The arena of tension between kasepekang indigenous sanctions and legal humanism occurred in the Paselatan Traditional Village, Karangasem Regency, Bali. One family residing in the traditional village received customary sanctions in the form of being temporarily dismissed as krama (citizen) due to not being able to pay off debt loans at the Paselatan Traditional Village Credit Institution. Dismissal as a krama of a traditional village in Bali is commonly called a kasepekang indigenous sanction. There is a gap between what should be in the law, both in the regulation and implementation of the law, with the reality that occurred in the Paselatan Traditional Village; There are still traditional Kasepekang sanction which are considered to violate humanism values. This study analyzes: first, the enforcement of the indigenous sanction of kasepekang which are considered to violate the values of legal humanism. Second, the implementation of progressive legal principles in the case of bestowing kasepekang sanction in the Paselatan Traditional Village as a mediator between the legal tensions of the kasepekang indigenous sanction and legal humanism. The research method used is a normative research method. The theory used as an analysis is progressive legal theory. The results of the study concluded that the indigenous sanction of Kasepekang are not in accordance with philosophical, sociological values, and are contrary to the juridical aspects and are contrary to the theoretical aspects, especially the progressive legal theory. Progressive legal principles are applied as an end to the tension between Kasepekang indigenous sanction and legal humanism.

Abstract (sommario):
Legal development aims to realize justice, certainty, and legal benefits, so legal development is explored in the social interaction of society itself. This research is concerned with the development of progressive and humanist law based on local wisdom. The concept looks at the relationship between 1) local wisdom and legal development, 2) local community participation and legal development, and 3) progressive legal development based on local wisdom. The type of juridical sociological research, data collection techniques with documentation, observation, and interviews, then the data analysis technique used is the interaction analysis model. The results of the study are the existence of local wisdom values in influencing the development of law in the community, namely the value of mutual cooperation and the value of deliberation. Community participation in the development of law in society has space for community participation in legal developments since planning, implementation, monitoring and evaluation. The values of local wisdom and community participation have potential in the development of progressive-humanist law, namely in the development of progressive and humanist law influenced by the values of local wisdom and the role of community participation so as to be able to build a law of conscience, respect human dignity and be able to provide a sense of justice according to the noble values that live in society. The suggestion from this research is that the community always maintains and preserves local wisdom that lives and grows in people's lives. The community and local government always maintain a synergistic relationship in the implementation of democratic community participation. In policy planning, it always explores the values of local wisdom in society and always involves community participation in creating progressive and humanist laws.

The philosophical thought of law in a new paradigm that identifies reason as the primary source of law, emphasizing rationality and humanism in the development of modern law. This emphasizes the inseparability of law from social life and the formation of legal values within communities, shaping norms that guide social behavior and reflect the essence of law. The discussion extends to studying indigenous communities, especially in Kalimantan, where customary law arises from experiential actions, recognized and regulated by the Indonesian constitution, acknowledging the existence of written and unwritten laws within the framework of customary law. The research method used is normative juridical with a conceptual approach based on these issues. The research findings indicate that the conception of legal philosophy studies related to Sociological Jurisprudence becomes important because it enables law to become an instrument that promotes social justice and equality, recognizing that law must reflect respected social values and be executed within society based on the thoughts of Hugo Grotius regarding justice, equality, and human rights, grounded in rationality and humanism, emphasizing the need to treat individuals with respect and consider the welfare of society. The implementation of Hugo Grotius's thought in Indonesia has made a significant contribution to a paradigm shift in legal construction, particularly related to Sociological Jurisprudence. Grotius emphasizes the importance of rational law that does not solely rely on dogma or religious beliefs. His views on justice based on reason and human rights as an integral part of natural law have shaped a modern legal perspective that prioritizes justice and equality. Grotius's thoughts are highly relevant, especially in efforts to build a fair legal system based on morality.

AbstractTaslim Elias's scholarship on the impact of English common law on the growth of African customary law illustrates the intersectionality negotiated between ‘centre’ and ‘periphery’, universal and subaltern laws. His intellectual portrait is also useful as a heuristic device to excise the doctrines, strategies, imageries, and narratives of progress elaborated about ‘Africa’ and ‘law’. Elias decried the contempt and ignorance exhibited by colonial masters towards native customs and laws; he also vilified judicially crafted ‘repugnancy’ and ‘public policy’ doctrines as instruments of colonial policy to prevent British justice from looking both ways, by ensuring that British standards were the ‘objective’ criteria of abrogation and change. Yet he nonetheless saw these doctrines and English law as a unifying force in the emergence of a unified Nigerian legal system. This article argues that this paradox in Elias's work and his struggle against the asserted dualism between English law and African customary law must be situated in the context of the rise of an African legal consciousness or juridical Negritude, home to various political projects of nation-building, African cultural liberation, and development which strategically intersected in their unstable relationship to law and Western culture. This signals a turn to ‘hybridity’ in legal discourse and Elias's professional trajectory seeking to develop a uniform common law for Nigeria as a way to explicate the workings of this relationship, and how African law is inscribed in the interplay of cultural forces constantly (re)negotiating the boundaries of their engagement with one another. This, in turn, reveals a complex picture of mediating between the simultaneous participation of Third World intellectuals in various struggles and personal or ideological projects within African humanism, which an analysis structured around the stability of centres/peripheries conventionally distorts.

