Two themes in legislative activity in 2010 were national uniformity and some movement in using law to promote equality, especially gender equality. The Fair Work Act 2009 (Cth) came into full effect with the commencement of the new safety net provisions and the referral to the Commonwealth of industrial relations powers over private-sector workforces in all states except Western Australia. Progress continued on the promised harmonization of Australian occupational health and safety laws with the release of a model Work Health and Safety Bill by Safe Work Australia, although developments in some states threaten to derail the process. An attempt to repeal most of the industry-specific regulation of the building and construction industry failed. The Federal Parliament passed legislation establishing a national paid parental leave scheme, and a number of changes to federal discrimination laws came into effect or were proposed, including the potential consolidation of federal discrimination legislation. This article provides an overview of these developments at federal level and concludes with a discussion of developments in the states including a brief overview of Victoria’s new equal opportunity legislation.

Interest in women’s labour force participation, economic security and pay equity received substantial media and public policy attention throughout 2019, largely attributable to the federal election and the Australian Labor Party platform, which included a comprehensive suite of policies aimed at advancing workplace gender equality. Following the Australian Labor Party’s unexpected loss at the polls, however, workplace gender equality largely faded from the political agenda. In this annual review, we cover key gender equality indicators in Australia, examine key election promises made by both major parties, discuss the implications of the Royal Commission into Aged Care Quality and Safety for the female-dominated aged care workforce, and provide a gendered analysis on recent debates and developments surrounding the ‘future of work’ in Australia.

In July 1998 the Soutb Australian goverment released a Discussion Paper concern ing the future of occupational bealth and safety regulation in South Australia. In examining the paradigm shift proposed in the Discussion Paper, this paper highlights the importance of workplace health and safety as public polig issues in Australia and seeks to locate the Discussion Paper within the broader context of deregulatory changes in the administration of occupational health and safety legislation that have occurred in South Australia in recent years. It identifies several fundamental flaws in the proposals put forward for change and suggests that the major problem with tbe regulation of occupational health and safety in South Australia is the failure to effectively administer the legislation. The paper also advances a number of proposals designed to achieve greater compliance with the legislation. It concludes that the major proposals contained in the Discussion Paper are unlikely to find widespread practical expression.

The effort to reduce and eliminate the dangers of mining activities by preventing losses that is by implementing the application of safety management. Safety management systems are applied throughout the world. The world gets permission for industrial safety and health to get occupational safety and health. This safety management system is not only applied in Indonesia but also applied in several other countries such as South Korea, Singapore, Malaysia and Australia. In this study an analysis of the differences in the safety management system in these countries with an outline with the aim to carry out an analysis of the safety management system in large rock countries. The comparison obtained from the management system required and applied by the government regarding the safety system in these countries. For Indonesia and Singapore, a safety management system must be implemented in industrial companies, whereas for countries such as South Korea the safety management system is voluntary in other words the safety management system is implemented voluntarily by the industry. Australia is more applying safety management system standards and references for industrial needs. Safety management systems in Australia, South Korea and Malaysia are being readjusted to suit industry needs.

This article, written by JPT Technology Editor Chris Carpenter, contains highlights of paper SPE 202353, “Drilling-Performance and Risk-Management Optimization Offshore Australia: Improving Overall Safety and Efficiency of the Well-Construction Process,” by Chandrasekhar Kirthi Singam, Farshid Hafezi, and Clyde Rebello, Schlumberger, et al., prepared for the 2020 SPE Asia Pacific Oil and Gas Conference and Exhibition, originally scheduled to be held in Perth, Australia, 20–22 October. The paper has not been peer reviewed. The emergence of real-time well construction performance-monitoring centers has improved the service delivery for operators across numerous offshore oil fields in Australia significantly. The complete paper details new technologies and work flows implemented for three Australian offshore wells, with the primary objective of improving drilling efficiency while managing associated risks. Additional objectives included optimizing daily operational performance, thus delivering time savings for the operator and highlighting areas of possible improvements. Introduction The paper describes a successful drilling campaign in a challenging field in the Timor Sea. It describes how data analysis, risk evaluation, and real-time performance monitoring can be influential in saving rig time and project success. As part of this project, a major operator in Australia decided to perform an infill drilling campaign involving three high-angle directional wells (J type) in a saturated, complex field. The campaign design stage was initiated in 2017 with a main objective of delivering the project within authority-for-expenditure (AFE) budget and with planning for all potential challenges. Technical Overview The technical solution (Fig. 1) was deployed using drilling-interpretation software and executed its work flows to achieve the required objectives.

