Abstract (sommario):

The paper elaborates on the term "police powers" from both a theoretical and legal standpoint. Following the introductory section, the second part of the paper offers a semantic analysis of the legal term "police power", whilst the third part deals with the structure of police powers. The fourth part considers general legal characteristics of police powers, whereas the fifth part focuses on demarcation in respect of other related terms. The author concludes that a police power in its nature is a type of power (public law prerogative), and that it differs from other similar terms in sense of its specific characteristics: coercive character, special purpose and necessity of its implementation for the purpose of discharging a police duty (task at hand). The differences between police powers, police measures and actions are not such as to require different legal regimes. If the reason for its use is an unfulfilled duty from an administrative legal relationship, and if its use falls within the limits of such legal relationship, the police power is subject to a legal regime of administrative action; the use of police powers in either criminal cases or cases of misdemeanour entails the procedural actions determined by the relevant procedural law.

Abstract (sommario):

This article considers the deepening of police power in New South Wales (NSW), Australia, criminal law. It analyses the combined effects of four recent criminal law regimes that not only give the NSW Police Force more powers, but also reflect the significant role of institutional police power and the pre-emptive logic of criminal law. We examine: the introduction of serious crime prevention orders; the introduction of public safety orders; investigative detention powers in relation to terrorist acts; and confiscation, forfeiture and search powers, and trespass offences that target protests. Drawing on the work of ‘police power’ theorists, we argue that these new regimes illustrate the centrality of police power to the criminal law rather than a deviation from a putative, ‘normal’ criminal law.

Abstract (sommario):

In the past, police were not a human rights protection agency for the people. It was just a part of the state's power. However, the police have come to realize that they have to change themselves according to social changes. Despite such efforts, however, police and prosecutors have formed a relationship between top and bottom in the investigation. But most of the investigations are handled by police. Therefore, it is a problem that investigative powers are granted to prosecutors. That is, it can be a problem in terms of rapid investigation and the protection of people's human rights. The police have tried to solve these problems. These efforts by the police gave them the right to close the primary investigation. However, it can be a problem to concentrate power on one institution. In the end, if power is concentrated in one institution, the human rights of the people may be violated. Therefore, the National Investigation Headquarters was launched through the revision of the police law. The establishment of the National Investigation Headquarters serves as a control tower for investigations. Nevertheless, it is pointed out that the National Investigation Headquarters needs policy alternatives in various areas, including organization and personnel management. This paper will find out the problems the National Investigation Headquarters has. Then I would like to present a policy direction on this.

Abstract (sommario):

A Likert Scale Attitudinal Survey was distributed to sworn, non-supervisor, police officers at six police departments in the state of California in a department roll-call setting to measure the counterbalance of power, trust, and influence between police managers and police union leaders. The relationship between a police management and police union leadership is critical component in the internal dynamics of the police organization. The results from this study provide evidence that although on average rank and file police officers tend to trust and attribute more power within police organizations to police unions rather than to police managers, an analysis of the survey responses by inferential statistics showed that these differences were not statistically significant. Furthermore, an analysis of the survey results measuring the relationship between the specific leadership bases of power and trust revealed a statistically significant relationship between the perception of trust by rank and file officers and the use of specific bases of power by police managers and police union leaders. In conclusion, the implications for studies of leadership, power, and policing are discussed.

