Quels sont les avantages et les inconvénients des deux systèmes a priori rivaux, l’enchère et la procédure collective fondée sur une analyse détaillée des possibilités de redressement de l’entreprise effectuée par le tribunal ? Puis, quelles sont les difficultés posées par l’introduction d’une procédure d’enchères dans un système juridique hermétique à cet instrument? Par ce biais, c’est la question plus générale de la réforme des procédures collectives fortement encadrées par le tribunal qui est abordée.

Summary After a brief outline of the historical evolution of the Collective Agreement Act since its adoption in 1934 and of the Labour Relations Act of 1944, the author examines in succession the contents, the authority and the application of these two laws. Both of them present certain difficulties in their application and thus cause differences in viewpoints between employers and employees. How can these differences be overcome ? There is the problem. The reader will find in this article a possible solution from the point of view of the law, union requirements and certain economic aspects, and two possible corrective measures that may be applied immediately.

L’extension d’une procédure collective est une création jurisprudentielle consacrée par la loi de sauvegarde des entreprises du 26 juillet 2005. Elle a pour objectif de reconstituer artificiellement le patrimoine séparé du débiteur. Ainsi, elle va consister à étendre la procédure collective initiale à une ou plusieurs personnes physiques ou morales. L’extension de procédure collective revêt un avantage considérable pour le débiteur dans la mesure où elle va lui offrir plus de possibilités et de moyens lui permettant de résoudre au mieux ses difficultés. De même pour le créancier qui verra le patrimoine du débiteur réuni à celui d’une tierce personne. Son fondement juridique est l’article L. 621-2 du code de commerce. Il dispose que le tribunal doit caractériser l’existence d’une confusion de patrimoine ou la fictivité avant de prononcer un jugement d’extension de procédure collective. La jurisprudence contribue grandement à l’évolution législative de l’extension de procédure collective. En dépit de la codification de cette procédure, la jurisprudence y occupe une place omniprésente. Ce rôle s’explique par le fait que le législateur laisse au juge le pouvoir d’interpréter et d’apprécier l’extension de procédure collective, sur la base de ses deux causes qui sont respectivement la confusion de patrimoine et la fictivité. Quel est donc le pouvoir d’appréciation laissé au juge ? Il s’agit de l’interprétation dont dispose ce dernier concernant l’existence de la fictivité ou de la confusion de patrimoine. Ainsi donc, pour prononcer une extension de procédure collective sur la base de la confusion de patrimoine, le juge doit nécessairement caractériser l’existence de relations financières anormales ou l’imbrication inextricable des patrimoines, à savoir celui du débiteur principal et celui ou ceux des personnes à qui il voudrait étendre la procédure collective.L’appréciation du caractère fictif de la personne morale est le cas le moins fréquent mais reste le plus complexe à déterminer. Les juges ont la lourde responsabilité de déceler la fictivité d’une personne morale et se heurtent la plupart du temps aux divers montages financiers établis dans les groupes de sociétés.Le juge n’a pas à chercher si la confusion de patrimoine entre deux personnes physiques ou morales a causé un préjudice au débiteur principal pour étendre sa procédure collective. Cet encadrement législatif laisse apparaître que les juges sont libres de prononcer l’extension de procédure collective en prenant en compte le fait qu’un contrôle rigoureux de leur décision est réalisé par la Cour de cassation. En outre, au regard des intérêts divergents du débiteur et du créancier, mais aussi en raison de l’impact des décisions d’extension de procédure collective sur la vie économique de ces deux catégorie de personnes, les décisions prononçant l’extension de procédure collective font l’objet d’un contrôle rigoureux de la part de la Cour de Cassation.Toutefois si cette procédure recèle bien des avantages, il n’en demeure pas moins, qu’au regard de sa pratique, certaines réformes pourraient permettre de l’améliorer
The extension of a collective procedure is a jurisprudential creation enshrined in the law on the protection of companies of 26 July 2005. Its objective is to artificially reconstitute the debtor's prepared assets. Thus, it will consist in extending the initial collective procedure to one or more natural or legal persons. The extension of collective proceedings is of considerable benefit to the debtor insofar as it will offer him more possibilities and means to solve his difficulties as well as possible. The same applies to the creditor who will see the debtor's assets combined with those of a third party.Its legal basis is Article L. 621-2 of the French Commercial Code. It provides that the court must characterize the existence of a Confusion of patrimony or fictitious nature before pronouncing a judgment extending collective proceedings. Case law contributes significantly to the legislative evolution of the extension of collective proceedings. Despite the codification of this procedure, case law is omnipresent. This role is explained by the fact that the legislator gives the judge the power to interpret and assess the extension of collective proceedings, on the basis of its two causes, namely confusion of assets and fictitious acts. What is the discretion left to the judge? This is the latter's interpretation of the existence of fictitious or confusing assets. Thus, therefore, in order to pronounce an extension of collective proceedings on the basis of the Confusion of Assets, the judge must necessarily characterise the existence of abnormal financial relations or the inextricable interweaving of assets, namely that of the principal debtor and that of the person or persons to whom he would like to extend the collective proceedings.The assessment of the fictitious nature of the legal person is the least frequent case but remains the most complex to determine. Judges have a heavy responsibility to detect the fictitious nature of a legal person and most often encounter the various financial arrangements established within corporate groups.The need not to look for whether the confusion of assets between two natural or legal persons has caused prejudice to the principal debtor in order to extend his collective proceedings. This legislative framework shows that judges are free to extend collective proceedings, taking into account the fact that their decision is rigorously reviewed by the Court of Cassation. In addition, in view of the divergent interests of the debtor and the creditor, but also because of the impact of decisions to extend collective proceedings on the economic life of these two categories of persons, decisions ordering the extension of collective proceedings are subject to rigorous control by the Court of Cassation.However, while there are many advantages to this procedure, the fact remains that, in terms of its practice, some reforms could improve it

