Testo completoSexual violence and conflict go hand in hand. In ancient warfare, sexual violence was a common procedure, perceived as an inevitable consequence of war. Soldiers needed to 'release' after heavy fighting; sexual distraction would reward, motivate and relax them. In other words, sexual violence was seen as 'collateral damage' and was therefore never prosecuted as a crime. This practice started to change after the Second World War. In fact, at the moment the existence of sexual violence was internationally acknowledged, women's rights gained recognition and several forms of sexual violence were classified. Finally, sexual violence was labeled as a 'weapon of war'.

Sexual and commercial explotation of children and adolescents is a social phenomenon which, nowadays, has found vast regulation in Brazilian law. According to the article 244-A of Child and Adolescent Statute and the article 218-B of Brazilian Penal Code it is considered a crime the conduct of submitting or favoring children and adolescents to prostitution or other forms of exploitation. However, there is a great controversy both in terms of doctrine and jurisprudence from the Brazilian Court of Justice in relation to establishing if the criminal responsibility in these cases would not only be upon the agents and allucers who intermediate the sexual practice, as ponces and ruffians, but if it would also extend to those users who, without the intermediation of others, keep sexual contact with children and adolescents who are included in a context of prostitution. Thus, the object of this study consists in the analyses of the criminal responsibility of the violations related to sexual exploitation of prostituted children and adolescents. Our aim is to understand the present mainstream legal argument in the jurisprudence of Brazilian Superior Court of Justice in order to establish the extent of the penal norm as well as the criminal responsibility of the agents involved. The understanding of the factors which favor the sexual exploitation of children and adolescents, such as social inequality, sexual mercantilization and the asymmetrical genders relationships in our society are presented as important instruments for analyses of the legal argument in the scope of the courts as well as for the strength of the child and adolescent protection system in this country. This research has an empirical nature and has been based on a legislation and specialized literature review about this theme.
A exploração sexual comercial de crianças e adolescentes é um fenômeno social que encontra atualmente no sistema jurídico brasileiro intensa repressão no campo normativo, sendo considerada crime a conduta de submeter ou favorecer crianças e adolescentes à prostituição ou outra forma de exploração, conforme estabelecem os art. 244-A do Estatuto da Criança e do Adolescente e o art. 218-B do Código Penal Brasileiro. Entretanto, existe uma grande controvérsia tanto no âmbito da doutrina quanto na jurisprudência dos Tribunais de Justiça do país em relação a estabelecer se a responsabilização criminal nestes casos recairia tão somente aos agenciadores e aliciadores que intermediam a prática sexual, como cafetões e rufiões, mas se também se estenderia àqueles usuários que, sem a intermediação de terceiros, mantêm contatos sexuais com crianças e adolescentes inseridas em um contexto de prostituição. Neste cenário, estariam crianças e adolescentes protegidas pela tutela da norma penal? Assim, o objeto de estudo deste trabalho consiste na análise da responsabilização criminal nos delitos relacionados à exploração sexual de crianças e adolescentes em situação de prostituição. Busca-se compreender a orientação jurídica que atualmente prevalece na jurisprudência do Superior Tribunal de Justiça STJ para se estabelecer o alcance da norma penal e a responsabilização criminal dos agentes envolvidos. A compreensão dos fatores que favorecem a exploração sexual de crianças e adolescentes, dentre os quais as desigualdades sociais, a mercantilização do sexo e as relações assimétricas de gênero na sociedade, se apresentam como importantes instrumentos para análise do posicionamento jurídico no âmbito dos tribunais, como também para o fortalecimento do sistema de proteção de crianças e adolescentes no país. Esta pesquisa é de caráter empírico, sendo realizada a partir da revisão da legislação e da literatura especializada sobre o tema.

