Testo completoPolitical emotions are here conceived as phenomena belonging to the category of passion, as opposed to that of action. In this way, they are distinguished from everything that is usually understood as contributing to action: attitudes, motives, desires, beliefs, judgments or cognitions. They also have no intentionality and for the same reason. Such a causalist conception of political emotions is placed in tension with our practical goal of autonomy. This aim presupposes a concept of a person understood as an agent. It is shown that, to take political emotions into account, practical philosophy must give way to a practical subject also understood as patient. Against moral naturalism, such a conception of political emotions and the practical subject implies positing the existence of non-natural moral facts taking place within institutions. They consist of norms, a species of the gender of rules. The institutionalism defended here is accompanied by a political realism making conflicts with institutions the cause of political emotions. They do not have moral value in themselves but only because they are likely to generate reflection on how to avoid their cause. Institutions, rather than physical or mental causes, are the subject of a politics of emotions. Liberalism can be understood as a case of this kind of politics when it aims to prevent the causes of fear by providing security through the government of institutions. The various attempts to resolve the social question can also be understood as such policies

It’s based on the analysis of the device of the “Experiment”. The student-engineers from the “Institut Catholique des Arts et Métiers” are to organise a 4-month travel project in relation with their personal yearnings. This project can take different forms. First of all, we will account for the context of this device. Then, we will examine the anthropology of Loyola since the “Experiment” is based on his pedagogy. Enlightening this anthropology by current approaches, the questions of the metamorphosis of the subject and the construction of his eticity will be considered. Finally, using a double methodology ie both a structural analysis of interviews and the setting of a writing workshop, we will show to what extend the mix between the writing and the travel leads the “Experiment” to a spiritual exercise of emancipation for the students. The articulation between self training and the role of the Institution - aiming at the emancipation of the subject - will be questioned

Testo completoThe institutional device turns out to be particularly relevant for the treatment of psychotic and autistic children, as demonstrated by the experiences of early childhood educators and psychoanalysts in Europe from the 1920s onwards. We are going to place the modalities of institutional intervention, which allows us to verify this hypothesis, based on the analysis of four different institutional experiences oriented by psychoanalysis. The Freudian and Lacanian doctrine gives the clinician the opportunity to invent and to constantly renew the means to admit and encourage the productions of the psychotic subject, giving them all their place and dignity. A clinical approche of psychosis develops in this way, and results in the transmission of its effects. This allows to consider an application of psychoanalysis in Ecuador, through the study of the parameters for the implementation of an unprecedented clinical device, in order to treat on an institutionnal level children suffering from psychic disorders

Testo completoThis PhD thesis analyses the institutionalization of organizational practices with the psychiatric diagnostic as a field of study. Fundamentally attached to the organization as an empirical object, we will try to answer a research question deeply rooted in it: what are the organizational phenomenons involved in the daily institutionalization of practices? Our work will tackle three mains issues: theoretical, epistemological and empirical.In a first time, we will clarify the concept of organizational practice. If the practice turn is now well engaged in Organization Studies, scholars are still far from a theory that would have given a clear definition of its central concept. We will provide a review of the literature on practice that considers the process of institutionalization as its birth. This will lead to a grid analyzing the multiple institutionalized ways of doing that are practices.In a second time, we will address an epistemological issue. Practices, classical empirical objects in sociology and anthropology, are central elements of the social life that cannot be easily captured through classical theoretical categories. We will have to go further in the concept in order to get out of the epistemological dead-end that the elaboration of a theory of practice is. In fact, it is a theory of practical logic that will be our real project, and precisely, the historical origins of this practice and its daily transmission.In a third time, we will face our field study loaded with these requirements. Behind classical methodological difficulties, it is the restitution of a fine-grained practical understanding produced by several months of immersion that will be challenging. In order to respect the field’s abundance and to not reduce it to a series of observations seen through a theoretical lens, we choose to present a scenarized synthesis that will condense our six-months study into a four-weeks story of a psychiatric department in a teaching hospital. This stylistic solution will allow us to account for a field that always overwhelms our perspective: the institutionalization of organizational practices

