After the fall of Tenochtitlan in 1521, the first groups of friars arrived in Mexico to Christianize the native inhabitants of Mesoamerica. This task was anything but easy, as explaining Christian doctrine to the Indigenous people posed both a linguistic and a theological challenge. The need to learn Indigenous languages and to prepare doctrinal materials dedicated specifically to the Christianization of this land was a task that might have seemed almost impossible to conduct in a short period of time, yet by the 1540s, the first printed catechisms (doctrinas) in Nahuatl began to appear. One of the earliest and broadest of these works is the 1548 Dominican Doctrina Christiana en Lengua Española y Mexicana, in which the friars attempted to explain all of the principles of Catholic theology to the Indigenous people. This paper analyses how through highly detailed descriptions and a meticulous choice of vocabulary, the authors strove to impart the tenets of Christian doctrine to the Nahuas in such a way as to make it both fully understandable and as unlikely as possible to be misinterpreted. It points to the sources on which the friars relied while writing the text. The article formulates a theory that the creation of the Doctrina Christiana would not have been possible without the participation of the native speakers of Nahuatl in the project, even though their role in writing the catechism would have had to be hidden from the religious authorities. The Indigenous authors served as cross-cultural bridges in the process of preparing the doctrinal materials. On the one hand, they could therefore help to explain crucial parts of the doctrine to the Indigenous audience. On the other hand, allowing Indigenous concepts to permeate the Christian discourse often led to the creation of ambiguity and provided a space of contestation that could influence the understanding of the Catholic concepts by the Indigenous audience.

Mexicans during the early national era actively grappled with identifying, clarifying, and defining core republican political values, principles, and doctrines. Throughout the first federal republic (1824-1835), the central republic (1835-1846), the second federal republic (1846-1853), and into the years of the Revolution of Ayutla (1853-1855) and the Wars for Reform (1858-1861), defining and protecting individual rights, delimiting the rights and prerogatives of corporations and their members, and limiting the power of the state became the fundamental challenges Mexicans confronted as they endeavored to create a republican political society and their own republican political culture. As in many, if perhaps not all, countries in transition from a corporate model to a republican model, the issues polarized public opinion; and militant elements procured arms and pursued civil war, not just once but several times. Simultaneously, el pueblo mexicano actively clamored for justice. Because of that clamoring, jurists, litigants, legislators, and executives all came to recognize that colonial jurisprudence was no substitute for new and innovative republican jurisprudence. The men on the Mexican Supreme Court of Justice persistently counselled politicians that extant jurisprudence contained their competence and impeded them from administering justice when individuals, corporations, and local and national government officials sought protection from perceived wrongs. Significantly, in seeking protection from perceived wrongs, in seeking justice, el pueblo mexicano initiated defining those values, principles, and doctrines that ultimately could unify the society and mystify and mythicize the meaning of the nation.

En el presente artículo se realiza un análisis de la evolución de la división de poderes en el constitucionalismo mexicano hasta la consagración de los llamados «órganos constitucionales autónomos» (OCA). Se analiza el origen y concepto de los OCA y las imprecisiones definitorias del préstamo conceptual de la doctrina constitucional mexicana de los «órganos constitucionales » en la doctrina española. Finalmente, se propone una noción propia de los órganos constitucionales autónomos que caracterizándolos como administraciones independientes e instituciones no mayoritarias constitucionalizadas, ofrece lineamientos para su identificación.

Despite being citizens, naturalised Mexicans are subjected to large restrictions in their political, civic, and even labour rights. Why such discriminatory regime is applied to such a reduced group of citizens, in a country that officially prides itself as open, tolerant, and having an intrinsically ‘mixed’ national origin? My hypothesis is that the roots of such differentiated treatment are the ideological legacy of the ‘Revolutionary Nationalism’ doctrine, which was promoted by the Mexican state during most of the 20th century, and is still expressed in laws and policies.

Los derechos sociales son reconocidos por la doctrina global contemporánea por su autonomía y justiciabilidad directa. No obstante, a la luz de diversos fallos en cortes regionales y nacionales, los efectos positivos de su judicialización no son del todo convincentes. En el sistema constitucional mexicano se está construyendo una demosprudencia sobre derechos sociales incoada por sectores marginados. Para lograrlo, la jurisdicción mexicana se guía por el derecho internacional de los derechos humanos y de las tendencias regionales en la materia. Con este marco de trabajo, el artículo subraya que la jurisprudencia mexicana de derechos sociales tiene avances y retrocesos, pues existen líneas decisorias que favorecen su progresividad y otras que denotan un sistema de interpretación ambiguo y restrictivo.

