Maciej Kazimierz Sarbiewski’s Cato (Lyr. II 6) and exercitia Seneciana The starting point for the research presented in this article was an attempt to trace the literary tradition which inspired the creation of the lyrical subject and the titular figure of Maciej Kazimierz Sarbiewski’s ode II 6 (Cato Politicus). The presence of this name implies that the intertextual dimension of the poem should be taken into account in its interpretation, hence, the author of this article assumed that the question of the literary tradition should be addressed before a hypothesis about the meaning of the poem is put forth. A review of Sarbiewski’s potential sources of inspiration – primarily works that were included in the basic and supplementary reading lists in Jesuit colleges – brings satisfactory results. It turns out that the ancient author who often mentions Cato the Younger is Seneca Philosophus, moreover, there are numerous similarities between some passages in his works and ode II 6. Sarbiewski seems to have been especially inspired by his Epistulae morales ad Lucilium, and also by the Senecan Consolationes. However, rather than refer to the views attributed by Seneca explicitly to Cato, the Polish poet explores the thoughts of the Philosopher himself, possibly assuming that the views of the politician and the philosopher were similar; this assumption could be justified by the fact that Seneca not only repeatedly expresses highest praise of the republican hero, but he also openly recommends to treat Cato Uticensis as a role model. These issues are discussed in the first part of this paper. In the second part, the author compares selected passages from Seneca’s works and two poems (II 5 and II 7) adjacent to the ode Cato Politicus. The comparison shows that the convergences discussed above are not incidental. On the contrary, there is a series of Sarbiewski’s odes inspired by Seneca, and therefore the Roman philosopher and tragedian can be considered the next, after Horace, master of the Jesuit poet. It is postulated that these inspirations deserve more recognition in further studies on Sarbiewski’s poetry, as they may be helpful in the interpretation of some problematic passages of his odes.

IntroductionPatients with metastatic or locally advanced, non-resectable, grade 3 poorly differentiated gastroenteropancreatic (GEP) and lung neuroendocrine carcinomas (NECs) are usually treated with in first-line platinum compounds. There is no standard second-line treatment on progression. Accurate biomarkers are needed to facilitate diagnosis and prognostic assessment of patients with NEC.Methods and analysisThe SEcond-line therapy in NEuroendocrine CArcinomas (SENECA) study is a randomised, non-comparative, multicentre phase II trial designed to evaluate the efficacy and safety of folinic acid, 5-fluorouracil and irinotecan (FOLFIRI) or capecitabine plus temozolomide (CAPTEM) regimens after failure of first-line chemotherapy in patients with lung NEC and GEP-NEC. Secondary aims are to correlate the serum miRNA profile and primary mutational status of MEN1, DAXX, ATRX and RB-1 with prognosis and outcome and to investigate the prognostic and predictive role of the Ki-67 score and 18-fluorodeoxyglucose positron emission tomography/computed tomography (18F-FDG PET/CT) or 68Ga-PET/CT. The main eligibility criteria are age ≥18 years; metastatic or locally advanced, non-resectable, grade 3 lung or GEP-NECs; progression to first-line platinum-based chemotherapy. A Bryant and Day design taking into account treatment activity and toxicity was used to estimate the sample size. All analyses will be performed separately for each treatment group in the intention-to-treat population. A total of 112 patients (56/arm) will be randomly assigned (1:1) to receive FOLFIRI every 14 days or CAPTEM every 28 days until disease progression or unacceptable toxicity or for a maximum of 6 months. Patients undergo testing for specific biomarkers in primary tumour tissue and for miRNA in blood samples. MiRNA profiling will be performed in the first 20 patients who agree to participate in the biological substudy.Ethics and disseminationThe SENECA trial, supported by Istituto Scientifico Romagnolo per lo Studio e la Cura dei Tumori (IRST), was authorised by the locals Ethics Committee and the Italian Medicines Agency (AIFA). Senecavirus A (SVA) is the only member of the genus Senecavirus within the family Picornaviridae. This virus was discovered as a serendipitous finding in 2002 (and named Seneca Valley virus 001 [SVV-001]) while cultivating viral vectors in cell culture and has been proposed for use as an oncolytic virus to treat different types of human neoplasia. SVA was found in lesions in pigs affected by porcine idiopathic vesicular disease in Canada and the USA in 2008 and 2012, respectively. In 2014 and 2015, SVA infection was associated with outbreaks of vesicular disease in sows as well as neonatal pig mortality in Brazil and the USA. Phylogenetic analysis of the SVA VP1 indicates the existence of 3 clades of the virus. Clade I contains the historical strain SVV-001, clade II contains USA SVA strains identified between 1988 and 1997, and clade III contains global SVA strains from Brazil, Canada, China, and the USA identified between 2001 and 2015. The aim of this review is to draw the attention of veterinarians and researchers to a recently described infectious clinical-pathologic condition caused by a previously known agent (SVA). Apart from the intrinsic interest in a novel virus infecting pigs and causing economic losses, the major current concern is the similarity of the clinical picture to that of other swine diseases, because one of them—foot and mouth disease—is a World Organization for Animal Health–listed disease. Because the potential association of SVA with disease is rather new, there are still many questions to be resolved.

