A Materialist Theory of Justice offers an innovative (re)reading of justice that draws from diverse theoretical currents, tracing in the process an age-old tradition of critical thought. Raising the banner of materialism against idealist conceptions, justice is conceived as a multiple process, which emerges in the dynamic reproduction and interaction of material bodies. Mapping out its presence on non-human fields, justice is then shown to attain in human beings the status of a contentious problem and a productive desire, which is related to the pursuit of a good life and is also determinative of human history. The theorization enlarges the scope of the notion by incorporating a wide spectrum of phenomena, from animal forms of sociality and activity, to revolution, empire, civil war up to and including the riots that spread out in the world today. In this way, the book also manages to extend beyond the disciplinary boundaries of normative political theory, within which theories of justice are usually logged, and enter a productive discussion with various currents of critical thought.

Abstract Many liberal political philosophers hold that the state should not impose or even promote any particular conception of the good life or human flourishing. Instead, the state should restrict itself to maintaining a fair framework of rights and opportunities within which all citizens can pursue their own ideas about the good life. Against this backdrop, this book defends a perfectionist political philosophy. Whereas previous perfectionists have argued that the promotion of flourishing ways of life is permissible or legitimate, the author casts perfectionism as a doctrine of justice. On this view, the implementation of laws and policies designed to promote sound ideals of the good life — ideals such as moral, intellectual and artistic excellence — is not merely a legitimate complement to justice but an essential constituent of justice. Over the years, liberals have criticized perfectionism on various fronts: that it relies on value judgements that are controversial within modern pluralistic societies; that it is unduly restrictive of freedom and autonomy; that it treats citizens as if they are unable to run their own lives; that it expresses the meddlesome mentality of a village busybody; that it mistakenly assumes that there are objective truths about human flourishing; and that it risks the abuse of power by incompetent, overzealous or corrupt state officials. These ideas represent some of the deepest, most vibrant and most powerful strains in liberal thought. In defending perfectionism against these charges, the author’s arguments make a novel contribution to longstanding debates about the philosophical foundations of liberalism.

Abstract (sommario):
This chapter demonstrates the dynamism and utility of positioning theory, in the domain of social justice. The illustrative examples are drawn from international intergroup situations, particularly in Afghanistan and Iraq. These situations involve interpretations of rights and duties by different groups, rights and duties being central to positioning theory. The chapter critically explores the questions of whether there are universals in rights and duties, and whether people apply moral principles consistently across contexts. Both the traditional empirical research literature and positioning theory reveal that context has an important influence on moral thinking, including on the interpretation of rights and duties.
