Testo completoDuring the 18th century, thanks to the efforts of the post-tridentine catholic church, the Clergy seems to be better trained, more educated and have a more ethical conduct, as confirms the figure of the “Good Priest” in French literature. Various sources from the archives of the Bastille, parliament and ecclesiastical courts reveal that a substantial number of clergy members had a deviant behavior. Some Clerics transgress chastity rules and engage in casual or regular intercourse with servants, other men or prostitutes. They are subsequently closely kept under close surveillance by their parishioners, fellow priests, hierarchy or by the police. The corpus studied has permitted to highlight their sexual practices as well as the geography of the places of debauchery in the city. It also revealed the existence of several threshold effects and the ensuing scandals, court cases and repression, which were essential for society to be reconciled with its Clergy

Testo completoThe French religious and sexual landscapes share certain mutations that characterized a larger dynamic of secularization. They are structured not only by processes that diversify practices, multiply the available choices for action, and individualize norms, but also by the persistence of social frameworks that regulate behaviour. The state of religion in France is characterized by the Catholic faith’s loss of institutional influence and a reduction in church membership, a growing number of people stating no religious affiliation, and the specific position of Islam. The latter is a young, dynamic religion that is often understated and racialized in social space. These changes—and the differing histories of Catholicism and Islam in France—explain and interrogate the high public and media visibility of a religious fringe concerned with questions of gender and sexuality. To better understand these phenomena, the thesis examines the links between gender, sexuality and religion in France since the 1970s, on the basis of the sexual practice and representations of Catholics and Muslims. My analysis uses two types of material: three major population surveys on sexuality in France (1970, 1992, 2006) and one on conjugality (2013), together with biographical interviews with respondents who identify as Catholics and Muslims. The combination of these research materials provides a comparative perspective on the development of sexual behaviour among women and men according to their religiosity.The range of sexual behaviour among individuals, whether Catholic, Muslim or non-affiliated, is wide and diversified. Practices (first sexual experience, masturbation, pornography) are becoming more similar between Catholics and the non-affiliated, while Muslims’ sexuality is characterized by major gender differences and practices related to their minorized position in social space (such as men’s use of prostitutes). The perceptions of family and homosexuality fall into three major patterns, according to the respondents’ attachment to life as a couple, childbearing and heterosexuality. Religious commitment to some extent determines these positions, which are also situated within broader life stories and sexual experience.The thesis also demonstrates how women and men’s religious and sexual trajectories are connected on the basis of their life stories and place in power relationship (class, gender, race). In some cases, religion may be a resource (cultural, social or symbolic) for finding a partner and underplaying or reinforcing processes of social selection. The research interviews throw light on the ways in which respondents appropriate their religion, in what they say about it and about their behaviour, and the ways they subjectivate norms and (re)construct them in hindsight as they review their life experiences.The thesis offers new insight into the process of secularization in France. The sexuality of Catholics and Muslims provides an original view of the way men and women establish themselves as subjects. It sheds new light on the various forms of social normativity in a society where normative sources are multiple and non-hierarchical. Finally, it demonstrates that religion is only socially significant in a society structured by gender, class, race, and sexual inequalities

Testo completoHistory of the repression of sexual behavior by the aragonese inquisition between 1560 and 1700 in the three secretariats of barcelona, valencia and saragossa. This study and all the statistics used to illustrate it are based on inquisitorial and manuscript sources : first, the files containing the relaciones de causas, and second, the extensive reports of certain trials which were kept for valencia. The four sexual deviations that form the object of this study are: solicitation by clerics, bigamy, sodomy, and bestiality. We studied the basis for repression before the beginning of the sixteenth century and the reasons why sodomy was entrusted to the inquisition. After the distribution of repression among four legally distinct offenses (seduction by priests, double marriage, homosexual practices, sodomy of women, zoophilia), we consider the sociological aspects of these human groups to fix the real aims of the holy office. In a second part, we study the activity of the tribunal in the proceedings and in the sentences and penalties inflicted upon such sexual offenses. The repercussion of this repression on the attitude of men, witnesses, and the whole society. In a third part, we analize in a positive way the contents of the relaciones de causas in order to establish a map of the distribution of marginal sexuality in town and in the country, and to insist on the importance of language. Finally we try to characterize the manifestations of exploitation of young men and the phenomenon of substitution in zoophilia. The last aspect concerned the link beween violence and the sexual behaviors

