Abstract (sommario):
Today, the Rainbow Nation as the central metaphor for postapartheid South Africa falls short of serving as a unifying identification marker due to its tendency to gloss over contrasting living realities of diversified identities and ongoing systemic discrimination. The South African Fallism movements – the student-driven protests against neocolonial structures in academic institutions – spearheaded public criticism with the current state of ongoing social disparity in South Africa and revived the critique of so-called rainbowism, i.e., the belief that a colour-blind society can be created. In an application of Critical Discourse Analysis focusing on mythical metaphors, this article asks to what extent the new president Cyril Ramaphosa in his maiden State of the Nation Address projected a post-Zuma South African nation and answered to the challenges posed by Fallists.

In 2015, South African university student protests drew critical attention to the state of higher education in the country. Newspaper reports of the student protests were pervasive. Reports of the violence that characterised parts of the protests dominated the news despite the students’ impact on the positive changes in higher education. Using a thematic analysis, this article interrogates student representation in newspapers from the inception of the protests to the end of the 2015 academic year. Four themes were identified: students as destructive vandals, violators of the rights of others, law-breakers, and agents of transformation. Results indicate that newspaper reports of the violence overshadowed reports of the positive changes that the student protestors catalysed, and in so doing, newspaper reports during this time delegitimised the students as agents of change.

Abstract This short essay offers reflective feminist insight into the Fees Must Fall Movement of 2015–16 that was led by students and workers at universities in South Africa. It considers the ways in which Black feminist life is negotiated and embodied in a contemporary student-worker movement that remains oriented by and toward hegemonic hypermasculinities. This text further argues that Black feminist intervention and mobilization is distinct from women's movements as they happened under apartheid. Feminist organizing is principled in particular ways, and these ways are evidenced by Black feminist interventions within the Fees Must Fall (FMF) movement. This essay demonstrates how intersectionality functions as more than a diagnostic tool. Intersectionality and how it is imagined and used in the contemporary South African feminist context does not only recognize multiple and interlocking oppressions. Intersectionality is also in itself a methodology. Intersectionality as demonstrated by feminists and the LGBTIQA community of the FMF movement is a methodological choice that requires that various forms of protest and intervention be used simultaneously to challenge systemic oppressions. Centering intersectionality as methodology works to disrupt archaic perspectives on what is and is not activism, thought, or feminist work. Relying on the intellectual work of student-activists in the movement, otherwise known as “fallists,” and memory and story-telling as methodological tools, this essay begins to imagine how we can think, research, and write in ways that memorialize and archive our lives, our histories, and our collective imaginaries.

The waves of 2015/2016 #FeesMustFall protests saw South African students questioning every inch of the higher education structure and its exclusionary patriarchal racist roots. Few alliances between students and staff were created because of the “us vs. them” divide, despite junior scholars in particular, having a great deal in common with students and the oppression and trauma they endure. “Post-FMF” saw many institutions scramble to create “transformative policies” for students and minority staff like women, people of colour, people with disabilities, the LGBTQ+ community and so on. Now, years later, everyone has policy fatigue. Minority staff have been pushed back to the margins and students battle the same challenges the fallists questioned. This paper with be a narrative study tracking the experiences of three junior scholars, black women at historically white universities; with the pseudonyms *Thoko, *Andile and *Thandazile. The research took a narrative approach rooted in qualitative research. It studies their insiderness/outsiderness to show just how little work institutions have done to ensure equality and inclusivity. This piece unpacks issues of belonging, and their experience as they try to navigate being postgraduate (PG) students and being staff, and being insiders and outsiders in both. This discussion is in relation to Alice Walker’s womanism theorising, focused on the experiences of black women. The authors also bring their own life experiences because the strong similarities between their own experiences and those of their participants are impossible to ignore. The authors’ diverse scholarly background is used in the analysis, leaning towards Critical Race Theorists like Cornel West’s discussion on black nihilism to better understand the aggression of black men towards black women in the academy. This is juxtaposed with a crisis of masculinity discussion. These experiences will also be viewed from a victimological perspective.