Employment and work-related exploitation and discrimination are important social determinants of health. However, little is known about the experiences of people on temporary visas in Australia, particularly those on refugee visas. This article reports on a study of people living on temporary visas in South Australia and their experiences of workforce exploitation and discrimination and impacts on health. Interviews were conducted with 30 people: 11 on non-refugee temporary visas and 19 on refugee temporary visas. Data was analyzed thematically. Analysis identified experiences of exploitation and discrimination in the Australian labor market that included difficulties securing work, underpayment, overwork, and hazardous workplaces. These experiences had negative health effects, particularly on mental health. None had made a formal complaint about their treatment, citing the precarity of their visas, difficulties finding an alternative job, and lack of knowledge about what to do. The impacts were especially evident for refugees who were also grappling with pre-settlement trauma and ongoing uncertainties about their future protection. Overall, these findings of discrimination and exploitation in the workplace and subsequent ill health highlight the pervasive impact of neoliberal agendas and stress the need for industrial, immigration, and welfare reform to protect workers on temporary visas.

Worker campaigns for a more direct say in protecting their health and safety are a significant but under-researched subject in labour history. Largely overlooked are the attempts by coalminers in the UK, Australia and Canada to establish mechanisms for representation on health and safety in the 1870s. This push for a voice then spread to New Zealand, France, Belgium and other countries, with unions eventually securing legislative rights to inspect their workplaces a century before workers in other industries gained similar entitlements. In Australia metalliferous miners’ unions followed coalminers in initiating a parallel campaign for the right to appoint their own mine-site and district inspectors (known as “check-inspectors”) from the late nineteenth century. This article examines the struggle for and activities/impact of workmen-inspectors in Australian metalliferous mines, including adoption of the competing UK-Australian and Continental-European models. It finds the development conforms to a resistance rather than mutual-cooperation perspective with check-inspectors performing the role of “knowledge activists.” The article argues this finding is not only relevant to understanding more recent experience of worker involvement in occupational health and safety but also demonstrates the relevance of historical research to contemporary regulatory policy debates and union strategies.

Safety culture and safety climate are terms that are used often in the context of safety management but are not very well defined or differentiated. This research concentrates on safety climate, a summary concept of employee perceptions of safety management practices within their organisation. There is a common assumption that a positive safety climate results in better safety performance outcomes, yet there is little research evidence to support this notion.
Despite being defined as a summary concept, much of the research on safety climate has been empirically driven and has concentrated on identifying the number and content of the dimensions/factors that contribute to the safety climate. Due to a lack of theoretical input in the field, the use of proprietary instruments which are unavailable in the public domain and varied developmental histories of these tools, the findings of past research has been mixed.
This research addresses several of the limitations in the literature on safety climate by using the National Safety Council of Australia’s Safety Climate Survey. The research centres around two main issues; the dimensionality and factor structure of safety climate; and investigation of the applicability of a framework linking safety climate to safety performance.
The project was divided into two studies. Study I is based on archival data collected by the National Safety Council of Australia (NSCA) (N=215, N=127, N=90). Study II utilises data collected specifically for the purposes pf this research (N=226). The survey instrument was further developed for Study II to include scales that allow for a more complete investigation of a framework linking safety climate to safety performance.
A comprehensive validation of the NSCA safety climate survey was conducted. Structural Equation Modelling was utilised to examine various models of the factor structure of safety climate. It was found that safety climate is best understood as a second order concept comprised of several specific first order factors. The factor structure remained consistent across several samples however the strength of the individual factors varied in each sample.
Structural Equation Modelling was also used to investigate the framework of the relationship between safety climate and safety performance. Evidence in support of his model was obtained however some variations to the model were necessary to achieve this support. Reinforcement for the influence of general organisational climate in providing a context for safety climate was revealed. Given that it was not possible to include all aspects of the framework within the statistical model these findings provide a good impetus for further research in this field.