This thesis examines the presentation of incest in selected texts in the Metamorphoses of Ovid and in the tragedies Phaedra and Oedipus Rex of Seneca. Previous scholarship has discussed incest in Roman literature from various perspectives, especially those of social history and literary criticism. This work offers for the first time a detailed study of the incest episodes in Ovid and Seneca, taken as a distinct group, and discusses questions relating to the main general themes, and, especially, the psychological and ethical dimensions of incest. It examines these topics through a close reading of key passages from the texts, taken in the context of the overall character of these literary works as well the broader context of Roman thinking about incest. The thesis identifies shared features in the treatment of incest in Ovid and Seneca as well as defining salient differences between them in these respects. It also considers whether there is anything distinctive in the presentation of incest in these authors when compared to the presentation of intense and problematic passions in these authors. The discussion brings out certain general features of incest in Ovid and Seneca and places these features in the broader context of ancient thinking about incest in Roman culture. The discussion highlights the fact that incest is seen by Ovid and Seneca as a type of erotic passion; this is partly linked with the importance given by these authors to the psychological and ethical dimensions of incest. Both Ovid and Seneca focus especially on exploring and trying to explain the nature of the psychological motivation to commit incest. This study also highlights salient differences between Ovid and Seneca in their interpretation of incest and explains these by reference to possible literary or philosophical influences and the distinctive poetic and intellectual projects of Ovid and Seneca. The most important point of difference between Seneca and Ovid in their treatment of incest consists in their approach to the moral status of incest. Seneca's presentation is strongly moralistic (though combined with a profound interest in the psychological roots of incest), while Ovid's approach is usually sympathetic to the incestuous lovers and is sometimes subversive of conventional ethics, especially through its treatment of the manipulation of names

L’objectif du présent travail est de faire la lumière sur la conception de l’âme présente à l’intérieur de la pensée philosophique de Sénèque, en faisant émerger, d’un côté, son orthodoxie fondamentale à l’égard du stoïcisme, de l’autre, sa contribution originale. Dans ce but, notre thèse est divisée en trois parties. La première s’occupe de reconnaître les caractéristiques de l’âme humaine dans ses traits essentiels (nature, structure, fonction) en faisant émerger un premier “modèle” psychologique : l’âme stable et harmonieuse qui a rejoint la vertu. La seconde partie approfondit un second “modèle” psychologique : celui d’une âme instable, dysharmonique et passionnelle. Enfin, la troisième partie analyse la question de l’âme dans les œuvres qui ne sont pas stricto sensu philosophiques (les tragédies et les Naturales Quaestiones) dans la mesure où elles se révèlent avoir des affinités significatives avec le discours développé dans les deux premières parties, nous permettant ainsi de spécifier encore mieux notre thèse
The aim of this work is to unveil the conception of the soul within Seneca's philosophical thought by bringing out, on the one hand, his underlying orthodoxy towards Stoicism and, on the other, his original contribution. In this regard, the dissertation is divided into three parts. The first one reconstructs the characteristics of the human soul in its essential traits (nature, structure, functions) and develops a first psychological “model”: the stable and harmonious soul that has achieved virtue. The second part deepens a second psychological “model”: that of an unstable, disharmonious and passionate soul. Finally, the third part analyses the works not stricto sensu philosophical (tragedies and Natural Questions), as they reveal significant affinities with the discourse on the soul conducted in the first two parts, allowing us to specify our thesis even better