This article examines the transformation of the Baye-fall movement (Baye-fallism, henceforth), a particular form of Senegalese Muridism, as it extends into the Senegalese diaspora. In particular, the article explores shifts in understandings of what it means to be a ‘good’ Baye-fall, as Senegalese migrants in Spain become confronted with hostility in their new social context, and as the need for spiritual engagement and community belonging intensifies. Starting with the origins of Baye-fallism as a Sufi heterodoxy in Senegal, the paper then focuses on Senegalese migrants in Lavapiés (Madrid, Spain) and in Granada (Andalusia, Spain). The central argument is that in this diasporic context, adhesion to Baye-fallism becomes more intense, and that the performance of Sufi orthodoxy takes on new meaning, which also informs discussions about being a ‘good’ Baye-fall in Senegal.

Abstract (sommario):
Il diritto fallimentare ha subito nell’ultimo decennio sostanziali modifiche finalizzate a determinare un vero e proprio cambiamento della concezione della crisi d'impresa nonché della figura del fallito, variandone i connotati e modificando il punto di vista del legislatore del 1942. Tra le tante novità apportate da queste riforme, quella del 2006 introduce l’istituto dell’esdebitazione. Questo istituto, già presente nei modelli legislativi americani ed europei, consiste nell’incentivante liberazione del debitore, persona fisica, dai debiti residui nei confronti dei creditori concorsuali non soddisfatti integralmente. Lo scopo di tale istituto è quello di recuperare l'attività economica del fallito per permettere un nuovo inizio, una volta azzerate tutte le posizioni debitorie. L'obiettivo di questo elaborato è quello di delineare il quadro normativo dell'esdebitazione valutando i punti di forza e le sue criticità.

Con il presente elaborato si intende analizzare l’istituto dell’esercizio provvisorio dell’impresa del fallito. Il lavoro si articola in tre parti principali, in cui sono suddivisi i diversi capitoli. La prima parte è dedicata ad un’analisi riguardante l’evoluzione del diritto fallimentare nella storia, dal 1882 ai giorni d’oggi, ponendo particolare enfasi sul cambiamento avvenuto con la riforma del 2006 e sul passaggio da una visione pubblicistica ad una visione privatistica del fallimento. Nella parte centrale dell’elaborato ci si focalizza sull’analisi dell’art. 104 L. F. (Esercizio provvisorio dell’impresa del fallito), analizzandone i vari i commi dal punto di vista della dottrina e della giurisprudenza. Da ultimo, con la parte finale si analizza l’istituto dell’esercizio provvisorio nell’ambito delle società sportive, focalizzandosi in particolare sul recente caso del fallimento del Parma Calcio.

Fallists belong to a constellation of radical student activist movements that pledge to disturb and reimagine South African society. Rather than restricting themselves to coordinated forms of collective action, Fallists’ advance their “revolution-as-becoming” within a context of everyday resistance (Haynes & Prakash, 1991; Molefe, 2015). In this dissertation, I propose that Fallists form an “emerging networked counterpublic” made up of individual activists that enact everyday forms of resistance on Twitter (Jackson & Foucault Welles, 2016:399). This dissertation explores the use of Twitter by a microblogger who has emerged organically as a “crowdsourced elite” among Fallists (Papacharissi & de Fatima Oliveira, 2012). I contend that this microblogger exemplifies the repertoires of communication and resistance that pervade within Fallist networks on Twitter (Jackson & Foucault Welles, 2016). The microblogger is identified through methods of observation and social network analysis (SNA). “#whitetip,” a Twitter hashtag network that exemplifies Fallist communication and resistance, informs the interpretive content analysis that follows. This analysis is conducted on the tweets that the microblogger broadcast between 1 April and 30 September 2016. Tweets are categorised according to “evaluative frames” that emerged inductively during the course of analysis. I find that “resentment,” “pride and care,” and “play” made up the vast majority of evaluative frames. The microblogger employs the platform in a manner that disturbs dominant understandings of public sphere communication: the microblogger’s tweets are evaluative rather than deliberative, and assert a marginal, embodied subjectivity (Papacharissi, 2014; Warner, 2002).

