The utilisation of the concept of vulnerability in international law has risen exponentially. This contribution intends to analyse the issues underlying this phenomenon. Vulnerability is frequently used in a functional manner in order to enhance the protection of individuals. Therefore, even if vulnerability has been initially developed as a non-legal concept, it has now become integrated into legal discourse. As it inevitably supposes the contributions of other disciplines such as moral philosophy and legal sociology, vulnerability reshapes the ways in which individuals are protected by law. Hence, the reconsideration of several concepts, especially individual autonomy and international responsibility, paves the way for better protection of individuals.

I propose that Hannah Arendt’s hermeneutical philosophy can make important contributions to ongoing debates in the study of epistemic injustice. Building on Kristie Dotson’s concern that Miranda Fricker’s formulation of hermeneutical injustice is needlessly restrictive, I argue that Arendt’s concept of ‘thinking’ challenges us to imagine a form of hermeneutical virtue that is rigorously self-critical. The self-destructive tendency of Arendtian thinking may help to guard against the specific danger that Dotson identifies - namely, that an overly rigid approach to hermeneutical injustice and hermeneutical virtue can itself generate situations of epistemic injustice. Despite important differences that emerge, it is productive to bring together Fricker’s concept of hermeneutical virtue and Arendt’s concept of self-undermining thinking in order to reveal the ways in which these two corrective strategies might enrich and pose important challenges for the other.

Finalement, je recours au concept de vertu naturelle pour examiner la question de l'unité des vertus et le problème du «courageux meurtrier nazi». Je comprends cette exploration du thème de la vertu naturelle comme une contribution à la réflexion sur la vertu en général et, plus particulièrement, au débat entre une éthique de la vertu et une éthique des principes.

Purpose: Virtue theorists debate qualities of society leading to human flourishing. Thus, aspects of scholarship on virtue theory may refine conceptualization of social good. We focus on the virtue of solidarity and its contributions to the ethical foundations of social good, providing a core connection to macro-level social work interventions and settings. Methods: We first identify a theoretical gap in the conceptual framework of social good, then use virtue theory and the example of solidarity to connect the concept of social good to social work professional values and macro practice. Results: Our primary critique of the concept of social good is the lack of a sufficient ethical frame that addresses social justice, value foundations, or power analysis. Discussion: Without this, the discussion of social good lacks tools needed to critically assess relevant systems of change and innovative technologies. Consequently, the work of social good risks reinforcing existing status quo and oppressive systems.

The idea that knowledge as an individual mental attitude with certain propositional content is not only true justified belief but a belief the truth of which does not result from any kind of luck, is widely spread in contemporary epistemology. This account is known as anti-luck epistemology. A very popular explanation of the inconsistency of that concept of knowledge with the luck-dependent nature of truth (so called veritic luck taking place when a subject’s belief could not be true if not by mere coincidence) presumes that the status of propositional knowledge crucially depends on the qualities of actions that result in the corresponding belief, or processes backing them, which reflect the socalled intellectual virtues mainly responsible for subject’s relevant competences. This account known as Virtue Epistemology presumes that if a belief is true exclusively or mainly due to its dependence on intellectual virtues, it just cannot be true by luck, hence no place for lucky knowledge. But this thesis is hard to prove given the existence of true virtuous beliefs which could nevertheless be false if not for some lucky (for the knower) accident. This led to an appearance of virtue epistemological theories aimed specifically at an assimilation of such cases. Their authors try to represent the relevant situations as such where the contribution of luck is not crucial whereas the contribution of virtues is crucial. This article provides a critical analysis of the corresponding arguments as part of a more general study of the ability of Virtue Epistemology to provide justification for the thesis of incompatibility of propositional knowledge with veritic luck. It is shown that there are good reasons to doubt that Virtue Epistemology can do this.

Abstract This essay aims to explore the concept of interpretive virtue and to elucidate its significance for contemporary exegetes. Although several recent works have referenced the importance of the virtues in renewing biblical interpretation, a concise account of the options, benefits, and challenges associated with such a move remains elusive. To sketch this account, this essay explores virtue epistemology as an analogous (but not identical) trend in a sister discipline. Two models of virtue epistemology—the first from Linda Zagzebski, and the second from Robert C. Roberts and W. Jay Wood—offer several insights that should inform appropriations of virtue ethics in biblical interpretation. While there are surely important differences between epistemology and exegesis, Roberts and Wood in particular demonstrate the great potential that lies in a virtues approach to biblical interpretation that aims at improving the intellectual life by forming habits conducive to the acquisition of various interpretive goods. Though this approach is unlikely to provide a way of adjudicating interpretive disputes, it can significantly enrich our understanding of biblical exegesis by delineating its goals more clearly while also helping teachers to train students more effectively. While this reorientation must not be overhyped—virtue theory does not offer a complete picture of what makes good biblical interpretation—it holds significant promise. Finally, the essay addresses three common objections to virtue theory: that it represents a poor fit with the biblical witness, that it yields no substantial contribution to hermeneutics, and that it ineluctably results in problematic forms of relativism.