L’obiettivo del presente lavoro è quello di portare alla luce la concezione dell’anima all’interno del pensiero filosofico di Seneca facendo emergere, da un lato, la sua fondamentale ortodossia nei confronti dello Stoicismo, dall’altro, il suo originale contributo. A tal proposito la tesi è divisa in tre parti. La prima parte si occupa di ricostruire le caratteristiche dell’anima umana nei suoi tratti essenziali (natura, struttura, funzioni) facendo emergere un primo “modello” psicologico: l’anima stabile e armoniosa che ha raggiunto la virtù. La seconda parte approfondisce un secondo “modello” psicologico: quello di un’anima instabile, disarmonica e passionale. Infine, la terza parte analizza le opere non stricto sensu filosofiche (tragedie e Naturales Quaestiones) in quanto rivelano delle significative affinità con il discorso sull’anima condotto nelle prime due parti, permettendoci di specificare ancor meglio la nostra tesi.

This thesis analyses which principles should govern the interpretation of tax treaties. This field is complex - because tax treaties have a dual status. Tax treaties are treaties between States - which are governed by public international law, the principles of which have been codified in the 1980 Vienna Convention on the Law of Treaties. Tax treaties are also laws which can affect the domestic rights of taxpayers (and States). Different, and possibly conflicting, principles of interpretation may apply in public international, and in (different) domestic, contexts. This thesis seeks to reconcile these different principles, recognising that tax treaties should be interpreted uniformly. Only if this is done can double taxation (and double non-taxation) be avoided - and reciprocity achieved. This thesis analyses why, and when, the Vienna Convention is relevant in interpreting a tax treaty in a domestic context. It seeks to describe a uniform approach to tax treaty interpretation - which could be applied by domestic courts worldwide. It reaches four main conclusions. Firstly, a textual approach (endorsed as the starting point of interpretation at a public international level by Article 31(1) of the Vienna Convention) should (also) be the starting point of interpretation in a domestic context. Secondly, the proper approach in a domestic context cannot be the mirror image of the Vienna Convention approach. Thirdly, a uniform domestic approach cannot be identical to any one particular State's approach to the interpretation of its domestic tax statutes. Fourthly, a uniform domestic approach should be autonomous - and neutral as between all States. It should recognise a tax treaty's dual status - yet be independent of any interpretative principles which are appropriate only in a purely public international, or a purely domestic, context.

What exactly is tax treaty override ? When is it realized ? This thesis, which is the result of a co-directed PhD between the University of Bologna and Tilburg University, gives a deep insight into a topic that has not yet been analyzed in a systematic way. On the contrary, the analysis about tax treaty override is still at a preliminary stage. For this reason the origin and nature of tax treaty override are first of all analyzed in their ‘natural’ context, i.e. within general international law. In order to characterize tax treaty override and deeply understand its peculiarities the evaluation of the effects of general international law on tax treaties based on the OECD Model Convention is a necessary pre-condition. Therefore, the binding effects of an international agreement on state sovereignty are specifically investigated. Afterwards, the interpretation of the OECD Model Convention occupies the main part of the thesis in order to develop an ‘interpretative model’ which can be applied every time a case of tax treaty override needs to be detected. Fictitious income, exit taxes and CFC regimes are analyzed in order to verify their compliance with tax treaties based on the OECD Model Convention and establish when the relevant legislation realizes cases of tax treaty override.
Che cosa é esattamente il treaty override ? Quando può dirsi realizzato ? Questa tesi, risultato di un dottorato in co-tutela tra l’Università di Bologna e l’Università di Tilburg, approfondisce un tema che non ha ancora trovato una sistematica analisi accademica. Al contrario, la ricerca relativa al treaty override è ancora ad uno stadio preliminare. Per questa ragione, la tesi, traendo origine dall’analisi di diritto internazionale generale, ha innanzitutto approfondito gli aspetti relativi all’origine ed alla natura del treaty override. Al fine di evidenziare le caratteristiche del treaty override e comprenderne le peculiarità sono stati analizzati gli effetti del diritto internazionale sui trattati contro la doppia imposizione che seguono il Modello OCSE. In modo particolare, la ricerca si è soffermata sugli aspetti concernenti la limitazione della sovranità nazionale quale effetto della valida conclusione di un trattato internazionale. La tesi, ha, quindi, prevalentemente avuto ad oggetto l’interpretazione del Modello OCSE al fine di delineare un ‘modello interpretativo’ che consenta l’individuazione dei casi di treaty override. Presunzioni, exit taxes e regimi CFC sono stati analizzati al fine di verificarne la compatibilità con il suddetto modello di Convenzione e stabilire quando la relativa legislazione nazionale determina casi di treaty override.

