Abstract (sommario):
Police discretion has been frequently studied in relationship to arrest practices. The present study reconceptualized Shaw and McKay's (1942) social disorganization theory of the causes of delinquency as a theory proposing that police discretion is largely determined by conditions of disorganization. This theory is viewed as more advantageous than conflict theories of police activity because it allows for normative, exchange, and coercive solutions, rather than only the latter as is the case with conflict based theory. To test this theory, individual, structural, and ecological variables were incorporated in the analyses which examined the distribution of type of referral made by the police. Additionally, Black's (1976) proposition that ecological and structural conditions sufficiently explain police behavior was evaluated. Investigation was limited to physical and citation referral. The sample consisted of all referrals of juveniles made during 1984 in Pima County, Arizona. Three regression analyses were performed: (1) individual level characteristics, (2) contextual characteristics only, and, (3) an analysis including both. The results of the first analysis indicated some police bias toward minorities, but the bulk of explanation was attributed to legal variables. The second analysis provided a model that was statistically sufficient to explain police behavior. However, the model indicated that Black's theory requires considerable revision. The last analysis indicated that the bulk of explanation of police behavior was attributable to legal and normative considerations. Few indicators of coercive solutions were located, suggesting that a theory incorporating social disorganization as a determinate of police behavior is superior to a conflict based theory.

As gatekeeper to the criminal justice system the Police Service is placed in a unique position to respond to the problem of domestic violence. The police are a reactive agency that is available 24 hours every day, but the activities, or more appropriately the inactivity, of the police to effectively deal with domestic violence has been the subject of considerable scrutiny over the past 20 years or so. Previous research has tended to centre around the victims and perpetrators of domestic violence and pointed towards a police service that is generally unsympathetic and unhelpful. Whilst considerable advances have been made over recent years and attitudes are changing, there is still the perception, whether right or wrong, that the police stance has not changed sufficiently to make any real difference.

Racial profiling by the police on the nation’s streets and highways has attracted much attention over the past two decades from scholars, media figures, politicians and police administrators. Several highly publicized cases propelled the issue into national consciousness in the early and mid 1990s, bringing a new public awareness to an undoubtedly old problem. Despite the proliferation of research and political attention, many questions remain unanswered. Among the most common criticisms facing racial profiling research today is the literature's lack of theoretical development. Grounded in focal concerns theory and the concept of symbolic assailants, the present research draws upon both crime control and discriminatory frameworks of racial disparity in traffic stop outcomes. The findings suggest that, while police concerns of crime and safety diminish the effect of race/ethnicity and gender on stop outcomes, race and gender remain important predictors of police decisions. The implications are discussed.

This thesis examines the issue of police response to domestic violence. It advances theory on this topic by applying the concept of coercive control to better understand the risk profile of domestic violence that comes to the attention of the police, and police officers’ use of discretion when identifying, recording and responding to domestic violence incidents. The research questions for the thesis are:(1) Can cases of coercive control be identified in national population surveys, and, if so, to what extent is coercive control gendered and more harmful than other forms of domestic violence?, (2) Is coercive control the most common form of domestic violence reported to the police?, (3) What degree of discretion do officers exercise when responding to cases of domestic violence?, and (4) What factors influence police officers’ responses at the scene of incidents of domestic violence? The thesis is structured around four published journal papers. Paper 1 uses national population survey data to show that coercive control is experienced primarily by women, and is more harmful than other forms of domestic violence. Paper 2 uses data from risk assessments to show that coercive control is the most common form of domestic violence that comes to the attention of the police. Using data from force systems, Paper 3 suggests frontline officers retain considerable discretion in relation to identifying and recording cases of domestic violence. Paper 4 uses in-depth interviews with officers alongside case-files to suggest that while officers are now more aware of policies such as presumptive arrest they are prepared to ignore such policies when they believe an incident is not serious; officers’ conceptions of what is serious were primarily incidents that involved physical violence and injury. I conclude that legislation to criminalise coercive control presents an opportunity to change officers’ conceptions of domestic violence and what constitutes threat and risk. I call for a reconceptualisation of the research agenda on domestic violence to focus initially on observational study in order to understand better the factors that influence police response.

