Testo completoSubrogation, a key legal mechanism, allows the insurer, after compensating the insured, to recover the amounts paid from the liable third party. This process is governed by a set of legal provisions, jurisprudence, and practices unique to each legal system. Despite its importance in the daily operations of insurers, subrogation has not been thoroughly analyzed from the perspective of its overall effectiveness in a comprehensive and comparative manner. Although some scholars examine subrogation in general or in relation to the insurer, they typically focus on its conditions of implementation and its effects, without taking the necessary step back to assess its global effectiveness. This gap in the literature can be attributed to the legal community’s reluctance to embrace the very concept of effectiveness in law. However, this hesitation must be overcome. This study investigates the effectiveness of subrogation under French law and within the member states of the Inter-African Conference on Insurance Markets (CIMA) by analyzing legal texts, jurisprudence, and insurers' management practices. The findings indicate that while a solid legal framework exists in both systems, the mechanism’s effectiveness remains limited. In French law, subrogation is more rigorously regulated due to precise legal texts and a liberal, well-established body of jurisprudence. In the CIMA member states, although progress has been made, the legal framework and insurers’ practices still require adjustments to achieve genuine effectiveness. However, in both systems, the complexities of the legal texts, the diversity of jurisprudential interpretations, and insurers' inconsistent management practices hinder the success of subrogation claims. As a result, theoretical and practical reforms are proposed. From a theoretical standpoint, it is recommended to simplify and harmonize the rules governing subrogation, particularly in the CIMA member states, where the legislative framework remains incomplete. From a practical perspective, it is suggested that subrogation management practices be improved in both systems through better coordination among insurers and the implementation of standardized procedures. Ultimately, an optimistic outlook on the future of subrogation mechanisms is advocated, with improvements that would make these mechanisms more effective, equitable, and better suited to the realities of the different legal systems

If the principle of legality is the translation of constitutional state requirements, the liability principle is another way to claim tower state that is not above the laws. As the role of the civil service has increased in a considerable way, it is now abslutely necessary to protect citizens against consequences of this phenomen which is not new. Testo completoThe germination and the evolution of the institution of administrative justice in Africa coincide with the development of the colonial administration. It will be maintained at the time of the accession to international sovereignty, even if its organization will depending on the States : on a side, those which, according to the example of Senegal, have, by preoccupation with the simplification, broken with the french solution of jurisdictional duality ; and other, those whose leader could be the Malagasy Republic, which prefered a solution closer to the preceding system. It is in the last category that is necessary to arrange Gabon anf Cameroon, two neighboring States of central Africa. However, the budgetary weight of the new organization and especially the absence of staff specialized in administrative dispute led in most States setting up a general-purpose Supreme court. The opening of the democratic transition also starts the beginning of the dismantling of this jurisdictional monism, more especially at the tendency is rather is the installation of autonomous administrative jurisdictions. All the excuses testify to the difficulty of the African States of obtaining a system adapted for the regulation of the litigations opposing administration and citizens. In a continent where one aspires more ever to setting-up and the consolidation of the Rule of law, it is not any more opportunity of such institution which would be matter with interrogations. On the other hand, its organization, its integration in a sometimes hostile sociological medium continue to feed doctrinal debates as well as political. Those which incarnate the institution are not in remainder. Thus, the timidity of the administrative judges and his promptitude to import foreign jurisprudence, particularly french, are far from supporting the emergence of a public law which is adapted to the States
