We argue that the neoliberal tradition and new public management reforms of the public sector effectively erode the core (liberal) democratic values of the rule of law and transparency. The tension between public law and managerially-influenced governmental policy is in practice resolved by the emergence of what we call “shadow management” in public administration, whereby managerial decisions that clash with constitutional and administrative law are dealt with in internal memos or consultancy reports and hidden from public view. The consequence is a duality in the public sector, which potentially reduces public trust in institutions and undermines their democratic legitimacy. Finally, we argue that when governmental neoliberal policy clashes with legal requirements, the likely effect is that the popular institution of the (governmental or parliamentary) ombudsman, originally introduced for legal supervision over civil servants, takes on the new deceptive role of providing pseudo-legal justification for neoliberal reform, making neoliberalism and ombudsmen a particularly problematic combination from a democratic and legal perspective. We support our contentions by a case study of Swedish higher education and hypothesize that the mechanisms we highlight are general in nature.

Increasingly, government agencies are using computers to automate decisions about citizens. Often, the reason proffered for this is increased efficiency. This article reveals the extent to which computer automated decision-making processes in government are being legislatively adopted, provides an overview of the risks associated with such incorporation and analyses the limited extent to which the parliament has considered these associated risks. We analysed 35 core pieces of Commonwealth legislation that allow computers to make decisions on behalf of the administrative decision-maker. The Commonwealth government has authorised at least 35 of its agencies to use computers to make decisions and in doing so has expanded its power. This has occurred without much debate. We reviewed the associated secondary materials – including second reading speeches and parliamentary debates – to understand the level of discussion on the issue. Surprisingly, our analysis reveals that most amendments have passed with little to no debate. While the drive for governmental efficiency is commendable, failing to adequately debate the risks involved in automating administrative decisions undermines core administrative law principles and exposes governmental agencies and, more importantly, the Australian population to the risk of serious error. This article calls for increased debate before these authorisations are made and the incorporation of audit and review processes to control the use of this power by government agencies ex post.

AbstractThe article charts the history and trajectory of neoliberalism provided in Foucault's 1979 lectures on ‘The Birth of Biopolitics’. In these fascinating contributions, first published in English translation ten years ago, Foucault identifies German and American forms of neoliberalism, defined in opposition to both the Beveridge reforms and Roosevelt's New Deal. In seeking to comprehend Foucault's articulation of neoliberalism it is important to locate it in the context of contemporary debates on the future of socialism and the reconfiguration of social policy. Despite theoretical problems with his account, the lecture series continues to aid our understanding of the contemporary evolution of social policy.

Abstract The goal of this article is to write a social and political history of the now preeminent approach to the ‘commons’ institutions, by focusing on Elinor Ostrom’s contributions to its development. My methodology is that of Science and Technology Studies (STS). I focus here on the materiality of E. Ostrom and her team’s research practices (fieldwork, data collecting, indexing and analysis), on their intellectual and institutional strategies, their networking practices, how their research was funded, and their interactions with administrative and academic institutions and actors (USAID, NSF, National Academy of Sciences). I analyze the history of the Workshop in Political Theory and Policy Analysis, the research center that E. Ostrom and her husband Vincent founded and animated for some 40 years at Indiana University, Bloomington. By doing so, I hope to be able to analyze the close ties between the form and content of the Ostromian theories on the commons and the main lines of tension in the U.S. society of the 1970s and 80s that saw their emergence: urban crisis and “neighborhood revolution”, increasing distrust of modernization and centralization ideals, mutations in U.S. development policies and doctrines, rise of neoliberalism.

