The foundation behind the concept of restorative justice is part of an approach that focuses on situations where in order to create justice and even balance the perpetrators who commit criminal acts, and also for the rights of victims. Procedures and procedures as well as criminal proceedings that lead to the principle of criminalization are changed to a process of family conversation and mediation in order to create an agreement and to resolve the criminal case which leads to crime and will be equal for the victim and the perpetrator of the crime The concept of restorative justice in itself has a meaning where justice will be repaired, and restoration here has a broader meaning to what is known in conventional criminal justice processes or in general that has been applicable so far with the existence of restitution or commonly referred to as compensation for victims. This restorative justiche concept, if included in a system in juvenile criminal justice, is considered well for its application, because restorative justiche is useful in order to prevent children from facing the criminal system and will be replaced in the guidance pattern for the child.

Objective: This study delves further into the application of restorative justice to the problems faced by young people in Indonesia who have been exposed to terrorism. Restorative justice is advocated as a feasible approach for addressing this complex issue because of its focus on restoration and readjustment. Methods: This subject is affected by legal norms and philosophy. The constraints of restorative justice and the necessity for stakeholder engagement limit its potential advantages in combating juvenile terrorism. Results: This research shows that restorative justice is part of a broader approach to prevent youth radicalization, including effective education, quick intervention, and support for at-risk families and communities. This research also emphasizes the necessity for legal, educational, family, and community involvement with teen terrorists. Restorative justice programs work best when they are part of a larger plan that identifies at-risk individuals, intervenes on their behalf, and supports their families and communities, according to the research. Conclusion: This research examines restorative justice for Indonesian teenage terrorists. Restorative justice's emphasis on rehabilitation and reintegration makes it useful for rehabilitating teen terrorists. The idea allows victims and community members a say in decisions.

Penyelidikan ini adalah kebijakan yang diterapkan untuk memaksimalkan penyelesaian kasus pencurian ringan melalui landasan hukum, hambatan, dan pendekatan keadilan restoratif di Wilayah Hukum Medan-Porestabes. Berdasarkan penyidikan, tindak pidana pencurian ringan yang diterapkan dalam restorative justice adalah tindak pidana pencurian ringan dengan kerugian tidak lebih dari Rp, menurut Perma 2 tahun 2012. 2.500.000 (dua juta lima ratus ribu rupiah). Dalam penerapan restorative justice harus terpenuhinya syarat materil dan formil. Syarat utama dalam pelaksanaan restoratif Keadilan restoratif dalam menyelesaikan pengaduan adalah keinginan pelaku untuk mengakui kesalahaannya dan kesediaan korban untuk memaafkan pelaku. Hambatan dalam menerapkan restorative justice pada penyelesaian tindak pidana pencurian dipengaruhi oleh sistem hukum yang belum mengatur tentang restorative justice dalam penyelesaian tindak pidana, termasuk pencurian ringan. Kebijakan dalam memaksimalkan penerapan restorative justice, antara lain dengan mengatur restoratif justice dalam RUU-KUHP dan RUU KUHAP dan meningkatkan profesionalisme aparat penegak hukum. Selain juga memberikan pemahaman bagi korban bahwa inti dari restorative justice adalah pemaafan terhadap pelaku, bukanlah besarnya jumlah ganti kerugian. Demikian pula terhadap pelaku, bahwa pelaksanaan restorative justice merupakan bentuk tanggung jawab pelaku atas kesalahannya, bukanlah upaya menghindar dari proses peradilan pidana.

Permasalahan menerapkan restorative justice terhadap kasus lingkungan menjadi persoalan yuridis terkait apakah semua tindak pidana lingkungan dapat diselesaikan secara restoratif, model restoratif yang cocok dan akibat hukumnya terhadap status kasus sedang ditangani penegak hukum. Tulisan ini bertujuan menemukan model restorative justice yang dapat diterapkan terhadap tindak pidana lingkungan dan untuk menentukan akibat hukum penerapan restorative justice terhadap status perkara tindak pidana lingkungan. Metode penelitian menggunakan pendekatan yuridis normatif dengan data sekunder dan studi kepustakaan serta menggunakan teknik analisis data secara kualtatif. Model Restorative Justice yang dimungkinkan dapat diterapkan dalam penegakan hukum pidana untuk menanggulangi tindak pidana lingkungan hidup adalah model Pertemuan Restoratif (Restorative Conferencing), sebuah model yang membutuhkan partisipasi dari pelaku (individu/korporasi), korban (masyarakat dan lingkungan), mediator, penyidik Polri dan PPNS secara sukarela untuk mencari kesepakatan perdamaian. Penerapan restorative justice dengan model pertemuan restoratif (Restorative Conferencing), menimbulkan akibat hukum terhadap status perkara tindak pidana lingkungan berupa penghentian penyidikan untuk menghindari sanksi pidana dan mengurangi penumpukan perkara melalui diskresi penegak hukum sepanjang memenuhi syarat materil dan formil yang diatur dalam Surat Edaran Kapolri No 8 Tahun 2018 Tentang Pedoman Penanganan Penyelesaian Perkara dengan Pendekatan Restorative Justice.

