Testo completoAccording to the article 957 of the new code of civil procedure, the chief president of the court of appeal can. . . " in the case of an appeal. . . Exercise the powers which are bestowed on him regarding the provisional execution. . . " the vocable "provisional execution" includes two facts completely different from each other depending on whether the provisional execution was required by the magistrate judging in first place or is de jure bound to his ruling. Thee two facts match two regulations specific of the chief president's competences. When the provisional execution has been required by the matistrate judging in first place, the chief president may stop it on condition that, it is forbidden he may fit up its clause differently too. When the provisional execution is de jure, the chief president may not stop it, he may only fit it up differently; still, for this purpose, he can use nothing but the right of making arrangements likely to give the sentenced party's interests as little support as possible. In this survey, on the basis of a jurisprudential analysis, we plan to emphasize the closeness of two regulations devised by the legislator in contrary terms. On the ground of a required provisional execution, either by exercising a power purely intended to reduce the consequences of the provisional execution as it is written in the texts, or by using this power in order to sanction the ruling matching the provisional execution, the jurisprudence's aim has been to make the most of the condition dictated to the powers. On the ground of a provisional execution de jure, either by considering a back of powers which jurisprudence abides by in most cases, or by creating exceptional ones, the jurisprudential work has been to ignore the legal prescriptions, on the assumptions whick exactly justify the extensive intterpretations of powers in the case of a required provisional execution. So, we have to state that this application provides a link between the matter of the required provisional execution and the matter of the provisional execution de jure both considered from the angle of the chief president's competences

Testo completoTo create - one of the most important innovations of the judicial reform in year eight is the creation of twenty courts of appeal. The following departments: Côte d'Or, Haute-Marne and Saône-et-Loire fall within the competence of the court of appeal of Dijon. Concerning the judicial staff, Cambacérès chose continuity: court of appeal's members are former barristers of the burgundy parliament elected judges during the French revolution. To remodel - successor of the burgundy parliament, the court of appeal has to define its own image. Relations with the executive power are not easy: frequent conflicts with the prefect, tough supervision by the minister of justice. In addition, at each change of government, the court is highly shaken. To innovate - magistrates became state employees : - they are appointed by the minister of justice who chooses from three candidates proposed by the two chiefs of the court, - they wish to make a good career for themselves in magistracy that is to say climbing in the hierarchy within which the court of appeal enjoys and enviable position. Finally comparative study of court magistrates'carreers of Dijon, Pau and Rennes shows an obvious likeness

The function of the criminal appeal system is surveyed through historical and juridical data of its mechanisms ans complemented with a case study : the meticulous reading and study of 794 judgments from the appeal court of Lyon, during the period of 1. 1. 1988 to 30. 6. 1988, concerning repressive decisions against 1015 accused persons. This study permitted comparisons in relative termes between sentences by courts of first instance and the appeal court and an evaluation of the effects of the judicial pronouncements. The thesis thus proposes an explanation of the scarcity of appeals from judgments of police and magistrates courts. The combinaison of rules which define the pwers of the public prosecution and the mandate of appeal judges dissuades the accused from appealing against the sentence. Lodging an appeal constitues a risk, rather than a chance for the convict

Testo completo: Based on the notion of criminal milieu and mafia, thethesis examines 94 cases of criminal conspiracy tried at the Court of Appeal of Aix-en-Provence todescribe the evolution of French organized crime, particularly Corso-Marseille. The latter is reputedto be the most important in France, thanks to its long-standing presence and its indigenousorganisation. We wish to confront the French notion of "grand banditism" with the internationalnotions of "organised crime" and "mafia", in order to understand the evolution of these groups interms of organisation, networks and power.In the first part, after presenting the methodology, the myths that inform much of the generalliterature on social change in criminal groups are reviewed, followed by an analysis of recentlegislation concerning criminal groups. The second examines the social composition of the populationconstructed from the records, the structure of criminal enterprises and the network structure definedby these groups.Among the main results, the thesis shows the presence of extra-legal forms of governance in theFrench illicit markets, where the position of authority is highlighted by the detection of structural holeswithin the general network, which represents a first form of mafia-like organisation in several AngloSaxon and Italian studies

Testo completoDuring the nineteenth century, the bankruptcy law instituted as a sanction mechanism of bankrupt debtors professionals has been gradually taking into account the debtor's situation and his good or bad faith in order to assess the degree of guilt.In Lyon, the evolution of the standard of bankruptcy and practice of the Commercial Court reveals a growing consideration of debtor’s humanity, sometimes accompanied by a legal reform promoted by the initiative of consular judges of Lyon. They take the initiative to institute measures contrary to the law to protect bona fide traders victims of a situation causing a major economic crisis that generates cascading bankruptcies.Instead of putting in place a comprehensive reform of bankruptcy law claimed by practitioners, doctors, case law and by litigants, the legislator establishes only temporary and palliative measures. Its inertia reinforces the conviction of consular judges of Lyon that their practice has established itself as an appropriate solution to reduce the adverse consequences of the inaction of the legislature not only on the situation of failed traders, but also on society and the economy of the city from Lyon
