Testo completoThe development of the Internet, and of digital technology in general, has facilitated the commission of a large number of offences, and has made its entry into most branches of criminal law. However, there is still one branch of criminal law where digital technology has not made its entry: offences against the physical integrity of the person. Doesn't this logical rejection raise questions? The development of objects connected to the Internet means that such attacks are becoming a reality. The possibility of such attacks must therefore be incorporated into the Penal Code. The first part of this paper proposes to explore this possibility by bringing together the notions of weapon and digital to create the notion of digital weapon. Although these notions may seem antinomic, they are in fact relatively close. Their integration into the penal code shows that they obey the same mechanism: sanctioning the use of a particular tool - a weapon or a digital device - to commit an offence. We therefore propose a paradigm shift in the analysis of the weapon to bring these notions closer together. This re-theorization of the weapon around its function, which we call the mode of perpetration, enables us to take better account of the dematerialization of offences. The second part sets out to extend the regime of the "mode of perpetration" weapon to include the digital weapon, thereby strengthening the economic efficiency of the law in the fight against cybercrime. In particular, this allows us to take a global approach to cybercrime, favoring proactive rather than merely reactive analysis

Testo completoIn criminal law, the plurality of participants in the commission of an offence is apprehended in various forms and through different means, but always for repression purposes. On the one hand, this plurality can appear as the triggering condition for repression while being explicitly or implicitly required for the existence of separate offences such as collective offenses or offence of adhesion, but also for the implementation of the dependent qualification of punishable complicity. On the other hand, the specific context of the plurality of participants in the commission of an offence sometimes establishes an aggravating condition that can result from the application of the aggravating circumstance or be the indirect consequence of a legislative will to adapt the law enforcement to certain serious behaviors and other collective offences. If the criminal law manages to understand the phenomenon of plurality of participants in the commission of an offence and to use it to have a more efficient and a more effective repression, the struggle is nevertheless serious due to the extension or even the deformation of its principles and its fundamental concepts. For the purposes of law enforcement, the temporal and material boundaries of the penal responsibility are constantly extended, and the principle of personal responsibility is continuously distorted. All this tend to underline the insufficient and inappropriate aspects of the existing tools used to understand the plurality of participants in the commission of an offence

It generally corresponds to set of well-known situations, processed legally by distinct and separate institutions: combination of offenses, legal recidivism and repetition of offenses. But whereas the legislator considers how to punish a perpetrator of several offenses, he/she does not give us the origin of his/her hypotheses, that is to say how to distinguish and count the offenses. The object of this study has a prospective impact: it implies that we detach ourselves from current mechanisms in order to elaborate an encompassing notion of repetition, to which corresponds a unique regime. The repetition of offenses is characterized by two or more offenses committed successively by a same perpetrator in a limited period of time. In order to lead to a specific repression, the repetition must not concern just any offenses. The repeat offenses must be connected with each other. They must share a certain seriousness or identity. Furthermore, punishment will not be the same if the offender has already been convicted by a penal decision. Depending on the existence of this previous sentence, the repeat offenses committed by the habitual offender will lead to a more severe punishment

Testo completoAs a social concept, parenthood can influence the provisions of criminal law as some special criminal texts, either French or Libyan, include numerous offences, whether trespass to goods (theft, for instance) or violent crimes ( sexual offences, parricide, infanticide…). Such texts sometimes protect the family institution as such, which is the case for the desertion of the marital home. They are connected with the parental authority, family solidarity, family intimacy, love or even dignity… The criminal codes, both French and Libyan, devote a chapter to the family-related offences. However, the field of our study cannot be limited to the offences mentioned in this chapter only. Our study will deal with all the offences that can be linked to parenthood, as well as all the criminal provisions concerning these offences. Parenthood appears at the same time as a factor of greater severity and indulgence. It can represent a constituent element of the purely family-related offences or of the criminal juvenile liability. The Criminal code then reinforces the repression by increasing the penalty if it concerns lethal assaults or grievous bodily harm and sexual assaults provided the offence is committed by a close relative of the victim. In this respect the French legislator, by the law N2006-399 of April 4th, 2006, the law N 2010-769 of July 9th, 2010 and that N 2013-711of August 5th, 2013, reinforced the repression of family-related violence. On the contrary, the parental link may represent an obstacle to repression, may constitute a justifying element, a mitigating condition of the penalty or an interference with the functioning of criminal justice, especially concerning the challenging of magistrates or of witnesses

Testo completoThis study aims to demonstrate that vulnerability is a real concept of law. The first part of the thesis presents the two material conditions structuring the notion. First, vulnerability has a material origin : that is a personal weakness. Secondly, vulnerability results of the material situation of the person which criterion is a correlation link between the weakness of the person and the arm he/she risks for that reason. These material conditions are nevertheless not completely relevant to state vulnerability as a legal concept. The second part of the thesis proves that the concept of vulnerability cannot exist without a functional condition :vulnerability must participate to the legal qualification of a harm which is also legal concept. Vulnerability may then be taken into account to qualify an abuse of the situation of the person by someone else. Vulnerability can moreover and beyond participate to qualify other serious harm in the application of law

Testo completoMinors who are victims of sexual crimes should be entitled to a special protection by the criminal law. The importance of such protection should not be minimised. Criminal law should include provisions which are able to address adequately sexual crimes in which the victim is a minor. The purpose of this research is to examine to any extent minority affects the provisions of the Criminal Code, aiming at providing the required protection of the minor victim in the criminal legal system. Can the substantive and procedural criminal rules regarding sexual offences which are not applying particularly to the victim as a minor provide him/her with the sufficient protection? In other words, should the rules dealing with sexual offences in which the victim is an adult be the same and apply to a case when the victim is a minor? If the answer to the previous questions is no, the minor as a victim of sexual offences would need new rules in order to address his case? How could we set these rules? One of the topics is to analyze all the preceding questions concerning the adaptation of the criminal law to deal more adequately with the cases when the victim of sexual offences is a minor. A comparative analysis between the required protection of the minor as a victim of sexual offences and that protection provided generally by the criminal law raises two main questions: firstly, how to adapt substantive criminal rules in order to provide a better protection for the minor victim of sexual offences. Furthermore, minority should be an element of the sexual offences rather than an aggravating circumstance. Secondly, to adapt the criminal law to suit the status of the minor victim can be by the individualization of procedural techniques. Criminal proceedings should be reorganised to take into consideration the minor victim as a subject of real protection. The French law which has a long history in protecting the minor victim should now adopt a new model providing a comprehensive care of the minor victim of sexual offences