Keadilan restoratif merupakan konsep yang populer di seluruh dunia, termasuk Indonesia. Selama ini konsep keadilan restoratif dikenal sebagai penyelesaian di luar pengadilan, dan hanya diterapkan terhadap peradilan anak ( juvenile ) dan tindak pidana ringan. Permasalahan yang diangkat dalam penelitian ini adalah bagaimana perkembangan dan pengaturan keadilan restoratif dalam hukum HAM internasional dan bagaimana urgensi rekonseptualisasi dan legislasi keadilan restoratif dalam sistem peradilan di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, history , perbandingan, dan filosofis. Kesimpulan yang diperoleh adalah bahwa hukum HAM internasional telah memberikan prinsip standar minimum bahwa penerapan keadilan restoratif tidak hanya untuk kasus juvenile , tetapi juga untuk pelanggaran HAM berat, serta tindak pidana biasa yang tidak terbatas tindak pidana ringan. Perkembangan lain adalah dikenalnya hybrid keadilan restoratif. Sangat urgen bagi Indonesia untuk merekonseptualisasi dan melegislasikan keadilan restoratif secara komprehensif dalam sistem perundang-undangan Indonesia karena keadilan restoratif banyak memberikan manfaat; legislasi akan menghapuskan atau mengurangi hambatan sistematis penerapan keadilan restoratif; memberikan legal inducement , menyediakan panduan pelaksanaan, struktur dan pengawasan program restoratif, serta menjamin perlindungan hak pelaku dan korban yang berpartisipasi dalam restorative programs . Saran penelitian ini adalah segera dilakukan rekonseptualisasi dan penglegislasian keadilan restoratif supaya tidak hanya menjadi wacana tetapi dapat diterapkan dalam kasus konkret.<p>Restorative justice has been popular in the world including Indonesia. Generally, restorative justice known as criminal justice outside the court; applied for juvenile and misdemeanor. Issues raised were how development and arrangement of restorative justice in international human right and how the urgency legislation reconceptualization and restorative justice legislation in the judicial system of Indonesia. Research methods are juridical normative with statute, historical, comparison and philosophy approach. The conclusion is that International human right law has given minimum standard principles, that the application of restorative justice is not only for juvenile cases, but also for gross human rights violations, as well as ordinary criminal offenses are not limited misdemeanor. Another development is the known of hybrid restorative justice. Urgently for reconceptualizing and legislating of comprehensive restorative justice in the Indonesian law system as restorative justice provides many benefits; l egislation would eliminate or reduce barriers to systematic implementation of restorative justice; provide legal inducement, providing practical guidance and oversight structures restorative programs, and ensure the protection of rights of perpetrators and victims participating in restorative program. Suggestion of this research is to be done reconceptualization and legislating that restorative justice is not just a discourse, but can be applied in concrete cases.</p>

Abstract The study aims to determine effect forgiveness and Fear of Crime toward Restorative Justice judgment. The study involved 110 subjects. Collecting data used Restorative Justice Scale, Transgression-Related Interpersonal Motivations Scale-18 (TRIM-18), and Fear of Crime scale. The results showed that there are significant effect of forgiveness and fear of crime simultaneously toward restorative justice. At the partial analysis show that forgiveness has positive effect toward restorative justice, otherwise fear of crime has a negative influence toward restorative justice.Key word: forgeviness, fear of crime, restorative justice.   AbstrakPenelitian ini bertujuan untuk mengetahui pengaruh pemaafan dan ketakutan pada kejahatan terhadap penilaian keadilan restoratif. Penelitian ini melibatkan 110 subjek. Pengumpulan data menggunakan Skala Keadilan Restoratif, Motivasi Interpersonal Terkait-Motivasi Skala-18 (TRIM-18), dan Skala Takut pada kejahatan. Hasil penelitian menunjukkan bahwa ada efek signifikan dari pemaafan dan ketakutan terhadap kejahatan secara bersamaan terhadap keadilan restoratif. Pada analisis parsial menunjukkan bahwa pengampunan memiliki efek positif terhadap keadilan restoratif, jika tidak takut kejahatan memiliki pengaruh negatif terhadap keadilan restoratif. The nominal sovereignty that the indigenous tribes exercise in the US is further constrained by the federal government exercising the powers of trustee and restricting their rights of alienation over lands. The plenary authority of Congress allows the enactment of all laws impacting on Indians that the federal government deems necessary. It is of overriding effect and has led to the emergence of a land law theory that preserves the power of preemption over the tribal nations. This legal framework dates back to the Marshall doctrine and the Indian Trade and Intercourse Act 1790. The issue is: can there be a reversal of the extinguished title for the indigenous peoples and an assertion of their original claim to rightful ownership? This article compares the land theory that prevails in the US with the developments that have taken place in common law countries, such as Canada and Australia, and concludes that there needs to be an affirmation of the principle of a right in land for the Native people rather than them being ‘tenants at will’ of the federal government.

