Abstract (sommario):
Contrary perhaps to expectation, Classical studies is at the vanguard of the latest technological developments for using digital tools and computational techniques in research. This article outlines its pioneering adoption of digital tools and methods, and investigates how the digital medium is helping to transform the study of Greek and Latin literature. It discusses the processes and consequences of digitization, explaining how technologies like multispectral imaging are increasing the textual corpus, while examining how annotation, engagement, and reuse are changing the way we think about “the text”. It also considers how the digital turn is reinvigorating textual analysis, by exploring the broader ecosystem, within which the digital text can now be studied, and which provides enriched contexts for understanding that are constantly shifting and expanding. Classical literature in the digital age has the potential to both challenge dominant modes of thinking about antiquity and disrupt traditional ways of doing research.

Abstract (sommario):
Abstract The water sector is in the middle of a paradigm shift from focusing on treatment and meeting discharge permit limits to integrated operation that also enables a circular water economy via water reuse, resource recovery, and system level planning and operation. While the sector has gone through different stages of such revolution, from improving energy efficiency to recovering renewable energy and resources, when it comes to the next step of achieving carbon neutrality or negative emission, it falls behind other infrastructure sectors such as energy and transportation. The water sector carries tremendous potential to decarbonize, from technological advancements, to operational optimization, to policy and behavioural changes. This book aims to fill an important gap for different stakeholders to gain knowledge and skills in this area and equip the water community to further decarbonize the industry and build a carbon-free society and economy. The book goes beyond technology overviews, rather it aims to provide a system level blueprint for decarbonization. It can be a reference book and textbook for graduate students, researchers, practitioners, consultants and policy makers, and it will provide practical guidance for stakeholders to analyse and implement decarbonization measures in their professions. Abstract (sommario):
This chapter examines the source or “grounding” of ethical duties. Some believe that for professional ethics, the professional association (in the case of pharmacy in the United States, the American Pharmacists Association) is the source, but, at most, the professional group seems to be only the place where ethical duties of pharmacists are identified, and even that claim is controversial. Others claim the source is the orders of the physician or other prescriber of therapy, the hospital’s policy, the patient’s values, or religious or philosophical traditions. This chapter presents cases raising these issues dealing with compounding lethal agents for the execution of criminals, dispensing a potentially lethal opiate, honoring a terminally ill patient’s wishes to refuse an antibiotic, medication errors, an employer’s exclusion of an infertility drug from insurance coverage, and the pharmacist’s right to refuse to dispense oral contraceptives that violate his religious beliefs.

Abstract (sommario):
This chapter comments on Article 98 of the Rome Statute of the International Criminal Court. Article 98 emerged in the context of the debate on grounds to refuse surrender and assistance. The Rome Statute has the potential to conflict with other obligations of States under international law, whether pursuant to customary international law or treaty. In particular, they are required to respect the immunities of diplomats and international officials. States that allow military activity by foreign troops on their territory often have agreements, known as ‘status of forces agreements’ (SOFAs). Article 98 governs these conflicts by, in effect, making obligations of arrest and surrender under the Statute subordinate to other legal norms.

Abstract (sommario):
This chapter focuses on the special challenges of ethical problems in mental health and behavioral health settings. The basic elements of informed consent, the special problems with decisional capacity, and the right to refuse treatment are examined in the light of mental health practice. The controversy that results from various understandings and meanings of the cause and treatment of mental illness are explored. Pharmacological and medical therapies such as electroconvulsive therapy and aversive therapy are discussed, with a focus on the parties who are in a position to judge the risks and benefits of such therapies. The interests of third parties are also explored as justification for overriding a patient’s autonomy because of potential serious harm to others.

Abstract (sommario):
This chapter provides a rationale for training family members of individuals with borderline personality disorder (BPD) to help them develop into therapeutic allies and treatment adjuncts. It also describes the experiences of family members in finding help for their loved ones with BPD and the family psychoeducation programs currently available for BPD and other disorders. By default, families often are the only alternative available to handle crisis situations since some individuals with BPD refuse to participate in therapy, have dropped out of therapy, or appropriate BPD services are not available in their communities. With an understanding of BPD, social support, and appropriate training, families can potentially develop as adjuncts and that can help improve treatment outcome

Abstract (sommario):
Because of their focus on psychopathology, mental health clinicians may overlook the potential significance of medical illness as a risk factor for suicide. In this chapter, the author presents evidence that physical illness, particularly certain physical illnesses, can be independent risk factors for suicide. In a number of these illnesses, depression is clearly a confounding risk factor, while in others the illness itself or its consequent functional impairments may lead to increased risk. When an individual has multiple physical illnesses, as often happens with the elderly, the cumulative burden can become overwhelming and heighten the risk of suicide. When physical illness becomes terminal, the competent patient has the right to refuse life-sustaining treatment. Whether that individual can receive assistance in dying has been more controversial. The chapter concludes with a presentation of data from a state where assisted suicide, also known as assisted death, has been legalized.

Abstract (sommario):
The consultation liaison psychiatrist frequently encounters questions of decision-making capacity for hospitalized geriatric patients. This trend will only continue as the population ages and questions about the ability of aging patients to make medical decisions and broader life decisions arise more and more frequently. Consultation liaison psychiatrists tasked with determining these capacities may be faced with a duality of roles: responsibility to the patient but also protective obligations imposed by laws and regulations. Consultation liaison psychiatrists should engage these evaluations carefully and be forthright with patients. An approach focusing on the nature and cause of incapacity, the potential for reversibility of incapacity, adequately informing the patient, relying on colleagues in occupational and physical therapy as well as speech and language pathology for functional assessment, and understanding the patient’s life history and story can lead to results respectful of both the patient’s well-being and dignity. This chapter presents forensic issues relevant to the geriatric psychiatry consultation-liaison service through an illustrative clinical vignette.

Sarah, Ganz. IV Trust Arbitration as a Matter of International Law, 21 Enforcement of Foreign Arbitral Awards Arising from an Internal Trust Arbitration: Issues Under the New York Convention. Oxford University Press, 2016. http://dx.doi.org/10.1093/law/9780198759829.003.0021.

Abstract (sommario):
The Convention on the Recognition and Enforcement of Foreign Arbitral Awards, commonly referred to as the New York Convention (Convention), makes the enforcement of foreign arbitral awards in Contracting States generally much easier than the enforcement of foreign judgments by, inter alia, imposing a presumptive obligation to enforce arbitral awards subject to only a limited number of grounds on which enforcement may be refused. This chapter looks at the different grounds that allow a domestic court to refuse enforcement under the Convention and analyzes the problems that a party trying to enforce a trust award could potentially face. It begins by examining the scope of the Convention under Article I(3), focusing on whether a trust can be characterised as being ‘commercial in nature’. It then considers the grounds for refusal of enforcement under Article V(1) of the Convention, focusing on issues of invalidity (such as consent and form requirements) and incapacity as well as lack of proper notice and representation. Lastly, the chapter examines whether the doctrines of non-arbitrability and public policy, as applied in the place of enforcement, may render an award unenforceable under Article V(2) of the Convention.