This thesis describes the development, application and evaluation of an OHS measurement tool incorporating positive performance indicators to measure OHS performance in Australia Post, a large multi-site postal organisation. Positive Performance Indicators (PPIs) are identified as systematically implemented measures of the management processes initiated to achieve strategic goals. A literature review indicated that there was widespread support for the use of PPIs to measure OHS performance, with proponents advocating their use to monitor and promote implementation of target OHS strategies, and to evaluate the effectiveness of these strategies by using PPIs in conjunction with outcome indicators. Despite this widespread support, there was little practical guidance published on the development or application of PPIs, nor was there empirical evidence validating the claims of advocates. A series of research projects was undertaken to firstly develop - then evaluate - a set of OHS self-assessment tools incorporating PPIs. These projects comprised: review of the Australia Post OHS strategic plan, as the basis for the development of PPIs to measure that plan; development of a set of paper-based self-assessment tools incorporating quantitative OHS PPIs to measure the local implementation of the OHS strategic plan; quasi-experimental pilot study of the use of the OHS PPI self-assessment tools by Postal Managers, to investigate the reliability and effectiveness of the OHS PPI process in monitoring and driving conformance of OHS management processes; experimental study of the use of the OHS PPI self-assessment tools by Postal Delivery Facility Managers, to validate and extend the findings of the pilot study; development of a web-based software application to facilitate OHS PPI data collection and reporting; and, the use of correlation statistics to study the relationship of OHS PPIs with OHS outcome measures, and to assess their role in evaluating the effectiveness of specific OHS strategies. The studies demonstrated that the OHS PPI self-assessment tool could be effectively used by local facility managers to assess and report their implementation of the OHS strategic plan. In addition, the OHS PPI self-assessment process proved to strongly improve the local implementation of those OHS management processes measured. The study further showed that the consistent attention to OHS management processes driven by the OHS PPI measurement process assisted in the achievement of impressive OHS outcome improvements. However, the study showed that the use of correlation statistics to link OHS PPIs with outcome measures to evaluate the effectiveness of OHS management strategies has only limited value. Limitations in both the OHS PPI and outcome measurement data and in the correlation statistics restrict the extent to which findings can be interpreted or that conclusive judgements concerning the effectiveness of strategies can be drawn. The thesis concludes with an account of Australia Post's experiences in integrating OHS PPIs into its OHS management system.

This thesis explores working and learning practices in the context of safety within the Civil Construction Industry (CC Industry) of Western Australia (WA) and specifically focuses on the relations between organisational safety values and current working practices, primarily focusing on the instrumental power of managers in organisations to produce safety. The thesis examines the values in action that permeate the workplace culture and mediate the daily practices of people working in this industry, and ultimately how they impact upon the minds and bodies of employees. The study provides insight into the working practices and discourses within this industry by exploring the space between rhetoric and reality. specifically in terms of managing actions. Patterns in the data illuminate particular relations between values and practices that can mediate improved regimes of occupational, safety and health (OS&H) practices within organisations in the CC Industry. This study was supported by the Civil Contractors Federation WA (CCF) enabling high-level access and reciprocal practical outcomes for the CC Industry.