As the popularity of restorative procedures increases, it is important to reflect on what we do and do not know about restorative justice, in order to enhance the effectiveness of restorative practices. In particular, we know little about the mechanisms that encourage success in restorative procedures. This article reviews research examining how, why, and for whom restorative procedures work. We consider how restorative processes differ from more traditional forms of retributive justice, and review the empirical research on factors driving people's perceptions of and responses to restorative justice. Through this overview of the existing knowledge base regarding why and for whom restorative procedures work, we draw attention to gaps in the restorative justice literature. We highlight the need for more focused research in understudied areas—in particular, we discuss the need for further development of experimental methods in restorative justice research—which will enable restorative justice scholars to develop more effective procedures that complement existing legal processes.

Abstracts: This study raises the issue of the process of restorative justice in crimes committed by children at the Bengkulu City Police and the perspective of Islamic law on the application of restorative justice to juvenile crimes. To answer this problem, empirical juridical research was used with direct interviews with investigators on the protection of women and children (PPA) at the Bengkulu City Police. After the data can then be analyzed based on normative descriptive analysis. The results of the study show that: (1) The process of implementing restorative justice for crimes committed by children at the Bengkulu City Police can be carried out in 2 ways; (a) restorative justice can be carried out outside the police office. (b) Restorative justice can be carried out at the police office. (2) The application of restorative justice to juvenile crimes in the perspective of Islamic law prioritizes peace or forgiveness through mediation, reconciliation between perpetrators, victims, law enforcers and the wider community directly participating in solving problems. Islamic law is aligned in law enforcement against children who are in conflict with the law.Keywords: Restorative Justice and Child Crime Abstrak : Penulisan menjelaskan tentang proses restoratif justice pada tindak pidana yang dilakukan anak di Polresta Kota Bengkulu dalam perspektif hukum Islam. Untuk menjawab permasalahan ini digunakan penelitian yuridis empiris dengan wawancara secara langsung kepada penyidik perlindungan perempuan dan anak (PPA) pada Polresta Kota Bengkulu. Hasil penelitian menunjukan bahwa: (1) Proses pelaksanaan restoratif justice pada tindak pidana yang dilakukan anak di Polresta Kota Bengkulu dapat dilakukan 2 cara; (a) restorative justice dapat dilakukan di luar. (b) Restorative justice dapat dilakukan di kantor kepolisian. (2) Penerapan restoratif justice terhadap tindak pidana anak dalam perspektif hukum Islam lebih mendepankan perdamaian atau pemaafan dengan mediasi, rekonsliasi antara pelaku, korban, para penegak hukum dan masyarakat luas ikut secara langsung berpartisipasi dalam menyelsaikan permasalahan. Restorative justice (keadilan restorative) berakar dari nilai-nilai tradisional dalam masyarakat tradisional seperti nilai keseimbangan, harmonisasi serta kedamaian dalam masyarakat. Oleh karena itu di beberapa negara tercatat bahwa lembaga peradilan adat tetap dipertahankan sebagai sarana bagi masyarakat untuk menyelesaikan sengketa atau permasalahan yang dialaminya termasuk di dalamnya perkara pidana agar pelaku, korban dan masyarakat serta tokoh masyarakat dirasakan lebih memberikan rasa keadilan masyarakat. Tujuan dan manfaat kegiatan pengabdian kepada masyarakat ini adalah sebagai berikut: 1) untuk memberikan pemahaman konsep restorative justice (keadilan restoratif) kepada organisasi kepemudaan, 2) untuk menggerakan tokoh organisasi kepemudaan agar berperan sebagai penengah (mediator) dalam penyelesaian sengketa di luar pengadilan. Metode pelaksanaan kegiatan literasi restoratif justice (keadilan restoratif) kepada Organisasi Kepemudaan dalam bentuk diskusi interaktif. Berdasarkan kegiatan ang telah dilakukan dapat diambil kesimpulan antara lain sebagai berikut: pertama, Para peserta sangat antusias dalam setiap materi yang diberikan, karena berhubungan langsung dengan persoalan di lapangan terkait dengan penyelesaian sengketa melalui restorative justice (keadilan restoratif). kedua Para peserta mulai memahami peran tokoh pemuda dalam penyelesaian melalui restorative justice (keadilan restoratif). Adapun saran yang ingin diberikan tim pelaksana kegiatan pengabdian kepada masyarakat ini adalan agar penyelesaian sengketa di luar pengadilan lebih optimal, maka sebaiknya perlu dilibatkan tokoh masyarakat terutama tokoh pemuda dalam proses penyelesaian sengketa melalui pendekatan restorative justice (keadilan restoratif).