La presente tesi affronta l’attuale disciplina del fallimento nelle società. Com’è noto, il D.lgs. n. 14 del 12 gennaio 2019, emanato in attuazione della L. 155 del 19 ottobre 2017, introduce nell’Ordinamento il nuovo Codice della Crisi d’impresa e dell’insolvenza, che in considerazione della modifica apportata all’art. 389 dello stesso dall’art. 5 del recentissimo D.L. 23 dell’8 aprile 2020 (“Decreto Liquidità”), entrerà in vigore il 1 settembre 2021 e sostituirà integralmente la vigente Legge Fallimentare (Regio Decreto 267/42). Probabilmente con tale scelta “forzata”, connessa all’attuale emergenza sanitaria e di conseguenza a quella economica che purtroppo si prospetta, si vuole consentire a tutti i soggetti coinvolti di continuare ad operare secondo una disciplina consolidata e permettere al sistema economico di superare la fase più acuta dell’emergenza economica. Del resto, è evidente che in un clima di incertezza e di una crisi economica derivante da causa di forza maggiore, di entità rilevante e diverse a seconda della durata dell’emergenza e dell’impatto sui vari settori produttivi, non potrebbero avere un reale significato gli indicatori della crisi ipotizzati; anzi, la loro “efficacia” probabilmente pregiudicherebbe la ratio della riforma, vale a dire, quella di intercettare tempestivamente lo stato di crisi, tramite un sistema di segnalazione tempestiva, e di intervenire sulla stessa, favorendo invece l’apertura di una procedura liquidatoria. La presente tesi nel primo capitolo analizzerà la disciplina fallimentare nel suo complesso e le novità introdotte con la nuova riforma, avente effetti modificativi sull’intera disciplina; per poi proseguire nel secondo capitolo, approfondendo il ruolo fondamentale del curatore e i suoi profili gestori all’interno della procedura. Il terzo capitolo affronterà il tema dell’autonomia processuale del fallito e le connesse questioni di legittimità avverso gli atti impositivi.

Lingering in the topic of literary engagement, this article follows a reader enthralled by words and the significant non-space where fiction and reality intersect. Using Terry Fallis’ political satire “The Best Laid Plans,” a physical map of the reading is followed as I amble through the Ottawa sites depicted in the novel. In this literary pilgrimage, reading is considered as a corporeal (re)action with a series of educative affects. Contrasting this experience with common in-school reading practices, this narrative encourages the honouring of the individualized relationship between reader and text as well as highlighting the pedagogical value of dallying in a work of fiction. Drawing on concepts of spatiality, I contemplate the notion of the home city as a familiar and yet capricious place, made more significant by a fantastic connection. Reading in significant spaces has a lasting, sprawling outcome whereby text, place and reader are all affected.

El tema de los Estados fallidos es una cuestión de singular actualidad, tal como lo señala Patrick Stewart1, los últimos 20 años —bautizados con el anodino calificativo de la era post Guerra Fría— podrían igualmente ser conocidos como la era de los Estados Fallidos. Tras décadas de enfrentamiento con el poder soviético, sucesivas administraciones estadounidenses se vieron de repente enredadas en la plaga de problemas de los países más disfuncionales del planeta. Aunque persiste la competencia ente las grandes potencias, son a menudo los casos desesperados del mundo —de Somalia a Afganistán, de Haití a Liberia, de Pakistán a Yemen— quienes dominan la agenda de política exterior de EE UU. Esta tendencia comenzó a principios de los 90, cuando una numerosa oleada de colapsos de Estados y violencia interna —incluyendo, aunque desde luego no únicamente, los episodios de genocidio en la antigua Yugoslavia y Ruanda— parecieron anunciar un nuevo desorden mundial.<br>Tesis