The major contribution of della Volpe and of "operaism" indeed includes (while separately, as was the common sign of their respective failures) a glimpse of the ontological significance of the Marxian criticism of the dialectic (for the first) and (for the second) the intrinsic "politicality" of the Law of Value bequeathed by Marx, double movements that Castoriadis reunites entirely in determining the political implications arising from the “linguistic” relativisation of the unitary ontology and, more precisely, the possibility of a radically democratic form of representation ("anonymous collective"), considered in the irreducible element of the social imagination (and of plurality)

Testo completoThe goal of this thesis is to offer a new interpretation of Cornélius Castoriadis' s work which is traditionallv presented as being split into two clearlv distinct moments: on the one hand. The political and militant period of Socialism or Barbarism (1949-1967), and on tin other hand, the philosophical and theoretical period of The imaginary Institution of Society and Crossroads in the Labyrinth (1968- 1997). However, what we endeavour to demonstrate is that, in reality, the political and philosophical dimensions are deeply interwove in Castoriadis's work. Through the analysis of hitherto unpublished philosophical texts written by Castoriadis throughout the 1950s, the first part of the thesis is devoted to emphasizing the antinomies of the contemplative thought which, according to Castoriadis. Are constituent of the traditional philosophy which is unable to take the specificity of the praxis into account. The second part of our work attempts to draw a parallel between the contradictions of the contemplative attitude and those of the traditional revolutionary politics, and to understand the deep reasons which led Castoriadis to break off with Marxism. The third part of the thesis seeks to highlight the originality of Castoriadis's political thought, elaborated following his breaking off with Marxism and which will have consisted of a reflection on the conditions of a genuine democratic society, conceived as an explicit self-institution; through an understanding of the historicity elaborated in keeping with psychoanalysis and the Greek ontology of chaos

Testo completoThe term deficit is currently at the forefront of the de-pathologization and de-psychiatrialization of the child and the adolescent. Institutions, called medical-social, which make deficit the watchword of the support they provide, are taking over from child psychiatry services. This shift of child pathology towards social services is reflected in the Diagnostic and Statistical Manuals of Mental Disorders (DSM). The major clinical structures (childhood schizophrenia, psychosis and autism) have been erased in favor of a concept of deficits in children's intellectual and adaptive capacities, henceforth referred to as neurodevelopmental disorders. However, this generalization of deficits is nothing more than a throwback to the early 19th century - when child psychiatry first saw the light of day with the clinical classification of idiots. The educational-behavioral and neuroscientific methods advocated today are more or less identical to those used two hundred years ago. There's nothing new or original about these approaches, which work to reject child psychiatry and psychoanalysis. In contrast, Freudian and later Lacanian psychoanalysis has always produced new knowledge about the child and its symptoms, taking into account the spirit of the times and the contemporary discourse. As early as the 1970s, Lacan had anticipated the decline of the Clinic and the generalization of the concept of deficit. Today, his latest teaching enables us, like no other practice, to find our bearings and bring out the most singular aspects of a subject

It studies the compliance function, a cornerstone of the compliance control system in place within financial services providers. Through this function, we highlight the ways in which norms are disseminated within practices, a dissemination that contributes to the institutionalisation of legitimate practices, aimed at reducing the reputational risk supported by the activities. We study how compliance officers achieve the deployment of discursive devices, making the transition from generic normative texts to specific practical contexts : such a transition can be said to perform market practices, by framing and making these legitimate. The explanation, which draws on a social-constructionist approach, has been elaborated from a long-lasting participant observation within an equity brokerage house

Testo completoFor several decades, a large number of countries of the South have followed policies of formalization of land rights through public intervention, establishing their argument on objectives of productive investments increase and establishment of social peace. Madagascar constitutes a case study of the implementation of a land rights recording “soft” policy through land certification (2005), envisaged as an alternative to land titles procedures for which the limits were empirically documented. This study is in a perspective of neo-institutional economy while integrating sensibilities from other social sciences (socioeconomics and anthropology). It deals with the influence of the certification introduction on the formal and informal practices of land rights securisation. It combines qualitative and quantitative data collection techniques and analyzes. Qualitative and econometric analyses show that the pursuit of securing land rights is the main determinant for certification process engagement. This engagement is considered independently of the conditions improvement for launching land market, for access to formal credit, or for investment on the land legally secure. The plot characteristics influence as well the decision to certificate as the choice of the plots of land to be certified within land in possession of a household. The relative low demand of certificate is explained more by the local land securisation practices and procedures and by the incompleteness of individuals' bundle of rights on certain plots, than by the costs of the certification procedure. Land certification does not eliminate the existing written local formalisation very standardized and considered justifiable. The local authorities (involved or not in the procedure of certification), and in certain cases their interpretation of the new legal framework, play a role in the preservation of these local land securisation. These results invite us to discuss about the future orientations of the land reform to pursue the effort of land management decentralisation and the development of tools even more adapted to the needs for rural households securisation