Police officers make decisions at the street level in a variety of situations that have direct impact on quality of life, justice in society, and individual freedom. These decisions inherently involve the exercise of discretion, since successfully performed police tasks are linked to the officer's choosing among alternative courses of action. Appropriateness of unsupervised decisions taken under street contingencies remains questionable in terms of police-behavior legitimacy. Law enforcement agencies seek ways to control excessive discretion to avoid undesired consequences of police discretion and maintain organizational legitimacy. Traditionally, organizations developed reward and sanction structures that aimed to shape officer behavior on the street. Recent perspectives, on the other hand, emphasize that it is imperative to manage discretion by employing a value-based approach that requires the agency to encourage subordinates in the exercise of certain behaviors simply because they are believed to be right and proper. This approach depends primarily on beliefs, values, and attitudes of employees rather than external contingencies of environment. Drawing on expectancy and value-based approaches, this study examines the factors affecting patrol officers' discretionary decisions to enforce law in the Turkish National Police (TNP). The reward expectancy concept was derived from the expectancy theory of motivation, which uses extrinsic rewards in structuring discretion. Regarding the value-based approach, public service motivation (PSM) represents the intrinsic motives of officers in this study, while selective enforcement corresponds to the attitudes of officers. Discretionary behaviors of officers on the street were conceptualized as responsiveness, which refers to the degree to which officers are willing to respond to street contingencies.; The study revealed some policy, theoretical, and methodological implications. The findings suggested that the TNP should either completely eliminate the existing reward system or revise it to motivate officers to be responsive. A leadership practice that promotes PSM and discourages selective enforcement was also suggested. Contrary to research that emphasizes the role of extrinsic motivation on police discretion, this study empirically reported that intrinsic motivation has an even stronger effect on officer behavior and needs to be taken into account in future studies. The study contributes to an understanding of police discretionary behavior in the TNP, which has unique characteristics of structure, culture, and law. The limitations of the study in terms of its dependency on officer perceptions and concerns about construct validity were discussed and future research was suggested.; The study tested the mediating role of work effort between reward expectancy/responsiveness and public service motivation/responsiveness relationships. Samples of the study were drawn from uniformed patrol officers in seven provinces of Turkey. A self-administered questionnaire was used to collect data. Responses of 613 patrol officers were analyzed using structural equation modeling (SEM). The study developed four latent constructs and validated their measurement models by using confirmatory factor analysis (CFA). Structural equation modeling was used to investigate causal and confirmatory relationships among latent variables. Findings of the study suggested that reward expectancy did not have a statistically significant relationship to responsiveness. The study did not find a significant association between reward expectancy and work effort of officers. This finding was found to be attributable to the fact that officers do not believe in the fair distribution procedures of rewards and they do not value organizational rewards. Public service motivation of respondents, on the other hand, indicated a strong, positive, and statistically significant relationship with both work effort and responsiveness. These results indicated that intrinsic motives of officers in the TNP are more powerful in explaining officer responsiveness to street contingencies. As hypothesized, officer attitudes toward selective enforcement negatively influenced officer responsiveness, indicating that officers' beliefs and values influence their discretionary behaviors. Among the demographic characteristics of participants, only age of officer indicated a negative significant relationship to responsiveness. This finding suggested that motivation decreases as age increases. Contrary to other findings in the literature, this study found that intensity perceptions of respondents was positively associated with responsiveness.

The current policy in New South Wales of referring to its law enforcement body as Police without reference to the word "force", is testimony to the re-emergence of the concept of community policing. This study deals with this phenomenon and the concept of discretion, which allows police to take action according to the dictates of a given situation rather than always act within the strict letter of the law. While the power of discretion should be used lawfully and ethically, political, legal and social acceptance of such an approach allows a more flexible strategy for coping with issues associated with deviant behaviour and social injustice. Therefore, the study present a holistic approach to a curriculum for police recruits. It deals with the linking of "reactive" and "proactive" policing strategies by means of discretion and in so doing enhances the police officer's ability to make a reasoned judgement in choosing between a number of alternatives according to the dictates of the situation. The proposed curriculum takes account of new policing strategies, students' needs and career aspirations, modem technology, effective teaching methods and the need for recruit training to be attuned to dynamic changes in social needs and demands. The study also emphasises the need for further research into the role of field training officers and the integration of field training with academy education as a vital component in the preparation of a police officer for the complex role ahead.

