Gil, Nelson E. "Reform in California's Immigration Enforcement and Immigration Court". Scholarship @ Claremont, 2010. http://scholarship.claremont.edu/cmc_theses/81.

Testo completo
Abstract (sommario):
According to the Department of Homeland Security, Office of Immigration Statistic, California accounts for approximately 2,600,000 illegal immigrants in 2009. This number represents about 25 percent of the entire estimated illegal immigrant population in the United States, which is roughly 10.8 million. Between 2003 and 2008, the U.S. government removed 1,446,338 noncitizens from the United States. This rise in deportation is a result o the changes that have been enacted by the federal government over the years that transformed the nature of immigration enforcement. This thesis explores the California Immigration Enforcement system from the programs established to apprehend illegal aliens in the United States, the rights illegal aliens are granted, the detention facilities where they reside and the immigration courts that ultimately decide their fate. The question that is being asked is whether the current system established works or if reform is needed.

Abstract (sommario):
This thesis aims to investigate the EU immigration and asylum policies by reviewing official policy documents. The method used is a discourse analysis which seeks to uncover different underlying patterns or discourses that might effect the policies. Apart from the discourse analytic perspective there are two theoretical views applicated. These two perspectives are a universalistic and a postcolonialistic. The universalistic perspective is used in order to examine how the EU treats human rights in their immigration and asylum policies. The postcolonialistic perspective is used with the purpose to see if there might be an expression for a kind of colonialism of compassion. According to the result this “new” kind of colonialism can be said to make part of the policies. As for the universalistic perspective it is shown that there is an explicit ambition to respect human rights but the political ideas seem to be more particularistic then universalistic. Another conclusion is that the EU seems to view immigration through a very negative perspective which this thesis claims has an effect on how the policies are written. When the EU insist to speak about “illegal immigration” instead of just “irregular immigration” this shows how they aim to strenghten the dimension of immigration and asylum as a problem.

Abstract (sommario):
The purpose of this study was to explore whether non-profit immigration organizations are ready for a comprehensive immigration reform. Social workers need to recognize that a lack of readiness among non-profit immigration organizations for a comprehensive immigration reform will lead to a lack of required services for undocumented populations. The sample consisted of twelve religious and non-religiously affiliated non-profit immigration organizations. A qualitative research method was used to analyze the data. The results of the study concluded that non-profit immigration organizations are not ready for a CIR. Although the organizations are not ready, several factors were found to affect their readiness for a comprehensive immigration reform. Factors that negatively contributed to their readiness included learned experiences with Deferred Action for Childhood Arrivals (DACA), directors’ perceptions, and funding. Recommendations for better service delivery to undocumented populations include the recommendation that organizations reviewing their plans by addressing these factors.

Abstract (sommario):
Immigration is a contentious issue for the governments of developed countries like the UK. Despite limited evidence demonstrating any substantial detrimental impact of immigration, it is often opposed. This thesis contains three empirical works that investigate a) how immigrants view immigration and how theses views compare to natives b) the role of the labour market in establishing views towards further immigration and c) the impact of immigrants on primary schools in England. Data come from the UK Citizenship Survey; the censuses, providing longitudinal data on immigration in local areas, and the Department for Education, providing panel data for primary schools. A variety of econometric techniques are employed for the data analysis: OLS, Probit, Ordered Probit, fuzzy Regression Discontinuity Design (RDD), fixed effect regressions, and Instrumental Variable (IV) are all implemented. Results suggest that earlier immigrants are similar to natives in being opposed to further immigration, while recent immigrants are more in favour of further immigration. Financial and economic shocks are associated with stronger anti-immigration responses. However, labour market concerns do not play a large role for either group of the respondents. The role of labour market is investigated more rigorously by studying the change in views of native males on exit from the labour market. After controlling for the potential selection and endogeneity biases using a fuzzy RDD, views of native males, essentially, remain unchanged with some evidence of reduced opposition after exit from the labour market. Finally, this thesis investigates the impact of immigrants on educational outcomes and schools. Using past location choice of immigrants to account for the non-random selection of immigrants into areas, results suggest that increased immigration has improved educational outcomes, both in English and maths, but also placed resource pressures on primary schools, as class sizes have increased and schools had to hire additional teachers.