Abstrak
Keadilan Restorative adalah teori keadilan yang mengutamakan pada pemulihan kerugian yang disebabkan oleh perbuatan pidana. Pendekatan keadilan Restoratif memfokuskan kepada kebutuhan baik korban maupun pelaku kejahatan. Tujuan dalam penulisan ini adalah menganalisa keadilan restorative dalam tindak pidana penggelapan. Pendekatan yang digunakan dalam kajian ini adalah dengan menggunakan pendekatan normatif,dimana bahan-bahan pustaka dan undang-undang menjadi sumber utama.Hasil penelitian ini menunjukan bahwa konsep pendekatan restorative justice sebagai alternatif penyelesaian tindak pidana segera diterapkan di Indonesia sebagai upaya pembaharuan hukum. Hal ini dikarenakan restorative justice merupakan suatu pendekatan yang lebih menitik-beratkan pada kondisi terciptanya keadilan dan keseimbangan antara pelaku tindak pidana dengan korban. Munculnya konsep keadilan restoratif bukan berarti meniadakan pidana penjara, dalam perkara-perkara tertentu yang menimbulkan kerugian dan kerusakan, maka pidana penjara masih dapat dipergunakan. Konsep dari keadilan restoratif yang berfungsi sebagai ekselerator dari asas peradiilan sederhana, cepat dan biaya ringan, sehingga dapat terpenuhinya kepastian hukum dan keadilan bagi masyarakat.

Abstract
Restorative justice is a theory of justice that prioritizes the recovery of losses caused by criminal acts. Restorative justice approaches focus on the needs of both victims and perpetrators of crime. The purpose of this paper is to analyze restorative justice in the crime of embezzlement. The approach used in this study is to use a normative approach, where library materials and laws are the main sources. The results of this study indicate that the concept of a restorative justice approach as an alternative to criminal acts is immediately applied in Indonesia as an effort to reform the law. This is because restorative justice is an approach that focuses more on the conditions for creating justice and a balance between the perpetrators of crimes and the victims. The emergence of the concept of restorative justice does not mean abolishing imprisonment, in certain cases that cause loss and damage, imprisonment can still be used. Indeed, showing justice is not easy for judges but to date in its development appears restorative justice that provides justice for all parties. Its future existence and response are interesting to be criticized. Based on this, the purpose of this study is to examine the paradigm of restorative justice in making legal decisions of judges on legal cases and the construction of the judges’ decisions which are paradigmatic in Restorative Justice. This research uses normative legal research with four types of approaches, which are case approach, legislative approach, conceptual approach, historical approach, and comparative approach. The results of the study show the restorative justice paradigm prioritizing restoration or amelioration will seek to provide justice, certainty and usefulness of the law, as well as realize progressive and responsive laws, and this makes it appropriate to be used as a judge’s paradigm in deciding a case. In constructing restorative justice-based judges’ decisions, judges do only make decisions based on the Criminal Procedure Code (KUHAP), but substantially, through the restorative justice paradigm the judges will consider justice for all parties (victims, perpetrators of crime, and the public). Rumusan masalah dalam ini adalah bagaimana pengaturan pelaksanaan Restorative Justice terhadap anak sebagai pelaku tindak pidana, bagaimana implementasi Restorative Justice sebagai perlindungan terhadap anak sebagai pelaku tindak pidana, bagaimana hambatan pelaksanaan Restorative Justice dalam pelaksanaan peradilan anak di Indonesia. Hasil penelitian menunjukkan bahwa hambatan dalam penerapan restoratif justice terhadap anak sebagai pelaku tindak pidana kekerasan adalah masih sangat terbatasnya baik sarana fisik bangunan tempat pelaksanaan restorative justice, maupun non fisik yaitu belum tersedianya tenaga-tenaga professional seperti dokter, psikolog, tenaga instruktur ketrampilan dan tenaga pendidik di berbagai tempat dimana anak di tempatkan selama dalam penanganan proses hukum.