<p class="15bIsiAbstractBInggris">The changing times demand the development of the education curriculum. This is because the challenges of life that will be faced are growing. Universities need to adjust the curriculum applied in their respective institutions. This research tries to trace the process of curriculum preparation in one of the study programs of the Faculty of Islamic Studies, namely Islamic Religious Education and how the implementation of the learning process is carried out by each lecturer. This research is a qualitative research with a document and field study approach. The results found that the Islamic Religious Education study program, in designing the curriculum with various approaches, both theological, juridical, philosophical, psychological, and technological. The profile of graduates is clearly illustrated and elaborated by the preparation of a curriculum with a mandatory Semester Credit Unit (SKS) of 135 credits with 57 courses. In practice, the lecturers have used various theories in the learning process, whether nativism, constructivism, behaviorism, empiricism, or convergent with the Islamic values that are in accordance with the ideology of Islamic education which is based on humanism theocentrism.</p><p class="15bIsiAbstractBInggris"><strong>Abstrak</strong></p><p class="16bIsiAbstrak">Perubahan zaman menuntut pengembangan kurikulum pendidikan. Hal ini dikarenakan tantangan kehidupan yang akan dihadapi semakin berkembang. Karenanya, perguruan tinggi perlu menyesuaikan kurikulum yang diterapkan di lembaganya masing-masing. Penelitian ini mencoba menelusuri proses penyusunan kurikulum di salah program studi Fakultas Agama Islam, yaitu Pendidikan Agama Islam serta bagaimana penerapan proses pembelajaran yang dilakukan oleh setiap dosen. Penelitian ini merupakan penelitian kulitatif dengan pendekatan studi dokumen dan lapangan. Hasil penelitian menemukan bahwa program studi PAI, dalam merancang kurikulum dengan berbagai pendektan, baik teologis, yuridis, filosofis, psikologis, dan teknologis. Profil lulusan tergambar dengan jelas dan dijabarkan dengan penyusunan kurikulum dengan Satuan Kredit Semester (SKS) wajib sebanyak 135 SKS dengan 57 mata kuliah. Dalam praktiknya, para dosen telah menggunakan berbagai teori dalam proses pembelajarannya, baik nativisme, konstruktivisme, behaviorisme, empirisme, ataupun konvergen diwarnai dengan nilai-nilai keislaman yang sesuai dengan ideologi pendidikan Islam yang bercorak <em>humanism theocentrisme</em>.</p>

Hugo Grotius has always been viewed as a theorist of either international or natural law. However, these designations obscure the civic focus of his work, from his early republican treatises through to De iure belli ac pacis. From sixteenth-century humanist and legal-humanist Aristotelianism, Grotius constructed a framework of natural right which enabled him on the one hand to locate the origins of the civil community in natural man's juridical capabilities, but on the other to give this ‘city’ a large measure of juridical autonomy in respect of the moral norms of natural law. In this he diverged significantly from the contemporary scholastic handling of natural law. Grotius further developed his understanding of the civil community and its right through elaborating a theory of the unity of the city, based originally on the Aristotelian notion of reciprocity but ultimately using a range of neo-Stoic sources to conceive of the civil community as a unitary reality.

AbstractIn Homo Juridicus, Alain Supiot argues that law has an 'anthropological' function – constituting people as rational beings by linking together their biological and symbolic dimensions. The law also serves a 'dogmatic function', embodying Western values and serving as a bar to totalitarian scientism and tempering the excesses of technology in the workplace. However, the anthropological function of the law has been undermined by the advance of science and economics and widespread privatisation, contractualisation and deregulation. This article contests Supiot's claims, especially as regards Marxism, counterposing his position to that of Bolshevik legal theorist Evgeny Pashukanis. Pashukanis's insights into the relationship between law and capitalism are used to re-frame Supiot's argument and to undermine his contention that globalisation is inimical to law. Pashukanis is also invoked to contest the claims that the anthropological function of the law is the only alternative to totalitarianism and that law serves to 'humanise' technology.

AbstractThis paper analyses the concepts of three great Romanian thinkers –theoreticians and philosophers of law – on the relations between law, morals and manners in order to discover, based on their idea filiation in the juridical Romanian culture, the differences of method and contents between them, to identify the practical implication in the field of performing the justice and law-making. Being trained and positioned in the core of the European juridical culture of their time, they reviewed the relations between law and morals, in a rationalist and humanist way, substantiating the need for the law to follow morals, the ethical principles both historically, and practically, the law-making being comprised as well. Thus, they leave room to the expression of human’s basic rights and freedoms in a democratic judicial order, while the rules of law subordinating the morals and manner proved to be widely open to totalitarianism.