AbstractScience, Technology, and Innovation play a crucial role in the Sendai Framework for Disaster Risk Reduction 2015–2030 (SF DRR). The International Consortium on Landslides (ICL) initiated the Sendai Landslide Partnerships 2015–2025 as a voluntary commitment to SF DRR. In 2020, the ICL launched the Kyoto 2020 Commitment for Global Promotion of Understanding and Reducing Landslide Disaster Risk (KLC 2020) as a follow-up of the Sendai Landslide Partnerships 2015–2025. Closely related to the above-mentioned Innovation are patents as a form of intellectual property rights and are often used as an innovation assessment parameter. This article reports on a study conducted to look at the patent documents that are available in open-access databases in order to evaluate how well they relate to the field of landslide research and technology. Landslide-related patent documents were extracted using different search terms in the patent document titles, abstracts, claims and/or their general text from the Google Patents, using the Espacenet tools from the European Patent Office, and the Derwent Patent Index inside the Web of Science offered by Clarivate Analytics, respectively. The extracted patent documents were analyzed with regard to the applicant respectively inventor affiliation (academic, non-academic, country of affiliation) and to the technical field of a patent using well-known patent classifications. The most active countries claiming landslide-related patents were recognized. Furthermore, review and research articles in SpringerLink and SCOPUS databases were searched to study how often scientific articles are citing landslide-related patents. The results of the study can be summarized as follow: (i) in the Google Patents database there are 15,000 + landslide-related patent documents, and in the Espacenet and the Derwent Innovation index database 5000+, respectively. In the patents titles, abstracts, and claims, processes are more often used to describe the patent than the technology; (ii) the number of technological (non-science) based patents is higher than that of academic (science-based) patents, with some specific field of applications, where the situation is the opposite; (iii) with regard to the different areas of technology to which landslide-related patent documents pertain, the categories “G-Physics” and “E-Fixed constructions” are clearly prevailing: “G” for debris flows and landslides, and “E” for fallings rocks and mudflows; (iv) the majority of landslide-related patents are filled and/or granted in China, followed by Japan and South Korea, USA and EU member countries—five major emerging economies (called BRICS) are outperforming developed countries, with a very prevailing Chinese contribution; (v) only a fraction of the order of a few one-in-thousands of landslide-related patents documents are cited in journal review and research articles.

Abstract With the development of oil and gas resources extending to the deep sea, more and more submarine pipelines are applied, and the importance of the structural and functional integrity of submarine pipelines is becoming more and more prominent. Dent has long been considered one of the potential factors affecting the integrity of submarine pipelines, which can be formed when pipelines are impacted by fallings objects from the sea surface. Due to the seabed subsidence, pipeline suspension and earthquake, mudslide activity and other factors, submarine pipelines may be under bending moment, seriously affecting the safe operation of submarine pipelines. The study of failure and limit load capacity of submarine pipelines under external pressure and bending moment is of great significance. In this paper, the nonlinear finite element method is used to study the collapse failure and local buckling failure of subsea pipelines under external pressure and bending moment respectively. The process of the pipeline being dented by the impact of objects is simulated, spherical denter and wedge-shaped denter are considered. The influence of D/t and dent depth on collapse capacity and bending capacity are investigated. The results can be referred in engineering practice.

Wells drilled in North Pakistan are notorious for extreme tectonic stresses, pore pressure &amp; geological uncertainties which in turn create significant amount of wellbore instability related challenges. All these problems posit extreme drilling challenges and results in significant NPT. Similar challenges were expected for the drilling of X-2 well being drilled by MOL Pakistan in TAL Block. The well was planned to be drilled to 3965m MD in J-shape profile in 147 days. However, during execution due to geological variance the target was revised to 4150m MD, and the profile was changed to S-shaped to further drill newly identified targets within the target tolerances. Despite the change in profile, increased footage and challenges on T&amp;D, Hydraulics and Geo-mechanics front, the well targets were successfully achieved in 89 days with 30% cost savings from the project. The conundrum for efficient drilling in North Pakistan has been long explored however several short fallings were recorded in past. The Drilling team of MOL Pakistan deployed efficient data analytics, engineering, robust communication, and quick response skills to execute this project. This paper discusses in detail the thought process adopted during planning and execution of the well. The limiters that were posited and how they were managed.