Testo completoFaced with current movements known as "deinstitutionalization" and in reference to the proposals of many authors on the failure of "metaframes" and contemporary disorder, this thesis is a study and an exploration of what persists and survives the institution in everyday life in care and social work institutions. Base on the example of institutionalized Foster Care on Babies (nursery), considered as potential and relevant analyzers, we have proposed in this study three different but complementary visions of the institution and of what makes it in and for each one collectively and individually. We propose to think: - The institution-environment - The institution as a group - Institution and institutional values. In each of these variations, we have worked the articulations between subjects and groups, material and psychic realities, individual and collective imaginaries, etc. We have also tried to propose the overtaking of conceptual oppositions in order to promote a reflection upon the articulations and maintain a dialectical reasoning. Starting from a main epistemology based on groups, families and institutions psychoanalysis, we entered into a qualitative clinical research integrating and analyzing the implications of the researcher to/in his study fields. The data collection was carried out in two nurseries during a period of 3 months for each, with an effective presence of two days per week minimum. For each of these fields of study, an original methodological device was designed to combine different sources of data (participative observation of the daily institutional, observation of professional practices in the units of life, observation of institutional meetings, semi-structured individual interviews with professionals from different trades, reading and analysis of institutional documents). The research approach also benefited from the contributions of individual supervision in order to identify and use the researcher's feelings, behaviors and counter- behaviors in order of collecting and analyzing data. In parallel to the two fields of study, this thesis was carried out within the framework of an Industrial Convention of Training by Research (CIFRE) with the National Observatory for the Protection of Childhood (ONPE, formerly Oned). From the analysis of everyday scenes and practices, the results of this work are intended to be complementary contributions to the existing theorizations and conceptualizations, as well as to the field practices already at work. If they are firmly rooted in the specific field of study areas (nurseries and child protection), we believe, however, that the proposals can also shed light on all the medico-social fields

Such is the guiding question of this dissertation, which examines efforts to envision the future at the regional and metropolitan level in France since 1955. When has foresight been used, by whom and for what ? Comparing sixteen exercises held in two cities (Nantes and Lyon) and two regions (Pays de la Loire and Rhône-Alpes), this work demonstrates that visioning is used less to shape the long term future than to govern current political institutions. Combining sociology of institutions with the discursive approach of public policy, this dissertation develops the concept of institution statement. Ephemeral although regularly revived, foresight activities are attempts to define the institution and to build discursive coalitions to support this definition. With such a statement, stakeholders in foresight activities act in pursuit of three goals: to demonstrate the unity of the institution, to justify its utility and to claim its leadership. The dissertation distinguishes four generations of foresight practices, each of which deals with a specific use of the future: to exist in advance through long term planning (1955-1983) ; to develop a need for an institution in spite of reluctance by the local political elite (1983-1995) ; to affirm the strategic vocation of the institution through the formulation of a project (1995-2004) ; and to alleviate growing contradictions in local public policies (2005-2015).This work contributes to revitalizing the study of the institutionalization of regional and metropolitan governments. Rather than studying national reforms and their implementation, it analyses the discursive work of local actors in order to define the role of these new state spaces. It reveals the importance of such statements in holding the institution in spite of spatial and sectorial centrifugal forces

Testo completoThe three essays contained in this thesis aim at filling part of the gap in the literature by empirically exploring specific instances of the importance of institutions for economic performance. The first essay examines how corruption affects productivity in a sample of firms from Eastern Europe and the former Soviet Union. Results indicate that the payment of bribes has, on average, a negative effect on firm level productivity. Moreover, firms in countries with generally poor institutional quality - proxied by greater prevalence of corruption at the country level and a by weak legal framework - see their productivity more negatively affected by the payment of bribes. The second essay examines whether regional institutional conditions have an effect on the exporting behaviour of Russian manufacturers between 1996 and 2001. Results indicate that the quality of the institutional environment, while it is inconsequential for the export decision per se, has a positive effect on the intensity of exporting to more developed foreign markets. The final essay investigates the consequences of dependence on natural resources for institutional quality in a panel of countries worldwide from the late 1990s to the late 2000s. Results point towards a negative association between an export structure dominated by extractive industries and the quality of the institutional environment measured by an indicator of government effectiveness