This work aims to think, from a specific interpretation of what Kaplan and Sprinker termed "the Althusserian legacy", his theoretical system and its objects, the specific relations linking the concepts of ideology, law and subjectivity. Thus, undertakes an analysis of ideology in its theoretical and practical senses, its connections with philosophy, science and politics, to understand that while the category of Subject is banned from the materialist philosophical problematic, it plays a decisive function as a scientific concept of historical materialism. Throughout the pages we discover the connection between the question of knowledge imposed by classical bourgeois philosophy and the categories effectively operating in legal practice; between Marx s early humanism and the theoretical and practical ideologies of Man, which appears always as the couple humanism-economism; and between the constitution of the imaginary function of the subject by the ideological interpellation and the commodity circulation practices. All this is unveiled through the tools of Marxists science and philosophy, exposed in its absolute specificity in the first two chapters, analyzed from the perspective of a chronology of its incorporation within the Althusser's work, which involves a number of aporias and mobilizes reading arrangements whose inspiration is the author himself. It is, therefore, at the end, an attempt to apprehend, from Althusser's developed problematic, its possible outcomes for thinking the juridical field, its historical specificity and the functions that correspond to it in the reproduction of social relations of capitalist production.
O presente trabalho tem por escopo, a partir de uma interpretação específica daquilo que Kaplan e Sprinker denominaram o legado althusseriano , seu sistema teórico e seus objetos, pensar as relações específicas que ligam os conceitos de ideologia, direito e subjetividade. Assim, empreende uma análise da ideologia em seu sentido teórico e prático, suas conexões com a filosofia, a ciência e a política, para compreender que, enquanto a categoria de Sujeito está irremediavelmente banida da problemática filosófica materialista, ela desempenha na qualidade de conceito científico uma função decisiva no dispositivo do materialismo histórico. Ao longo das páginas vamos descobrindo a conexão existente entre a questão do conhecimento imposta pela filosofia burguesa clássica e as categorias efetivamente em operação na prática jurídica; entre o humanismo de juventude de Marx e as ideologias teórica e prática do Homem, que se constituem sempre na forma do par humanismo-economicismo; e entre a constituição da função imaginária do sujeito pela interpelação ideológica e as práticas da circulação mercantil. Tudo isso vai sendo desvendado através dos instrumentos da ciência e da filosofia marxistas expostos em sua absoluta especificidade nos dois primeiros capítulos, analisados sob a ótica de uma cronologia da sua constituição no interior dos trabalhos de Althusser, o que envolve uma série de aporias, e mobiliza expedientes de leitura cuja inspiração é o próprio autor. Tratase, portanto, ao cabo, de uma tentativa de apreender, a partir da problemática althusseriana desenvolvida, seus possíveis desdobramentos para o pensamento do campo jurídico, sua especificidade histórica e as funções que a ele correspondem na reprodução das relações sociais da produção capitalista.

Resumo: A discussão trazida nesta dissertação se fundamenta no conceito de homo juridicus desenvolvido pelo jurista francês Alain Supiot (2007) enquanto construção dogmática, coligada às noções de pessoa e de personalidade, e recuperada em torno dos homens concretos em suas vidas particulares e em coletividade (Enrique Dussel). Baseia-se, igualmente, nas preocupações de Supiot por se compreender o direito como técnica de humanização das técnicas e, ainda, em se ter uma das tarefas da ciência do direito como a de se identificar déficits antropológicos das teorias jurídicas. Abordam-se, nesse contexto, algumas dimensões de uma possível mundividência nominável como humanista (visão de mundo, ou Weltanschauung, distinta de uma ideologia, pré-compreensão ou paradigma), imprescindível do raciocínio jurídico, compreendida nas esteiras de uma tutela humana (e ambiental) total e incondicional obtida por meio do implemento das categorias de direitos da personalidade, direitos fundamentais e direitos humanos, dos quais todos são titulares, assim como dos microssistemas protetivos e de princípios sempre presentes como o da dignidade da pessoa humana e da regra de interpretação pro homine, todos inspirados pela pretensão de atingimento de um bem-estar social e individual e assentados nos princípios republicano e democrático, bem como instrumentalizados que devem ser via diversos atos e processos públicos e privados. Neste sentido, abordam-se alguns elementos filosóficos componentes desta cosmovisão, ao exemplo das discussões sobre a condição humana, a ética e os modelos do cuidado, as questões da antropologia filosófica, da alteridade, da subjetividade, da vulnerabilidade e hipervulnerabilidade, da política do reconhecimento, entre outros aportes, cientes da fragilidade da vida e da responsabilidade social partilhada por ela, que apontam ao apreço pelo humano e por sua proteção enquanto finalidades ínsitas ao ordenamento jurídico e indissociáveis de suas técnicas hermenêuticas. Enfatiza-se, também, a humanização do direito internacional dos direitos humanos, assim como do direito internacional privado e, ainda, a categoria constitucional do humanismo e o modelo de Estado humanista como importantes ferramentas de construção desta visão de mundo garantista e tuitiva.