Testo completoThe definition of sexual harassment is phenomena, comments or approaches that are of a sexual nature and from the victim are perceived to be undesirable. Employers have statutory obligations under the Discrimination Act to work on preventive sexual harassment within their own organization. However, #metoo shows in the fall of 2017 that sexual harassment is more prevalent than the public previously believed and thus has increased the critical awareness that employers may have shortcomings in their preventive work on sexual harassment within their own business. The purpose of this study will be to investigate whether employers in the restaurant industry have changed their prevention work on sexual harassment as a result of #metoo and, if so, how this change work is concrete. In order to answer the purpose of the study and problem identification, a method combination consisting of a web survey and further interviews was conducted. The survey was sent by mail as distribution to 265 restaurants, in six pre-selected cities and brought a response rate of 29 %. Based on the survey, the selection was conducted for further interviews, where the requirement was that the restaurant has been noted the hashtag, implemented or planned changes as a result of #metoo, and that the respondent had an interest in participating in a deeper interview. Nine interviews were conducted to highlight how the change work has been implemented. The final result of the study is that 93,5 % were noticed or partially noticed #metoo and its significance, 45,5 % have made changes as a result of #metoo and 54,5 % rejected change. It is clear that it is the more employer who have noticed the hashtag than then chose to make changes. Those who, on the other hand, chose to initiate or plan to initiate a change implemented this in different ways, to different degrees, ambition levels and time perspectives.

Testo completoThe interest in conducting the study was raised in the autumn of 2017 when the #metoo movement spread on social media and a large number of individuals witnessed their vulnerability to sexual harassment at their workplaces. The movement certifies sexual harassment in a number of industries, where our interest was raised to investigate the nurse's experiences of sexual harassment. Past studies that constitute the research front are focused on the individual and the individual consequences of sexual harassment. The knowledge gap that was identified was how organizations are affected by the occurrence of sexual harassment as well as how they can carry out preventive and remedial work on the issue. The purpose of the study is therefore to highlight the occurrence and the consequences of sexual harassment. One purpose is to explain how the organization works with issues related to sexual harassment. To answer the purpose of the study theories describing the definition of the concept of sexual harassment, individual- and organization effects, power, culture of silence, organizational culture and employer responsibility is all brought up. The data collection of the study is based on a triangulation using a quantitative web-based survey as well as qualitative semi-structured interviews. A demarcation has been made to female nurses employed in an organization in central Sweden. The results of the study shows that sexual harassment occurs at the workplace and that there is a culture of silence about the subject where the asked employees do not know where to turn to tell their experiences. Employees also show great unknowledge about the organization's policy, action plan and what support they are entitled to receive. The results of the collected data have been analyzed using the theoretical reference framework and concentrated on four main areas that are also discussed. The main areas are where to drawn boundaries, culture of silence, organizational culture and organizational work.

Testo completoSexting has been linked to a range of sexual behaviors, including sexual assault; however, the mechanism through which sexting increases the risk for sexual assault is unknown. One explanation for the role of sexting in sexual assault could be due to gender differences in sexting and sexual communication. The current study examined men’s and women’s perceptions of sexting as a form of communicating sexual intent and sexual consent, and how sexting influences attributions of responsibility and blame in sexual encounters and alleged sexual assault. Additionally, considering the role of alcohol in sexual assault, the study also examined how both sexting and alcohol influenced individuals’ perceptions of a sexual scenario. Method:Using a factorial vignette design, N = 525 college students (48.6% women; 71% Caucasian) were randomly assigned to one of four vignettes regarding a sexual scenario between a man and woman (John and Jennifer), with sexting and/or alcohol involved. Results: Significant differences in sexting vs. texting conditions were seen for perceptions of sexual intent (F = 147.28, p< .01) and sexual consent (F = 105.86, p< .01). Men were more likely to perceive that sexual consent was exchanged (F = 9.16, p< .01) and to interpret the sext as a consent cue (F = 7.82, p< .01). John was attributed more responsibility/blame across all conditions (F = 154.58, p< .01); however, Jennifer was attributed more blame in the sexting conditions (F = 9.16, p< .01). Conclusion: Results suggest that despite sexting as a signal of sexual interest, there are differences in how men and women perceive sexting as sexual consent, which may influence the risk for sexual assault. Additionally, there are differential effects of sexting for men vs. women, such that women may be judged more harshly for sexting, suggesting evidence of the sexual double standard. Results offer important implications for sexual assault prevention and sexual gender roles.

