stronger: the underlying connotation of this question of quickly criticizing their actions and even the tendency to blame them. This question we often heard from students, social workers and from members of different professions in multidisciplinary consulting teams. Our question in reaction : “What is your view of these parents?” was very often followed by a rather negative view on their parenting, based on the assumption: “Why don’t they see the needs of their child?” Apparently for a professional it is more common to keep in mind the vulnerability of a child than that of a parent. The challenge for a great number of care workers who meet children and their parents seems obviously: how to be open minded towards parents? Professionally and parent focussed working with parents is, to our opinion, a question of perspective of the professional. We all tend to look at parents firstly from our professional view on the needs of a child, we call that the child-perspective. But parenthood is more than bringing up a child or knowing how to help them in their growth, also called parenting. Although parents themselves also see as their core business: raising and educating their own child, they are also individuals, partners, family members, and a number of other social roles as a member of the society. For that reason we did choose as the main title: “Do you see those parents?” For trying to take their perspective is primarily seeing their normal daily struggle, with their specific circumstances, their personalities, their histories, their beliefs, their doubts and weaknesses and, last but not least, their possibilities. So, this book does not consider the question: “How to help parents to become better educators?” We try to avoid the word parenting and if we do so in this book, we use it in the meaning of educating their child. But once again, that is not the main focus of this book. Trying to help professionals to support parents in their improving of strength in their parenthood is our first goal. Every family has its own culture, and every person is part of more cultures, local, regional, national and even international. Cultural aspects always count, also in parenthood, but discussing them all would result in a very different content of this book. We try to give general support to students and workers of very different professions and in very different countries and cultures. We do not mention those separately, but we focus in this book on aspects of parenthood which are more or less universal, without generalising parenthood in all different countries and cultures. Our experiences in working with parents was mainly in Holland and Western Europe, so our examples are mostly from this cultural background. We use them not as an example for others how to work, of how to treat parents, but to explain our use in practice of the theory on parenthood which inspired us for so many years. We hope that reading about the use of this theory and our experiences with it will offer support and inspiration to a great number of care workers and professionals in very different disciplines in their daily work. And especially for lecturers, teachers and trainers of students and coaches of professionals who work with children and subsequently with parents to help them to improve their professional attitude toward parents.

Any public debate about air pollution starts with the premise that air pollution cannot be good for you, so we should have less of it. However, it is much more difficult to determine how much is dangerous, and even more difficult to decide how much we are willing to pay for improvements in measured air pollution. Recent UK estimates suggest that fine particulate pollution causes about 6500 deaths per year, although it is not clear how many years of life are lost as a result. Some deaths may just be brought forward by a few days or weeks, while others may be truly premature. Globally, household pollution from cooking fuels may cause up to two million premature deaths per year in the developing world. The hazards of black smoke air pollution have been known since antiquity. The first descriptions of deaths caused by air pollution are those recorded after the eruption of Vesuvius in ad 79. In modern times, the infamous smogs of the early twentieth century in Belgium and London were clearly shown to trigger deaths in people with chronic bronchitis and heart disease. In mechanistic terms, black smoke and sulphur dioxide generated from industrial processes and domestic coal burning cause airway inflammation, exacerbation of chronic bronchitis, and consequent heart failure. Epidemiological analysis has confirmed that the deaths included both those who were likely to have died soon anyway and those who might well have survived for months or years if the pollution event had not occurred. Clean air legislation has dramatically reduced the levels of these traditional pollutants in the West, although these pollutants are still important in China, and smoke from solid cooking fuel continues to take a heavy toll amongst women in less developed parts of the world. New forms of air pollution have emerged, principally due to the increase in motor vehicle traffic since the 1950s. The combination of fine particulates and ground-level ozone causes ‘summer smogs’ which intensify over cities during summer periods of high barometric pressure. In Los Angeles and Mexico City, ozone concentrations commonly reach levels which are associated with adverse respiratory effects in normal and asthmatic subjects. Ozone directly affects the airways, causing reduced inspiratory capacity. This effect is more marked in patients with asthma and is clinically important, since epidemiological studies have found linear associations between ozone concentrations and admission rates for asthma and related respiratory diseases. Ozone induces an acute neutrophilic inflammatory response in both human and animal airways, together with release of chemokines (e.g. interleukin 8 and growth-related oncogene-alpha). Nitrogen oxides have less direct effect on human airways, but they increase the response to allergen challenge in patients with atopic asthma. Nitrogen oxide exposure also increases the risk of becoming ill after exposure to influenza. Alveolar macrophages are less able to inactivate influenza viruses and this leads to an increased probability of infection after experimental exposure to influenza. In the last two decades, major concerns have been raised about the effects of fine particulates. An association between fine particulate levels and cardiovascular and respiratory mortality and morbidity was first reported in 1993 and has since been confirmed in several other countries. Globally, about 90% of airborne particles are formed naturally, from sea spray, dust storms, volcanoes, and burning grass and forests. Human activity accounts for about 10% of aerosols (in terms of mass). This comes from transport, power stations, and various industrial processes. Diesel exhaust is the principal source of fine particulate pollution in Europe, while sea spray is the principal source in California, and agricultural activity is a major contributor in inland areas of the US. Dust storms are important sources in the Sahara, the Middle East, and parts of China. The mechanism of adverse health effects remains unclear but, unlike the case for ozone and nitrogen oxides, there is no safe threshold for the health effects of particulates. Since the 1990s, tax measures aimed at reducing greenhouse gas emissions have led to a rapid rise in the proportion of new cars with diesel engines. In the UK, this rose from 4% in 1990 to one-third of new cars in 2004 while, in France, over half of new vehicles have diesel engines. Diesel exhaust particles may increase the risk of sensitization to airborne allergens and cause airways inflammation both in vitro and in vivo. Extensive epidemiological work has confirmed that there is an association between increased exposure to environmental fine particulates and death from cardiovascular causes. Various mechanisms have been proposed: cardiac rhythm disturbance seems the most likely at present. It has also been proposed that high numbers of ultrafine particles may cause alveolar inflammation which then exacerbates preexisting cardiac and pulmonary disease. In support of this hypothesis, the metal content of ultrafine particles induces oxidative stress when alveolar macrophages are exposed to particles in vitro. While this is a plausible mechanism, in epidemiological studies it is difficult to separate the effects of ultrafine particles from those of other traffic-related pollutants.