Testo completoThis research is about the institutionnal entourage of Georges Pompidou during his mandates as a Primer Minister (April 1962-July 1968) and as a President of the French Republic (June 1969-April 2th 1974, when he prematurely died). It focuses on two institutions whose organisation, structure and internal functioning have been empirically shaped : the Prime Minister Cabinet and the Secretary-Generalship of the Presidency. It analyses their long-term evolution and the way Georges Pompidou modified them, from both points of view of rupture and continuity. It interrogates the impact of the gaullist legacy and Pompidou's personal influence regarding the global stabilisation of the Fifth Republic's institutions. This research also aims to depict the history of men and women that worked for Pompidou in its civilian and military cabinets, in Matignon and at the Elysee's Secretary-Generalship between 1962 and 1974. A thorough exploration of their professional background, their profile and career allows us to describe the specificities of this political entourage. Furthermore, it contributes to the understanding of the political and administrative high-level servants during the 1960's and the 1970's. Finally, by analysing the relations between Georges Pompidou and his staff, and between this staff and other political circles, we get onto the sensitive question of influence. This research then tries to assess the influence that the advisors may have exerted on their Prime Minister and President, and on the decision-making process

Studying "social justice at work" means analyzing the principles of autonomy and human dignity through the process of the institutionalization of labour: our subject here is the relationship between social norms, social practices and institutions, and our method is a critical, empirical, and interdisciplinary one. This approach should enable us to address decisive questions which are usually left aside in the theoretical debate between liberalism, marxism, communitarianism and republicanism. Studying "social justice at work" also means studying how social justice challenges the coherence of some of the most robust theories in contemporary political philosophy

Testo completoThis research is based on a study on clinical and institutional practices and focuses on three points; domestic violence (family abuse), trauma, the institution; it is meant to analyse their common point: violence. It is part of the institutional context family abuse. It studies the discourse and practices of institutions confronted with violence. The general hypothesis supports the idea that there is a link between domestic violence and violence within the institution. There are two aspects in this research; one clear specific institution: “Centre Maternel” (Mother Care institution), responsible for the taking into charge of the family so to avoid a child placement procedure and institutions for the protection of children as part of a clinical process. The qualitative analysis of the data relies on the methodology of situations and systematical observation of events and individuals in situation. (Pedinielli, Fernandez, 2007; Marty, 2009). This research raises the questions of violence within the institution itself and its close relationship with the family situation (Ferrant, 2006). It links up with the effects of the de-subjectivation while taking in charge of the family (Houssier, 2006). It questions the place of action seen as a sign of the traumatic experience and the risks incurred in the process of repetition which leads to a gradual loss of significance (Penot, 2001; Bokanowski, 2005). It shows the obvious impact on institutions and its influence on the quality of the taking into charge of the institution. Broadly speaking, it raises the question of the child protection system, underlining its function of exclusivity as regards institutional to the detriment of the network

In the study their two founders, the psychiatrists Basaglia and Tosquelles are compared as well as the relation between psychiatrist and patient and patient and world (as society but also as group of care). The observation is focused on common grounds among different disciplines, psychoanalytic, historical, sociological, philosophical and phenomenological, over a central axis: the relationship between physician and patient outside the logic of closed institutional clinics. The setting of this intellectual encounter of operators, users and patients can only be understood through the concepts that underlie it: the unconscious, the transfer, the impulse. Lastly our “encounter” is, as we'll understand it here, a transferential encounter. It is a network of interpersonal relations that must adapt to each other actor’s singularity and individuality