La révolution politique romaine dont les XII Tables furent la traduction juridique consista dans la limitation du pouvoir (imperium) des magistrats par la loi, dont le peuple était seul auteur. Mais l’invention du légalisme romain fut plus tardive et plus durable : la loi devint aussi la source de tout pouvoir dans la cité, faisant de l’imperium une notion juridique. Un tel légalisme permit de conférer des pouvoirs extra-légaux, de telle sorte que les leges regiae de imperio, dont la pratique répétée est attestée outre le cas de Vespasien, prolongeaient sous l’Empire la forme républicaine du gouvernement. La jurisprudence romaine ramena cette pratique politique à un modèle unitaire, la lex regia. Quand l’Empire devint chrétien, la source divine du pouvoir entra en compétition avec le légalisme romain. Néanmoins, celui-ci survécut et continua d’être utilisé dans l’Empire tardif en tant que modèle théorique ; Justinien ne manqua pas de le reprendre dans ses compilations, en même temps que les affirmations chrétiennes d’un imperium a Deo, mais pour en déduire le caractère unitaire, indivisible, législatif et impérial de tout le droit. Ce double héritage se retrouve dans les interprétations des docteurs médiévaux, qui insistèrent néanmoins sur la conception juridique de l’empire et conséquemment sur ses limites. L’humanisme juridique, par l’épigraphie et l’histoire, brisa le modèle unitaire de la lex regia en redécouvrant la pratique politique des leges regiae de imperio, une pour chaque prince. Un tel apport entraîna une novation de la lex regia, qui de loi royale devint loi du royaume, à la fois source et limite de l’empire des rois héritiers de Rome
The Roman political revolution of which the Twelfth Tables were the legal expression consisted in limiting the power (imperium) of magistrates through the lex, of which the people were the sole author. But the invention of Roman legalism was later and more lasting : the lex also became the source of all power in the city, making imperium a legal concept. Such legalism made it possible to confer extra-legal powers, so that the leges regiae de imperio, the repeated practice of which is attested in addition to the case of Vespasian, extended the republican form of government under the Empire. Roman jurisprudence reduced this political practice to a unitary model, the lex regia. When the Empire became Christian came into competition with Roman legalism. Nevertheless, the latter survived and continued to be used in the late Empire as a theoretical model; Justinian did not fail to take it up in his compilations, along with the Christian assertions of an imperium a Deo, but to deduce from it the unitary, indivisible, legislative and imperial character of all law. This dual heritage is reflected in the interpretations of medieval doctors, who nevertheless insisted on the legal conception of empire and, consequently, on its limits. Legal humanists, through epigraphy and history, shattered the unitary model of the lex regia by rediscovering the political practice of leges regiae de imperio, one for each prince. This contribution led to an novation of the lex regia, which went from being a royal law to becoming a law of the realm, both the source and the limit of the empire of kings claiming Roman heritage

A presente tese tem como foco a análise da definição e abrangência do termo personalidade jurídica, buscando perquerir quais os elementos necessários para que um ente possa ser considerado dotado de tal atributo. Nesse espeque, percebe-se que o Código Civil brasileiro vigente abre as portas para que se compreenda como dotado de personalidade juridíca não apenas o Homem, à moda da visão oriental sobre a equiparação da dignidade de todos os seres com o Homem. Dessa forma, cria-se um campo fértil para o desenvolvimento da teoria do direito animal e, também, do direito robótico, possibilitando compreender o robô como sendo uma pessoa juridicamente qualificada. Isso porque o conceito de pessoa não se confunde com o de ser humano, a exemplo do nascituro, não considerado como pessoa, mas sim, um homem virtual em potência, titular de determinados direitos da persoanlidade. à sua semelhança estão os projetos exequíveis e factíveis de robôs, que já reúnem todos os elementos necessários para a criação dos mesmos. Nessa comparação de seres, ressalta-se a tese de que se seres vivos são máquinas autopédicas, logo, as máquinas são seres vivos. Diante desse cenário, busca-se examinar o que é preciso, na visão jurídica, para que o Homem seja considerado um sujeito e não como objeto de direito. Ainda nesse contexto, contribuindo para a proposta da presente, imprescindível o estudo comprarativo entre a máquina cerebral e a maquina computacional. Cérebro e computador não se equivalem, sendo tal aspecto irrelevane, pois, ao final, o que importa é o resultado derivado de um efeito ou ato inteligente, cuja causa certamente terá sido inteligente. Ademais, cérebro e computador se assemelham uma vez que o incosciente é um software, considerado como uma linguagem inscrita e obedecida em segundo plano. Em asim sendo, o inconsciente pode ser formalizado pela análise, transmutando-se numa linguagem de máquina de alto nível de interpretação inatingível por seres humanos. Nesse caminho e, a título de exemplo, estão a criação da nanotecnologia e o uso de materiais supercondutores, que eliminam as barreiras térmicas presentes na utilização de componentes de silício, aumentando exponencialmente a potência das máquinas. Esse ganho possibilitará o surgimento de máquinas muito mais capazes que a humanidade em conjunto. o paradigma antropocêntrico segurante será abandonado empouco tempo, dando espaço,possivelmente, a uma era Pós-Humana, dissolvendo concepções culturais há muito envergadas na sociedade atual, redefinindo noções como a vida humana e o sistema jurídico que rege.

