Cet article propose d’explorer la manière dont les travaux de Colette Guillaumin ont été reçus et lus en France par ses collègues sociologues, entre les années 1970 et aujourd’hui. Leur réception semble d’abord faible, entravée par un puissant nationalisme méthodologique qui imprègne alors les sciences sociales françaises. Ses apports théoriques sont néanmoins partagés dans quelques cercles dont nous éclairerons les acteurs et leurs débats. Cette réception apparaît à la fois lente, fragmentée, et divisée entre des chercheur.e.s en relations interethniques pour qui le racisme n’en constitue qu’une dimension, d’une part, et d’autre part des chercheur.e.s investi.e.s dans la création du champ des études féministes. Ce n’est qu’au cours des années 2000 que ses outils conceptuels ont commencé à circuler plus largement, sous diverses formes, visant souvent l’articulation des rapports sociaux de sexe, de classe et de race.

La présence d’élèves de diverses origines ethniques dans les classes françaises et espagnoles est un fait indéniable. Les deux systèmes éducatifs cherchent à faire face à ce défi grâce aux dispositifs mis en place en prêtant attention à la diversité, mais sont souvent critiqués pour leur inefficacité, voire leur absence. Plusieurs études ont également mis en évidence des difficultés d’intégration scolaire liées à des facteurs comme le cycle scolaire, l’origine ethnique, ou le rôle de la famille. L’objectif de cette étude est d’analyser et de comparer deux collèges à partir du statut d’élèves d’origine étrangère selon des critères de choix et de rejet.

Dans une perspective d’anthropologie historique, l’auteure retrace l’évolution des catégorisations ethnonationales dans l’espace yougoslave au XXe siècle, en rapport avec la fondation des clubs de football locaux, d’après l’étude de cas de Mostar. Au début des années 2000, à l’image de la structure politique de Bosnie-Herzégovine et de l’organisation «dualiste» de Mostar, les deux équipes de la ville cristallisaient l’opposition entre Bosniaques et Croates. L’évolution des clubs et du supportérisme permet d’appréhender la dynamique des identifications ethnonationales et des relations interethniques dans l’espace sud-slave, de la construction des États nations à la transition démocratique à la fin des années 1990.

Dans cet article, les auteurs tentent de présenter systématiquement l’évolution des relations économiques entre la Serbie et la France. Pour cela, les auteurs partent d’une revue de l’histoire des relations économiques, nécessaire à la compréhension du contexte contemporain. La revue historique comprend une analyse des relations économiques entre la Serbie et la France à travers les étapes suivantes : 1. 1878-1918 ; 2. 1918-1939 ; 3. 1945-1991, et 4. 1991-2000. Les tendances contemporaines sont examinées pour la période allant des changements politiques en Serbie en 2000 jusqu’au 2020. L’histoire des relations économiques indique l’importance du niveau de coopération économique pour le caractère des relations politiques globales entre les États. Presque en règle générale, on peut remarquer qu’un niveau plus élevé de coopération économique a entraîné l’amélioration des relations politiques entre les deux pays, et vice versa, et que les années ’90 représentent la période des relations économiques et politiques les plus faibles de l’histoire de relations entre la Serbie et la France. Avec ce niveau de relations économiques, on est entrée en un nouveau millénaire. L’observation de la période postérieure aux années 2000 indique cependant l’amélioration des relations économiques entre les deux pays, observée à travers les relations de commerce extérieur et le mouvement des investissements directs étrangers (IDE). La base de l’amélioration des relations est la libéralisation des relations commerciales entre la Serbie et l’Union européenne (UE) réalisée par la conclusion de l’Accord de stabilisation et d’association (ASA), ainsi que l’arrivée d’entreprises françaises en Serbie, qui a été lancée au début des années 2000 avec l’ouverture de l’économie serbe. Cette évolution est à la base d’attentes optimistes quant à une coopération économique productive entre les deux pays dans les années à venir.