Restorative justice ini dapat dipahami sebagai upaya penyelesaian tindak pidana secara alternatif yang tidak melibatkan aspek penal atau penghukuman. Mekanisme ini diterapkan kepada pelaku tindak pidana yang baru melakukan tindak pidana pertama kali karena “terpaksa” oleh keadaan yang dihadapinya. Maka, restorative justice ini tidak berlaku terhadap tindak pidana lain yang berpotensi merugikan warga masyarakat dan negara. Hal ini telah diuraikan dalam dua peraturan yang sampai saat ini digunakan sebagai landasan hukum dalam implementasi restorative justice yaitu: (1) Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif; dan (2) Peraturan Kejaksaan Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif. Implementasi restorative justice ini diyakini dapat menurunkan laju kriminalitas di masyarakat seiring pelaku mendapatkan kesempatan kedua setelah menyadari kesalahan yang dilakukan dan melakukan ganti rugi terhadap korban dalam proses mediasi yang dilakukan. The work conceptually analyzed the principle of restorative justice and appraised the provisions for the principle of restorative justice in the Administration of Criminal Justice Act of 2015. The paradigm shift from retributive to restoration justice as provided by the Administration of Criminal Justice Act of 2015 and the laudable consequences arising therefrom was underscored. To achieve the set goals the paper discussed the Nigerian Criminal Justice System, Restorative Justice in Perspective, the Innovative Provisions of the ACJA 2015 on Restorative Justice and New Direction for Criminal Justice in Nigeria. It concluded with a call on other States of the Federation to emulate the Federal Government in re-couching their criminal justice system on the principle of restorative justice.

This research aims to understand how theft cases are resolved using the restorative justice approach in court. This study combines normative and empirical research methods. Subsequently, the collected data were analyzed qualitatively to describe the problem and address the research purposes. The results show that resolving theft cases with a restorative justice approach in court offers a new paradigm that not only focuses on applying retributive justice but prioritizes the processes of restoration and reconciliation between the Accused and the Victim. Through the implementation of Supreme Court Regulation Number 1 of 2024, the stages of case resolution with restorative justice from trial preparation to creating a restorative agreement ensure that the justice pursued is restorative. The effectiveness of this approach depends on the Victim’s willingness to forgive the Accused, the restoration of losses suffered by the Victim, and the Accused’s status as a non-recidivist. Therefore, it is recommended that Judges proactively facilitate dialogue between the Accused and the Victim and ensure that the restorative agreement adheres to the principles of proportionality and substantive justice. Public Prosecutors should more actively identify cases suitable for restorative resolution and prepare proof and physical evidence carefully to support the mediation process. The Accused and the Victim are encouraged to participate openly and honestly in mediation. In particular, The Victim needs encouragement to state their losses and needs clearly, and to consider the option of reconciliation as a step towards recovery. Finally, the community is expected better to understand the benefits and processes of restorative justice, thereby providing broader support for a criminal justice system oriented not only towards delivering retributive justice but also towards restoration and repairing social relationships in the future.

Konsep Restorative Justice ini ramai diperbincangkan dalam ranah lingkup hukum pidana di Indonesia, namun jauh sebelum itu hukum Islam telah mengatur dan mengimplementasikan mengenai konsep tersebut dalam bentuk Qisas dan pembayaran uang diat. Penelitian ini menggunakan pendekatan deskriptif dan pendekatan komparatif. Dari kedua konsep dari restorative justice tersebut dapat diketahui apa saja perbedaan persamaannya. Retributive justice-focused law enforcement against criminals can be ineffective. Convictions tend to be useless since victims' losses, damages, and injuries are overlooked. To overcome this, criminal case settlement led to restorative justice. Several law enforcement authorities, including the Police, Attorney General's Office, and Supreme Court, have adopted internal regulations on restorative justice-based penal mediation. Restorative justice settlements are currently limited to select circumstances, and the worth of losses that can be remedied through restorative justice mediation is limited. In Indonesia's criminal justice system, it's difficult to implement a restorative justice-based penal mediation method. No concrete criminal procedural statute binds law enforcement officers to bring cases to mediation, hence the restorative justice-based penal mediation method cannot be administered with legal certainty. Keadilan restoratif merupakan proses penyelesaian perkara pidana dengan menggunakan pendekatan keadilan dan kesempatan memperoleh pemulihan kepada korban akibat perbuatan pidana yang dilakukan oleh pelaku. Sering kali, sistem peradilan pidana mengesampingkan hak-hak korban yang menderita dan dirugikan. Oleh sebab itu, hadirlah konsep baru sebagai teori kritis akan filosofis pemidanaan yang dikenal dengan restorative justice. Penelitian ini mempergunakan jenis penelitian hukum atas dasar pendekatan penelitian yuridis-normatif dimana diperoleh dengan studi kepustakaan. Di Indonesia, keadilan berbasis restoratif bermula dari sistem peradilan pidana anak yang dimanifestasikan dalam konsep diversi. Namun, peradilan pidana umum belum memuat pelaksanaan dari paham baru pemidanaan tersebut. Meskipun telah ditemukan pelbagai peraturan yang merujuk pada realisasi keadilan restoratif. Justru memicu kendala-kendala dalam proses penegakan hukum pidana yang kian memuncak. Peraturan tersebut juga tidak memberikan implikasi yang signifikan guna memperlancar proses legalitas dengan membentuk undang-undang mengenai restorative justice. Dimana bertujuan untuk membentuk legitimasi hukum bagi masyarakat luas dalam mereformasi sistem peradilan pidana yang tidak relevan di jaman sekarang. Oleh sebab itu, diperlukan urgensi perumusan undang-undang induk sebagai payung hukum pelaksanaan restorative justice secara konkrit dengan mengedepankan keadilan dan kepastian hukum.