Les récentes réformes ont profondément modifié la nature de ce mécanisme : longtemps perçu comme une véritable sanction, ce dernier tend de plus en plus à être utilisé comme un simple outil de restructuration, voire de protection. Ses effets autrefois redoutés sont aujourd’hui recherchés. La thèse révèle la complémentarité de ces derniers dans le traitement des situations de confusion des patrimoines et propose plusieurs solutions permettant d’assurer leur prévisibilité. Elle suggère également plusieurs pistes de réflexion permettant de mettre en adéquation les cas de recours au mécanisme à la nature particulièrement originale des effets produits par ce dernier
Extending a collective insolvency procedure in the case of estate compels a number of debtors to comply with a unique collective procedure. Recent reforms have deeply modified the nature of this mechanism: for a long time perceived as a sanction, it is now used as a simple tool for restructuring, and to an extent a tool for protection. Its consequences were once dreaded, whereas now they are coveted. This thesis enhances the complementarity that exists between the latter when dealing with situations of estate confusion and offers several solutions enabling foreseeability. Furthermore, it opens up to several lines of thoughts that can correlate cases when resorting to this mechanism to the particularly original effects generated by the latter

L'effet réel de la procédure collective peut être défini comme l' effet de saisie des biens du débiteur par la collectivité de ses créanciers représentée par le mandataire de justice. Il s' agit d' abord de mesurer l' étendue de l' effet réel de la procédure collective en le comparant à celui d' une voie d' exécution du droit commun. La première partie montre que le droit des procédures collectives appréhende le gage tel qu' il est défini par le droit civil et de la même manière que le ferait une procédure civile d' exécution; la seconde partie montre au contraire que le droit des procédures collectives étend le gage commun des créanciers à des biens appartenant à d' autres personnes que le débiteur, voire à la totalité du patrimoine de celles-ci. Second enjeu de la recherche : voir comment la notion de gage commun dans les prócédures collectives transcende les différences de gage pouvant exister entre les différents créanciers. Cette étude montre que les disparités de gage ne sont pas traitées de la même manière lorsque l' effet réel de la procédure collective porte sur les biens du débiteur et lorsqu' il tend à reconstituer ou étendre l' actif de cette procédure
The effect of bankruptcy proceedings on the debtor's property may be defined as the seizure of the property by the creditors as a collectivity represented by the receiver. First, it seeks to determine the scope of the effect of bankruptcy proceedings on the debtor' s property through a comparaison with seizure under ordinary law. Second, this study intends to discover how the concept of collective seizure under bankruptcy law overcomes the diversity of the seizures effected by the creditors. This study shows that these disparities between seizures are not treated in the same way according to whether bankruptcy proceedings are directed against the debtor' s property or against a third party' s property

