This is the first study of the Athenian juvenile justice system and, indeed, of any such system in Greece. The thesis concentrates on the operation of the juvenile court, the probation service and the role of the police in the formal and informal handling of delinquent and anti-social minors. In his proposals, the researcher reconceptualises the local justice system in a way which encourages the informal handling of petty offenders, the development of a range of community alternatives for the rising number of repeated and serious offenders and the enhancement of its links with the local community.

Research indicates that states have implemented juvenile justice reforms to enact harsher punishments, to transfer greater numbers and younger juvenile offenders to adult criminal court, and to restrict discretion of the juvenile court judges. Social science studies have found that harsher punishments, transfers to adult criminal court and other measures do not work, but that comprehensive approaches which address the numerous major factors contributing to juvenile offending have been successful. This study examined the legal status of the juvenile justice system by focusing upon ten diverse sample states and analyzed the social science research on factors contributing to juvenile offending and on prevention, treatment, and rehabilitation approaches. The study was accomplished by legal research, qualitative social science research, and analysis of both. Findings indicated: a) state statutes require and allow adult punishment of juvenile offenders, transfer of juvenile offenders to adult criminal court, and direct filing of charges against juveniles in adult criminal court; most states begin these proceedings at age 14, some have no age minimum; b) social science research indicates numerous factors contribute to juvenile offending with most of the factors categorized into the major factors of early antisocial behavior, deviant peers, parents and family, sociomoral reasoning, biological factors, and violence which interact with each other creating a complicated web; and c) prevention, treatment, and rehabilitation efforts should be comprehensive, multidimensional and multimodal addressing the interacting major factors contributing to juvenile offending and the needs of the juvenile, the family, and the home environment. Implications include the need for legislators to access the social science research to craft legislation and programs which are effective. Suggestions for improvement include collaboration within communities and with knowledgeable and committed social science professionals and educators. Areas suggested for further research include education of the public, the media, and stakeholders; long term follow-up on promising programs; design and improvements in approaches based upon the social science research; meeting the needs of the juvenile, the family, and the home environment; and study of how the factors may differ for disabled juveniles.

Each year more than 100,000 juveniles are incarcerated in residential rehabilitative facilities. As part of their course of treatment, educational services are mandated for these incarcerated youth. Programs serving these individuals must provide adequate and appropriate educational programs for these juveniles. With a growing public concern over juvenile delinquency and recidivism, programs are being held accountable for the effectiveness and quality of the programming they offer. In Florida, juvenile justice programs offering educational services are monitored annually by the Juvenile Justice Education Enhancement Program. These programs receive a Quality Assurance (QA) rating as determined by a review team that spends several days in the program reviewing documentation and interviewing youth and program staff. This study proposes to examine any potential relationship between the rating a program receives and how successful youth are in returning to mainstream society and subsequently school. Linear regression analysis is the main statistical method to answer four research questions designed to examine these potential relationship. A total of 177 Moderate and High Risk programs were included in the study and the QA scores they received over a three year were analyzed. Surprisingly, the research and subsequent analysis shows little relationship between educational program quality and success rates for juveniles exiting incarceration. This result may warrant further study as to the additional factors contributing to a youth's re-involvement in the juvenile justice system.

The Nevada State Juvenile Justice and School systems do not currently screen or treat juveniles for post-traumatic stress disorder (PTSD). Left untreated, PTSD may contribute to behaviors that can lead to engagement with the juvenile justice system and contribute to high rates of recidivism and possible future engagement with the adult justice system. Using Erickson's theory of psychological development as the foundation, the purpose of this case study was to explore whether, from the perspectives of key stakeholders whether interventions and prevention services for juvenile justice clients in Carson City met the needs of youthful offenders also diagnosed with PTSD. Data were collected through in-depth interviews with 2 mental health counselors, 6 juvenile justice administrators, and 10 parents. Interviews were transcribed and then subjected to Braun and Clarke's thematic analysis procedure. The findings of the study revealed 2 primary findings. First, the juvenile justice system is adequate in terms of identifying youth with mental-health issues and referring to behavioral-health providers when appropriate. Staff, however, may not have adequate training to provide proper intervention when necessary. Second, service delivery by behavioral-health providers fails when health care providers do not accept feedback from stakeholders that may result in inconsistent intervention services. Recommendations to the juvenile justice system decision makers to adopt a validated risk and needs assessment tool to asses all youths' level of care and mental health status and treat youth with mental-health issues separately from other justice-involved youth may lead to improvements in intervention services thereby decreasing youths' involvement with the juvenile justice system.

