Abstract (sommario):
This meticulously curated edited volume presents an assemblage of insightful, critical, and contemporary perspectives on how Israeli domination has been sustained and reproduced in new forms and means using various mechanisms and techniques of control, coloniality, and settler colonialism. Based on original empirical fieldwork, the contributors to this book adopt interdisciplinary and decolonial approaches in their examination of the intricate functions and structures of domination that permeate Palestinian life by illuminating the power dynamics at play and revealing the mechanisms that sustain the settler-colonial regime. This book identifies sites of colonial control and domination exerted on Palestine by Israel, and demonstrates how these sites of control are also sites of Palestinian resistance. The first section explores the political sites of control by focusing on governmentality, institutions, and technologies and mechanisms of control including how Israel manages access to health, life and death. The second section examines the economic mechanisms of exploitation, dispossession, and de-development including banking, taxation and the relationships between finance capital, aid and military occupation. The third section turns attention to environmental sites of control, focusing on land, indigeneity, space and racial capitalism. Finally, section four scrutinizes the intellectual sites of control, highlighting how norms, narratives, and knowledge production perpetuate domination.

Abstract (sommario):
This chapter examines Israel’s invasion of southern Lebanon on 14 March 1978, often referred to as ‘Operation Litani’. First, the chapter discusses the immediate and long-term causes of the Israeli invasion: the former includes the ‘Coastal Road Massacre’ that occurred on 11 March 1978, whilst the latter includes the effects of the Palestinian presence in southern Lebanon. The second section analyses the positions of the main antagonists, setting forth the positions adopted by Israel, Lebanon, the PLO, Jordan, the US, Syria, Egypt, Kuwait and the United Nations’ Security Council. The third section discusses the legality of this use of force, purportedly an act of anticipatory self-defence to prevent future attacks. Finally, the chapter offers a brief conclusion on the precedential value of this incident. It concludes that the Israeli use of force, which was unanimously condemned by the Security Council, was unlawful.

Abstract (sommario):
Every nation has narratives or stories it tells itself about its history but which typically contain factually false or misleading mythologies that often result in devastating consequences for itself and for others. In the case of Israel and its indispensable ally, the United States, the central mythology is “the Arabs never miss an opportunity to miss an opportunity,” as the Israeli diplomat Abba Eban famously said in a 1973 statement that has been widely quoted ever since. However, the historical truth is very nearly the converse: it is Israel and the United States that have repeatedly lost or deliberately dismissed many opportunities to reach fair compromise settlements of the Arab-Israeli and Israeli-Palestinian conflicts. The book reexamines the entire history of the conflict from its onset at the end of World War I through today. Part I begins with a reconsideration of Zionism and then examines the origins and early years of the Arab-Israeli state conflict. One chapter is devoted to the question of what accounts for the nearly unconditional US support of Israel throughout the entire conflict. Part II focuses on war and peace in the Arab-Israeli state conflict from 1948 through today, arguing that all the major wars—in 1948, 1956, 1967, 1973—could and should have been avoided. This section also includes an examination of the Cold War and its impact on the Arab-Israeli conflict. Part III covers the history of the Israeli-Palestinian conflict from 1917 through today, and examines the prospects for a two-state or other settlement of the conflict.

Abstract (sommario):
The 2018 edition of The Global Community Yearbook of International Law and Jurisprudence both updates readers on the important work of long-standing international tribunals and introduces readers to more novel topics in international law. The Yearbook continues to provide expert coverage of the Court of Justice of the European Union and diverse tribunals from the International Court of Justice (ICJ) to criminal tribunals such as the International Criminal Court (ICC) and the Tribunal for the Former Yugoslavia, to economically based tribunals such as ICSID and the WTO Dispute settlement procedures. The contents of this part have been enriched with the inclusion of a new section devoted to the Permanent Court of Arbitration (PCA), the oldest global institution for the settlement of international disputes. This edition contains original research articles on the development and analysis of the concept of global law and the views of the global law theorists such as: whether the Paris Declaration of 2017 and the Oslo Recommendation of 2018 deals with enhancing their institutions’ legitimacy; how to reconcile human rights, trade law, intellectual property, investment and health law with the WTO dispute settlement panel upholding Australia’s tobacco plain packaging measure; Israel’s acceptance of Palestinian statehood contingent upon prior Palestinian “demilitarization” is potentially contrary to pertinent international law; and a proposal to strengthen cooperation between the ECJ and National Courts in light of the failure of the dialogue between the ECJ and the Italian Constitutional Court on the interpretation of Article 325 of the Treaty on the Functioning of the European union. The Yearbook provides students, scholars, and practitioners alike a valuable combination of expert discussion and direct quotes from the court opinions to which that discussion relates, as well as an annual overview of the process of cross-fertilization between international courts and tribunals.