This article describes the creation of the Journalism Studies Network (REJ) between the University of Brasilia and the University of Rennes 1 (Lannion), to which other French-language research centers such as the University of Laval, Quebec, and more recently the Free University of Brussels also joined. Joint research started in 2000 and is still active today in international cooperation involving dozens of teachers and students from different institutions. Periodic meetings are held at different institutions and countries to present and discuss topics related to ongoing research, from epistemological issues to comparative reports on field research.O artigo a seguir trata de remontar às origens da criação da Rede de estudos sobre jornalismo – REJ, entre a Universidade de Brasília e a Universidade de Rennes 1 (Lannion) ao qual vieram se agregar outros centros de pesquisa em língua francesa tais como a Universidade de Laval, Quebec, e mais recentemente a Universidade Livre de Bruxelas. As pesquisas conjuntas, iniciadas a partir de 2000, se mantêm ativas atualmente dentro de um contexto de cooperação internacional que envolve dezenas de professores e alunos de diferentes instituições. Encontros periódicos são realizados em diferentes instituições e países a fim de apresentar e debater temas relativos a pesquisas em andamento, desde questões epistemológicas até relatos comparativos sobre pesquisas de campo.El siguiente artículo se remonta a los orígenes de la creación de la Red de Estudios de Periodismo – REJ –, entre la Universidad de Brasilia y la Universidad de Rennes 1 (Lannion), a la que se agregaron otros centros de investigación en lengua francesa como la Universidad Laval, Quebec, y más recientemente la Universidad Libre de Bruselas. La investigación conjunta iniciada desde 2000 sigue activa en la actualidad en un contexto de cooperación internacional que involucra a docenas de profesores y estudiantes de diferentes instituciones. Se realizan reuniones periódicas en diferentes instituciones y países para presentar y discutir temas relacionados con la investigación en curso, desde cuestiones epistemológicas hasta informes comparativos sobre investigación de campo.

Europeanisation research into social movements has focused on the emergence of political opportunity structures at the supranational level. This paper examines how movement actors are exploiting shifts in domestic opportunity structures caused by EU policy. Empirical evidence is drawn from qualitative interview data and document analysis on high profile anti-incinerator campaigns in France. Surprisingly, European legislation on waste incineration has not significantly influenced domestic opportunities. It is, however, revealed that EU policy on biodiversity proved decisive for understanding shifts in opportunity structures, and ultimately their role in contributing to movement campaigns in France. Several important lessons are discussed for future Europeanisation research into social movements.

Nous utilisons une approche dynamique structurelle pour évaluer l’importance relative de l’économie souterraine en France sur la période 1990-2019. Notre stratégie est fondée sur une analyse systématique des sources potentielles, légales et illégales, de l’économie souterraine. Nous montrons que l’écart entre les taux de croissance de consommation d’électricité et du PIB réel, sont les principaux moteurs de l’économie souterraine. Cependant, les infractions liées à la drogue ou les envois nets de billets à l’étranger ont aussi des effets significatifs sur les activités souterraines, même si leurs effets sont de moindre ampleur. L’économie souterraine reste importante en France, mais, rapporté au PIB, son poids a considérablement baissé dans les années 2000. Enfin, on observe de fortes relations entre l’indicateur d’économie souterraine et dénominations des billets. Ainsi, les tests de concordance montrent une synchronisation forte entre les indicateurs de l’économie souterraine (globale et légale) et les émissions nettes de billets (notamment les émissions nettes totales et les émissions nettes des coupures de 50 et 200 euros). En outre, les indicateurs de l’économie souterraine et de l’activité réelle (PIB réel, travailleurs indépendants) sont synchronisés. Nous observons également des corrélations positives entre les composantes cycliques des émissions nettes totales de billets de banque et des indicateurs estimés de l’économie souterraine. Par ailleurs, il existe des relations de causalité bidirectionnelles entre tous les indices de l’économie souterraine et la demande globale d’espèces. Toutefois, il n’existe qu’une causalité unidirectionnelle entre ces indices et la demande de petites dénominations (5, 10 et 20 euros). Classification JEL: C32, C51, O17

After regaining independence in the early 1990s, the Republic of Azerbaijan signed many international agreements. It also established relations with the European Union. Economic contacts between the partners were revived by the partnership and cooperation agreement’s entry into force in 1999. It assumed political dialogue, assistance in building democracy, cooperation in the sphere of economy and investment. In terms of trade in goods and services, the country have granted each other most-favored-nation clauses in the collection of customs duties and charges, transit clearance, composition and transhipment of goods, payment transfers for purchased goods and services. This has led to increased trade between the European Union and Azerbaijan. The most important trade partners of Azerbaijan in the years 2000-2017 were the following members of the European Union: Italy, France and Germany. The exports were dominated by Germany, France, Italy, the United Kingdom and Spain. The opening of the oil and gas sector to foreign companies has contributed to a significant inflow of foreign direct investment. More than 80% of the incoming investment is in the oil sector and the main activities are focused the construction of new gas and oil pipelines. The leading investors in this group in the years 2000-2013 were the United Kingdom, the Netherlands, Germany, Italy, France and Cyprus.

