Abstract (sommario):
This thesis in political theory explores the salient moral problems of asymmetric war. It begins with the assumption that the just war tradition provides an important language for addressing asymmetric war. I argue, however, that the modern conception of the tradition is statist and it should be reconceptualized from a cosmopolitan perspective. This claim is applied to four problems. The first problem is that asymmetric war involves non-state actors who, under the modern account of the principle of legitimate authority, cannot have the authority to engage in war. After challenging prevailing conceptions of the relationship between sovereignty and authority, I argue that non-state actors can have legitimate authority. The second problem is that non-state actors often look more like civilians than soldiers and use the civilian population as cover and, thus, questions arise about combatant equality and responsibility. Contrary to dominant conceptions of combatants and responsibility, I argue that non-state actors can be considered combatant equals and that certain 'non-state' tactics do not affect their status since such tactics are not necessarily irresponsible. The third problem is whether assassination is a justifiable tactic. Three positions are evaluated: a policy of absolute prohibition; assassination justified as a means of state-sanctioned revenge and punishment of terrorists; and assassination justified as 'named killing.' None, however, are successful. Nevertheless, I argue that assassination is a justifiable tactic of war, within some limitations, since it can be more discriminate and proportionate than other tactics. The fourth problem is whether terrorism is a justifiable tactic, whether as a means of bringing people out of 'bad lives,' equalizing or redistributing rights violations, or necessary in a supreme emergency. I conclude that regardless of how terrorism is justified, the tactic is immoral and its use entails a flagrant disregard for the principle of noncombatant immunity.

In this thesis, I show how a current radio program, War of the Roses, acts as a ritual of shaming that affirms the social order as moral order, involving moral condemnation, degradation of social identity, and public embarrassment (Goffman, 1956, 1967; Turner 1987). I use discourse analysis (DA) (e.g., Bergmann, 1998; Tracy, 2001; Tracy & Mirivel, 2008) and membership categorization analysis (Baker, 2000; Roulston, 2001) to examine eight transcripts from multiple versions of the War of the Roses radio program across the country. The basic premise of the radio program War of Roses involves a "caller" who suspects her or his partner of infidelity colluding with the radio DJ to devise a test to confirm whether or not the partner is in fact "cheating" on the relationship. The sequencing of the show inevitably involves exposing and confronting the cheater with their infidelity, and embarrassing the cheater in the public forum of the radio medium. Specifically, I trace how morality is enacted as a dynamic of talk-in-interaction, which requires a negotiation and authorization of claims, and involves differential access on the part of the DJ, the "cheater," and the victim to the social discourse of shaming and embarrassment.

The thesis focuses upon what might be termed 'war's moral problem.' The problem relates to an aporetic relation between a transcendental position of morality and the phenomenon of war. In general terms the problem refers to the situation where, on the one hand, a 'particular conception of morality' condemns war, yet, on the other hand, morality is forced to legitimate particular wars in the attempt to overcome the condition of war. This can be understood as a jurisprudential question that comes to Anglo-European jurisprudence through a long tradition(s) of natural law.

This study is a transdisciplinary inquiry into the reasons for waging war, for fighting, and for repudiating war as an instrument of foreign policy. In Part I, its essential premise is that there are many ways for analysing the ethics and morality of war, and that to develop a comprehensive understanding of this subject one must be willing to engage with a broad range of alternate views. Though moralists usually argue about the rights and wrongs of conduct from within a given set of ethical ideas, the author's aim has been to move beyond the accepted boundaries of current philosophical argument.Questions raised include: To what extent is it morally right to adopt non-violent, pacifist or abolitionist attitudes?; How should the morality of domestic and ethnic wars be considered?; What are the human costs of war? Case studies such as the Vietnam War, the Falklands War, the Gulf War, Bosnia and Rwanda are used. In Part II, three inescapable observations add to the foundation of the thesis.First, war is not inevitable. Second, the need to prevent war is increasingly urgent.Third, preventing war is possible.Examples from 'hot' spots around the world illustrate that the potential for domestic war can be diffused through the early, skillful and integrated application of political, diplomatic, economic and military measures

Situated within the fields of diplomatic history and comparative genocide studies, this thesis examines the German colonial period from the standpoint of German-British relations before, during and after the Second Boer War in British South Africa (1899-1902) and the Herero and Nama War in German South West Africa (present-day Namibia, 1904-1908). I contend that German and British diplomatic efforts at cordiality functioned as a means of tacitly condoning each power’s humanitarian abuses—or at least “letting them slide”—for the sake of stability both on the European Continent and within the colonies. Despite activism against reported maltreatment and violence—even among citizens of “the perpetrating power” and among those of “the observing power”­—neither the German nor the British government was willing to chastise the other openly, for fear of alienating a key ally. Only with the advent of the First World War, when the former allies became enemies, did an explosion of criticism of each other’s maltreatment of their colonial subjects erupt. In the wake of German defeat, the British victors reaped the spoils of war—including the ability to shape perceptions of what had happened nearly two decades before in the African colonies—and succeeded in expropriating the German overseas territories in the 1919 Treaty of Versailles. From this narrative the following conclusion emerges: German and British official responses to humanitarian concerns in the colonies were dictated not by morality or compassion but rather by realpolitik expediency. And, as often in history, the one-sided narrative that emerged from this rather hypocritical series of events continues to skew perceptions of both British and German colonialism today. Thus, as a whole, this thesis poses broad theoretical questions regarding the politicization of morality and the social construction of genocide classifications, as well as the extent to which changing perceptions of violent conflicts have played a role in how the international community has categorized these conflicts through legal means in the wake of the Holocaust.

This thesis is divided into two chapters. In the first chapter, I analyze Michael Walzerâ s account of the moral legitimacy of states. In the second chapter, I analyze his account of the morality of killing in war. I begin the first chapter by contrasting Walzerâ s account of state legitimacy and humanitarian intervention with that of David Luban. Next, I develop a Rawlsian account of state legitimacy and humanitarian intervention and argue that this account is more plausible than both Walzerâ s and Lubanâ s accounts. The second chapter is divided into two parts. In the first part, I argue that Walzerâ s account of the distinction between combatants and noncombatants is misleading because it gives the impression that all and only infantry soldiers are combatants and that all and only civilians are noncombatants. In the second part of the second chapter, I describe an account of the morality of killing in war developed by Jeff McMahan that is based on an analogy with the morality of killing in domestic society and argue that this account is more plausible than Walzerâ s account of the morality of killing in war. I also suggest a way that McMahanâ s account could be improved.