Throughout the history of western ethics, there has been a ceaseless debate between rationalism and sentimentalism. The two normative movements which born from the debate have caught our attention. The first one happened in the late 19th century, as represented by Kantian deontology and utilitarianism. Meanwhile, the other one is the revival movement of virtue ethics initiated by Hursthouse, MacIntyre, Michael Slote (Slote), and others, discussing the normativity and rationality of virtue ethics. During the second normative movement of virtue ethics, Slote proposed moral sentimentalism based on the ethics of empathy, which made him the focus on the academic attention. The doubts about the Ethics of Empathy constructed by Slote falls under three aspects, which are the concept of empathy, the process of empathy argumentation, and the reliability of using empathy ethics to answer Hume’s problem. Meticulous research on these doubts and Slote’s responses to them can help us to understand better on the construction of his ethical thoughts, their contributions, and limitations, which the author believes, is essential for the current development of moral sentimentalism.

‘Virtue ethics’ is prominent, if not pre-eminent, in contemporary moral philosophy. The philosophical model for most of those urging a ‘virtues approach’ to ethics is of course Aristotle. Some features, at least, of the motivation to this renewed concern with Aristotelian ethical thought are fairly clear. Notoriously, Kant held that the only thing good without qualification is the good will; and he then made it difficult to grasp what made the will good when he denied that it could be its preoccupation with or attention to anything in the world. The idea of the good will then seems to be an idea of something which transcends the world, and therefore to be no easier to make sense of, or to believe in, than Plato′s form of the good is usually thought to be. The first obvious attraction of Aristotle′s ethics, then—at least to those of an empiricist or worldly cast of mind—is that it promises an understanding of the ethical which locates that robustly within the world. Aristotle′s virtues are real this-worldly existences. They are, moreover, qualities whose place in our lives seems to be explained readily, and attractively, in Aristotelian terms. Moral virtue is essentially connected with eudaimonia, a concept variously construed as happiness, as living well, or even as flourishing. Morality is important because of the contribution it makes to the living of a fully human life. And a ‘fully human’ life is characterizable in what modernity calls ‘humanist’, or sometimes ‘naturalistic’, terms: it requires no invocation of transcendence or other-worldliness.

This paper aims at an accurate and detailed analysis of some of the main echoes of the Latin comedy of Plautus and Terence in Morean epigrams. The fundamental Greek background from which More’s epigrams spring is somehow enriched by the Latin contributions by virtue, among other factors, of the cultural legacy of the language in which the humanist chose to write them. A contextualized analysis of the clearest echoes found allows distributing them in a general way in two global types: (1) those of a more formal nature (morphological, lexical-semantic, syntactic) and (2) those that convey a debt of content, concept, or topic; it is shown that both types can occasionally be interrelated in a particular and original way.

In this paper, we shall first delve into the foundations and underlying principles that shaped Aquinas’s interpretation of religion. Next, we will undertake a thorough examination of religion as a virtue, highlighting Aquinas’s emphasis on its intrinsic connection to justice rather than confining it to the realm of religious sentiment, piety, or devotion. Finally, our research will explore the specific terminologies employed by Aquinas to elucidate the concept of religion, providing a comprehensive and nuanced approach to the ongoing discourse on this topic. Aquinas’s contribution rests in his defence of religion’s inherent public nature, grounded in its anthropological foundation and its virtuous essence.

The capabilities approach has largely addressed individual capabilities via a liberal framework common in its literature. However, a growing number of scholars concerned with sustainable human development are analyzing theories and methodologies that are both suitable for human flourishing and display a respect for nature. This paper explores several forms of considering the value of non-animal and non-individual natural entities, such as ecosystems. I first expose some instrumental reasons why we may care about the flourishing of ecosystems and then other reasons based on the assumption that they have integrity and their own capabilities and, therefore, deserve moral consideration. I argue that despite the possible moral conflicts that may emerge between human and ecosystemic autonomy, they could be avoided by adopting an ecological justice virtue. I present this ecological justice characterized by some contributions of decolonial thought and environmental virtue ethics. I propose that if the capabilities approach was not anchored only in an individualistic ontology, it could better assume a multi-level axiology from which the inherent and instrumental value of ecosystems would be interconnected. And, to this end, I find the concept of synergetic flourishing helpful to accept an interdependent and non-human-centered recognition of the capabilities.

