Testo completoDecentralized cooperation is the device by which local authorities drive international cooperation actions. It consists of community with community exchanges and relations within a partnership framework, most of the time formalized by convention. The types and the dynamics of these partnerships are diverse. With regard to the cooperation types and dynamics diversity, this thesis suggests managerial analysis by approaching the cooperation decentralized as the inter-organizational cooperation and by emphasizing commitment and reciprocity as levers to explain the success of partnerships. To this end the approach of research aims to be comprehensive and bases itself on mixed methodology. It allies the study of 22 cases of decentralized cooperation partnerships between French and African local authorities (Gabon, Senegal) to a commitment questionnaire. The results of the study confirm the three-dimensional character (calculative, normative and affective) of commitment in decentralized cooperation partnerships; the leading mode is calculative one. Reciprocity presents a multiple character so much in the type (generalized and balanced), the mode (direct and indirect) and the dimension (instrumental and symbolic). The moderating and mediating link between commitment and reciprocity, in the determination of a partnership success, is discussed

Testo completoThere are many reasons for this, but the first is budgetary. There are many reasons, but the first is budgetary. The costs of a parallel administration, as set up with deconcentration and decentralization in France, are no longer reasonable. The distinction between deconcentration and decentralization is a very French one, with most countries grouping them under the same concept of decentralization. The concept of "unitary" administration, as used in Germany for example, should be particularly explored. This rapprochement between deconcentrated and decentralized administrations is also part of French administrative history, illustrated by the figure of the mayor, both agent of the State and local executive, as well as the more general history of local authorities, which should be examined. In other words, we have to accept that the same actor can defend both national and local interests, and that the existence and competence of the decentralized actor makes it possible to do without the deconcentrated actor. This change ofperspective, obviously a source of savings for the State, can also benefit local authorities, by enabling them to be better players in the decentralization process. The aim is not only to examine the past in order to better understand the future, but also to monitor all the "signs" of a rapprochement between devolved and decentralized administrations in the present. There are the soft signs, the ongoing experiments by decentralized and deconcentrated players, which are leading to the coordination of a good number of public policies. The hard signs are those of positive law. In this respect, the delegation of powers is particularly emblematic, enabling the State to entrust the implementation of a power which remains its responsibility, to a decentralized territorial level. The new deconcentration charter of May 7, 2015 still introduces the principle of modularity in deconcentrated administration by stating that the State administers territories in "a relationship of proximity to adapt to the reality of the French, which is not identical at all points of the country"

Testo completoThroughout South America, a political and legal system that recognizes local governments as actors of regional integration is under construction. This system mainly emerges from a spontaneous and coordinated convergence. Decentralization processes allow local governments to act externally, internationally. Inter-States integration initiatives support the cooperation between local authorities. Norms and rules for decentralization and for South American integration converge to set a minimum framework for the collaboration between local governments of different countries.An increase in decentralised cooperation is thus observed. Exchanges between local authorities have become natural on the political level, and legitimate on the legal level. Thanks to a circular dynamic, local governments adapt their administrations to the « territorial cooperation system » designed by States, and at the same time perfect it through their practices. At least two consequences flow from the system. Local authorities have the jurisdiction to free associationthroughout South America. They support the emergence or consolidation of transnational spaces. Then, a new territorial division emerges. Bi-oceanic and cross-border spaces coexist with more traditional territories, such as municipalities, regions or States. Therefore local authorities contribute to the regional integration in South America

Testo completoThe decentralized co-operation which is based on a new type of partnership takes root in research of the durable development of which one of the solutions resides in the restoration of dies of management of the development aid. It is thus the means of diversification and decentralization of the decision-making centre as regards management of the policy of international co-operation especially relative to this help. Also, in margin of the purely official international relations and exclusively policies build it e new give incarnated by the decentralized co-operation of the local authorities still called co-operation “of community to community” to this end, these people take note which are not classified easily in a precise category or a single legal order because pf existence sometimes of several elements of extraneity. From the point of view of the construction of a harmonized Community space, the local authorities and in particular the areas become the instrument of implementation of the European policy. Thus, reforms is structural funds and the creation of national commission of decentralized co-operation take part of the achievement of this objective. Consequently, an important and coordinated engagement is started in favour of the interest of this new exercise of local freedom. This step will become the point of support of a convergent orientation of the local policies for an official recognition of the international action of the local communities. So that the change of he NORTH-SOUTH relations remains especially characterized by the entry in scene of local authorities thus marking the end of the official monopoly and the beginning of emergence of the local authorities in the international relations of the development. In this moment, the decentralized co-operation becomes the new alternative of the economic and social development. In the analysis of this decentralized co-operation, the legal approach of the acts and actors of this new type of partnership are an important shutter. It contributes to the determination of the nature of concluded conventions. As for the aspects of its practical evolution, it seems like the development and the implementation of these conventions or of the projects which they contain. The partnership experiment of the local authorities of franche-comté and west-mountainous of Ivory Coast aims to elucidate all these remarks