The understanding of terrorism has thus far been determined not by some independent line of inquiry but instead by a strong interplay between conflicting moral positions. Treated sometimes as a method or tactic and at other times as a distinct form of violence, the true nature of terrorism remains elusive, while a failure to understand it has squarely been blamed on the moral problem. The conceptual and theoretical debate in the field of terrorism studies as a result has not progressed in any meaningful way. Issues that were associated with terrorism when a formal inquiry into the problem was first launched still remain unresolved. Basic questions as to whether terrorism generates fear and if it is possible to identify its victim or perpetrator continue to plague the terrorism discourse. Meanwhile matters that are crucial, such as the widespread tendency to treat terrorism as a tactic, strategy or ideology and the essentially contested character of terrorism scholarship are either ignored or erroneously taken for granted. This thesis will show that our inability to define terrorism is not due to the moral problem as it is made out to be but because of our failure to understand the true nature of terrorism. To accomplish this task, it not only analyzes issues that are regularly contested but also discusses in detail the ones that are trivialized and overlooked. It ultimately concludes that terrorism primarily plays only an auxiliary or a facilitatory role and therefore the key to defining it and understanding its true nature lies in its utility and function.

The overall aim of this thesis is to look at some philosophical issues surrounding autonomous systems in society and war. These issues can be divided into three main categories. The first, discussed in papers I and II, concerns ethical issues surrounding the use of autonomous systems – where the focus in this thesis is on military robots. The second issue, discussed in paper III, concerns how to make sure that advanced robots behave ethically adequate. The third issue, discussed in papers IV and V, has to do with agency and responsibility. Another issue, somewhat aside from the philosophical, has to do with coping with future technologies, and developing methods for dealing with potentially disruptive technologies. This is discussed in papers VI and VII. Paper I systemizes some ethical issues surrounding the use of UAVs in war, with the laws of war as a backdrop. It is suggested that the laws of war are too wide and might be interpreted differently depending on which normative moral theory is used. Paper II is about future, more advanced autonomous robots, and whether the use of such robots can undermine the justification for killing in war. The suggestion is that this justification is substantially undermined if robots are used to replace humans to a high extent. Papers I and II both suggest revisions or additions to the laws or war. Paper III provides a discussion on one normative moral theory – ethics of care – connected to care robots. The aim is twofold: first, to provide a plausible and ethically relevant interpretation of the key term care in ethics of care, and second, to discuss whether ethics of care may be a suitable theory to implement in care robots. Paper IV discusses robots connected to agency and responsibility, with a focus on consciousness. The paper has a functionalistic approach, and it is suggested that robots should be considered agents if they can behave as if they are, in a moral Turing test. Paper V is also about robots and agency, but with a focus on free will. The main question is whether robots can have free will in the same sense as we consider humans to have free will when holding them responsible for their actions in a court of law. It is argued that autonomy with respect to norms is crucial for the agency of robots. Paper VI investigates the assessment of socially disruptive technological change. The coevolution of society and potentially disruptive technolgies makes decision-guidance on such technologies difficult. Four basic principles are proposed for such decision guidance, involving interdisciplinary and participatory elements. Paper VII applies the results from paper VI – and a workshop – to autonomous systems, a potentially disruptive technology. A method for dealing with potentially disruptive technolgies is developed in the paper.

The ethics of economic sanctions is an issue that has been curiously neglected by philosophers and political theorists. Only a handful of philosophical journal articles and book chapters have ever been published on the subject; yet economic sanctions, as I will show, are significantly morally problematic and their use stands in need of moral justification. The aim of this thesis then is to consider how economic sanctions might be morally justified. Of the few writers who have considered this issue, the majority point to the analogies between economic sanctions and war and use the just war principles (just cause, proportionality etc.) as a framework within which to assess their moral permissibility. I argue that this is a mistake. The just war principles are derived from a set of complex and detailed arguments all planted firmly within the context of war. These arguments contain premises that, whilst they may hold true in the case of war, do not always hold true in the case of economic sanctions. Nevertheless, the rich just war tradition does offer a valuable starting point for theorising about economic sanctions and in the thesis I consider how the wider just war tradition might be brought to bear on the case of economic sanctions, beginning, not with the just war principles, but with the underlying arguments for those principles. In particular, I consider whether economic sanctions can be justified on the grounds that they are a form of self- or other-defence, that they are the ‘lesser evil’ and that they are a form of punishment. I argue that certain types of economic sanctions can be justified on the grounds that they are a form of self- or other- defence and that, in extreme circumstances, certain types of economic sanctions can be justified as the ‘lesser evil’. However, I argue that economic sanctions cannot be justified on the grounds of punishment. I also develop a ‘clean hands’ argument for economic sanctions that is unavailable to the just war theorist; I argue that where the goods and services to be supplied would contribute to human rights violations or other wrongful acts, there is a duty to impose economic sanctions to avoid complicity in this wrongdoing.

Colombia's protracted civil war between Marxist insurgencies and the state has brought grave consequences for the civilian population and the prospects for constructing a viable political community in the country. With up to 5 million internally displaced people, rampant impunity for perpetrators of crimes against humanity and human rights and International Humanitarian Law violations, dozens of politicians and countless members of the armed forces linked to paramilitary organizations, along with increasing social injustices and inequalities, Colombia presents a troubling social-political panorama that has led to what is often referred to as a profound social and institutional 'moral crisis'. Much discussion has centred on the question of achieving some degree of minimal moral and political consensus and 'collective conscience' to humanize and slowly transform the conflict at local, regional and national levels. However, the philosophical and political parameters of this discussion have been and continue to be set firmly within variants of the liberal tradition which, it is argued, does not provide the necessary resources for adequately conceptualizing the problem and conceiving the task of addressing conflict, constructing moral consensus, and seeking social and political coexistence. The thesis argues that the philosophy of Alasdair MacIntyre can provide such resources. MacIntyre provides a convincing account of the philosophical problems that underlie ongoing intractable disagreement and the conflicts it breeds, offering a philosophy that can inform and underpin efforts at social transformation, resistance, and coexistence as well as aiding the necessary task of social scientific research and analysis of the conflict. The thesis analyses the moral dimensions of the conflict in light of MacIntyre's philosophy but also critically explores the adequacy of his politics of local community for the Colombian context. MacIntyre argues that a rational political community can only be constructed through the praxis of local communities engaging in shared moral-political deliberation. Through an empirical case study of a Constituent Assembly process in a rural community that has suffered the impacts of armed conflict for decades, the thesis explores an attempt at constructing peaceful social and political coexistence in light of MacIntyre's moral-sociological framework.

Machine ethics is a field of applied ethics that has grown rapidly in the last decade. Increasingly advanced autonomous robots have expanded the focus of machine ethics from issues regarding the ethical development and use of technology by humans to a focus on ethical dimensions of the machines themselves. This thesis contains two essays, both about robots in some sense, representing these different perspectives of machine ethics. The first essay, “Is it Morally Right to use UAVs in War?” concerns an example of robots today, namely the unmanned aerial vehicles (UAVs) used in war, and the ethics surrounding the use of such robots. In this essay it is argued that UAVs might affect how the laws of war (LOW) are interpreted, and that there might be need for additional rules surrounding the use of UAVs. This represents the more traditional approach of machine ethics, focusing on the decisions of humans regarding the use of such robots. The second essay, “The Functional Morality of Robots”, concerns the robots of the future – the potential moral agency of robots. The suggestion in this essay is that robots should be considered moral agents if they can pass a moral version of the Turing Test. This represents the new focus of machine ethics: machine morality, or more precisely, machine agency.