This chapter talks about leaders of the Six Nations of the Haudenosaunee Confederacy agreed to a treaty with the United States of America on November 11, 1794. It explains that the treaty defined the lands that belonged to the Oneida and Seneca nations, which set forth the parameters for the management of a wagon road to be constructed on Seneca lands. It also details the conference of the President of the United States with the Six Nations of Indians in order to remove from their minds all causes of complaint and establish a firm and permanent friendship with them. The chapter outlines the articles ratified by the President of the United States and bound them and the Six Nations. It mentions Timothy Pickering and lists the names of Sachems and War-Chiefs of the Six Nations that set their hands and seals.

Abstract Of all the issues treated in the Greek philosophical schools, none had more appeal for the Romans than the choice between a life of service to the res publica and a life of otium devoted to philosophy. The thesis ‘sitne sapientis ad rem publicam accedere’ was in the late Republic and the Empire one of the favourite exercises taken over by the rhetorical schools from the philosophers. The prominence of this theme in Seneca’s works and the complexity of his views alone would recommend it for study, but it is particularly relevant to the present inquiry as a theme on which Seneca’s work might well be expected to reflect his own political career and friendships, and the political climate of the reign of Nero. But before we can examine the relation of his various works on the subject to the political and personal circumstances in which they were composed (III, IV, V), we must first try to give a clear account of what Seneca actually wrote on the subject (I) and then establish where he stood in relation to Stoic doctrines and Roman attitudes as they had evolved (II).

Looking at motion in the NQ’s rather posthuman world, and in its physics, prevents too narrow an emphasis on humans and ethics. Yet entities like wind and sea are personified through movement. Transitive (imposed) and intransitive movement have hierarchical consequences; agency and causation enter. Motion runs through the treatment of people, both metaliterary, for narrator and addressee, and satirical, for the depraved. The work’s precision on motion is shown in its handling of verbs and especially preverbs; Seneca’s vocabulary expands for the NQ. The work does not treat the whole cosmos; it concentrates on things that move, especially in disruptive change. The regular movement of heavenly bodies contrasts; spiritus (wind, air) is quite different. Passages include: throwing stones into water, the possibility of fire falling, the journeying of old Hannibal and old Seneca, the types of earthquake, the madness of sailing to war. In them description of motion is both evocative and argumentative, argument on motion is organized and visionary; levels of motion differ pointedly; types of motion are conveyed with nuance; human motion is reproached through elaborate structures of thought, not just shouting. The NQ do not, like narrative works, present a single world to immerse the reader; argument is to the fore, and rival views are prominent (so Democritus on atoms, Epigenes on comets). Truth is reached through observation and understanding of movement (so on the roundness of drops). Motion is presented both with philosophical penetration and with literary richness.

Abstract This chapter discusses book 7 of the Natural Questions, which treats the subject of comets. At the opening of this book, Seneca outlines two possible forms of miratio, or wonder, in the face of comets. The first type of wonder, which this chapter calls “elevated miratio,” is a gentle feeling of amazement in the face of a divine order. The second, which this chapter calls “common miratio” is a sense of thrill in response to unusual or flashy phenomena. From a moral perspective, Seneca clearly privileges the former type of wonder over the latter. However, for individuals whose ignorance impedes them from experiencing elevated miratio, even common miratio can provide valuable Stoic lessons, alerting them to the intentional design of the cosmos. Overall, then, Seneca harnesses morally ambiguous affects for quasi-moral ends.