Abstract. This article aims to provide a reinterpretation of the concept of landscape and to investigate, in some respects, its possible “new” relevance. More specifically, the analysis of “new” theoretical resources of landscape – “new” as they are yet to be explored – is linked here to an alternative interpretation of some neglected pathways of its history. I argue that the possible “new” relevance of landscape also lies in some forgotten ethical narratives on mobility that it has inherited from its chorographic roots, which I outline by re-reading some ancient and 16th-century sources. In fact, I try to show that, by virtue of this chorographic legacy, landscape may represent today a critical and destabilizing perspective, able to undermine the striated and hegemonic certainties of modern thought through the lens of human mobility and its association with an ethical conception of happiness. The final section of the article is dedicated to the theoretical contributions that the chorographic side of landscape can provide to some contemporary reflections on mobility and to geographical ideas of ethics. These theoretical contributions are regarded as an integral part of the possible “new” relevance of landscape.

This article is the author's reflections on the problems of humanism, morality, and traditional culture in connection with the concept of a Moral State put forward by Professor S.N. Baburin. The role of the spirituality of the Slavic peoples and their contribution to the strengthening of European cultural identity is considered. The author argues the importance of the conclusion that the virtue of the state as its internal quality in itself turns the state into a guarantor of virtue as a universal value and the validity of the thesis that the values of both Orthodox Christianity and Slavic spirituality represent a solid foundation of a Moral State. The author sees in the Moral State a mechanism for the harmonious combination of the spirit of the revolution with the revolution of the spirit.

Abstract This paper deals with the ethical views of the 17th century Czech thinker Jan Amos Komenský, also known as Johann Amos Comenius. Comeniologic studies are focused on different aspects of his contribution to education, theology and philosophy but surprisingly there are only a few studies on his ethical standpoints. Jan Patočka classified Comenius’s work in three periods: prepansophic, pansophic and panorthotic. Here the focus is on the panorthotic works in order to trace the different conceptions of ethics, virtue and other ethical concepts specially the virtue of prudence (prudentia/phronesis). Furthermore, to have a broader perspective, a short analysis of his prepansophic period book The Labyrinth of the World and the Paradise of the Heart is also included in order to contrast the evolution of the concept of prudence and the ethical sphere in his world-view. The methodology is based on conceptual analysis, the contrast of different references to ethics in his late period books. At the same time, this work is an attempt to extract secular elements for understanding his ethics, although the organic link between philosophy, theology and politics is recognized in his thought.

This article discusses Lockwood’s concept of the work situation and its fate within class analysis. For a brief period, this concept served to make the experiences that people have by virtue of their positions in the division of labour a central concern in class analysis. Over time, however, attention to such issues has given way to an increasing interest in workers’ individual characteristics, and the measurement of social mobility according to class schemes. Over recent decades, the wider contexts of ‘class culture’ and ‘social space’ have become common frames of interpretation. While these developments have all broadened understandings of social class, their net effect has been to break up the once close relation between class analysis and the study of work. Key findings from recent labour market research suggest that, in the current context of increasing inequality and precariousness, the contribution of class analysis might be strengthened by a reincorporation of attention to work situations.

The article is based on the concepts of epistemic virtues and epistemic vices and explores A. Einstein’s contribution to the creation of fundamental physical theories, namely the special theory of relativity and general theory of relativity, as well as to the development of a unified field theory on the basis of the geometric field program, which never led to success. Among the main epistemic virtues that led Einstein to success in the construction of the special theory of relativity are the following: a unique physical intuition based on the method of thought experiment and the need for an experimental justification of space-time concepts; striving for simplicity and elegance of theory; scientific courage, rebelliousness, signifying the readiness to engage in confrontation with scientific conventional dogmas and authorities. In the creation of general theory of relativity, another intellectual virtue was added to these virtues: the belief in the heuristic power of the mathematical aspect of physics. At the same time, he had to overcome his initial underestimation of the H. Minkowski’s four-dimensional concept of space and time, which has manifested in a distinctive flexibility of thinking typical for Einstein in his early years. The creative role of Einstein’s mistakes on the way to general relativity was emphasized. These mistakes were mostly related to the difficulties of harmonizing the mathematical and physical aspects of theory, less so to epistemic vices. The ambivalence of the concept of epistemic virtues, which can be transformed into epistemic vices, is noted. This transformation happened in the second half of Einstein’s life, when he for more than thirty years unsuccessfully tried to build a unified geometric field theory and to find an alternative to quantum mechanics with their probabilistic and Copenhagen interpretation In this case, we can talk about the following epistemic vices: the revaluation of mathematical aspect and underestimation of experimentally – empirical aspect of the theory; adopting the concepts general relativity is based on (continualism, classical causality, geometric nature of fundamental interactions) as fundamental; unprecedented persistence in defending the GFP (geometrical field program), despite its failures, and a certain loss of the flexibility of thinking. A cosmological history that is associated both with the application of GTR (general theory of relativity) to the structure of the Universe, and with the missed possibility of discovering the theory of the expanding Universe is intermediate in relation to Einstein’s epistemic virtues and vices. This opportunity was realized by A.A. Friedmann, who defeated Einstein in the dispute about if the Universe was stationary or nonstationary. In this dispute some of Einstein’s vices were revealed, which Friedman did not have. The connection between epistemic virtues and the methodological principles of physics and also with the “fallibilist” concept of scientific knowledge development has been noted.