The thesis argues that, as a tradition, the concept of just war is socially and contextually sensitive and revisable. It explores the relevance of theory according to the dynamic changes in the nature of threats in the international arena and concludes that the just war tradition is still relevant to the contemporary modern threats that require an act of pre-emptive warfare. However, it needs some revision to be comprehensively applicable to the dynamic of modern threats and the nature of pre-emptive war. Due to the nature of pre-emptive war a nation launches the attack before the aggression from the other nation-in-conflict erupts. The author, therefore, proposed several theoretical and procedural revisions in both the principle of “Jus Ad Bellum” and “Jus In Bello” using the method of reflective equilibrium to create a comprehensive “just” pre-emptive war doctrine as part of the development and dynamic in just war tradition.

A despeito do sucesso dessas campanhas iniciadas em 1413, a governação daqueles territórios até primórdios da década de 1450 foi marcada, segundo relatos conhecidos, por instabilidades decorrentes da conduta inadequada dos guerreiros de um lado e de outro da contenda. Tais descaminhos foram alvo das inquietações de William Worcester (1415-1480/5?), letrado que denunciou em seu tratado Boke of Noblesse um fazer bélico contemporâneo descompassado, pouco virtuoso e marcado por desvios, distante, pois, dos modelos recomendados aos cristãos. Suas reflexões, quando comparadas com outras externadas por seus contemporâneos, trazem indicações sobre as etapas de organização e execução do conflito e permitem questionar características do fazer marcial quatrocentista tanto dos adversários franceses como dos próprios guerreiros ingleses. Ao atentar para esse aspecto, o objetivo desta investigação é perquirir o que se julgou condenável no empreendimento das contendas, interrogando, a partir da produção escrita inglesa, a redefinição dos caminhos para a condução do conflito e dos planos de conquista. Em síntese, a pesquisa dispõe-se a questionar sobre uma fração particular da história da guerra: os juízos e avaliações sobre os combatentes, esmiuçando seu papel como espelho para interpretar as condutas dos povos para além do próprio conflito.
Abstract: At the first half of fifteenth-century, military expeditions led to the effective occupation of French domains claimed by English monarchs. Despite the successful results achieved in the campaigns started in 1413, it was generally asserted that, until the beginning of 1450’s, the governance of those territories was characterized by instabilities originated from the inadequate behavior of warriors on both sides of the struggle. Such state of overall jeopardy was noticed by William Worcester (1415-1480/5?) in his treatise Boke of Noblesse, where he denounced a state of disorderly warfare, on the one hand, poorly associated with virtues and, on the other, strongly related to vices, stretched away from Christian recommended models. When compared to his contemporaries ideas, William Worcester’s offer evidences regarding crucial steps in conflict organization and performance, enabling, in like manner, a proper questioning of both French and English martial enterprises characteristics. Aware of such perspective, this inquest targets what was understood as condemnable in war making, and, therefore, it interrogates English writings about the desired paths to be tread on effective conflict development and conquest plans. Shortly, this research aims to question a particular fraction of military history: the reasonings and evaluations concerning warriors’ behaviour, scrutinizing their role as a mirror that enables a deeper interpretation of people’s conducts beyond war itself.
Resumen: A lo largo de la primera mitad del Cuatrocientos, expediciones militares llevaron a la ocupación efectiva de dominios en Francia pleiteados por los monarcas ingleses. A pesar del éxito de estas campañas iniciadas en 1413, la gobernación de aquellos territorios hasta principio de la década de 1450 fue marcada, según relatos conocidos, por instabilidades consecuentes de la conducta inadecuada de los guerreros de un lado y de otro de la contienda. Tales descaminos fueron objeto de las inquietudes de William Worcester (1415-1480/5?) letrado que denunció en su tratado Boke of Noblesse un hacer bélico contemporáneo descomedido, poco virtuoso y marcado por desvíos, distante, pues, de los modelos recomendados a los cristianos. Sus reflexiones, cuando equiparadas con otras externas por sus contemporáneos, traen indicaciones sobre las etapas de organización y ejecución del conflicto y permiten cuestionar características del hacer marcial cuatrocentista tanto de los adversarios como de los propios guerreros ingleses. European security and defence policy has developed at a significant rate since the late 1990s. As a growing field of analysis, there have been few studies to date that have explored the foreign and domestic implications of the European Union's emerging security and defence policies. This thesis seeks to assess the quality and effectiveness of the present day defence policies of the European Union through an examination of its commitment to civilian and military missions abroad. In so doing, this thesis suggests that these missions stem from a misguided belief that the promotion of human rights, democracy, and the rule of law beyond its border is the most effective means by which to achieve security within Europe. This thesis concludes that the economic and political tools available to the European Union provide a better means by which to ensure security in Europe and around the world.

This thesis is about individuals and groups - and about judgements made of individuals because of their membership of groups. I argue that the concept of caste can illuminate our understanding of discrimination. Chapter I adumbrates the properties of a group. Chapters" draws a distinction between two types of statistical discrimination: between extrapolations based on characteristics like race, sex or eye colour and those based on past behaviour. But within the former category we feel more strongly about discrimination based on sex than discrimination based on eye-colour. Chapters III explains why this is so. attempt to show that the concept of caste is essential for making sense of our intuitions. Race and sex are not supposed to be relevant in a meritocracy - potential employees and university applicants are supposed to be assessed on their individual worth. And yet there are cases where an individual's worth to a company may be a function of a characteristic like skin colour - such as when customers are racist and would rather not be served by a black person. Chapter IV attempts to reconcile this tension within merit. If we wish to break down caste, I argue, then far from pandering to the racist attitudes of the customers, the employer may have an added reason to employ somebody who is black. This brings us to Chapter V, and some reflections on how caste can illuminate the impassioned debate on affirmative action. But should we wish to break down caste? What is wrong with a society being rigidly split? Chapter VI offers a tentative answer, in the liberal tradition. The answer has something to do with autonomy. Chapters VII and VIII then examine two final areas where groups are relevant, and where caste can once again shed light: voting rights, and animal rights.

International Relations in modernity have undergone phases of nation-state struggle and, more recently, globalized conflict. Theorists have used the paradigms of idealism and realism to explain state actor motivations in such conflicts; yet in the early 21st century, the United States initiated regime change in Iraq with claims of necessity pertaining to morality and security that could not be adequately explained using either framework. This thesis postulates that a paradigm shift in International Relations, as described by John Vasquez via Thomas Kuhn, is occurring as evidenced by the conduct of United States foreign policy towards Iraq. This new paradigmatic approach, which Edward Weisband has titled Hegemonic Moralism, is analyzed in this thesis, explicating the ontological assumptions and policy initiatives made by the United States administration in the lead-up to the Second Gulf War. Hegemonic Moralism clashes with the realist beliefs underpinning Germanyâ s foreign policy during the same time period: with the threat of Anglo- American neo-liberal dominance in the Middle East a distinct possibility, Germany realigned its allies to forestall and de-legitimize looming U.S. regime change in Iraq. An analysis of realist theory and its assumptions of human and nation-state behaviour leads into an explication of the paradigm of US Hegemonic Moralism, comparing it with the realist behaviour exhibited by Germany. I suggest that descriptions of German sociopolitical discourse after the September 11 2001 attacks on the US and prior to the Second Gulf War convincingly show Germanyâ s social and political readiness to oppose the hegemonic neo-liberal Anglo-American paradigm.

