This article is a tribute to Professor David McLauchlan on the occasion of his 40th teaching anniversary. The first part is a personal recollection from each of the two authors. The second part is a joint case note. It poses the question: how could a real estate firm who knew the vendor did not intend to appoint the firm as agent nevertheless have a legal right to withhold commission? In the decision of Nightingale v Barfoot Ltd, Venning J confirmed that the firm had such a right. This article challenges the accuracy of that conclusion, suggesting that as there was no evidence to support the formation of an agency agreement, the real estate firm did not have the right to deduct commission. It analyses critically a number of the legal arguments raised in the case and those that should have been raised, including those concerning contract formation, the objective principle, promissory estoppel, and the effect of s 62 of the Real Estate Agents Act 1976 and the Contracts Privity Act 1982. Much responsibility for the outcome of the case must be pinned on counsel for the vendor, who failed to stop and ask himself "But Where’s The Contract"?

This was David Drew's last published article. Completed in December 2008, it appeared in May 2009 as a contribution to “… dass alles auch hätte anders kommen können”. Beiträge zur Musik des 20. Jahrhunderts edited by Susanne Schaal-Gotthardt, Luitgard Schader and Heinz-Jürgen Winkler, published as Band XII of Frankfurter Studien, a publication of the Hindemith-Institut (Frankfurt am Main: Schott ED 20571, 2009).David Drew had discussed with the present editor a projected followup article for Tempo, to deal specifically with Walter Leigh's music for A Midsummer Night's Dream and the ideological and critical misunderstandings which he felt were beginning to envelop it as a result of its citation in Fred K. Prieberg's Musik im NS-Staat. This was presumably one of the ‘several research-projects’ ongoing to which he alludes in footnote 37. Sadly, little if any of that projected article was written down. But since the publication of ‘North Sea Crossings’ in an otherwise German-language source must inevitably have found it few English readers so far, it seemed a fitting tribute to its author to reprint it here, with profound thanks for co-operation to Schott Music GmbH & Co. KG, Mainz, to Sally Groves in particular, and the estate of David Drew.

This text discusses and explains the relation between the urban crisis today and the antivalue in respect to the conceptual framework by David Harvey, a well-known British geographer. He approaches this theme in many of his books, including ‘Marx, capital and the madness of economic reason’, published in Brazil, in 2018. This text uses this book as a starting point for the discussion of how the contemporary world, which is increasingly urban, is dominated by the Empire of antivalue, especially in the form of a growing debt. The antivalue, in the form of capital holder of interest, plays a crucial role in the accumulation of capital, articulating production, circulation and realization of commodities, promoting and facilitating the geographical movement of capital and the transfer of capital between economic circuits and cycles of production. However, debt is the favorite form of antivalue under capitalism today. In addition to being supported and granted by the State in a variety of ways, including through public debt, debt imprisons all economic agents in perpetual servitude. Debt follows the tendency of continuous production of value and surplus value under capitalism, a movement that Harvey calls bad infinity. Antivalue in its form of debt is also called fetishism of capital, which defines the contradictory situation in which money alone seems to have the magic powers to create more money. The consequences of growing debt to the urban crisis go beyond the necessity of solving fiscal problems of the State. The need to produce value and surplus value, in addition to the service of the debt generates urban spaces marked by gentrification and segregation. In sum, the text discusses the urban crisis today in the context of the domination by the financial-real estate complex, basing the discussion on Marx’s theory of value and the concept of antivalue, as presented by David Harvey.

ABSTRACT This article revisits and affirms Derek Pearsall’s reading of Chaucer’s Merchant’s Tale, elaborating it with reference to the medieval theory of satire, ecclesiastical literature relating to the sacrament of marriage, analogues of the pear tree escapade from the novella tradition, and David Lawton’s research on “voice.” The idea of a single, all-encompassing narrative voice is challenged. Pearsall’s assertion that we do not need the Merchant to understand the tale, because its voice is “fully established from within,” gives rise to the question of whether there is any need to assign it to a singular voice. The contemptuous references to “secular estate” by a teller who is supposedly a merchant drives the speculation that Chaucer may originally have intended the story for a member of some religious order—a friar or monk perhaps. However, the risk of a cacophony of different voices is averted by the ultimate dominance of mercantile discourse. Whatever the poet’s original intention may have been (the Canterbury Tales being a work in progress), it has convincingly grown into a merchant’s tale, wherein supposedly noble characters speak and act in ways inappropriate to their high estate, and the values of commerce gain priority.