Public opinion polls have shown the public lacks confidence in U.S. police to use appropriate amounts of force and treat racial minorities fairly, which undermines police legitimacy and the quality of life of all citizens. Although rules have been shown to positively constrain police uses of force, researchers have not demonstrated the effect of rules on racially influenced policing (RIP). In 2005, the RIP directive which prohibits officers from using race as a factor in taking discretionary actions was promulgated in New Jersey. The purpose of this study was to determine through the theoretical lens of Lipsky's street-level bureaucrat theory the influence of the RIP directive on municipal police officer uses of force upon non-Whites. A quantitative nonexperimental retrospective design was used to examine a stratified, proportionate random sample of 301 use of force reporting forms from municipal police agencies in one New Jersey county for a 5-year period before and after the enactment of the RIP directive. A binomial logistic regression indicated that the RIP directive had no influence on the use of force upon non-Whites. Suspect race did not significantly influence force outcomes. Scholarly implications include producing research based upon existing policy to better help inform evidence-based policymaking. Policy implications include police practitioners and policymakers actively monitoring officer uses of force for racial bias and broadening their examination to other issues affecting the problem of trust. Implications for social change include framing the problem within the public policy paradigm to promote political discourse, evidence-based decision making, and improved civilian oversight of the police, which could strengthen trust and police legitimacy.

Perceptual differences in how citizens and police view police-initiated contacts can result in individual and communal tension, mistrust, and social strife, which complicate the relationships needed in order to thrive and promote safe environments. To examine how police officers interpret these contacts, this case study sought to explore the nature of citizen-police relations from the perspective of police officers in a city in the northwest part of the United States. Social contract and procedural justice theories were used to examine the circumstances that officers cited for taking enforcement actions, including operational definitions of police fairness and legitimacy from the Queensland Community Engagement Trial. Data were collected from interviews with 10 officers during police ride-alongs and from departmental data related to officer performance. These data were inductively coded and then analyzed using a naturalistic inquiry approach. Findings suggest that police officers were amenable to creating formal, quasi-contractual agreements between police and citizens based on a shared understanding of how police exercised power and discretion to guide the citizen-police interaction. Participants perceived that, under certain circumstances, explaining police discretion to citizens may decrease the level of community tension police officers experience. These findings support the theoretical constructs of procedural justice and have implications for social contract theory. This type of arrangement encourages positive social change by strengthening the ties with community members, which in turn promotes officer and public safety.

Police officers are allowed considerable discretion within the criminal justice system in addressing illegal behaviors and interpersonal conflicts. Broadly, such resolutions fall into two categories: formal (e.g., arrest) and informal outcomes. Many of these interventions involve persons who have historically faced stigmatization, such as those who have mental disorders, criminal histories, or both (i.e., mentally disordered offenders). On this point, stigma generally includes discriminatory behavior toward the stigmatized person or group and can be substantially influenced by internal and external attributions. In addition, researchers have suggested that internal attributions lead to punishing behaviors and external attributions lead to helping behaviors. The current study examined attributions about offender behavior made by police officers in an effort to evaluate the effectiveness of Corrigan’s model. Specifically, this study investigated the effects of officer attributions on their immediate decisions in addressing intentionally ambiguous and minor offenses. Officers provided one of two vignettes of a hypothetical offender who was either mentally disordered or intoxicated and provided their anticipated resolution of the situation. Encouragingly, disposition decision differed by offender condition, with a substantially higher rate of arrests for the intoxicated offender (i.e., the external condition). Corrigan’s model was initially successful for both offender conditions, but was overall more successful for the mentally disordered condition. Results are discussed within the broader context of police policy, such as crisis intervention training, and identification of officers who could benefit from additional mental health trainings.

This study intends to present a discussion about police power based on the daily police work developed by the police officers of the Military Police of the state of Rio de Janeiro. In order to accomplish this proposal it was fundamental to focus in its constitutional elements, which are: police discretion, the terms of the mandate of the police, control of police work and aspects of both autonomy and subordination of the police force.

