<p>Desde la perspectiva histórica feminista, el artículo analiza el impacto que la represiónde la dictadura militar del general Augusto Pinochet Ugarte (1973-1990) causó en las mujeres que conformaron la oposición política. La Tortura Sexual se definió como una estrategia dirigida y pensada contra las prisioneras en los diversos campos de concentración que se extendían a lo largo de Chile. Este hecho, invisibilizado durante años por los diversos estudios entorno a los Derechos Humanos, se reconoció de forma oficial cuando en 2004 se publicó el Informe de la Comisión Nacional sobre Prisión Política y Tortura (<em>Informe</em><em> Valech</em>), un documento pionero que recogía 4000 testimonios de mujeres supervivientes.</p><p>From the feminist historical perspective, the article analyses the impact of the Pinochet dictatorship repression (1970-1990) against women from the political opposition. The sexual torture was a specific strategy carried out in the military concentration camps all around Chile. This fact was not visible until the publication of the National Commission on Political Imprisonment and Torture Report in 2004 (<em>Valech</em><em> Report</em>), a pioneer investigation that recognises sexual tortur as specific torture against prisoners including 4000 women survivors testimonies.</p><p> </p>

Artiklen diskuterer køns-specifikke torturformer, tværkulturelt, set fra et Menneskerettighedsperspektiv. Den diskuterer hovedsageligt sexuel tortur og grov, umenneskelig og nedværdigende behandling af kvinder udført af statslige magtudøvere, som politi og fængselsfunktionærer i mange kulturer. De seneste udviklinger i internationale love om kvinders menneskerettigheder som de udtrykkes i FN strategier beskrives og diskuteres. Derudover diskuterer artiklen årsagerne bag den totale straffrihed for udøvere af massiv sexuelt misbrug af kvinder under WW2, og opridser de seneste mentalitetsforandringer i opfattelsen af voldtægt af kvinder fra statslige magtudøveres side. I dag anerkendes voldtægt som tortur ifølge FN’s Konvention mod tortur. De fysiske og psykologiske konsekvenser af sexuelt misbrug opsummeres og artiklen foreslår en række forebyggende foranstaltninger på lovmæssigt, institutionelt, civilsamfunds -og individuelt niveau. Nobody asks a male torture victim whether he has consented to torture but the issue of consent is always present when a woman wants to reveal that she has been sexually abused by an official.

Resumo: Concebendo a tortura como uma das mais graves violações de direitos humanos, o artigo tem como principal objetivo analisar os obstáculos à aplicação da legislação infraconstitucional para prevenção e combate às práticas de tortura no Brasil. Considerando diversas pesquisas científicas e matérias jornalísticas que apontam para a existência e a permanência das práticas da tortura institucional no Brasil, trabalhamos com a hipótese de que tais obstáculos não se explicam apenas pela legislação tardia, mas também – e sobretudo – pela forte correlação entre um modelo de Estado Penal e ideologias punitivistas fundamentadas na “cultura do controle” e no “populismo penal” (Garland, 2008; Zaffaroni, 2012). Tal configuração se reflete na dinâmica dos três poderes, ou seja, alimenta propostas legislativas mais punitivas, incentiva a implementação de políticas criminais mais severas e permite uma maior tolerância da justiça criminal com as práticas de tortura por agentes públicos. Tortura y derechos humanos en Brasil: entre avances y retrocesos Resumen: Concibiendo la tortura como una de las más graves violaciones de los derechos humanos, el objetivo principal del artículo es analizar los obstáculos a la aplicación de la legislación infraconstitucional para prevenir y combatir las prácticas de tortura en Brasil. Considerando diversas investigaciones científicas y artículos periodísticos que apuntan a la existencia y permanencia de prácticas institucionales de tortura en Brasil, trabajamos con la hipótesis de que tales obstáculos no se explican sólo por la legislación tardía, sino también, y sobre todo, por la fuerte correlación entre un modelo de Estado penal e ideologías punitivas basadas en la “cultura del control” y el “populismo penal” (Garland, 2008; Zaffaroni, 2012). Esta configuración se refleja en la dinámica de los tres poderes, alimenta propuestas legislativas más punitivas, incentiva la implementación de políticas criminales más severas y permite una mayor tolerancia de la justicia penal con las prácticas de tortura por parte de los agentes públicos. Torture and human rights in Brazil: between advances and retrocess Abstract: Conceiving torture as one of the most serious human rights violations, the article’s main objective is to analyze the obstacles to the application of infraconstitutional legislation to prevent and combat practices of torture in Brazil. Considering various scientific research and journalistic articles that point to the existence and permanence of institutional torture practices in Brazil, we work with the hypothesis that such obstacles are not explained only by the late legislation, but also by the strong correlation between a Penal State model and punitive ideologies based on the “culture of control” and “criminal populism” (Garland, 2008; Zaffaroni, 2012). This configuration is reflected in the dynamics of the three powers, resulting in more punitive legislative proposals, encouraging the implementation of more severe criminal policies and allowing greater tolerance of criminal justice with torture practices by public agentes. Resumen: La presente investigación se centra su análisis en un esquema exegético, se aborda la importancia de los derechos humanos y la eliminación de la tortura, este trabajo aborda un análisis de las formas constitucionales que han permitido la creación de una nueva Ley contra la Tortura en México, lo cual, crea una visión más uniforme en la protección de los derechos humanos, tanto en el ámbito nacional, internacional y del derecho comparado con otros países. Pero ¿acaso basta con una nueva legislación para prevenir y erradicar la tortura? Ciertamente, habría que estudiar lo que constituye la tortura y los avances multifactoriales en materia de derechos humanos en este país.Este trabajo versa sobre una reflexión de incluir al turismo en los derechos humanos de segunda generación y cómo se integra, así de los límites o afectaciones hacia los derechos económicos, sociales y culturales del otro identificado como las comunidades de origen indígena o no, el entorno natural y el patrimonio turístico. Abstrac: This research focuses its analysis on an exegetical scheme, it addresses the importance of human rights and the elimination of torture, this work addresses an analysis of the constitutional forms that have allowed the creation of a new Law against Torture in Mexico, which creates a more uniform vision in the protection of human rights, both at the national, international and legal levels compared to other countries. Artykuł porusza problem tortur we współczesnym świecie, które są stosowane nawet w wysoko rozwiniętych demokracjach. Mimo istnienia regulacji prawnych i mechanizmów kontrolnych, tortury wciąż znajdują się w repertuarze środków bynajmniej nie terrorystów, ale przedstawicieli legalnie działających instytucji państwa, takich jak policja czy więziennictwo. Protokół stambulski to dokument, który pozwala trafniej rozpoznać przez odpowiednie służby stosowanie tortur u osoby zatrzymanej (więźnia). Autorki artykułu rozważają, czy w Polsce zalecenia tego dokumentu są przestrzegane i jakie instytucje są zaangażowane w kontrolę przestrzegania praw człowieka w tym obszarze.