Within the Florida Department of Juvenile Justice system, juvenile delinquency referrals have decreased, yet at the same time, juvenile recidivism rates continue to challenge policy makers. Using Hirschi's social learning theory as the foundation, the purpose of this descriptive phenomenological study was to examine the perceptions of juvenile justice professionals about their experiences with youthful offenders in order to determine the causes of juvenile recidivism. Data came from in-depth interviews with 9 participants including state attorneys, judges, and mental health counselors from within the central region of the state of Florida. Data were analyzed and coded using Colaizzi's method. Two primary themes emerged from the analysis of data: First, participants perceived that the influence of peers and factors such as environment, family criminal and mental health history, substance and abuse, truancy have a significant effect on juvenile recidivism. Second, participants perceived that parent bonding is the most important factor in reducing recidivism among juveniles aged 17 and 18 years old. The positive social change implications of this study include recommendations to the Florida Department of Juvenile Justice to implement, modify, and improve services and policy to reduce recidivism for juveniles aged 17 and 18 years old. This implementation, modification, and improvement may reduce recidivism among this subgroup of juvenile delinquents and may reduce the number of young adults entering the criminal justice system.

The juvenile justice system was originally set up under the philosophy that juveniles are inherently different than adults and therefore should not be subject to same harsh punishment as adult criminals. Rehabilitative treatment methods became the center of the juvenile justice system in order to reduce recidivism rates and help reintegrate youths back into society as smoothly as possible. This philosophy changed early in the 21st century, and many states began treating youth offenders in ways similar to adult offenders, with a particular increase in direct files of juveniles to adult court. After about a decade of harsh punishment, the system once again reverted back to the rehabilitative model. California did so through several legislative reforms; however these reforms have not been as successful as they should have been, and the system is still in a state of disarray. California is currently balancing a failing state juvenile justice system while trying to simultaneously support realignment efforts to the county level. After evaluating the failures of Division of Juvenile Justice and the capacity of the counties, it is evident that counties are not only physically equipped to take on the increased responsibility but are much better suited to do so financially. To best uphold the original goals of the juvenile justice system and the rehabilitative model, California should move to close the Division of Juvenile Justice and completely realign all responsibility to the counties. Keeping juveniles close to their communities creates stronger ties, more continuity of treatment, and reduces the likelihood a youth will reoffend. By tailoring treatment to the individual on a local level, problems such as mental illness, substance abuse, and anger management, can be directly targeted and solved. Intervening at first arrest with effective treatment programs is crucial to decreasing the chance that a juvenile will become a career adult criminal. These juveniles are the future of society; focusing on the rehabilitation of these youths will not only increase community safety but will also produce healthy, productive citizens to contribute to the economy.

Juvenile delinquency in the nation’s cities, suburbs, and rural communities has been considered a longstanding problem with severe implications for not only youth offenders but their families and communities as well. The source of juvenile delinquency has been attributed to a number of factors including the breakdown of the family, antisocial behavior as a result of the child’s environment, and rapid urbanization of America’s cities. No matter the source, the problem of juvenile delinquency has been addressed by a variety of stakeholders including law enforcement agencies, community organizations, and school systems with the purpose of diminishing the problem. The current climate of juvenile justice reform is shifting toward prevention and intervention, rather than complete suppression by way of detainment. According to the theoretical framework applied to this study, a consideration for understanding forms of deviance relates to social controls and the presumption that conformity is not intrinsically accepted, but is the result of internal and external motivations or factors. This research was conducted to evaluate the effectiveness of the Youth Against Violence (YAV) program, which focused its efforts on reducing juvenile delinquency in the community and assisting youth to meet bond conditions in order to reenroll in traditional public schools. Participants were referred to the YAV program by court order, school referral, or parent/self referral for participation in an 8-week intervention and prevention program to help rehabilitate offenders for the purpose of successful re-entry into the community and completion of their education in public schools. To determine program effectiveness, this study utilized several independent variables including parental involvement, participant demographics, gang membership/affiliation, program curriculum, frequency of contact with law enforcement, family history with law enforcement, and extended family support. These variables were selected to measure participants’ perception of YAV program effectiveness. This mixed method analysis utilized participant surveys, focus groups with former participants, parents of former participants, and interviews with YAV personnel. The research concludes by identifying the significant relationships between the dependent and independent variables revealed in descriptive and correlative statistics. The research also discusses the emergent themes related to program effectiveness that were identified in qualitative analysis. Finally, the research provides recommendations for program practice, juvenile justice policy, and future rehabilitative and reentry research based on the research findings to assist practitioners with the development of prevention and intervention programs that can effectively deter youth from engaging in delinquency.