Resumo: Seis dimensões influenciam na decisão pelo uso da força letal, com utilização de arma de fogo em situações de perigo, na complexidade de uma ação policial: 1) perfil do policial; 2) ambiente do confronto; 3) tomada de decisão; 4) reações emocionais; 5) lição aprendida antes e depois do evento; 6) valores e expectativas dos policiais quanto à visão interna e externa sobre enfrentamento armado. Quando uma ação é desencadeada, todas as dimensões citadas influenciam de alguma forma no resultado geral. É o que esta pesquisa se propõe analisar, com o objetivo de contribuir com apontamentos e subsídios psicossociológicos para o currículo relacionado ao uso da força e armas de fogo, no campo da educação policial. A metodologia combina explicação por mecanismos via técnicas etnometodológicas com utilização dos seguintes recursos: pesquisa bibliográfica, observação participante, entrevistas e grupos focais com policiais, iconografia com desenhos de confrontos elaborados por policiais que decidiram pelo uso da força letal Na introdução do trabalho, incluímos a problematização, os dilemas relacionados ao uso da força e a metodologia da pesquisa. O desenvolvimento foi estruturado em seis dimensões analíticas sobre a decisão pelo confronto armado, incluindo eventos que, em muitos episódios, resultaram no derramamento de sangue entre policiais e seus oponentes eventuais. Nas conclusões, apontamos as diversas impressões e reflexões sobre o assunto. Outras dimensões de análise podem existir, porém as seis que elencamos foram as que surgiram ao longo do desafio de quatro anos de pesquisa em educação com ênfase nas ciências sociais.
Abstract: In police action, six dimensions influence the decision to use lethal force, with a firearm in dangerous situations: 1) behavior of the police officer; 2) environment of confrontation; 3) decision making; 4) reactions emotional; 5) the learning before and after; 6) beliefs and expectations of police officers. When an action is triggered, all these dimensions in some way, can influence the overall result. That's what this thesis analyze search, with the aim of contributing to analysis psychosociological for curriculum related to the use of force and firearms, in the field of education. The methodology combines the following features: literature review, participant observation, interviews and focus groups, iconography with drawings prepared by police officers about use of lethal force. In the introduction to the work, include the problem, dilemmas related to the use of force, and research methodology. The development was divided into six analytical dimensions of the decision by the armed confrontation. The conclusions point out the various impressions and thoughts on the subject. Further analysis dimensions may exist, but the six that were those that emerged during the challenge four years of research in education with an emphasis in social sciences.

Makt kan utspela sig på många olika sätt, i varje sammanhang inom varje rum finns någon form av makt. I min studie har jag valt att undersöka makten i mötet mellan ungdomar och polis, utifrån ungdomars berättelser. Ungdomar är vår framtid, det är våra framtida ledare och politiker, det är de som kommer att ta över världen efter oss, därför är det viktigt att vi tar hand om våra ungdomar och att vi skapar en ljus framtid för dem. För att våra ungdomar ska bli välartade måste vi undersöka förhållanden som påverkar dem och deras utveckling av jaget. Därför har jag valt att undersöka makten i mötet mellan dem och polisen då jag anser att mötet påverkar dem och deras framtid. Poliser ingår i vårt rättsväsende, vi ger dem makt och legitimitet för att de ska skydda oss och bekämpa brottsligheten. Alla som har blivit utsatta för någon form av brott upplever det starka behovet av en disciplin som ska bevaka vår rätt och få oss att känna trygghet när vi går ut, trygghet när vi är i våra hem, tryggheten att kunna leva och vara fria. Men hur blir det när vi, den stora majoriteten ger så mycket makt till enstaka individer som ska bevaka vår rätt. Poliser är också mänskliga varelser som kan falla för frestelser och mänskliga reaktioner. Och hur blir det när vi ger poliser makt att hjälpa och skydda våra ungdomar och de istället använder sin makt för att trycka ner och kränka dem. Ja, makt är ett strakt ord som kan ge upphov till många olika konsekvenser.
ABSTRACTPower can be played out in many different ways. In my study I have chosen to investigate the power of the encounter between youth and police, from stories told by youth. In order to help our young people to become functional human beings, we must examine the relations which can affect them and their development of self and therefor I have chosen to explore the power in the meeting between them and the police because I believe that the meeting affects them and their future. Police officers are part of our judicial system we give them power and legitimacy not only to fight crime but also to protect us. Anyone who has been subjected to some form of crime feel a strong need for a discipline that will guard our rights. But what about when we, the great majority give so much power to certain individuals in order to guard our right. What if the individuals that we have given the right to protect us instead missuses this power in order to suppress and abuse? Yes, power is an abstract word that can provide many different consequences. I will try to explore the power in the meeting between young people and the police in this essay by trying to find the answers to these questions.- How does the meeting between youth and police look like?- Which aspects of power are there?- How do young people experience the power of the police?- How is the power played out in the meeting between youths and police?- What are the consequences of the power in the meeting?I have chosen to use phenomenology as theory and focus my remarks on Schutz's work, instead off Husserl's phenomenological philosophy. The method I have used is qualitative research through a deep group interview with five youths and one depth individual interview. The result of my study has shown that police use violence, not only necessary violence that is permissible to use by the law, but also excessive violence, violence that is unjustified. Some police officers use their power to offend and assault young people. After listening to young people's stories about the police, which confirmed the earlier research that has been done, is my conclusion that the power in the encounter between youth and police is abused by the police and that young people find this very negative.