This article presents the results from research into education for citizenship in which Chilean teachers participated. Ninety-nine interviews and two focal groups that included questions on knowledge, beliefs, values and practices related to education for citizenship were carried out. NVivo 12 software was used for the analysis of the discourses, following the direction similar to the grounded theory that considers elaborating free nodes, structuring categories and configuring categorical trees, according to the school’s administrative dependency. The results yield six macro-categories: School, Authoritarianism, Neoliberalism, Curriculum, Teacher Role and Citizenship. The present article analyses the Neoliberalism macro-category formed, in turn, by the following subcategories: (1) subject and resistance, (2) competitiveness and individualism in a subject that is instrumental, consumer and reproducer of the establishment, (3) commodified schools, where the economic value regards students and families as clients, (4) a culture of bureaucratization and accountability, and (5) lack of a sense of communality as a collective, supportive body. In all of them, teachers show themselves eloquently critical of the neoliberal system and of the obstacles it poses to rights, justice and democracy in the current capitalist citizenship and school.

Since the election of Donald Trump, MS-13, the Salvadoran street gang, has become a national security and foreign policy concern for his administration. Due to the violence of street gangs like MS-13, El Salvador has become a country with the highest rates of homicides, alongside forced migration. Like much of the mainstream media and personal accounts of asylum seekers, the arguments about violence emerging from street gangs in El Salvador from the Trump administration are based on actual material conditions, but what is often missing are the root causes. This article argues that the production of a moral panic over MS-13 has been transnationalised between the United States and El Salvador to displace the contradictions of global capitalism in El Salvador to a local and deported relative surplus population. It argues that the spectre of MS-13 in El Salvador and throughout US cities must be placed within the limits of a Salvadoran revolution, the insertion of the Salvadoran political economy into the global capitalist system in the 1980s, the development of a neoliberal Salvadoran state, and the US sponsoring of law-and-order polices in the country as a response to regulate a relative surplus population.

In this paper the author substantiates a thesis that the reason for the emergence of the economic and general social crisis lies in the withdrawal of European countries from the legislatively proclaimed model of a social market state and the assumption of neoliberal principles, which are the basis of economic globalization. He finds that globalization gave rise to numerous negative social phenomena resulting from the predominance of the economic interests of capital over other social values. The reestablishment of the functioning of the market–social state in Europe that would be based on human rights could significantly contribute to the elimination of the causes of the crisis. The enforcement of the UN Guiding Principles on Business and Human Rights (Ruggi’s Guiding Principles) would mean the first step towards the change in principles and neoliberalism in the world and its negative effects.

L’étude la banalisation du droit des personnes publiques par le prisme de la distinction droit public-droit privé, s’inscrit dans une démarche paradigmatique d’analyse du rôle de l’État et de son droit dans la société. Elle traduit significativement la pénétration effective du droit privé et du modèle de l’entreprise dans « l’univers mental » du droit des personnes publiques. Cette infiltration manifeste une profonde crise du modèle de l’administration et de son droit conduisant à des transformations sans précédent des fins et des moyens juridiques de l’action publique et révélant, par-delà même la permanence de la crise d’identité du droit administratif et de son autonomie, l’évolution de ses sources et l’érosion de son exorbitance. Ce faisant, les mutations du droit des personnes publiques remettent-elles en question le partage fonctionnel de l’ordre juridique ? Et en filigrane, la summa divisio résiste-t-elle à l’évolution des faits et des réalités économiques et sociales ? Notre étude montre ainsi le dépassement nécessaire des limites quant à la manière traditionnelle de penser les spécificités du droit des personnes publiques et de la summa divisio au regard de la redistribution des rôles sociaux entre les sphères publique et privée et l’émergence de mouvements convergents tels que la constitutionnalisation et l’européanisation des droits qui tendent progressivement au rapprochement des droits. Elle appelle donc au-delà de la confrontation de la crise des concepts du droit administratif et de la summa divisio, à une reconsidération du mode de lecture transversale de la séparation entre deux cultures juridiques jadis opposées et aujourd’hui en cours d’ajustement pour conforter l’unité de l’ordre juridique
The study of the trivialization of public law through the prism of the public/private law distinction is part of a paradigmatic approach to analyzing the role of the State and its law in society. It significantly reflects the effective penetration of private law and the corporate model into the “mental universe” of public law. This infiltration manifests a profound crisis in the model of the administration and its law, leading to unprecedented transformations in the legal ends and means of public action and revealing, even beyond the continuing identity crisis of administrative law and its autonomy, the evolution of its sources and the erosion of its exorbitance. Do changes in the law governing public entities call into question the functional division of the legal system? And does the public/private summa divisio stand up to changes in economic and social realities? Our study shows that the traditional way of thinking about the specificities of public law and summa divisio needs to be transcended, given the redistribution of social roles between the public and private spheres, and the emergence of converging movements such as the constitutionalization and Europeanization of rights, which are gradually bringing rights closer together. In addition to confronting the crisis in the concepts of administrative law and summa divisio, it calls for a reconsideration of the way in which the separation between two formerly opposed legal cultures is now being read across the board, with a view to reinforcing the unity of the legal order