Very little research has been conducted on the contribution of political education to learning progress in Germany. Hence, there is a need for intervention studies measuring performance against the theoretical background of a political competence model. This model comprises three constructs: subject knowledge, motivation and attitudes. According to this model, politics lessons should not only convey knowledge but also arouse subject interest, promote political attitudes and develop problem-solving skills. This study investigates how knowledge acquisition is influenced by intervention using theory-oriented teaching materials on the European Union, intervention using conventional textbooks on the European Union and politics lessons without any reference to the European Union. It further asks how the performance-related self-concept and subject interest in political issues impact political knowledge and whether civic virtue and trust in the system are related to it. The sample comprises 1071 pupils. Theory-oriented politics classes lead to greater growth of pupils’ knowledge than in the control group. As anticipated, this study proves that a positive subject-specific self-concept impacts knowledge. The examination of political attitudes reveals a positive correlation between civic virtue and knowledge. There is no connection between trust in the political system and knowledge.

In order to examine the effect of changes in heart rate (HR) upon cerebral perfusion and autoregulation, we include the HR signal recorded from 18 control subjects as a third input in a two-input model of cerebral haemodynamics that has been used previously to quantify the dynamic effects of changes in arterial blood pressure and end-tidal CO 2 upon cerebral blood flow velocity (CBFV) measured at the middle cerebral arteries via transcranial Doppler ultrasound. It is shown that the inclusion of HR as a third input reduces the output prediction error in a statistically significant manner, which implies that there is a functional connection between HR changes and CBFV. The inclusion of nonlinearities in the model causes further statistically significant reduction of the output prediction error. To achieve this task, we employ the concept of principal dynamic modes (PDMs) that yields dynamic nonlinear models of multi-input systems using relatively short data records. The obtained PDMs suggest model-driven quantitative hypotheses for the role of sympathetic and parasympathetic activity (corresponding to distinct PDMs) in the underlying physiological mechanisms by virtue of their relative contributions to the model output. These relative PDM contributions are subject-specific and, therefore, may be used to assess personalized characteristics for diagnostic purposes.

Ikujiro Nonaka’s contribution to the knowledge management (KM) field over the last decades is remarkable. His research has heralded major paradigm shifts (e.g., emphasis on tacit knowledge). In this regard, we can consider his widely received article – The Wise Leader in Harvard Business Review (May 2011) – as an attempt to develop KM towards a new direction. In it, Nonaka and Takeuchi introduce phronesis, i.e., practical wisdom, as a complementary source of knowledge and emphasize its importance for responsible leadership. A decade after its presentation, we aim to understand how their work has influenced subsequent research. Using VOSviewer software, we develop a bibliometric analysis of the research that follows the paths laid out by Nonaka and Takeuchi. Therefore, we searched the studies citing The Wise Leader on the Scopus database. The outcomes comprise 119 documents. We scrutinized the metadata – papers, journals, institutions, countries, authors, and keywords – applying a comparative approach – authorship, bibliographic coupling, citation, co-citation, and co-occurrence analyses. The results reveal that the concepts of phronesis and practical wisdom link knowledge management and leadership, supporting Nonaka and Takeuchi’s stance on knowledge management as a primarily social endeavor whose success depends on personal capabilities and the enactment of (tacit) knowledge, both of which are mirrored in phronesis. We also find that the concept has hardly spread beyond the boundaries of knowledge management, leadership, and business ethics, although it has become interwoven with other concepts. Of these connections, those to non-rational forms of knowledge and values (e.g., spirituality, emotions, virtue ethics) may be of particular relevance to the further development of the knowledge management field. This is also reflected in the recently started discussion on responsible knowledge management. Moreover, we set an agenda for future research and offer contributions to theory and practice.