A presente dissertação tem por objetivo articular as contribuições de dois marxistas à ciência jurídica, são eles: Eugeny Pasukanis e Antonio Gramsci. Trata-se de esforço para delimitar pontos de diálogo entre ambos, os quais refletiram, cada um à sua maneira, sobre o direito. Apesar de contemporâneos, esses dois pensadores não mantiveram contato entre suas posições teóricas. O diálogo entre as suas reflexões, tendo como fio condutor a abordagem sobre o direito, é o desafio enfrentado nessa pesquisa. Por um lado, com o conceito de forma jurídica, a teoria de Pasukanis busca explicar a especificidade do direito que se desenvolve intimamente conectado às relações de produção e troca do capitalismo. Por outro lado, ao investigar as particularidades que conformam as relações políticas no capitalismo, a abordagem de Gramsci sobre a hegemonia estabelece quadro analítico para o estudo da dinâmica do direito. Da aproximação entre essas análises, apostamos na construção de campo conceitual fértil ao estudo jurídico, capaz de iluminar as questões sobre os limites, as possibilidades de desenvolvimento e os sentidos do direito na sociedade capitalista.
This research aims to analyse the contributions of two marxist authors to the study of Legal Science: Eugeny Pasukanis and Antonio Gramsci. It seeks to delimitate the points of contact, deviation and complementation between these two authors, who came to think about Law in their own different ways. Although contemporaries, Pasukanis and Gramsci did not maintain any contact regarding their theoretical positions. Thus, the attempt to stablish a dialogue between their thoughts, using Law as a common thread, presents itself as the main challenge facing this research. On the one hand, through the concept of juridical form, Pasukanis theory seeks to explain the specificity of Law that arises from its intimate historical connections to capitalisms production and trade relations. On the other hand, by investigating the specificities that shape political relations under capitalism, Gramscis approach to hegemony stablishes an interesting analytical framework for studying the dynamics of Law. By approximating these two concepts of juridical form and hegemony, a rich conceptual field is constructed, enabling a critical analysis that could shed light into some compelling questions in relation to the limits, development possibilities and meanings of Law in a capitalist society.

A presente dissertação enfrentará alguns conceitos fundamentais da obra foucaultiana, tais como o poder, a soberania, a disciplina, a instituição de seqüestro, a vigilância, para aprofundar a análise naquilo que se refere ao tema da arte de governar. Nesse ponto, será a obra de Nietzsche, no recorte que lida com a temática do pecado, chamada a oferecer uma breve contribuição. Das novas formas de poder pastoral, em Foucault, até alcançar o tema do racismo de Estado, serão abordadas as doutrinas da razão de estado e da polícia, a história da verdade no âmbito das práticas judiciárias, o panoptismo e a origem da pena de prisão. The presente paper will face some main concepts inserted in the philosophical work of Michel Foucault, such as power, sovereignty, discipline, surveillance, in the way to improve the analysis to what referes to the governing art. At this point, a specific scene of Nietzschean´s philosophy, in wich the theme of the sin takes place, will be added as a brief contribution. Between the new forms of the priest´s power, in Foucault, and the theme of State racism, other subjects will be approached, like the doctrine of State reason, the doctrine of police, the history of truth in the judicial practices, the panopticon, and the origens of the prison penalty. Esta dissertação propõe-se a identificar o sentido ideológico da tutela às liberdades do trabalho em direitos humanos no Sistema Interamericano de Direitos Humanos (SIDH). Para tanto, a autora utiliza-se do Caso Trabalhadores da Fazenda Brasil Verde x Estado do Brasil (Caso nº 12.066) que tramitou perante a Corte Interamericana de Direitos Humanos (CrIDH) até dezembro de 2016. A análise parte do aparato teórico oferecido pelo Marxismo, pela Teoria Marxista da Dependência e da Sociologia Jurídica Crítica desenvolvida por Óscar Correas para compreender e analisar a problemática. Como método, vale-se do histórico-dialético que permeia a Sociologia Crítica presente na obra de Correas e do próprio Marx. Tem-se como hipótese preliminar que o sentido ideológico da tutela ao trabalho livre no direito internacional dos direitos humanos está localizado na sua matriz liberal europeia, uma vez que se encontra concentrada no elemento salarial, que dá forma de mercadoria ao trabalho e de contrato à relação de exploração. A pesquisa, no entanto, ampliou esta hipótese preliminar para concluir que ademais da prevalência da formamercadoria, a permanência de formas superexploratórias e précapitalistas de exploração do trabalho entre elas o trabalho escravo - na contemporaneidade está relacionada à manutenção das relações internacionais que mantêm o Brasil na condição de país de capitalismo dependente e que se configura na superexploração do trabalho que, por sua vez, assume duas facetas: uma admitida pelo direito e outra por ele repudiada.

Abstract : This dissertation intends to identify the ideological meaning of the international judicial protection over the free work rights in the Inter-American Human Rights System. To do so, it uses the Case n. 12.066 Fazenda Brasil Verde Workers versus Brazil, analyzed by the Inter-American Court of Human Rights up to December 2016. The research also uses the theorethical apparatus of Marxism, Marxists Theory of Dependency and the Critic Sociology developed by Óscar Correas to understand and analyse this problematic. For a method, it draws upon the historical dialectic method that permeates all Correa s Critic Sociology and Marx s work itself. Once the theorethical framework is presented, the author follows to understand the Inter-American System as a whole per passed by the political forces that, in conflict, shape it, in order to localize the contemporary slave work in the actual reality of Brazil. The preliminary hypothesis is that the ideological meaning of the international judicial protection over the free work rights in the Inter-American Human Rights System is localized in its liberal european heritage. The research, however, has broaden this perception and showed that the endurance of the slave work a pre-capitalist form of explotation contemporarily is related to the maintenance of international relations that keep Brazil in the condition of a dependent capitalist country and is consolidated by the supler-explotation of work, which takes two faces: one is accepted by law, the other is repudiated by it.