Abstract (sommario):

A configurable, modular, and flexible vehicle model utilizing scalable powertrain components has been developed at the University of Waterloo. The configurable vehicle model is modified to create an anti-idling system for police vehicles, where an additional battery is utilized to reduce the amount of engine idling time. The goal of the design study is to perform modeling and simulation of the anti-idling system from a financial cost point of view, in order to investigate the potential cost and fuel reduction over a conventional system. The cost function includes the total cost of the battery, the equivalent fuel consumption, and the carbon tax over a period of five years. It is concluded that the anti-idling system demonstrated significant fuel and cost reduction compared to one without. Furthermore, it is found that depending on the SOC threshold of the power management logic, the duration of time over which the engine is activated varied in a non-linear fashion. Future works include performing optimization of the power management logic and also investigates the effects of utilizing different battery types and sizes.

Abstract (sommario):

Abstract Decentralized power generating systems, such as micro-gas turbines (MGT) for micro combined heat and power (CHP), can contribute to achieving the global energy and emission targets thanks to features like low emissions, primary energy savings, and fuel flexibility. It can also help increase the share of renewables due to its ability to easily integrate with renewable energy systems. Micro gas turbines, despite being such a promising technology, have achieved very limited market success due to barriers like high investment costs and a lack of supporting policies. The large-scale market penetration of MGT requires clear and strong policy support to achieve widespread adoption. This paper establishes a quantitative model to assess the impact of the policy measures on the long-term market penetration of MGT for the domestic micro-CHP to establish a relationship between policy parameters, economic factors, technological advancements, and the market share of MGT. The work compares five different policy scenarios for the case study of the UK market. The results demonstrate that the usual economic forces are insufficient for MGT to achieve its long-term market growth. Several combinations of direct and indirect policies are to be implemented by the regulatory authorities to promote the commercial growth of the technology. Finally, some insight into policy and decision-making in the UK for micro-CHP is provided, indicating promising policies to pursue.

Abstract The processes used in managing protective system equipment failures in the commercial nuclear power setting are reviewed. We assert that efficacy of protection is governed by maintenance policy that includes system modification, maintenance inter-arrivals as a function of time, and upset inter-arrivals as a function of time; we further assert that such a maintenance policy is the one used in nuclear power plant protective systems. Observations described in this article bear on the impact of time-dependent activities, associated with maintenance policy, as they relate to endogenous and exogenous upset inter-arrival times. We describe why methods evaluating maintenance policy reliant on combinatorial logic, such as Probabilistic Risk Assessment (PRA), fault trees, or event trees, may lead to ineffective maintenance policy decision-making for protective system efficacy, and we show why this is true. Recommendations for maintaining effective protections, and connections to engineering maintenance practice and regulations are made based on the implications that come from our observations. The importance of the issues described is that relationship of design, maintenance, and repair policies must be properly understood and taken into account by process owners, operators, and investors as well as regulators, who manage protections in hazardous processes.