Introduction: Policing is a public health issue. The police often encounter vulnerable populations. Police officers have wide discretionary powers, which could impact on how they support vulnerable populations. In encountering vulnerable populations the police officers are required to be professional; maintaining mental health in the face of challenges is part of professionalism. Their encounters with vulnerable populations might influence their mental health which in turn might influence the way they use their discretion when making decisions. Background/context: Sweden receives more unaccompanied, asylum-seeking refugee children than any other country in Europe. The number of asylum applications for such children increased from 400 in 2004 to 7000 in 2014 to over 35,000 in 2015. These children come to Sweden and apply for asylum without being under the care of their parents or other legal guardian. Some are denied asylum. If they do not return to their country of origin voluntarily the police are responsible for their deportation. The Swedish government wants an increasing number of deportations and wants them carried out with dignity. This thesis is about the police officers’ perceptions of how to interpret the seemingly contradictory demands for more deportations, that is, efficiency; and concerns for human rights during the deportation process, that is, dignity. This is conceptualized using three theoretical frameworks: a) street-level bureaucracy, b) job demand-control-social support model and c) coping. These theoretical frameworks indicate the complexity of the issue and function as constructions by means of which understanding can be brought to the police officers’ perceptions of deportation work involving unaccompanied, asylum-seeking refugee children and how such work is associated to their mental health. Aim: The current research aims to investigate and analyse Swedish police officers’ mental health in the context of deportations of unaccompanied, asylum-seeking refugee children. Methods: This thesis uses both qualitative and quantitative methodology. The qualitative approach comprised interviews conducted to achieve a deeper understanding of the phenomenon of police officers’ perceptions of deportations of unaccompanied, asylum-seeking refugee children. The quantitative method involved the use of validated questionnaires to investigate the association between police officers’ mental health and psychosocial job characteristics and coping. This approach made it possible to study a complex issue in a complex environment and to present relevant recommendations. A total of 14 border police officers were interviewed and 714 police officers responded to a survey. Results: The police officers utilize their wide discretionary powers and perceive that they are doing what is best in the situation, trying to listen to the child and to be aware of the child’s needs. Police officers with experience of deportations of unaccompanied, asylum-seeking refugee children were not found to have poorer mental health than police officers with no such experience. Furthermore, high job demand, low decision latitude, low levels of work-related social support, shift work and being single are associated with poor mental health. Coping moderates the association between mental health and the experience of carrying out deportations of unaccompanied, asylum-seeking, refugee children, and the police officers seem to utilize both emotional and problem-solving coping during the same complex deportation process. Implications / conclusions: The general conclusion reached in this thesis is that if police officers are subject to reasonable demands, have high decision latitude, access to work-related social support, and utilize adaptable coping, the deportation work does not seem to affect their mental health. When police officers meet vulnerable people, they utilize their discretionary powers to deal with seemingly contradictory demands, that is, efficiency and dignity. The executive role in the deportations of unaccompanied, asylum-seeking refugee children and the awareness of dealing with a child threatened with deportation might give rise to activation of a sense of protection, safety and security. Discretion might make it possible to act on this sense of protection, safety and security and to combine efficiency and dignity. Further studies, which integrate cognitive and emotional discretion with coping, need to be undertaken.
