Testo completoPaul Bert (1833-1886) taught physiology at the Sorbonne and was also a member of the academy of science, a republican member on the French parliament, a secretary of state for education and religious issues and a governor of Tonkin and Annam. He played an active part in the reforms of primary, secondary and further education. Together with Jules Ferry, he founded the free, unsectarian and obligatory state education for all. An advocate of secularity, in the name of the freedom of thought, he fought for the suppression of religious education and the introduction of civics and moral education. While he acted in favor of secularization, he attacked clericalism. He was eager to create the school of the republic which had to develop citizenship. His thoughts stemmed less from the philosophical movements of his time, and more from his love for science and his attachment to the French revolution. Science provided him with a methodical approach, while the revolution gave him his ideal

Testo completoThis thesis analyzes the part played by The Grand Lodge of France in developing free, compulsory state primary education. It distinguishes three phases. Between 1861 and 1870, Freemason lodges began to get involved in this philanthropic activity. Although not very far-reaching, it was conspicuous enough (creation of state schools, of libraries, prize giving ceremonies, support to the Ligue de l'enseignement) to create general sympathy towards the lodges among the free-thinking republican non religious circles. Then, from 1871 to 1878, while becoming itself more democratic and secular, The Great lodge of France took part in the national debate through the medium of its local lodges. Including many political leaders such as Jules Ferry, some lodges, through their debates, became intellectual circles thus paving the way for legislative activity and, at the same time, identifying themselves with the republican ideal for schools. But, under the pressure of varied influences (positivism, neo Kantianism, anticlerical and/or antireligious free-thinking, spiritualism, atheism, opportunism, political radicalism. . . ), the free masons, like the republicans, became divided on several issues particularly concerning the freedom of education and secularism. Finally, from 1879 to 1882 Freemasonry entered the political arena. If Freemason involvement was effective and influenced political decisions, their action was often uncoordinated. Freemasons disagreed among themselves during several parliamentary debates, which contradicts the suspicion of a masonic conspiracy put forward by the Church and their opponents in parliament. All in all, this thesis shows there were no coherent masonic positions on schools, Freemasonry helped to conceptualize the school of the Republic but, because of its very divisions, it accompanied the movement rather than led it

Testo completoThis work is a systematical analysis of the parlementary debates from the constituante to the directoire period included. Throughout a typology of the projects, the complexity of the different positions is showned as well as the problematical debates. Four types of projects are identified : public instruction system, national education system, non systematical projects concerning only the primary degree, and non systematical projects concerning different degrees. The projets itselves depend on different conceptions of the social form of government of the republique : democratic, liberal, conservative, popular. This involves different conceptions of citizenship a subject citizen, a limited citizen, a confined citizen, a modelized citizen. Several ideological forms are also identified : rationnalism, utilitarism, and anti-intellectualism. Two thermidorien politics succeeding one another can be revealed : a liberal - democratic strategy from enlightment, and a liberal strategy for the elite the recurrency of the debates under the directoire period showes the necessity for the republique to have a democratic strategy and at the same time, the constant opposition of the conservatives and liberals. Nervertheless, a ideal-type of the public instruction can be elaborated, expressing a democratic and rationnalist strategy. The real matter of these debates is the human rights interpretation, and the significance of the right for instruction