À l’appui des Caractères de la Bruyère, nous ouvrons à nouveau une question laissée en suspens par les études qui ont été menées autour de « la philosophie comme manière de vivre ». Cette question concerne la nouvelle relation entre la parole et l’action qui se serait établie à partir des XVIe et le XVIIe siècles en Occident. Au travers des différentes hypothèses proposées, nous avons choisi d’étudier le rôle qu’y a joué la parole de type machiavélien ou la logique de la domination. À la fois mode d’accès à la connaissance, mode de constitution de soi et rapport à la politeia, cette logique en laquelle s’est inscrit progressivement le savoir moderne nous détourne d’un accès au texte de la Bruyère pouvant libérer tout son potentiel de réformation éthique – sa psychagogie. Pour accéder à ce potentiel, il nous faut tour à tour prendre distance avec la logique de la domination et renouer avec cet autre rapport au langage qu’elle n’a cessé par ailleurs de discréditer, à savoir ce rapport d’origine socratique que relaient les différentes productions philosophiques de l’Antiquité auxquelles se réfèrent les Caractères. Aussi, devrons-nous réévaluer objectivement les postulats anthropologiques qui sont autant de motifs éthiques qui innervent la pensée politique et sociologique moderne et qui configurent le foyer de notre expérience politique actuelle
By having recourse to La Bruyère’s Characters, this work aims at reassessing a question that has been let aside by scholarly studies dedicated to « the philosophy as a way of life ». This question deals with the new relation between speech and action which is believed to have occurred in the 16th-17th centuries in the West. Through different hypotheses, we have chosen to examine the role played by the Machiavellian type of speech, or the logic of the domination. Being at the same time a way to access knowledge, a mode of self-constitution and a relationship to politeia, this logic is the place where the Modern knowledge gradually falls within and also turns us away from an access to La Bruyère’s text that can release its potential of ethical reformation – its psychagogy. In order to gain access to this potential, we have in turns to distance ourselves from the discursive logic of domination and to renew with this other relation to language, to oneself and to politeia that this logic constantly brings into disrepute, in other words to this Socrastic relation to be found in the philosophical production of the Antiquity to which the Characters refer to

The persistence of preventable Maternal Morbidity and Mortality (hereafter MMM), in the developing world, despite ground breaking technological and scientific advances, is unacceptable. There is no cause of death and disability for men between ages 15 and 44 that comes close to the large scale of maternal mortality and morbidity. Thus, the prevalence of high MMM ratios indicates the side-lining of women's rights. Surprisingly, the causal factors of preventable MMM and interventions needed to reverse the pervasively high numbers are now well known. Yet, hundreds of women continue to die daily and to suffer lifelong illnesses while giving birth. In Uganda, despite various regulatory, policy and programmatic strategies, the most recent survey revealed that the maternal mortality ratios were at a staggering 438 per 100,000 live births.

On a l’habitude, concernant Bergson et Popper, de souligner que le second emprunte au premier la notion de « société ouverte » en la détournant de son sens. C’est une erreur : au moment où il met cette notion au centre de La société ouverte et ses ennemis, Popper est persuadé d’être l’inventeur de la notion. Lorsqu’il apprend que Bergson en a fait usage avant lui, il marque la différence entre les deux sociétés ouvertes tout en reconnaissant une similitude entre les deux sociétés closes. Mais comment, si la société close s’oppose, par définition, à la société ouverte, et si les deux notions de « société close » sont similaires, les deux notions de « société ouverte » pourraient-elles être fondamentalement dissemblables ? Nous nous demandons, dans une première partie, jusqu’où les deux sociétés closes peuvent être considérées comme similaires et s’il est possible d’en construire une conception unifiée. Nous cherchons d’abord à montrer comment Bergson et Popper, en partant de problèmes différents, finissent par se rejoindre sur la notion d’une morale naturelle close. Nous montrons ensuite que ces deux modalités du clos — exclusivisme guerrier et holisme conservateur — se trouvent chez les deux auteurs, sans qu’ils ne leur accordent la même importance : un certain nombre de différences souterraines annoncent les oppositions à venir sur la société ouverte. Ces différences n’empêchent toutefois pas l’élaboration d’une conception unifiée de la société close. Nous suivons Bergson pour articuler les deux modalités du clos en considérant que la cohésion sociale trouve en partie sa source dans l’hostilité à l’égard des ennemis. Notre deuxième partie se demande si ce qui apparaît au premier abord comme contradictoire entre les deux sociétés ouvertes ne pourrait pas plutôt être considéré comme des tensions au sein d’une même société ouverte. Nous insistons d’abord sur ce qui peut apparaître comme contradictoire en montrant que l’ouverture n’a pas le même sens chez Bergson et chez Popper : passage de la cité à une société comprenant l’humanité pour le premier, passage à une cité où sont libérés les pouvoirs critiques de l’homme pour le second. La société ouverte de Popper est close pour Bergson, la société ouverte de Bergson relève pour Popper d’une nostalgie pour la société close. Mais la contradiction vient du fait qu’on compare la modalité de l’ouvert que chacun privilégie et qui n’est pas la même. Il faut, pour avoir une vision plus juste, comparer la modalité rationaliste de l’ouverture chez les deux auteurs, et la modalité mystique de l’ouverture chez l’un et chez l’autre. En procédant à cette comparaison, on peut montrer que ces deux modalités sont l’une et l’autre une façon, pour une société, de transcender la nature, d’être créatrice. En ce qui concerne la modalité rationaliste de l’ouverture, c’est Popper qui parvient à en montrer le caractère créateur, sur le plan théorique comme sur le plan pratique — Bergson en étant empêché par sa conception de l’intelligence ; pour ce qui est de la modalité mystique, c’est Bergson qui montre comment elle permet à une société de transcender, au moins partiellement, la nature — Popper en étant empêché par sa conception de l’amour. A partir de là, il ne semble pas impossible d’élaborer une conception unifiée de la société ouverte articulant ces deux modalités : la modalité rationaliste de l’ouverture repose sur la foi en la fraternité humaine, laquelle ne peut trouver son plein élan que dans la modalité mystique. Il est vrai qu’il y a tension entre ces deux modalités de l’ouvert, mais leur équilibre est nécessaire à la société qui s’ouvre : la présence de la modalité mystique évite à la modalité rationaliste, qui permet le conflit, une dégénérescence guerrière ; la présence de la modalité rationaliste évite à la modalité mystique, qui transcende les conflits dans l’enthousiasme, de dégénérer en « nationalisme mystique »
It is usually said, when talking about Bergson and Popper, that the former borrows the notion of “open society” to the latter and diverts its meaning. It is a mistake: when he puts this notion in the center of The open society and its enemies, Popper is convinced that he is the one who came up with the notion. When he learns that Bergson used it before him, he underlines the differences between both open societies, while admitting a similarity between both closed societies. But how, if the closed society opposes, by definition, the open society, and if both notions of “closed society” are similar, could both notions of “open society” be fundamentally dissimilar?We are wondering, in our first part, to what degree the two closed societies can be considered similar, and if it is possible to build a unified conception of both of them. We are first seeking to show how Bergson and Popper, while starting from different issues, end up reuniting on the notion of a closed natural morality. We are then showing that these two modalities of the closed – warrior exclusivism and conservative holism – are found in both authors, although they don’t give it the same degree of importance: a number of underlying differences are announcing the upcoming oppositions on the open society. These differences, however, do not prevent the elaboration of a unified conception for the closed society. We are following Bergson to articulate both modalities of the closed while considering that social cohesion comes partly from hostility towards enemies. Our second part questions if what first shows up as a contradiction between both open societies could not be considered rather as tensions among one same open society. We first insist on what can appear as contradictory by showing that openness doesn’t have the same meaning for Bergson it does for Popper: for the former, it’s stepping from the city to a society containing humanity. For the latter, it’s stepping to a city where man’s critical powers are liberated. Popper’s open society is closed to Bergson, and Bergson’s open society is, to Popper, an expression of the longing for the unity of the closed society. But the contradiction comes from comparing each author’s preferred modality for openness, which differs. It is necessary, to have a better vision, to compare the rationalist modality of openness for both authors, as well as the mystical modality of openness for one and the other.By proceeding to this comparison, we can show that these two modalities are both a way for a society to transcend nature, for it to be inventive or creative. When it comes to the rationalist modality of openness, Popper is the one who manages to show its creative aspect, in both theory and practice – Bergson being restrained to do so by his conception of intelligence; when it comes to the mystical modality, it is Bergson who shows how it allows a society to transcend, at least partially, nature – Popper being restrained to do so by his conception of love.From this point, it doesn’t seem impossible to elaborate a unified conception for the open society articulating both of these modalities: the rationalist modality of openness is based on faith in human fraternity, which can only reach its fullest with the mystical modality. It is true that there is tension between these two modalities of openness, but their balance is necessary for a society that opens up: the mystical modality’s presence prevents the rationalist modality, that allows conflict, to fall into warrior degeneracy; the rationalist modality’s presence prevents the mystical modality, that transcends conflicts in enthusiasm, to degenerate into “mystical nationalism”