Thompson, Erik. "Transnational organised crime, immigration and security : a study of Norwegian immigration Policy". Thesis, Stellenbosch : Stellenbosch University, 2014. http://hdl.handle.net/10019.1/97134.

Testo completo
Abstract (sommario):
Thesis (MA)--Stellenbosch University, 2015.
ENGLISH ABSTRACT: This research study discusses the extent to which transnational organised crime (TOC) has had an impact on Norwegian immigration policy. There has been a public debate in Norway about the involvement of asylum seekers in various forms of organised crime, leading immigration authorities to lament their insufficient resources and means to tackle the problem. Simultaneously, restrictive amendments have been made to the Norwegian Immigration Act, suggesting that immigration law is applied against TOC. The aim of the study is to understand why there has been a change in Norwegian immigration policy, and to discuss the effects and implications of the change. The study is a single-case study using qualitative methods, as the study seeks to provide a detailed description of Norwegian immigration policy and the context in which the changes in the immigration policy have been made. The case of Norway has been chosen because of the increasing focus that TOC has been receiving from Norwegian immigration authorities, accompanied by broad media coverage and restrictive amendments to the Immigration Act. The theories that are applied – criminologies of the self and the other, crimmigration, and securitisation theory – are all chosen because they address different aspects of “us” and “them” thinking. The study argues that the increased focus on transnational organised crime in Norwegian crime statistics reflects the narrative of the criminal other, found in criminologies of the self and the other. Within this narrative the criminal others are distinctly different from ordinary citizens of society and must be excluded for our own security and protection. This contributes to reinforcement of a discourse in which asylum seekers and illegal immigrants become difficult to distinguish from suspicious others and criminals. Accordingly, there is support for the claim that Norwegian immigration policy has been subject to a process of crimmigration. Further, it is found that Norwegian immigration policy has been securitised. It is concluded that although there might be a connection between transnational organised crime and a shift in immigration policy, the change in immigration policy is rather a result of the larger issue of immigration in general. The theoretical framework shows how immigration becomes framed within a security and criminal context, leading to a narrative where the other becomes a potential threat to members of society. This is problematic in a world where inequality is on the rise, and international conventions on human rights are at odds with punitive populism.

Abstract (sommario):
Singapore is a country built entirely by migrants. The topic of migration thus forms a very important part of the history of Singapore, in which much research has been done. However, one aspect of the modern migration history of Singapore has not been wellstudied, and that is illegal immigration. Since centuries ago, people have been smuggled on the very waterways that modern Singapore owes its prosperity to. Today, people are still entering and exiting the country clandestinely using the same waterways. However, as technology develops, the methods by which these people use to enter Singapore clandestinely are constantly changing. Regardless of the change in methods, such clandestine migration often involves great danger and hardship for those who dare to embark on the journey, just as the way it was in the past. This is even more so as Singapore turns from a colony to an independent country, and as the independent government increasingly exercises more control on the type of immigrants it allows into its borders to help take the country to greater heights in terms of prosperity. Immigration policies and laws thus become fine-tuned and people who are deemed ??undesirable?? are filtered out. The strict laws did not, however, deter some people from entering the country in search of a good job and a better life. As Singapore gears itself to receive more legal migrants, it must also be prepared to take measures against illegal immigrants. Illegal immigration is therefore a continuous battle between the authorities and the illegal migrants. Through the use of official and unofficial documents and public resources, some of which are not easily obtainable, this thesis traces the development of illegal immigration from a historical context and explores the life of the illegal migrants in Singapore so as to fill in the gaps on an under-studied topic, as well as the change in mindsets migrants-turned-citizens have towards new migrants, in an attempt to use a historical approach to explain the issue of the social phenomenon of illegal migration to Singapore.

Abstract (sommario):
This dissertation analyzes the complex relationships between language, immigration, and labor and housing market outcomes. First, I model the urban labor market as segmented by language barriers. The prediction of this segmentation theory is confirmed by Canadian Census data, which allow me to identify a worker's labor market segment by her work language. Second, I explore whether the housing market reflects people's willingness to pay for higher quality social-ethnic interactions. By combining housing transaction data and Census information, I am able to test such a relationship with positive results. Finally, I ask what properties housing price series have if some people have better knowledge of the future immigration/migration flows to a city. Under this setup, the price series become serially correlated and the price volatility varies over time. The model also explains the long-standing price-volume relationship in housing transaction data.