Testo completoThis thesis focuses on the study of a Shiite Communitarian space: Al Husseiniya. Its interest goes also to the religious, social and political interactions that this space hosts and the actors involved in them. Al Husseiniya is a space specific to the Shi'a practises. The Husseinit majlis, where the Shiites’ Imams are mourned, their biographies are read and commented, is one of those practices. The majlis is generally held for celebrating occasions related to the anniversaries of births and deaths of these Imams. The most important of these occasions is the commemoration of the martyrdom of Imam Al Hussein in Karbala. The Husseinit procession or parade, known as “Mawkib Al 'Aza'” or “Al Mawkib Al Husseini” is the second among the most important Shi'a rituals associated with the Husseiniya. This ceremony is generally held for other sad celebrations. Initially related to the events or Karbala, the most important Markova al ‘Aza is the one organized during the first ten days of Muharram till Ashura (the 10th day of this Month). Our research’s interest goes also to the main actors and stakeholders in Al Husseiniya and the rituals and celebrations it holds and how these actors participate in the creation, financing, animation (or orchestration) of the shi'a rituals. The government, dignitaries and wealthy individuals, associations, and political parties, the management of Awqaf, religious scholars (Ulema) and intellectuals are among those actors. It is also question to identify the position and the status of women in Al Husseiniya and in these practices and celebrations as well. The on site observations, interviews and data analysis helped to highlight the important developments occurred on Al Husseiniya, its architectural forms, position in the city and on the shi'a rituals whether held in or out of this space. Evolutions that were due to the Islamic revolution in Iran combined to the political openness that Bahrain lived since the reign of his last sovereign

Testo completoWithin the educational system, mentors are entrusted with two tasks: teaching, as well as training adults. In a sense, they are expected to act as “model workers”, transmitting official wisdom, and publicizing “good practices”. They are subjected to Background effects, which determine their leeway. Our research was conducted in the context of institutional changes, namely the granting of MAs to trainees for the teaching profession. It highlights the constraints bearing upon mentors, who are expected to maintain standards of excellence. Such standards were inherited from the traditional training schools for primary education (“écoles normales”) as well as the newer teacher training institutions (IUFM), but also underwent significant changes. Primary sources include interviews with mentors as well as direct observation: Training schemes for mentors, training sessions and assessment of trainees, self analysis. This dissertation purports to demonstrate that the granting of a responsibility in training to mentors craving for recognition and distinction leaves them in a double bind. On the one hand they are subjected to institutional injunctions, on the other hand they aspire to professional freedom and autonomy, just as any other teacher. Mentors in fact negotiate their way between official demands and the constraints of practical work. Acknowledging the existence of a “compact” between mentors and their institutional employer is essential to an understanding of this process of negotiation

We seek to expand the focus by underlining the key elements that influence the leadership practice in CoPs, and recommending a promising path for further investigation, which involves the “distributed leadership” theory. Drawing from an extended literature review on the subject of leadership in CoPs, the study proposes that predominant descriptive and conceptual perceptions of the topic should be supplemented by more field observation studies – evidence-based research - to support and validate the theoretical literature. During past three decades, several scholars have extensively studied this concept (CoPs) in a variety of disciplines. However, there have been very few studies of the influence of routines in these communities. The aim of this study is to analyze the notion of routines in CoPs, in light of the literature on distributed leadership theory. Testo completoClosed Tutors Software or CTS are used in classrooms in many schools in mathematics. To analyze their potential role in the school, we have built a model based on the notion of institution, central to the Anthropological Theory of Didactics, defined by us, based on criteria of social reality, legitimacy, stability and specificity. To understand whether CTS can be used as an institution of teaching and learning, each of four software in our study has been fully inspected by an expert whose captures videos allow us some comparisons with the work of students our experiment. The decryption of all data was conducted using a software analysis of behavior, the Observer from Noldus. More specifically, with regard to mathematics learning, we chose to analyze how the four CTS offer numeracy, whether arithmetic, numerical or algebraic. For this, the theoretical framework developed by Houdement and Kuzniak for learning geometry has been extended including the notions of paradigm and workspace. The tests we conducted we have shown that CTS of our study can hardly be used as an autonomous institution of the regular classroom which is the primary institution. But their use can be valued for student learning by creating parallel institutions adapted

Testo completoArchaeological finds have contributed to the enrichment of the messin history since the mid-18th century. At this time, archaeology was a privilege of scholars and findings were merely incidental. Modern archaeology was born in Metz thanks to JB Keune, at the end of the 19th century, at the time of the first German Annexation. For a century there where personalities who marked the research in Metz, which developed as a result of spatial planning works. From a scientific point of view, this research took advantage of the advance of the German research during both First and Second Annexations. Therefore, the case of Metz may or may not have some particularities inherent to the national context. Messin archaeology relied regularly on societies whose members have contributed to the protection of cultural heritage. Metz Museums and their curators played a decisive role for the protection of archaeological remains and for the spreading of knowledge. For one century, analytical methods progressed and allowed historical data to become more accurate. In the 1980s, this evolution ended up in an emergence of an urban archaeology and in standardization of practices. Metz, and therefore its region, is one of the first French cities to adopt such a new policy