Véritable dogme en droit interne et s’imposant comme un standard dans l’ordre juridique international, le concept d’« État de droit » est dépourvu d’une signification clairement déterminée. Différentes conceptions sont admises et dépendent des acceptions de l’État en question, d’une garantie hic et nunc de certains droits ainsi que d’une volonté politique des gouvernants. L’objet de cette recherche s’attache au droit administratif, précisément au rôle du juge administratif, comme vecteur de soumission de l’autorité de l’État afin de promouvoir les droits et libertés fondamentales des administrés en France. Si rien ne présageait une telle évolution au nom de la raison d’État, le Conseil d’État, par une pensée politique (néo)libérale, s’est imposé comme l’institution juridictionnelle majeure dans la construction du concept d’État de droit administratif. Au moyen d’une interprétation formelle et substantielle du principe de légalité, l’État de droit administratif légitime l’action publique des gouvernants tout en garantissant la sécurité juridique des administrés. Cette liaison de l’État et du droit administratif relève d’une construction inépuisable, appréhendée par l’État de contentieux qui s’analyse comme le kaléidoscope des faits sociaux. Ce dernier résulte d’une politique de la force, d’un conflit positif entre les Hommes, les institutions, les normes ou les pouvoirs institués. Ainsi, en conciliant l’Autorité et la Liberté, le concept d’État de droit administratif révèle le degré d’assujettissement de l’administration au droit administratif. Le développement objectif du concept d’État de droit administratif est bâti par l’État de justice et protégé par l’État légal, au profit d’une justice administrative garante des valeurs républicaines de l’État. Le perfectionnement de l’État de droit administratif par l’État de contentieux est agencé par l’État démocratique et régulé par l’État global, en libérant l’administré de toute servitude de la part de l’administration. L’illibéralisme administratif s’estompe au profit d’une société de(s) droit(s), d’une juridicisation et d’un normativisme absolus, au détriment de l’État
The Rule of law concept is a real domestic law dogma and has established itself as a norm in the international judicial order. It is beneft of a clearly defined signification. Different concepts are accepted and depend on the agreements of the state, on a hic et nunc warranty of some rights as well as the rulers political will. This study aims to consider the administrative law, and more specifically the administrative judge’s role, as a means of control over the authority of the state so as to promote the rights and fundamental freedoms of the constituents in France. Even if nothing could portend such an evolution on the account of the state, the Conseil d’État, through a (neo)liberal political influence, became major judicial institution which builds the concept of domestic rule. The administrative juridiction legitimizes the public action of the governments while ensuring the legal security of the constituents through a formal and substantive interpretation of the principle of legality. This relation on between the state and the administrative law state of litigation which can be analyzed as a kaleidoscope of social facts. This stems from a power policy, of a positive conflict between men, the institutions, the normes or the instituted powers. Therefore, by accommodating authority and freedom, the administrative jurisdiction exposes the extent to which the administration is subjected to the administrative law. The objective construction of the administrative Rule of law allows the setting up of an administrative justice, which guarantees the republican values of the State thanks to legal Justice and Legal State. The upgrading of the administrative Rule of law by the democracy provide some freedom to the people vis-à-vis the state. The lack of liberalism fades away in favour of a litigious society, juridification and normatism to the detriment of the state