This thesis examines industrial welfarism in Australia from 1890 to 1965. This period witnessed the gradual spread of the welfarism movement throughout Australian industry as employers sought ways to increase productivity and control in the face of external challenges. Once reaching its peak in the immediate post-War period, the welfarism movement was gradually subsumed as part of the increasing formalisation of personnel management. Waves of interest in welfare provision coincided with periods of labour shortage and/or labour militancy in Australia, indicating its dual role in the management of labour. Firstly, by offering benefits and services beyond that made necessary by the law or industrial awards, welfarism was designed to create a pool of good quality workers for management to draw from. Secondly, managers sought to enhance their control over these workers and their productive effort, using welfarism as a technique to build worker consent to managerial authority. This could be achieved through subtle methods aimed at boosting loyalty and morale, or through more direct programs designed to increase worker dependency on the company. In both ways, individual and collective worker resistance could be minimised, thereby reinforcing managerial prerogative. Despite its adoption by a variety of companies, a number of economic, political and institutional factors limited the extent of industrial welfarism in Australia. These include the small-scale of most enterprises prior to the Second World War, state involvement in the area of industrial relations and welfare provision, and the strength of organised labour. While the welfarism movement did not reach the heights experienced overseas, it nonetheless provided an important contribution to the development of formal labour management in Australia.

Safety culture may be conceptualised as an interpretive device that mediates between organisational safety rhetoric and safety programs on the one hand, and local workplace cultures on the other. More recently, risk-awareness has emerged as a cultural approach to safety. Front line workers are encouraged to become risk-aware through programs designed to prompt them to undertake mental or informal risk assessments before commencing work. The problem is that risk-awareness programs have not been the subject of systematic research and the impact of these programs on the culture of safety and the resultant level of risk is unknown. Therefore, this ethnographic study of two sites within a large contract maintenance organisation in Australia explored what impact risk-awareness programs have upon the culture of safety and the resultant level of risk. The researcher spent two months in the field and data was collected through participant observation, semistructured interviews and through a review of organisational documents. This study found that managers focused upon collecting the paperwork associated with the program as proof that workers had a safer workplace, whereas workers preferred to rely upon their common sense rather than the paperwork to keep them safe. As a consequence, the riskawareness program resulted in a culture of paperwork and varying levels of risk reduction because the paperwork associated with the program created an illusion of safety for managers as much as common sense did for workers. The results of this study have implications for safety culture, risk-awareness programs and for organisational learning. They also have implications for organisations wishing to improve their safety culture by encouraging risk-awareness in front-line workers.

The purpose of the study was to analyse aircraft pushback accidents which have resulted in death or serious injury to aircraft pusback ground crew members and to develop effective strategies to prevent such accidents.

Level crossing risk continues to be a significant safety concern for the security of rail operations around the world. Over the last decade or so, a third of railway related fatalities occurred as a direct result of collisions between road and rail vehicles in Australia. Importantly, nearly half of these collisions occurred at railway level crossings with no active protection, such as flashing lights or boom barriers. Current practice is to upgrade level crossings that have no active protection. However, the total number of level crossings found across Australia exceed 23,500, and targeting the proportion of these that are considered high risk (e.g. public crossings with passive controls) would cost in excess of AU$3.25 billion based on equipment, installation and commissioning costs of warning devices that are currently type approved. Level crossing warning devices that are low-cost provide a potentially effective control for reducing risk; however, over the last decade, there have been significant barriers and legal issues in both Australia and the US that have foreshadowed their adoption. These devices are designed to have significantly lower lifecycle costs compared with traditional warning devices. They often make use of use of alternative technologies for train detection, wireless connectivity and solar energy supply. This paper describes the barriers that have been encountered for the adoption of these devices in Australia, including the challenges associated with: (1) determining requisite safety levels for such devices; (2) legal issues relating to duty of care obligations of railway operators; and (3) issues of Tort liability around the use of less than fail-safe equipment. This paper provides an overview of a comprehensive safety justification that was developed as part of a project funded by a collaborative rail research initiative established by the Australian government, and describes the conceptual framework and processes being used to justify its adoption. The paper provides a summary of key points from peer review and discusses prospective barriers that may need to be overcome for future adoption. A successful outcome from this process would result in the development of a guideline for decision-making, providing a precedence for adopting low-cost level crossing warning devices in other parts of the world. The framework described in this paper also provides relevance to the review and adoption of analogous technologies in rail and other safety critical industries.