This thesis explores the recent introduction of restorative justice into the youth justice system in England. It examines the historical and political context from which current youth justice policies have emerged and aims to evaluate how this new system is functioning 'on the ground' several years after being implemented. Specifically, the primary aim of the research is to investigate final warnings and referral orders. The findings are based on an in-depth study of one Youth Offending Team (YOT). The research adopted a predominantly qualitative, case study based method utilizing techniques of observation, informal conversations, formal interviews with the young offenders and their supporters as well as with authority figures who are amongst those responsible for policy and practice in the youth justice system. The substantive chapters of this thesis focus on the delivery of final warnings, referral order panel meetings, victim participation, and the structural, cultural and political influences on YOT practice. This research concludes that at present, restorative practices in England are seriously compromised. However, simply because these programmes experience difficulties, they should not necessarily be considered a failure. The present failures in practice are not related to the philosophical foundation of these programmes or even to the way in which they have been set up. Rather, the current shortcomings in practice are due mostly to a failure of implementation on the part of the YOT. The final warning and referral order programmes, if improved, have the potential to become an effective first encounter with the criminal justice system and to impact positively on many first time offenders.

The juvenile justice system was established as a result of an unprecedented movement pioneered by the child savers. Child savers strived to protect America's children from physical and moral harm. Since the juvenile justice system's inception, research has focused extensively on the effectiveness of the juvenile system. Numerous studies have observed the perceptions of the general public, juvenile probation officers, and juvenile correctional staff regarding the juvenile justice system. The current study examined actual participants in the juvenile justice system to assess their opinions of the system that was designed to serve, protect, and rehabilitate them into active members of society. A survey was conducted with juvenile offenders who had been placed on court mandated juvenile probation, and their responses were analyzed and compared with previous research regarding the effectiveness of the juvenile justice system.

Conferencing is a Restorative Justice practice operating in juvenile justice systems in Australia. Some conferences are convened by police, despite research demonstrating that ethnic minority youth often view police as biased or untrustworthy. Justice research in evaluative legal procedures indicates that perceived third party bias and outcomes delivered by a third party affect fairness judgments. Many disputants regard conferences as more fair than court. However, psychological mechanisms underlying fairness judgments in conferences, where offenders participate in outcome decisions, have not been directly investigated. This research program examined the effects of outcome and perceived convenor bias on procedural and distributive justice ratings in conferencing. Past research indicates that people high and low on Hofstede??s power-distance dimension differ in their emphases on outcome and third party bias when forming fairness judgments. This thesis investigated whether power-distance moderated the interactive effect of trust and outcome on fairness judgments in conferences. Study 1 established power-distance variation in a university sample, and similarity with a community sample on perceived police bias. Study 2 confirmed that high power-distance people who consider police biased against them may nonetheless choose to participate in police-convened conferences. Studies 3 and 4 extended previous research examining interactive effects of trust and outcome on justice judgments in evaluative procedures, investigating whether power-distance moderated this effect. No significant effects of power-distance and trust emerged, but the findings demonstrated the importance of outcome fairness (correspondence between outcomes and beliefs) in determining procedural justice. Studies 5, 6 and 7 extended this investigation to conferencing procedures. Studies 6 and 7 employed a computer-simulation, allowing participants to interact with a conference transcript and select outcomes, thereby investigating the effects of trust and power-distance on outcome choice, as well as the effects of trust, power-distance, and outcome on justice evaluations. Studies 5 and 6 were unsuccessful in manipulating bias by varying convenor identity (police versus civilian). Study 7 successfully manipulated bias according to convenor behaviour and revealed that third party bias in conferencing affected outcome choices but not fairness judgments. Results are discussed in terms of implications for culturally-relevant police practices, procedural justice theory and conferencing policy.