Testo completoA critical discourse on the contemporary public school systems denounces the loss of transcendent teaching ideals, which would manifest itself in the weakening authority of the pedagogical tradition, and by gradually forgetting the emancipator and reflexive vocation of education. As a starting point for this thesis, three elements (public education, transcendent authority and teaching ideals) helped us understand the sense of the Québécois state education for its founders. Inspired by work of Émile Durkheim and Max Weber, we compare the original ideals of the Québécois state education with an ideal type of the modern teaching ideal, based on reflections from Rousseau, Condorcet and Hegel. This ideal supports both the valorization of an active human autonomy (in modern philosophy) and the trust in the benefits of human freedom (in western liberalism, questioning any abusive authority). The ideal of civilisation in constant evolution, however, maintains the authority of teaching’s tradition as an essential source of reflexivity, and thus for its role in acquiring wisdom. The analysis of the ideals expressed in school projects and laws from 1789 to 1875, and of the authority implementing them, highlighted the prevalence of a concern for the political society in development. This society was characterized by the awareness of multiple identity attachments and the distance with European metropolises. With each new law, the tolerance between Catholics and Protestants, and the acceptance of the linguistic differences between French-speaking and English-speaking people were maintained, leading to a tight separation between two cultural communities. In spite of this growing division, these laws enforced the ideal of the state education common to the French-speaking and English-speaking liberals by creating higher degree schools following elementary education, as a stepping-stone towards classical colleges. This ideal combined the utilitarian and universal intellectual vocations of public education. For the French Canadians, this was a mean of collective emancipation in the political society and towards the evolution of civilization. The teaching authority of the State remained quite limited until it was gradually granted to the religious authorities.

Testo completoBetween 1842 and 1914, the French ministère de l'instruction publique disposes of a financial resource that allows numbers of savants to make scientific, or literary travels abroad. The study of the 1205 files containing details about these travels makes the scientific and political goals of these missions scientifiques et litteraires clear. A closer approach of a few selected travels shows how financial help is asked and given. An historical sociology of those who benefit from the states money shows that this population changes greatly over the years. From a larger point of view, we can see, on one hand, that scientific travelling occupy a low grade on the hierarchical, and ideological, ladder of scientific activities. On the other hand, the study of the administrative surroundings of the missions scientifiques, sh ows that the traditionnal regal distribution of money, which has been carried on for decades by the kings of france, doe s not completely disappear during the 19th century, even under republican law. Both these elements explain the great div ersity of the scientific goals of the travels, and the heterogeneity of the population of the charges de mission. The monographical approach of the use made of state money gives an original point of view on the relations, so specific to France, between state and scientists. A dictionnary of the 796 charges de mission containing details about their live s and travels, constitutes the second volume of the work

Testo completoThe public management reforms that have been under way over the past thirty years are based on the widely held belief that the welfare state is at least partially lacking in efficiency, both in its so-called bureaucratic organization and in its actions, which are considered to be unsuited to the user’s needs. Regularly disputed in its objectives, its methods but also in its results, the Civil Service is since subjected to a “crisis of legitimacy” which makes necessary an overall modernization of its organization and its way of operating. The recent introduction of PRP (Performance-Related Pay) in the public service hospital reflects the wish to reform human resources management practices carried out until now. The aim of this thesis is to question the foundation of this individualization of remunerations which are based, on a theoretical point of view, on the principles of the New Public Management. Our approach aims to show that work design is at least as important, and perhaps more, than the introduction of PRP as a mean to manage motivation and satisfaction of hospital doctors. Beyond, we show that PRP could contradict the intrinsic determinants of motivation and job satisfaction of the hospital doctors, which are, in reality, widely affected by the characteristic of their job. We propose a research model that we then validate on a sample of 2 502 hospital doctors

This phenomenon could be partially explained by the contingency of social life and the uncertainty of individual and collectif engagements. Trust is one of the necessary conditions for actions. Trust is considered to be located in the tension between incitement and control. It would allow the reduction of breaking-off and breach situations in social relations. From a pragmatical point of vue, it would appear in a process during which actors (individual and collectif) facing problemtical situations, have to report to others. They would then begin an inquiry to resolve the problems which come out during their specific actions. Until this point, their engagement are affected by an institutionnal and abstract trust which we call a priori trust or infra-trust. .