ABSTRACT This study discusses the Transformation of Pangurason Performing Arts Ritual. Describes the presentation of Pangurason tortors in the transformation of saucers to the Batak Toba Society in Samosir, and also describes the transformation of Pangurason tortors in the art of tortor cup performances.The theory used in this research is Ritual theory, Transformation, presentation theory form. The time used in this study is during (two months), which starts from October to December 2016. The location of this study was conducted in Pangururan Government of Samosir Regency. The population in this study were artists who knew about Pangurason and the samples were all actors involved in tortor Pangurason and actors involved in tortor bow transformation, data collection techniques including observation, interview, literature study, and documentation, then analyzed by descriptive method qualitative.Based on the data collected, it can be seen that Pangurason is a cleansing or purification of a place that has been considered sacred, so that the place is far from distress, and not disturbed by evil spirits. Formerly when Pangurason was used because at that time, the place wanted to be disturbed by evil spirits, then sibaso or shaman made a ritual to reject the reinforcements, by making a bowl of water, kaffir lime and banyan leaves.The transformation transforms the form of ritual presentation into the performing arts and uses the media or property of the saucer as an attraction in the tortor cup art show. The democratization that followed the last military dictatorship in Argentina (1976–1983) has been influenced by human rights organizations’ relentless work to bring about truth and justice regarding the consequences of state terrorism and to keep the memory of that period alive. These efforts frame the discursive context in which human rights violations, including torture, are interpreted in contemporary Argentina. Argentine interviewees from across the political spectrum condemn torture, but the language and frames they use and the narratives surrounding political events vary. These accounts expose the conflicted terrain of memory making and the ambivalences and contradictions that permeate the construction of a torture-rejecting culture. La democratización que vino después de la última dictadura militar en la Argentina (1976–1983) ha sido influenciada por el trabajo incesante de las organizaciones de derechos humanos para lograr que se establezca la verdad y se haga justicia sobre las consecuencias del terrorismo de estado y para mantener la memoria sobre ese periodo viva. Estos esfuerzos enmarcan el contexto discursivo a través del cual las violaciones de los derechos humanos, entre ellas la tortura, son interpretadas en la Argentina contemporánea. Las personas entrevistadas en Argentina, quienes atraviesan el espectro político, condenan la tortura. Sin embargo, el lenguaje y los esquemas que usan y las narrativas sobre los acontecimientos políticos varían. Estos relatos exponen el terreno conflictivo de la construcción de la memoria y las ambivalencias y contradicciones que permean la construcción de una cultura de rechazo hacia la tortura.

Tortor Naposo Nauli Bulung is one of North Sumatra's local dance content, originating from the Mandailing Batak. As a traditional dance, this tortor has binding rules, sourced from the Dalihan Na Tolu kinship system, which illustrates the roles in it such as kahanggi, Mora, and boru children, so that the various movements contain traditional rules and norms that apply and must be obeyed when adhered to to dance it. This article discusses the history, form of presentation, and function of tortors. Theories used to explore history are the progressive-linear theory according to Ibn Khaldun, Djelantik's opinion for the form of presentation, and the theory of function according to Shay. The research method is descriptive qualitative. The results of the study conveyed Tortor Naposo Nauli Bulung became a medium for socializing. This tortor was performed by young people with six or three pairs of dancers. The floor pattern used was only two shapes, namely the horizontal line pattern and the triangle shape. The group of dancers in the front are called 'na gakspi' or 'na isembar', while the group in the back is called 'pangayapi' or 'panyembar'. The basic motions of the Naposo Nauli Bulung tortor are: a) Manyomba tu Raja, b) Markusor (spinning), and c) Singgang (squatting). Naposo Nauli Bulung Tortor contains four functions, namely: as a reflection and legitimacy of the social order, as a vehicle for secular rite expression, dance as social entertainment or recreational activities, and dance as a reflection of aesthetic values.