Wittgenstein himself did not extend his argument to the concept of art. Purpose – The purpose of this study is to examine the influence of attachment anxiety, attachment avoidance and gender on different forms of organizational citizenship behavior (OCB). Design/methodology/approach – A total of 132 employees with different occupational backgrounds were surveyed by means of the “Scales to measure two dimensions of attachment insecurity” (Grau, 1999) and a German-speaking OCB questionnaire (Staufenbiel and Hartz 2000). Findings – Results suggest that employees high in anxiety show higher ratings in OCB-conscientiousness, whereas employees high in avoidance show higher ratings in OCB-civic virtue. Moreover, we found highly avoidant individuals to be less likely to engage in OCB-altruism. Finally, besides an overall gender effect for OCB-loyalty, results reveal significant interaction effects of anxiety and gender on OCB-conscientiousness as well as of avoidance and gender on OCB-civic virtue. Practical implications – Considering the increase in flexible employment relationships and in team work, we think of attachment orientations as a concept of practical relevance because adjustment to such work environments can be assumed to be highly dependent on attachment security. Originality/value – The research at hand is the first that analyzes unique and joint contributions of attachment orientations and gender to the prediction of different OCBs. Thereby, it provides evidence for the neglected applicability of attachment theory to the understanding of workplace behaviors in general and of OCBs in particular. Furthermore, the present study expands existing knowledge on the relationship between gender and OCB and implies that the influence of attachment orientations on some OCB-dimensions is stronger in the absence of gender stereotypes.

Clinical engagement has supplemented clinical governance in healthcare to strengthen the contribution of medical professionals to the assessment of clinical outcomes for patients. Assessments of clinical engagement have, until now, been qualitative; this case study introduces the concept of quantitative assessment of clinical engagement by measuring the number of patients managed according to specialist society guidelines. Such an assessment engages all staff (medical, nursing, allied health and pharmacy) involved in patients receiving treatment according to such guidelines and provides an assessment of individual and organisational compliance with those guidelines. Clinical engagement is then quantified as the percentage of patients that have been documented to receive specialist society- or college-approved guideline-compliant treatment, relative to the total number who could receive such treatment, in any healthcare organisation. What is known about the topic? Clinical engagement has emerged in recent years as a virtue to be encouraged in healthcare organisations because of its association with improved patient outcomes and employee satisfaction. Assessments have relied on repeated staff surveys in order to gauge engagement. What does this paper add? This paper proposes a novel means of measuring clinical engagement in an organisational setting. The vision put forward is that adherence to clinical guidelines in an organisation measures clinician engagement across professional disciplines. What are the implications for practitioners? The implications are that organisations will contribute to measuring the adherence of specialty groups of clinicians to guidelines that the clinicians select and use the data for individual and organisational accreditation.

The Indonesian Ministry of Education and Culture has applied the ‘Merdeka Belajar’ (Freedom to Learn) and ‘Kampus Merdeka' (The Freedom Campus) (abbreviated MBKM) learning concepts. In legal education, these concepts aim to form legal students who master the knowledge, skills, and competence demanded by the job market. Unfortunately, these programs lack the fundamental vision to create honest individuals of law that have integrity. This paper analyzed the MBKM program that only envisions catering students to the needs of the job market and how that policy neglects the essence of legal education, namely morals and justice. This research employs the philosophical approach. Without morality, the legal sector will become a facility for destruction through moral hazards such as corruption, collusion, and manipulation. A legal expert should ideally strive to demand and uphold justice, truth, goodness, and virtue, as well as the integrated and personal moral ideals that are non-existent in the MBKM concept. The MBKM policy in legal education needs to be revised as legal education should emphasize its philosophical essence; namely the perspective of justice can only be achieved through moral integrity. Contribution of completed study to modern education to remind, the philosophical essence is still needed.

Data analysis in the form of non-statistical analysis is suitable for descriptive data or textual data. Main Findings: The findings in this research provide a little more knowledge about: The important education of patience which has been explained in Q.S surah al-Baqarah verses 45, 153, 294 and Ali Imran verses 125, 186, 200, apart from providing calm for life. Patience also has the function of solving problems well and not being hasty in carrying them out, so that people who implement this trait will find it easy to obey Allah and His Messenger. Novelty/Originality of this study: This research carries originality in exploring the dimensions of patience education contained in the verses of the Qur'an, especially Surah Al-Baqarah verses 45, 153, and 249, as well as Ali Imran verses 125, 186, and 200. The focus of the research is on analysis in-depth understanding of the historical, linguistic context and interpretation of these verses, in order to reveal the nuances and wisdom contained in patience education. Thus, this research makes an important contribution in enriching the experience of Islamic religious education in madrasah and increasing its relevance to the demands of the times.