Transition from single core to multicore technology has brought daunting challenge for thermal management of microprocessor chips. The issue of power dissipation in next generation chip will be far more critical as further transition from multicore to many-core processors is soon to be expected. It is very important to obtain uniform on-chip thermal profile with low peak temperature for improved performance and reliability of many-core processors. In this paper, a proactive thermal management technique called ‘power multiplexing’ is explored for many-core processors. Power multiplexing involves redistribution of locations of power dissipating cores at regular time intervals to obtain uniform thermal profile with low peak temperature. Three different migration policies namely random, cyclic and global coolest replace have been employed for power multiplexing and their efficacy in reducing the peak temperature and thermal gradient on chip is investigated. A comparative study of these policies has been performed enlisting their limits and advantages from the thermal and implementation perspective considering important relevant parameters such as migration frequency. For a given migration frequency, global coolest replace policy is found to be the most effective among the three policies considered as this policy leads to 10 °C reduction in peak temperature and 20 °C reduction in maximum spatial temperature difference on a 256 core chip. Proximity of active cores or power configuration on chip is characterized by a parameter ‘proximity index’ which emerges as an important parameter to represent the spatial power distribution on a chip. Global coolest replace policy optimizes the power map on chip taking care of not only the proximity of active cores but also the finite-size effect of chip and the 3D system of electronic package leading to almost uniform thermal profile on chip with lower average temperature.

On March 26, 2004, a six-year-old boy ran into an automatic revolving door when it was about to close. The door caught the boy’s head and killed him. The accident immediately caught the attention of mass media, police, government, and the people. Amidst all the opinions and talks about how dangerous these automatic revolving doors are and how safety measures should be installed, we organized a group of volunteers to analyze the dynamics of the accident to measure the forces, door velocity, acceleration, and if available, the driving current and voltage of the motors. The group not only studied the same door that caused the fatal accident but it also ran the same series of tests on a smaller size power-assisted revolving door, an automatic sliding door, an elevator door, a building shutter, a commuter train door, a bullet train door, an automatic sliding door on an automobile, and its power window. With the safety mechanisms disabled, we measured an impact force of 548kgf on a dummy head of a 3-year old when it was jammed between the revolving door edge and the door frame. The human scull of a child crushes at only 100kgf and our results show that in addition to this large automatic revolving door, the smaller size power-assisted revolving door, the shutter, and manually closing automobile doors generate forces that exceed this limit. These doors inherit the danger of causing fatal accidents.

The paper introduces four kinds of new combustion ways, namely reverse combustion, open fire counter burning, double layers and two-way combustion, forward and reverse combustion, to solve the environmental pollution of manual coal-fired oven in China from the aspect of the combustion technology. And it also designs the environment-friendly structure of the manual oven with the forward and reverse staged combustion and exchange filter via the coal seam staged combustion and exchange filtration technology on the basis of the forward and reverse combustion ways, and proposes specific measures from the prospective of policy, which have provided new technology to solve the environmental pollution of the manual coal-fired oven.

This article aims to assess the efficiency of the Bank of Albania’s monetary policy in attaining its goals of price stability and economic expansion. Price stability is essential for ensuring a favorable business environment, preserving the purchasing power of the currency, and reducing uncertainty in the economy. The analysis takes into account the unique characteristics and challenges faced by the Albanian economy. This article offers insights into the effectiveness of the monetary policy framework in Albania by assessing the primary instruments and tactics used by the BoA, including interest rates, reserve requirements, and open market operations. It also investigates how external influences affect the efficacy of monetary policy and makes suggestions for improvement. This paper concludes with suggestions for boosting the Albanian monetary policy’s efficacy. It recommends actions to strengthen the transmission mechanism, improve data quality and availability, enhance coordination between monetary and fiscal policies, and boost the institutional capability of the central bank. It also stresses how crucial it is to have a consistent and well-defined policy framework. In the end, this article provides recommendations for enhancing the effectiveness of the Albanian monetary policy. It suggests measures to strengthen the transmission mechanism, improve data quality and availability, enhance coordination between monetary and fiscal policies, and increase the central bank’s institutional capacity. Additionally, it emphasizes the importance of maintaining a stable and predictable policy framework.