Resumen: La tortura es una práctica que ha existido desde la antigüedad de los tiempos y se ha practicado en mayor o en menor medida dependiendo del lugar del que se trate. El concepto principal –la tortura- se analiza teniendo en cuenta varios aspectos contextuales importantes: su evolución a lo largo de los años, el tipos de prácticas que se utilizaban y cómo han evolucionado esas prácticas, los lugares en los que se ha practicado así como un análisis terminológico. La metodología que se ha utilizado en el trabajo sobre el que este artículo trata se basa en tres etapas principales: la primera etapa consistió en establecer una base teórica; la segunda etapa consistió en analizar el concepto de la tortura teniendo en cuenta su evolución histórica, sus prácticas y su percepción actual. Finalmente, hemos explicado la terminología desde el punto de vista de la creación de un glosario bilingüe de español-inglés de términos relacionados con el concepto de la tortura.Abstract: Torture is a practice that has existed since ancient times and has been practiced in varying levels depending on the location in question. The main concept -torture- is analysed taking into account several important contextual aspects: its evolution through the years, the types of practices that were used and how these practices have evolved, the places in which it was practiced as well as a terminological analysis. The methodology used in the paper that the article covers is based on three main stages: first stage consisted on establishing a theoretical basis; second stage consisted in analysing the concept of torture considering its historical evolution, its practices and its current perception. And finally we explained the terminology from the point of view of the creation of a Spanish-English bilingual glossary for terms related to the concept of torture.

Este artigo tem por objetivo interpretar, sob a perspectiva da antropologia visual, dos filmes documentários “Brazil, a report on torture” e “No es hora de llorar”. Ambas produções foram realizadas no Chile em 1971, mas abordam e, sobretudo, encenam a tortura sofrida por militantes brasileiros durante a ditadura militar (1964-1985). Assim, por meio da descrição das sequências fílmicas em que há tais encenações, pretendemos evidenciar alguns efeitos de sentido, indícios de uma cultura, sociedade e de um tempo no qual a prática da tortura era institucionalizada.

Abstract Objective: To analyse the impacts of forced disappearance as a form of psychological torture in the forced disappearance of students known as the Ayotzinapa Case (Mexico). To make visible the effects of impunity. Method: Historical and documentary analysis. Interviews with two groups of people affected: 1) relatives of the 43 young students who disappeared; 2) young students that survived. Analysis of the information obtained from the group and individual clinical interventions carried out during three months. Results. In both groups, various impacts related to political violence were identified, in particular forced disappearance, which leads us to consider that the criteria for torture are fulfilled and especially the elements derived from the subsequent re-victimising action of the State in the investigations and the impunity derived from the lack of access to justice and truth. Conclusion: In addition to the enforced disappearance itself and its impacts, the suffering resulting from the State’s subsequent processes must be analysed. Keywords: Psychological torture, forced disappearance, impunity. ___________________________________________________________________________________________________ Español El artículo tiene como propósito analizar los indicios de tortura psicológica en los familiares de los desaparecidos y los estudiantes sobrevivientes del caso de Ayotzinapa, a raíz de la desaparición forzada, la ejecución extrajudicial de los estudiantes y los mecanismos de impunidad liderados por el estado. Se utilizó como metodología, el análisis del discurso de las víctimas a través intervenciones clínicas grupales e individuales durante 3 meses. Los resultados de las entrevistas mostraron sentimientos de humillación, culpa y deterioro a nivel físico, psicológico, familiar y social a raíz de los eventos ocurridos el 26 de septiembre, así como el incremento del deterioro derivado de la falta de justicia, la criminalización y la impunidad por parte de funcionarios del estado. Por lo tanto se concluye que si hay incidencia de tortura psicológica en las víctimas del caso de Ayotzinapa. El trabajo busca evidenciar la relación entre la tortura psicológica y la desaparición forzada en los familiares. Keywords: Tortura psicológica, desaparición forzada y ejecución extrajudicial.

Abstract (sommario):
The article is focused on studying the concept, content and essence of the definition of “tortuous legal relations”. The scientific works in the researched sphere have been analyzed. The author has indicated that there are gaps in the interpretation of the term of “tortuous legal relations” in its classical meaning and the place of this type of public relations in the legal system of Ukraine. It has been proved that most of scientific works do not reveal the meaning of this term, but its certain features were only indirectly analyzed in one way or another. The relevance and necessity of formulating the author’s definition of the term of “tortious legal relations” have been substantiated. The author has offered to understand this definition as relations regulated by legal norms arising in connection with the commission of an offense (tort), establishment of the tort’s fact, the use of state coercion during the process of bringing the subject of the committed illegal act to one of the types of legal liability, restoration of violated rights and freedoms and compensation for damage. Considerable attention has been paid to the novelties of national legislation on amendments to some codified acts of substantive and procedural law; the author has provided comments on the suggested amendments. It has been noted that the legislative enshrinement of the term of “criminal offense”, as well as the division of criminal offenses into crimes and misdemeanors and the selected criteria for such division is the most controversial. The components of the term of “tortious legal relations”, namely: the terms “tort” and “legal relations” have been revealed. It has been stated that tortious legal relations arise at the time of tort’s commission and are part of the legal relations. The issue of classification of legal relations and their features has been studied. Characteristic features of tortious legal relations have been revealed. It has been concluded that tortious legal relations, which are the component of legal relations and have all their features arise during the commission of a tort by a subject of legal liability.