Abstract (sommario):
This book explores the evolving internationalism of the Black Panther Party (BPP); the continuing exile of former members in Cuba is testament to the lasting nature of the international bonds that were forged during the party's heyday. Founded in Oakland, California, in October 1966, the BPP began with no more than a dozen members. Focused on local issues, most notably police brutality, the Panthers patrolled their West Oakland neighborhood armed with shotguns and law books. Within a few years, the BPP had expanded its operations into a global confrontation with what Minister of Information Eldridge Cleaver dubbed “the international pig power structure.” This book traces the shifting intersections between the black freedom struggle in the United States, Third World anticolonialism, and the Cold War. By the early 1970s, the Panthers had chapters across the United States as well as an international section headquartered in Algeria and support groups and emulators as far afield as England, India, New Zealand, Israel, and Sweden. The international section served as an official embassy for the BPP and a beacon for American revolutionaries abroad, attracting figures ranging from Black Power skyjackers to fugitive LSD guru Timothy Leary. Engaging directly with the expanding Cold War, BPP representatives cultivated alliances with the governments of Cuba, North Korea, China, North Vietnam, and the People's Republic of the Congo as well as European and Japanese militant groups and the Palestinian Liberation Organization.

Abstract (sommario):
‘The archaeological site and caves’ examines the archaeological evidence found at the Khirbet Qumran site. Palestinian archaeology was previously dominated by the biblical agenda, but Khirbet Qumran is not mentioned in the Bible, and was only excavated because of the Dead Sea Scrolls. The occupation of the site is generally divided into three phases: the Israelite phase, the communal phase (occupation by the Essenes), and the Second Revolt phase. A cemetery also exists at the site. This was the burial ground of the Qumran people (mixed with some later Bedouin burials), and arguments have raged over the importance of the different sections of the cemetery.

Abstract (sommario):
This book grapples with much-disputed topics in medieval Jewish history and takes issue with a number of reigning views. The book provides a searching analysis of oft-cited halakhic texts of Ashkenaz, frequently with conclusions that differ from the current consensus. Part I questions the scholarly consensus that the roots of Ashkenaz lie deep in Palestinian soil. It challenges the widespread notion that it was immemorial custom that primarily governed Early Ashkenaz. It similarly rejects the theory that it was only towards the middle of the eleventh century that the Babylonian Talmud came to be regarded as fully authoritative. It is shown that the scholars of Early Ashkenaz displayed an astonishing command of the complex corpus of the Babylonian Talmud and viewed it at all times as the touchstone of the permissible and the forbidden. The section concludes with a radical proposal as to the source of Ashkenazi culture and the stamp it left upon the Jews of northern Europe for close to a millennium. Part II treats the issue of martyrdom as perceived and practised by Jews under Islam and Christianity. It claims that Maimonides' problematic Iggeret ha-Shemad is a work of rhetoric, not halakhah. This is followed by a comprehensive study of kiddush ha-shem in Ashkenaz. The book concludes with two chapters on Mishneh torah, which argue that that famed code must also be viewed as a work of art which sustains, as masterpieces do, multiple conflicting interpretations.

Abstract (sommario):
The first cookbook to present the dishes of more than 120 ethnic groups now in America, The American Ethinic Cookbook for Students illustrates how those dishes have changed throughout the years. This cookbook contains more than 300 recies plus references to ethnography, food history, culture, and the history of American immigration. A bibliography at the end of each ethnic group section is included. Covering the cooking of Native American tribes, old-stock settlers, old immigrants from 1840-1920, and the new immigrants, no other cookbook describes so many different ethnic groups or focuses on the American ethnic experience. Arranged alphabetically by ethnic group, each chapter consists of a brief introduction to the ethnic group, its food history and ethnogaphy, followed by recipes, with step-by-step instructions, techniques hints, and equipment information. Among the 120 ethnic groups included are: Amish-Mennonites, Arcadians, Cugans, Dutch, Cajuns, Eskimos, Hopi, Hungarians, Jamaicans, Jews, Palestinians, Serbs, Sioux, Turks, and Vietnamese.

Jamal, Manal A. Promoting Democracy. NYU Press, 2019. http://dx.doi.org/10.18574/nyu/9781479811380.001.0001.

Testo completo
Abstract (sommario):
Democracy aid has grown considerably since the end of the Cold War. In the late 1980s, less than US$1 billion a year went to democracy assistance; by 2015, the estimated total was more than $10 billion. Despite this overwhelming commitment to spreading democracy abroad, the results have been mixed, and in some cases, this aid has in fact undermined the longer-term prospects for democratic development. What factors account for these different outcomes? Why are democracy promotion efforts far more successful in some cases as opposed to others? Promoting Democracy answers these questions while also providing an often overlooked perspective - the perspective of those most directly affected by the impact of this assistance. By examining two primary conflicttopeace transition cases- the Palestinian territories and El Salvador- and drawing from over 150 interviews with grassroots activists, political leaders, heads of NGOs, and directors of donor agencies, Manal A. Jamal investigates how democracy assistance shaped the re-constitution of political and civic life. She examines these developments at a more macro, general level in terms of democratic outcomes and then at the level of civil society by tracing transformations in one social movement sector--the women’s sector--in each case. She argues that ultimately the pervading political settlements determined the different outcomes, and that democracy assistance mediated these processes. The book then expands the temporal and geographic aperture of the study by examining developments in the Palestinian territories following Ḥamas’ 2006 election victory, and then by investigating the impact of political settlements and the mediating role of democracy assistance in Iraq and South Africa during the start of their political transitions. Jamal challenges more simple accounts that rely on NGO professionalization to explain civil society outcomes and illustrates how pervading political settlements that govern political relations in these contexts ultimately determined the different outcomes. By providing a systematic analysis of how democracy assistance impacts civil society and broader democratic outcomes, she provides new ways of understanding the relationship between foreign aid and domestic political contexts and resolves key debates about the limits of democracy promotion in non-inclusive political contexts.