Ao longo dos tempos da história do homem, os arquivos valorizaram os poderes do Estado e a história científica era constituída sobre os documentos que a legitimavam como ciência. O património documental é, nos nossos dias, uma das preocupações mais acentuadas, quando se referem questões de salvaguarda patrimonial. Falar de património documental é falar de documentos oficiais e não oficiais, de registos e cartas, é todo o suporte em papel que permite guardar a memória de uma qualquer atividade. A documentação é tudo aquilo que é registado pela população humana e que pode servir de testemunho para a história do ser humano num determinado contexto sociocultural. É de extrema importância salvaguardar estes registos, pois através desta documentação é possível apurar factos, conhecer realidades e observar as alterações nas dinâmicas sociais existentes numa determinada fase da história. A Câmara Municipal de Évora (CME), através do Núcleo de Documentação (ND) é uma das entidades que zela pela conservação desse património, tentando reunir no seu interior a totalidade de documentação que se encontrava, até a sua criação em 1987, dispersa por diferentes serviços da autarquia. É sua premissa inicial prestar informação especializada sobre toda e qualquer questão associada ao Património Documental existente, disponibilizando também todos os seus recursos para a inventariação documental, para a conservação de documentação específica e sua posterior disponibilização ao público. Desde a criação deste núcleo foram vários os espólios doados, sendo todos eles tratados, segundo os pressupostos acima referidos. O espólio do Arq.º Raul David e do Eng.º Celestino David foi doado pelos seus herdeiros à CME, no dia 30 de novembro de 2016, no âmbito das comemorações do trigésimo aniversario da elevação de Évora a cidade património mundial, sendo entregue ao ND para a sua guarda, inventariação, conservação, criação de uma base de dados e disponibilização dessa mesma base para consulta ao público em geral. O espólio destes dois ilustres eborenses é composto por cerca de 1110 unidades, entre processos e plantas, neles se podendo encontrar a marca das alterações arquitetónicas que ocorreram durante mais de 50 anos na arquitetura do distrito de Évora, ou ainda a introdução de alguns modelos de construção inovadores, graças às novas tecnologias que despontam no séc. XX; ABSTRACT: Throughout the history of man, the archives valued the powers of the state and scientific history was constructed on the documents that legitimized it as science. Documentary heritage is one of the most serious concerns of our times, when it comes to safeguarding patrimonial issues. To speak of documentary heritage is to speak of official and unofficial documents, records and letters are all the paper support that allows storing the memory of any activity. Documentation is everything that is recorded by the human population and that can serve, as a testimony to the history of the human being in a particular sociocultural context. It is extremely important to safeguard these records, since through this documentation it is possible to ascertain facts, to know realities and to observe the changes in the social dynamics existing in a certain phase of history. The Municipality of Évora (CME), through the Documentation Nucleus (ND) is one of the entities, that ensures the preservation of this heritage, trying to gather in its archives all the documentation that was, until its creation in 1987, dispersed by different services of the municipality. It is them initial premise, to provide specialized information on any and all issues associated with the existing Documentary Heritage, also making available all of its resources for documentary inventory, for the preservation of specific documentation and its subsequent availability to the public. Since the creation of this nucleus (ND), several donated spoils have been treated, all of which are treated according to the aforementioned assumptions. The estate of Arq. Raul David and Eng. Celestino David was donated by his heirs to the CME, on November 30, 2016, as part of the commemorations of the thirtieth anniversary of the elevation of Évora to world heritage city. He was handed over to the ND for his custody, inventory, conservation, creation of a database to be used by the general public. The collection of these two illustrious Eborenses is composed of about 1110 units, between processes and plants, in which is possible to find the mark of the architectural changes, that occurred during more than 50 years in the architecture of the Évora´s district, or the introduction of some models of construction, thanks to the new technologies that emerged in the XX century.

