Testo completoCe mémoire porte un regard critique sur les instruments juridiques relatifs à la lutte contre la désertification adoptés par le Mali depuis son indépendance jusqu’à nos jours. La désertification a commencé à prendre de l’ampleur dans les pays d’Afrique de l’Ouest, notamment au Mali, avec les grandes périodes de sècheresses de 1968 à 1973 et de 1982 à 1984. Nous verrons que dès l’indépendance acquise en 1960, le Mali a entrepris de protéger juridiquement son environnement avec la Convention d’Alger de 1968 et la loi forestière de la même année. Le présent mémoire est divisé en deux parties, la première étant consacrée à la période pré démocratique, allant de 1960 à 1991, et la seconde couvrant la période démocratique, allant de 1991 à nos jours. Pendant la période pré démocratique, le Mali a adopté peu de textes juridiques dans le domaine de la lutte contre la désertification. Cette faille fut corrigée au cours de la seconde période. En ce sens, l’analyse effectuée permet de relever les failles dans les textes juridiques maliens en matière de lutte contre la désertification depuis l’indépendance du pays à nos jours et de proposer des recommandations en vue de parfaire le droit de la lutte contre la désertification.
This thesis takes a critical look at the legal instruments relating to the fight against desertification adopted by Mali since its independence until today. Desertification has begun to increase in West African countries, particularly in Mali, with the major drought periods from 1968 to 1973 and 1982 to 1984. We will see that since independence in 1960, Mali has undertaken to legally protect its environment with the Algiers Convention of 1968 and the Forest Law of the same year. This thesis is divided into two parts, the first dealing with the pre-democratic period from 1960 to 1991, and the second covering the democratic period from 1991 to the present. In the pre-democratic period, Mali adopted few legal texts in the field of combating desertification. This flaw was corrected in the second period. In this sense, the analysis carried out makes it possible to identify gaps in Malian legal texts in the fight against desertification since the country's independence to date and to propose recommendations for improving the law to combat desertification.

These status adaptation project, necessary to the country economic and social development, is organized around two aims: promotion of progeny rights and particularly non recognized child and surviving spouse rights. To annul disparities conditions instaured by traditional law about of new legacy. To attain these objectives, political authorities had proposed conciliation of new death duties traditional part. In spite of traditional rules ineffectiness, this instrument can not solve the problematic of estate duties sources diversity; it remains fundamental in rural world which represents 85 per cent of country population. Thus, the solution, which most takes into account social environment feature, is defined as follow: in short term, Muslim law, near the traditional one, can be adapted by facilitating this unification. In long run, synthesis with modern rules will insure law homogenization

Testo completoFocusing to highlight the challenges associated to the coexistence within the Malian Law of the three sets of applicable inheritance rules (statutory law, religious law and customary law) and to contribute to resolving internal conflicts of law between codified law and competing normative systems. The goal is to reflect on possible solutions to make Malian legal pluralism work, which is characterized by a lack of visibility and clarity. In addition to the difficulties when it comes to identifying inheritance law under Malian domestic law, this thesis also emphasizes the challenges linked to the application of Malian law, particularly its religious and customary rules, first within the Malian context, considering the fundamental provisions of the Malian Constitution and international treaties ratified by the Republic of Mali. Therefore, after showing the existence of internal conflicts of law and the shortcomings of the current conflict-resolution systems, this thesis proposes offers strengthening the role of individual will in matters of religious and customary. This thesis suggest introducing a public order clause into domestic law to allow Malian judges to exclude traditional rules that are manifestly contrary to certain principles of modern law. This challenge faced by Malian law in the domestic context may also rise internationally when an international inheritance involving a Malian national is opened in France or handled by a French notary or judge. Many Malians travel and a many of them choose France as their country of residence. The settlement of their succession, which will have an international character, requires the application of French conflict of law rules to determine whether French law or Malian law should apply, depending on the relevant connections with the entry into force of Regulation (EU) No. 650/2012 of 4 July 2012, on jurisdiction, applicable law, recognition and enforcement of decisions, the acceptance and enforcement of authentic instruments in matters of succession, and the creation of European Certificate of Succession. The application of Malian law in France may become more frequent, particularly due to the choice of law option or if the deceased’s last residence was in Mali, even if the succession is opened in France, due to the presence of heirs ( children or surviving spouse ), or because of the principle of unity of the estate which governs the regulation process. The conflit of law rules, whether from national or European sources, designate Malian law as applicable in an international inheritance case, two major challenges arise : identifying the Malian domestic law that will ultimately apply and applying certain religious or customary rules in France. This situation leads us to consider the potential conflict between Malian law and the requirements of French international public order, especially regarding fundamental rights and therefore the risk of Malian law being set aside in France

Testo completoThe Republic of Mali is a former French colony. Consequently, there are similarities between French and Malian law as regards the level of the definition of liability, whether criminal or civil, applicable in medical matters and the corresponding penalties. But in practice, the application of these notions is not done in the same way in both countries. This difference in application is due to social, cultural and economic reasons. To illustrate the points of convergence and divergence between these two legal systems, we have analyzed medical liability in both countries on the basis of criminal, civil and ethical provisions. At the end of this study, we made suggestions to improve the Malian law in the image of French law which has undergone enormous changes. We have also proposed the adoption of a code that will better address all aspects of medical liability, taking into account traditional medicine

The heteronomy of malian administrative law implies that the approach in our country should also integrate the decision process. But the processes that are outside the juridical problems stricto sensu lead one to investigate on the actors, their strategies and their powers in the soccio-cultural and institutional environment of the decision, because decisionmaking demands not only the implementation of the acts, but above all, the efficiency of administrative action. The administrative act, in mali, the almost exclusive way of administrative action, the multiple political, economic, social and cultural pressures demand a contextual methological approach of the process; an approach which is innoving on the heuristic level. Testo completoThe Laws in Mali and Senegal concerning child adoption have considerable weakness to which this thesis tries to deal with. In fact, Malian and Senegalese Law-makers, in their effort of codifying the adoption law, have unfortunately adopted French legislation on adoption, ignoring the socio-legal standards of their own countries. In these countries, there are two forms of legal adoption based on the French model. In Mali, there are direct descendant adoption and adoption for protection; whereas in Senegal there are plenary and short-term adoption. Such legislative typology concerning adoption suffers a lack of balance and coherence in its structure and purpose as well. Consequently, it does not provide strong protection of the rights of both Malian and Senegalese Children. With legal adoption, coexist in both countries, circumstantial adoption to which resists the Law. So, traditional and recurrent practice of Children in custody in families in these countries remains a bizarre area sheltered by Law. These circumstantial adoptions correspond to a kind of social and affective parenthood which is supposed to make law. By legalizing circumstantial adoption, Malian and Senegalese law-makers would create a possibility of the creation of an adoption model without direct descendances according to Malian and Senegalese contexts which are more favorable to intra-family adoption. Some fundamental rights of the Child would be better guaranteed. However, the laws concerning international adoption in both countries is in its embryonic stages and need to be better established. In this perspective, it is worth maintaining and reinforcing the key principles according to the Hay Convention of 1993 concerning international adoption, and insert some controversial rules and laws into domestic legislations of the two countries concerning international adoption where the deep interest of a child in family-forfeiture is most respected. These new rules will permit to determine the legislative capability and efficiency in Mali and Senegal concerning decisions made abroad by countries which are not concerned by the Hay Convention of 1993