Abstract (sommario):
The European Union has become a region of intense immigration and the movements of third country nationals from outside or within the territory of the Member States has jumped to the top of ECIEU political agenda. Important ECIEU measures have been adopted concernmg the most important aspects in the area of immigration since the late eighties. The movements of third country nationals have nonetheless been regulated by EC law, although incidentally, since the origin of the Communities. The analysis covers fifty years of Community immigration history and it studies the changes in the immigration movements themselves and, in particular, of their regulation under ECIEU law. The research focuses on the factors that have contributed and that are shaping the emerging European immigration policy in order to evaluate the real impact of old and, especially, new rules on racial and ethnic minority groups and women. An EU integrated policy covenng all aspects related to third country nationals does not exist but very important steps, consolidated in the Amsterdam Treaty, have been taken over the last decade (1989/1999). The strategy to adopt at EU level is not very clear or coherent due to the complexity of the area itself and because of the different approaches of the EU Institutions on the answer to give to immigration issues. It has been demonstrated that although some gaps remain in the labyrinth of ECIEU immigration rules, the main trend, imposed principally by the Member States, is towards the creation of a White Fortress Europe.

Abstract (sommario):
Historically, Chinese immigrants to the United States are a special group. They were or almost were banned from 1882 to 1968. Since in 1968 the United States abolished national origin quotas and eliminated national, race, or ancestry as a basis for immigration, thousands of Chinese immigrants came to the United States. The total population of Chinese immigrants to the US between 1980 and 2002 was 911,220, whereas it was 136,843 between 1891 and 1979. Not only did the population of Chinese immigrants have great change, the quality of Chinese immigrants also had substantial difference from those immigrated in the last century. However, there are very limited literatures focusing on the dynamics of Chinese immigration in these twenty years, which is the most important time period for Chinese immigration. The following study tries to describe the dynamics of Chinese immigration to the United States between 1980 and 2002; and analyze the influence of the American immigration laws on Chinese immigration. The dynamics of Chinese immigrants are described and analyzed by different migration categories. Other social and economic factors are added to comprehensively understand the change of Chinese immigration.

Abstract (sommario):
Contemporary liberal democratic societies currently enact immigration policies that are morally indefensible from a liberal autonomy and social justice perspective. In a world characterized by stark inequalities in individual opportunities to lead autonomous lives, and in which many individuals lack the basic conditions for autonomous functioning, I argue that contemporary immigration regimes that distinguish between desirable immigrants---who are typically from similarly wealthy countries---and undesirable one ---who are typically members of the global poor---conflict with liberal commitments to individual autonomy and equality of opportunity. I advocate that such commitments should lead wealthy countries to change their criteria for immigration, so that they admit proportionally many more of the global poor than they currently do. Such redistributive immigration policies are a way for rich countries to fulfill their global distributive justice duties. The thesis examines two major objections to formulating immigration policies on grounds of global distributive justice. First, some theorists posit a moral distinction between compatriots and non-compatriots, and argue that duties of redistribution should be restricted to compatriots. Second, some theorists fear that redistributive immigration schemes will have negative consequences on the conditions of social justice in host communities. This fear derives from the assumptions that social solidarity and social trust will be eroded by the greater ethno-cultural heterogeneity that is likely to result from the implementation of redistributive immigration policies. In response I show, first, that social solidarity is not circumscribed by national boundaries; the empirical evidence does not support claims that solidaristic acts rely on a predefined idea of community. Second, drawing on the Canadian case study, I find that institutional trust rather than interpersonal trust is key to motivating compliance with social welfare policies, and that this kind of trust can be sustained under conditions of ethno-cultural heterogeneity.