Ce travail propose d’étudier l’un des nombreux textes médiévaux portant sur le mythe de la guerre de Troie. Transmis à l’Occident médiéval non pas par le biais d’Homère mais par celui des classiques latins et de certains auteurs de l’Antiquité tardive, ce mythe connut un immense succès en Europe durant tout le Moyen Âge, malgré l’ignorance du grec et de l’Iliade. Nous avons choisi d’éditer partiellement et de commenter l’un des plus importants monuments de la matière troyenne médiévale, texte presque inédit aujourd’hui, car totalement délaissé depuis la Renaissance et le retour aux textes anciens. Dans une introduction, nous avons exposé les principes de notre travail d’édition, c'est-à-dire listé les différents manuscrits utilisés par l’éditeur précédent (Nathaniel Griffin), puis surtout présenté notre manuscrit de base, le Cod. Bodmer 78, absent de la liste des manuscrits collationnés par Griffin. Puis nous avons consacré un chapitre à la langue du texte, un latin médiéval très lisible quoiqu’empreint de « modernismes », notamment au niveau du lexique. Puis, après avoir présenté le texte, sa langue et notre méthode d’édition, nous avons exposé le peu d’éléments que nous avions sur notre auteur, sa vie, son œuvre et le contexte intellectuel au milieu duquel il évolua dans la Sicile du XIIIe siècle, ainsi que l’engouement européen pour la matière troyenne qui explique son choix de reprendre ce grand mythe dans son Historia. Enfin il nous a fallu évoquer les nombreuses sources utilisées par Guido delle Colonne, ses sources directes, indirectes ou inavouées. En dernier lieu, nous avons offert un résumé de chaque livre édité et traduit. Suit une bibliographie détaillée sur les manuscrits et éditions anciens de ce texte, des manuels, le contexte culturel et historique en Europe et en Sicile au Moyen Âge, les textes grecs, latins et vernaculaires se rapportant à la guerre de Troie et ayant influencé notre auteur de près ou de loin, les ouvrages critiques sur le traitement de cette matière troyenne dans l’Antiquité et au Moyen Âge, et enfin les quelques éléments bibliographiques portant sur Guido et sur son œuvre. Vient ensuite notre édition-traduction. La traduction est accompagnée d’un double apparat : un apparat des sources et réminiscences ainsi qu’un apparat critique qui prend en compte et compare les leçons contenues dans notre manuscrit de base avec les variantes citées par l’éditeur précédent dans les quelques manuscrits qu’il a utilisés. Au bas de la traduction, figurent des notes d’érudition destinées aux noms ou des faits cités dans le texte et qui méritent une explication. Après cette partie introduction philologique et édition, la deuxième grande partie de cette thèse consiste en un commentaire et des annexes. Dans notre commentaire, nous avons souhaité interroger notre texte dans ses aspects narratologiques, thématiques, génériques, linguistiques et idéologiques. C’est pourquoi nous avons consacré un premier chapitre à l’étude narratologique du texte, son contenu, son agencement, ses techniques narratives, son utilisation des sources et ses principales thématiques. Dans une seconde partie, nous avons abordé le genre et le ton de cette Historia, qui se veut un texte historique quoique traitant une matière fictionnelle puisque mythologique à une époque où les genres littéraires ne sont pas encore définis et encore moins cloisonnés ; nous avons en outre longuement commenté et illustré le choix de l’écriture en prose et en latin à une époque où la mode est au vers et au vernaculaire. Enfin, notre troisième chapitre porte sur le contenu scientifique, politique et idéologique de ce texte truffé de parenthèses érudites et morales. En dernier lieu, nous avons proposé une édition diplomatique de la partie non éditée ni traduite du manuscrit, ainsi que des annexes sur les manuscrits et le vocabulaire, et bien sûr des index des noms propres et un glossaire des mots rares ou surprenants
This work proposes to explore one of the many medieval texts on the myth of the Trojan War. Transmitted to medieval Europe not through Homer but by the Latin classics and some authors of late Antiquity, this myth was a huge success in Europe during the middle Ages, despite the ignorance of the Greek and the Iliad. We chose to partially edit and comment on one of the most important monuments of the medieval Trojan material, almost unpublished text today because totally abandoned since the Renaissance and the return to the ancient texts. In an introduction, we exposed the principles of our editing work, that is to say, listed the various manuscripts used by the original publisher (Nathaniel Griffin) and especially presented our basic manuscript, Cod. Bodmer 78, absent from the list of manuscripts collated by Griffin. Then we have a chapter on the language of the text, a medieval Latin highly readable although full of "modernism", particularly in terms of vocabulary. Then, after introducing the text, the language and our editing method, we exposed the little things we had on our author, his life, his work and the intellectual context in which he evolved in thirteenth century Sicily, and the European craze for the Trojan material explains his choice to take this great myth in his Historia. Then, we had to mention the many sources used by Guido delle Colonne, its indirect or direct or unacknowledged sources. Lastly, we provided a summary of each book published and translated. Then follows a detailed bibliography on manuscripts and old editions of this text, textbooks, historical and cultural context in Europe and Sicily in the Middle Ages, the Greek texts, Latin and vernacular related to the Trojan War and that influenced our author near or far, the critical works on the treatment of this Trojan material in antiquity and the Middle Ages, and finally some bibliographic elements on Guido and his work. Then comes our edition-translation. The translation is accompanied by a double pageantry: one for the sources and reminiscences, and a critical apparatus that considers and compares the lessons contained in our manuscript with basic variants cited by the previous editor in some manuscripts that he used. At the bottom of the translation include scholarly notes for names or facts mentioned in the text and deserve an explanation. After this introduction and part philological edition, the second major part of this thesis consists of a comment and annexes. In our review, we wanted to examine our text in its narratological, thematically, linguistic, generic and ideological aspects. That is why we have devoted the first chapter to the narratological study of the text, its content, its layout, its narrative techniques, use of sources and its main themes. In a second part, we discussed the type and tone of the Historia, which intends to be a historical text while attending a fictional material since mythological, at a time when genres are not yet defined and less compartmentalized; we have also commented extensively and illustrated the choice of writing in prose and Latin at a time when fashion is to poetry and vernacular. In the end, our third chapter focuses on the scientific, political and ideological content of this text peppered with parentheses and moral scholars. Finally, we proposed a diplomatic edition of the unedited or translated part of the manuscript, as well as appendices on manuscripts and vocabulary, and of course the name index and a glossary of rare or surprising words