It is even more patent currently with the phenomenon of the constitutionalization of Law.In this article, the author analyses this phenomenon in the field of Administrative Law, the administrative-constitutional principles, and examines how various institutions of Administrative Law have been constitutionally configurated,outlined and controlled in Peru, for which he goes over the most important jurisprudence of the Peruvian Constitutional Court regarding the matter.
La vinculación entre el Derecho Administrativo y el Derecho Constitucional, ramas del Derecho Público, es incuestionable. Ello es incluso más notorio actualmente con el fenómeno de la constitucionalización del Derecho.  En el presente artículo, el autor analiza este fenómeno en el campo del Derecho Administrativo, los principios constitucionales administrativos, y examina cómo distintas instituciones propias del Derecho Administrativo han sido configuradas, delineadas y controladas constitucionalmente en el Perú, para lo cual repasa la más importante jurisprudencia.

Competition law has been defined as the rules or provisions which aim to ensure and sustain a market where vigorous, but fair competition will result in the most efficient allocation of economic resources and production of goods and services at the lowest price. The goal, which competition law wishes to attain, is to level the playing field where both small and large firms can compete with one another, fairly and competitively, which in turn leads to a greater benefit for the consumer. South African competition authorities consider cartels as the most egregious of all competition law contraventions because of their harmful impact upon consumers, economic development and the market. Cartel activities are formed in secret and this renders these activities more dangerous, because it is difficult for competition authorities to detect and prosecute them. In South Africa, cartels are regulated in terms of section 4(1)(b) of the Competition Act 89 of 1998, which practices are per se prohibited. Section 4(1)(b) specifically lists the following activities as cartel practices: price fixing, bid rigging and market allocation. Administrative penalties are a common retributive and preventative tool in numerous jurisdictions, including South Africa, which are imposed on firms which participate in cartel activities. Section 59 of the Competition Act postulates that an administrative penalty may be imposed by the Tribunal on a contravening firm, should it be found that such firm has engaged in such prohibited practices. The penalty may be determined and enforced in one of two ways, either unilaterally by the Competition Tribunal in terms of section 59 of the Competition Act, or in terms of a consent agreement concluded between the contravening firms and the Competition Commission, which agreement needs to be approved and enforced by the Tribunal in terms of Section 58 of the Competition Act. The primary objective of the imposition of administrative penalties on cartelists is to both prevent and deter cartel behaviour. It is not a perfect system and has faced its challenges over time. The issues which the competition authorities have had with the imposition of administrative penalties relates to, inter alia, the quantification thereof, the enforcement thereof and the economic and social impact that such penalties have on the contravening firms, its employees and the consumers in general. This dissertation will interrogate the manner in which the competition authorities have approached the imposition of administrative fines. The focus will be on fines imposed for cartel conduct as set out in section 4(1)(b) of the Competition Act. The objective is to determine whether South Africa’s approach to the imposition of administrative fines is in need of reform, and if so, to make suitable recommendations.

An issue that has always caused controversy, both in the theory and in the practice, is the application of the law over time, which becomes more complex in terms of its non-retroactivity or retroactivity. In the present article, the author develops theretroactivity of the most favorable rule principle. First, the author describes the concept and fundamentals of retroactivity. Then, he reports its normative support and its delimitation. Finally, the author exposes the most discussed and controversial assumptions on its application and non-application, making parallels with its regulation in Spain.
Un tema que siempre ha causado controversia, tanto en la teoría como en la práctica, es la aplicación de la norma jurídica en el tiempo, la cual se complejiza en cuanto a su irretroactividad o retroactividad. En el presente artículo, el autor desarrolla el principio de la retroactividad de la norma más favorable. En primer lugar, describe el concepto y fundamentos de la retroactividad. A continuación, informa sobre su sustento normativo y su delimitación. Finalmente, expone los supuestos discutidos sobre su aplicación e inaplicación, haciendo un paralelismo con su regulación en España.