Testo completoThis works aims to question the evolutions brought by young people aged 14 to 25 in two mouvements of Specialized Catholic Action in 1960s France. Historiography makes a link between social changements in gender or intimacy issues during this time and students as social actors and the phenomenon of secularization, however, this study would like to renew the field by focusing on the young people in a religious mouvements aimed at the working class. Born in the interwar period on a line of uncompromising moral and Christian reconquest of the workers, YWCs became unexpected but real actors of gender evolutions in French society of the postwar boom. The mouvements represent a middle way of social change by seeking an original ecclesial and social position in accordance with the double injunction of a Christian and social activist movement. The beginning of the coeducation, debates on gender equality in schools, at work or in society, as well as matters of sexual emancipation are a good historic observatory of the evolution on gender. While Catholicism gradually abandoned as a primary form insertion into society as a lay specialized Catholic Action from the 1970s, this history is also that of the consequences of secularization on a denominational movement. The bursting of meaning, the development of a practical pluralism, the search for autonomy reflect the tensions in contemporary French Catholicism since the 1980s on issues of gender and intimacy in the very contemporary

Esta investigación trata sobre distintas organizaciones católicas en favor de la liberación sexual: organizaciones católicas por la diversidad sexual, organizaciones católicas por los derechos reproductivos, organizaciones católicas por la igualdad de género y organizaciones católicas por el celibato opcional. Estas agrupaciones están conformadas por gente que profesa la fe católica y que sin embargo contestan la posición de la Iglesia con respecto a la homosexualidad, el aborto, la ordenación femenina y el celibato. La pregunta que se plantea entonces es la siguiente: Cómo es que estos grupos se afirman católicos y al mismo tiempo en desacuerdo con la Iglesia? Testo completoIs the notion of good morals, as it has been received in the canonical tradition, destined to disappear in positive Canon Law under the influence of recent developments in the secular laws of many countries in recent decades? This is the question that runs through all the pages of this doctoral research.The introduction of the notion of personal autonomy in secular law paved the way for many developments in the area of individual freedoms. This led to the rise of subjective rights, particularly in the area of private and family life. In addition to the increase in remarriages after divorce, other forms of conjugality obtained legal recognition, seriously undermining the model of the traditional matrimonial institution protected by Canon Law.In this socio-juridical context marked by major changes in family structures, the Catholic Church was confronted with complex and unprecedented pastoral situations, requiring new and appropriate canonical responses, i.e solutions that take account of current sociological realities without losing sight of the requirement of their conformity to the moral principles of Divine Law. Until 2016, the Church constantly reaffirmed the impossibility of changing canonical legislation to respond to requests tending to relativize the teaching of Christian morality, based on divine Revelation.However, the apostolic exhortation Amoris laetitia, published on March 19, 2016 following two Synods of Bishops held in 2014 and 2015 on the pastoral challenges of the family, brought about a real paradigm shift in the Church's attitude by establishing the category of personal and pastoral discernment. In reality, this means taking into account the judgment of the enlightened conscience of the subject of law in the canonical evaluation of certain personal life situations that are in objective contradiction with the precepts of Christian morality.We are therefore entitled to ask whether, with the consecration of this new juridical figure, Canon Law is still justified in punishing behavior that objectively violates certain norms of Christian morality. The answer must be in the affirmative, insofar as the canonical legislator has not repealed the provisions of the Code in force designed to protect the theological conception of the boni mores, but has merely created a new instrument for relaxing their application to certain members of the faithful in particular situations and under specific conditions.While this juridical category, still emerging in Canon Law, now makes it possible us to envisage adequate, differentiated and equitable solutions to the difficult question of the integration into the Church of persons whose marital situation objectively contradicts the precepts of Christian morality, it must nevertheless be recognized that its implementation has without doubt begun a progressive and irreversible decline of the traditional notion of boni mores in Canon Law. Ultimately, one might ask whether the category of personal and pastoral discernment is not, in fine, in Canon Law, the moderate facet of the notion of personal autonomy in Secular Law