Ses chroniques sont autant d'exemples d'une écriture des moeurs, critique et satirique de la bonne société de son temps et notamment à l'égard d'une morale hypocrite et bigote. Satire des puissants, les écrits d'Hilda Mundy viseront également les travers et les scandales de la vie politique de l'époque ainsi que la montée du militarisme qui se profilait à la fin de la guerre ; ceci marquera le destin de l'écrivaine sous le signe de la censure. Son seul livre Pirotecnia, ensayo miedoso de literatura ultraista, publié à La Paz en 1936, est la suite de cette écriture des formes brèves, centrée sur la désacralisation des symboles du pouvoir. Les thèmes de la ville moderne, de la technique, du jeu et de l'attaque contre la tradition, présents aussi dans ses écrits parus dans la presse, constituent l'univers avant-Gardiste de Pirotecnia. A Bolivian writer in the thirty's - forgotten until the 90's - Hilda Mundy became known especially at the end of the Chaco War (1932-1935) and in the immediate post-War period as a humouristic columnist in Oruro, the town where she was born. All her columns are instances of a literature of manners, on which she turns a critical and satirical eye. Her remarks on hypocritical and sanctimonious moral standards of her time are particularly scathing. Hilda Mundy's texts satirize the powerful and target the faults and scandals of political life, and the rise of militarism which was looming at the end of the war. This marked the destiny of the writer under the sign of censure. Her only book, Pirotecnia, ensayo miedoso de literatura ultraista, published in La Paz in 1936 remains loyal to this type of writing, favouring short texts and focused on deconsecration of power symbols. The themes of the modern city, of technology, games and gambling and the attack on tradition, which are also present in her press articles, made up the avant-Garde universe of Pirotecnia. Movement and mistrust are at the heart of this modern literature, which is written in the first person. The self of Hilda Mundy's writing is enriched by its heteronymy and continues a poetic project related to an aesthetics of scenic arts, where the most important mask is that of language

François de La Noue (1531-1591), gentilhomme français et protestant, compose, alors qu’il est incarcéré, les Discours politiques et militaires, publiés en 1587 : nous en proposons ici une édition commentée, précédée d'une introduction. Celle-ci comporte sept chapitres dont le premier relate la vie de l'auteur, étroitement liée aux guerres de religion. Nous nous sommes ensuite intéressés à la genèse des Discours, avant d'établir un catalogue complet des éditions et émissions de l'œuvre. Un bilan des études consacrées à La Noue et à ses écrits termine ce chapitre. Puis, l'univers culturel de ce gentilhomme qui a manié l'épée et la plume est examiné : par l'identification des sources des Discours, nous avons reconstitué sa bibliothèque. Voulant restaurer l'État, il dénonce, en moraliste, la corruption des valeurs, et propose, en réformateur, un programme éducatif. Sa vision politique tirée des Saintes Écritures et son rôle politique joué durant les guerres font l'objet du chapitre IV. Le cinquième traite de la guerre tant du point de vue de sa légitimité que de celui des institutions militaires que La Noue cherche à améliorer. François de La Noue (1531-1591), a French protestant gentleman, composed, during his time in prison, Discours politiques et militaires published in 1587 : here we give you a commented edition, preceded by an introduction, made up of seven chapters. The first one describes the author’s life, closely related to the religious wars. We then focused on the genesis of the Discours, before establishing a complete catalogue of the editions and issues of the book. This chapter ends with an assessment of the studies devoted to La Noue. After that, this gentleman’s cultural universe, which wielded sword and quill is examined: by identifying the sources of the Discours, we have reconstituted his library. Wanting to restore the state, he denounces, moralistically, a corruption of values and he proposes, in way of reform, an educational program. His political vision, taken from the Holy Scripture and his political role during the wars make up Chapter 4. Chapter 5 looks at the war from both a legitimacy side and from the side of the military institutions that La Noue sought to improve. Speech XXVI, which talks about the history of the civil wars made us question, in Chapter 6, his conception and composition of history. We finish with a rhetorical approach to the question of the genre of the Discours. Several documents in the appendix bring clarification. To follow: Discours politiques et militaires, with critiques and historical and lexical notes. A glossary, an index and a bibliography complete this thesis

This thesis starts from the proposition that moral and ideological issues now drive the continuing intense interest in World War II. There has been an increasing challenge to the probity of the response of both opponents and bystanders to the threat raised by Nazism. The thesis views these issues from the viewpoint of the Spanish Catholic Church, an institution involved in yet detached from the war, having morality as its core concern yet itself struggling to reconcile moral principles with political imperatives. Such tensions might illuminate, in particular, the similar struggles of the Western Allies. This study has been set against a background of historiographical development. It has considered the evolution of Catholic teaching on the morality of war and threats posed to the Church in the early twentieth Century political world of conflicting ideologies. In Spain, the Church, quintessentially Spanish yet inspiring extremes of devotion and hatred in Spain's total, ideological Civil War, had been devastated by that struggle. In defending its urgent spiritual priorities during a new European war, it faced many challenges that necessitated reactions involving complex interplay of morality and politics. Not only was its relationship with the victorious Franco regime uncertain but it feared the infiltration into Spain of any of the European war's contending ideologies-Fascism and Nazism, Communism and liberal democracy. The thesis describes the Church's response. This work also takes the view that the intensity of the ideological struggle made World War II a war of unprecedented totality. This study examines the attitudes of the Spanish Church to aspects of total war. It concludes that, although the responses of the Spanish Church reveal interplay of the moral and the political, these reactions shed some light upon questions of war and morality still asked today.