Cet article suit les prospections de gaz de charbon entreprises par une compagnie junior australienne, Kimberley Oil, dans le Bassin lorrain entre 2000 et 2015. Cette compagnie procède par forages horizontaux dans des couches de charbon naturellement fracturées. Ces développements visent à produire du gaz en France et à réduire les émissions de CO2 liées aux importations gazières. L’article s’inscrit dans le champ de la géologie politique. Il mobilise la notion de « strate » développée par Nigel Clark pour porter un propos de sciences sociales sur les processus de recomposition des sous-sols en contexte de transition. Il étudie l’émergence d’une nouvelle strate (gazière) en tenant compte de l’ensemble des relations qui la constituent et qui sont opérées dans l’incertaine matérialité d’un volume. À travers l’étude de ces relations, il contribue à éclairer la formation de nouvelles segmentations autant géologiques que sociales, et interroge le contenu politique de cette promesse de transition.

Two additional agreements have been concluded on the enforcement of sentences of the International Criminal Tribunal for the former Yugoslavia (ICTY). On 25 February 2000, an agreement was concluded between the Government of the French Republic and the United Nations on the enforcement of sentences of the ICTY. Thus, France thereby became the first permanent member of the Security Council to conclude such an agreement. A month later, on 28 March 2000, another agreement was concluded between the Kingdom of Spain and the United Nations. Both these agreements will enter into force upon notification to the United Nations by the respective states that the necessary national legal requirements have been met. Previously, agreements have been concluded with the following states: Italy, Finland, Norway, Sweden and Austria.

Abstract: This article provides an analysis of the recent legal developments in France in the field of equal treatment and equal opportunity in the workplace. It begins with a survey of the situation prior to 2001, paying special attention to the failures of French law, in particular where the burden of proof and indirect discrimination are concerned. It then proceeds to examine the two statutes enacted in 2001. In an attempt to implement EC Directives 2000/43/EC and 2000/78/EC these statutes provide additional incentives for collective bargaining on sex equality, an extension of the scope of protection against discrimination, a new regime as regards the burden of proof and measures to ensure more effective judicial protection.

Si l’« exceptionnalisme » supposé du cas tunisien, fer de lance de la transition démocratique dans le monde arabe grâce au « dialogue » et aux politiques de « réconciliation », a été déconstruit à juste titre, force est de constater l’existence d’une longue histoire d’alliances entre acteurs politiques antagonistes, dont une partie significative s’est déployée au-delà des frontières nationales. J’interroge ici les conditions de possibilité des alliances anti-régime Ben Ali en France, et les conditions de dépassement des polarisations idéologiques entre les principales forces de l’opposition tunisienne depuis l’indépendance : les militants islamistes et ceux des gauches. En analysant les modalités concrètes et ce que la « distance » fait à ce type d’alliances improbables, je montre en quoi elles sont révélatrices des caractéristiques de l’espace des mobilisations et des rapports de force qui s’y jouent. L’union ne fait pas nécessairement la force face à l’autoritarisme, mais elle révèle les rapports de force dans l’architecture de ces luttes en France.

In 2000, the European Union established three principles that should guide Member State pension systems and their reforms: the financial sustainability of pension systems; adequacy of pensions; and the modernisation of systems. The latter included the achievement of greater gender equality and sought to respond to the significant gender gaps in public pension systems. This article demonstrates how the reforms carried out over the period 2000–2017 have focused on strengthening the financial sustainability of systems but may also have contributed to even greater gender inequality in old age protection. To this end, we examine the major legislative amendments concerning eligibility criteria and entitlement conditions in six countries (Austria, Belgium, France, Germany, Portugal and Spain), as representative of the social insurance scheme.