Abstract
Restorative justice is the process of solving criminal cases using a justice approach and the opportunity to obtain recovery for victims due to criminal acts committed by perpetrators. Many times, the criminal justice system overrides the rights of both suffering and aggrieved victims. Therefore, there is a new concept as a critical theory of the philosophy of punishment known as restorative justice. This research uses a type of legal research on the basis of a juridical-normative research approach which is obtained by literature study. In Indonesia, restorative-based justice starts from the juvenile criminal justice system which is manifested in the concept of diversion. However, the general criminal court has not yet contained the implementation of the new definition of punishment. Although various regulations have been found that refer to the realisation of restorative justice. It actually triggers obstacles in the criminal law enforcement process that are increasingly mounting. The regulation also does not have significant implications to expedite the legality process by forming a law on restorative justice. Where it aims to form legal legitimacy for the wider community in reforming the criminal justice system that is irrelevant today. Therefore, the urgency of formulating the master law as a legal umbrella for the implementation of restorative justice is needed concretely by prioritising justice and legal certainty.

The article uses as a framework two key issues. First, whether restorative justice should be defined primarily in terms of the process to be used or the outcomes to be achieved. Secondly, attention will be drawn to the lack of clarity in defining restoration. This article proposes a list of irreducible core values of restorative justice and contends that agreement about these will best advance the theoretical debate, assist the appraisal of restorative justice in practice and prioritise the restoration of victims and the fair treatment of offenders.

Penerapan prinsip keadialan restoratif oleh Kejaksaan dengan mengeluarkan Peraturan Kejaksaan Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif. Dengan adanya Perja 15 Tahun 2020 terebut maka kewenangan penuntut umum lebih mengedepankan prinsip keadilan restoratif terutama untuk melakukan proses penghentin penuntutan (menutup perkara demi kepentingan hukum). Seperti diketahui semula Pasal 14 Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana mengatur beberapa kewenangan penuntut umum. Lahirnya Keadilan Restoratif karena keadaan Indonesia pada masa lalu. Pendekatan yang dipakai dalam penelitian ini yaitu jenis penelitian hukum sosiologi (yuridis empiris) bertujuan menganalis permasalahan dengan memadukan bahan-bahan hukum (yang merupakan data sekunder) dengan data primer yang diperoleh dilapangan. Adapun kesimpulan Penelitian Penelitian ini adalah, bahwa : Penerapan restorative justice di Kejaksaan Negeri Deli Serdang pada dasarnya telah sesuai dengan Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020. Namun demikian, sampai saat ini Kejaksaan Negeri Deli Serdang hanya berhasil melaksanakan mekanisme penyelesaian perkara di luar pengadilan. Beberapa kendala yang dihadapi oleh Kejaksaan Negeri Deli Serdang dalam menerapkan restorative justice meliputi; persoalan struktur pelaksana restorative justice yang kurang siap melaksanakan mekanisme tersebut; Masalah fasilitas dan sarana berkaitan dengan berkas yang dibutuhkan untuk menunjang terealisasinya restorative justice ; Partisipasi masyarakat juga masih sangat minim dalam restorative justice yang diakibatkan kurangnya pemahaman masyarakat akan pentingnya menerapkan mekanisme dan budaya hukum masyarakat yang kebanyakan masih belum dapat menerima penyelesaian dengan restorative justice.