Vietnam War literature is a reflection of a sustained tension between politics and history on the one hand and morality and the effect of the war on human nature on the other hand. Although the authors under discussion urge the reader to forget the political, moral and historical milieu of the Vietnam War, it is impossible to separate the war from those three factors and by extension, the literature that stems from it. I have chosen Philip Caputo’s A Rumor of War (1977) and Robert Mason’s Chickenhawk (1983) because I think they represent, perhaps in the simplest and least obtrusive way, the voices of 55 000 men whose names appear on a black, granite wall in Washington. The authors chose to write their respective memoirs for the Everyman who died in, or lived through, the aberration that was Vietnam. Through their reconstruction of the war and their experiences, they keep the demand for recognition of those who fought (whether morally sanctioned or not) in Vietnam for their country. While American society tried to force the war from its psyche because so many of them thought it was unjust, immoral and unnecessary, authors like Caputo and Mason demanded that the nation examine itself on the whole and reconsider its political endeavours. But perhaps one of the starkest revelations is their portrayal of the corruption of innocence, loyalty and idealism of those soldiers who represented their country abroad.

The fundamental elements that shaped and gave rise to Christianity as a dominant religious movement rest in the crucifixion, death and resurrection of the person of Jesus of Nazareth. Had there been no crucifixion and had Jesus died a natural death, there would be no foundation for the Christian gospel as we have it today. Jesus had to die a violent death and be a human sacrifice in order for him to be a historical figure that he is today. My point in departure is to highlight that the events that constitute history are in many aspects very violent in nature. Therefore, it may not be a great exaggeration to conclude that the shedding and spilling of blood is necessary in the making of history, since war and history are so joined together like Siamese twins. War is so much part of our lives, it is said that only the dead have seen the end of it. And history according to James Joyce, is a nightmare from which [he is] trying to awake. Such has been the explicit nature of Just War Theory as it is rooted in the backdrop of Christian conviction. This thesis seeks to illuminate the topic of Just War Theory from a Church and Augustinian perspective. It demonstrates how Augustine’s writings are a rich resources for theological, political and judicial reflection on international politics. It critically examines the connection between Church and State, that is to say, the origins of the Just War Theory. Further, it goes on to demonstrate that for Augustine the two are intertwined and God ordained. It draws conclusions for current Just War practices as outdated since its failure to attain world-peace.

Despite long being surrounded by controversy, trauma remains a pervasive medical-moral discourse to explain suffering and distress. Anthropologists have often been critical of the globalisation of medicalised subjectivities such as trauma, yet few have sought to examine how the notion of trauma itself changes as it travels through different cultural and political milieu. This project is a grounded ethnographic study of how this globalised and vernacularised trauma construct has come to feature within the moral imagination in Aceh, Indonesia. The loanword 'trauma' has become a key idiom of distress through which Acehnese people understand illness and suffering and narrate the implications of a life lived through war. I argue that through this narrative work my interlocutors not only describe their experience but attempt to transform the medical-moral realm that trauma describes. The thesis begins by discussing the clinical and social history of trauma in its Indonesianised form. I show how trauma has been shaped not only by psychiatrists and international NGOs, but also by the media, the military, state officials and social movements who together produced and popularised trauma as a medical-moral idiom. I then move on to contemporary Aceh, showing how my interlocutors use trauma to reflect on the nature of history, suffering and bravery (Chapter Three). I explore how trauma has become integrated into spirit possession practices, and come to shape understandings of the body, illness and the limits of sensory experience (Chapter Four). In Chapter Five, I discuss understandings of death and destiny in relation to trauma, and explore the ways that the tsunami and the conflict shaped normative responses to suffering. In Chapter Six, I look at the question of stigma, showing how a diagnosis of trauma paradoxically enables Acehnese people to problematise madness and interject in the association between madness and colonisation. By making a shift to seeing trauma as an idiom of distress through which people think, rather than a disease from which people suffer, it becomes possible to see how trauma plays a significant role within Acehnese medical practice and political imaginaries. Trauma has become a salient medical-moral idiom in Aceh not only because of the political power of biomedical psychiatry but because the moral imaginary of medicine and the body has been reconstituted through Aceh's history of violent conflict. Bringing together critical medical anthropology with the anthropology of violence, this project is a case study of the ways through which medicine and illness become reimagined, challenged and reconfigured through the suffering of war.

Entre 1970 e 1974 a música foi usada de modo experimental na ação psicológica da Guerra Colonial Portuguesa no Enclave de Cabinda ao norte de Angola, como modo de elevar o moral das tropas. O presente estudo etnomusicológico decorre da análise de entrevistas a um grupo de ex-combatentes selecionados de um batalhão do exército português e a documentos oficiais militares e civis relacionados com este período em Cabinda: relatórios e cartas governamentais e dos combatentes, filmes, fotos e fonogramas entre outros, sustentam a análise desenvolvida. O trabalho de campo realizado entre 2012 e 2014 teve em particular atenção o modo como a memória agiu na reconstrução da informação acerca de experiências do passado, no grupo em causa. De entre os ex-combatentes selecionados a diversidade de patentes e funções, de furriel a tenente-general, da chefia do inaugural serviço de ação psicológica à operação de rádio comunicações, passando pela de entretenimento e animação, assegura neste estudo uma visão considerada muito representativa neste estudo. Futuros estudos poderão colher na informação aqui apresentada, original, que assim se disponibiliza para o desenvolvimento de um campo de investigação que se encontra apenas ainda em fase inicial.
Between 1970 and 1974 the music was used experimentally in the psychological action of the Portuguese Colonial War in the Enclave of Cabinda, north of Angola, as a way to stimulate the morale of the troops. The present ethnomusicological study stems from the analysis of interviews with a group of ex-combatants selected from a battalion of the Portuguese army and official military and civil documents related to this period in Cabinda: reports and letters from government and militars, films, photos and phonograms among others, support the analysis developed. The field work carried out between 2012 and 2014 paid particular attention to the way in which memory acted in the reconstruction of information about past experiences in the group in question. From the ex-combatants selected, the diversity of patents and functions, from furriel to lieutenant-general, from the head of the inaugural service of psychological action to the operation of radio communications, through entertainment and animation, ensures in this study a view considered very representative in this research. Future studies will be able to gather in the information presented here, original, that thus becomes available for the development of a field of investigation that is only still in initial stage.