Abstract (sommario):
This dissertation studies the emergence and the development of an immigration and asylum control policy in Italy over the last twenty-five years. The theoretical and methodological background of the research is a discourse-analytical approach to public policy. My analysis is therefore focused on official political discourse about immigration control and my main data are parliamentary debates concerning the most important Italian immigration acts passed from the early 80s to the present. The general aim of the thesis is to challenge the taken for granted nature of contemporary immigration policies by showing in the specific case of Italy how the meaning of the immigration control problem was constructed differently across time and across the political spectrum by the political elite. I also show that by defining the problem space Italian political elite discourse has conditioned the possible policy on the issue, rather than merely legitimising it ex post. In each Chapter ofmy thesis I deal with a different stage ofthe history ofItalian immigration control policy and I highlight the emergence, consolidation and transformation across political parties and political coalitions of different arguments, narratives and stories in relation to the nature of the immigration problem and the rationale for itS regulation. I then examine the policy devices that: were consistently advocated. My research also aims at understanding under what conditions and for what reasons the Italian elite discourse on migration control has been articulated in a certain form and why it has been changed or maintained. I show that the conditions of possibility of a certain political discourse about migration, and consequently of a certain immigration policy, are subject to change and are influenced by the interaction of multiple factors. Among them a crucial role is played by contingent party political struggle; mutual discursive positioning; pre-existing discursive structure on the migration policy issue; political ideologies; representations of national identity; transformations in the structure of political institutions and the impact of Europe and the ED policy on internal narratives about national identity.

Abstract (sommario):
All nations with significant dimensions of immigration and ethnic minorities are facing policy tensions stemming from two contradicting fundamental constitutional principles. The establishment and preservation of nationhood seems to require cultural homogeneity and associated integration of the population living on a specified territory. However, the aim of integration is challenged by the principle of recognising and safeguarding cultural identities of minorities and immigrants. One of central debates concerns language policy. This country study concerns the recent relation of language policy and immigration policy in Germany. It is based on the analysis of public discourses circling around the legislative process and the subsequent application and amendment of the foreigners’ statute of 1997 and the immigration statute of 2004 including the Green card initiative (2000) and the debate about restrictive policies after the Madrid bombing (2004). It also contains a case study of the controversies on the German-only policy on the playground of a multi-ethnic school in Wedding, a district of Berlin. Recent media coverage shows that this example, picked in 2006, has since achieved a paradigmatic quality. The thesis outlines and applies aspects of critical discourse analysis for the interpretation of selected relevant texts, mainly contained in national quality newspapers. The case study is also based on interviews and use of correspondence addressed to the school.

The study argues that implicit in the Universal Declaration of Human Rights, the principle of immigration as human rights is supported by principle of positive freedom, negative freedom, and equal autonomy. The study endorses a liberal egalitarian perspective by claiming that human right to immigrate promotes equal autonomy. The study also investigates why the principle of immigration as a human right has been dismissed by doctrines within Liberalism. It argues that a state lacks a legitimacy to employ a principle of national self-determination against the immigration issue. Instead, a state has a moral obligation to the protection of a human right to immigrate; it also has a duty to provide equal social rights to the immigrants in compared with those of the citizens.

Abstract (sommario):

Abstract (sommario):

This dissertation addresses the problem of racial stratification of the Latino community in the United States from the theoretical position of critical race theory. Racial stratification for Latino residents and Latino immigrants is possible in the everyday through a series of practices that allow for persons of the community to contribute to the proliferation of race in American society by rendering race very difficult to address politically. The theoretical analysis of friendship as a form of moral aesthetics in the works of Aristotle, Kant, and Rousseau allows for a theory of race that addresses the invisibility and the transcendence of race constitutive of American society and, therefore, constitutive of the racial stratification of the Latino community in the United States. In this theoretical development, race is thought as an aesthetic of both the citizen and the immigrant subjects or, in other words, as a race-aesthetics. McKnight's (2010) theory of the conditionality of race, Hall's (New Ethnicities 1996, Race, Articulation, and Societies Structured in Dominance 1996) theories of cultural representation and hegemonic domination, Gilroy's (1995) theory of Black Atlantic counterculture, and Mills' (1997) theory of the hegemony of the racial contract are critically engaged and expanded with the theory of the race-aesthetic.