Introduktion: Polisarbete är i mångt och mycket en folkhälsofråga, något som inte minst blir tydligt i polisers möte med utsatta människor. Poliser har ett stort handlingsutrymme, vilket kan påverka hur de bemöter utsatta människor. I mötet med dessa människor behöver poliserna vara professionella; att ta hand om sin psykiska hälsa när man möts av utmaningar är en del av professionalismen. Att möta utsatta människor kan påverka polisernas psykiska hälsa, som i sin tur kan påverka hur de använder sitt handlingsutrymme när de fattar beslut. Bakgrund: Sverige tar emot fler ensamkommande asylsökande flyktingbarn än något annat land i Europa. Antalet asylansökningar för sådana barn ökade från 400 år 2004 till 7000 år 2014 till över 35 000 år 2015. Dessa barn kommer till Sverige och ansöker om asyl utan sina föräldrar eller annan vårdnadshavare. Somliga av dem nekas asyl. Om de inte återvänder till sitt ursprungsland frivilligt är polisen ansvariga för utvisningen. Den svenska regeringen kräver ett ökande antal verkställigheter av av- och utvisningar samt fastlår att verkställigheterna ska genomföras med respekt för människors värdighet. Denna avhandling handlar om polisers uppfattningar och tolkningar av de till synes motsägelsefulla kraven på att verkställa fler av- och utvisningar, det vill säga effektivitet; och hur man hanterar de mänskliga rättigheterna under utvisningsprocessen, det vill säga värdighet. Detta beskrivs och analyseras med hjälp av tre teoretiska ramverk: a) gräsrotsbyråkrati, b) jobb-krav-kontroll-socialt stödmodellen och c) coping. Dessa teoretiska ramverk visar på arbetsuppgiftens komplexitet och fungerar som utgångspunkt för att skapa förståelse för polisernas uppfattningar av arbetet med att verkställa av- och utvisningar av ensamkommande asylsökande flyktingbarn och hur sådant arbete är associerat med polisernas psykiska hälsa. Syfte: Denna avhandling syftar till att undersöka och analysera svenska polisers psykiska hälsa i relation till av- och utvisningar av ensamkommande asylsökande flyktingbarn. Metod: Både kvalitativ och kvantitativ metod användes i denna avhandling. Det kvalitativa tillvägagångssättet innefattade intervjuer för att uppnå en djupare förståelse för hur poliser uppfattar av- och utvisningar av ensamkommande asylsökande flyktingbarn. Den kvantitativa metoden innebar tillämpning av validerade frågeformulär för att undersöka sambandet mellan polisernas psykiska hälsa och psykosociala jobbkarakteristika samt coping. Detta tillvägagångssätt gjorde det möjligt att studera en komplex fråga i en komplex miljö och att presentera relevanta rekommendationer. Totalt intervjuades 14 gränspoliser och 714 poliser svarade på en enkätundersökning. Resultat: Resultatet visar att poliserna utnyttjar sitt stora handlingsutrymme och uppfattar att de gör det som är bäst i situationen, att de försöker lyssna på barnet och vara medvetna om barnets behov. Poliser med erfarenhet av av- och utvisningar av ensamkommande asylsökande flyktingbarn har inte visat sig ha en sämre psykisk hälsa än poliser utan sådan erfarenhet. Vidare är höga krav och lågt beslutsutrymme på arbetet, låga nivåer av arbetsrelaterat socialt stöd, skiftarbete och singelliv associerat med dålig psykisk hälsa. Coping mildrar effekten på den psykiska hälsan hos de som har erfarenhet av att utföra av- och utvisningar av ensamkommande asylsökande flyktingbarn. Poliserna verkar utnyttja både emotionell och problemlösande coping under en och samma komplexa utvisningsprocess. Slutsats: Den viktigaste slutsatsen i denna avhandling är att om poliser utsätts för rimliga krav, har stort beslutsutrymme, tillgång till arbetsrelaterat socialt stöd och använder sig av anpassningsbar coping, verkar det som att arbetet med av- och utvisningar inte påverkar deras psykiska hälsa. När poliser möter utsatta människor utnyttjar de sitt handlingsutrymme för att hantera de till synes motsägelsefulla kraven, det vill säga effektivitet och värdighet. Den verkställande rollen i av- och utvisningar av ensamkommande asylsökande flyktingbarn och medvetenheten om att hantera ett barn som hotas av utvisning kan ge upphov till en aktivering av känslan att ge skydd, trygghet och säkerhet. Handlingsutrymmet kan göra det möjligt att agera på denna känsla av skydd, trygghet och säkerhet samt att kunna kombinera effektivitet och värdighet. Ytterligare studier, som integrerar kognitivt och känslomässigt handlingsutrymme med coping, behöver emellertid genomföras.