Abstract:This paper investigates whether, in theoretical terms, corporations can be citizens. The argument is based on the observation that the debate on “corporate citizenship” (CC) has only paid limited attention to the actual notion of citizenship. Where it has been discussed, authors have either largely left the concept of CC unquestioned, or applied rather unidimensional and decontextualized notions of citizenship to the corporate sphere. The paper opens with a critical discussion of a major contribution to the CC literature, the work of Logsdon and Wood (Wood and Logsdon 2001; Logsdon and Wood 2002). It continues with a consideration of the nature and role of metaphors for business and of the contestable nature of the political concept of citizenship. It evaluates corporations as citizens through a four-dimensional framework of democratic citizenship offered by Stokes (2002). The analysis suggests that corporations do not easily fit the “liberal minimalist” model of citizenship. It finds, however some possibilities for fit with the three more participatory models. The paper concludes by cautioning against basing corporate citizenship on legal and administrative status or identity, and mapping out specific criteria by which we might determine whether corporations could be considered as citizens by virtue of their participation in processes of governance.

Ethics of leadership has been dominated by western views about ruling a country; hence marginalizing local cultural ethics of leadership in practice. This paper explores the ethics of leadership as contained in the Balinese text ?iv?gama composed by Ida Pedanda Madé Sidêmên (1858–1984) and its relevance for the modern era. Data was taken from lontar palm-leaf manuscripts and analyzed in a qualitative way focusing on the conception of nava natya (nine ethical principles) of leadership. Also included was the pañca visaya, five external objects and the corresponding senses, which can cause harm when facing enemies. In the past, these ethical principles were used as the basis upon which the royal system of governance was practiced for the welfare of all. This concept is still relevant nowadays as long as service is considered to be a human virtue. The research results thus offer a contribution to the study of leadership ethics in the Old Javanese tradition.

AbstractWhile Epictetus’ Diatribai are not an ethical treatise, but aim chiefly at urging and training pupils to practice philosophy, they can also be used to reconstruct Epictetus’ positions about some of the questions raised within the Stoa after Zeno. This paper focuses on the problem of the contribution of indifferent (external or bodily) things to happiness and of the relationship between virtue and these indifferents. Against scholars claiming that Epictetus shared Aristo of Chios’ heterodox indifferentism, it is shown that Epictetus upholds Chrysippus’ ethical doctrine of the telos and acknowledges that some indifferents are natural or have ‘value’ (axia) and should not be despised or ignored. In making this point, Epictetus uses the concept of ‘good reasonning’ about value which can be traced back to Diogenes of Seleucia (and Antipater of Tarsus). Moreover, when he describes how we can reach the goal of life through our natural faculties, Epictetus might also borrow Panetius’ explanation of the telos.

Vilnius UniversityThis article deals with the treatment of human talent (cai 才) in pre-imperial and early imperial China and concentrates on its relationship with other Chinese philosophical and anthropological concepts and the general cultural context. On the one hand, it analyses the moral meaning of talent, discussing its relationship with the concept of xian 贤 ( the worthy) in Classical Confucianism, and on the other hand it analyses its relationship with the concept of de 德 (virtue) as it was treated from Classical Confucianism and Legalism to the Six Dynasties. The latter analysis is based mainly on books by Xu Gan Zhong lun 中论 (Balanced Discources) and Liu Shao Renwuzhi 人物志 (The Study of Human Abilities), paying special attention to the infiltration of the Legalist understanding of cai into those books. The second problem discussed here is the relationship of cai and human nature (xing). The author argues that the discussions concerning human resources or talent in pre-imperial and early imperial China were inseparable from the anthropological and philosophical thinking on human nature and from the resolution of political problems. The understanding of human resources in China had from the very beginning a strong motivation for applicability in the political sphere, and this was a contribution not only of Confucian thinkers, but also by the schools of Legalists, Logicians (or School of Names), and Dialecticians (or School of Yin-yang). This could be the reason why the Chinese avoided the mystification, essentialisation and romanticisation of human talent, as happened in Western culture (especially with the titanism of the Renaissance and beyond).

This contribution examines the provisions of the constitutive documents of companies under two specific provisions, namely s 65(2) of the Companies Act 61 of 1973 and s 15(6) of the Companies Act 71 of 2008. The aim is to determine who is bound by these provisions, the circumstances which give rise to being bound by them, and the possible effect thereof on various parties. The provisions of the constitutive documents under section 65(2) of the 1973 Companies Act are interpreted by courts and academic writers to amount to a statutory contract between a company and its members and between members inter se. The members are said to be bound by the provisions of these documents only in their capacity as members. It is submitted, however, that the rights and obligations are granted to members in their capacity as such if they are membership rights which are granted by virtue on one’s membership. So far the courts have failed to provide a logical explanation of the concept “capacity of a member as such”. This failure and the “qua membership test” resulted in limitations in the interpretation of section 65(2): for example, the exclusion of persons who are regarded as outsiders. The directors, despite the fact that numerous provisions of the applicable article provides for their rights, have rights that are unenforceable via the articles, for being regarded as outsiders. The company on the other hand can enforce the obligations against the directors on the basis of breach of their fiduciary duties. These limitations called for a redraft of section 65(2). This contribution raises the legal challenges raised by the above. It arrives inter alia at the conclusion that the “qua membership test” may find application under the 2008 Companies Act, since members/shareholders may be allowed to exercise rights that are membership rights granted to them by virtue of their membership, and directors may be allowed to exercise rights that are granted to them in their official capacities as such.