Abstract (sommario):
A source of emigration until the early 1970s, Greece has become home to a rising tide of immigrants since 1991, and its foreign-born population rose from below one to over 11 percent. Equally important is the fact that the Greek state has historically premised national belonging on ethnicity, and striven to exclude people who did not exhibit Greek ethnic traits. My study examines how immigration has challenged this nationalist model of ethnically homogeneous belonging. Further, it uses the Greek case to problematize the hegemonic assumption that the nationalist model of social organization is a human universal. Data consist of reactions to a 2010 landmark law that constituted the first jus soli bill in the nation’s history, and include a plurality of voices found in parliamentary proceedings, newspapers, a government-sponsored online forum and Facebook discussions. Voices examined correspond to three main conceptual camps: people who premise belonging on ethnicity and hegemonic definitions of what it means to be Greek, people who mitigate nationalist norms enough to include immigrants, but reproduce a nationalist worldview, and people who seek to divorce political belonging from ethnicity altogether.

Abstract (sommario):
The fall of the communist regime in Albania has lead to the influx of minority immigrants of Greek origin into Greece, transforming it from a country of origin to a recipient country of immigrants. This influx, often confused with the repatriation of emigrants, is marked by the xenophobic dimension of having to live with the “foreigners-expatriates”. The members of the minority, as a special category in the Albanian population but also as an immigrant group in the Greek community, were gradually lead to the (re)formation of their identity, according to the demands and standards of local recipient communities. Therefore, through the cultural osmosis among local and immigrant communities, in the official –state– as well as the unofficial levels, their identity has been (re)defined after the immigrational experience, and as a generative force of group goals and individual choices is (re)produced ethnically through innovative codes, corresponding to their contemporary field of reference

Jaozandry, Marie. "Les femmes africaines en immigration". Thesis, Paris Est, 2009. http://www.theses.fr/2009PEST0075.

Testo completo
Abstract (sommario):
Our study of Immigrated African women opens up the way to a new reading of the female character in novels and short stories by three women writers : Calixte Belaya, Leila Sebbar and Michèle Rotoson. This controversial subject of the African woman character arouses many crucial debates. African women have often been accused of having remained behind, compared to other women throughout the world. They need changes as much in their perception of things as in their implication in the development of their country. Education is one of the best way for them to acquire skills and essential qualities of a dynamic growth phase. It is thus necessary to return in the world of knowledge to think about her professional commitment and to arm herself of necessary tools as well for her personal fulfilment as for her own country. Obviously it is this context that a few women are devoted themselves to writing and to try to fight for coming out this dulling which freezes them up and prevent them from evolving in the modern society. So as part of this study for the end of my studies, I will analyse the career and practical experiences of African Women in Immigration. This work is based on novels and short stories written by women who inspired themselves from their daily lives to convey their helplessness which is often part of a migrant population. At the time when these novels were written, it was mainly men who motivated by the idea of a better job, migrated to France bringing along their wives and their children with them. It is anymore the case today. In our study we are going to follow the experiences of a few heroines of novels by revealing their successes and their failures. At the same time we are going to bring out the positive and negative influences of their social backgrounds, the striking and indelible facts which constitute the factors of personal and professional changes

Sandelind, Clara. "Nationalism and attitudes to immigration". Thesis, University of Sheffield, 2015. http://etheses.whiterose.ac.uk/8731/.

Testo completo
Abstract (sommario):
National identity is believed to create a sense of trust and solidarity amongst co-nationals that is necessary to underpin the democratic welfare state. Immigration, in turn, is viewed as a potential threat to the stability of such a shared national identity. Yet concerns about immigration in public opinion are to a large extent dependent on how people understand the meaning of their national identity. Therefore, this thesis argues that different kinds of shared identities may construct images of immigration that are seen as less of a threat. The key argument this thesis pursues is that attitudes to immigration are affected by constructed understandings of identity, belonging and exclusion. To this end, a focused, qualitative, comparative study of Sweden and Britain has been conducted. 47 in-depth interviews were conducted with respondents from the two countries, concerning questions of identity, democracy, welfare and immigration. The main findings are threefold. First, three different understandings of a shared identity are found, for which belonging is based either on an idea of a common nation, on making contributions to the community or on a commitment to social and political institutions. Second, these identities are differently related to attitudes to immigration. Those for whom belonging is based on a common nation are the most negative to immigration. Those for whom the boundaries of belonging depend on institutions are the most positive, followed by those who base belonging on contributions. Third, national identity seems to be constructed by interpretations, as well as the institutional and political context, of the democratic welfare state. Thus, the welfare state is argued to be an important, yet overlooked, factor that influences the formation of symbolic boundaries of political communities. In short, ideas of institutions and contributions were found to have strong inclusionary potential, in contrast to when belonging is primarily based on renderings of a common nation. This thesis therefore argues that a form of “institutional patriotism”, for which belonging is based on the experience of, and commitment to, fair and effective social and political institutions, can generate trust and solidarity whilst being more welcoming to newcomers.

