This chapter considers the role of the courts, which is expected to be critical for electoral integrity through upholding voting rights; examining legal appeals, petitions, and complaints in specific cases; and evaluating the constitutionality of electoral procedures. In many countries, constitutional courts have often played a vital role in judging legal complaints about electoral malpractices. This process is particularly important in democratic states with an independent judiciary. By contrast, in autocratic states, the judiciary is often believed to be in the pockets of ruling parties, although this assumption has been challenged where the courts ruled against the government. Through examining cases in eastern Europe this chapter considers the role and independence of the courts as a check and balance both on the legislature and executive branches.

This chapter examines the role of national constitutional courts in European democracy. It first provides an overview of national constitutional courts in Europe, focusing on the requirements that they impose on national institutions and the consequences of those requirements at the treaty level—i.e., transferring national powers to the European Union and regulating how these powers are exercised; at the level of the EU’s exercise of these powers; and at the level of implementing European law within national legal systems. The chapter also discusses how the European Court of Justice’s jurisprudence enabled the European treaties to function as a constitution; the non-political mechanism of EU decisions and how it promotes economic liberalization; and how the design and function of European primary law undermine democracy. The chapter suggests that the democratic legitimacy imparted to the EU’s decisions by its citizens can only develop within the framework of the European Parliament’s powers.

This chapter presents concepts that are essential to understanding the role and functioning of the Colombian Constitutional Court. It covers the aggressive role conception of the Court in a context in which there is significant political distrust because of the dysfunctionality and corruption of some political institutions in the Colombian context. It also covers the efforts of the Court to create a system of precedent in a civil-law context, as well as its jurisprudence on the constitutional block, where the Court has incorporated core precepts of international law into the Colombian constitutional order. The purpose of this chapter is to give the reader case law needed to understand the work of the Court throughout the rest of this volume.

This chapter details the role of courts regarding counsel in an arbitration proceeding. Korean courts will generally only review whether a case should be subject to arbitration or court litigation before an arbitral tribunal has been constituted. After constitution, they will defer to the arbitral tribunal. This development, however, is a recent one. From here the chapter explores a tribunal’s negative competence-competence ruling, which may be subject to court review, as well as the capacity of the courts to provide some measure of interim relief. The chapter also discusses objections during court proceedings, as well as the source of legal fees.

In Reference Re Secession of Quebec, 1998, the Supreme Court of Canada concluded that the unwritten constitutional principles of federalism and democracy dictated that the clear repudiation of the existing constitutional order and the clear expression of the desire to pursue secession by the population of a province gave rise to a reciprocal obligation on all parties to the federation to negotiate constitutional changes to respond to that desire. To understand this astonishing decision, the author first examines how, over time, in Canada and Quebec, issues of identity(ies), constitutional law, and democracy came to be formulated in absolutist terms, making political compromises next to impossible. Only then does he analyse the Supreme Court’s decision and attempts to explain why the latter chose to decide as it did.

This chapter examines a number of positions that defend the legitimacy of constitutional review on grounds of a special connection between courts and fundamental rights. It starts by insisting that the issue cannot be settled by appeal to any constitutional logic but must make reference to political morality. It then critically assesses the view that sees in courts a forum for the realization of a general procedural right to lodge complaints against political decisions setting back our interests. Such a procedural right, though, is dubious and does not straightforwardly apply to constitutional design. The chapter then turns to Ronald Dworkin’s thesis that courts ought to decide questions of principle and not policy and are better suited for this purpose than legislatures. However, this thesis cannot account for the dependence of the judicial role on legislative decisions.

This chapter examines the question of interpretation with regard to the Indian Constitution. It begins with an overview of two meta-judgments underlying constitutional interpretation, the first of which relates to the legitimate source of the Constitution’s authority and the second to the tools and techniques that can be relied upon in order to expound constitutional meaning. It then considers the three historical phases of the Indian Supreme Court’s interpretive philosophy: textualism, structuralism and ethicalism, and panchayati eclecticism. It also explains how the Court started deciding cases based on self-conceptions of its own role, resulting in the adoption of various interpretive approaches that are not only incongruent, but also often producing incoherent constitutional jurisprudence.

Since the wave of constitutional reforms in Africa during the 1990s, the role of courts in interpreting and applying constitutions has become critical to the on-going process of constitutional construction, reconstruction, and maintenance. These developments have resulted in fundamental changes in the nature and role of courts exercising jurisdiction in constitutional matters. The chapters in this second volume of the Stellenbosch Handbooks in African Constitutional Law series are the first to undertake a critical and comparative examination of the interplay of the diverse forms of constitutional review models on the continent. As the list of areas in which these courts have intervened has grown, so too have their powers, actual or potential. By identifying and examining the different models of constitutional review, these chapters consider the extent to which courts are contributing to the establishment of constitutionalism and the rule of law in Africa.

By presenting the Court’s principal lines of case law regarding the allocation of powers in the Italian constitutional system, this chapter explores the constitutionally regulated relationships among the President, Executive, Parliament, and Judiciary. It reveals that rather than a “separation of powers” in the conventional sense of contemporary constitutional models, the Italian system is best described as instituting a set of reciprocal “relations of powers” with the Constitutional Court as the “judge of powers” that maintains and guarantees these interrelationships of constitutional actors. The chapter explores this role of the Constitutional Court in its relations with both Parliament and the President of the Republic, as well as the Court’s regulation of the relationship between the President and the Executive.

This chapter considers the meaning, scope, and application of three constitutional principles of surpassing importance in Canada. The rule of law is foundational to Canada’s constitutional framework and may properly be characterized as the first principle of Canadian constitutional law. It is linked to, and in some respects, forms the underpinning for other fundamental principles, including constitutionalism, federalism, democracy, and parliamentary sovereignty. As the latter principles are the focus of chapters by other commentators in this Handbook, this chapter will examine the rule of law primarily in relation to the separation of powers and judicial independence. The principle of judicial independence is also essential to the functioning and structure of the Constitution, given the role the courts are called upon to play in policing the constitutional limits of legislative power and administrative action. The separation of powers is still an emerging principle in Canada, but also increasingly viewed as fundamental.