An entire body of administrative law exists to guide the administrative discretion of public administrators. Although an increasing share of public services is being outsourced to the private sector, much of administrative law is not applicable to governments’ contracted agents. Alternatively, contracting agencies use the contract instrument to guide and constrain contractors’ exercise of delegated administrative discretion. This essay reports on a study of selected Florida local governments’ contracts for residential trash collection services. Although minimal discretion was placed in contractors’ hands, it still presented opportunities for abuse. The local governments used a variety of ways to manage the administrative discretion, including the imposition of public service ethics and transparency requirements. Upon analysis of contractual grants of and constraints upon administrative discretion, some suggestions are offered for enhancing contractual management of delegated administrative discretion.

This thesis consists of three essays on optimal monetary policy. In the first essay I study time-consistent monetary policy in an small open economy model with incomplete financial markets. I demonstrate the existence of two discretionary equilibria. The model is capable of explaining periods of different exchange rate volatilities as well as the transition between those regimes. Following a shock the economy can be stabilised either `quickly' or `slow', where both dynamic paths satisfy the conditions of optimality and time-consistency. I also show that a policy of partially targeting the exchange rate results in far worse welfare outcomes relative to a strict inflation targeting policy. In the second essay, I analyse how a policy maker can avoid expectation traps and coordination failures. Using a framework developed by Schaumburg and Tambalotti (2007) and Debortoli and Nunes (2010) in which a policy maker may or may not default on past promises I show that already mild degrees of precommitment are sufficient to generate uniqueness of the Pareto-preferred equilibrium. In the last chapter, I examine optimal monetary policy from an empirical perspective. I estimate a simple small open economy model separately for a policy maker acting under commitment and discretion and find that the data favours the commitment approach. Furthermore, the data suggest that the Bank of Canada did not target the nominal exchange rate in the inspected time period.

This dissertation examines inspector discretion and industry compliance in the street-level implementation of building codes. In particular, this study examines the effects that agency-level, individual-level, and environmental variables have on the choice of inspectors to exercise discretion. Unique to this study is the examination of policy congruence between building departments and street-level inspectors as a predictor of industry compliance with regulatory policy. In addition, the various effects of building department enforcement philosophies, departmental capacity for enforced compliance, and environmental variables are considered. The findings indicate that regulatory policy implementation and impact are complex phenomena. There is no single, best predictor for determining what influences inspector behavior and industry compliance. Rather, this study shows that it is a multiplicity of factors, in concert, that shape regulatory outputs and outcomes. From this dissertation we can learn lessons that can be applied to other policy areas to create a better understanding of inspector discretion, improve industry compliance with regulations, and achieve more effective street-level implementation and understanding of policy impact.

A vast literature acknowledges the corruptibility of regulators; however, empirical tests on the matter have been limited to two-agent models examining the rulemaking process and price regulation of natural monopolies. It remains an open question whether political contributions, by driving legislative pressure, can entice laxity from regulators in their application of the rules. To remedy this issue, I observe the highly-regulated coal mining industry for which there exists several points for inspector discretion. By comparing the outcomes with Congressional coal mining contribution levels, I am able to ascertain capture across several dimensions. Specifically, I find that contributions are associated with agency inspectors using their discretion to preempt violations requiring follow-up inspection, grant more inspections to waive safety requirements, conduct shorter inspections, and grant lower penalties. It is troubling that these findings occur at relatively low levels of contributions, suggesting a high level of corruptibility on the part of regulators.

This dissertation analyzes administrative discretion in public policy implementation in application of a new framework of integrative approach to administrative discretion developed from deficiencies of the citizen participation, representative bureaucracy, and private-interest groups democracy frameworks. The new framework holds that public agencies use discretion to integrate in decision making views of elected authorities, private-interest groups, public-interest groups, and other groups that seek to influence implementation. The No Child Left Behind (NCLB) policy is used as the case study, and the U.S. Department of Education (DOE) is the implementation setting. The dissertation answers the following question: How integrative of group views was DOE’s discretionary decision making in the implementation of NCLB? This research applies a structured content analysis method that consists of content analysis and a content analysis schedule (see Jauch, Osborn, & Martin, 1980). Using a Likert question, the dissertation developed six integration levels of DOE’s discretionary decision making from not at all integrative to extremely integrative and found that most decisions were very integrative.

Wild Dog policy in New South Wales is controversial. There is a clear conflict between wild dog control methods as specified by the policy, and the need to conserve the rapidly diminishing numbers of dingoes in Australian ecosystems. Through an analysis of the types of discretion that National Parks rangers use in their implementation of Wild Dog Policy, this thesis will analyse the way in which discretion can be used as a means of resolving conflict in controversial policy areas. An initial understanding of the background to the complex issue of wild dog management, and the legislation and policies surrounding wild dog control provides substance to theories of discretion. These theories have been applied to the interview data of nine National Parks rangers, and an analysis of their experiences in implementing the controversial policy issue. Fundamentally this thesis finds that the different 'types' of discretion allow rangers to resolve conflict and implement a difficult policy area effectively.