La ciudad de México históricamente ha concentrado una parte importante de la población y la actividad económica del país, su territorio agrupa la mayor planta industrial y de servicios, junto a su correspondiente equipamiento social, administrativo y cultural, condición que ha logrado cimentar como resultado de un transitar entre modernidades, y donde su base territorial, producto de distintos ejercicios de planeación, ha sido fundamental aun con sus límites. Pese a esos atributos, la ciudad muestra una serie de problemas de carácter social donde sobresalen las contradicciones suscitadas en sus periferias, ya que junto a espacios con buenos niveles para habitar, se desarrollan otros sin los mínimos necesarios; y si bien han existido loables trabajos de planeación urbana, éstos no han encontrado ambientes propicios para su buen desarrollo, lo anterior, debido a los efectos generados por un neoliberalismo que privilegia minorías, y que da cuerpo a una postmodernidad desigual. Mexico City has assembled a large part of the country’s population and of its economic activities. Industries and services are to be found in its territory, along with corresponding social, administrative and cultural infrastructure. Such condition has been strengthened thanks to the city’s transition throughout modernities, transforming a territory that continues to be essential. However, in spite of these features, the city shows a series of social problems, especially in the outskirts of the city. Whereas certain areas have adequate livable conditions, others develop without the very basic services. Despite important urban planning projects, proper atmospheres to favor their development have not been found. All of this is the product of a neoliberalism privileging a few people and giving way to unequal postmodernity.

В данной статье рассматривается сущность административной деликтоспособности, которая является правовой категорией довольно сложной по содержанию, несмотря на то, что она является самостоятельным свойством, входящим в состав правосубъектности. Кроме того, теоретики права неоднозначно подходят к выявлению её правовых признаков, поэтому в данной статье предпринята попытка обозначить и проанализировать различные подходы к признакам деликтоспособности с целью дать полное и точное выявление её правовых элементов. Деликтоспособность имеет свои признаки, в соответствии с которыми определяется, во-первых, её наличие и, во-вторых, её объём. This article examines the essence of administrative delictworthiness, which is a complex legal category in terms of content, despite the fact that it is an independent property that is part of legal personality, legal theorists ambiguously approach the identification of its legal features, therefore, this article attempts to identify and analyze various approaches to the signs of delictworthiness in order to give full and accurate identification of its legal elements. Delinquency has its own characteristics, according to which, firstly, its presence is determined and, secondly, its volume.

Terrorism in Western nations has changed significantly over the past years, putting security services to the test and prompting necessary adaptations in counter-terrorism strategies. In this context, states may be tempted to resort to more flexible and swiftly implemented tools such as administrative measures. However, this Policy Brief argues that the known risks associated with administrative measures may be magnified today by a combination of factors and pose new challenges. First, the broadening of the perceived terrorist threat, as it coincides with escalating social and political tensions in many democracies, contributes to obscuring the boundaries between activism, disorder, extremism (violent or not), and terrorism, increasing the risk of misuse as part of attempts to protect the public order. Second, the increasingly tense political climate displaying growing polarisation and escalating populist rhetoric raises additional risks of intentional abuse. Finally, it appears that the overreliance on administrative measures, even when prima facie compliant with the law, may also contribute to an erosion of some human rights and rule of law principles. In addition to causing harm to specific individuals or groups, the accumulation of these circumstances may also affect entire societies and undermine democracy altogether. This Policy Brief argues that the current backdrop calls for renewed caution in the use of administrative measures and a dramatic strengthening of existing safeguards and protections against arbitrary or unlawful uses.