On December 2, 1823, the fifth President of the United States, James Monroe, announced the most important declaration regarding American foreign policy. His seventh annual message to Congress, more commonly known as the Monroe Doctrine, asserted the Western Hemisphere as America’s rightful sphere of influence. This paper argues how later federal administrations, under John Tyler and James K. Polk, manipulated the Monroe Doctrine’s terms to justify territorial expansion across North America. By examining four instances of American imperialism during the mid-nineteenth century, including the Texas Annexation, the Oregon Treaty, the Mexican-American War, and Cuban-American relations, this paper addresses how the United States turned a defensive declaration into an aggressive policy fueling socioeconomic and territorial gains. Although American hegemony in the Western Hemisphere remains undoubted, in great part due to the Monroe Doctrine, an insight into its controversial origins demonstrates the ironic nature of present-day American foreign policy. As global geopolitical tensions between the West, China, and Russia increase, the Monroe Doctrine may perhaps reemerge as a focal point in the United States’ grand strategy.

Se parte de la premisa de considerar que dicho encuentro interamericano constituía la institucionalización del proyecto de integración liderado por Estados Unidos en el continente americano. A través del análisis del informe de ladelegación a la Secretaría de Relaciones Exteriores de México, se reconstruyen las contradicciones y tensiones que se dieron ante el intervencionismo estadounidense en América Latina, en el escenario de la reunión argentina, apoyándose en fuentes hemerográficas surgidas durante los meses de julio y agosto de 1910.Abstract: This article refers to the debate that took place within the Fourth Pan American Conference of 1910, held in Buenos Aires based on the initiative presented by the United States and Brazil tended to validated juridical speaking the Monroe Doctrine. It is based on the premise of considering that this meeting constituted the institutionalization of the usa-led integration project in the Americas. Through the analysis of the delegation’s report to the Mexican Ministry of ForeignAffairs, we will reconstruct the contradictions and tensions that occurred in the face of American interventionism in Latin America, in the setting of the Argentine meeting, and we will complement the study with hemerographic sources that emerged during the months of July and August 1910.Keywords: Panamericanism; Monroe Doctrine; Mexico; Diplomacy; Press.

AbstractThis article traces the significant yet largely unexplored experience of transnationalism in the lived religious experiences of Mexican and Mexican American Catholics by focusing on the parish as a central unit of analysis. Within this analysis, the parish unit is rethought as an analytical unit in two important regards. First, the way in which parish life in rural Mexico has been predominately conceptualized as one whose rhythm revolves around a traditional ritual calendar centered on community celebrations of particular religious holidays and localized votive devotions needs to be replaced. Based on research from an ongoing historical case study (1890-present) of a central Mexican parish, Nuestra Señora del Rosario in Coeneo, Michoacán, and on other parishes, the rhythm of parish life has clearly shifted to celebrations of marriages and baptisms. These religious celebrations of marriages and baptisms in Mexico have become the focal point of identity and community in this transnational Mexican and Mexican American experience. These sacraments of baptism and marriage have multiple meanings that not only include universal Catholic doctrines but also notions of family, community, and a particular appreciation for the sacralized landscape of their Mexican parish. Second, notions of parish boundaries as fixed and parish affiliation as singular must be reconsidered because many Mexicans and Mexican Americans living in the United States consider themselves to be active members in at least two parishes: one in Mexico and one or more in the United States.