It is about an institutional analysis, based on the historic and social embedding of the health. After presenting the specificities of health economics and a history, we will deal with the institutions of private medical practice. The essential features of « supply » are introduced by stressing upon the drawbacks of private medical practice concerning the opportunistic behaviour of private practitioners and the deficiencies in regulation, without ignoring the fact that it is a profession that is suffering and needs recognition. As far as « demand » is concerned, we will stress upon the state of sickness in the economic analysis. Finally, after underlining the problems linked with private medical practice, we will outline proposals with a perspective of developing primary health care. The conclusion will treat the utility factory of private medical practice and it’s future, based upon it’s capability to reform itself

In the first section, we study the major stages of a gradual emancipation process starting in 1848; women gain access to higher education, become active in voluntary associations, obtain the right to vote and achieve official positions in the new deal administration. In the second section, from 1945 to the present, we focus on the fight for equal rights. Women denounce discriminations, demand affirmative action programs, demonstrate for the equal rights amendment. In the third and final section, we assess the current status of american women in the power elites. In spite of major breakthroughs in political and economic fields, there are still many gender and structural barriers to overcome. Inconclusion, we stress the irreversible trend that drives the most highly qualified women to achieve equal status and full partnership with men in power in order to implement strategies which will accompany certain predictable social changes in the american society of the future

In order to do that, we studied the main amendments to the brejnevian 1977 Constitution and the main steps of russian constitutional reforms between 1990 and 1993. This leads us to analyse the causes of political and juridical constitutional crisis between executive and legislative powers in the years 1992-1993, to study the definition of the power separations principle in the Constitution of the Russian Federation of the 12 december 1993 and its application in the elaboration of some articles as well as the influence of foreign constitutions ( french and American ) and of the European Council norms in the preparatory works to the adoption of the 1993 constitution. Testo completoHard news press faces the early beginnings of a deep institutional change through a managerialization process of newsrooms’ and journalistic practices management. Using the new institutionalism theory we assume to scrutinize this change through studying emerging conflicts between institutional logics – and underlying institutional logics – Inside newsrooms. We particularly notice that the strength of the dominant logic (since 1944 in France) – the editorial logic – that traditionally shapes and governs the newsroom and journalistic practices’ management is eroding; thus sometimes the competitive logic – the business logic –appears dominant or a new hybrid logic – combining elements from editorial and business logics – comes up. We have done extensive ethnographic studies inside newsrooms of three French major national newspapers, La Croix, 20 Minutes, and Le Parisien-Aujourd’hui en France (from 2007 to 2009). As a result we offer a first deep description of the characteristics of journalist-managers and analysis of their daily practices, and we show the major role played by these journalist-managers in the managerialization process. We also identify the three major situations that face the French Press groups regarded to managerialization: some newsrooms are still ruled and shaped by the editorial dominant logic; some that face a shift in the dominant logic – from the editorial to the business one; some that experience the attempt to define a hybrid institutional logic that only appears at a proto-institutionalization stage. Our socio-historical analysis of this deep institutional change process that affect the hard news press (from 1944 to 2010) finally invites to consider the evolution of the underlying struggle for power to run the Press firms involving shareholders, managers, and journalists; we assume journalist-managers play and will play the major role in shaping the orientation and content of managerialization process

Testo completoAs mentioned in the title, this research aims at deciphering the organisation and the way of functioning of seigneurial juridictions located in Anjou and Maine at the end of the Middle Ages. After having long being depicted as ineffective, incompetent, biased and even greedy, seigneurial justices have since then undergone a historiographical revision. Law history, which is currently booming, has also given rise to new and original issues that we mean to partially address. Based on an exhaustive research in the archives of judicial practice, the study attempts to approach case and fine records both in a quantitative and qualitative way, while widely addressing the customary law that was in force in these two provinces of the realm of France. This research's goal is also to examine the way the hearing was organised (time and place of justice), the personnel that it required (law practitioners and justice auxiliaries), but also the daily activity of seigneurial courts (civil gracious and contentious justice, but also criminal justice) through the followed procedure, the type of cases that were judged and pronounced condemnations, while attempting to figure out the "models" that are likely to have influenced the carrying out of judicial practice in this region and at this institutional level. Beyond these strictly legal and judicial aspects, the study lastly attempts to outline the profile of the litigants, the way they used justice, and more widely, the place and the role assigned to justice towards the population falling under this juridiction and seigneurial authority