Cette thèse a pour objet l'examen des diverses situations dans lesquelles la procédure collective ouverte vis-à-vis d'une entreprise peut atteindre une société qui coopérait avec elle. La coopération interentreprises est diversifiée et s'adapte au contexte juridique et économique: elle se manifeste soit par l'existence d'un groupe de sociétés soit par une relation contractuelle. Le droit utilise divers instruments afin de permettre la diffusion de la procédure collective vers une entreprise coopérante. La matière est complexe et la distinction entre les divers instruments utilisés ne semble pas très nette. Au-delà de ces difficultés techniques, la raison réelle de cette situation est que l'ensemble des mécanismes utilisés poursuit un objectif unique. Leur fondement juridique doit donc aussi être commun. Celui-ci apparaît intuitivement au travers de l'étude approfondie de ces phénomènes (1ère partie). Il était donc intéressant de rechercher ce but et ce fondement communs. En considération de l'importance de la matière, ils devaient résider dans un concept juridique de premier plan. Après l'échec des notions fondamentales de personnalité morale et de contrôle, il apparaît que ce fondement réside dans l'éthique des affaires, c'est-à-dire dans la référence aux valeurs fondamentales de notre droit (2ème partie)
The subject of this thesis treats the various situations in which the collective proceedings against a company can touch another firm working with it. The inter-company cooperation is diversified; adapting itself to the economic and legal context. It occurs either under the excistence of a group of companies or a contractual relationship. The law uses different instruments permetting the diffusion of collective proceeding against a cooperative firm. The matter is complex and the distinction between these differents way does not seems very clear. Beyond the technical difficulties the very reason of this situation is that the employed mecanism as a whole tends towards a single aim. So the legal foundation has to be common. Intuitively, we discover this through a close study of theses phenomenons (Part 1). Thus, it is interesting to seek the common aim and fundation. We consider legal concepts to be more important. After the failure of fundamental notions of legal entity and control, it seems that this foundation lies in the fact of business ethics - that is a reference to fundamental values of our Law (Part 2)

L'offre de reprise, une fois emise par son auteur, va mener une veritable existence au cours de laquelle elle va connaitre plusieurs novations juridiques. D'abord, a son emission, si ce n'est qu'elle s'adresse singulierement a un tribunal, elle se rapproche de l'offre de droit commun en ce que son auteur determine librement les engagements qu'il prend dans son offre et conserve meme la liberte dela retirer. Cependant, s'il persiste dans sa volonte de la maintenir, elle se transforme alors en veritable engagement unilateral, autonome par rapport a la volonte de son auteur, qui, des le depot du rapport par l'administrateur judiciaire, ne peut plus, pendant un certain delai defini par la loi, ni la revoquer, ni meme la modifier a la baisse. Aussi, afin de maitriser cet engagement, le legislateur l'a encourage en amont, et reglemente en aval. C'est que la specificite de son objet justifie bien une telle influence legislative, d'autant plus que cet engagement unilateral ne pouvait etre pris par son auteur de maniere completement desinteressee. Ensuite, l'offre, a moins qu'elle ne soit pas retenue par le tribunal, auquel cas elle deviendra caduque, si elle est acceptee, le sera par un jugement revetu de l'autorite absolue de la chose jugee. Le consentement de l'offrant sera alors regrettablement mis a mal puisque, non seulement il en decoulera une purge des vices du consentement, mais en plus, le tribunal aura singulierement la possibilite de depasser le consentement de l'offrant en lui imposant quelques charges supplementaires. Surtout, la force juridique de l'offre s'en trouvera accrue tant a l'egard des tiers qu'a l'egard de son auteur, l'offre acquerrant des son acceptation judiciaire une dimension contraignante, puisque le tribunal, par son jugement, scelle un accord parfait