The aim of this work is to show how the French Revolution of 1789 led in the 20th century, in Mexico and France, to a conservative paradigm that we call the “new tradition”. Indeed, following the Revolution of 1789, a “legalistic” paradigm emerged in France and Mexico. However, at the turn of the century, this old law-based model came up against a new “social” paradigm, which sought to adapt the law to social evolution. The main purpose of the doctoral dissertation is to present the development of the relations between the United States of America and Great Britain from the declaration of the Monroe Doctrine to the American-Mexican war during the years from 1823 to 1846 in three mainly aspects: politics, trade and slave trade. The scope of the dissertation is carried out in the period from 1823 to 1846. However, in the first part, the dissertation also presents this relation from the establishing of this relation until the Monroe Doctrine declared in 1823 in order to show that the development of relations between the United States of America and Great Britain in the next period was based on the previous historical events and relations. Except for an introduction, a conclusion, a list of references and appendixes, the doctoral dissertation is divided into four chapters. The first chapter introduces the history of the relationship between the United States and Great Britain from the beginning to the birth of the Monroe Doctrine in 1823. I have sketched the history of relations between the two countries through periods, from the foundation after the revolutionary war of the United States, the war of 1812 to its development after the war. I have used an important part to analyze the Monroe Doctrine in terms of origin, the process of birth, its content and impact. These issues are the basis for the main topic of the thesis. The second chapter deals with political relations and territorial disputes between the United States and Great Britain. In particular, I have focused on analyzing territorial disputes such as the case of Oregon, Texas, the Northeast border of Maine and New Brunswick which had existed in the bilateral relationship since the Paris treaty in 1783. Political accidents such as Caroline affair (1837) and McLeod case (1841) appeared during this period are also presented. The issues of territorial disputes and diplomatic events are comprehensively approached from the historical context, views of each country, and the process of negotiating to the results achieved between the two countries related to the problem. The third chapter presents the British-American trade. Compared to other relationships, trade between the United States and Great Britain was not only direct but also indirect. In this chapter, the thesis analyzes the direct relationship in trade between the United States and Great Britain and indirect trade exchanges between the United States and the British colonies in East Indies, West Indies and in North America. At each specific issue, I concentrated on analyzing historical aspects affecting trade exchange, synthesizing, and processing of data on export, import and import-export turnover, comparing the scale of trade between the United States and Great Britain compared to other countries, or the scale of trade between the United States and the British colonies to clarify the British-American trade during the study period of the thesis. The last chapter deals with slavery and maritime rights in relations between the United States and Great Britain. This chapter is divided into four issues. The first issue mentions the release of slaves on American ships by Great Britain in specific cases such as Comet (1831), Encomium (1835), Enterprise (1835) and Hermosa (1840). The next section presents the controversial issue in the Anglo-American relations involving impressment of American sailors by British ships, which was the cause of the war in 1812. Part three relates to maritime rights associated with Creole incidents in 1841. In the final section, the relationship between Great Britain and the United States on the right of search and visit of British cruisers toward the American ship in preventing the exploitation of the United States flag for slave trade.

AbstractThis chapter introduces cognitive legal studies and cognitive economic methods for measuring and minimizing decision-making mistakes using cognitive nudges. It outlines a case study that shows how adding an index to complex case files improved the quality of justice in Mexican labor arbitration courts in cases of unfair dismissal. It also indicates the need for cognitively-informed mandated disclosure regulations. It stresses how cognitively demanding is the Duty to Understand legal doctrine for complex online privacy disclosures and other sign-in-wrap contracts. It introduces experimental methods to test the effects of mandated disclosure regulations in reducing decision-making mistakes based on Bloom's educational taxonomy.

This chapter discusses Margarito Bautista’s efforts as a missionary for The Church of Jesus Christ of Latter-day Saints in Mexico from 1922 to 1924, his preaching of unconventional doctrines while there, the fracas that ensued after his return to Salt Lake City over the lack of indigenous leadership in the Mexican Branch, and Bautista’s subsequently diminished influence in the Mormon Church. It argues that Bautista’s meteoric rise through the ranks of Mormon leadership came to a halt as he became increasingly insistent that Mexicans should govern their own congregations. Bautista’s name disappeared from the records of the Mexican Branch at about the same time the company that had employed him prior to his mission went bankrupt. During this period, his nationalism grew as he read about the Cristero Rebellion in Mexico. By 1930, without influence in the Church and unemployed, Bautista took up his pen and began to write.

Abstract (sommario):
This chapter examines Bautista’s U.S. residency (1910 to 1922) and its influence on his spiritual trajectory. It argues that during his first twelve years in the United States, Bautista experienced a decade of unprecedented personal growth and opportunity, which probably led him to expect a lifetime of increasing responsibility as a Mexican member of the Church of Jesus Christ of Latter-day Saints. Bautista crossed the border a month before the Mexican Revolution began. He settled first in Mesa, Arizona, but moved to Utah in 1913 where he helped found the first Spanish-speaking branch of the Mormon Church in Salt Lake City. Though initially a gardener on Temple Square, Bautista became president of his congregation and the Lamanite Genealogical Society, mastered temple rituals and Mormon doctrine, published an article, and spoke to audiences about his experiences as a Mexican Mormon.