Literature shows that IDPs struggle to access services, which has an impact on their ability to live healthy and fulfilling lives. In the field of health, IDPs frequently have worse outcomes than both host community and refugees. This rapid literature review finds evidence of a number of policy and administrative barriers to access of services for internally displaced persons (IDPs). IDPs remain citizens of the countries in which they are displaced, and the national authorities retain responsibility for meeting their basic rights. However, their displacement, loss of livelihoods and assets, lack of documentation, as well as discrimination against them, lack of protection under international law, lack of policy to address their needs, poor services and conflict or disaster conditions, can all make it more difficult for IDPs to access basic services than non-displaced citizens. There is relatively little literature systematically addressing the issue of administrative and policy barriers to service access among IDPs. Much of the literature discusses IDPs alongside refugees (who have a different legal status and access to different national and international support), or discusses the whole range of difficulties facing IDPs but does not focus on administrative or policy barriers. The literature frequently does not compare IDPs and other citizens and service users. Nevertheless, policy and administrative barriers are discussed, ranging from analysis of international instruments on IDPs to documentation procedures in particular countries. Much of the literature shows the prevalence of disease, lack of school attendance, limited provision of services etc. faced by IDPs, but does not discuss the policy and administrative barriers in detail.

This document describes the foundations of cybersecurity practices in the Republic of Korea, specifically laws, regulations, governance, and foundational infrastructure, which comprise the core components of its cybersecurity practices. It also highlights a number of important lessons for improving cybersecurity practices in the country. The first lesson is that laws and regulations are essential for the deployment of effective responses to future cyber threats. Korea has enacted many national laws related to cybersecurity, these laws have been revised to reflect current realities in Korea. These laws form the basis of national policy and governance for effective cybersecurity responses. Second, the Korean government has implemented a pan-government national cybersecurity plan, which delineates the development of a national pan-government information protection system encompassing the public, private, national defense, and financial sectors. Under the National Security Council, Korea's top administrative entity for dealing with national cybersecurity, several agencies work closely to protect the country against cyber threats. The Inter-American Development Bank member states should promote and nurture special cybersecurity-related institutions.

The note explores the issue of crimes against movable and immovable property (assets) affected by criminal acts committed by individuals who possess firearms irregularly, resulting in the deprivation of ownership or rights. These victims find themselves in a vulnerable position as part of an unarmed society, unable to exercise the right to self-defense of their assets due to the prohibition on carrying a weapon for this purpose.

Putting migrants and asylum seekers into detention for administrative reasons is a common practice in Greece, despite this policy contravening human rights. Greek authorities are using detention and the new EU-funded closed compounds as a way to discourage people from seeking asylum in Europe. Detention, as outlined in Greek law, should only be used as a final resort and only then in specific instances. Detention carries with it not only a financial cost, but also a considerable moral cost. Detention without just cause violates basic human rights, such as freedom of movement, the right to health and the right to family life. Alternatives to detention exist and must be prioritized.

We conducted an experiment in quota-eligible firms to study if firms can be nudged to include individuals with disabilities (PwD) with different information letters. The intervention was conducted in the first year of implementing a quota law for PwD in Chile. Firms were randomly assigned to receive an informational email, benefits of inclusion email or information, and fines information. We use anonymized administrative data on monthly employer-employee linkages and disability certification records. We find that the pure information treatment increased the number of PwD working in the firms, and that most of this impact is explained by an increase in the reclassification of incumbent workers.

In War-Algorithm Accountability (August 2016), we introduce a new concept—war algorithms—that elevates algorithmically-derived “choices” and “decisions” to a, and perhaps the, central concern regarding technical autonomy in war. We thereby aim to shed light on and recast the discussion regarding “autonomous weapon systems” (AWS). We define “war algorithm” as any algorithm that is expressed in computer code, that is effectuated through a constructed system, and that is capable of operating in relation to armed conflict. In introducing this concept, our foundational technological concern is the capability of a constructed system, without further human intervention, to help make and effectuate a “decision” or “choice” of a war algorithm. Distilled, the two core ingredients are an algorithm expressed in computer code and a suitably capable constructed system. Through that lens, we link international law and related accountability architectures to relevant technologies. We sketch a three-part (non-exhaustive) approach that highlights traditional and unconventional accountability avenues. We focus largely on international law because it is the only normative regime that purports—in key respects but with important caveats—to be both universal and uniform. In this way, international law is different from the myriad domestic legal systems, administrative rules, or industry codes that govern the development and use of technology in all other spheres. By not limiting our inquiry only to weapon systems, we take an expansive view, showing how the broad concept of war algorithms might be susceptible to regulation—and how those algorithms might already fit within the existing regulatory system established by international law.