Mechanisms of city regulation are always complex and affect many areas of society. The concept of regulation itself should take into account both real needs and strategic goals, as well as the possibilities of the tools for its subsequent application. It is obvious that these mechanisms cannot be universal for different territories and political entities, and their functioning requires a developed administrative and legal base. It is worth noting that often local requests are in conflict with global geopolitical tasks, the implementation of which has certain risks and does not guarantee the same success in individual territories. Even in a relatively small area of France, it is difficult to develop equally effective universal regulatory mechanisms. The task of the reform started in the 1980s. in France, there was a process of decentralization of the administrative system in order to develop the most flexible mechanisms of territorial regulation. The changes that followed in the legislation on gradoregulation (Code de l’urbanisme) formed the legal framework of territorial relations, while the direct tools are created in hierarchically coordinated local entities - from region to city. Such a solution is intended to form working mechanisms for regulating the environment with possible consideration of all levels of interests, sometimes overlapping and contradictory. The article discusses the hierarchical system of urban regulation, currently used in France, highlights its strategic objectives, as well as the issues of the direct application of these regulations in practice: • principles for the development of local city regulatory documents and their main characteristics, • composition of town planning documentation, • main tools and features of the application of urban planning documentation. The article also addresses the problems of the functioning of urban planning documentation in the context of complex and controversial issues related to renovation, revalorization of individual territories, and negative public att itudes.

Recompositions familiales et successions patrimoniales en France et au Québec Cet article aborde sous l’angle de l’ethnologie de la parenté les normes juridiques et les usages sociaux de la transmission des biens dans les familles recomposées françaises et québécoises. Il examine les possibilités de reconnaissance juridique des liens électifs et pluriels nés dans les familles recomposées, et les confronte aux usages de la succession au sein des familles françaises et québécoises, à travers les résultats d’une enquête menée en France au début des années 2000 au sein de familles recomposées, et d’une recherche menée à Montréal en 2006 dans plusieurs études notariales. En dépit de la liberté testamentaire régnant au Québec, qui tranche avec le caractère plus contraignant de la législation française, les usages dessinent une valorisation comparable de la transmission des biens comme support de continuation de la personne au sein de sa parenté. Mais la transmission se limite le plus souvent au second conjoint et aux descendants biologiques et légaux. Les beaux-enfants et les relations « choisies » nées des recompositions familiales y sont rarement représentés. Lorsque c’est le cas, c’est la dimension éducative des relations et le souci d’égalité entre « frères et soeurs » qui fonde leur reconnaissance à travers la succession. La législation québécoise, plus ouverte, permet pour sa part à ces relations choisies de s’incarner plus aisément dans la transmission des biens.

La baie de Wissant possède une façade littorale composée d’une côte sableuse encadrée par des falaises rocheuses. Elle est affectée par une érosion importante à l’origine de l’effondrement de la digue de protection de la station balnéaire en 2000 et 2007. Le rythme du recul contemporain de la côte est un des plus importants en France. Depuis le milieu du XIXe siècle, de nombreuses campagnes de fouilles archéologiques ont été conduites à Wissant. Elles ont notamment été menées avec l’objectif de retrouver les vestiges du port médiéval et du Portus Itius de César qui pourrait être situé à Wissant. Les données sur l’occupation humaine et l’évolution du bassin de Wissant montrent que les populations ont entretenu des relations avec la mer depuis le Néolithique. L’occupation a été tantôt favorisée tantôt rendue difficile par les dynamiques littorales. L’étude du site de Wissant s’inscrit donc dans l’appréhension de la relation entre les phénomènes naturels et les faits humains. Elle passe par la synthèse des données historiques, archéologiques et géomorphologiques mises en relation dans une étude géoarchéologique générale de la baie.

The objective is to determine the relationship between the openness of markets and human development in Mexico and France for the period 2000–2019. A comparative analysis is carried out by looking at the effect of migration (measured by the inflow of remittances) and the opening of capital markets and trade on the Human Development Index in both countries. Estimations are based on a Cointegrated Vector Autoregressive model. Results show that Foreign Direct Investments has a positive influence on HDI in both countries, but remittances seem to contribute more to human development, in Mexico, than trade and capital liberalization do.