Testo completoThe historiography of the general headquarters of the gendarmerie during the Occupation is void. Its chain of command is the great absentee of an institutional history, and also missing in the university research works, even though the units and the gendarmes of the years 1939-1945 have been the subject of numerous research works. This subject is however essential to understand how a military institution such as the French gendarmerie, and the men who command it, civilians and soldiers, adapt to an unprecedented crisis situation. The higher command is primarily a central administration. This administration experienced an unprecedented growth during the years 1940-1944, particularly from June 1942 thanks to the empowerment of the gendarmerie. It is supplemented by an inspection for the occupied zone, gradually extended, from 1942, to the southern zone. In charge of developing and implementing the operational strategy, senior gendarmerie officials were confronted with the French State's policy of collaboration and the demands of the occupier, particularly in terms of repression and economic policing. They must deal with these constraints to guide the action of the gendarmes, while preserving their anchorage in the territories. While running the human resources, the higher command of the gendarmerie must also solve the difficult equation of adapting its human resources policy to the contingencies of the moment, and the need to maintain the identity of the gendarmerie. To achieve this purpose, it develops constant hierarchical control, with particular attention to the officer corps, and to the selection and training of new recruits

Testo completoSince 1986, because of the maladjustment of the public (civil) service law and the choice of a centralised system of administration, the congolese administration became inefficient and absorbed all state ressources to the detriment of public investment. On account of the deterioration of the exchange terms, the administration became a source of debts for the nation, blocking the economic , political and social development of the country. In order to increase development, the I. M. F. And the World Bank proposed a series of policies centred on the reduction of manpower and the cost of administration and its structural and qualitative improvement. But the success of this reform was conditioned by the success of annex and allied politicies. This explains why, the evolution of the principles governing the management of public(civil)service was insufficient. Furthermore, and because of the difficulties in application of some politicies and the incoherence of others, the general impact of these politicies brought no concrete results. Indeed,these various and interdependent politicies were difficult to apply. In same cases, their application made difficult the application of others. For example, the objective of stabilizing public money through the reduction in the numbers of civil servants was annihilated by the blaze of military manpower and expenses. Finally, the difficulties of democratic transition increased the weaknesses which a true transition would have solved

The stakeholders in the junction of these two policies are always oblige to take into account the opposite logics if these two policies. Our aim is to analyze the acting of stakeholders in the junction of these two policies. This analyze involve many issues. In the origin and host countries, the bonds between these two policies question's the migration of patients living with AIDS in search of the last therapeutic projections or treatments essential to their survival. In the countries of origin particularly in Sub-Saharan Africa, the link between health and migration question's the push factors of "health tourism". The social and political contexts in those countries encourage people to leave their own countries. Some of them know their Aids status before leaving their countries but a lot of them ascertain their Aids status in host countries. What is the scope of health tourism concerning Aids in France? Who are these patients who emigrate (statute, sex, level of studies. . . ) which is the place of health in their migration project? In the host countries the arrival of foreign patients living with Aids in efficient health. Systems but nevertheless in crisis, also question's the Universalist aiming of the health system particularly in France. These issues and the debates which they cause are often put, at the political agenda by politicians, in terms of costs of their health care and the increase of the number of new recipients in medical benefits. On the level of the implementation of the policy against Aids, the issue of migrants living with Aids also question's the working and logics of the health services witch are not adapted to these immigrant populations in terms of cultural and social issues? Which are the problems raised by health care of migrants living with Aids in the France? Which are the strategies and programs implemented to improve health care among migrants living with AIDS? The inscription on the political agenda of the issue of migrants living with AIDS and in precarious situation, requires an important social and medical treatment? How this specific care is organized in hospitals? How the social professionals are integrated in care for migrants living with AIDS? Which are the resources mobilized for this socio-medical care? The care of migrants asks also the question of cultural dimensions of health care among these populations. Some organizations recruit cultural mediators to improve the health care of migrants. How those professionals are integrated in health services? Which are their roles? ln this context of development of immigration policy control, the health and AIDS sector seems to escape from the restrictions of foreigners rights