What makes it hard to sum up this work is not its length (430 pages), but rather its interdisciplinary approach, the depth of observations, the richness in contents and points of view, its geographical width. Yet, these aspects make the book fundamental for anyone willing to understand migratory movements in today’s world. Its main merit is having addressed, consistently and systematically, the close relation that has come to be, over the course of decades, between torture and migration. Such relation is no recent piece of news: for a long time, torture has been indicated as one of the most widespread reasons for leaving, one of the most frequent experiences lived along the migration path and, more and more often, a reality that migrants are forced to tackle in receiving countries. Nevertheless, the scientific narrative of such relation is often limited, fragmented and, sometimes, manipulated. Torture has thus far been studied systematically in relation to power (MacMaster 2004), wars and dictatorships (Hajjar 2013, Cohen 2005, Rejali 2009), it is considered as lying at the basis of modernity (Reemtsma 2012) or of the process of civilization (Linklater 2007), but never before it had been analyzed as a structured element of migration. Thus, the volume deserves to be recognized as paving the way for an innovative field of research.

Estuda-se o referencial teórico desde o panorama mundial, regional e local, abordando os períodos de disseminação da prática da Inquisição à Ditadura Militar brasileira, discorrendo sobre os pontos mais relevantes, em especial, nos períodos históricos em que essa prática era “institucionalizada”, inerente às próprias funções reais ou estatais, positivada e aplicada por meio das Ordenações Filipinas. Como objetivo geral pretende-se realizar uma pesquisa sobre os Inquéritos Policiais inconclusos, onde o suposto crime de tortura tenha ocorrido em uma unidade prisional, e supostamente tenha sido praticada por um agente estatal, a fim de estabelecer os entraves ao andamento da investigação desses crimes em suas variadas modalidades. Faz-se uso do método dedutivo, da pesquisa bibliográfica, documental, do referente, da categorização a partir da tipificação dos crimes praticados e seus agentes apontados como autores e da descrição operacional dos termos. Conclui-se que há indícios de ocorrência de tortura em todas as unidades prisionais pesquisadas, devido a uma complexidade de fatores como os culturais, os decorrentes de superlotação, falta de condições de trabalho, impunidade, entre outros fatores, sugerindo-se uma série de medidas de enfretamento, que perpassam por reciclagem periódica de agentes, mediante treinamentos não torturantes, reeducação para Direitos Humanos e sua transversalidade, novas formas de valorização da carreira de agente penitenciário, incorporação de tecnologias de aferição de desempenho não violento, entre outras medidas. ABSTRACT The present paper deals with the investigation of torture practiced within prison walls, in the capital of Porto Velho, state of Rondônia. The theoretical framework is studied from a worldwide, regional and local perspective, addressing the periods of dissemination of the practice of the Inquisition to the Brazilian Military Dictatorship, discussing the most relevant points, especially in the historical periods when those kinds of practices were “institutionalized”, inherent to the real or state functions themselves, positivized and applied by the Philippine Ordinances. As a general goal, it's intended to carry out a research on the inconclusive Police Inquiries, where the alleged crime of torture occurred in a prison unit, and supposedly was committed by a state agent, in order to establish the obstacles to the progress of the investigation of these crimes in its several modalities. The deductive method is applied, as well as the bibliographic and documental research, the referent, the categorization based on the typification of the crimes committed and their agents identified as authors and the operational description of the terms. We conclude that there is evidence of torture occurring in all the prison units analyzed, due to a complexity of factors such as cultural, those resulting from overcrowding, lack of working conditions, impunity, and other factors, suggesting a series of confrontation projects, which go through periodic recycling of agents, through non-torturing training, re-education for Human Rights and it's transversality, new ways of valuing the career of prison staff, incorporating technologies for measuring nonviolent performance, among other measures. En este artículo se explica en qué consiste el procedimiento de las sentencias piloto del Tribunal Europeo de Derechos Humanos y se analizan las sentencias piloto sobre el estado de las cárceles que el Tribunal ha dictado hasta el momento. Escritos entre 1964 e 1966, os cinco ensaios do livro tratam da conditio inhumana dos campos de concentração nazistas, afastando-se da narrativa autobiográfica de outros sobreviventes. Cada um dos ensaios anuncia uma tese sobre a especificidade do mundo do extermínio, comprovando-a por uma argumentação na qual a experiência do sobrevivente ocupa um lugar crucial. O método de Ponsetti é considerado, hoje, o padrão-ouro para o tratamento do pé torto congênito, inclusive em casos sindrômicos como a mielomeningocele. Sua indicação em casos negligenciados é bem estabelecida em crianças e adolescentes, mas para adultos, permanece incerto. Apresenta-se um caso clínico de uma paciente de 27 anos, portadora de mielomeningocele, com pés tortos congênitos negligenciados, que foi tratada nessa idade, pela primeira vez, com o método de Ponsetti, com obtenção de bons resultados. Em países em desenvolvimento, frequentemente encontram-se pacientes adultos portadores de pés tortos congênitos que não tiveram acesso a assistência a saúde. Apesar da idade limite para instituir o método de Ponsetti como opção terapêutica ainda ser obscura, é uma opção barata, segura, acessível, plausível de resultados satisfatórias mesmo em casos adultos, negligenciados e síndrômicos.