Leroi-Gourhan et d'Hlne Balfet (1953) et ont t connu un regain d'intrt dans les annes 1990 2000 (Astruc et al. 2004, Giligny and Mry 2010). Ils sont galement fonds sur une tradition des tudes de matriaux cramiques mens en parallle ds les annes 1980 (Constantin and Courtois1980). Le principe de ces travaux est bas sur une approche double : une analyse et description des stigmates et macrotraces de faonnage ainsi que des reconstitutions exprimentales afin de tester les chanes opratoires. Les premires donnes nous permettront une approche trans-culturelle et une reconstitution de l'histoire des mthodes de production des premires cramiques dans le nord de la France. Ils permettent aussi d'apprhender de manires anthropologique les relations entre technique et socit. Abstract : Since about fifteen years, works of reconstruction of the pottery operational sequence of manufacturing were realized on corpuses of the Neolithic of Paris Basin and the North of France. These works were led within the framework of university memoirs or of research programs and are still widely unpublished. They are based on the principles expressed from the 1950s by archaeologists and ethnologists of techniques trained in France by A. Leroi-Gourhan as Hlne Balfet (1953) [1] renewed in the 1990s to 2000 [2; 3]. They also lean on a tradition of the ceramic materials studies led in parallel since the 1980s [4]. The principle of these works bases on a two-pronged approach: an analysis and a description of stigmas and shaping fabric marks and the experimental reconstructions to test the hypotheses of operational sequences. The first data repository will have to allow later a cross-cultural approach and a reconstruction of the history of the production methods of the first potteries in northern France. They also allow to work on the anthropological analysis of the relationship between technique and society.

The reasons that prompted the Albanian exodus were numerous and varied. While if we take a look on its consequences will see that they have a dual nature. Among the positive aspects of exodus we can mention the fact that it helped Albania economically meeting the needs of a considerable part of the population in the moment of political and social crisis transition enabling the survival of many families. On the other hand it had a negative impact not only becouse of spending vital energies of the nation abroad, but also because it led to the formation of a bad opinion about Albanians, opinion spread almost all over Europe, especially where their presence was bigger. For this reason we got to study precisely the image of immigrant in two countries ( Italy and Greece ), where they have the largest flow of migration in 1990-2000. We should note that in recent years in both countryes in Italy and in Greece prevails the same closed mentality against foreigners. Also it is accompanied ( especially in Italy with the malfunctioning of the structure that handles issues of migratory movements, not like in the other states like Germany, England or France where, besides the small number of immigrants, there were laws and better functioning of the state that associated with emigration’s problems. On the other hand we can say that in this period, whether in Greece the fortunes of the Albanian immigrants depended from the relations of the Greek-Albanian state, in Italy they depend mainly on the behavior of immigrants.

The paper deals with the impact of centre-periphery relations on the demographic change in Europe in the 21st century. The reasons why the projections presented by Statistics Netherlands and the Netherlands Interdisciplinary Demographic Institute in 1999 underestimated the future population growth in France, Italy, Spain and UK are analyzed. Current statistics and UN population projections (2012 revision) demonstrate that the idea of the total depopulation coming in Europe, commonly held there over the 20th century, is out of date. In fact, depopulation is far from being total; it is common only in peripheral countries of Europe, not in semi-peripheral and central ones (Germany is an exception). This conclusion is corroborated by the close positive correlation (r=0.754) between per capita GNI and the rate of population increase in 34 European countries between 2000 and 2012. The alarmist perspective of ageing is criticized. It is argued that ageing is often unreasonably blamed for negative effects which, in fact, are caused by other faults of socioeconomic system. So, the recent number of unemployed in Spain (5.7 millions) is four times more than the expected decrease in the number of people aged 20 to 64 between 2010 and 2030 (1.4 millions). The prospective institutional and structural consequences of the post-crisis shifting of immigration flows from Spain to Germany are considered. Given this shifting, the further expansion of the peripheral and semi-peripheral enclaves in German economy seems to be verisimilar. Nevertheless, the centripetal migration maintains, like before, the centre-peripheral differences in Europe. The centre concentrates knowledge-intensive services and attracts the most qualified migrants; semi-periphery receives the less qualified ones; the periphery is the source of labour force for both the centre and the semi-periphery.