Abstract (sommario):
The purpose of the thesis is to evaluate economic theory of immigration and economic growth. We use Borjas theory (1995) about the economic benefits from immigration as a point of departure. Borjas theory says that the costs of immigration must be compared to the economic benefits of immigration. If the benefits of immigration are great enough, immigration can be compared to an investment with a high rate of return. To maximize the gains of immigration the immigrating population should complement the factors of production of the receiving country. To examine the relationship between immigration and growth econometric models using panel data for the EU25 countries over the time period 2004–2015 have been estimated. To test if our results are robust we use three different measurements of immigration: quantity of immigrants, refugee population and number of new citizens. The results show a significant positive relationship between immigration and growth, supporting Borjas hypothesis of benefits of immigration. The thesis further discusses if the economic growth actually is a product of the lowering of wages or if endogenous technological change as a result of an increase in human capital is the answer. Immigration as an answer to Europe’s demographic changes is also discussed. The conclusion of the thesis is that there is a positive relation between immigration and growth, which aligns with the economic theory, but that it is difficult to comment on the underlying mechanisms of the relationship. Conclusively a joint immigration policy for the EU is recommended for the purpose of fully capturing the economic benefits of immigration.

Abstract (sommario):
The research on natives’ attitudes regarding immigration has increased during the past decades. The overall findings question the common theory of labor market competition and that native attitudes are affected by personal economic considerations. In the same time an increased concern in the political debate has become immigration. In many countries, there is a growth and progress of political parties with a far-right orientation that disapproves and attempts to prevent immigration. We examine data on attitudes towards immigration from eight rounds of the European social survey (ESS) which covers the years between 2002-2016. We study if the attitudes in Europe towards immigration from poor non-member countries of the European Union have changed during the 21th century and examine if the massive acceleration of refugee applications during the refugee crisis in 2015 has had an impact on the attitudes towards immigration. We estimate different models to examine how different factors are associated with individuals' attitudes towards immigration. Furthermore, we test if the labor market competition model holds for the seventh round of ESS due to limitation in data. We find that natives’ attitudes have not become worse in Europe, and that the refugee crisis in 2015 has not made the attitudes worse. We find that the factors that are associated with individual attitudes towards immigration are to a large degree connected with cultural values and beliefs, and that individuals with more years of schooling are more likely to favor immigration regardless of where the immigrants come from. These findings are consistent with the growing body of empirical findings that considers that cultural values and believes are the main drivers of attitudes towards immigration, and that actual effects of immigration on income and employment are quite small. These findings put the labor market competition premise in forming immigration attitudes into question.

Abstract (sommario):
The thesis is a compilation of three articles that explore the relationship between immigration and minority nations. It focuses on Stateless Nationalist and Regionalist Parties (SNRP) through the lens of the centre periphery cleavage. Overall, the articles make contributions towards the research question how do the main dimensions of the centre-periphery cleavage (identity, territory and economy) reflect on the SNRPs’ discourses on immigration? Each article explores one of the dimensions of the centre periphery cleavage. They analyse how identity, territorial distribution of powers and the economic context appear in the SNRPs’ official discourse on immigration. Paired comparisons of different SNRPs in different contexts (Catalonia, Quebec and Scotland) are carried out using qualitative content analysis of manifestos, parliamentary debates and other party documents. The thesis provides, among other contributions, a deeper understanding of SNRPs discourses on immigration and how centre-periphery relations interfere in its construction.