Local elections are often contested on the grounds of public safety, but do elected officials have any power to curb crime? Black mayors have particular interest in the issue because Black communities are victimized by high levels of crime and fragile police-community relations. Using data on elections of first-time Black mayors, I find that police forces add more Black officers, a finding that is especially true for mayors with executive authority. Officers arrest 48 fewer potential Black offenders per 10,000 Black residents for crimes where they have the ability to exercise discretion, a finding that is commensurate with the overall reduction in crime. This effect is not visible for similar white arrests. Using changes in the levels of arrests and officers induced by pivotal Black elections, I then estimate the correlation of an additional officer on race-specific arrests. An additional Black officer is related to large reductions in discretionary Black arrests, perhaps suggesting increasing the presence and visibility of Black officers may offer a solution to the “over-policing, under-policing” problem Black communities tend to face.

This paper analyses the dynamics of policy-making among the various political institutions in Brazil. The authors find that the driving force behind policies in Brazil is the strong set of powers given to the President, though several institutions constrain and check this power, in particular the legislature, the judiciary, the public prosecutors, the auditing office, state governors and the Constitution itself. The electorate of Brazil holds the President accountable for economic growth, inflation and unemployment. At least for the past ten years, and particularly during the Lula administration, executive power has been aimed at pushing policy towards macro orthodoxy. Achieving stable macro policies required constitutional amendments as well as considerable legislation. To attain their goals, the past administrations used their property rights over pork to trade for policy changes. The rationale for members of Congress to exchange votes on policy for pork is that the electorates reward or punish members of Congress based on the degree to which pork lands in their district.

Traditionally, labour concerns have not been top-of-mind when considering competition policy, but the current approach to wage-fixing, anti-poaching, and anti-mobility agreements between firms has been one of the main reasons behind recent Parliamentary attention to competition policy and labour markets. Key stakeholders in academic and policy circles have called for more robust enforcement regarding monopsony / oligopsony power in labour markets, when assessing mergers and acquisitions for example, as well as regarding market power in labour representation (unions) and certification as entry barriers in labour markets. The objective here is to identify the numerous challenges and pitfalls in assessing the level of competition on labour markets, both supply and demand, and in addressing remedies if necessary.

The UK’s 2021 Integrated Review of security, defence, development and foreign policy describes Russia as ‘the most acute direct threat to [the UK’s] security’ in the 2020s. Relations did not get this bad overnight: the trend has been negative for nearly two decades. The bilateral political relationship is now broken. Russian policymakers regard the UK as hostile, but also as weaker than Russia: a junior partner of the US and less important than Germany within Europe. The consensus among Russian observers is that Brexit has reduced the UK’s international influence, to Russia’s benefit. The history of UK–Russia relations offers four lessons. First, because the two lack shared values and interests, their relationship is fragile and volatile. Second, adversarial relations are the historical norm. Third, each party exaggerates its importance on the world stage. Fourth, external trends beyond the UK’s control regularly buffet the relationship. These wider trends include the weakening of the Western-centric international order; the rise of populism and opposition to economic globalization; and the global spread of authoritarian forms of governance. A coherent Russia strategy should focus on the protection of UK territory, citizens and institutions; security in the Euro-Atlantic space; international issues such as non-proliferation; economic relations; and people-to-people contacts. The UK should pursue its objectives with the tools of state power, through soft power instruments and through its international partnerships. Despite Brexit, the EU remains an essential security partner for the UK. In advancing its Russia-related interests, the UK should have four operational priorities: rebuilding domestic resilience; concentrating resources on the Euro-Atlantic space; being a trusted ally and partner; and augmenting its soft power. UK decision-makers should be guided by four propositions. In the first place, policy must be based on clear, hard-headed thinking about Russia. Secondly, an adversarial relationship is not in itself contrary to UK interests. Next, Brexit makes it harder for the UK and the EU to deal with Russia. And finally, an effective Russia policy demands a realistic assessment of UK power and influence. The UK is not a ‘pocket superpower’. It is an important but middling power in relative decline. After Brexit, it needs to repair its external reputation and maximize its utility to allies and partners, starting with its European neighbours.