The present study investigated how embodied power influenced sexual harassment (SH) judgments by manipulating the initiator to embody responsibility-focused, or self-focused power (compared to a control), and whether moral licensing, operationalized through moral crediting and moral credentialing, would mediate relations between power embodiment and SH judgments. Participants were 376 adults (42% female) residing in the U.S. who were recruited through Mturk. Moral crediting was significantly higher for perpetrators described as embodying responsibility-focused power, compared to a control condition (no power cues), which in turn was higher than perpetrators described as embodying self-focused power. Moral crediting was positively related to false accusations, SH severity (opposite of predictions), and severity of punishment. Additionally, there were gender differences in moral crediting such that the effects of power-embodiment on moral crediting were stronger for women than for men, though both were significant. Taken together, the findings of this study indicate that some initiators evade censure as their actions are seen as less severe when others believe them to have embodies responsibility-focused power. This should serve as an indication that SH is not always done by “bad actors”, but by those who appear to be virtuous. These findings should inform future SH policies, research, and training.

Testo completoA proposta central do presente estudo se refere à análise da responsabilidade penal do agente transmissor do vírus da SIDA, por via sexual. Mesmo que dotado de caráter de ultima ratio, o Direito Penal cumpre um papel fundamental ao intervir nesta área, haja vista o considerável perigo que aludida enfermidade representa para a saúde e para a vida humanas. A fim de se resolver a problemática relativa à imputação do resultado à conduta – por se estar perante resultados tardios –, bem como de se proceder à adequação técnica da conduta ao tipo legal previsto – tendo em vista que Portugal não possui um tipo legal específico destinado à punição da conduta em tela –, convocam-se os delitos de homicídio, de ofensa à integridade física e de propagação de doença contagiosa como principais candidatos a tipificar tal conduta. Após analisar, individualmente, cada um destes delitos, apontando-se as possíveis dificuldades encontradas no momento da imputação, elege-se o tipo de ofensa à integridade física grave, previsto pelo artigo 144.º, alínea “d”, do Código Penal, como sendo a figura típica mais adequada a incriminar a ação de transmissão da SIDA. Na sequência, entretanto, defende-se que a realização do risco proibido não deve consistir no único critério a fim de que se proceda à imputação objetiva, devendo o alcance do tipo ser também avaliado no caso concreto. Para tanto, passa-se à apreciação da contribuição do ofendido, a qual, a depender do grupo em que este se encontra inserido, pode vir a influenciar na responsabilização penal do agente transmissor do vírus, de forma a diminuí-la ou até mesmo a excluí-la.
The main proposal of this current study is to analyze the criminal responsibility of the transmitter agent of the AIDS’s virus by sexual means. Even endowed with ultima ratio nature, the Criminal Law fulfills a crucial role by interfering in this area, considering the significant danger that the mentioned disease cause to humans’ health and life. Willing to solve the issue related to the imputation of the result to the transmitter’s conduct - for the results are behindhand -, as well of proceeding to the technical adequacy of the conduct to the legal type estimated - knowing that Portugal does not have a specific legal type destined to punish the conduct aforesaid -, the homicidal offense, the physical integrity offense and the contagious disease spread are called as main candidates to typify such conduct. After analysing, individually, each of these offenses, indicating the possible difficulties found in the moment of the imputation, the type of severe physical integrity offense is elected, predicted by the article 144.º, “d”, of the Portuguese Penal Code, as being the most adequate typical figure to incriminate the action of AIDS’s transmission. However, it is defended that the exercise of this behavior must not consist in the only measure to proceed with the objective imputation, due to the range of the type also being evaluated in the concrete case. Therefore, the contribution of the victim becomes a part of the analysis, which, depending on the context, can influence the criminal liability of the virus’s transmitter agent, reducing it or even nullifying it.

Em especial, trata dos casos em que o agressor não exerce responsabilidades parentais relativamente à vítima do crime, mas sobre outros sujeitos, também eles menores de idade.Porque o interesse superior da criança consiste num bem jurídico fundamental na nossa comunidade, sempre que aquele não esteja plenamente assegurado, é legítima a atuação de uma entidade alheia à família, sendo esta quem tem, em primeira linha, o dever de assegurar o interesse superior da criança, grosso modo, o desenvolvimento integral e harmonioso daquela, criando-lhe todas as condições indispensáveis à sua efetivação.A proteção do interesse superior da criança pode então ser alcançada por diversas vias, de acordo com o quadro circunstancial no qual está inserida a criança.Assim propugnamos uma análise que incida não só sobre os abusos sexuais de menores, mas também sobre o regime das responsabilidades parentais. Considerando as finalidades do instituto das responsabilidades parentais e tomando como referência a proteção da autodeterminação sexual dos menores, pretendemos averiguar se o menor em convivência com o agressor que exerce responsabilidades parentais, se encontra numa situação de perigo. Em busca de uma solução que garanta a proteção do supremo interesse das crianças, critério orientador de toda e qualquer atuação, e através de um juízo de adequação, consideramos a possibilidade de se aplicar ao caso em discussão, alguma(s) das medidas já previstas no âmbito da lei penal, da lei civil e, nomeadamente, no âmbito do processo tutelar cível.