Rape had an indelible effect on the American Revolutionary era. Using trial testimonies and depositions, newspapers, and literary sources, this thesis argues that there was a level of continuity between peacetime and wartime rape characterized by the assaulters’ modus operandi and rape’s ideological exploitation. Eighteenth-century Anglo-American society dictated that rape, or “carnal knowledge of a woman forcibly against her will,” was only a crime against virtuous white women. The gendered and racialized ways pre-revolutionary society identified and prosecuted rape influenced how rapists conducted their assaults. Women had to prove their sexual morality, that penile penetration and male ejaculation occurred, and that they sought help immediately after the assault to prosecute their attackers. During the war, rape became an important metaphor. Wartime publishers and propagandists used reports and victim testimonies as evidence of British immorality and to justify political independence. The rape of America subsumed individual atrocities. The nationalization of women’s sexual virtue continued into the new Republic. Artists and writers memorialized the Revolution through explicitly sexualized narratives and sentimental novels that emphasized female sexual morality. Women’s sexual virtue was linked with the stability of the Republic. This thesis utilizes a diverse historiography to highlight the intersectional correlations between rape and eighteenth-century patriarchal power in America.

abstract: ABSTRACT This study explored the functions of dialogue in emerging adults' moral turning points. Through purposive sampling, the researcher interviewed 10 emerging adults between 25 and 30 years old about experiences of turning point conversations during the years of 18 and 25. This study employed constant comparative and grounded theory methodologies to analyze messages reported in memorable conversations during this period. Results indicated that dialogue functioned to educate, disturb, and maintain emerging adults' moral perception during this period of moral reorientation. Subcategories under each included dialogue that functioned to explain, invite, warn, direct or instruct, challenge, persuade, agitate, expose, inquire, legitimize, co-reflect, redefine, and affirm or reinforce. This report cites passages from interview data to highlight how dialogic themes informed or shaped changes in moral perception. In each participant's self-reported turning point conversations there was an admixture of dialogic functions at work. Notably, participants' experience of moral turning (degree and trajectory) varied despite there being similarity in intended functions of dialogue.

The focus of fighting tyranny and the justifications of the consecutive wars in fantasy literature for children and young adults play a noteworthy role in the intertwinement of literature and its educational potential. This genre is filled with numerous images of violence, in particular different scenarios of war and its justifications. In the books war constitutes the final battle between good and evil, and thus manifests the protagonists’ ultimate moral decisions between these two forces. The following books constitute the corpus: C. S. Lewis’s The Chronicles of Narnia (1950-56), Susan Cooper’s The Dark Is Rising Sequence (1965-77), Philip Pullman’s His Dark Materials (1995-2000), J. K. Rowling’s Harry Potter series (1997-2007), Christopher Paolini’s Inheritance Cycle (2002-11), Amanda Hemingway’s Sangreal Trilogy (2005-07), and P. C. Cast and Kristin Cast’s House of Night novels (2007-2014). Although not all the books feature wars, all display justifications for war and the imperative to fight tyranny. Located within an intersection of diverse critical theories, my thesis engages literary texts in order to reflect on their capacity to negotiate, challenge, subvert, and perpetuate values and power structures. Motif analysis forms the centre of this analysis. I deploy a varied approach to literary analysis, relying upon literary and cultural theories (especially theories of ideology) to understand the realizations of the different motifs. Through issues of character construction, (political) authority, religion, and the construction of difference, the reader learns much about the culture and values of the respective world. Furthermore, this analysis invites the reader to find parallels between the fabricated world and the real world, and thus transfer what s/he has learned from the texts his/her own world. Engaging in such a reading ensures the drawing of direct connections between the reality constructed in the books on the one hand, and politics, the construction of difference, religion, and just war theory in the reader’s world on the other. The content analysis leads to broader cultural messages, which comprise assumptions about gender, power, ethnicity, religion, and morality. This methodology emphasizes the relevance as well as the complexity of the books and their educative potential, and facilitates the analysis of the books as tools for the defence and perpetuation of Western values and culture.

The diploma thesis deals with the terrorism and war, their meaning in the globalised world and with the possibility of ethical justification of violence. Theoretical part delineates terrorism, its terminology and political and social environment. It describes kinds and methods of terrorism, its history and some of the terrorist organizations with their goals. The thesis also compares terrorism and war in the parts where they intersect. In the next chapters it presents original ethical theories which would be supported by the moral assessment of violent enforcing of interests. There is explained the term of just war, its basic principles and obligatory attributes. Practical part characterize three chosen actual conflicts: the Al- Qaeda attacks on the United States from 11th September, 2001, Chechnya war for its autonomy and current factual occupation of Iraq by allied forces. Legitimate setting in the sense of ius ad bellum, the right to defend by the use of violence, was not mostly deconstructed. In the area of ius in bello, the right in the war, the hypothesis was not verified and the particular violent action did not fulfill some of the basic principles of just war.

Abstract (sommario):
Le présent mémoire aborde les problématiques morales de la scission corps-esprit chez les soldats de la guerre du Việt Nam telles que représentées à travers certains films traitant de cette guerre. Notre démarche sera centrée sur le travail individuel que propose le film Apocalypse Now, plutôt que sur la representation de la guerre. Nous postulons que ce film met les individus devant les contradictions inhérentes d'une société qui prétend justement pacifier le monde en faisant la guerre, et qui plus est, comme ce fut le cas au Việt Nam, au moyen d’un déchainement de violence qui dépasse l'entendement (torture, massacre de masses, napalm et Agent Orange). Notre hypothèse est que le film, à travers son personnage central, nous propose une « voie » qui n’empêche pas la guerre, certes, mais permet du moins d'entreprendre une demarche de distanciation et de redefinition morale individuelle permettant de survivre au(x) temps de guerre(s). Cette mutation morale, chez le personnage principal, s'acquiert au bout d'un voyage réflexif à tout point de vue « au coeur des ténèbres » – de la jungle, tout autant que de son être.
This master’s thesis addresses some moral issues of the body/spirit dichotomy, induced in the military training, in the Vietnam War vets as portrayed in several films on that war. Our work will be centered on the work of the individual as suggested in Apocalypse Now, rather than on the depiction of the war. We contend that this film puts the individuals in front of the contradictions of a society that pretends to pacify the world using war, and inasmuch, as was the case in Vietnam, using a conspicuous outburst of violence (torture, mass murder, napalm, Agent Orange). We hypothesize that the film, through its main character, propose a “way” which doesn’t eradicate war, but suggest that we can take a step to redefine our moral standpoint in front of ourselves to heal the wounds caused by Wars. This individual moral mutation, in the main character, is the result of a reflexive process, on all accords at the “heart of darkness”, of the jungle as much as of his soul.