La primera, partidària del model de llengua de l’IEC, era minoritària als anys vint però es generalitza a partir dels anys trenta (La Veu de Tortosa, La Veu Comarcal, Ara, Acció, Vida Tortosina i Lluita); mentre que el tortosinisme, que es correspon amb una ideologia cada cop més localista i que eleva el «parlar tortosí» a la categoria de llengua, queda reduït durant la ii República a tres revistes bilingües: La Zuda, Germanor i La Santa Cinta. Paraules clau: premsa tortosina, actituds lingüístiques, tortosinisme, fabrisme. Abstract: There were two linguistic actitudes in the tortosine press of the first third in the 20th century: the fabriana amb the tortosinista. The fabriana, in favour of the IEC linguistic model, was in minority during the 20’s, but it became widespread from the 30’s (La Veu de Tortosa, La Veu Comarcal, Ara, Acció, Vida Tortosina i Lluita). The second, the tortosinista, had a local ideology and compared the tortosinisme talk as a complet language, but it was reduced during the ii Republic to three magazines: La Zuda, Germanor i La Santa Cinta. This leads to a brief examination of the word ‘humanidad’ in "El delincuente honrado" by Jovellanos, a play which questions the Spanish judicial system. The method in this research uses descriptive qualitative method. The population are; the Department of Culture and Tourism Samosir, Museum Huta Bolon Simanindo officers, musicians, dancers, Public figures/Leader, community of Simanindo, and the tourists. The sample was part of the study population. The place of this research was taken in the Museum Huta Bolon Simanindo -Samosir regency. The data collection was done by observation, interviews, documentation and literature study. Generally, it discusses the development of cultural tourism through the performances of tortor Batak Toba which is the potential resources of local communities as cultural attractions. Cultural attractions are expected to have contributed to the preservation of culture in local communities. Tortor performance is held on an open stage in the old village of Huta Bolon. Performanceis no longer sacred but still follow the traditional rules of adatni gondang, such as the number of gondang types, rules of how to ask certain gondang types, the rules of motion in tortor, apparel and equipment. Another packaging of forms of performance that is of short duration and dense, full of variety, imitation of the original forms, and effective cost. Travelers can enjoy the Batak Toba culture, such as music, dance, historical objects, and the feel of Batak Toba villages. Overall the show is divided into two sessions, the first are Tortor Lae-lae, Tortor Mula-mula, Tortor Mula Jadi, Tortor Mangaliat, Tortor Marsiolop-olopan, tortor tortor Si Boru Si Doli, and Tortor Pangurason. AbstrakTortor toping huda-huda adalah pemberian penghormatan kepada orang tua yang telah meninggal, yang merupakan suatu bentuk kesenian tradisi yang secara turun temurun diwarisi oleh masyarakat Simalungun untuk memenuhi kebutuhan upacara adat sayurmatua. Upacara adat sayurmatua adalah ritual upacara kematian, dimana sayurmatua merupakan orang tua yang sudah lanjut usia meninggal dunia, yang mana orang tua tersebut sudah memiliki cucu dari anak laki-laki dan anak perempuannya. Upacara adat sayurmatua terdapat 2 pembagian acara yaitu mandingguri dan manggiligi. Tortor toping huda-huda ditampilkan dalam acara mandingguri. Dalam pelaksanaan upacara adat sayurmatua terdapat beberapa acara kemudian terdapat musik dan tari di dalamnya yaitu gonrang sipitu-pitu, , tortor manggiligi, dan tortor toping huda-huda. Tujuan penelitian ini adalah mengungkap makna yang terkandung pada tortor toping huda-huda dan pelaksanaan tortor toping huda-huda dalam upacara adat sayurmatua di Simalungun Sumatera Utara. Metode yang digunakan adalah metode kualitatif, pengumpulan data dilakukan melalui observasi dan mengamati upacara adat sayurmatua, khususnya pertunjukan tortor toping huda-huda yang terkait dengan upacara, kemudian didukung oleh dokumentasi audio dan visual serta wawancara dengan sejumlah tokoh adat dan masyarakat. Penelitian ini dianalisis dengan teori Semiotika oleh Ferdinand De Sausurre.Kata Kunci: upacara, sayurmatua, tortor toping.AbstractTortor toping huda-huda is giving respect to deceased parents, which is a form of traditional art that has been inherited from the Simalungun community for the needs of the adat vegetable ceremony. The sayurmatua traditional ceremony is a ritual death ceremony, where sayurmatua is an elderly parent who has passed away, in which the parents already have grandchildren from their sons and daughters. There are 2 adat divisions of the sayurmatua ceremony, namely the mandingguri and mujukigi. Tortor toping huda is displayed in the mandingguri program. In the implementation of the sayurmatua traditional ceremony there are several events then there are music and dance in it, namely gonrang sipitu-pitu, tortor manggiligi, and tortor toping huda-huda. The purpose of this study was to reveal the meaning contained in tortor toping huda-huda and the implementation of tortor toping huda-huda at the sayurmatua traditional ceremony in Simalungun, North Sumatra. The method used is a qualitative method, data collection is carried out through observation and observing the vegetablematua traditional ceremony, especially the tortor toping huda-huda performance related to the ceremony, then supported by audio and visual documentation and interviews with a number of traditional leaders and the community. Abstract - This study aims to determine the symbols and meanings contained in tortor martonun in the Simalungun community. The theoretical basis used is Anya Peterson Royce's theory of symbols. The research method used is a qualitative descriptive method with a population consisting of dancers of the Sultan Agung Foundation, resource persons / traditional leaders, and the Simalungun people who know about Simalungun culture and the research samples are resource persons / traditional leaders, dancers of the Sultan Angung Foundation. Data collection techniques were carried out in two ways, namely, written data collection techniques and field data collection techniques. Written data collection techniques in the form of literature study by reading books, journals and theses, field data collection techniques in the form of observations, interviews, and documentation. The musical accompaniment symbol in the martonun tortor is seen by reading the scores which consist of musical instruments in the form of gondrang sidua-dua, ogung, serunei, and mongmongan. The meaning of movement contained in tortor martonun, which means discipline and patience in doing a job from beginning to end, in order to get the desired result, the meaning in tortor martonun clothing is to show the majesty and authority of Simalungun women in doing a job, while the meaning of musical accompaniment is in tortor. Abstrak -Penelitian ini bertujuan untuk mengetahui simbol dan makna yang terdapat dalam tortor martonun pada masyarakat Simalungun.Landasan teori yang digunakan adalah teori simbol Anya Peterson Royce, dan teori makna Anya Peterson Royce yang dijadikan acuan dalam penelitian ini. Metode penelitian yang digunakan ialah metode deskriptif kualitatif dengan jumlah populasi terdiri penari sanggar Yayasan Sultan Agung, narasumber/tokoh adat, dan masyarakat Simalungun yang mengetahui tentang kebudayaan Simalungun dan sampel penelitian yaitu narasumber/tokoh adat, penari Yayasan Sultan Angung. Teknik pengumpulan data dilakukan dengan dua cara yaitu, teknik pengumpulan data tertulis dan teknik pengumpulan data lapangan. Teknik pengumpulan data tertulis berupa studi pustaka dengan cara membaca buku-buku, jurnal-jurnal serta skripsi-skripsi, teknik pngumpulan data lapangan berupa observasi, wawancara, dan dokumentasi, Hasil penelitian ini adalah tortor martonun pada masyarakat Simalungun: kajian simbol dan makna. Simbol dan makna dalam tortor martonun dilihat dari gerak, busana, dan iringan musik. Simbol gerak yang terdapat dalam tortor martonun ini menyimbolkan bagaimana proses bertenun, dimulai dari proses mengumpulkan kapas, proses membentuk kapas menjadi benang, sampai proses menenun benang menjadi ulos, Simbol busana dalam tortor martonun memakai pakaian marabit datas yang terdiri dari bulang sulapei, suri-suri, dan ulos hatirongga. Simbol iringan musik dalam tortor martonun dilihat dengan membaca partitur yang terdiri dari alat-alat musik berupa gondrang sidua-dua, ogung, serunei, dan mongmongan. Makna gerak yang terdapat dalam tortor martonun yaitu bermakna kedisplinan dan kesabaran dalam melakukan suatu pekerjaan dari awal hingga akhir, agar mendapat hasil yang diinginkan, makna dalam busana tortor martonun yaitu memperlihatkan keagungan dan kewibawaan perempuan Simalungun dalam melakukan suatu pekerjaan, sedangkan makna iringan musik dalam tortor martonun adalah menyampaikan suasana yang tenang, damai saat melakukan proses bertenun. ABSTRACT This study examines the semiotics contained in the Parsiarabu Tortor in Tomok Village, Samosir Regency. The purpose of this study is to explore the meaning contained in Tortor Parsiarabu and the interpretation of the meaning seen. To discuss the research objectives above, use theories related to the research. The theoretical foundation in this study uses the Semiotics theory of signs, markers and markers by Ferdinan De Saurrsure and the theory of forms concerning motion and clothing by Humardani. The location and time of the study was carried out in Tomok Village and the time of the research was two months, the population and sample were the community and members of the Parsaulian GPSB Studio (Generation of Art and Culture Lovers). The author conducts data collection techniques including library research, field observations, interviews with resource persons, and completes the data by taking photo documentation. This research uses descriptive qualitative. The results of the study are based on data that has been collected that Tortor Parsiarabu has 6 main motives namely Siubeon, Marsomba, Mambukka Roha, Patoru Diri, Papunguhon, Mangandungi. Clothing used in this Parsiarabu tortor is Ulos Sibolang, Ulos Bittang Maratur, Ulos Suri-suri Ganjang. The semiotics contained in the Parsiarabu tortor are poured through the sign that is in the form of motion that is seen in the serving, the signer which is seen from the main range of motion in the Parsiarabu tortor, and the signfied is the meaning contained in the motion Parsiarabu tortor, it can be interpreted that the meaning of this whole dance is respecting God, respecting the high position or government, respecting fellow human beings, staying humble and not arrogant, respecting others, uniting the hearts of fellow people so that there is no envy and revenge . This study aims to find out how non-verbal communication of Tortor Husip-husip in Batak Toba society. The population in this study are some of the traditional leaders Batak Toba society in Simanindo district, some of the artists who know about Tortor Husip-husip and the actors (citizens) who are involved as performer Tortor-husip Husip. The sample is also customary prominent figure, artists, and actors involved in Tortor Husip-husip. The method is used descriptive qualitative method. To complete the data in this study, the research conducted field observations, video, interviews and also documentation. The results of the data collected can be seen in non-verbal communication of Tortor Husip-husip in Batak Toba society, which is not only as a dance performed in ceremonies of death Batak Toba, but also can serve as a medium of communication and symbolic systems. The uniqueness and characteristic of this tortor are gotten in Husip-husip which has meaning how expressing of whispering, hopeful and prayers to those who have Saurmatua. As a medium of non-verbal communication can be seen from the gesture. The dancers are not only get dance as usual, but there are non-verbal messages will be conveyed through by gesture in Tortor Husip-Husip. The form of non-verbal communication in Tortor Husip-husip is symbolized by keep nodding head with body position leaning forward and whispering with a corpse. Gondang Bolon as the traditional music is used in this ceremonial celebrating. It contains sarune, taganing, gordang, ogung and hesek. The Non-verbal messages will be submitted to each community must be respecting to parents. And the Tortor Husip-husip is one of final tribute and delivering of the prayer, hope, gratitude and apology to the parents who have saurmatua.