Kejaksaan Negeri Binjai yang telah menerapkan restoraitive justice terhadap tindak pidana pencurian ringan yaitu pemberhentian penuntutan perkara Pasal 362 KUHP yang dilakukan oleh terdakwa dengan inisial MF. Tujuan penelitian ini untuk mengetahui pengaturan hukum mengenai restorative justice dalam penyelesaian perkara tindak pidana pencurian ringan, untuk mengetahui penerapan restorative justice dalam penyelesaian perkara tindak pidana pencurian ringan di Kejaksaan Negeri Binjai, dan untuk mengetahui hambatan bagi Kejaksaan Negeri Binjai dalam penerapan restorative justice penyelesaian perkara tindak pidana pencurian ringan. Penelitian yang dilakukan adalah penelitian hukum normatif dengan pendekatan yuridis empiris yang diambil dari data primer dengan melakukan wawancara dan didukung data sekunder dengan mengelolah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa pengaturan hukum mengenai restorative justice dalam penyelesaian perkara tindak pidana pencurian ringan adalah Perma Nomor 2 Tahun 2012 tentang Penyesuaian Batasan Tindak Pidana Ringan, Undang-undang Sistem Peradilan Pidana Anak Nomor 11 Tahun 2012 Pasal 5 Ayat (1) wajib mengutamakan keadilan restoratif Surat Edaran Kepolisian Nomor SE/8/VII/2018 tentang Penerapan Keadilan Restoratif (Restorative Justice) Dalam Penyelesaian Tindak Pidana dan Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif.

Restorative Justice is the restoration, compensation, and repayment of a part of the relationship between the victims and perpetrators, as well as the society regarding the prosperity or conciliation in criminal justice system. Specifically, this book focuses on the steps involved in implementing Restorative Justice and social justice responses for criminal victims in Indonesia. This book also presents empirical data that shows how Restorative Justice has been used in legal practice by several countries, how victims and perpetrators respond to a new perspective on the legal system through the resolution of Restorative Justice, and how far this can be used effectively to create a standard of punishment and compensation based on fair and balanced treatment of victims and perpetrators.

Restorative justice merupakan bentuk penyelesaian alternatif dari pemenjaraan, dikarenakan memberikan kesempatan kepada Korban dan Pelaku untuk menyelesaikan konflik tanpa meninggalkan rasa dendam. Artikel ini mengakaji praktek pelaksanaan dan hambatan penggunaan restorative justice dalam penyelesaian perkara tindak pidana ringan di wilayah hukum Kepolisian Resor Brebes. Data dalam artikel ini menggunakan data primer yang didapatkan dari interview dengan Penyidik Kepolisian Resor Brebes yang dilakukan di tahun 2018 dan data sekunder berupa referensi yang berkaitan dengan restorative justice dan tindak pidana ringan. Pelaksanaan restorative justice dalam penyelesaian tindak pidana ringan di wilayah hukum Polres Brebes, prosedur pelaksanaan restorative justice yang dilakukan Polres Brebes telah sesuai peraturan, dasar hukum peraturan Kepolisian dalam melaksanakan restorative justices Surat edaran Kapolri Nomor: SE/8/VII/2018 tentang pelaksanaan restorative justice dalam penyelesaian perkara pidana, terkait dengan dasar hukum pelaksanaan restorative justice dalam penyelesaian perkara tindak pidana ringan di wilayah hukum Polres Brebes belum bekerja secara maksimal karena ada beberapa faktor dan indikator yang tidak terpenuhi yaitu lembaga pembuat peraturan dan pemangku peran. Hambatan-hambatan yang mempengaruhi pelaksanaan restorative justice antara lain faktor yaitu budaya hukum, kurangnya pemahaman dari para pihak terkait, terutama korban, masyarakat dan pelaku yang terlibat dalam tindak pidana ringan di wilayah hukum Polres Brebes, sehingga masyarakat cenderung tidak menerima kembali seseorang yang telah melakukan tindak pidana.

Restorative justice is an alternative disciplinary approach to the traditional, punitive approach to discipline. The present study has done justice to the researcher’sexpectation to be a path breaking one in the region of Swat, KP-Pakistan for initiation Restorative justice, first as a class based intervention, and then to be offered after enrichment, a whole school programme.Despite its increasing recognition and use in Swat, Primary schools, a limited amount of research has evaluated the effect of restorative justice (RJ) for Primary schools and its impact, and response. To date, there is no standardized method for restorative justice implementation. The inherent qualities such as disciplining the students intrinsically, reducing the misconducts ranging from small cheating to causing wounds or loss to others, inducting students in peer mediation, and organizing Restorative justice mediation/conferencing for achieving reparation and restoration of relationships, and converting the entire institution as a place of social healing are shown to be a viability with Restorative justice. The present study enjoys the credit of successfully testing 78% of the Restorative justice practice in the primary schools. The reduction of misconducts in students and increase in their psychological capitals is a laudable performance of the Restorative justice in the maiden run for its approval and consideration.