Prosecutors have enormous discretion in the criminal justice system. Their decisions can ultimately impact and shape the course of the lives of the offenders whom they prosecute. This is certainly true for juvenile offenders considered for transfer to the adult court. Previous research indicates that serious, violent offenders are the most likely to be transferred to the adult court. However, very little is known on prosecutors' views of the role of the juvenile court, the process of transfer or the facts that influence their decision to transfer a juvenile to the adult court. A statewide survey of 800 Florida prosecutors was implemented using factorial vignettes. The results indicate that prosecutors support the idea of transfer generally, particularly when they are making the final determination to transfer to the adult court. Further, prosecutors indicate that juvenile transfer should be used sparingly, in extreme cases that are not appropriate to the resources of the juvenile court. The data were also examined to determine the effect of juvenile offender and juvenile offense characteristics on the decision to transfer a juvenile to the adult court. Analysis revealed several significant predictors of preference for transfer: age, threat to society, presence of a violent offense, ethnicity of juvenile, presence of prior adjudications, and amenability to treatment.

Approximately 2.2 million children and adolescents are arrested each year, and these youthful offenders often display serious psychosocial dysfunction across a wide spectrum of areas: family dysfunction, mental health distress, problems with drug use, risky sexual behaviors, and a history of traumatic experiences. Of particular interest, the rate of female adolescent arrest and incarceration has been on the rise over the past several decades, yet female juvenile offenders are understudied compared with their male peers. It is important to identify risk factors that predispose certain female adolescents to criminal behavior to inform future interventions. Given the associations of mental health problems, substance use, trauma, and family dysfunction with crime in adolescent girls, further study is warranted to more clearly understand the links between these psychosocial factors and criminality in adolescents, especially girls. The impacts of mental health disorders, family functioning, risky sexual behavior, trauma, and substance use on juvenile justice involved youths are of great public health and social importance because of the potential to intervene and to prevent criminal behavior in at-risk teens. However, the relationships between these risk factors and the severity of juvenile offending in girls have not been studied adequately. By analyzing data from interviews and follow-up criminal records for almost 500 arrested and detained adolescent girls, we first investigated the associations between concurrent substance use and psychosocial dysfunction in this population. Secondly, we examined which psychosocial domains (i.e., mental health disorders, substance use/abuse, trauma, sexual behavior, and family functioning) were most predictive of recidivism and violent recidivism during adolescence for this group of offending girls. Finally, we studied which psychosocial variables best predicted time to next arrest, thereby determining if psychosocial functioning can also predict the amount of time before a given adolescent reoffends. Our findings indicated that substance use and sexual risk behaviors are the most important psychosocial predictors of poor outcomes in adolescent female juvenile offenders.

As a growing field of research, neuroscience receives more and more attention from lay people as well as professionals in various contexts. This ESRC funded dissertation investigates how neuroscientific research findings influence juvenile justice practice in Scotland. The study concentrates on the aspect of aggressive behaviour in children and young people. The thesis begins by reviewing juvenile justice practice in Scotland. This is followed by an overview of key neuroscientific research findings possibly relevant for juvenile justice practice. Further context for this dissertation is provided by a review of the theoretical frameworks for understanding how practitioners use knowledge with particular reference to knowledge production and transdisciplinarity in social work. The thesis then moves on to an empirical analysis, based on a case study approach employing qualitivative data collection methods in addition to a discourse analysis of relevant neuroscientific research publications. The empirical chapters explore different aspects and perspectives of the process, by which neuroscientific research findings move from a scientific paper to juvenile justice practice. The conceptualisation of aggressive behaviour in the different social worlds of juvenile justice practice and in neuroscientific research publications is examined, and aggressive behaviour is identified as a boundary object that spans the analysed social worlds. The perspective of training providers and practitioners on the utilised neuroscientific knowledge is explored. The conceptualisation of neuroscience is then placed in the context of the day-­‐‑to-­‐‑day realities of juvenile justice practice, with the aim of understanding how this knowledge potentially changes practitioners’ perspectives towards service users. The knowledge utilisation process is investigated, with focus on the different actors and their roles in a context of transdisciplinarity in juvenile justice practice. In conclusion, the thesis provides recommendations for knowledge providers, practitioners, policymakers and academics by considering ways of improving a critical perspective on knowledge from other disciplines; encouraging training providers and practitioners to become more active participants in this knowledge utilisation process; and by including the need for working environments where active knowledge utilisation is integrated in the work place.