Penelitian ini bertujuan untuk mendeskripsikan kajian semiotika (tanda, penanda, dan petanda) yang terdapat dalam gerak dan busana Tortor Balang Sahua pada masyarakat Simalungun. Tortor Balang Sahua merupakan tari tradisi kerakyatan yang berasal dari Kabupaten Simalungun. Penelitian ini menggunakan teori Ferdinand de Saussure dalam Amrin, Khairil, Zulkifli, dkk (2021:62) mengartikan semiotika adalah ilmu yang mengkaji dan mempelajari peran dari tanda di mana ruang lingkup semiotika dibagi dua yaitu penanda (Signifier) dan petanda (Signifield). Penelitian ini menggunakan penelitian deskriptif melalui pendekatan kualitatif. Populasi dan sampel pada penelitian ini adalah dua orang seniman Simalungun yang berada di Sanggar Sayur Matua. Hasil penelitian menunjukan bahwa ada tujuh motif gerak dalam Tortor Balang Sahua yaitu sombah, habang, patuduhkon arah, mandoppak hutoruh, manjaga diri, manganhon sipanganon, tinggalak. Busana yang digunakan dalam Tortor Balang Sahua adalah baju dan celana hitam, suri-suri sibirong dan gotong parhorja. Iringan musik pada Tortor Balang Sahua adalah gual imbou manibung. Adapun semiotika yang terdapat dalam Tortor Balang Sahua yang dituangkan melalui tanda diwujudkan dalam simbol gerak, penanda merupakan lambang yang berbunyi dan memberi makna, sedangkan petanda merupakan penjelasan makna yang dihasilkan oleh penanda.