Pressure vessels, which are widely used in various industries, have different levels of hazards. In order to provide different technical requirements for vessels with different levels of hazards, classification of pressure vessels is necessary and supervision and administration should be carried out by category. The aim of this paper is to introduce a simple and rational classification method presented in the new version of Chinese Supervision Regulation on Safety Technology for Stationary Pressure Vessel, which specifies that the stationary pressure vessels should be classified according to the design pressure, volume, and fluid type. The classification methods of European Union and Australia are also described in this paper.

Industry is implementing increasing amounts of automation into operations. The Australian mining industry is no exception as it is introducing autonomous mining vehicles and trains, remote controlled processing plants and the use of drones and robots to do survey and inspection work. Often these technologies are adopted to improve operational efficiencies and to reduce workers' exposure to high risk situations. However, in most mining environments, the adoption of automated technologies has not completely removed humans from the operation. Humans still need to interact with the technology to clean, service and maintain it. Humans also have to perform other tasks in the automated mining environment such as inspection of ground conditions, mapping mining and dump areas, maintaining roads and infrastructure etc. Thus, introducing automation into mining environments has the potential to introduce new and significant human-system interaction safety risks. The emergence of these new safety risks are evident in recent accidents in the mining industry as well as in other industries that have introduced automation. Traditionally, risk based approaches have been used in the Australian mining industry and other industries to identify and treat safety related risks. Such approaches include the use of hazard identification techniques (HAZID), Workplace Risk Assessment and Control (WRAC), Failure Mode and Effects Analysis or Failure Modes and Effects Criticality Analysis (FMEA or FMECA), and Process or Job based Hazard Analysis (PHA or JHA). These traditional techniques have helped reduce fatal and catastrophic incidents in the mining industry but deficiencies in their application has also been highlighted in a number of major accident investigation reports. In addition, recent research has suggested that that traditional risk identification techniques by not be effective for new, software-enabled technologies that are embedded in socio-technical systems with complex or dynamic human-system interactions. In response new socio-technical risk assessment approaches have been develop such as System Theoretic Process Analysis (STPA) and Strategies Analysis for Enhancing Resilience (SAfER). However no publications could be found that seek to understand from a end-user perspective the efficacy of the traditional and new techniques in assessing human-system interaction risks associated with the introduction of autonomous and automated technologies in mining environments.To begin to address this gap, research was conducted that sought to answer the question - What combination of risk assessment techniques delivers the most effective means of identifying risks associated with human-system interactions in remote and autonomous mining operations? The research method involved have mining industry professionals trial four techniques - Preliminary Hazard Analysis (HAZID), Failure Mode and Effects Criticality Analysis (FMECA), Strategies Analysis for Enhancing Resilience (SAfER), and System Theoretic Process Analysis (STPA) (Systems-theory Method) - in a workshop environment. Three different workshops were conducted each of which focused on a different automated technology. The first focused on identifying human-system interaction safety risks in surface mine automated haulage areas. The second focused on identifying human-system interaction safety risk associated with autonomous longwall mining operations underground. The third focused on human-system interaction safety risks associated with remote controlled operation of ore processing plants. After the workshop trialed each technique, the participants were survey to collect their perceptions of the usability and usefulness of each technique. Results from the participant feedback suggest that each techniques was able to identify potentially hazardous human-system interactions but that each had strengths and weaknesses depending on whether risks were being assessed risks pre or post implementation. A hybrid or combination approach was suggested with further testing of the proposed approach being recommended.