Testo completoThese last years, Moroccan public Administration has been criticised about its management, its organization, its slowness, and the quality of its services. Diagnoses made by different international and national authorities mean that the human resources management is remaining the weak point of the Moroccan Administration. It apparently groups many acute competencies, but they are no longer adapted to the new missions which are entrusted to it. Thus, it must face the thorny problem of the equivalence of training's to jobs. For that purpose, the Administration is trying to set up methods of competencies development which will be effective, efficient and allow the improvement of this training - jobs relevance. In this frame, we proposed the integrated training method, worked out by Professor H. Savall and the researchers team of the Institute of Socio-Economics of Organizations (ISEOR). This method, whose main objective is to ensure the best possible relevance training - jobs, is remarkable by its efficiency and decentralization particularity. Thus it enables to improve the staff polyvalence and to lower the departments vulnerability. Its implementation is widely facilitated by the use of operational tolls such as the competencies diagnosis, competencies bars and guides of integrated training. Before experiencing on the ground its reality and adaptability, we were brought to wonder first about the specificity of public management and about its human resources management. Analyses we carried out on this subject have allowed us to notice that the border between the public and private management is artificial, and that the specificities of the public management are no contradiction at all to an efficient implementation of the training integrated method in the Public Administration. Besides, led experimentations allowed not only to confirm the adaptability of this method to the specific context of the Moroccan Administration, but also to use it widely in all the structures related to our searching ground. Checking our minimal central hypothesis and our hypotheses body has contributed to strengthen the universal character of this method

Testo completoWhile research in the field of education sociology has hitherto mainly focussed on the vast topic of the teaching profession and its members, this thesis explores the less well-trodden but equally central question of national recruitment procedures. My chosen starting point is an analysis of national competitive examinations for the recruitment of state secondary school teachers in the light of a case study based on social and economic science teachers. This case study is centred on all the national competitive examinations, internal and external, statutory and non-statutory, organised by the French Ministry of Education since their creation or bearing on a significant period of thirty years. I intend to open up the ‘black box’ relative to these modes of recruitment, carry out a complete statistical analysis on the ground, meet members of the various examining boards and candidates, and gather their testimonies. The research for this thesis, which required the compilation of a substantial data base, is notable for being the first of its kind, as it was not carried out by an administrative service. In a second phase, I attempt to examine the profound changes which have marked my profession as administrative director of national competitive examinations in terms of both technical processes and strategy. The period covered extends back to 1992, when I took office. Challenging our established practices, a process due in great part to the constraints created by the Organic Law governing Finance Acts (LOLF) and the development of new technologies, makes it possible to measure what has been achieved over the past, to anticipate new working methods whereby the expectations of our interlocutors may better be satisfied and to guarantee the regularity and security of competitive examination management operations. This second part leads me to envisage a number of sociological perspectives specific to professional relationships at work, in education and within organizations. The interactionist paradigms will be foregrounded here

Testo completoThe workplace relationship consists of an agreement for the exchange of services between the employee and the employer. The terms and conditions of the pact are interpreted differently by each part. Each individual develops a "psychological contract" based on his perception of reciprocal promises and obligations. Studies show that the evaluation and implementation of this agreement has significant repercussions on the attitudes and behaviors of employees. In France, the concept of the "psychological contract" has not been deeply studied. International literature on the subject has mainly focused on the private sector. Our works aims to discover the particularities of this contract in the public sector, for local civil servants, a group which has not been analyzed but which has a very important position in the French employment market. Our research wants to contribute to debate both on a theoretical and in and operational basis: on one hand, we analyse the employee's perceptions of wage policies as one of the factors influencing the psychological contract; on the other hand, we explore the links between the perception of the breach of contract and how the employee places himself in terms of salary with regards to others. We find one of the first indicators of the existent reciprocity between organisational justice and psychological contract. Our work confirms in this way the existence of a link between procedural justice (perception of equality and transparency in wage policies) and the perception of a breach in the psychological contract. We also confirm the link between the perception of this breach and salary comparisons (distributive justice)