L'intitulé donné au présent sujet de thèse évoque une terre de conflits et d'intérêts contraires. Le droit de la faillite demeure un droit perturbateur. Pour autant, il ne peut pas empêcher que certains biens lui échappent. L'espace de liberté laissé au droit de gage par le droit de la faillite, dans ce cadre spécifique que constitue la procédure collective qui présuppose l'impossible satisfaction de tous les créanciers, révèle les limites du gage commun. Dans une certaine mesure, le droit de la faillite contribue à améliorer la connaissance des biens qui lui échappent et enrichit en cela la théorie générale du patrimoine. L'étude des biens qui échappent à la procédure collective révèle l'existence d'une scission patrimoniale qui réduit la portée de l'effet réel de la procédure collective. En effet, la division du risque de défaillance du patrimoine s'opère par sa compartimentation interne. Considérer que le gage commun se différencie du gage général conduit à raisonner en distinguant deux masses de biens du débiteur failli qui coexistent au sein de son patrimoine, celle appréhendée par la procédure collective et celle qui lui échappe. L'identification des biens qui échappent à la procédure collective est conduite dans une seule direction : ils en sont écartés d'emblée. Les biens qui échappent à la procédure collective sont abordés dans leur ensemble afin d'identifier leur nature et leur régime en droit de la faillite. Les biens qui gravitent autour de la procédure collective ont un régime peu ou mal défini. L'ambition est celle d'esquisser certains traits du régime juridique des biens qui échappent à l'emprise de !a procédure collective
This Ph. D. thesis is about conflicting interests. Collective discipline has to be implement when a debtor files for Bankruptcy. Consequently bankruptcy law is a disruptive law. ln theory, French law achieves some discipline by freezing all the assets of the debtor and shielding them from any foreclosure (« l'effet réel de la procédure collective»). It is the equivalent of an estate during bankruptcy in common law. This Ph. D. thesis is about what goes in and what stays out of the estate. In French law, most of the assets are insert into the estate but some of them can escape it for multiple reasons and with different means. Thus the common pledge of creditors is limited in many ways. First this Ph. D. thesis contributes to identify the allocation of assets during bankruptcy. It thereby enriches the civil law theory of estate by showing some of its limit. This Ph. D. thesis demonstrate how French bankruptcy law reduces the range of assets included in the estate of the debtor. The estate appears partitioned when the theory predicate on the contrary its unity. Indeed two sets of assets can be identify within the debtor estate those that are pledge to the creditor and those that are shielded from them. The Ph. D. points out some of the legislation failures on this matter. It also suggests to distinguish between two types of assets : those that escape and those that are removed from the estate. ln doing so it suggests the set of rules applicable to each one of them and offers some solution to improve the law