This research is situated in the field of studies on political and legal regulation ways of family relationships, and aims to analyze the new modalities of legal treatment to the divorce in contemporary Brazil. The social and political determinants applied to the family sphere in the context of everyday juridical regulation of the breakdown of marital relationships modes are investigated. The empirical framework is based on four family juridical circuits at the Court of São Luís, Maranhão state capital. The study then focused on the apprehension of the assumptions and implications adopting the principle of facilitation of marital dissolution as juridical reaction model to the interpersonal conflict. Thus, it is focused a variety of aspects that precede and condition the juridical treatment of divorce, and the effects of the required meeting between judges and those who is getting the divorce in a legal framework of interaction aiming to regulate the particular conflicts. Moreover, were mobilized different methodological devices such as sociographic analysis of legal process, archival research, interviews with the actors involved (people in the process of getting a divorce, judges, justice officials) and ethnographic observation at the Court hearing. Based on this study, it was found that the juridical treatment of divorce reveals the ambiguities of institutional logic of public management of private domain, and the state of relations between the spouse and their representations of themselves, about family, marriage and the justice.
Inscrito no campo de estudos sobre os modos de regulação jurídica e política das relações familiares, o presente trabalho tem como objetivo analisar as novas modalidades de tratamento judiciário do divórcio no Brasil contemporâneo. Trata-se de investigar os determinantes sociais e políticos aplicados à esfera familiar no contexto da regulação judiciária cotidiana dos modos de ruptura das relações conjugais, tomando por base um referencial empírico representado por quatro varas de família do Fórum de Justiça de São Luís, capital do estado do Maranhão. O estudo centrou-se então na apreensão dos pressupostos e implicações da adoção do princípio da facilitação da dissolução conjugal como modelo de reação judiciária ao conflito familiar. Foram mobilizados diferentes dispositivos metodológicos, tais como: análise sociográfica de processos, pesquisa arquivística, realização de entrevistas com os atores envolvidos (divorciantes, magistrados, funcionários da justiça) e observação etnográfica das audiências. Constatou-se que o tratamento judiciário do divórcio revela não somente as ambiguidades das lógicas institucionais de gestão pública do domínio privado, como também o estado das relações entre os esposos e de suas representações sobre si, sobre a família, casamento e a própria justiça.

This present study has the aim to examine the new demands that the Brazilian juridical teaching tries to fulfill helped by the historical knowledge of public policies responsible for the construction of the national Juridical Teaching curriculum, emphasizing Portugal influence on it. Based on the philosophical and historical perspectives since the creation of Law Courses (1827) until the present days, searching for a combination of Studies in the Curriculum Area with Law, discussing the historical intervention articulated of the public and private in the construction of its paradigms and reach the interdisciplinarity. To the elaboration of this study, we are going through an itinerary that begins with a brief overview of today s juridical teaching, a history about the Juridical Teaching, besides a history about the theories of Curriculum, Juridical Teaching, the international influences and the search for innovation. The most specific exam is about the understanding that the current problems are due to the lack of historical knowledge about the Portuguese legacy concerning the Juridical Teaching, and also the lack of distinction about the theoretical fundaments to a good curricular organization of the undergraduate courses in the perspective of an organic link between the Juridical Teaching and the social and political development of the country. The methodological option used was the qualitative research, from the bibliographical type. The objective of this research is to approach the historical trajectory of the Law courses in Brazil focusing the interference, the influence, and the heritage received from the Law courses form Portugal with the goal to promote a contextualized reflection about the needs for a change in the public and private intervention in the formation of the candidates to become bachelor of Laws. In this sense, it is necessary a critical look and thought, so that we can evaluate and plan the formation guidelines that enforce and charge to all that are committed, that is, to educate professionals that, beyond the ability to deal and research the juridical knowledge with autonomy, have the ethics comprehension of his/her professional activity articulated to the interdisciplinary humanistic knowledge searching for an effective social participation. It is concluded that the great change is found in the construction of a new conception about the juridical teaching that serves the social demands and get the innovation to graduate professionals with a perception of new ways to work in the juridical area
Este trabalho tem por objetivo examinar as novas demandas que o ensino jurídico brasileiro busca atender auxiliado pelos conhecimentos históricos das políticas públicas responsáveis pela construção do currículo do Ensino Jurídico Nacional com ênfase sobre a influência de Portugal. Com base na perspectiva filosófica e histórica desde a criação dos cursos de Direito no Brasil (1827) até a atualidade, busca uma combinação dos Estudos na Área de Currículo com o Direito, para discutir a histórica intervenção articulada do público e do privado na construção de seus paradigmas e inovar por meio da interdisciplinaridade. Para a elaboração deste estudo, percorremos um itinerário que tem início com um panorama dos desafios e conquistas do ensino jurídico na atualidade, um histórico acerca do Ensino Jurídico no Brasil e Portugal, além de um histórico sobre as teorias de Currículo, o Ensino Jurídico, as influências internacionais e, por fim, a busca pela inovação no ensino da justiça. O exame mais específico recai sobre o entendimento de que os problemas da atualidade decorrem da falta de conhecimento histórico sobre o legado português ao Ensino Jurídico e também da falta de clareza sobre os fundamentos teóricos para uma boa estruturação curricular dos cursos de formação na perspectiva de uma vinculação orgânica entre Ensino Jurídico e desenvolvimento social e político do país. A opção metodológica utilizada foi a pesquisa qualitativa, do tipo bibliográfica. O objetivo dessa pesquisa é abordar a trajetória histórica dos cursos de Direito no Brasil focando a interferência, a influência e a herança recebida dos cursos de Direito de Portugal, com o objetivo de propiciar a reflexão contextualizada sobre a necessidade de mudanças na intervenção pública e privada na formação dos candidatos a bacharéis. Nesse sentido, faz-se necessário um olhar e um pensamento críticos para que possamos avaliar e planejar as diretrizes de formação que cumpram e entreguem a todos o que prometem, ou seja, formar profissionais que, além da capacidade de lidar com o conhecimento jurídico e pesquisá-lo com autonomia, tenham uma compreensão ética da sua atividade profissional articulada ao saber humanístico interdisciplinar, buscando uma participação social efetiva. Conclui-se que a grande mudança se encontra na construção de uma nova concepção curricular sobre o ensino do Direito que atenda às demandas sociais e produza a inovação, ao formar profissionais com uma percepção das novas formas de atuação na área jurídica