Testo completoThe thesis is a monograph of the integration process following the merger between a private company and a public company. It builds on an ethnographic approach, complemented by a literature review related to internal and external business environment, as well as a participant observation conducted in the HR department of a multinational industrial group's branch over a three-year period (late 2009-2012). The thesis studies the transformations and evaluations of the HR function. It seeks to understand how it faces the organizational dissonance and confusion and how HR professionals manage to keep their role. The survey highlights the transformation process. It shows that it is multiple and unachieved four years after the merger. It follows several contingent, structural, institutional, managerial influences: Europeanization and implementation of an Anglo-Saxon model of human resources management within French subsidiaries, privatization, and many changes of all kinds, economic and financial crises. Measuring devices are varied and unstable, highlighting what counts at any given time. These factors explain much of the confusion felt by HR professionals. Using four theoretical models from the neo-institutional theory and economic sociology, the thesis makes some assumptions about mechanisms implemented by HR professionals to deal with this confusion, to organize and be effective. These mechanisms, such as coordination, individual relations and cooperation, hierarchical power and control involved at several levels in the post-integration period

Testo completoA new approach to the vision of human resources in the public service of State tends to develop over the past fifteen years. The GPEEC has appeared with the stated desire to reform the traditional approach of public management. Since 2006, LOLF new financial constitution also appeared to be a lever GPEEC. How these two strategies they impacting the HR administrations? The strategic vision developed to support this new deal is it compatible, realistic, applicable in the French government. How the combined weight of the LOLF GPEEC and is it perceived operatively? The status of the public can live with this development? On this issue, a working basis was chosen for the analysis of an administration and immersed in the GPEEC LOLF: French Customs. Approached from three angles, missions, recruitment and training, mobility, it will consider how this administration or suffered accompanies these developments? What are the pitfalls, opportunities, achievements and up to how blocking can we go? Evolving missions require a streamlined and sustainable approach to understand the first part of the GPEEC: The appearance of estimates of numbers and skills. The recruitment and training must be re-engineering to integrate the second part of the GPEEC: appearance matching skills to needs. Mobility implies a revaluation to match the third installment of the adaptation GPEEC ie geographical and functional needs of the administration. Given this approach, the articles of the civil service and the concept of career but also the organizational and weight of the multi-mission does not favor it seems a good practice GPEEC. The impact of LOLF dimension in performance and efficiency may become an obstacle to GPEEC when they should be the engines of the new vision of public management. Testo completoThe modernization of the public sector requires an HRM accompaniment, for the evaluation competencies of the supervisory staff. This approach relies on the necessity of having an adapted management tool, requiring NICT, and allowing the aggregation of qualitative data. To achieve our objectives, we used an innovative, internal, interference engine based on artificial intelligence, namely the “fuzzy logic”. It would seem, at the conclusion of the realization of our Computer-Aided Evaluation tool, that it must possess particular qualities allowing it to carry out the most objective and fairest evaluation as possible. Its use in real conditions indicates that it must, to be accepted and an appropriation, at once by the managers and the estimated staffs, be credible and effective. The realized tests allow us to assert that the essential perception of its role, its utility, and its facility of use, are a necessity which will be the corollary of ensuring its continual existence

