Abstract Transgender people have long been associated with sexual perversion. For example, many early versions of the Diagnostic and Statistical Manual of Mental Disorders (DSM) infamously categorized any gender variance as sexual deviance or paraphilia. This article therefore investigates the taxonomical movement away from the transgender subject as perverse toward the current diagnosis of gender dysphoria, which instead consolidates the transgender subject as distressed and suffering. Through an unconventional use of psychoanalytic theories of perversion, I argue that DSM-5’s new diagnosis criteria work defensively, functioning as an antidote to the clinician's anxiety in the face of difference. When separated from stereotypical acts and identities, perversion proves to be quite valuable in understanding clinical transphobia. In particular, Freud's writings on fetishism and disavowal reveal some of the unconscious roles at play in the repeated medicalization of trans people and the restricting of transition-related resources. Through the donning of a fetish object, disavowal acts to ignore an upsetting reality while the traumatic truth remains intact. An analysis of Chase Joynt's video installation, Resisterectomy, provides grounded narratives of gendered surgery and illness that disrupt anticipated affects, temporalities, and curative measures.

PurposeThis paper will discuss two problems that have plagued the literature on the Ward-Domar-Vanek labor-managed firm (LMF) model, the perverse supply response problem and the horizon problem. The paper also discusses the solution to the horizon problem and the alleged “solution” of a membership market.Design/methodology/approachThis is a conceptual paper so it analyzes the two problems and shows how they can be resolved. It also shows how one alleged “solution” (membership market) is based on several conceptual mistakes about the structure of rights in a democratic firm.FindingsThe perverse supply response is based on the assumption that the members of a democratic firm can expel for no cause some members when it would benefit the remaining members. It is shown that the same perverse behavior happens conceptually and historically in a conventional firm under the same assumptions. The horizon problem is resolved by the system of internal capital accounts (ICAs) that has been independently invented at least four times.Research limitations/implicationsThe idea of a democratic firm is quite often dismissed by conventional economists: “At first it seems like a good idea but unfortunately it is plagued by structural problems such as the perverse supply response and the horizon problem.” Hence it is important to see that the first is not a problem under ordinary assumptions and that the second is a solved problem.Practical implicationsThe perverse supply response problem can be reproduced in a conventional firm under similar assumptions, and the horizon problem is real problem for social or common ownership firms but is solved in the Mondragon-type worker cooperatives by the system of ICAs. This has been known and published since the early 1980s, but conventional economists ignore the solution and still cite it as an inherent structure problem of a democratic firm.Originality/valueIt has not been previously shown in the LMF literature that the perverse supply response can be reproduced in a conventional corporation under similar assumptions since the maximand for the conventional firm is not total market value but that value per current shareholder. The solution to the horizon problem using ICAs has long been “known” but never acknowledged in the conventional literature as if it was a necessary feature of workplace democracy. The idea of a membership market is analyzed and criticized.

Abstract (sommario):
If torture is both ethically odious and usually ineffective as an interrogation method, why have states, especially democratic ones, practiced it? This paper develops a theoretical response to this puzzle by extending constructivist understandings of normative effects. I argue that the norm prohibiting torture has the perverse effect of making torture more attractive to some political leaders in two ways: first, the norm attracts those who are looking for an outside-the-box solution to challenging intelligence-gathering scenarios; second, the norm offers political leaders a narrative of heroism in which they sacrifice their morality for the greater good. I illustrate these explanations with the example of torture in the United States war on terror. My argument suggests that norms can shape the interests even of those who do not follow their scripts, implying that the scope of normative impact may be much wider than previously believed.

Instrument choice - the comparison of technology standards, performance standards, taxes and tradable permits - has been a major topic in environmental law and environmental economics. Most analyses assume that emissions and health effects are positively and linearly related. If they are not, this complicates the instrument choice analysis. This article analyses the effects of a nonlinear dose-response function on instrument choice. In particular, it examines the effects of hormesis (highdose harm but low-dose benefit) on the choice between fixed performance standards and tradable emissions permits. First, the article distinguishes the effects of hormesis from the effects of local emissions. Hormesis is an attribute of the dose-response or exposure-response relationship. Hotspots are an attribute of the emissions-exposure relationship. Some pollutants may be hormetic and cause local emissions-exposure effects; others may be hormetic without causing local emissionsexposure effects. It is only the local exposure effects of emissions that pose a problem for emissions trading. Secondly, the article shows that the conditions under which emissions trading would perform less well or even perversely under hormesis, depend on how stringent a level of protection is set. Only when the regulatory standard is set at the nadir of the hormetic curve would emissions trading be seriously perverse (assuming other restrictive conditions as well), and such a standard is unlikely. Moreover, the benefits of the overall programme may justify the risk of small perverse effects around this nadir. Thirdly, the article argues that hotspots can be of concern for two distinct reasons, harmfulness and fairness. Lastly, the paper argues that the solution to these problems may not be to abandon market-based incentive instruments and their cost-effectiveness gains, but to improve them further by moving from emissions trading and emissions taxes to risk trading and risk taxes. In short, the article argues that hormesis does not pose a general obstacle to emissions trading or emissions taxes, but that in those cases where hormesis does pose such a problem, a shift toward risk trading or risk taxes would be the superior route.