The imperative to provide humanitarian and medical services on an urgent basis in armed conflicts is anchored in moral tenets, shared values, and international rules. States spend tens of billions of dollars each year to help implement humanitarian programs in conflicts across the world. Yet, in practice, counterterrorism objectives increasingly prevail over humanitarian concerns, often resulting in devastating effects for civilian populations in need of aid and protection in war. Not least, confusion and misapprehensions about the power and authority of States relative to the United Nations Security Council to set policy preferences and configure legal obligations contribute significantly to this trajectory. In this guide for States, we present a framework to reconfigure relations between these core commitments by assessing the counterterrorism architecture through the lens of impartial humanitarianism. We aim in particular to provide an evidence base and analytical frame for States to better grasp key legal and policy issues related to upholding respect for principled humanitarian action in connection with carrying out the Security Council’s counterterrorism decisions. We do so because the lack of knowledge regarding interpretation and implementation of counterterrorism resolutions matters for the coherence, integrity, and comprehensiveness of humanitarian policymaking and protection of the humanitarian imperative. In addition to analyzing foundational concerns and evaluating discernible behaviors and attitudes, we identify avenues that States may take to help achieve pro-humanitarian objectives. We also endeavor to help disseminate indications of, and catalyze, States’ legally relevant positions and practices on these issues. In section 1, we introduce the guide’s impetus, objectives, target audience, and structure. We also describe the methods that we relied on and articulate definitions for key terms. In section 2, we introduce key legal actors, sources of law, and the notion of international legal responsibility, as well as the relations between international and national law. Notably, Security Council resolutions require incorporation into national law in order to become effective and enforceable by internal administrative and judicial authorities. In section 3, we explain international legal rules relevant to advancing the humanitarian imperative and upholding respect for principled humanitarian action, and we sketch the corresponding roles of humanitarian policies, programs, and donor practices. International humanitarian law (IHL) seeks to ensure — for people who are not, or are no longer, actively participating in hostilities and whose needs are unmet — certain essential supplies, as well as medical care and attention for the wounded and sick. States have also developed and implemented a range of humanitarian policy frameworks to administer principled humanitarian action effectively. Further, States may rely on a number of channels to hold other international actors to account for safeguarding the humanitarian imperative. In section 4, we set out key theoretical and doctrinal elements related to accepting and carrying out the Security Council’s decisions. Decisions of the Security Council may contain (binding) obligations, (non-binding) recommendations, or a combination of the two. UN members are obliged to carry out the Council’s decisions. Member States retain considerable interpretive latitude to implement counterterrorism resolutions. With respect to advancing the humanitarian imperative, we argue that IHL should represent a legal floor for interpreting the Security Council’s decisions and recommendations. In section 5, we describe relevant conduct of the Security Council and States. Under the Resolution 1267 (1999), Resolution 1989 (2011), and Resolution 2253 (2015) line of resolutions, the Security Council has established targeted sanctions as counterterrorism measures. Under the Resolution 1373 (2001) line of resolutions, the Security Council has adopted quasi-“legislative” requirements for how States must counter terrorism in their national systems. Implementation of these sets of resolutions may adversely affect principled humanitarian action in several ways. Meanwhile, for its part, the Security Council has sought to restrict the margin of appreciation of States to determine how to implement these decisions. Yet international law does not demand that these resolutions be interpreted and implemented at the national level by elevating security rationales over policy preferences for principled humanitarian action. Indeed, not least where other fields of international law, such as IHL, may be implicated, States retain significant discretion to interpret and implement these counterterrorism decisions in a manner that advances the humanitarian imperative. States have espoused a range of views on the intersections between safeguarding principled humanitarian action and countering terrorism. Some voice robust support for such action in relation to counterterrorism contexts. A handful call for a “balancing” of the concerns. And some frame respect for the humanitarian imperative in terms of not contradicting counterterrorism objectives. In terms of measures, we identify five categories of potentially relevant national counterterrorism approaches: measures to prevent and suppress support to the people and entities involved in terrorist acts; actions to implement targeted sanctions; measures to prevent and suppress the financing of terrorism; measures to prohibit or restrict terrorism-related travel; and measures that criminalize or impede medical care. Further, through a number of “control dials” that we detect, States calibrate the functional relations between respect for principled humanitarian action and countering terrorism. The bulk of the identified counterterrorism measures and related “control dials” suggests that, to date, States have by and large not prioritized advancing respect for the humanitarian imperative at the national level. Finally, in section 6, we conclude by enumerating core questions that a State may answer to help formulate and instantiate its values, policy commitments, and legal positions to secure respect for principled humanitarian action in relation to counterterrorism contexts.