La réserve de propriété, consacrée par le législateur comme une sûreté réelle depuis l’ordonnance du 23 mars 2006, utilise le droit de propriété à des fins de garantie. Elle suspend le transfert de propriété du ou des bien(s), objet(s) du contrat translatif de propriété, jusqu’à complet paiement, par le débiteur, du prix. Par cette technique juridique, la réserve de propriété offre une protection particulièrement efficace au créancier devant faire face à l’ouverture, à l’encontre de son cocontractant, d’une procédure collective. Elle lui permet de se présenter, au près des organes de la procédure, non seulement comme un créancier titulaire d’une sûreté mais aussi comme un propriétaire. Sa situation, grâce à cette double casquette, est bien plus enviable que celle offerte aux autres créanciers, puisqu’elle lui donne, notamment, la possibilité d’exercer une action en revendication. Cependant, cette position -trop ?- privilégiée peut aller à l’encontre du redressement de l’entreprise en difficulté et du principe de l’égalité des créanciers. Cette thèse a, ainsi, pour objectif, d’examiner, au regard des évolutions législatives et jurisprudentielles, la nature et l’efficacité de cette sûreté opposé à la procédure collective de l’acheteur
The Retention of Title mechanism, recognized by the law as a security over assets since the Order of 23 March 2006, uses the property right for guarantee purposes. Actually, the retention of title suspends the transfer of property or good(s) until full payment of the price by the debtor. This legal technique affords an effective protection to the creditor who is faced with the initiation of collective insolvency proceedings against his contractual partner. This technique allows the creditor to be considered by the legal entities involved in the proceedings not only as the holder of a security right but also as the owner of the good. Thanks to this double-hatting approach, the position of the creditor is enviable compared with others creditors because providing, in particular, the opportunity to proceed to an action in restitution. However, this privileged position can otherwise conflict with the recovering of the company in difficulty and the principle of equality of creditors. The aim of this thesis is in the light of the legal and jurisprudential evolutions, to discuss the nature of this security interest and to challenge its effectiveness as regard from the one of the collective insolvency proceedings of the buyer

In this article, a review is conducted to the implementation of Peruvian law of collective agreements and their impact at company level. To achieve this purpose, in principle we mentioned what the Peruvian labor laws and their current application, and then compared with other Latin American visions, and finally outline a more peaceful solution considering the guidelines of the International Labour Organization labor standards and our constitutional current.
En el presente artículo, se realizará una crítica a la aplicación de la legislación peruana de los convenios colectivos y sus efectos a nivel de empresa. Para alcanzar tal finalidad, en principio analizaremos lo que menciona la normativa laboral peruano y su aplicación actual, para luego compararla con otras visiones latinoamericanas, y finalmente, esbozar una solución más pacifica considerando los lineamientos de la Organización Internacional de Trabajo y nuestra normativa constitucional laboral vigente.

Comment payer les créanciers d'une entreprise placée sous procédure collective lorsque cela n'est pas possible ? Telle est la délicate question que les répartitions de fonds se proposent de résoudre. Le plus souvent, en effet, le montant de l'actif à distribuer est inférieur à celui du passif à apurer. Or, le système juridique ne saurait créer un actif pour corriger cette balance négative. Face à une telle pénurie, le Droit ne peut donc guère qu'arbitrer entre les multiples intérêts en présence. Mais la façon dont il opère cet arbitrage est éminemment problématique. Le régime des répartitions est d'une telle complexité qu'il en devient indéchiffrable, à telle enseigne qu'il est pour ainsi dire impossible de les réaliser correctement. Déterminer le périmètre de l'actif distribuable, identifier les personnes autorisées à participer aux répartitions et les attributs à prendre en considération, définir l'ordre des paiements, c'est-à-dire établir le classement des créanciers et fixer l'ordre des distributions, et rectifier les éventuelles erreurs de répartition, constituent autant d'étapes aussi nécessaires qu'impraticables. Afin d'y voir plus clair, doctrine et praticiens ont exhorté les pouvoirs publics à dégager un ensemble de principes directeurs, et, faute de réponse à cette sollicitation, ont eux-mêmes entrepris leur formalisation. How can the creditors of a company that is the subject of collective insolvency proceedings be paid when it is not possible to do so ? This is the sensitive issue that fund apportionments seek to resolve. Often, the amount of assets to be distributed falls short of liabilities to be discharged. Nevertheless, the legal system cannot create an asset to correct this negative balance. In view of the lack of funds, the law can only arbitrate between the many interests involved. However, the way in which such arbitration works is extremely problematic. The apportionment procedure is so complex as to be incomprehensible, to the extent that it is more or less impossible to carry it out in a satisfactory manner. Determining the perimeter of distributable assets ; identifying the persons authorized to participate in apportionments and the attributes to be taken into consideration ; defining the order of payments, i.e., prioritizing creditors and establishing an order for distributions ; and correcting any apportionment errors are all steps that are at once necessary and unworkable. In order to make sense of all this, legal theorists and practitioners have urged the authorities to issue guidelines and, in the absence of any response to their request, have them-selves set about drafting some. Starting from the observation that collective insolvency proceedings can be seen as a collective seizure, and, therefore, as collective distribution governed by essential rules that are specific to it and distinct from those governing the ordinary law of compulsory enforcement and distribution proceedings, this study draws from such work in order to present fund apportionments in collective insolvency proceedings in the form of a dynamic system of guidelines seeking to clarify their legal regime and render it practicable