Testo completoAfter the independence, Algeria developed a cultural policy for the overall management of its cultural heritage. An assessment of the former indicated deplorable cultural development conditions which were inherited from the colonial era. A policy of institutionalization of the different aspects of the national heritage was implemented gradually, accompanied by the implementation of important laws. The beginnings of Algerian archeology were characterized by empirical practices that typically arose from the lack of qualified human resources. A special attention was given to the Islamic archeology with regard to the significant delay that occurred in the ancient times. However, the difficulties inherent to the implementation of training, insufficient resources, etc...) have contributed to maintain the development of the heritage sector, unfortunately no to the desired extent. A case study that focuses on two the museums, the archeological museums of Cherchel ; the first site museum is of colonial design and creation and the second one is of an Algerian design. It combines four complementary methodological approaches: an institutional history of the network of organizations tasked with elaborating and implementing the SS’s schooling program, at the center of which stood the SS-Schulungsamt (educational office), that oversaw the work an « educational apparatus » (schulungsapparat) of more than a thousand instructors present at all levels; an analysis of the ideological discourses and teaching methods elaborated by these institutions in their attempts to relay nazi ideology to the rank and file of the SS; the biographies of the men who operated the « educational apparatus », constituting a specific group of perpetrators in the Nazi hierarchy; and an evaluation of the way the SS’s own brand of education impacted those who served in its civil, military or police units. By assessing the nature of the ideological training the SS provided to its members, fruit of the attempt of forging both a new man seeing all fields of life through the lens of Nazi ideology and an homogenous troop of « political soldiers » at the service of the regime, and tracing the evolution of this educational project within the framework of the SS’s growth and transformations, this study seeks to bring a new perspective to the understanding of the mentalities of the men who committed to the cause of the « Third Reich » and fought and murdered in its name

Testo completoIn the Middle Ages, Clerics bearing arms, often bishops, regularly appear. Both priests and secular lords, these men fight for various reasons: to serve the king, for the cause of the Church, or even for their own interests. This is a study of these prelates and of the cultural, legal and social norms that condition their behaviour: noble and military culture, various services owed to the the king, limits brought by canon law. The chosen period begins with the Great Schism (1378) and ends at the dawn of the Lutherian Reform (1517). In France, this time is marked by the omnipresence of war, especially in the first half of the century; prelates often have to take part in these conflicts. On the other hand, the Hundred Years War induce the development of new military institutions, which tend to discharge bishops and abbots from the old feudal obligations. Prelates who engage in warfare are only rarely punished, even the most scandalous ones.At the councils, critics are expressed against them, but they lead to no conclusion. Testo completoThis work tries to identify the issues encountered in the practice of psychiatry, and to propose reference points likely to clarify thinking from an ethical perspective. We initially examined institutional psycho-therapy, an open and humanistic movement of hospitals, and deliberated the topic in light of ethical medical concepts ; in return, we hoped to interpret ethical principles in the field of psychiatry. This approach placed the accent on the experience inherent in the illness, inter-subjectivity and the institutional context. Secondly, a study conducted via semi-directed discussions among 12 hospital psychiatrists revealed that collective practices are not oriented towards the accountability of patients. The third part dealt with two surveys of hospitalized people. A qualitative study explored the perception of seclusion by 30 patients : they predominantly show negative affects and an experience of being deprived of information. Then, a questionnaire survey showed the opinion of 169 patients on the procedure and effects of a hospital stay ; their rating was over-whelmingly favourable. The confrontation of opinions by psychiatrists and hospitalized patients, compared with the three fundamental principles, revealed the primacy of a benevolent dimension, to the exclusion at times of autonomy and non-maleficence. The ethical dimension of care must continue to be queried and re-asserted unceasingly. To this end, we will continue to discuss and interrogate the pertinence of a questioning tool of practices that would validate the patient’s viewpoints