Taxpayers sometimes engage in complex transactions with uncertain tax treatment, such as mergers, acquisitions, demergers and spin-offs. With the rise of global value chains and proliferation of multinational corporations, these transactions increasingly involve transnational financial arrangements and cross-border dealings, making tax treatment even more uncertain. If improperly structured, such transactions could have costly tax consequences. One approach to dealing with this uncertainty is to create a private rulings regime, whereby a taxpayer applies for a private ruling by submitting a statement detailing the transaction (proposed or completed) to the tax authority. The tax authority interprets and applies the tax laws to the requesting taxpayer’s specific set of facts in a written private ruling. The private ruling offers taxpayers certainty as to how the tax authority views the transaction, and the tax treatment the taxpayer can expect based on the specific facts presented. Private rulings are a common feature of many tax systems around the world, and their main goal is to promote tax certainty and increase investor confidence in the tax system. This is especially important in a developing country like Uganda, whose tax laws are often amended and may not anticipate emerging transnational tax issues. Private rulings in Uganda may be applied for in writing prior to or after engaging in the transaction. The Tax Procedures Code Act (TPCA), which provides for private rulings, requires applicants to make a full and true disclosure of the transaction before a private ruling may be issued. This paper evaluates the Ugandan private rulings regime, offering a comparative perspective by highlighting similarities and contrasts between the Ugandan regime and that of other jurisdictions, including the United States, Australia, South Africa and Kenya. The Ugandan private rulings regime has a number of strengths. It is not just an administrative measure as in some jurisdictions, but is based on statute. Rulings are issued from a central office – instead of different district offices, which may result in conflicting rulings. Rather than an elaborate appeals process, the private ruling is only binding on the URA and not on the taxpayer, so a dissatisfied taxpayer can simply ignore the ruling. The URA team that handles private rulings has diverse professional backgrounds, which allows for a better understanding of applications. There are, however, a number of limitations of the Ugandan private rulings system. The procedure of revocation of a private ruling is uncertain. Private rulings are not published, which makes them a form of ‘secret law’. There is no fee for private rulings, which contributes to a delay in the process of issuing one. There is understaffing in the unit that handles private rulings. Finally, there remains a very high risk of bias against the taxpayer because the unit is answerable to a Commissioner whose chief mandate is collection of revenue. A reform of the private rulings regime is therefore necessary, and this would include clarifying the circumstances under which revocation may occur, introducing an application fee, increasing the staffing of the unit responsible, and placing the unit under a Commissioner who does not have a collection mandate. While the private rulings regime in Uganda has shortcomings, it remains an essential tool in supporting investor confidence in the tax regime.