This dissertation assesses the factors that influence the development of juvenile justice policy in France and Germany within the context of systems theory, The project utilizes an open/closed systems framework as a way to conceptualize determinants of juvenile justice policy. France and Germany serve as two single case studies for demonstrating the open and closed dichotomy that characterize system theory with France being characterized as a closed system while Germany is characterized as an open system. This difference is demonstrated through a discussion of historical, cultural, political, social and economic variables, which shape policy development in each of these countries. This project contends that a significant contribution is made to the understanding of policy making using the open and closed systems framework. Design and methodology: Single case studies : France and Germany Development of common variables to be investigated across two systems Focused interviews with key informants, non-random sample, one-on-one, in person, purposive, taped and transcribed Content analysis of focused interviews Content analysis of juvenile justice policies in France and Germany Database searches of print media coverage A review of documents: laws, policies, penal codes, newspapers, legislative minutes Comparative analysis Data analysis: qualitative and quantitative techniques, mixed methodology Gathering of public opinion poll information Summary of the findings: 1) The preponderance of information indicates that the relationship between policy change and media coverage is strongly related in both France and Germany 2) Public concern over juvenile crime in France has the greatest influence on the implementation of policy rather than on policy development. The research indicates that in Germany, public opinion has a decided influence on the formation of public policy 3) The evidence seems to indicate that the process of policy making in Germany is more complex due to the open nature of the system, while in France the policy making process is simpler due to the closed nature of the system. 4) The evidence indicates that the French juvenile justice policy is as prevention-oriented as the German policy, in spite of France being characterized as a closed system. The open and closed framework provides two mutually exclusive models that can be used to assess, in an eflicient manner, factors that influence policy development. Through comparison and contrast, a variety of factors that may shape policy can be articulated using the open and closed dichotomy.

The criminal justice system is filled with theories regarding the treatment of convicted offenders, one such theory is the restorative justice approach. This approach stands apart by aspiring to educate offenders while repairing community bonds. If this approach has the intended impact when implemented in the juvenile justice system, it presents an alternative to the traditional system by reducing the number of repeat offenders and preventing new offenders from arising because of the increased community involvement. In order to assess the effects and implications of restorative justice, the Community Justice Boards program of Pima County was looked to as an example of the application of background and theories pertaining to restorative justice in the juvenile justice system. Moreover, the potential benefits, short comings, and cost effectiveness of the implementation of restorative justice programs were examined. The findings that arose from the research conducted on the topic of restorative justice include that they have the possibility of being cost effective. Further, this form of policy has positive impacts on community involvement as has been the case with the Pima County system, but could benefit through the expansion of offenses addressed and a firm level of monitoring to ensure these programs do not stray from their goals.

This study examined how restorative justice programs impact the probability of recidivism among juvenile offenders. It compared juveniles who completed restorative justice programs versus juveniles who were released with warning from the courts. Both groups were compared to determine if restorative justice juveniles outcomes differed based on recidivism. Logistic regression showed that restorative justice programs had statistically significant increased odds of recidivating when compared to juveniles released with a warning. However, when the groups of restorative justice were disaggregated, only the adjudicated juveniles were statistically significant. Survival time analysis showed that restorative justice juveniles have longer survival times of recidivism when compared to juveniles released with a warning. Suggestions for further research and analysis are discussed with respect to the current results.

Juvenile delinquency is a social issue which has been shown to have a significant cost to society in a variety of ways which include community safety, the cost of arrest, charges, and court processes, as well as the damage done in families and to the youth through the label of juvenile delinquent or Person in Need of Supervision (PINs). One important area in treatment and discharge planning for youth designated as either juvenile delinquent or Persons in Need of Supervision is the inclusion of supports to help youth change the trajectory from these behaviors into more socially acceptable activities and actions. The research problem addressed in this study is that the supports utilized at this time are insufficient and ineffective, as evidenced by rates of recidivism. The purpose of this study was to explore whether the use of non-custodial grandparents in treatment and discharge planning as a support system is of value to the youth and their parents. Using a grounded theory methodology, professional staff from Multidimensional Treatment Foster Care (MTFC) programs, now known as Treatment Foster Care Oregon (TFCO), which work with these youths and their families and was developed based on social learning theory, participated in interviews to obtain data regarding the use of non-custodial grandparents and whether they were found to be of value. The results of the study support the use of grandparents under specific conditions, such as when they have positive relationships with parents and when they are positive role models themselves. NVivo 11 software was used to assist in the process of analyzing the data collected from these professionals. The implications for social change remain that the process of assisting youth to make these changes could create safer communities with lower crime rates, and decreases in the costs associated with the legal process, and these savings can then be passed on to communities and to the taxpayer.