Praktek penegakan hukum pidana sering kali mendengar istilah Restorative Justice, atau Restorasi Justice yang dalam terjemahan bahasa Indonesia disebut dengan istilah keadilan restorative. keadilan restoratif atau Restorative Justice mengandung pengertian yaitu: "suatu pemulihan hubungan dan penebusan kesalahan yang ingin dilakukan oleh pelaku tindak pidana (keluarganya) terhadap korban tindak pidana tersebut (keluarganya) (upaya perdamaian) di luar pengadilan dengan maksud dan tujuan agar permasalahan hukum yang timbul akibat terjadinya perbuatan pidana tersebut dapat diselesaikan dengan baik dengan tercapainya persetujuan dan kesepakatan diantara para pihak. Penelitian ini menggunakan metode penelitian yuridis normatif. penelitian hukum normatif ini dilakukan secara diskriptif kualitatif, yaitu materi atau bahanbahan hukum tersebut dikumpulkan, dipilah-pilah untuk selanjutnya dipelajari dan dianalisis muatannya, sehingga dapat diketahui taraf sinkronisasinya, kelayakan norma, dan pengajuan gagasan-gagasan normatif baru. Pendekatan Restorative justice memfokuskan kepada kebutuhan baik korban maupun pelaku kejahatan. Di samping itu, pendekatan Restorative Justice (Keadilan Restoratif) membantu para pelaku kejahatan untuk menghindari kejahatan lainnya pada masa yang akan datang.

This article aims to examine restorative justice (RJ) practices in China’s youth justice system, seeking to make contributions to the global effort of operationalising the notion. It begins with an outline of the Chinese youth justice system. Following a brief literature review on RJ movements in China, it moves on to introduce the current programmes in the country’s youth justice practices, including those similar to the Western notion of RJ and those recognised as RJ only in China, and the legal mechanisms facilitating the development of restorative justice. It concludes that China is in its own way translating the critical values of RJ theory into its youth justice system, leaning towards a better one for juveniles. The development of restorative justice and criminal justice as a whole in China is a work in progress. Local variations and timeframe for development should be permissible in its legal reform.

<p><em>Restorative Justice </em>merupakan penyelesaian perkara tindak pidana dengan melibatkan pelaku, korban, keluarga pelaku/korban, dan pihak lain yang terkait untuk bersama-sama mencari penyelesaian yang adil dengan menekankan pemulihan kembali pada keadaan semula, dan bukan pembalasan. <em>Restorative Justice</em> sebenarnya memiliki posisi yang strategis sebagai suatu sarana dalam mempertahankan hak-hak anak yang berkonflik dengan hukum. Namun yang menjadi kendala adalah bagaimana <em>Restorative Justice</em> itu tidak dapat berjalan secara efisien bila diterapkan bukan dengan cara yang benar. Penelitian ini dilakukan bertujuan untuk mengetahui sinkronisasi/harmonisasi formulasi ide Restorative Justice di berbagai peraturan perundang-undangan anak di Indonesia, baik yang berlaku sekarang ini (<em>ius constitutum</em>) maupun di masa mendatang (<em>ius constituendum</em>). Dengan menggunakan metode Yuridis Normatif dalam arti luas, penelitian ini tidak hanya sebatas melihat secara logis/ sistematis dalam keseluruhan perangkat norma melainkan juga mencakup latar belakang filosofis, sosiologis, historis, komparatif, dari implementasi ide <em>restorative justice </em>itu sendiri. Tidak sebatas implementasi dalam formulasi ketentuan peraturan perundang-undangan saja, bagaimana ketentuan-ketentuan tersebut dilaksanakan dalam masyarakat juga perlu diperhatikan dalam mencapai suatu keadilan restoratif bagi anak.</p><p><em>Restorative Justice is a settlement of criminal cases involving perpetrators, victims, families of perpetrators / victims, and other concerned parties to jointly seek a fair settlement by emphasizing restoration back to its original state, rather than retaliation. Restorative Justice actually has a strategic position as a means of defending the rights of children in conflict with the law. But the constraint is how Restorative Justice can not run efficiently </em><em>if</em><em> applied not in the right way. The aim of this research is to find out the synchronization / harmonization of Restorative Justice idea formulation in various laws of child in Indonesia, both current (ius constitutum) and in the future (ius constituendum). By using the Normative Juridical method in a broad sense, this research is not only limited to looking logically / systematically in the whole set of norms but also includes the philosophical, sociological, historical, and comparative background of the implementation of the idea of restorative justice itself. Not only the implementation of the formulation of the provisions of legislation only, how the provisions are implemented in the community also need to be considered in achieving a restorative justice for children.</em></p>