Testo completoAt the end of 1910', Max Weber wrote : in the sphere of everyday affairs, domination "consists precisely in administration". If he could come back one century later, he would say : "It consists in management." How to understand, from the viewpoint of an history of public and private bureaucracies, the current invasion of the public sphere by management technics ? This PhD in historical sociology studies the rise in business companies, and propagation in state administrations, of several power apparatuses in France from 1945 to nowadays. If we don't want to satisfy ourselves with the lazy explanation which relates it to "neoliberalism", we must replace the whole transformation into the long term history of public wage labor and the reinvention of capitalism. Main instrument of the first managerial revolution, management by objectives gave birth to a new organization of the firm : an individualized government of executives by numbers, directed towards the unlimited growth of the productivity of the work force. High civil servants from the national economic planning tried without success to transpose this kind of managerial bureaucracy into ministries : not in the name of "the market", but of employees' control, GDP growth and the power of French State. In the completely different context of 1990-2000' and financial capitalism, LOLF and RGPP finally instituted this government of public services by objectives, to serve a new end : public spending reduction. Health systems, tax collection, administrative offices or unemployment offices have been reorganized on the basis of the integrated fordist firm model of the 1970'. Some high civil servants are now trying to radicalize this project with the imposition of a new kind of organization, even more dangerous to a democratic public service : the neoliberal bureaucracy of the network-firm arising from the second managerial revolution of 1980-1990', in which an important element is the government of direct producers by an individual competition, formalized by human resources managers

Testo completoThe survey, conducted by the audit of people involved in HIV prevention in Guadeloupe, was focussed on the migrant population, in order to lower their risk of exposition. Targeted questions xere asked during the interviews and the information collected computerized for data processing. After thorough reviews the data had to be put together for close examination. We have met a public of multidisciplinary protagonists and we have identified a network of structures withinfour areas of activity (sanitary instituional, socio-sanitary individual, socio-educatuinal communautary and environmental), with a federative body: COREVIH. But 70% of the protagonists say the networkis badly coordinated. The different media through wich HIV information is transmitted, are translated for foreigners. But few are distributed, considered inappropriate (36%). Health centres appear to be ideal places for indivdual prevention (high rate migrants coming). Programmes for community prevention are too fex. They target Dominican prostitutes while fruitless attempts are made toxwards the Haïtian community. In fact, 34% of the protagonists found it hard to mobilize representatives of associations, in order to include the population in the programme of prevention. At the same time, 28% of the people working in prevention say they meet unfavorable conditions for their mission: severe anti-migratory laws, access to basic rights denied, discrimination. Finally, 1/4. Of the people involved in this fight, emphasized the various reasons making the migrants vulnerable to the disease : lack of knowledge, wrong attitudes, riskly sexual behaviour, precariousness. To conclude, ail the people involved in HIV prevention near migrant population should necessarily meet and work together, to elaborate a regional prevention programme

Till this day, Wasta remains a relatively obscure topic of research, insufficiently dealt with in academic papers. Therefore, this dissertation comes as an attempt to build a theoretical framework model for Wasta from the data grounded in the field, which seeks to offer a deep understanding of the factors and considerations that relate to its extent among various HRM practices in the Jordanian public sector. To do so, we illustrate the definition of the concept of Wasta and demonstrate its negative impacts on HRM and overall performance of public institutions. We also explore the realities in the Jordanian organizations in the post-public reform era. Furthermore, this dissertation aims to provide several propositions regarding the factors that determine Wasta’s extent in the public sector in Jordan. This work also offers insights for academics who are interested in HRM research in the Middle East and Jordan alike, for decision makers and HR specialists in the Middle East; as well as for global leaders who are interested in business potentials in Middle Eastern countries in general and in Jordan in particular by pointing out Wasta-related realities. Testo completoThe administration of the King's Buildings in the 18th century is an institution in the service of the King under administrative supervision of Maison du Roi. It administers the building, the maintenance and upkeep of the King's residences and properties such as the Château de Versailles, Fontainebleau, Saint-Germain, Marly, and Compiègne. In this respect, some academies like those of architecture, painting and sculpture, depend on it. One can also quote as examples the Manufacture des Gobelins and de la Savonnerie. The administration also includes the Departments of the Machine de Marly, of the drains in Trappes and in Saclay, those of the marbles and the plants nurseries. The evolution from the Superintendency to the Direction under the Duc d'Antin (1708-1726) has consequences on the power of the Director mainly, who loses his financial prerogatives in relation to the superintendent. Even if the bureaucratic organisation is strengthened and rationalised indeed, the modifications are mostly due to the budget problems met by the monarchy that urged for savings and impeded the initial missions of the administration. This thesis studies the way a central administration works in the age of the Enlightenment, focusing on the administrative, economic, politic and social areas. Through a study of the accountancy, it puts forth the functioning and organisation of an administration that is becoming a bureaucracy as well as a political tool, particularly for the Directors who work for the King. The dissertation also sets forth a study of the personnel and their daily tasks, having to deal with administrative procedures, the influence of the Court and financial difficulties