In Germany the Law concerning the encouragement to independence, retroactive until 1.1.1999 (BGBL I 2000, 2), changed the rules about social insurance (§ 7 SGB IV) and instituted the obligation of retirement contributions for pseudo-independents (§ 2 Nr. 9 SGB IV), together with an official request for information concerning the statute. In France the ‘Aubry II Law’ struck off the first two paragraphs from the L 120-3 C.trav ‘ancien’ Law, so called ‘Madelin Law’, striking any legal definition of labour. The aim of this article is to show the advantages and disadvantages of both laws by comparing the different criticisms.

Study of French political history for the period of 1789 to 1851 is exceedingly complex. Not only must one possess knowledge of a succession of regimes (with their varying constitutions, institutions, laws, and conventions), one must also grasp the essentials of political traditions such as royalism, republicanism, and liberalism, all of which altered over time, and familiarize oneself with a plethora of groups or sub groups, such as Montagnards and Girondins, authoritarian and Revolutionary Bonapartists, moderate and ultra royalists, that often adjusted their beliefs and positions according to circumstance. Matters become further complicated when one takes foreign relations into account, assessing the impact of France abroad or the role of foreign relations in shaping French domestic politics.

AbstractAt the beginning of the twenty‐first century, the large democracies of Western Europe experienced some of the most prosperous and peaceful decades in human history. Specifically, the United Kingdom, France, Italy and Germany experienced high and stable quality of life, democratic accountability and state capacity between 2000 and 2019, according to the 2022 Berggruen Governance Index. While all four of these countries are among the top performers in the Index, substantial problems lurk beneath the surface. Notably, each failed to capitalise on the low interest rate environment in the decade following the global financial crisis of 2007–2009—albeit in different ways and for different reasons in each country. In particular, low investment in infrastructure and key technologies, the persistence of stubborn regional inequalities, and resulting sluggish GDP growth have prevented the ‘Big Four’ in Western Europe from improving further and future‐proofing their existing gains.

The Minquiers and Écréhous reefs are located in different parts of the Gulf of St Malo between the British island of Jersey and the French mainland. As a part of the Bailiwick of Jersey, they are geographically very close to the international sea border between Jersey and France, and have had a history of disputed sovereignty. Due to their respective geographical locations and histories, the Minquiers and Écréhous are important sites for the field of Island Studies because of their existence as “border islands”. This article offers a study of these reefs in their spatial context of land and sea, discussing contemporary issues, including fishing, environmentalism and tourism, and offering cross perspectives in terms of their political, economic and cultural connections with Jersey and France. They exist in a context of immense spatial change with substantial tidal ebbs and flows, and between mainlands and historically contested maritime terrains. Such a study helps show how the Minquiers and Écréhous occupy an inbetween space (land, sea and nations), which resulted in international agreements in 2000 that confirmed both the maritime boundary separating France and Jersey, and the areas agreed on as common waters for fishing purposes within Jersey’s jurisdiction. In this setting, this paper offers a critical discussion on the nature of “islands inbetween” (including all the Channel Islands), where land and sea are interconnected as a result of nature, politics, historical fishing rights and leisure activities.

Deux principaux types d'échanges sont traités, les aides à l'habitat et les dons financiers. Ces données font apparaître un lien entre, d'une part, les pratiques de corésidence des jeunes et de leurs parents et, d'autre part, celles des personnes âgées et de leurs enfants adultes. Elles montrent également l'importance des transferts économiques entre générations, qui profitent principalement aux jeunes. Le circuit des aides économiques privées entre générations s'établit en sens inverse du circuit des transferts publics organisé par les systèmes de retraites. This interview was carried out in September 2019, via e-mail, with Donald C. Kiraly, Professor at the Johannes Gutenberg-Universität School of Translation, Linguistics and Cultural Studies, located in Mainz, Germany. Donald C. Kiraly studied Political Science at Cleveland State University in Ohio, obtained his M.A. in International Relations at Florida State University, and a Ph.D. at the University of Illinois, in the United States. He was a visiting professor at the Monterey Institute of International Studies in Monterey, California, and from September 2008 to August 2012, he held a visiting professor's position at the Ecole Supérieure d'Interprètes et Traducteurs of the University of Paris III, in France, where he taught French-English, Spanish-English and German-English translation. Among his main works dedicated to translator education are Pathways to translation (1995), Social Constructivist Approach to Translator Education (2000) and Towards Authentic Experiential Learning in Translator Education (2016). Professor Don Kiraly provides several important contributions in the following interview on the topic "evaluation of translations".