Testo completoAll the educational reforms operated in Benin brought some improvements to the educational system. The territorial decentralization initiated in the nineties affected subsequently the sectors of education and professional training. With this decentralization, the local governments in Benin which constitute the only decentralized level were transferred new competencies such as education and training. Nevertheless, the transfer of decentralization's funds following the transfer of competencies is not sufficient because the Beninese local governments cannot devote a significant portion of their budget to the material management of education and training. Therefore, to accomplish their goals related to their competence, they are forced to turn to their foreign counterparts, like the French local governments. And, moreover, the legal framework of the decentralization gives them the power to undertake the decentralized cooperation, which exceeds in reality, the French framework of this cooperation. They can indeed tie partnerships with foreign territorial collectivities, organizations and associations, even with international non-governmental organizations. Material, technical and financial supports from all the partners of the Beninese local governments, give them the possibility to make powerful public policies of education and training in Benin. As a result of this decentralized cooperation, one can see today in Benin, a growing number of schools with well-equipped modern classrooms, as well as canteens and dormitories for needy students. There are also teachers who, through the decentralized cooperation, benefit from trainings and witness improvement of their wages and living conditions. The direct consequence of this cooperation is that Benin exceeded the rate of 100% as regards to universal schooling while having improved at the same time, the percentage of boys and girls at school, and even, the teachers/students ratio. Finally, the training centers built by the decentralized cooperation allow the training of qualified workers likely to satisfy the needs of local craft businesses, but also, decrease the illiteracy rate which, ultimately, reduces poverty

Testo completoThe decentralized cooperation between French and African public authorities has various interests of a historical, economic, political and socio-educative nature. However, the issues raised by such types of cooperation are multiple. Indeed, the legal regime of these agreements is fairly complex. Few texts have been devoted to them. Thereby, those agreements do they reveal an internal public law or a private law? Do they give rise to laws conflicts? Which courts are competent and which law is applicable? May arbitration be used? And if so, what particularities that it's regime presents? Hence, the importance to determine the nature of transnational agreements.The fact that those agreements are concluded between public entities of different national origin, namely French and Burkina Faso, they could be connected to a public international law. However, people's right governs only the relations between sovereign states. If we admit the existence of these "contracts between sovereign states”, the submission to an internal law of agreements between mere public persons of a national distinct origin seems to be conceivable

Testo completoBy Act I and Act II of the Decentralization, the public authorities have made the choice to transfer competences to the territorial collectivities, and consequently to take into account the local potential of territories. The territorial organization of France is today very criticized. The constant legislative evolution in this field, did not know how to build an effective system. Indeed, the division of powers between the State and local authorities and between municipalities and their EPCI has become synonymous with complexity. If the will of the legislator was initially to introduce a decentralization by blocks of competences, and to transfer at each level a well-defined block of competences, the reality was quite different. Today, the goal of intercommunality is to establish a real collaboration based on a common project of development within relevant perimeters. However the pooling of services remains difficult and too little applied. The necessary rationalization in the division of powers has led to a reorientation of intercommunality, which is now moving towards a two-tier intermunicipal co-operation between rural and urban areas. The legislator by the law of modernization of the territorial public action and affirmation of the metropolises of January 28, 2014 and the law of August 7, 2015 on the new territorial organization of the Republic, favored the expansion of the metropolises, which appear as a as a solution to the stacking of intercommunal structure

Testo completoOur thesis is about the effect of the administrative border in an urban community and concerns particularly on the relations between Grand Lyon and its surrounding municipalities in the context of the territorial reform aiming at rationalizing and reinforcing the intermunicipal cooperation. What are the possibilities of the cooperation? How are the possibilities reconfigured? We reach the questions, in the first place, by the modification of the border of Grand Lyon, in one part following to new communes adhesion, in other part following to the creation of the Lyon metropolitan. In the second place, we study the impact of Grand Lyon border on the urban services, with study cases devoted to the recent territorial evolution of transport Lyonnais syndicate intervention (Nouveau Sytral).Our research was carried out by using various juridical documents, press reports, student works in which were analyzed in the point of view of urban planning leaning on geographical and political science methods. This study also focuses on interviews in the selected municipalities. The analysis reveals that the definition of intermunicipal Lyonnais grouping perimeter is completely a geopolitical issue, in the meaning that Phillipe Subra gives the notion. In terms of the situation, the local political context, the communal projects, the alliances between the territories are established or unraveled