The thesis has two overarching objectives. One is to understand monetary policy in the Czech Republic, Hungary, Poland and Slovakia during 1990s and early 2000s; the other to use these findings to shed light on monetary policy in less developed, but highly open and financially integrated market economies. In order to achieve its aims, it analyses specific factors with significant influence on the conduct or outcomes of monetary policy in these countries; it analyses the transmission mechanism of monetary policy in Central Europe, based on a technique called vector autoregression; and examines use of principal types of constraints on policy discretion, such as central bank independence, exchange rate commitments and domestic targets for monetary policy, in countries of the sample. The thesis finds that strong internal and external pressures, together with frequent bouts of fiscal irresponsibility and sizeable additive and parametric uncertainty regarding the working of the economy, led, in all four countries, to pronounced macroeconomic vulnerability and a need for periodic adjustment to dangerous fiscal and external imbalances. Reaction of policy-makers in countries of the sample to this environment can be characterized as discretion constrained by a strong nominal anchor and real exchange rate considerations. Experience of Central European countries shows that various elements of a commitment by monetary authorities are not duplicatory or contradictory, but interdependent in contributing to the goal of constraining discretion. During the period studied, the two key overall developments in policy were the gradual shift of emphasis from exchange rate targets to domestic targets and (within domestic targets) a shift from monetary targets to inflation targets. This approach has been largely successful.

This dissertation examines the role of military officers as policy implementers by investigating the discretion of Swedish force commanders in the multinational military campaign in Afghanistan between 2006 and 2013. By developing an analytical framework that takes both an outside-in and an inside-out perspective, and that encompasses both the objective implications that structural factors project on force commanders as well as their subjective perceptions of those structural factors, and applying that framework to a range of official documents as well as unique interview data, the thesis describes the discretion that force commanders have had in interpreting, choosing and shaping their mission and concept of operations. The findings show that Swedish force commanders in the Afghanistan campaign have had considerable discretion in interpreting and framing the principal’s overarching mission, the mission of their own force, as well as their force’s concept of operations. Their discretion can be understood as a combination of structurally induced freedom to make choices, the force commanders’ perceptions of that freedom and their inclination to use it. Circumstances regarding structural factors such as duality of command, passive authority of superiors, non-specific tasks and ambiguous implications of allocated resources has created this discretion and rendered force commanders disproportionately influential in the policy implementation process. Although this influence can be regarded as a manifestation of modern management ideals such as Auftragstaktik and mission command in the military, or management by objectives in government and business, it can also be regarded as a downwards passing of the buck where strategic implementation decisions trickle down to the level of force commanders in the field, making them “strategic colonels”.

The purpose of this paper has been to investigate the monetary policy in the West African Economic and Monetary Union (WAEMU), in terms of a Taylor rule based approach to their use of their interest rate. The evaluation of the different rules was based on both in-sample and out-of-sample forecast errors. Few significant or consistent influences from the variables proposed by the rules can be established, which might suggest that the bank operates primarily under a discretionary framework rather than a rule. Furthermore, our findings indicate that the European Central Bank interest rate (ECB-rate) does not exclusively drive the Central Bank of West African States interest rate (BCEAO-rate), which suggests that they indeed do retain some independence of monetary policy to respond to domestic variables as proposed by earlier research, despite having a fixed exchange rate. These results put into question the credibility of the BCEAO in attaining their stated primary goal of price stability, as there seems to be no significant or consistent response to it in the setting of their interest rate, despite a suggested ability to react to it. This can be the cause of the current high volatility of inflation in the area and give rise to future volatility and instability as well.

Harold Lasswell (1936) defined politics as the exploration of "who gets what, when, and how." As such, one of the central concerns of democratic governance is the role that affected interests play not only in politics, but in the implementation of adopted policies as well. In this dissertation, I use both comparative method case studies, as well as pooled-time series statistical techniques, to examine the effects of political, economic and market forces, and competition between the affected interests on implementation of the Surface Mining Control and Reclamation Act of 1977. The findings of this, as well as previous, research shows that state-level implementing agencies have some discretion in enforcement activities; however, closer examination shows that this discretion is rarely used. This lack of use of regulatory discretion by the state-level implementing agencies suggests that in most states, there is either sufficient competition between the affected interests to neutralize the excessive use of discretion in enforcement activity, or that there is insufficient pressure placed on the implementing agencies by the affected interests to warrant the use of discretion.