AbstractThe structure as well as the themes of the Symposium suggest that Eryximachus’ speech plays a fundamental role in the dialogue. The problem is that what he says in praise of love is far from clear and continues to be a subject of debate. The aim of our article is to re-examine this speech to clarify its meaning and determine its contribution to Plato’s theory of love. First, we will analyse the text of the Symposium, then we will investigate its medical back-ground, and finally we will evaluate its philosophical impact. We will argue that Eryximachus’ speech, which draws inspiration from the Hippocratic Collection and the Pre-Socratic thought, is based on the concept of ‘harmony’: a balanced and organised unity of opposites. According to Eryximachus, love – conceived of as harmony – is the key to the health and the virtue of human beings, as well as to the cosmic order and justice. Thereby the specificity of Eryximachus’ speech will become clear: Plato tries to combine science and morality by proposing, among other things, some considerations on bioethics.

In a contribution to this journal Amos Witzum has challenged a common interpretation of Adam Smith's theory of justice, according to which Smith ‘employed a concept of justice – in the tradition of natural laws theories – whereby rights are related to guarding what is one's own rather than to what is one's due’ (Witzum, 1997, p. 242). Witzum claims that not only does Smith's conception of justice include one's due, and hence, distributional considerations, but the right to one's own ‘stems from the right to what is one's due’ (p. 244). Furthermore, he asserts that ‘as all members of society own their natural faculties, which presumably were given to them to enable them to survive, the fruits of their labour up to subsistence level belong to them by virtue of their ownership of their own faculties’ (p. 259). This leads him to the conclusion that property acquisition gives rise to a duty, on the part of property holders, to ‘distribute subsistence’ and that when wages fall below the subsistence level, the rights of workers have been violated ‘in exactly the same sense that taking an acquired asset away from its owner constitutes a violation of justice’ (p. 244).

Bringing sinful people onto the path of virtue is a basic pastoral concern of Christianity. With the begin of the Catholic renewal this path of virtue was a crucial element of Pastoral care with the Virgin Mary was stylised as a role model for women of all classes, both in humility (humilitas) and strength (fortitudo). The focus of this contribution is on German-language oratorios in Vienna and their threefold "translation problem": on the one hand, in the realisation of theological content, on the other hand, in the confrontation with Italian (court) librettistics, which are indispensable as a model, and thirdly (as far as they have survived at all) in the musical realisation of the texts. Whether, in addition, changed theological-pastoral concepts, as they increasingly took hold in Vienna around the middle of the century (turning away from the Baroque "heaven of saints", strengthening Eucharist and Christology, discourse on indulgences), were able to find their way into the depiction of virtue, finding the right way in the area of tension between cardinal virtues and mortal sins.

Purpose: Artificial intelligence as a subfield of the Fourth Industrial Revolution has been a controversial concept since its inception. The reason for its controversy is that through it, incredible inventions and also inventions detrimental to the society have surfaced. A deep fake is an Artificial Intelligence technology that creates videos and images of persons and events that in fact did not happen. The aim of this paper is to evaluate the concept of deepfake, its positive impacts and threats posed to individuals, corporate institutions and nations. It further assesses the legal implications of and provisions against deep fakes. Methodology: The research methodology adopted in this study is doctrinal. Just like every Artificial Intelligence technology, it has benefits that cut across the marketing, fashion, and art industry among others. However, the issue for determination remains whether the positive impact of this AI technology supersedes the negative impacts. Findings: Findings revealed that it has a high tendency to deceive an average person and also create uncertainty about the authenticity of a piece of information. This can lead to the spread of fake news, fraud, blackmail, fabrication of evidence, and even national and global insecurity. Trust in the social media and the internet generally will face a great decline at the spread of deepfakes, this will then be a medium for denial of videos that are in fact true. Unique Contribution to Theory, Practice and Policy: The world is set to face a new and modified aspect of social engineering that will require an upgrade in cybersecurity techniques and strategies. By virtue of the sensitivity of the negative impacts of deepfake, this study concludes that it is necessary to promulgate legislations both at national and international levels to curb or regulate deepfakes.