It will specifically deal with situations where the aggressor has not a parental relationship with his victims, but has his own underaged children.The best interest of the child is a fundamental juridical asset in our community, when it is not fully assured, it is legitimate to act from an entity outside the family, which is primarily responsible for ensuring the superior interest of the child, roughly, the integral and harmonious development of that one, creating all the indispensable conditions to its effectiveness.The protection of the child´s best interest can then be achieved by several routes, according to the circumstantial framework in which the child is inserted.Therefore, we advocate an analysis that focuses not only on child sexual abuse but also on the regime of parental responsibility.Considering the purposes of the institute of parental responsibilities and taking as a reference the protection of sexual self-determination of minors, we intend to find out if the child when living together with an aggressor who has parental responsabilities, is in danger of suffering sexual abuse.In search for a solution that ensures the child protection, using the child´s best interest as a guiding criteria in all scenarios, and through a judgment of adequacy where it is needed, will also be considered the possibility to apply in the case at hand, some of the practices already contemplated in the penal law, and also regarding the civil tutelary process.

Testo completoA análise aqui efectuada começa por atender ao fenómeno do feminismo enquanto movimento social que apesar de diversificado, tem como um dos objectivos a atingir, o fim das estruturas patriarcais, cujo pilar central se baseia na violência de género. Como tal, procedemos à desconstrução da categoria género, que se afigura como uma representação que a sociedade efectua das nossas diferenças biológicas. Estas mesmas diferenças, que à partida, não apresentam consequências surgem como um dos grandes responsáveis pela discriminação de que é alvo a mulher comparativamente ao homem e que em consequência se traduzem na prática de crimes contra si, entre os quais os de cariz sexual. Sendo os conflitos armados, um território onde se privilegia o vigor físico enquanto símbolo da masculinidade dos soldados, a execução de crimes sexuais surge como um desfecho inevitável da junção desses ingredientes, como uma espécie de efeito natural dos conflitos armados ou mesmo como uma espécie de bónus para a prestação dos soldados em campo. Passamos a analisar posteriormente o modo como a violência sexual foi interpretada e analisada nos diversos tribunais internacionais e no fim, como evoluiu a responsabilidade criminal ao nível dos intervenientes da cadeia de militar, quer no que respeita aos pressupostos da responsabilidade comando, quer perante a Joint Criminal Enterprise.Palavras-chave: Feminismo - Violência de Género - Crimes Sexuais – Conflitos Armados -Responsabilidade Criminal - Joint Criminal Enterprise
The analysis made here begins by looking at the phenomenon of feminism as a social movement that although diversified, has as one of the objectives, the end of patriarchal structures, whose central pillar is based on gender violence. As such, we proceed to the deconstruction of the gender category, which appears essentially as a representation that society makes of our biological differences. These same differences, which have no consequences at the outset, appear as one of the main causes of discrimination against women compared to men, and which consequently result in crimes against them, including sexual offenses. The armed conflicts, a territory where physical vigor is a symbol of the masculinity of soldiers, the practice of sexual crimes arises as an inevitable consequence of the combination of these ingredients, sort of a natural consequence of the conflicts or even as a bonus for soldiers in the field. We went on to analyze later how sexual violence was interpreted and analyzed in the various international courts and, in the end, how the criminal responsibility at the level of the various actors in the chain of command evolved, not only at the level of the assumptions of command responsibility but also towards the joint criminal enterprise which is composed of three different categories.Keywords: Feminism - Gender Violence - Sexual Crimes –Rape–Sexual Slavery–Forced Marriage – Armed Conflicts - Criminal Responsibility – Command Responsibility –Joint Criminal Enterprise