Bien qu'aussitôt dénoncé, et malgré ses impasses, le contrat de consentement sexuel continue pourtant de séduire ses utilisateurs, signe qu'il doit promettre certain bénéfice secondaire. Ce sont ces (fausses) promesses que notre travail s'appliquera à analyser, pour en dégager la logique pulsionnelle et les ressorts subjectifs, dans le cadre d'une clinique du sujet de l'inconscient. Nous montrerons alors comment le contrat sexuel se présente comme une suppléance perverse au non rapport sexuel tel que défini par Lacan. Ainsi, sous couvert de garantir harmonie et complémentarité, contre tout abus, il fait finalement la promotion d'une jouissance sexuelle qui sépare et isole, méconnaissant les dimensions de l'amour et du désir. Regarding the problem of sexual consent, brought to light by the #MeToo movement, the use of contractualization has become widespread. Despite immediate denunciation and despite its impasses, the sexual consent contract nevertheless continues to allure its users, sign that it must promise a certain secondary benefit. lt is these (fa Ise) promises that our work will analyze, to identify the drive logic and the subjective motives, within the framework of a clinic of the subject of the unconscious. We will thus show how the sexual contract presents itself as a perverse substitute for non­sexual relations as defined by Lacan. Therefore, under the guise of guaranteeing harmony and complementarity, against any abuse, it ultimately promotes a sexual jouissance which separates and isolates, ignoring the dimensions of love and desire. lt will finally appear that it inaugurates a new form of contractualization, under the modality of a re-feudalization of the social link, where everyone also consents to serving the jouissance of the other

Cette thèse a été préparée à l'Institut de Mécanique Céleste et de Calcul des Ephémérides de l'Observatoire de Paris, de septembre 2001 à avril 2005, sous la direction de MM. Alain Chenciner et Alain Albouy. Elle traite du problème des N corps, qui consiste en l'étude des solutions des équations de Newton. Celles-ci décrivent le mouvement de N particules ponctuelles en interaction gravitationnelle. Cette thèse a plus précisément pour objet l'étude des solutions homographiques (les rapports entre les distances mutuelles sont constants) associées à des masses de signe quelconque. On étudie le cas des mouvements rigides (les distances mutuelles sont constantes). Ce problème est plus difficile que le problème à masses positives, car il n'est plus possible d'associer un produit scalaire aux masses.

On s'intéresse au cas où la somme des masses est nulle. Le centre d'inertie devient alors un vecteur, invariant par translation. Ceci rend les équations de Newton "plus intégrables". Ainsi, sous une hypothèse sur les vitesses initiales, le problème colinéaire des trois corps devient intégrable. Cette propriété permet de calculer les configurations centrales (configurations qui engendrent un effondrement homothétique sur un centre) pour des masses x, -x, y, -y.

On applique une propriété des équilibres absolus à somme des masses nulle au problème des chorégraphies. Une chorégraphie est une solution dans laquelle les corps se suivent sur la même courbe avec des intervalles de temps égaux. On montre que, pour le potentiel logarithmique, les masses d'une chorégraphie sont nécessairement égales.

Chapter 5 explores the origins of Jacob Robinson and Shabtai Rosenne’s ambivalence towards the Genocide Convention and Raphael Lemkin. At its core was their reading of the Convention as the extension of interwar protection of minority rights—in essence, as a programme of Diaspora Nationalism. The Convention was predicated on a competing model of Jewish nationalism that, following Simon Dubnow, identified the Diaspora—not Palestine—as the proper locus for Jewish national revival. It challenged Zionism’s core assumptions about the Jewish condition and the solution it prescribed to the ‘Jewish Question’. A return to minority rights, after the Holocaust, undermined Zionism’s achievement of majority status in Palestine and negated the need for a Jewish state to guarantee the protection of Jews. Both Robinson and Rosenne had previously subscribed to Dubnow’s teachings; the chapter traces their ideological transformations: from investment in to disenchantment with national autonomy, minority rights, and Dubnow’s theories.