The aim of this research is to explore what relations self-affection bears to the intuitions of inner sense. I propose that self-affection makes some contribution to formal intuitions and empirical consciousness by arguing that the functions of self-affection consist respectively in conceptualising and conscious-making. I begin by examining Kant’s concept of inner sense and point out that inner sense as a receptive faculty depends on self-affection. In so doing, I emphasise that self-affection includes both a pure and an empirical aspect which corresponds to Kant’s distinction between the transcendental synthesis of imagination and the empirical synthesis of apprehension. Then, I focus on the pure aspect and argue that the conceptualising function involved in the pure self-affection is decisive for the generation of formal intuition. In particular, I explain why the formal intuition of time depends on the intuition of space and how it is constituted by drawing a line. After that, I turn to analysing the empirical aspect of self-affection and show that by virtue of the empirical synthesis of apprehension one is aware of both the empirical contents of representations and the mental actions performed on them, whereby I suggest that this empirical conscious-making function can be understood as an act of distinguishing from a mereological point of view.

The various scandals that have shaken the corporate world have shown the need to analyze once again the ethic foundations of the corporation. It is not enough to issue a simple negative judgment; we must learn from failure and reflect on its causes. Why didn’t these companies fulfill their missions? What happened to their fundamental values? What happened to the personal convictions of their general managers, with their vision of the future, with their contributions for the country and the community? Experience shows that it is not enough to merely propose worthy goals, guiding values or policies in favor of the environment and the community. It is necessary that all these propositions originate in the personal convictions of each individual, so that each action will have a distinctive, personal mark. Integrity must be found in the center of each individual and corporation. This paper presents integrity as a superior concept amongst the values and virtues which are normally mentioned; it implies that management must adopt the enabling attitudes and abilities they need to carry out their work properly.

Purpose: The main objective of this study was to establish whether psychological contract can be applied by the courts in case of unfair termination of employment. Methodology: The study used exploratory research design to establish whether psychological contract can be applied by the courts in case of unfair termination of employment. The study analyzed psychological contract theory from a legal perspective and how human resource practitioners, advocates and judges can incorporate it in court cases. The study used exploratory research since it intends merely to explore the research questions and does not intend to offer final and conclusive solutions to existing problems. This is because the concept has not been clearly defined yet. However, the study helps us to have a better understanding of the problem. The study relied on decided court cases, journal articles and publications and books. Results: The study found that psychological contract breaches occur when an employee perceives that an organization has failed to meet its obligation to the employee. When the breach occurs it affects the employee contribution in three forms; performance, civic virtue and intention to remain in the organization. The legal employment contract does not embrace the principles of contract law such as consideration. Unique contribution to theory, practice and policy: The legal employment contract does not embrace the principles of contract law such as consideration. The employee does not dictate the terms of the contract. Therefore, there is need to consider psychological contract theory as an input to understanding contemporary labour practices. This is because psychological contract brings in a unique way of interpreting an employment contract, understanding employment relationship and the need for policy reforms.

If there were a list of subjects about which it seems that there is definitely no more to be said—or that even if there were, nobody would want to hear it anyway—then surely the topics of ideology, in general, and ideology in Marxist theory, in particular, would have to rank very near the top. Diffusing outwards from Western Marxism's postwar preoccupation with the mechanisms of capitalist hegemony, the concept has now become virtually ubiquitous in the humanities and social sciences. Yet we feel reluctantly impelled to add one more paper to this already overflowing pile, hoping to catch readers' attention even as reflexive ennui glazes over their eyes. For a (though not, we trust, the only) virtue of the thesis we are going to propose is its originality in relation to the contemporary spectrum of opinion. If we are right, then, in one of Marx and Engels' main uses of the expression “ideology” they were not referring to ideas at all, but to the social superstructure itself. Even on purely scholarly grounds, it would be of some interest that so many commentators could have missed this meaning of “ideology” in texts as thoroughly scrutinized as these have been. But more importantly, if our analysis is correct, then certain very famous passages in the Marxist corpus (such as the 1859 “Preface” to A Contribution to the Critique of Political Economy and parts of the Critique of the Gotha Programme) have been misinterpreted for decades.

With the recent wave of corporate scandals, organizational culture has regained relevance in politics and the media. However, to acquire enduring utility, the concept needs an overhaul to overcome the weaknesses of earlier approaches. As such, this paper reconceptualizes organizational culture as a negotiated order (Strauss 1978) that emerges through interactions between participants, an order influenced by those with the symbolic power to define the situation. I stress the complementary contributions of theorists of practice (Bourdieu and Swidler) and theorists of interaction (Goffman and Strauss), building upward from practice into interaction, symbolic power, and the negotiated order. Using data from initial reports on the fall of Arthur Andersen and Co., I compare this symbolic power approach to other approaches (culture as subjective beliefs and values or as context/public meaning). The symbolic power model has five virtues: an empirically observable object of study; the capacity to explain conflict and integration; the ability to explain stability and change; causal efficacy; and links between the micro-, meso-, and macrolevels of analysis. Though this paper focuses on organizational culture, the symbolic power model provides theoretical leverage for understanding many situated contexts.