Abstract (sommario):

The publication examines the provisions on administrative and economic sanctions of the French Commercial Code and other acts of French legislation. It was concluded that the French experience of regulation of commercial relations is based on complex solutions involving a combination of private-law and public-law regulation. It is substantiated that during the last century the commercial legislation of France was saturated with public legal provisions. The new French Commercial Code of 2000 incorporated a significant number of provisions that are public law, including administrative and criminal sanctions. The presence of provisions in the French Commercial legislation, which by nature of administrative influence on business entities can be recognized as administrative and economic sanctions, is established in many spheres of relations. These sanctions include typical penalties imposed on economic entities for antitrust violations, violations of reporting and other rules of conducting commercial activities, as well as other numerous sanctions of an organizational nature. It is substantiated that the disciplinary responsibility of certain professions in commerce defined in the FCC can be qualified as a type of administrative and economic sanctions relevant to the Ukrainian legal sense. Taking into account the experience of French commercial law, it was concluded that the ideas of reducing the discretion of state bodies when applying sanctions to business to eliminate the risks of corruption and abuse are not confirmed in modern European legislation. It is obvious that this follows from the quite reasonable assumption that the fight against corruption should affect the specific offender, and not destroy the effectiveness of the state's response to offenses, including in the business sphere. Several trends in the legislative regulation of administrative and economic sanctions in France have been identified, including attempts to solve the problems of the ratio of administrative sanctions and criminal penalties on legal entities, the expansion of judges' approaches to the assessment of administrative sanctions imposed on merchants from the point of view of compliance with procedural provisions and respect for human rights. It was concluded that the introduction of criminal liability of legal entities into national law cannot take place without an analysis of the problems caused by relevant institutions in foreign countries, in particular in France.

Internet access providers, online platforms and other intermediaries benefit from a protection against liability claims caused by end-users' illegal or harmful information. This liability limitation is enshrined in the 2000 Directive on Electronic Commerce, a directive considered crucial for a proper functioning of the internal market, the uptake of the information society and the protection of freedom of speech. Throughout the years, the liability protection for online intermediaries seems, however, to have been gradually carved out by case law, particularly on the Member State level. In recent cases, such as C- 236/08, Google France, and C-324/09, L'Oréal, the European Court of Justice has also interpreted relevant EU legislation. Online intermediaries are increasingly forced to monitor the activities of their users if they want to remain shielded from liability. Paradoxically, obliging online intermediaries to monitor the information transmitted or stored by users is forbidden by the same Directive on Electronic Commerce. This article proposes a balanced approach in which the intermediary protection regime can be safeguarded, whilst still protecting the rights of third parties whose rights may be infringed on the internet.

Villes, Régions et Universités : Recherches, Innovations et Territoires., Sous la direction de Hudon, Raymond et Jean-Pierre Augustin,, Les Presses de l'Université Laval, Québec, 2005, 385 p.Ce livre est un compte rendu particulièrement fidèle des deuxièmes Rencontres Champlain-Montaigne entre la ville de Bordeaux en France et celle de Québec au Canada, qui se sont tenues en 2002. Ces rencontres se veulent un forum d'échanges portant sur les relations entre les universités et les partenaires socioéconomiques de leurs espaces régionaux respectifs. Elles ont été établies dans le contexte des relations bilatérales entre ces deux villes qui prévalent depuis leur jumelage en 1962. Depuis 2000, un protocole de coopération a été signé entre l'Université Laval, le Pôle universitaire de Bordeaux, la ville de Québec, la ville de Bordeaux, le Conseil régional de concertation et développement de la région de Québec et le Conseil régional d'Aquitaine. Les premières Rencontres Champlain-Montaigne se sont déroulées à Québec en 2001. Elles avaient déjà pour thème les villes, les régions et les universités et s'intéressaient tout particulièrement aux acteurs et à leurs pratiques. La seconde édition de ces rencontres les inscrit donc dans la durée et confirme l'intérêt pour le même sujet. Ces deuxièmes rencontres abordent toutefois la question du point de vue de la recherche, des innovations et de la dimension territoriale.