AbstractLanguage, traditional ecological knowledge, and the defense of territory come together in this chapter focused on the Yoreme communities of the Mayo river basin of northwestern Mexico. Language plays a fundamental role in our interpretation of the rich archival sources that allow us to comprehend the deeply rooted knowledge base that Indigenous peoples developed from their material and spiritual worlds. It is also an essential part of the living histories we construct in collaboration with the Indigenous peoples that maintain their traditions in a radically transformed ecological region through their ritual cycles and collective memories. The analysis of changes in land tenure and use presented here privileges Indigenous knowledge of landforms, biological species, and the cultural values that the communities of this region ascribed to the physical features and the territorial extension of the spaces they inhabited and defended. Its objectives seek to highlight the parallel production of oral and written sources and to contribute an historical analysis that is useful for the Yoreme communities in their present-day defense of their territory and its resources.

Abstract Many failed attempts have tried to tie the obligation to obey the law from consent. This chapter explores three more, all of which also fail. One is to derive implicit consent from the ‘nature of the business’ of either politicians standing for office or voters casting ballots. A second asserts a logical entailment between engaging in a collective decision procedure and the outcome of that procedure constituting a binding collective decision (‘a collective decision’ may be analytic, whether morally binding is a wholly separate question). Neither does consent to lower-order rules necessarily logically imply consent to higher-order rules. At most consenting to something becoming law by voting in an election or a legislature may pragmatically imply consent to the institutional infrastructure required to make that law-on-the-ground.

Socio-technical systems are social systems that incorporate technological infrastructures. At the group level of analysis, the most important question in understanding socio-technical systems is how their technological infrastructures modulate collective capacities for performance and experience. This research addresses collective capacities with respect to various sorts of communities—interest communities, professional communities, and residential communities. One question the authors have pursued is how technological infrastructures can enhance beliefs about collective capacities, as operationalized in Bandura’s social-cognitive construct “collective efficacy”. In this chapter, the authors first review Bandura’s conception of collective efficacy as a social extension of his cognitive construct “perceived self-efficacy”. They then discuss the development of our own community collective efficacy scale, and its use in understanding a range of community-oriented attitudes, beliefs and behaviors in the context of the Blacksburg Electronic Village community network. The next three sections describe applications and extensions of community collective efficacy to three on-going community informatics projects. In each of these cases, the authors explain how the community collective efficacy construct is being applied and extended.

This chapter considers efforts to legislate Native American religious freedom in the American Indian Religious Freedom Act (AIRFA, 1978). Where courts and even common sense have seen AIRFA as a religious freedom statute—as an extension of the legal protections of the First Amendment into the distinctive terrain of Native American traditions—the chapter suggests a different view. If the legal force of “religious freedom” discourse has been only dimly effective for Native sacred claims in courts, this chapter is the one that most pointedly shows how Native peoples drew on the rhetorical power of the sacred and religious freedom to win significant legislative protections specific to Native peoples. It does so through interviews with Suzan Shown Harjo. These interviews show how the remarkable legislative accomplishment of AIRFA and, later, the Native American Graves Protection and Repatriation Act (1990), carry the rhetorical force of religious freedom into the legal shape of federal Indian law, with its recognition of treaty-based collective rights and the United States' nation-to-nation relationship with Native peoples.