The appearance of the concept of sustainable development, although a sort of universal remedy at its beginnings, is becoming increasingly frequently the object of tensions both as objectives but especially as content. Regarding its objectives, the debate is organized around a logic based on the theory of the stakeholders but also on the competing logic that mobilizes an ethics of responsibility as teleological principle. Consequently, the meanings and implicitly the programmes of sustainable development are also the object of certain controversies and remain susceptible of being solved by a process of normalization of their contents. However, this dynamics of normalization itself is the bearer of certain “perverse effects”, already noticed in the accountancy standards domain and, under these circumstances, this dynamics of normalization cannot pretend to be the solution for regulating these controversies. The problem are mainly the weak doctrinal points characterizing Sustainable Development today, obviously, by comparison to what it wanted to be.

This chapter offers a concise description of the origins and evolution of the Israeli-Palestinian conflict and the unfolding of the peace process since the 1991 Madrid Peace Conference. It also challenges partisan accounts that pervert the complex truth of what is one of the most intractable conflicts in modern times. It describes the drama of the interplay between leadership and political culture as it was embodied in the three main leaders at the Camp David process, Bill Clinton, Ehud Barak, and Yasser Arafat. Although it defines the book as an obituary to the two-state solution, it also challenges the funereal historiography that has emerged in the wake of the Camp David process. It praises its final product, the Clinton peace parameters, as the litmus test of every serious peace proposal in the future. All, from George W. Bush’s roadmap in 2004 to Donald Trump’s “Deal of the Century” in 2020, are scrutinized.

In his book Superintelligence, Nick Bostrom points to several ways the development of Artificial Intelligence (AI) might fail, turn out to be malignant or even induce an existential catastrophe. He describes ‘Perverse Instantiations’ (PI) as cases, in which AI figures out how to satisfy some goal through unintended ways. For instance, AI could attempt to paralyze human facial muscles into constant smiles to achieve the goal of making humans smile. According to Bostrom, cases like this ought to be avoided since they include a violation of human designer’s intentions. However, AI finding solutions that its designers have not yet thought of and therefore could also not have intended is arguably one of the main reasons why we are so eager to use it on a variety of problems. In this paper, I aim to show that the concept of PI is quite vague, mostly due to ambiguities surrounding the term ‘intention’. Ultimately, this text aims to serve as a starting point for a further discussion of the research topic, the development of a research agenda and future improvement of the terminology.

Navies perceive benefit from proclaiming the intent to acquire ‘fully environmentally compliant’ warships, but such statements indicate minimal understanding of what is entailed, or realisation of the emasculation of ships’ operational effectiveness inherent to such ambition. Inescapable technical realities further void any possibility of achieving this aspiration in all but limited circumstances. Navies need to be smarter in objectively characterising and managing environmental risks, and innovative in generating bespoke technical solutions. Compliance with International Maritime Organization (IMO) marine environment protection obligations can be exceptionally onerous for warships, and in many cases nonsensical to pursue and arguably impossible to achieve. It is also ever more divergent from the standard caveat of ‘not impairing the operations or operational capabilities of such ships’. Extant, emergent and forecast regulations address matters such as fuel consumption, speed limits, fuel tank protection, and ship materials. Some requirements can be accommodated, offering benefits in terms of operational effectiveness and sustainment. Many, however, cannot be addressed without penalty in combat capability, survivability and through-life costs. IMO rules are founded upon merchant ship risks and linked merchant ship solutions; strict application of merchant ship risk remedies to warships can result in inappropriate design responses to ill-defined, inconsequential or non-existent risks. The design and acquisition processes of warships are also incompatible with IMO implementation schedules. Myopic application to warships of IMO prescripts can result in perverse outcomes which actually amplify risks to the environment. Novel ways in which to demonstrate effective compliance with the intent of rules need to be adopted. Sensible environment protection should remain a policy goal, but implementation should only be on an innovative, judicious, and risk-assessed basis if warships are to accentuate operational capabilities, which, axiomatically is the base reason for their existence. It is incumbent upon navies to also manage wider regulatory and policy dimensions. This can only be achieved by generating a clear understanding of what compliance entails in terms of capability and technical risks and how this may relate to a navy’s core mission — to fight and win at sea. This must then be communicated as a cogent and reasoned argument to regulators and policy makers. This is so that commitments by navies to ‘environmentally compliant warships’ are neither arbitrary nor to the detriment of capability.