Time spent in discussing Tortor Ilah Majetter in Simalungun of values research on the study of public during three monhs from june 2016 to august 2016. The location where the research is desa Purba Tongah Kecamatan Purba, Kabupaten Simalungun, Sumatera Utara. Data analysis in this research use descriptive qualitative data collection techniques by observation, library research, interviews, and documentation. The result of research based on the data collected can be seen that Tortor Ilah Majetter a young dance game on the night when the bright moon full moon that came with the singing. Tortor Ilah Majetter describe the joy of young people Simalungun. Though not much in the range of motion, but Tortor Ilah Majetter have values which are : 1) religious values which can be seen through poetry, 2) social values can be seen through the movement made jointly and simultaneously indicating Simalungun society very closely in togetherness, 3) aesthetic values can be seen through the motions, the pattern of the floor is well ordered and tidy. But it also can be seen through clothing and makeup dancer, 4) ethical values can be seen through the motions, the pattern of the floor, the clothes are limits and rules.

This Note proposes a new tort to address employers' and their agents' increasing abuse of the Unemployment Insurance appeals process, which interferes with employees' expectancy of entitlement benefits. Though existing state Unemployment Compensation statutes sanction both unemployed workers claiming benefits and employers for making fraudulent statements, these provisions approach the issue of fraud too narrowly to combat this growing problem. Meanwhile, no existing remedy properly compensates victims of this sort of abuse, adequately deters abusive behavior by scaling the penalty to the harm, and is accessible to economically disadvantaged plaintiffs. As well as providing an analysis of the specific problem of abuse of the appeals process in the Unemployment Compensation arena, this Note also aspires to provide the framework for a compelling legal argument that such abuse should trigger tort liability in the hopes of easing the work of any public interest attorney interested in bringing such a suit. Although this Note focuses on Unemployment Insurance claims, the principles discussed are generally applicable to a variety of other entitlement benefit claims. Part I identifies the employer behavior that presents the need for a remedy in tort. Part II articulates the criteria for an adequate remedy. Part III examines potential legal remedies to the problem of abusive appeals by employers during the claim and appeals process and finds them inadequate to protect the pressing economic interests of claimants and society. Part IV proposes the recognition of a new tort to fill this gap, and details both the grounds for liability and the computation of damages flowing from this form of liability.

Abstract (sommario):
When the Toba Batak ethnic wedding party in the Silalahi area, where Tortor was held, was no longer a medium of communication by paying attention to the meaning of every symbol of the movements that exist in Tortor, but Tortor was held to only be an art that could entertain and enliven the party and some had purposes can seek profit for the party organizers. This study aims to determine the meaning contained in the Tortor dance in Batak Toba marriage in Silalahi Village and to find out how the community's understanding of the meaning contained in the Tortor dance movement in Batak Toba marriage in Silalahi Village. The study used qualitative methods with the informant as the data source, and the researchers themselves as a means of capturing data using interview guidelines. The results of the research on the meaning of the Tortor dance movement in Toba Batak marriage show that the meaning of Manea-nea in a Toba Batak marriage is a way of welcoming the bride and groom and their entourage to enter the building. Mamasu-masuya where the bride and groom ask for blessings from parents, parhata kings and invited guests. Manombaya is the last worship performed by the bride and groom to their parents.