Objetivos: Estudiar la eficacia del aripiprazol para el tratamiento del craving en los trastornos por uso de sustancias tóxicas. Material y métodos: Revisión de un caso clínico y literatura existente al respecto. Resultados y conclusiones: Se presenta un caso clínico de un paciente varón de 46 años, sin antecedentes medicoquirúrgicos de interés. Seguimiento por parte de Psiquiatría y Psicología Clínica desde mayo de 2017 por consumo abusivo de alcohol. Como antecedentes familiares psiquiátricos, dos hermanos con síndrome de dependencia a opiáceos y dos con diagnóstico de Esquizofrenia Paranoide. Durante los primeros meses de seguimiento se objetivó consumo asociado de cannabis (3-4 "porros"/día). Tras un año de consultas, reconoció craving y pensamientos intrusivos, egodistónicos, que relacionaba con el consumo de cannabis (recogida de latas y colillas de la calle para consumirlas), con importante repercusión afectiva. Desde el inicio se trató activamente con distintos antidepresivos hasta llegar a Sertralina 200 mg/día y antipsicóticos (Olanzapina hasta 15 mg/día, Quetiapina 100 mg/día; Clotiapina 40 mg/día y Paliperidona hasta 18 mg/día que se suspendió por afectación sexual). Asimismo, se asociaron distintos tratamientos de tipo ansiolítico. Tras varios ajustes de tratamiento psicofarmacológico, se logró mantener abstinencia alcohólica, aunque persistió el consumo de cannabis y las conductas de recogida. Hace cinco meses se inició Aripiprazol 15 mg/día, tras lo que se ha mantenido abstinente hasta el momento actual. Tras varios tratamientos antipsicóticos fallidos, el aripiprazol parece haber resultado útil para controlar el craving y la sintomatología asociada al consumo de cannabis. Según los estudios revisados, se considera una estrategia farmacológica eficaz para pacientes con patología dual. Aripiprazol lleva a cabo una modulación dopaminérgia y serotoninérgica sobre los circuitos subcorticales, que podría guardar relación con el control del craving, la impulsividad y los síntomas ansiosos relacionados.

La Ciudad Vieja, ha rappresentato per secoli il centro funzionale, abitativo e commerciale della&#x0D; città di Montevideo, eppure nel corso dell’ultimo secolo ha subito molte trasformazioni che ne&#x0D; hanno mutato sia il volto urbano che la composizione sociale. Risulta infatti essere il barrio&#x0D; Montevideano con il maggior calo di abitanti (circa il 20%) e la causa principale di tale&#x0D; fenomeno è imputabile alla localizzazione del porto commerciale nella baia e al conseguente&#x0D; svilupparsi in loco dei servizi legati all’attività di quest'ultimo, che hanno trasformato l'antico&#x0D; centro storico in un “barrio portuale”.&#x0D; Lentamente la Ciudad Vieja si svuota e si classifica come luogo pericoloso e degradato agli&#x0D; occhi dei suoi abitanti, che se ne allontanano attratti da abitazioni più comode e tranquille sul&#x0D; bordo dell'oceano.&#x0D; A questo flusso di popolazione in fuga, se ne affianca uno contrario, invisibile, composto dal&#x0D; ceto più povero, il quale in cerca di un rifugio, è attratto dallo stock abitativo disponibile e&#x0D; abbandonato che occupa illegalmente e dalle possibilità di lavoro offerte dal vicino porto. Il volto&#x0D; della Ciudad Vieja cambia ancora, e il degrado urbano delle vie, corrisponde al peggioramento&#x0D; delle condizioni di vita dei suoi nuovi abitanti, i quali vivono in totale assenza di regole igieniche,&#x0D; in condizioni di sovraffollamento, privi di acqua e luce.&#x0D; Nonostante negli ultimi anni le amministrazioni si siano occupate del degrado urbano e sociale&#x0D; presente nella zona, le proposte di rilancio pensate, limitate al recupero di alcune facciate o alla&#x0D; pedonalizzazione di alcune vie, son fallite miseramente e il fenomeno non è stato arginato,&#x0D; mentre l'auspicata partecipazione di investitori privati non ha mai avuto seguito. For centuries the Ciudad Vieja was the functional, residential and commercial centre of the city&#x0D; of Montevideo, however over the past century it has undergone many transformations, which have changed its urban essence and its social composition. It has been shown to be the barrio&#x0D; in Montevideo with the highest population decline (about 20 %). Such phenomenon may be&#x0D; attributed to the position of the commercial port in the bay and to the consequent development&#x0D; of activities linked to the port, which have transformed the old town centre into a "port barrio".&#x0D; The Ciudad Vieja slowly emptied and it was seen as dangerous and degraded by its inhabitants,&#x0D; who went away from it attracted by more comfortable and quiet homes by the ocean. Another&#x0D; flow contrasted that of the fleeding population: it was made up of the lower class in search for&#x0D; refuge, attracted by the vacant and abandoned homes, which it occupied illegally, and by work&#x0D; opportunities offered by the nearby port. The essence of the Ciudad Vieja changed once again&#x0D; and the urban decay of the streets was equivalent to the worstening of the living conditions of its&#x0D; new inhabitants, who live without sanitation rules, in overcrowded conditions and without&#x0D; running water and electricity. Although in recent years administrations have dealt with the area's&#x0D; urban and social decay, the proposed solutions, limited to the reclamation of a few facades and&#x0D; to the pedestrianisation of some streets, have failed miserably and the phenomenon hasn't&#x0D; been contained, while private investors have never participated.