Course-focused and comprehensive, the Textbook on Land Law provides an accessible overview of one key area on the law curriculum. This chapter discusses the nature of the freehold estate, and the impact of the 1925 Act on the freedom of a landowner to create limited or ‘successive’ freehold estates (such as life estates, estates for the life of another, and estates that are determinable or contingent on some event). It illustrates the law by reference to the case of David Derby, the owner of 4 Trant Way, who wants to give estates in the land to his niece, nephew, and friends on certain specific conditions. It concludes with a brief discussion of ‘commonhold’, a method for freehold owners of mutually interdependent properties (such a flats) to manage the shared spaces affecting all their properties.

The phrase ‘fee simple absolute in possession’ imposes a series of requirements, all of which must be satisfied if the estate is to qualify as a legal one. The chapter examines these requirements in more detail, and considers whether the proposed gifts would satisfy them. The chapter contains a short consideration of commonhold.

This chapter aims to show that land value tax has both theoretical and practical merit. The author traces the classical normative arguments for land tax in Adam Smith, Tom Paine, David Ricardo, Henry George, and Lloyd George, and the current academic literature, and then shows how some of difficulties of inheritance (estate) tax can be resolved by a land tax. It would also improve on the UK’s current ragbag of property taxes. In the final sections, issues of practicability, and of winners and losers, are addressed. The examples almost all come from the United Kingdom, but the arguments are intended to be general.

The market analysis report that is submitted to the decision maker (see chapter 4) should include a descriptive, qualitative overview of the context the real estate project has to the existing and changing urban environment. To better accomplish this task, one should have knowledge of the general theory regarding the market processes that bring about land use and urban form. This chapter presents three relevant general theories of land use and land value. Together, these general theories provide a general qualitative understanding of how the existing urban environment came to be and allows the analyst to prognosticate the trajectory of change of urban land uses and land values. The first two of the general theories presented here arose out of an attempt to explain agricultural land values and land uses. Why should a discussion of the agronomy sector be included in a book on urban real estate analysis? First, all the general theories relevant to land values and land use, and their spatial distribution within a city, are part of an intellectual heritage that dates from general theories of agricultural land values and land use. Second, much of new urban development occurs at those suburban margins. To understand development at the suburban margins, there must be an understanding of the nonurban land uses and land values at those locations. The third general theory explains spatial equilibrium and its role in shaping urban land values and land uses. Two eighteenth-century theorists, David Ricardo and Johann Heinrich von Thünen, are credited for having created a vast and sometimes opposing literature on land valuation. Ricardo’s economic theory was based upon the relative productivity of sites. In contrast, von Thünen’s geographic theory was focused on the locational component of land values and land use. The juxtaposition of these two competing giants of land theory in many respects still differentiates economists and geographers even today. After the theories of Ricardo and von Thünen are presented, an overview of the consumption theory of land rent (CTLR) is provided. The CTLR is my general theory and methodology for evaluating urban housing land use, land values, and urban form (Thrall 1980, 1987, and see 1991).

The letters in Part I show Beaumont cultivating a dynamic of critical exchange with Wordsworth. Beaumont’s love of the theatre serves as a pathway to a broader discussion of the arts: they discuss the paintings of David Wilkie and Henry Edridge as well as the poetry of Robert Southey and Walter Scott. Following the death of John Wordsworth, letters concerning ‘Character of the Happy Warrior’ and ‘Elegiac Stanzas’ (touching on issues including politics, fortitude, hope and grief) demonstrate the depth and complexity of the developing friendship between Beaumont and Wordsworth. Sir George introduces Wordsworth to the literary heritage of his Coleorton estate, begins to involve him in decisions about the landscaping of the grounds, and invites him to design a Winter Garden.