The Tortor Dance Performance has a cultural tourism attraction, and its role in increasing tourism is no less important when compared to other cultural attractions belonging to the Batak Tribe. This research is interesting because it was conducted in DKI Jakarta, as it is known that Jakarta is the national capital as a representation of a mini-Indonesia. Jakarta no longer only belongs to the Betawi tribe, but also to immigrant tribes who have lived in Jakarta for a long time, including the Batak tribe. The analytical method used is SWOT using a qualitative approach through data collection techniques through interviews. The results of this study stated that the potential for the Cultural Arts of the Tortor Dance in DKI Jakarta obtained positive results, meaning that the Tortor Dance has good potential, even though this dance originates from North Sumatra Province, the community still has high interest in this traditional dance. The role of stakeholders in DKI Jakarta towards the Tortor Dance Cultural Arts is considered very good, but there has not been a significant role in supporting the preservation of the Tortor Dance Cultural Arts in Jakarta. The strategy for promoting the Tortor Dance Cultural Arts in DKI Jakarta by using information technology is considered the most appropriate form to reach all levels of society. In an effort to increase the interest of the younger generation in terms of publication and information, stakeholders disseminate information about the Tortor Dance Cultural Arts through websites and social media such as Instagram, Twitter, TikTok, YouTube, and linked in.

Abstract (sommario):
The role of the local government of North Sumatra province in the development of Tortor Toba dance and gordang sambilan dance as performing arts that are expressions of traditional culture. EBT (traditional cultural expression) is a form of traditional intellectual property. Tortor is a dance, but the meaning more than the movements states that Tortor is a medium of communication, where through the movements displayed there will be interaction between participation in ceremonies, weddings, and also welcome. On the other hand, the lack of attention of the Indonesian government makes the Tortor dance has no copyright protection, therefore the author is interested in conducting further research on legal protection of the Tortor dance, the important role of the local government of North Sumatra province and the solution that can be provided by the government to the problem of claiming tortor and gordang sambilan dances by neighboring countries. This research uses qualitative descriptive research methods, with normative-empirical legal research types. Data collection techniques are interviews, documentation and data sources from the North Sumatra Provincial Culture and Tourism Office and the owner of the Sihoda dance studio. The finding in this study is that legal protection for Tortor's dance has not provided legal certainty specifically for Tortor's own dance, but the law recognizes the existence of regional arts.

Analysis of the data in this study using quantitative descriptive , to complete the data in this study , the authors conducted a field observation , interviews and documentationIn accordance with the understanding of the value of education in tortor Sirintak Hotang is work to foster public personality suitable values. Educational value contained in tortor Sirintak Hotang namely : ( a) Discipline : Discipline is the act of a person in complying with the rules applicable in public life.As for the kinds of discipline that is included in tortor Sirintak Hotang namely a. cooperation / mutual help , responsibility , never showed a lazy attitude to work , time discipline , a sense of belonging , a loyal neighbor and work groups . ( B ) Confidence : Confidence is assured on the ability and self-assessment in the conduct and beliefs on what she is doing . As for the kinds of confidence in the range of motion Tortor Sirintak Hotang namely : brave , always optimistic in doing the job , had a higher spirit , has the mental strength, have a high responsibility on himself . ( 3 ) Constancy of the soul: the soul is the strength or firmness is a provision in the soul . As for the kinds of mental firmness in the range of motion tortor Sirintak Hotang namely : Patience in the face of obstacles , self-sacrificing .

Abstract (sommario):
O léxico enquanto tesouro vocabular de uma língua configura-se como patrimônio social e cultural de uma determinada sociedade, transparecendo crenças, costumes, e tradições de uma comunidade linguística. Posto isto, este trabalho discute resultados de estudos sobre denominações para caolho (zarolho) e vesgo (olho torto) registradas na carta 0220.a – “E quem só enxerga com um olho porque perdeu o outro” e 0221.a – “E o indivíduo que tem os olhos tortos, que parece que está olhando para um lado e está olhando para outro?”, do ALMS – Atlas Linguístico de MS (OLIVEIRA, 2007, 159- 160). O atlas contempla uma rede de pontos de trinta e duas localidades e realizou inquéritos com 128 informantes. O estudo orientou-se por fundamentos da Lexicologia (BIDERMAN, 1998; ISQUERDO, 2009); Etnolinguística (GUÉRIOS, 1979), Dialetologia e Geolinguística (FERREIRA; CARDOSO, 1994; CARDOSO, 2010). Para caolho registraram-se – cego, zarolho, cego de um olho, cego de uma vista, cego de um lado, olho torto, deficiente do olho, vesgo – tendo caolho 36,71% de ocorrências, documentada em todas as localidades da rede de pontos. Para zarolho houve os seguintes registros: vesgo, caolho viroto, estrábismo, olho torto, biruto, míope, olhando do avesso, ziroto, sendo zarolho a forma mais produtiva (39,06%), registrada em 28 das 32 localidades da rede de pontos. Em síntese, o estudo demonstrou que as formas lexicais disfêmicas caolho e zarolho são utilizadas com maior frequência, mas sem levar em conta sua carga semântica pejorativa. Notou-se também um maior cuidado entre as mulheres quanto às escolhas lexicais, predominando entre elas o item cego ao invés de caolho.