In classical scholarship, the presence of legal language in love poetry is commonly interpreted as absurd and incongruous. Ovid’s legalisms have been described as frivolous, humorous, and ornamental. This book challenges this widespread, but ill-informed view. Legal discourse in Latin love poetry is not incidental, but fundamental. Inspired by recent work in the interdisciplinary field of law and literature, the book argues that the Roman elegiac poets point to love as the site of law’s emergence. The Latin elegiac poets may say ‘make love, not law’, but in order to make love, they have to make law. Drawing on Agamben, Foucault, and Butler, the book explores the juridico-discursive nature of Ovid’s love poetry, constructions of sovereignty, imperialism, authority, biopolitics, and the ways in which poetic diction has the force of law. The book is methodologically ambitious, combining legal theory with historically informed closed readings of numerous primary sources. It aims to restore Ovid to his rightful position in the history of legal humanism. The Roman poet draws on a long tradition that goes back to Hesiod and Solon, in which poetic justice is pitted against corrupt rulers. Ovid’s amatory jurisprudence is examined vis-à-vis Paul’s letter to the Romans. The juridical nature of Ovid’s poetry lies at the heart of his reception in the Middle Ages, from Boccaccio’s Decameron to Forcadel’s Cupido iurisperitus. The current trend to simultaneously study and marginalize legal discourse in Ovid is a modern construction that this book aims to demolish.

Historians, literary scholars, and international lawyers interested in the early modern period have all grappled with the problem of anachronism, yet mostly independently of one another. This essay uses the question of war crime in Shakespeare’s Henry V to argue that early modernists interested in international law need not reject synchronic historicism for explicitly anachronistic or presentist approaches. Proposing as a new context for Shakespeare’s play a little-known humanist disputation by the civil lawyer Alberico Gentili, De amis Romanis (1599), it illuminates a juridical approach to the international past cultivated in the early modern period alongside the rise of international law—an approach closely linked with literary epistemologies.

Populism in politics and policy orientations in law have thrown the jurisdiction of the academy and the disciplines of interpretation into disarray. Critique flounders in abstraction and negativity, law loses itself in particularity. Administering Interpretation brings together philosophers, humanists, and jurists from both continental and anglophone jurisdictions to reassess the status and trajectory of interpretative theory as applied in the art of law. Tracking the thread of philosophical influences upon the community of legal interpretation, both reception and resistance, the essays move from the translation and wake of Derrida to the work of Agamben, from deconstruction to oikononmia. Sharing roots in the philological excavation of the political theology of modern law, contributors assess the failure of secularism and the continuing theological borrowings of juridical interpretation. This study commends the public theology of the English Reformation as a fruitful though neglected resource for a critical analysis of the contradictions of freedom that riddle late-modern liberal democracies and a constructive response to them. Drawn from the key legal, liturgical, homiletic and confessional elements of the English Reformation, this foundational Anglican tradition provides a theological vantage point for understanding current moral and political impasses in the western legacy of natural rights. The extensive development of natural rights in pre-modern scholastic theory and practice and its continuity with theoretical development from the seventeenth century onward make the Reformers’ criticisms of scholastic moral, political, and ecclesial thought germane to identifying the problematic features of the prevailing modern tradition and to furnishing a theological alternative to them. These problematic features are: an individualistic and voluntarist conception of moral agency, a regulative and juridical orientation to human relationships, and an anthropocentric concentration on human rather than on divine right, judgement, and freedom. The humanity they portray, detached from its created ordering to Christological perfection and bound within a self-enclosed ethical and political self-understanding, is effectively countered by the English reformers’ presentation of the salvation of creation in Christ, faith working through love, the spiritual fellowship of the church, and the provisional character of political jurisdiction.