Sin embargo, muy poca atención han recibido las instituciones que se pueden considerar como experiencias fallidas. El análisis detallado de este último tipo de instituciones en la región latinoamericana se constituye en una fuente invaluable de lecciones para continuar expandiendo la frontera del conocimiento práctico en microfinanzas. Con base en entrevistas con expertos y su opinión acerca de qué puede considerarse una experiencia fallida, el presente estudio identifica seis tipos de causas comunes de fracaso de Instituciones Microfinancieras (IMF). Se analizan en profundidad 10 casos que tipifican cada una de estas causas y se extraen valiosas y variadas lecciones que incumben a diversos actores.

Pablo Moñino llevaba dos largos años apostando por producir cal en Turkana en un horno tradicional. Después de varios intentos fallidos, a la cuarta hornada, en 2015, se logró el éxito necesario: una cal de alta pureza y con todas las características precisas. Ahora, en este artículo, detallaremos cómo se fue avanzando e innovando en el proyecto ‘Chokáa’, hasta poder llegar hoy al empleo de más de medio centenar de jóvenes turkanos, fabricando importantes aportes de materiales tradicionales, e iniciando la construcción de nuevos edificios, de un tamaño cada vez mayor, en las misiones de la zona.

A pesar de que la agenda de políticas vinculada a la internacionalización productiva cobra cada vez mayor relevancia, la experiencia de los países de América Latina en la implementación de las mismas ha sido mixta. Una de las razones que explica la gran cantidad de intervenciones fallidas o truncas es la falta de evaluación previa sobre la disponibilidad de capacidades estatales requeridas para cada política, así como de los costos y riesgos asociados. Sin embargo, no existe un marco conceptual que facilite el abordaje de dicha evaluación. Este trabajo realiza una contribución en ese sentido. Construimos una taxonomía de políticas de apoyo a la internacionalización productiva en términos de sus requerimientos de capacidades estatales, costos y riesgos. Luego, evaluamos la evidencia disponible sobre utilización e impactos de cada tipo de políticas en América Latina y su relación con las capacidades estatales disponibles en los países de la región. Sobre esta base, concluimos que es necesario rebalancear el portafolio de políticas vigentes hacia instrumentos que requieren capacidades más complejas (particularmente en la fase de su ciclo de vida que denominamos “operativa”), por lo que dicho rebalanceo debe ir de la mano de un esfuerzo por construir aquellas capacidades.