Examples of coupled resonator and oscillator arrays in engineering, scientific and mathematical contexts are diverse and abundant. However, when the technical scope is limited to mechanical systems, research typically focuses on arrays of resonators in which the coupling between the sub-units is conservative and nearest-neighbor in nature. In these arrays, if the sub-units are nominally identical, and the coupling is weak, collective behaviors such as localization, the spatial confinement of energy in distinct or limited regions, can be observed. In contrast, if the coupling is global and dissipative, very different collective dynamics are observed, namely, group resonance, confined attenuation, and group attenuation, the latter two of which are associated with the local absence of energy. This paper investigates these dynamic phenomena within the context of a generic, globally-, dissipatively-coupled system, which is motivated by recent work related to electromagnetically-coupled microresonator arrays. The results of this work have direct applicability in new single-input, single-output resonant mass sensors, and, with extension, a variety of other sensing and signal processing applications.

The ability to predict variations in cleavage fracture toughness behaviour of ferritic RPV steels, accounting for the effects of irradiation and defect geometry, is vital to safety assessment and life extension decisions. Local approaches to cleavage fracture offer a promising methodology to accomplish such calculations. However, the limited progress achieved by improving the local failure probability expression suggests that the methodology for calculating global cleavage might not be adequately representing real material. The basis for the existing methodology is the weakest-link assumption that all individual failure events are independent and non-interacting. Here an approach is considered which utilises a microstructure-informed model incorporating the experimental knowledge needed to postulate deterministic criteria for particle rupture and micro-crack propagation, whilst accounting for the probabilistic distribution of particle sizes. This is then used in a lattice model that can help detail the evolution of the formation of micro-cracks on global failure, therefore inferring the suitability of the weakest-link assumption. Predicting the probability of cleavage fracture requires such models, as the macroscopic cleavage phenomenon is governed by a number of micro-structural features. The material microstructure is represented by a regular lattice of truncated octahedral cells forming a computational site-bond model, with sites located at the cell centres and connected by two distinct sets of bonds. These bonds are modelled with structural beam elements, which represent all the possible relative deformations between coordinated sites. Particles of various sizes are distributed in the bonds, based on an experimentally determined distribution of cleavage initiating particles in RPV steel (Euro Material A). Although only elastic deformations are considered here, the results demonstrate that the interactions between individual failure events could potentially have a strong effect on the way global failure is reached. Nucleation of micro-cracks by rupturing second-phase particles affects their subsequent formation. In particular, it was found that once formed there is a reduced probability of further development of micro-cracks at particles outside the crack planes and an enhanced probability of formation at particles along the crack planes. This will therefore influence the distribution of micro-crack sizes that could in principle be used to calculate the global probability of failure, and could lead to substantially different distributions of particle sizes, then used in the current local approach methods.

Argumentation frameworks are a core formalism in the field of formal argumentation, with several semantics being proposed in the literature. Among them, preferred semantics is one of the most popular but comes with relatively high complexity. In fact, deciding whether an argument is skeptically accepted, i.e. contained in each preferred extension, is Pi^P_2-complete. In this work we study the complexity of this problem w.r.t. the length of the cycles in the considered AF. Our results show which bounds are necessary to decrease the complexity to coNP and P, respectively. We also consider argumentation frameworks with collective attacks and achieve Pi^P_2-hardness already for cycles of length 4.

Proportional ranking rules aggregate approval-style preferences of agents into a collective ranking such that groups of agents with similar preferences are adequately represented. Motivated by the application of live Q&A platforms, where submitted questions need to be ranked based on the interests of the audience, we study a dynamic extension of the proportional rankings setting. In our setting, the goal is to maintain the proportionality of a ranking when alternatives (i.e., questions)---not necessarily from the top of the ranking---get selected sequentially. We propose generalizations of well-known aggregation rules to this setting and study their monotonicity and proportionality properties. We also evaluate the performance of these rules experimentally, using realistic probabilistic assumptions on the selection procedure.