Out of War is an ethnographic engagement with the nature of intercommunal violence and the material returns of history during and after the 1991–2002 Sierra Leone civil war. The questions raised concern the nature and reckoning of time and reality, fact and fiction; the experience of violence and trauma; the reversibility of perpetrator and victim, friend and enemy; and past, present, and future in the colony and postcolony. The book is a reflection on West African epistemologies and ontologies that contribute to questions in counterpoint with those of international humanitarianism, struggling with the possibilities of truth and quandaries of justice. In the context of massive population displacements and humanitarian interventions, the ethnography traces strategies of psychological, political, and cultural survival and material dwelling in liminal spaces in the midst of the destruction of the social fabric engendered by war. It also examines the juridical creation of new figures of crimes against humanity at the Special Court for Sierra Leone. The Sierra Leone scene, in the aftermath of war, is visualized as a landscape of chronotopes, neologisms that summon the uncertainty of war: the sobel (“soldier by day, rebel by night”), pointing to the instability of distinctions between enemy and friend, or of opposing parties in the war (the rebels of the Revolutionary United Front [RUF] and soldiers in the national army), and the rebel cross, pointing to the possibility that the purported neutrality of the Red Cross masked partisan interests alongside the RUF. Chronotopes also testify to the difficulty of discerning between facts and rumors in war, and they freeze in time collective anxieties about wartime events. Finally, beyond the traumas of war, the book explores the returns of material traces in counterpoint to the more “monumental” presence of Chinese investments in Africa today, and it explores the forgotten sensory history of another China (Taiwan versus the People’s Republic of China) and another Africa inscribed in ordinary agrarian practices on rural landscapes, and in the fabric of domestic life, particularly since the non-aligned movement emerged from the Bandung conference in 1955.

AbstractControversies about the moral and legal status of robots and of humanoid robots in particular are among the top debates in recent practical philosophy and legal theory. As robots become increasingly sophisticated, and engineers make them combine properties of tools with seemingly psychological capacities that were thought to be reserved for humans, such considerations become pressing. While some are inclined to view humanoid robots as more than just tools, discussions are dominated by a clear divide: What some find appealing, others deem appalling, i.e. “robot rights” and “legal personhood” for AI systems. Obviously, we need to organize human–robot interactions according to ethical and juridical principles that optimize benefit and minimize mutual harm. Avoiding disrespectful treatment of robots can help to preserve a normative basic ethical continuum in the behaviour of humans. This insight can contribute to inspire an “overlapping consensus” as conceptualized by John Rawls in further discussions on responsibly coordinating human/robot interactions.

Abstract Normative Islam develops in three phases: the Qur’anic or scriptural phase; its elaboration in the f:iadfth, that vast literature of sayings and doings ascribed to the Prophet; and the comprehensive system of law (jiqh), which adds new tributaries to the stream, drawing anew on the ancient floodplain of ethical and juridical culture that had from the outset fed the wellsprings of Islamic norms. The first section of this chapter aims to consider the shape that Islamic practical ethics takes under the impress of scripture, tradition, legal theory and practice, and theological theories of action. Having done that, I’d like to focus on two key thinkers. The first is the humanist ethical philosopher, his­ torian, and courtier AI:imad ibn MuI:iammad Miskawayh (ca. 932-rn30), a learned and articulate exponent offalsafa and adab, the Islamic traditions of philosophy and literary culture. The second is the Sufi-inspired theologian, jurist, and philosophic critic of falsafa, al-GhazalI (rn58-rm), who spoke up as a friend of music in chapter 1. GhazalI’ s ethics builds systematically on Miskawayh’ s work, but with telling revisions for the fate of Islamic humanism.

Further, it situates the volume within the history of classical scholarship since the eighteenth century, and relates how the volume contributes to the broader milieu of contemporary philosophy and the theoretical humanities. Finally, it gives an outline of each chapter, showing how each contributes to the volume’s project as a whole.

We are witnesses and participants of Copernican changes in the world which result in major crises/challenges (economic, political, social, climate, demographic, migratory, MORAL) that significantly change “normal” circumstances. The law, as a large regulatory system, must find answers to these challenges. Primarily, these circumstances relate to (i) the pandemic - Corona 19, which requires ensuring economic development with a significant encroachment on human freedoms and rights; (ii) globalization, which fundamentally changes the concept of liberal capitalism as the most efficient system of production of goods and services and democracy as a desirable form of government; (iii) automation, robotics, artificial intelligence, and big data are changing the ways we work, live, communicate, and learn in a Copernican manner. The law should serve to shape the relationship between people in order to realize a life of love and freedom. This is done to the greatest extent through the constitutional engineering of selected institutions. The legal system focuses on institutions that have a raison d'etre in their mission, which is read as “ratio legis”, as a desirable normative and real action in the range of causal and teleological aspect. Crisis situations narrow social cohesion and weaken trust in institutions. It is imperative to seek constitutional engineering that finds a way out in autopoietic institutions in allopoietic environment. We believe that the most current definition of law is that = law is the negation of the negation of morality. It follows that morality is the most important category of social development. Legitimacy, and then legality, relies on morality. In other words, the rules of conduct must be highly correlated with morality - legitimacy - legality. What is legal follows the rules, what is lawful follows the moral substance and ethical permissibility. Therefore, only a fair and intelligent mastery of a highly professional and ethical teleological interpretation of law is a conditio sine qua non for overcoming current anomalies of social development. The juridical code of legal and illegal is a transformation of moral, legitimate and legal into YES, and immoral, illegitimate and illegal into NO. The future of education aims to generate a program for global action and a discussion on learning and knowledge for the future of humanity and the planet in a world of increasing complexity, uncertainty and insecurity.