Testo completoThis research consists in a comparison between the legal instruments of human resource management in the French and Italian public service sector. The objective is to evaluate their efficacy and uncover the main problems linked to their implementation. In the Italian public service sector, the manager is assimilated to the employer found in private firms. The link between the public servant and the administration is first regulated by a specific law, then by collective bargaining and labour law. In the French system, labour law isn’t applied to the public service sector. However, labour law has an influence on it, and vice versa. Collective bargaining doesn't have any formal rule because the civil servant must accept conditions imposed by the administration. Despite appearances, throughout their evolution the two systems seem to increasingly resemble each other, particularly in the realm of human resource management legal instruments, the use of temporary jobs and the rule of collective bargaining. It seems that flexibility in human resource management isn’t necessarily associated to the nature – public, private or mixed - of the link between the public servant and the administration. The choice between unilateralism and negotiation, administrative law and labour law doesn’t matter so much. Though French statute law is flexible, there are some political and administrative customs which are damaging. In both Italy and France, public administrations do not need to ignore - respectively - privatisation and statute law in order to become more effective. It seems that public administrations do not use all the possibilities offered by existing laws. They have to invest in human resources in order to transform office directors into real managers, rather than to continuously work on useless or damaging radical reforms

Testo completoThe remuneration of directors of listed companies generated a lively debate and even controversy as to their amount or to the principles guiding their determination. This debate is often intensified by vivid media coverage aimed at instigating the public opinion and encouraging the legislator to take up the question. The latter then seeks to regulate the practices in question either by imposing mandatory measures at times, or by encouraging self-regulation at others. This study aims to assess the relevance and effectiveness of all of these rules under the hard law and soft law. Such an examination of the substantive law shows a real inability to provide an answer to the problem of the social acceptability of these remunerations through legal tool. It also reviews the evolution of French legislation during the last twenty years, based on the need for transparency and the development of procedures for determining and awarding the remuneration of directors. Judges do not appear to have effective leverage and means of struggle in the Corporate Laws against the excesses of the remuneration. So many hopes have been based on the principles derived from the soft law and in particular, Corporate Governance, yet those hopes were however deceived in many ways. Finally, the question that remains particularly urgent and haunting is whether the law, be it hard or soft, can be a useful and effective tool for regulating the level of remuneration of directors and executives of listed companies

Testo completoStemmed from a democratic will of emancipation of the citizen and of working out of a new society, the public Theater, in France as well as in Italy, seems again to be a prey to a triple crisis (political, structural and artistic), since the turning point of 2000. This allows to question the political and symbolic connections which are at stake between art and society within institutional limits led by a public service mission. Through the examples of the “Théâtre National de Strasbourg” (TNS), Villeurbanne’s “Théâtre National Populaire” (TNP) and Milano’s “Piccolo Teatro”, the point is to consider the public Theater with the whole of its participants and constituents (esthetic, political, economic, symbolic, architectural and social) via the prism of their respective managers’ process and strategies of justification, in order to determine and explain the evolution of the institutions and the transformation of the duties they assume and implement. By distinguishing between the various strategies elaborated by the managers, we can give shape to the positions, held by the artists and the authorities towards the neo-liberal society and the institutional issues. These positions are linked and answer a contamination of the cultural sphere by the economic sphere. They reveal a division, increased by the role given to the audience, between the institutions, which try to compensate this contamination by ways of interactions and experimentations with the society, and those, which deplore this situation and answer it by standing aloof from reality and focusing on their conception of dramatic art