Testo completoIn its official documents, the Magisterium of the Catholic Church often refers to intra-marital artificial contraception as an intrinsically evil act. The use of this concept seems to consider the biological nature as an imperative index of a moral standard without other considerations. If artificial contraception is wrong in itself, then what place do we give to conscience and freedom of couples in birth control? Is there an irreducible opposition between the natural law and contraceptive techniques? Does a technique, if taken by itself, hold a defined moral value? To answer these questions, we have traced back the evolution of this concept through a rereading of its anthropological-theological issues based on the circulation of several poles of thought (Scripture, Tradition and Reason, Humanities, Experience, etc.). To dispel any equivocities and ambiguities related to this concept, we believe it is better to use the term unjustifiable act rather than that of an intrinsically evil act. The concept of unjustifiable act has the advantage of granting hermeneutics and the use of practical reason in ethical discernment. In this way, we can honor otherness (recognition of particularities and subjectivities, while searching for the universal), grant the plurality of actions, norms and systems of legitimation of standards and allow regulation to better enable the regulation of historicity, temporality and systemic complexity in moral judgment of human actions

Testo completoIn Colombia it can be found a network of discourse patterns that seeks to control the discursive production on sex and to restrain the sexuality of the Colombian people. La Virgen de los sicarios by Fernando Vallejo (1994) responds subversively to such discursive and sexual conditioning. The discursive production on sexuality in Colombia has been mainly created and influenced by the Catholic tradition, discourses originating with the State and scientific texts. As a result, sexual attitudes which are not consider as normal by institutional discourse are subjugated to a power that places them in an abominable place in what could be called the Colombian sexual order. La Virgen de los sicarios comes from Colombia’s queer literature, presenting a story that is both discursively and sexually subversive. This thesis first seeks to describe the inevitable presence of the religious speech in Colombia and its strong relation with the State in order to prove the existence of a discursive norm. Second, by analyzing Vallejo’s narrative in the novel, it shows how this norm is subverted by using its own ideological guidelines to weaken it. Finally, using various concepts developed by Michel Foucault and Judith Butler, it exposes the existence of a sexual norm in Colombia that is present in discourses and that extends to bodies. This Norm is disproved through a process in which the author releases the sexuality of the characters from the power that dominates their bodies.
Existe en Colombia una red de discursos que busca controlar la producción discursiva sobre el sexo y las realizaciones sexuales de los colombianos. La Virgen de los sicarios de Fernando Vallejo (1994), responde de manera subversiva a dicho condicionamiento discursivo y sexual. La producción discursiva sobre la sexualidad en Colombia se ha construido, principalmente, a partir de la tradición católica, de discursos estatales y de textos científicos. Como consecuencia de esto, los comportamientos sexuales que el discurso institucional no considera como normales son sometidos a un poder que los ubica en lugares ominosos dentro del orden sexual colombiano. La novela de Vallejo surge desde la producción literaria queer colombiana y esgrime una historia subversiva tanto de manera discursiva como de manera sexual. Esta memoria describe, en primer lugar, la presencia inevitable del discurso religioso en Colombia y su fuerte relación con el Estado para demostrar la existencia de una norma discursiva. En segundo lugar, al realizar un análisis de la novela de Vallejo, se observa cómo dicha norma es subvertida al usar sus propios lineamientos para desvirtuarla. Por último, a partir de conceptos desarrollados por Michel Foucault y Judith Butler, se pone de manifiesto la existencia de una norma sexual en Colombia que parte de los discursos y que se extiende hacia los cuerpos. Norma que es impugnada por medio de un proceso en el que el autor libera la sexualidad de los personajes del poder que recae sobre sus cuerpos.