Communal forests occupy one million hectares in the Northern of Portugal and Galicia. Since centuries ago, “Baldios” and “Montes Veciñais en Man Común” (MVMC) played an essential function in the economy of their owner communities. This role was lost all through the last century due to the enormous afforestation and the decrease of agriculture. The restitution of democratic regimes returned the communal forests tenure to the communities. Given the extension and high average area, our paper aims to research its potentialities and limitations of contribution to rural development. Two case studies, one in North Portugal and another one in Galicia, allow identifying the individual and collective traditional uses and the achievements made with revenues linked. Both Galician and Portuguese realities exhibit similarities and complementary benefits, and needing social and economic innovation to make a better use of rural resilience. Communal lands and small-scale business projects could maintain the network of local produce markets with attractive aesthetic values as well as biodiversity conservation. The comparison of the different criteria shows economic aspects are the most valorised by the stakeholders. The management decision of collective forests was the alternative mixed by the communities and the Forestry Services as the best one to complete the main objective of sustainable rural development. As a final conclusion of our work, remarking that the communities owning these forests currently seem to have the conditions to successfully manage their properties if the commoners are able to mobilize and adequate organize the communities.

In socio-ecosystems, human activities are structured in time and space by interactions between different regulatory systems with different collective goals. These regulatory systems are modeled by institutions and organizations, and the regulatory mechanisms by norms applied to agents in Multi-Agent Systems (MAS). However, little is said about sharing resources, space and time. In particular, temporal and spatial expressivity is often limited in MAS for institutions and norms. This research proposes an institutional MAS model capable of representing multiple institutions and norms in the socio-ecosystem, in order to account for the multiplicity of interactions through agents, resources, space and time. We propose an extension of Descriptive Logic for the description of institutions and norms, and use Allen's algebra and the RCC8 to represent time and space. The resulting model allows us to know the norms applicable to an agent located socially, spatially and temporally.

Abstract (sommario):
Seismic analysis is of great importance in the evaluation of nuclear systems due to the heavy influence such loading has on their designs. Current Department of Energy seismic analysis techniques for a nuclear safety-related piping system typically involve application of a single conservative seismic input applied to the entire system [1]. A significant portion of this conservatism comes from the need to address the overlapping uncertainties in the seismic input and in the building response that transmits that input motion to the piping system. The approach presented in this paper addresses these two sources of uncertainty through the application of a suite of 32 earthquake realizations with equal probability of occurrence whose collective performance addresses the total uncertainty while each individual motion represents a single variation of it. It represents an extension of the soil-structure interaction analysis methodology of SEI/ASCE 43-05 [2] from the structure to individual piping components. Because this approach is computationally intensive, automation and other measures have been developed to make such an analysis efficient. These measures are detailed in this paper.

Abstract (sommario):
Many collective decision-making settings feature a strategic tension between agents acting out of individual self-interest and promoting a common good. These include wearing face masks during a pandemic, voting, and vaccination. Networked public goods games capture this tension, with networks encoding strategic interdependence among agents. Conventional models of public goods games posit solely individual self-interest as a motivation, even though altruistic motivations have long been known to play a significant role in agents' decisions. We introduce a novel extension of public goods games to account for altruistic motivations by adding a term in the utility function that incorporates the perceived benefits an agent obtains from the welfare of others, mediated by an altruism graph. Most importantly, we view altruism not as immutable, but rather as a lever for promoting the common good. Our central algorithmic question then revolves around the computational complexity of modifying the altruism network to achieve desired public goods game investment profiles. We first show that the problem can be solved using linear programming when a principal can fractionally modify the altruism network. While the problem becomes in general intractable if the principal's actions are all-or-nothing, we exhibit several tractable special cases.
